41. History and identity should not blight the EU’s enlargement policy towards the Western Balkans

Abstract:
The EU must reject any attempt to introduce notions of history and identity into its enlargement policy. Otherwise it risks trampling on its 70 years of experience in overcoming the legacy of the past and promoting a peace project based on reconciliation and the rule of law. Yet this is precisely what is happening with Bulgaria’s veto against the opening of EU accession negotiations with North Macedonia. In March of last year the European Council gave the green light for the opening of accession negotiations with Albania and North Macedonia. A date for the first intergovernmental conference to formally launch the negotiations with both countries remains – unfortunately, out of sight.

42. Balkan and Eastern European Comparisons: Building a New Momentum for the European integration of the Balkan and Eastern European associated states

Abstract:
CEPS first published in 2018 a comparison of how the Balkan and Eastern European associated states fared in their progressive alignment on EU laws and norms. This attracted considerable attention, notably because the detailed research showed that the two groups of states were becoming increasingly comparable in their alignment on the EU acquis. A more recent suggestion that this work should be updated and deepened for its policy implications has led to this study. Andrius Kubilius MEP, former Prime Minister of Lithuania, in particular encouraged CEPS to do this, and the authors thank him for his stimulus and support. Considerable interest is now being expressed in this study advocating a new momentum for the European integration of both Balkan and East European associated states. Both the enlargement and neighbourhood policies are at best stagnating. The perceived incentives for reforms in line with European norms and values are too weak or uncertain. The study proposes enhancing the ‘more for more’ principle with quantification and benchmarking of ratings for all chapters of the relationships with the EU. A major proposed innovation is that in addition to ongoing sectoral and functional integration, the EU should officer partial and progressive institutional integration, conditional on performance in relation to the ratings, as a more constructive approach than the present ‘all or nothing’ method of accession.

Abstract:
This CEPS Policy Insight takes a lively rhetorical approach to showing how state capture in the Western Balkans has been ignored since the launch of the region’s EU accession process, despite the many examples highlighted by civil society and independent media. It argues that while the EU first acknowledged the clear signs of state capture in an official document in 2016, Western Balkan political elites had already built powerful networks of corrupt interests around them. Not only that, they had already reached the highest point of state capture – tailor-made laws.

Abstract:
With the bold title EasternPartnership policy beyond 2020: Reinforcing Resilience – an Eastern Partnershipthat delivers for all, the recent EU Joint Communication offers a broad array of policy orientations but little operational specificity, find the authors of this commentary. Georgia, Moldova and Ukraine – each with EU Association Agreements, requested a ‘quadrilogue’ with the EU to deal with matters of common concern to them but not the other EaP states. The fact that this request was not granted is a glaring omission from the Communication, but one that could still be corrected at the EaP summit on June 18th. The summit should also agree the policy direction of the EU and the Eastern partner states beyond 2020, and include the many transnational issues worthy of quadrilateral consultations. Among these issues is how the revision of major EU policies, such as those on energy, climate and competition, may affect the associated states.

There are now many ideas in circulation to enhance the Association Agreements (AA), which include the Deep and Comprehensive Free Trade Areas (DCFTA), stimulated in part by the ‘Structured Consultation’ on the future of the Eastern Partnership (EaP) initiated by the Commission in 2019. All three AA states made detailed submissions; the present note seeks to incorporate these and other ideas into the makings of a possible initiative to upgrade the agreements and give them renewed and politically significant momentum.

46. Ten years after EULEX: Key principles for future EU flagship initiatives on the rule of law

Abstract:
With its “credible enlargement perspective for and enhanced EU enlargement with the Western Balkans”, the EU plans to launch several new flagship initiatives for the six aspiring countries. The key initiative envisaged is “to strengthen rule of law” through more detailed assessment of the rule of law and reform implementation by including case-based peer reviews, trial monitoring of serious corruption cases and organised crime, developing indicators for reform implementation and deploying advisory missions. The EU has begun some planning but detailed action plans are yet to come. New programmes and initiatives should be new in content and form. In the case of Kosovo, things are more complex; the clarity of the new plan and drawing the line between the past and future is key for any success of the upcoming initiatives. With EULEX still on the ground, after 10 years of deployment, plagued by low trust and an image of failure, the rule of law has little improved in Kosovo. The EU should carefully consider the conditions upon which new initiatives are established. Equally, local authorities need to be fully in the driving seat. Reluctant to do so until now, the government has recently initiated a Functional Review of the Rule of Law Sector and Justice 2020. Their agendas have not progressed much in the absence of political will, and undefined roles and agendas remain between the local authorities and EU. Any new initiatives should be launched based on certain principles that ensure they have full local ownership, are driven by local demand, are based on in-depth evaluation and verification, build upon broad consultations and inclusion, have a clearly defined role and scope, have realistic expectations and contribute to streamlining the reform agendas.

Abstract:
2018 was dominated by deep divisions among the EU member states despite the great expectations set by the European Commission’s February 2018 strategy paper. A major effort will now be required to restore credibility to the EU’s enlargement agenda and ensure a genuine re-engagement with the Western Balkans. It will be up to the new Commission to regain a leadership role and give the integration of the region into the EU the priority it deserves.

Abstract:
The state capture and oligarchic control of political power and electoral processes in the associated countries of the Eastern Partnership – Georgia, Moldova and Ukraine – are acknowledged by EU institutions, civil society organisations and in public opinion. That inevitably puts pressure on the resilience of these three countries, in addition to Russia’s aggressive campaigns, carried out with or without the use of conventional weaponry. This policy brief looks at the EU’s actions to invest in and consolidate the rule of law, in the direction of stimulating internal resilience. It provides a range of arguments supporting the idea that the EU is not sufficiently tackling the oligarchic influences in Moldova, Ukraine and Georgia. These are followed by timely recommendations for the EU institutions to remedy the situation.

At a time of cooling relations, culture is arguably the European Union’s most powerful instrument to shape positive long-term relations with Russia. Against a convoluted international and domestic background, EU cultural action in the country is at present supported through a variety of financial instruments and programmes. Stakeholders and cultural operators agree that EU engagement in the cultural sphere plays a vital role in breaking civil society isolation and fostering long-term openness in Russia. However, in spite of considerable improvements, EU action in the cultural realm has still underutilised potential.
