Abstract:
The constitutional construction of Bosnia and Herzegovina created multiple police agencies and four judicial systems, which means that fifteen police agencies and the Intelligence- Security Agency of BiH could file a demand for telecommunication surveillance from 68 different courts. Even though the legal framework has been equalized, this complexity together with parliamentary oversight on multiple levels opens up penetration points for the misuse of telecommunication surveillance. In order to prevent eventual misuse, this paper recommends to decrease the number of courts that can issue warrants, create a coordination system for telecommunication surveillance between the police agencies and define guidelines for parliamentary oversight.

Abstract:
The origin and foundations of religious extremism in Pakistan are a byzantine mix of national, regional and international influences resulting in a complex scenario. The extremists have been multiplied as a result of improved organization, and comparative inaction of government to counter them. Muslim extremism at the global level has a variety of root causes. The Afghan war of the 1980s supported and assisted by the West as a proxy war against the Soviet Union, saw the appearance and promotion of pan-Islamic militancy. Islam as a religion was used to tie together masses, worldwide Muslim support. Since Pakistan‟s establishment as a distinct state in 1947, Pakistan has struggled with the connotation of its identity. General Zia, who tumbled the government of Z. A. Bhutto in 1977, used Islam to validate his rule. Extended military interferences in politics led to an insecure political system. Ethnic differences and nationalist movements further deteriorated it. In such surroundings, parties were estimated as the shields of national identity based on Islamic standards and temperate political forces were considered as an intimidation to Islamic identity of Pakistan.

Abstract:
This paper attempts to review and analyze important features of Pakistani and Bangladeshi politics, the socio-economic situation and cultural traditions from both historical and contemporary perspectives with focus upon challenges of poverty alleviation. In so-doing, this paper analyses the major issues related to poverty alleviation against the backdrop of sociopolitical and economic structures. The present paper has been extracted from the published PhD work of the first author. The review indicates some of the important features of Pakistan and Bangladesh. Both the countries share similar ranking on human development index. Substantial proportions of populations in both the countries are engaged in primary sector of economy. Gender disparities on socio-economic indicators, ethnic and sectarian divide, political instability and corruption are intertwined with political, economic and cultural structures of the countries. Good governance, increased civic participation, collaboration of Faith-based organizations with NGOs and CSOs can help improve indicators of Human Development Index in Pakistan and Bangladesh.

Abstract:
Our Spring 2016 volume encapsulates the dangerous developments in MENA over the course of the past year. While the international community hoped for a resolution to the five-year Syrian Civil War, the conflict has further divided the region into a sectarian split, pitting Shia Iran and the Sunni gulf states on opposing sides. Additionally, Russia’s brief military intervention, finally winding down as of March 2016, has further destabilized the country and significantly increased the flow of refugees into the heartland of Europe. With the November 2015 Paris attacks, the threat of the so-called Islamic State (Daesh) to the west was finally realized, calling into question ongoing efforts to counter violent extremism, as well as to resolve the Syrian Civil War. Meanwhile, Turkey’s increasing two-front war against the Kurdistan Workers’ Party (PKK) and Daesh has resulted in a series of deadly terrorist attacks throughout the country, putting further pressure on Turkish leadership to both find a solution to the Kurdish question and stem the refugee flow transiting northward from Syria. It is through this lens that the Spring 2016 edition has been crafted. With conflict and instability abound, we present first an exclusive interview with Speaker of the Iraqi Parliament Salim al-Jabouri. On a more positive note, JMEPP also interviewed Tunisia’s Minister of Economic Infrastructure and Sustainable Development, Hedi Larbi, on Tunisia’s relative stability and success in its post-Jasmine Revolution transition. This year’s featured articles include Robert Mason’s assessment of the Saudi leadership and the perilous position it now finds itself in, both geopolitically and domestically; and Serhat S. Çubukçuoğlu’s eyes on Turkey’s natural gas ambitions as being linked to settling the Cypriot peace talks, as well as re-establishing partnerships with its regional neighbors in the eastern Mediterranean. Benjamen Franklen Gussen creates a new picture of a geographically reoriented Middle East, while Dylan MaGuire analyzes the no-fly zone option in Syria, with a look back to previous operations in Iraq and Libya. Focusing on gender, Dr. Dalia Ghanem-Yazbeck looks at integration and inclusion of women in Algeria’s military, yet presents a critique on its superficiality. With an eye on Turkey’s destabilized southern border region, Joseph Sadek provides commentary on the political and geostrategic jostling between Turkey and its Kurdish population, as well as the complex relationships between Turkey, the PKK, and Syrian People’s Protection Units (YPG) rebels. Turning to terrorism, Lauren Fisher presents an argument against the stovepipe methodology of countering violent extremism by exploring the complexities behind the topic. Finally, we conclude with a literature review by Adi Saleem Bharat on the Boycott, Divest, Sanction (BDS) movement as it pertains to academia.

