Abstract:
The advance of globalization has involved additional governance capacity at supranational levels and thereby raised concerns about democracy, which has traditionally been based on the nationstate. For the most part, these governance arrangements take the form of intergovernmental fora, where nation-states are the principal players. In some policy areas where globalization is more pronounced, such as international finance, governance appears to feature some autonomous institutional development. Autonomy may come in the form of a relatively strong international organization with a mandate anchored in international law such as the World Trade Organization (WTO), or of the institutionalization of norms and values that give the intergovernmental forum an autonomous and distinct global perspective. As Held (1995) has observed, democratic theory has assumed that the nation-state is the relevant decision-making unit. The migration of political authority to supranational levels thus has the potential to undermine long-standing democratic arrangements.

Abstract:
Using the example of Estonia, the criterion of citizenship as a prerequisite for membership in a national minority and its legal consequences for persons belonging to these groups is discussed. While at the universal level minority protection is considered as a basic human right, at the European level it is still viewed as a right of citizens. The author pleads for a simplification of the naturalisation process and the renouncing of the citizenship criterion as a requirement for membership of a national minority.

863. Popes, Kings and Endogenous Institutions: The Concordat of Worms and the Origins of Sovereignty

Very rough preliminary and incomplete draft The modern state-centric international system is generally thought to have its origins in the Treaty of Westphalia. From that perspective, the modern sovereign state owes its origins to the resolution of the Thirty Years War. Prior to 1648, international politics are thought to have been less territorially focused, with feudal ties taking precedence over considerations of state. Here I set out a modest theory of competition between the Catholic church and European kings, especially the Holy Roman Emperor and the kings of France and England, during the years from 1122 onward. That theory suggests that the modern territorial state has its origins in the Concordat of Worms, 500 years earlier than is generally thought. It also suggests that the development of important institutions of the modern sovereign state are an endogenous product of strategic maneuvering between the Catholic Church and European kings over political control within their domains. Naturally, other factors, including competition between kings and barons, and aristocrats and merchants also play an important part in the evolution of political institutions. Those other considerations, however, are not examined here so that what I propose is a partial, incomplete account of the early developments that culminated in the modern territorial, sovereign state. Specifically, the theory maintains that the development of “modern” political institutions and the history of economic growth in Europe are to a significant degree the consequence of competition between monarchs and the Catholic church. This views stands in contrast to the general accounts of economic growth or of institution building found in the sociological literature beginning with Weber or in the historical and much of the political economy literature.

864. Illuminating Tomorrow's War

Abstract:
The United States is midway through what may be called a revolution in military affairs (RMA). 9 This revolution opened in the 1970s with the development and refinement of precision-guided munitions 1° (PGMs), which can hit anything that can be located. It is likely to culminate with the multiplication and integration of the DOD C41SR assets, thereby creating a well-populated Grid. In the process, the physical battlespace will become illuminated better than ever. As this occurs, conventional warfare will change from force on force to hide-and-seek. Hence the need for a Grid capable of illuminating the battlespace, a case that rests on five tenets: With precision weaponry, seeing a target is tantamount to being able to kill it. The guidance for such weaponry is potentially shifting from shooters or internal sensors to externally provided information. Defenses exist against PGMs, but the link between seeing and hitting is likely to strengthen over time.

In the early months of 1998, the outlook for relations between Iraq and the West looked distinctly bleak. The crisis over UN inspections of Iraq's potential to create weapons of mass destruction began in November 1997 with the Iraqi government's attempt to control the make-up of the United Nations Special Commission (UNSCOM) inspection teams on the grounds that the Anglo-American components of them were, in effect, spies came to a head in February 1998 when the United States and Britain insisted on full, unrestricted compliance with all UN sanctions under the threat of military action. Even though Iraq reluctantly acquiesced in Western demands, little thought appeared to be given in American and British planning to what the consequence of such action would be on Iraqis themselves and on Iraqi public opinion.

Conflict and cooperation constitute the basis of much interest in political analysis. Nevertheless, political theory abounds in disagreement as to which predominates, which constitutes the norm and as to the reasons for their occurrence. Game theoretical models have been applied to these problems with some success. The proposed article aims to contribute to our understanding of the phenomena of creating cooperation, and thus regulating a situation of conflict between two actors by a third party. A third party will be introduced to a prisoners' dilemma game and conditions for its cooperation creating regulatory strategies will be derived. The impact of informational and institutional structures on the prospects for cooperative outcomes will be discussed. Applications to governments' policies in regulating domestic conflict and to a hegemon's problem of maintaining order in the international arena will be shortly discussed.

