Abstract:
The Democratic Republic of the Congo (DRC) is one of the world’s most resource-rich countries, and in 2024, it attracted the largest volume of mineral exploration investment in Africa. Enhancing U.S.-DRC cooperation is critical to counterbalance China’s dominance. The United States has historically underinvested in commercial diplomacy in the DRC, while China has established control over key mines through state-backed financing and infrastructure-for-resources deals. This brief answers two questions: First, how can the U.S. government utilize its resources to maximize impact in this sector? And second, what reforms can the DRC government implement to attract investment? Building the bilateral minerals partnership will require a suite of bilateral diplomatic, financial, and legislative reforms.

Abstract:
Given the country's increasing stability, transitional justice has become an option for addressing the violence and gross human rights violations that have marked Somalia's history from the colonial period to the present. Experiences in other African countries over the past three decades show that transitional justice processes are more likely to be effective if they are rooted in popular participation, particularly of victims/survivors and communities affected by violence. This study explores emerging measures linked to transitional justice in Somalia, which are rooted in local practices and build on local resources, to provide recommendations to state authorities, civil society, and multilateral actors, including the African Union, for enabling popular participation and thereby a more contextual, inclusive, and effective transitional justice process in Somalia. Based on extensive fieldwork with 114 participants in Mogadishu, Dhuusamreeb, and Gaalkacyo, the study examines formal and non-formal measures already occurring in Somalia to identify ways in which future transitional justice processes could enable people's agency over the goals, forms, and outcomes of measures dealing with the past.

Abstract:
Maintaining international peace and promoting the development and protection of human rights are three pillars upon which the United Nations (UN) is founded. This innate relationship between peacebuilding and human rights has been underscored several times by the UN. For instance, addressing the UN Security Council on 18 April 2017, UN Secretary-General António Guterres said, ‘upholding human rights is a crucial element of [conflict] prevention’ and ‘human rights are intrinsically linked to sustaining peace.’1 For the African Union (AU), the promotion of peace, security, and stability, on the one hand, and the promotion and protection of human and peoples’ rights, on the other hand, are among its key objectives.2 Despite this intrinsic relationship between peacebuilding and human rights, less attention has been given to mainstreaming this relationship into the decisions, interventions, and institutions of the AU. This article aims to shed light on the nexus between peace and human rights and why it is important for sustainable peace on the continent. In the first section, the article will analyse the peacebuilding and human rights nexus, and then the second section will zoom in on key peacebuilding and human rights frameworks under the AU. Finally, the article will highlight how peacebuilding and human rights could be better integrated under the AU frameworks and operations.

6. Nigerien Law 2015-36: How a New Narrative in the Fight Against Smugglers Affects the Right to Leave a Country

Abstract:
In 2015, the Republic of the Niger adopted an anti-migrant smuggling law (Law 2015-36) with direct involvement of the European Union (EU). Since then, concerns have been raised that this law constitutes a de facto travel ban for anyone moving northwards from Niger. Rather than addressing the involvement of the EU, this article will focus on the direct obligations of Niger, including those set by regional human rights agreements, as the country where the so-called cooperative migration control takes place. People on the move towards Libya will be a special focus as the most affected by the Nigerien law. First, the Nigerien law and its provisions will be described, in order to then assess whether the law and its application infringe the human right to leave any country including one’s own. Drawing from the findings of non-governmental organizations and the United Nations Special Rapporteur on the Human Rights of Migrants, this article argues that Law 2015- 36 renders it impossible for non-Nigerien nationals to leave the country without risking their life and safety. Thus, Law 2015-36 infringes the right to leave. The third part explores possible justifications for the law with a focus on the interests of people on the move, the interests of bordering States, and national interests. It finds that Law 2015-36 is disproportionate and, in fact, impairs the essence of the right to leave, resulting in an unjustified interference. The concluding fourth part contains recommendations for possible amendments to the law.

