1. What Synergy of Action in the Fight Against Corruption in Cameroon?

The phenomenon of corruption is growing so much in Cameroon, to the point where we must be careful that it does not become a characteristic of Cameroonian identity. Cameroon has twice held the rank of the highest corruption index in the world.[1] However, the will of the public authorities to put an end to it is matched only by the determination of the actors of corruption to escape the meshes of the control mechanisms. Given the government strategy and the proliferation of organizations fighting against corruption, one could expect a significant reduction of this scourge in Cameroon. But like a hydra, corruption remains a major problem in Cameroonian society. A substantial literature has been able to highlight the strengths and weaknesses of administrative, political, and jurisdictional bodies in the fight against corruption.[2] Among other weaknesses are prominently the subordination of the power of sanction to the will of the president of the Republic, the politicization of special operations to fight against corruption, and the lethargy of certain control bodies. The creation of the NACC, an organization specializing in the fight against corruption, has created hope in Cameroon. But, the decree fixing its attributions does not give it its own power of sanction. Consequently, NACC limits itself to noting the facts of corruption and reports them to the public authorities or seizes the judge by denunciation. This technique of referral by denunciation was mainly oriented toward the judicial judge. In practice, however, NACC had to experiment with referral to the Audit Bench of the Supreme Court, which opens up the prospect of collaboration between these two bodies in the fight against corruption in Cameroon. The question arises as to how NACC and the jurisdiction of accounts can combine their actions in the fight against corruption in Cameroon. After analysis, it appears that the ways of functional collaboration between the two organizations exist (I); however, they require some operational coordination (II).

2. Remittances and corruption perceptions in Africa

Abstract:
The relationship between remittances and corruption is contested. For some authors, external income endows individuals with financial buffers, which undermine these individuals’ incentive to hold governments to account and allow rent-seeking politicians to invest fewer resources in public goods. For others, remittance payments undermine clientelist networks and increase individual-level political engagement and accountability. For others still, remittances diffuse social norms, since senders are likely to live in large cities or wealthier countries where corruption is less tolerated. However, despite being rooted in individual-level assumptions, many of the conflicting results in the extant literature have an empirical focus at the aggregate level. In this paper we offer a corrective, explaining variation in individual-level perceptions of corruption among remittance recipients through a new mechanism. With survey data from 34 African countries, we show that recipients are endowed with greater cash income, which is used to bribe officials in the hope of securing preferential access to basic services. This act of paying bribes, coupled with the fact that access does not appear to improve, fuels perceptions that the government is corrupt.

Abstract:
‘What counts’ as accountability, and who decides? Accountability is often treated as a magic bullet, an all-purpose solution to a very wide range of problems—from corrupt politicians or the quality of public service provision to persistent injustice and impunity. The concept has become shorthand to refer to diverse efforts to address problems with the exercise of power. In practice, the accountability idea is malleable, ambiguous — and contested. This working paper unpacks diverse understandings of accountability ideas, using the ‘keywords’ approach. This tradition takes everyday big ideas whose meanings are often taken for granted and makes their subtexts explicit. The proposition here is that ambiguous or contested language can either constrain or enable possible strategies for promoting accountability. After all, different potential coalition partners may use the same term with different meanings—or may use different terms to communicate the same idea. Indeed, the concept’s fundamental ambiguity is a major reason why it can be difficult to communicate ideas about accountability across disciplines, cultures, and languages. The goal here is to inform efforts to find common ground between diverse potential constituencies for accountable governance. This analysis is informed by dialogue with advocates and reformers from many countries and sectors, many of whom share their ideas in blogposts on the Accountability Keywords website (see also #AccountabilityKeyword on social media). Both the working paper and blogposts reflect on accountability-related words and sayings that resonate with popular cultures, to get a better handle on what sticks. The format of the working paper is nonlinear, designed so that readers can go right to the keywords that spark their interest: The introduction maps the landscape of accountability keywords. Section 2 addresses what counts as accountability? Section 3 identifies big concepts that overlap with accountability but are not synonyms- such as good governance, democracy, responsiveness and responsibility. Section 4 shows the relevance of accountability adjectives by spelling out different ways in which the idea is understood. Section 5 unpacks widely used, emblematic keywords in the field. Section 6 considers more specialized keywords, focusing on examples that serve as shorthand for big ideas within specific communities of practice. Section 7 brings together a range of widely-used accountability sayings, from the ancient to the recently-invented—illustrating the enduring and diverse nature of accountability claims. Section 8 makes a series of propositions for discussion.

