2. Kosovo and Serbia: A Little Goodwill Could Go a Long Way

- A violent standoff in northern Kosovo risks halting Kosovo's and Serbia's fragile dialogue and threatens Kosovo's internal stability and Serbia's EU candidacy process. Pristina's push to control the whole territory of the young state, especially its borders with Serbia, and northern Kosovo Serbs' determination to resist could produce more casualties. Belgrade has lost control and trust of the northern Kosovo Serb community, which now looks to homegrown leaders. The international community, especially the EU and U.S., should encourage Belgrade to accept the government in Pristina as an equal, even if without formal recognition, but not expect it can force local compliance in northern Kosovo. All sides should seek ways to minimise the risk of further conflict, while focusing on implementing what has been agreed in the bilateral technical dialogue. They should build confidence and lay the groundwork for the political talks needed to guide a gradual transformation in northern Kosovo and eventually lead to normal relations between Kosovo and Serbia.

3. Setting Kosovo Free: Remaining Challenges

- Kosovo has implemented much of the Ahtisaari plan – the blueprint for its democracy, providing substantial rights for Serbs and other minorities – and deserves to be fully independent, but there should be no slippage, and remaining parts of the plan should be honoured. The Pristina government mostly abides by it, and many Serbs south of the Ibar River now accept its authority, obey its laws and take part in political life in a way unimaginable four years ago. These achievements are threatened, however, by the tense Kosovo-Serbia relationship, declining Serb numbers and Pristina's frustration at its inability to extend its sovereignty to the Serb-majority northern areas and to achieve full international recognition. A surge in ethnically-motivated attacks shows peace is fragile. The government should remain committed to the Ahtisaari requirement for minorities. But the plan was not meant to work in isolation and cannot be separated from the overall Kosovo-Serbia relationship. Belgrade needs to earn Pristina's trust and acquiescence for its continued involvement on Kosovo territory, especially the south.

4. Bosnia: Europe's Time to Act

- After years of hesitancy, European Union (EU) member states should make 2011 the year when the lead international role in Bosnia and Herzegovina shifts from the Office of the High Representative (OHR) to a reinforced EU delegation. Bosnia has outgrown the OHR established in 1995 after the Dayton Peace Agreement and the creation of the Peace Implementation Council (PIC). Today the country needs EU technical assistance and political guidance to become a credible candidate for EU membership, not an international overseer to legislate for it or maintain security. Member states should rapidly install a comprehensive plan to reinforce the EU presence, including an embassy led by a strong ambassador, strengthen the membership perspective and build local credibility. OHR should withdraw from domestic politics and, unless a threat to peace emerges, focus on reviewing past decisions.

5. Macedonia: Ten Years after the Conflict

- Ten years after signature of the Ohrid Framework Agreement (OFA) that ended fighting between the country's ethnic Albanians and Macedonians, much of the agreement has been implemented, and a resumption of armed conflict is unlikely. Macedonia is justified in celebrating its success in integrating minorities into political life, but inter-party and inter-ethnic tensions have been growing for five years. While this part of the Balkans looks to eventual EU membership to secure stability, it remains fragile, and worrying trends – rising ethnic Macedonian nationalism, state capture by the prime minister and his party, decline in media and judicial independence, increased segregation in schools and slow decentralisation – risk undermining the multi-ethnic civil state Macedonia can become. Prime Minister Nikola Gruevski, who has just formed a new government, should work closely with his Albanian coalition partners and opposition parties to pass and implement the measures needed for more democratisation, inter-ethnic reconciliation and a solution to the name dispute with Greece.