Throughout 2016, MEI will be releasing several policy papers by renowned scholars and experts exploring possibilities to foster regional cooperation across an array of sectors. The purpose is to highlight the myriad benefits and opportunities associated with regional cooperation, and the high costs of the continued business-as-usual model of competition and intense rivalry. Infrastructure serves as one of the key tools available to enhance regional cooperation and build toward an integrated Middle East. Under the reign of the Ottoman Empire, the Middle East and North Africa was an integrated web of railways, arterial and trading routes, much of which has disappeared over the last century. A region unaccustomed to division has since fragmented, with each state erecting numerous barriers that hinder integration—from trade tariffs to poor customs services. The economic potential and benefits for the region as a whole lies within deeper integration. This paper explores feasible possibilities for short-term and long-term infrastructure integration across several key sectors: energy, I.C.T., transport and facilitation.

The Middle East and North Africa (MENA) is regarded as one of the most water-challenged regions in the world. The destabilizing impact of its resource constraints is compounded by the fact that some 60 percent of the region’s water flows across international borders, generating and exacerbating political tensions between states. Water insecurity will increase in the MENA region if the current situation of minimal water cooperation persists under the disabling conditions of political volatility, economic disintegration, institutional failure, and environmental degradation. Experiences from around the world demonstrate that countries that have achieved regional water cooperation have prospered together and kept the threat of conflict a remote possibility. It is time for the countries in the Middle East to realize that there is no alternative to sustainable water cooperation.

249. Building a New Foundation for Stability in Libya

Abstract:
For almost five years, Libyans have struggled to build a new political order for their country out of the wreckage left by Moammar Gadhafi’s four-decade dictatorship. Despite successful national elections in July 2012, political factions backed by various militias have sought power at the expense of their rivals. As a result, Libya’s oil production and, consequently, its economy have collapsed along with any semblance of a post-Gadhafi political order. This violent struggle for power has created a security vacuum, filled in part by the Islamic State of Iraq and al-Sham, or ISIS, and various Al Qaeda-linked terrorist groups, such as Ansar al-Sharia. In the past year, Libya has become a strategic location for ISIS. Due to coalition military pressure, the group has told recruits to head for Sirte in Libya rather than stay in Syria or Iraq. The growing presence of ISIS in Libya—now estimated to total as many as 6,500 fighters—represents a direct security threat to the United States and its allies in Europe, the Middle East, and North Africa.

250. Next Steps in Libya

The alarming security, economic, and political trends in Libya are currently a critical issue for the international community. Europeans are particularly concerned about Libya as a point of departure for refugees and migrants. Despite recent progress, the presence of the Islamic State, or IS, in Libya is also an urgent security issue for the country, as well as for the United States, Europe, and Libya’s neighbors. At the same time, Libya is struggling to unify its government. Libya’s downward economic spiral further complicates the possibility of a unified government and a more stable Libya. Libya’s problems are legion, but establishing a single government and creating a more secure environment are the first orders of business. The Government of National Accord, or GNA—a body that reflects an agreement made last December with the help of the United Nations—has begun to establish itself in Tripoli and is trying to incorporate two opposing Libyan governments, which have been fighting each other since 2014. These are the Islamist-led Libya Dawn coalition—also known as the General National Congress, or GNC, which controls Tripoli and the eastern government in Tobruk—and the House of Representatives, or HoR, backed by retired Libyan Gen. Khalifa Hiftar and Operation Dignity. The GNA is working to establish a new government and taking immediate steps to improve conditions. While Libya has made progress in fighting IS over the past few months, the threat remains as long as IS leadership views Libya as a way to extend its caliphate—an Islamic state led by a caliph, a successor to the Prophet Muhammad. This is particularly true in light of recent setbacks for IS in Syria and Iraq. If the international community wants to help Libya rebuild, it needs to have a plan that outlines how it will assist Libya with its economy and the development of institutions that can provide the foundation for a revitalized nation. It is clear that having a functioning, unified government and making Libya significantly more secure is necessary to implement efforts to help Libya rebuild its economy and government. Indeed, a blueprint for such efforts could be an important incentive for the Libyan people to coalesce around a government and a unified approach to security. As President Barack Obama famously said in a press interview earlier this year, his biggest “mistake” was not having a plan to help Libya after the fall of Prime Minister Moammar Gadhafi. But it is not too late to develop plans to put Libya on a path that offers promise rather than chaos.

This is particularly true in Iraq, where the liberation of Fallujah last month has focused attention on Mosul—the capital of the so-called caliphate. But military victory is only half the battle. As the Islamic State is pushed out of Iraqi cities and towns, the communities it ruled must be integrated back into Iraq. Nature abhors a vacuum; the U.S.-led Global Coalition to Counter ISIL should do more to support the Iraqi government in filling that vacuum. For its part, the Iraqi government itself must display a greater commitment to inclusive governance that reinforces its own legitimacy. Failure to do so would risk squandering hard-won gains by setting the stage for the Islamic State—or its successor—to return. It also could undercut U.S. strategic goals in the Middle East more broadly. The key will be to close the gaps in resources and priority afforded to the different elements of the global coalition’s campaign. That campaign is organized along five lines of effort: military efforts, counter-finance, stopping the flow of foreign fighters, stabilization, and strategic messaging. The military line, otherwise known as Operation Inherent Resolve, has cut the territory controlled by the Islamic State almost in half. Other key coalition lines have yielded less robust results. In particular, efforts to stabilize territory in the wake of combat operations have not kept pace with progress on the battlefield—even as that progress makes stabilization all the more urgent.