Drawing on broad stakeholder consultations, corruption case analysis and reviews of existing best practices, this guidance proposes concrete measures that international oil, gas a mining companies should adopt to reduce corruption risks in their work with state-owned enterprises (SOEs) in the oil, gas and mining industries. It also recommends measures SOEs can take to strengthen their anticorruption safeguards. The guidance for private-sector companies has five parts: Conducting due diligence on SOEs; Avoiding high-risk agents; Responding to political exposure; Safeguarding payments; Protecting joint ventures from corruption. The final section identifies corresponding recommendations for SOEs in each of these five areas.

5. Measuring the Impact of Campaign Finance on Congressional Voting: A Machine Learning Approach

How much does money drive legislative outcomes in the United States? In this article, we use aggregated campaign finance data as well as a Transformer based text embedding model to predict roll call votes for legislation in the US Congress with more than 90% accuracy. In a series of model comparisons in which the input feature sets are varied, we investigate the extent to which campaign finance is predictive of voting behavior in comparison with variables like partisan affiliation. We find that the financial interests backing a legislator’s campaigns are independently predictive in both chambers of Congress, but also uncover a sizable asymmetry between the Senate and the House of Representatives. These findings are cross-referenced with a Representational Similarity Analysis (RSA) linking legislators’ financial and voting records, in which we show that “legislators who vote together get paid together”, again discovering an asymmetry between the House and the Senate in the additional predictive power of campaign finance once party is accounted for. We suggest an explanation of these facts in terms of Thomas Ferguson’s Investment Theory of Party Competition: due to a number of structural differences between the House and Senate, but chiefly the lower amortized cost of obtaining individuated influence with Senators, political investors prefer operating on the House using the party as a proxy.

The death of Mahsa Amini in the custody of Iran’s so-called morality police sparked protests that continue to spread across the country, posing the most serious challenge to Tehran’s theocratic dictatorship in years. The demonstrations have focused on opposing the compulsory wearing of the hijab, but Iranians are also venting anger at a regime that has lost legitimacy after decades of political repression, economic mismanagement, and systemic corruption. Policymakers in the United States are rightly focused on constraining Iran’s nuclear program and state sponsorship of terrorism. Sanctions and other measures targeting the regime’s illicit financial networks tend to reflect these urgent priorities. But Iran’s theocratic regime is also a sprawling, deeply entrenched kleptocracy against which the US should apply more pressure. This brief examines the prevailing forms of corruption within Iran, the implications for US policy, and how the US can intensify efforts to expose and target the regime’s kleptocracy.

Abstract:
This paper aims to provide an overview of the transparency policy in Greece with a focus on public administration. To this end, we explore and critically analyse the origins and the state of play of transparency policy in line with the key components of the current policy agenda, namely: open government, access to documents and digital information, internal audit, and lobbying activities. The goal is to identify (i) the way by which transparency policy has been embedded in the domestic agenda of state reform and evolved over time and (ii) the processes and mechanisms through which transparency policy is currently formulated, implemented and evaluated. The findings of the analysis show that the focus of the transparency policy has shifted over time and has included a wide range of both symbolic and pragmatic initiatives, such as citizen empowerment and participation (1980s), control of public administration (1990s-2000s), open/ digital governance and open data (2000s), anti-corruption (2010s) and public sector digitalization (2020s). In this respect, the term “transparency” seems to have embraced a wide variety of concerns, objectives, procedures, and institutions. Like other policy domains, the fragmentation of the legislative framework and competent institutions has been a constant feature of the domestic transparency policies, which has hampered policy coherence and co-ordination over time. Accordingly, the formulation, implementation and monitoring of the transparency policy implicates multiple actors across central government together with the growing influence of external experts during the past years. Τhe role of civil society and citizen participation in transparency policy remain weak. Recently, an effort has been put forth to centralize control mechanisms and interconnect existing platforms in order to alleviate the observed weaknesses. Yet, beyond the institutional and technical improvements, the role of transparency for democracy and accountability remains in question and needs to be brought back into the debate.

