1611. Immigration in Europe at a Time of Economic Hardship

Abstract:
The global recession is resetting the context of the immigration debate across Europe. Immigration is one of the most visible manifestations of globalization for large numbers of Europeans. Globalization is a disruptive process challenging long held social assumptions and beliefs. It creates resistance, and concern over immigration is part of this. The recession is amplifying this effect significantly. The costs and benefits of globalization have never been equally shared, either within states or amongst them. Certain social groups fear immigration more than others, particularly in labour competition. The recession is leading to national or nationalist priorities becoming more popular and xenophobia can result. Political leaders understand this and even those who actively try to explain the advantages of immigration still tend to discuss it unhelpfully as a security issue. Immigration is a legally complex set of interrelated but different issues. The public discourse tends to not separate them, leading to all immigration issues being politically loaded. The EU plays an important role, but because borders and who can cross them is so closely linked to notions of sovereignty, the Union takes a secondary position to national policies.

The social sciences have many different understandings of 'normative power'. The purpose of this brief is to help clarify the concept of normative power in world politics as developed in European Union (EU) studies over the last ten years. The brief uses a five-point conceptualisation of normative power as being ideational; involving principles, actions, and impact; as well as having broader consequences in world politics. For each point both a general observation about world politics and a specific comment about the EU is made.

Abstract:
The 1982 Convention on the Law of the Sea—the instrument that created the overarching governance framework for nearly three-quarters of the earth's surface and what lies above and beneath it—has been signed and ratified by 156 countries and the European Community, but not by the United States. The Law of the Sea Convention, with annexes (hereafter in this report referred to as the “convention”), and the 1994 agreement on its implementation have been in force for more than a decade, but while the United States treats most parts of the convention as customary international law, it remains among only a handful of countries—and one of an even smaller number with coastlines, including Syria, North Korea, and Iran—to have signed but not yet acceded to the treaty.

Abstract:
Several developed countries have introduced emergency measures to mitigate the effects of the Global Financial Crisis, including Australia, Germany, Ireland, the United Kingdom, and the United States. Although the measures taken are still undergoing changes by the executive branch and are thus a “moving target”, our survey reveals early evidence of differentiation between foreign and domestic actors in the emergency plans adopted by this sample grouping. It is this differentiation that may give rise to liability as breaching guarantees against discrimination of foreign investors under international investment law.

Maritime security challenges in Africa are growing rapidly and represent an increasingly central component of the threat matrix facing the continent. African states struggle to meet these threats because their maritime security structures are misaligned with the challenges posed. Redressing this misalignment will require valuing the coast guard capacity demanded by these threats and constructing the array of intragovernmental partnerships needed to be effective in combating these threats.

Despite significant recent gains, Africa's security environment remains fragile with a wide array of ongoing and emerging threats placing great strains on already overburdened governments. United Nations peacekeeping operations in Africa have realized some success in recent years, especially when they have involved direct support from members of the Security Council. Much more cohesive interagency coordination under strong White House direction is required if the United States is to contribute to Africa's sustained stability given the region's persistent conditions of poverty, inequality, and weak governance.

1618. The Obama Administration and Iran: Towards a Constructive Dialogue

Abstract:
For much of the last 30 years, official relations between the United States and Iran have been strained. The most visible indication of this was US President George W. Bush's labeling of Iran as a member of the "axis of evil" in 2002. Breaking with the past, the new US administration is taking a more conciliatory tone. President Barack Obama has demonstrated that Washington is willing to open the lines of communication with Iran. This paper seeks to locate the Obama administration's efforts within the history of US-Iranian relations while also highlighting the contemporary issues that would inform a constructive dialogue, such as the upcoming Iranian presidential elections. Improved dialogue between the two countries could help to improve the situations in Iraq, Afghanistan and the Palestinian-Israeli conflict, demonstrating how overlapping areas of interest may provide a new path for US-Iran relations.

1620. Justice in Times of Transition: Lessons from the Iberian Experience

A key contention of the transitional justice movement is that the more comprehensive and vigorous the effort to bring justice to a departed authoritarian regime the better the democratizing outcome will be. This essay challenges this view with empirical evidence from the Iberian Peninsula. In Portugal, a sweeping policy of purges intended to cleanse the state and society of the authoritarian past nearly derailed the transition to democracy by descending into a veritable witch-hunt. In Spain, by contrast, letting bygones be bygones, became a foundation for democratic consolidation. These counter-intuitive examples suggest that there is no pre-ordained outcome to transitional justice, and that confronting an evil past is neither a requirement nor a pre-condition for democratization. This is primarily because the principal factors driving the impulse toward justice against the old regime are political rather than ethical or moral. In Portugal, the rise of transitional justice mirrored the anarchic politics of the revolution that lunched the transition to democracy. In Spain, the absence of transitional justice reflected the pragmatism of a democratic transition anchored on compromise and consensus.