253. Rethinking Human Rights in EU External Policies

The EU’s Global Strategy on Foreign and Security Policy is an opportunity for the EU to redefine its role on the global stage in a way that builds on the norms that underpin its own progress, shows leadership and ambition, and takes a decisive stand against regressive regimes that prefer compliant partners that prioritise interest over universal values. In this paper, the Open Society European Policy Institute calls on the EU and its member states to end the false dichotomy between “values and interests” and argues that universal human rights constitute a building block of any policy aimed at supporting sustainable security, prosperity, and stability in Europe and beyond. The input builds on the main conclusions and recommendations that emerged from the expert discussion on human rights in EU external action cohosted by the Open Society European Policy Institute and the European Union Institute for Strategic Studies in January 2016. The convening brought together over 30 human rights experts (including from Egypt, Kenya, and Azerbaijan), EU officials, parliamentarians, and diplomats.

Abstract:
In 2014, a war started in Ukraine that has led to a current death toll of approximately 8000 people. This war was the result of a climax of ongoing challenges in Eastern Europe in its transition from the post-Soviet era. While the region as a whole undertook divergent paths, with some states joining NATO and the EU, Ukraine has struggled for 25 years to find its bearing. Caught between its historical connections to both West and East, and a failure to solve the problem of an oligarchic based economy with a chronic national debt, Ukraine today is the focus of the search for stability in Eastern Europe. Canada and its NATO Allies are fully engaged in assisting Ukraine with its challenges of reform. The Minsk 2 process, established in early 2015, has stabilized the fighting, but a diplomatic resolution remains elusive. Faced with the prospect of either further war, frozen conflict or diplomatic resolution, Canada's new Liberal Government has the option to raise its diplomatic game and bring Canada's experience of ethnic and regional diversity to the negotiating table. Such a contribution to stability would well serve Canada's national interests.

This report is the Chair’s Summary of a colloquium on the theme of reconciling self-determination and territorial integrity, “Models of Self-Governance as Tools to Promote Peace and Stability in Europe,” which was held in Triesenberg, Liechtenstein, from March 20-22, 2016. The report conveys key points from the discussions among academics, experienced mediators and diplomats, aimed at considering new and innovative ways of thinking about self-determination that do not equate it with independence or secession, in particular, in the context of ongoing conflicts in the Organization for Security and Cooperation in Europe area. The meeting was held in collaboration by Liechtenstein Institute on Self-Determination at Princeton University and the Permanent Mission of Liechtenstein to the United Nations.

After making himself one of the most powerful leaders in PRC history, Xi Jinping launched the largest ideological campaign that China has seen since Mao—a mixture of communism, nationalism, and Leninism that is meant to strengthen and discipline the CCP, reinforce its grip on power, maintain political stability, and (more nebulously) achieve the “China dream” of national rejuvenation. Xi’s ideological gambit now looks less like a show of strength than an embarrassing confession of regime fragility in a twenty-first century China buffeted by fears of economic slowdown, impatient liberals, and a public angered by rampant corruption.

257. The Danger of Deconsolidation: The Democratic Disconnect

Abstract:
The citizens of wealthy, established democracies are less satisfied with their governments than they have been at any time since opinion polling began. Most scholars have interpreted this as a sign of dissatisfaction with particular governments rather than with the political system as a whole. Drawing on recent public opinion data, we suggest that this optimistic interpretation is no longer plausible. Across a wide sample of countries in North America and Western Europe, citizens of mature democracies have become markedly less satisfied with their form of government and surprisingly open to nondemocratic alternatives. A serious democratic disconnect has emerged. If it widens even further, it may begin to challenge the stability of seemingly consolidated democracies.

Abstract:
This article points out the cataclysmic power shift that would take place in the event of Saudi Arabia’s descent into political turmoil, and briefly covers some of the catalysts that could bring about such an event. Overall, the oppressive policies towards the Shia minority carried out by the Sunni-dominated Saudi monarchy are detrimental to the country’s national security. The religious disparities in the country have given the monarchy’s enemies—primarily Iran and Russia—a weakness to exploit. This article does not give evidence of any clandestine operations taking place within the Kingdom; however, it gives evidence that Iran and Russia have much to gain and virtually nothing to lose if the country was to spiral into violence like so many others in the region.

Abstract:
The Arab world never seemed more unified than during the incandescent days of the 2011 Arab uprisings. Tunisia’s revolution clearly and powerfully inspired Arabs everywhere to take to the streets. Egypt’s January 25 uprising that led to the removal of Hosni Mubarak taught Arab citizens and leaders alike that victory by protestors could succeed. The subsequent wave of protests involved remarkable synergies that could not plausibly be explained without reference to transnational diffusion. Bahrainis, Yemenis and Jordanians alike attempted to replicate the seizure and long-term encampments in Egypt’s Tahrir Square and protestors across the Arab world chanted the same slogans and waved the same signs.