8. Barriers to Effective Whistleblowing in Botswana: Lessons from the Construction Industry

Adopting Botswana’s construction industry as a case study, this Policy Brief examines key barriers to effective whistleblowing in Botswana. Data were drawn from 117 construction firms and interviews with regulators of this sector. Despite the enactment of the Whistleblowing Act 2016, the study finds the following key barriers to effective whistleblowing: (i) fear of retaliation or punishment, (ii) fear of job loss, (iii) absence of organisational whistleblowing policies, (iv) lack of incentive to report, (v) lack of education on whistleblowing, and (vi) insufficient action and follow-up on disclosures by authorities. From a policy perspective, there is a need to strengthen the existing legal protection offered to whistleblowers, their families and associates to ensure they are not subject to harm, retaliation or victimisation. There is also a need to increase levels of education and awareness on whistleblowing in general, and the Whistleblowing Act 2016 in particular.

Abstract:
In June of 2021, the Biden administration announced that it would be establishing the fight against corruption as a core concept in US national security and a pillar of its foreign policy.1 The following December, it launched the “US Strategy on Countering Corruption” as a “whole-of- government” initiative to, among other objectives, curb illicit financing, hold corrupt actors accountable, and improve diplomatic engagement and leverage foreign assistance in the pursuit of its policy goals.2 With the United States the premier actor in international politics and influence, the administration set out to formulate strategies, lay down markers, and implement policies that can help at least make a dent in the scourge of corruption around the world. Today, the task of fighting international corruption must include the countries of the Arab world, most of which are close political, economic, and strategic partners of the United States. Corruption in the region is eroding what little is left of social and political stability. From bribery to influence peddling, and from the use of public and official power for private gain to interference with the judiciary, the region’s corruption requires diligent internal and international efforts to address it. Democracy and economic development depend first on the striving of the region’s populations to ensure and protect their human rights, but also on an active role played by the United States government and its many institutions.

Abstract:
Kleptocracies seem to enjoy powerful coherence between their domestic and foreign policies, given that they wield power at home and abroad through the same corrupt assemblage of actors, networks, tactics, and resources. By prioritizing the fight against corruption and kleptocracy, the United States can similarly pursue the most internally coherent grand strategy since it combined the containment of communism with neoliberal deregulation to win the Cold War. Doing so will require deeply reorienting foreign and domestic policy priorities by featuring the opposite side of the U.S. economic model, with less cowboy and more sheriff: well-regulated clean capitalism under the rule of law.

Foreign Direct Investment (FDI) has been always associated with a high level of trade openness and freedom environment, and with a lower incidence of institutional corruption. Because it is assumed that a high level of international capital mobility makes foreign investors more cautious when there is a fluctuation in political stability and institutional transparency. Most American countries (except Canada and the USA) have been always related to a lack of transparency in their institutional and bureaucratic procedures, which conduct to important levels of corruption and in consequence, to other serious issues such as prominent level of violence, or even the inequality phenomena. This study investigates whether the variables of corruption indices, trade openness and inflation rates have positive or negative effects on FDI between Turkey and American countries. For analyzing this econometric model, it was gathered information from OECD, COMTRADE, TUIK, Heritage Foundation, UNCTAD, and the World Bank Database. The observed data correspond to a decade (2005-2014) and were only taken a sample of 14 American countries. The empirical results of the present study revealed that there is a positive correlation between the trade openness index and FDI; and, it was found a positive correlation between corruption index, inflation, and FDI. The increase in the corruption index causes a 41% increase in FDI inflow.

Since the opening up of the Chinese economy by Deng Xiaoping in 1979, China has grown wealthy, but corruption has also become pervasive at all levels of the Chinese Communist Party (CCP). Corruption has been a part of Chinese business and governance for millennia, but despite the grand pronouncements of the CCP about eradicating corruption, it has not only endured under the current system but grown to extraordinary heights. Due to deeply entrenched corruption across the government, as well as the variable spread of economic benefits, this issue will remain a severe challenge for the CCP as the Xi Jinping era enters its second decade. The necessity for the state security agencies to support political control by Xi will also ensure that anti-corruption purges continue to impact the police and security agencies.