6. Bosnia: What Does Republika Srpska Want?

- Republika Srpska's flirtation in June 2011 with a referendum is a reminder that Bosnia's smaller entity still threatens the stability of the country and the Western Balkans. It is highly unlikely that the RS will secede or that the Bosniaks will attempt to eliminate it, but if its Serb leaders continue driving every conflict with Sarajevo to the brink, as they have done repeatedly to date, they risk disaster. The agility of leaders and the population's patience need only fail once to ignite serious violence. Over the longer term, RS's determination to limit Bosnia and Herzegovina (BiH) to little more than a coordinator between powerful entities may so shrivel the state that it sinks, taking RS with it. RS also suffers from its own internal problems, notably a culture of impunity for political and economic elites and a lingering odour of wartime atrocities. Its leadership, especially its president, Milorad Dodik, needs to compromise with Sarajevo on state building and implement urgent entity-level reforms.

7. Brčko Unsupervised

- It is time to close international supervision of Bosnia's Brčko District. Once seen as a model of post-war reconciliation and good government, it is drowning in corruption and mismanagement that flourished despite its supervisors' best efforts. The territory is vital to Bosnia and Herzegovina (BiH)'s stability: it links the two halves of both Republika Srpska (RS) and the BiH Federation (FBiH), and belongs technically to both entities but is independently governed and multi-ethnic. Many of its former leaders are under suspicion in a corruption probe that may have only scratched the surface; several high profile development projects are collapsing in bankruptcy and litigation. RS has a strong influence on the district but is not threatening to undermine its status. Nevertheless, the international community should ensure that Serb leaders of that entity are left in no doubt that any move to take Brčko over would meet a strong reaction. Stability is now dependent on whether local politicians, law enforcement and the judiciary can take responsibility. International supervision is no longer helping, and a new strategy is needed.

8. Kosovo and Serbia after the ICJ Opinion

- In the wake of the July 2010 International Court of Justice (ICJ) advisory opinion on the legality of Kosovo's declaration of independence, Kosovo and Serbia have an opportunity to resolve differences, establish bilateral relations and unblock their paths to greater European Union (EU) integration. The obstacles are formidable, including mutual suspicion, incompatible agendas and uncertainties about the true goals of each. Failure to negotiate in the next months would probably freeze the conflict for several years, as the parties entered electoral cycles, during which the dispute would likely be used to mobilise nationalist opinion and deflect criticism of domestic corruption and government failures. Enough has changed recently, especially the development of more realistic if not yet fully public attitudes in Belgrade and Pristina, to suggest a win-win solution is possible. Without preconditions and facilitated in particular by the EU, Kosovo and Serbia should promptly open talks with the aim of reaching as comprehensive a compromise settlement as possible.

9. Federation of Bosnia And Herzegovina – A Parallel Crisis

- The Federation of Bosnia and Herzegovina (FBiH), the larger of Bosnia and Herzegovina's two entities, is in crisis. Disputes among and between Bosniak and Croat leaders and a dysfunctional administrative system have paralysed decision-making, put the entity on the verge of bankruptcy and triggered social unrest. Much focus has been on the conflict that pits the Serb-dominated Republika Srpska (RS) against the Federation, but the parallel crisis within the Federation also deserves attention. The need for overhaul of the FBiH has been ignored because of belief that state-wide constitutional reform would solve most of its problems, but any state-level reform seems far off. Bosnia's challenges all have echoes at Federation level, though in simpler form. Reform in the Federation, starting with establishment of a parliamentary commission, is achievable and could give impetus to state-level reform, while improving the livelihoods of the people in Bosnia's larger entity. If it does not happen, Bosnia, which was wracked by three and a half years of war in the 1990s, may well slide toward new political and economic ungovernability.

10. The Rule of Law in Independent Kosovo

- More than two years after declaring independence, Kosovo struggles with uneven rule of law and a weak justice system that is failing its citizens. The police, public prosecutors and courts are erratic performers, prone to political interference and abuse of office. Organised crime and corruption are widespread and growing. Realising that prosperity, relations with the European Union (EU) and affirmation as an independent state depend on the rule of law, the government has taken important steps, replacing key officials and passing long-delayed reforms. But critical weaknesses remain, notably in the courts, and the government, supported by the international community, must act swiftly to curtail them.