So declared Secretary-General Boutros-Ghali in 1994. Indeed, peacekeeping emerged in the post-Cold War period as the "most prominent U.N. activity." The organization was freed of the shackles placed upon it by superpower rivalry, that heretofore had rendered U.N. machinery inoperative in coping with local crises and was suddenly becoming "the center of international efforts to deal with unresolved problems of the past decades as well as the array of present and future issues." Between 1988 and 1993, more than a dozen new peacekeeping operations were launched, involving more than 70,000 military and civilian personnel for field operations, at an annual cost to the United Nations in excess of $3 billion.

The issue of the financing of international justice has been generally neglected by international research. Legal scholars have rarely ventured beyond generic calls for the widening of the jurisdiction of international courts or for the creation of new courts. The financing of international justice has usually been conceived as an essentially political and technical issue and, therefore, as outside of the scope of legal discourse. Economists, on their side, have never taken a hard look at the way international law works, aside from decisions that effect the functioning of the international economic system per se. It is not surprising, therefore, that there does not exist any serious study on how much international rule of law costs, how and if efficiency could be enhanced, and where and if additional resources could be tapped to enhance the functioning of the courts themselves and allow a greater use of existing means. Hopefully, the data presented in this paper, together with some general observations proposed in the conclusions, will elicit constructive criticism and new thoughts on these much neglected aspects of this particular area of international cooperation.

At the end of the Cold War every country was forced to reexamine the fundamental assumptions that had formed their security policies for the last 45 years. Among the "victors" of the Cold War, few countries were faced with a more disparate set of new circumstances than Turkey. Unlike the United States and Western Europe, "victory" for Turkey had a very ambivalent quality. Almost overnight Turkey moved from being the buttressing flank of one strategic region, to the epicenter of a new one.

Abstract:
In this paper, we propose a dynamic theory of legal integration, test the model quantitatively, and then cross-check it by way of process tracing. We show that transnational exchange, litigation, and the production of Euro-rules have evolved interdependently, and argue that this interdependence provokes and reinforces the spillover effects that partly drive the construction of supranational governance. In case studies of the impact of the legal system on outcomes in two areas, the free movement of goods and European social provisions, we show that our model outperforms the dominant framework for understanding how the EC legal system operates - intergovernmentalism. In each of these areas, the data show that the legal system functions to reduce member-state government control over policy outcomes, and to enhance the influence of supranational institutions, national judges, and private actors.

877. The European Commission's Ability to Act under European Competition Law: The Example of Telecommunications and Electricity Policy

Abstract:
European competition law allocates far-reaching competences to the European Commission. The paper asks for the conditions under which the Commission may use these rights against the member states, focusing on the most powerful provision - the right of the Commission under Article 90 to issue directives by itself in those cases where member-state governments have allocated specific rights to undertakings that conflict with the Treaty's rules. In addition the Commission may pursue Treaty violations on a case-by-case basis. In European telecommunications policy the Commission has used its powers rather successfully, with all liberalization decisions being based on Article 90. But for European electricity policy the Commission has shrunk away from using these powers in favor of initiating council legislation. The paper analyzes the conditions of the Commission's ability to act under European competition law in a multi-level framework, drawing among others on a principal-agent approach.

This study assesses the Caribbean security landscape on the eve of the fast-approaching new century with a view to considering what the future portends in the security arena. Engaging in even guarded prospection during this period of history is particularly difficult, but also exciting, partly because of dramatic changes that the world began undergoing during the 1980s. These changes make scholars and statesmen approach the new century with a combined sense of expectancy and apprehension. The expectancy stems from the anticipated benefits of the end of the Cold War, among other things; the apprehension is driven by them may unknowns that tile dynamics of changing international relations hold for the future. This is true for the Caribbean as it is for other regions of the world, and it holds true for security as it does for other issue areas.

880. Defiant Again: Indigenous Poeples and Latin American Security

Abstract:
The cycle of Indian rebellion and government repression that characterized the first centuries of contact between European and Amerindian peoples cannot yet be consigned to the history books. The eruption of an armed movement in southern Mexico, comprised primarily of destitute Maya Indians, as well as smaller demonstrations of resistance in Brazil, Ecuador, and elsewhere speaks eloquently to this fact. While the majority of conflicts between the estimated 40 million indigenous peoples in Latin America and the societies in which they live are now played out in the political arena, security issues continue to generate violent interethnic conflict. Since the Conquest, the interests of indigenous communities usually have conflicted with national governments' security policies. These include a dimension explicitly intended to control the autonomous tendencies of indigenous communities, suppress Indian political organizing, and erase the independent identity of Indian nations.