Money laundering is not the issue of today, as it is coming from the early days in many ways and the evil to society as it effects not only those peoples which are related to this evil as well as it also hits the noble peoples of the society by not paying the legal levies that increases the prices of products in the market. Research is carried out to check the impact of money laundering on the economy of Pakistan in an econometric way along with the other control variables (inflation, unemployment, remittances, number of crimes, total investment, and corruption). Money laundering is measured with informal economy and economic growth is measured with GDP. Annual data from 2000 to 2019 is employed for the purpose of analysis and suitable statistical tools are applied to derive the results. Through these test short run and long run effects are derived also. For analysis of the data, secondary data of two recent decades are used which is collected from the different sources i.e. economic surveys, published papers, and World Bank database etc. At the end it is concluded that money laundering has negative effect on the economy of Pakistan along with other variables.

14. The Development Response to Kleptocracy and Strategic Corruption

Kleptocracies do not stop at their own borders. The same actors, networks, tactics, and resources that they wield to prevent democracy and rule of law from sprouting at home are also repurposed for foreign aggression. While cronies, oligarchs, and lesser operatives do get rich in the process, “strategic corruption” is chiefly a geopolitical weapon directed by autocratic regimes to secretly undermine the sovereignty of other countries. The three most common manifestations of strategic corruption vary on a spectrum of how directly and boldly they violate sovereignty and subvert democratic processes. Starting with the most indirect and chronic form of strategic corruption, Russia and China invest “corrosive capital” throughout Eastern Europe and the Belt and Road Initiative, respectively. They use corrupt patronage networks and opaque business dealings to spread their kleptocratic model of authoritarian governance. Those corrupt investments are usually also supported by tactics of “malign influence,” like when a minister or politician receives bribes or economic threats until they censor their political speech, advance a foreign policy initiative, or otherwise subordinate the legitimate sovereign interests entrusted to them by their own people in favor of the interests of a foreign power. Finally, the most direct and acute form of strategic corruption involves financial methods of election interference and other tactics of corrupting democratic processes. Often funded with the proceeds of kleptocracy, election interference through covert political financing has become the bailiwick of Kremlin-directed oligarchs. Separate from those three manifestations of strategic corruption—corrosive capital, malign influence, and election interference—China and Russia try to hide their dirty money and malign activities by pressuring foreign journalists into silence through surveillance, thuggery, and lawsuits. Western foreign assistance has not yet offered a coherent response to kleptocracy and strategic corruption, but that is starting to change under the Biden administration. Building resilience to this transnational threat through foreign aid will require four new approaches that are more political and coordinated than traditional development assistance. First, aid should be informed by local political analysis. More important and less used than technical reviews of laws and institutions, political analysis should center anti-corruption efforts around known corrupt activity. That starts by asking sensitive questions about which individuals, institutions, and sectors are the most corrupt, how extensively their networks of wealth and power span, and which corrupt figures must be held accountable to thoroughly purge grand corruption. Second, aid should be responsive to political shifts, scaling up and down, respectively, in response to windows of opportunity for anti-corruption reform and times of backsliding toward kleptocracy. Third, aid responses to kleptocracy should be coordinated at the regional and global levels, similarly to how grand corruption operates across borders through transnational networks of actors and tools. Fourth, anti-corruption programming should be deeply integrated across the traditional sectors of assistance, particularly health, infrastructure, energy, climate, and security. Some of these new approaches are already being prioritized under the Biden administration’s new strategy to combat corruption, particularly coordinating across tools and sectors to fight transnational corruption. But operationalizing this mission will be no small endeavor, given that anti-corruption assistance is delivered through a notoriously technocratic and apolitical bureaucracy built during the Cold War to aid socioeconomic development in individual countries steadily over decades. But getting this right offers the key to defending democracies from autocratic aggression, showing how democracy can deliver, and even helping bring foreign policy and domestic politics into alignment for the first time in a generation.