7. Transforming Social Relations: Restorative Responses to Massive Human Rights Violations

Abstract:
Restorative justice and transitional justice are closely and fundamentally related responses to crime. They emphasize shared values and promote similar frameworks that seek to clarify responsibilities, and they both address the inherent limitations of existing institutions: for restorative justice, the limitations of retributive systems in dealing with domestic crimes; for transitional justice, the additional limitations of conventional or compromised rule of law institutions in dealing with serious and massive international crimes. In many ways, restorative justice is at the center of transitional justice. While scholars and practitioners of transitional justice have consistently applied the concepts of restorative justice, in practical terms, there are few examples of restorative justice practices being explicitly integrated into transitional justice processes, specifically those aimed at criminal accountability. There is also a general lack of understanding within both fields about what such integration means or requires. This report offers reflection, clarity, and guidance on the application of a restorative justice framework in contexts of massive human rights violations, including the advantages, risks, opportunities, and challenges of such an approach. The analysis is based on the experiences of Colombia, Sierra Leone, Tunisia, and the Bangsamoro region of the Philippines, which represent a range of different processes that all either integrated or reflected the practices or principles of restorative justice. These principles include stakeholder participation and repair of harm, and the practices include the use of direct or indirect dialogue or engagement between victims and perpetrators to resolve crimes. The study's findings address the role of dialogue between victims and perpetrators; the importance of engagement with communities and society in establishing a link between the micro and macro levels; the contribution of alternative or restorative sanctions in facilitating participation and repair; the need for integrity, legitimacy, and efficacy of process; and the coherence of restorative justice with other justice, peacebuilding, and transitional processes.

Abstract:
How does the 2020–2022 civil war in Ethiopia contribute to our understanding of the Responsibility to Protect (R2P) doctrine? This study seeks to revisit the debate over the effectiveness of the R2P doctrine in the wake of increased intrastate conflicts. The objective is to assess the dilemma that arises with the implementation of R2P when governments are involved in the conflict and the international community is reluctant or unable to intervene. The study adopts the systematic review approach (PRISMA) to identify the shortcomings, trends, and debates around R2P. It uses the Ethiopian civil war to contribute further to the existing body of literature. The paper finds that, indeed, the R2P doctrine is facing serious challenges with its implementation. It shows that when governments fail to acknowledge the other actors as legitimate combatants and instead describe them as terrorist groups, it becomes difficult to uphold the R2P doctrine. The paper also identifies a lack of leadership and coordinated efforts at regional and international levels as contributing factors, which further undermine the effectiveness of R2P. The paper concludes that the Ethiopian civil war exposes serious shortcomings in the R2P doctrine that need to be reviewed and reformed urgently. It proposes the adoption of a systems-thinking approach that can streamline the actors and processes of response during civil wars.

Abstract:
Armed conflict is a perennial problem that has plagued Africa for decades, resulting in flagrant human rights abuse. The central problem this paper seeks to address is identifying the laws establishing institutions and agencies for protecting human rights in Africa and examining how well-adapted these institutions are to protect human rights in times of armed conflict in Africa. This research employs the doctrinal research method, which entails an examination of the relevant primary sources of the law as laid down in the statutes and treaties and interpreted by the courts as well as secondary source materials, including journal articles, reports, and other relevant sources materials. It is contended that though human rights institutions were not established with the goal of interventions in times of armed conflict to protect human rights, they can be adapted to meet this challenge to stem the tide of gross human rights violations during armed conflicts. The paper concludes by recommending the expansion in the practice of the mandate of these human rights institutions to accommodate mechanisms for the protection of human rights in times of armed conflicts.

10. Advancing Victims’ Rights and Rebuilding Just Communities: Local Strategies for Achieving Reparation as a Part of Sustainable Development

Abstract:
This comparative study examines strategies used by local actors to facilitate the operationalization of reparations for victims of widespread human rights violations, while highlighting the synergies between these efforts and sustainable development. The study is based on the fieldwork of ICTJ and its partners in four contexts—Colombia, The Gambia, Tunisia, and Uganda. These countries represent a range of different situations, where the progress made, challenges faced, and overall political and institutional contexts vary significantly. Nonetheless, comparison of the approaches used across the cases offers valuable insights for those working in these and other contexts. In The Gambia, the truth commission and legislation for reparations have created expectations among victims, but a program has yet to be implemented. In Uganda, the legal and policy framework for reparations exists, but there is no enabling legislation or mechanism to provide them as a result of stalled political will. In Tunisia, the truth commission recommended reparations, but the political and economic situation make operationalization unlikely. In Colombia, challenges faced by reparations have informed the design of restorative sanctions that include reparative projects but are yet to be implemented. The major insights gained from this comparative study relate to the specific ways in which reparations can contribute to individual and community well-being and development; innovative and effective approaches to ensuring victims and communities receive reparations and support, including through collective action, engagement with government, and grassroots initiatives; the integration of victims’ needs and priorities into development policies and models; and the reparative elements of complementary accountability and reform measures that are participatory, address corruption and marginalization, and contribute to gender justice and equality. The report offers practical guidance and policy recommendations for advancing reparations as an integral element of broader societal efforts to facilitate inclusion, justice, peace, and development.