15. Global oil theft: impact and policy responses

This paper, the first of two on global oil theft and fraud, discusses the prevalence, methods, and consequences of global oil theft, valued at US$133 billion per year and equivalent to 5–7 per cent of the global market for crude oil and petroleum fuels. However, the impact of oil theft is significantly larger than the value of theft itself. Government tax yields have been assessed for 30 developing countries associated with oil theft and found to be significantly lower than in the International Monetary Fund’s benchmark study. Oil theft, smuggling, and illicit trade in petroleum products are often seen as lesser forms of crime than human trafficking, the drugs trade, smuggling of weapons, kidnapping, and terrorism. However, oil theft as an act of opportunity tends to evolve into organized crime and, if left unchecked, oil theft may interlink with other organized crime activities and groups. Actions against oil theft should target the transnational crime syndicates that continue to find ways to replicate their thefts by adapting their theft strategies and business models. However, there is a lack of basic data, including how much oil is stolen, how the stolen oil is transported, and how illicit oil transactions are conducted. The mixing of legal commercial operations with illegal oil theft activities and fraud obscures many oil theft crimes.

16. Countering global oil theft: responses and solutions

This second of two papers on global oil theft discusses ways to reduce oil theft, misappropriation, and fraud. At US$133 billion per year, oil is the largest stolen natural resource globally, while fuel is the most smuggled natural resource. Oil theft equates to 5–7 per cent of the global market for crude oil and petroleum fuels. It is so engrained in the energy supply chain that thefts are priced in by traders and tolerated by many shipping companies as petty theft. Oil theft and related insecurity have substantial negative economic effects on developing countries, whether they produce oil or not. In 2012, non-oil-producing Benin saw a 28 per cent drop in taxable income after a spate of oil tanker hijacking incidents in the Gulf of Guinea in 2011. In Nigeria, the oil capacity shut-in and amount of oil deferred is more than twice the amount estimated as stolen, with a US$20 billion annual loss in petroleum profit tax—63 per cent of total government tax revenue in 2019. Organized oil crime syndicates are often transnational and conduct theft and fraud professionally, exploiting gaps in jurisdiction and adapting their practices when law enforcement becomes more effective. They evolve from ship piracy to stealing tanker cargoes to kidnapping tanker crews; from physical ransom of assets to digital hijacking via ransomware. The proceeds of oil theft often finance other organized crime, and it triggers violence against the community and in crime-on-crime activities. Twelve commonalities in oil theft and fraud have been identified that can direct international solutions, in three target areas: stolen oil volumes, stolen oil transport, and stolen oil money. Prosecution for acts of bribery offers opportunities for action: transport of or payment for illegal oil could constitute a bribe under the US Foreign Corrupt Practice Act if government officials were involved in the transaction or shipment. Bribe charges could be raised for paid ‘services’ that facilitate oil theft (through action or non-action).

17. Corruption and crisis: do institutions matter?

While the short-term effects of the COVID-19 pandemic on lives and livelihoods are well understood, we know little about the effect of the pandemic for longer-term outcomes such as corruption. We look at the historical data on political and economic crises to assess what we can learn from the long-term effects of past crises on corruption. We hypothesize that strong rule of law institutions may ameliorate the possible adverse effects of political and economic crises on corruption. We test our hypotheses using panel data for over 100 countries during the years 1800– 2020. The results suggest heterogeneous effects depending on the type of crisis and how we measure it. We find that rule of law institutions can control corruption in cases of political violence and economic slowdown, but the effect is not seen for democracy breakdowns, coups, armed conflict and civil war, and economic crisis such as currency and debt crisis.

The first Strategy on Countering Corruption, adopted on 6 December 2021, assumes that by making better use of existing international regulations and organisations, as well as by establishing new mechanisms, the U.S. will tighten global anti-corruption cooperation. The American goal is to limit the freedom to conduct financial operations by authoritarian states, mainly China and Russia, and at the same time to strengthen democratic countries and promote democracy. For Poland, this is an opportunity to tighten bilateral and multilateral cooperation with the United States.

EU Member states can be divided on China, even on issues such as human rights. Often singled out as an agent of division is the Hungarian government of prime minister Viktor Orbán. Hungarian dissent begs the question: how can the EU move forward on China given Hungary’s strategy of obstructive dissent? European cooperation ought not wait for unanimity, nor should it rely on value-politics: member states should play the power game to circumvent or break lingering impasses. Against a background of contemporary security challenges such as terrorism, violent extremism, insurgency, armed banditry, and separatist movements across the country, the study attempts to examine critical infrastructure protection. With the aid of largely secondary data, the study finds that there is an inextricable link between CIP and institutional corruption in Nigeria. Institutional corruption has been a major factor inhibiting effective critical infrastructure protection in Nigeria. This is because funds meant for the strengthening of operational effectiveness of the agencies are often diverted to other expenditure that does not have an effect on the operational strength of the agencies, thereby undermining their capacity to deliver on their mandates and increasing the vulnerability of the infrastructures to vandalism. The study recommends the adoption of a whole-of-society approach to CIP in Nigeria, because of its ability to block leakages and ensure transparency in the business of government as well as encouraging all stakeholders, the state, private, CSOs, the media, traditional institutions and all others involved, to share responsibilities in the protection of infrastructures as part of their concerns.

Security institutions in Kosovo are constantly maintaining, and in some cases, increasing their trust among the citizens, thus resulting as the most trustworthy institutions compared to other sectors. Kosovo Security Force is the most trusted institution with 83 percent of trust, followed by Emergency Management Agency with 73 percent, and Kosovo Police, which is trusted by 72 percent of respondents. Two other security institutions have marked significant increase in 2022: around 60 percent of respondents trust the Police Inspectorate of Kosovo and 51 percent trust the Kosovo Intelligence Agency. This is the first time that both institutions gained the confidence of more than 50 percent. The President of Kosovo, with 59 percent, and Municipalities, with 55 percent of trust, are ranked as the most trusted among the central and local institutions followed by Kosovo Customs with 46 percent.

The Kosovo Security Forces, the Kosovo Police, the President of Kosovo and the Municipalities are the most trusted public institutions in Kosovo, with over 50 percent of respondents declaring that they trust or completely trust these institutions. This is followed by the Kosovo Customs and the Kosovo Intelligence Agency with 45 percent of respondents sharing such an opinion. On the other hand, less than 40 percent of the respondents declared that they trust or completely trust Courts, Prosecution, Kosovo Correctional Services, the Government of Kosovo and the Kosovo Assembly. The results of the report show that citizens of Kosovo find the security institutions more reliable with a higher level of trust towards them, compared to other public institutions in Kosovo, such as the justice institutions which citizens perceive less trustworthy and with weak integrity. The citizen confidence in the institutions of the Courts and the Prosecution in Kosovo has been consistently in decline, and this is concerning. Citizens have higher confidence in the public institutions from the central level, especially when compared to the previous year (2020), however, the skepticism towards these institutions generally prevails.

Abstract:
Noting that few studies to date have investigated the determinants of social cohesion in a comprehensive and systematic manner, this paper examines the macro-level determinants of social cohesion using a panel of up to 92 developing and developed countries for the period 1990–2020. Employing the system GMM dynamic panel data estimator, which addresses endogeneity concerns by means of internal instruments, I find that the levels of education, government size, globalisation, and economic development have significantly positive effects on most dimensions of a country’s social cohesion. In contrast, inflation, corruption and income inequality are detrimental to social cohesion.

Uganda’s legislature is made up of 556 members of Parliament (MPs) who are meant to represent and serve their constituents and oversee the government’s actions. Since President Yoweri Museveni and the National Resistance Movement (NRM) party came to power in 1986 and appointed all members of Parliament, the country’s legislature has changed in several important ways (Kasfir & Twebaze, 2009). First, today all MPs are either directly elected via a first-past-the-post system or indirectly elected via special electoral colleges. Second, the number of parliamentarians has almost doubled over 25 years, from 295 in the 6th Parliament (1996-2001) to 556 in the current 11th Parliament (Inter-Parliamentary Union, 1996; Parliament of Uganda, 2022).1 This drastic increase can be attributed to the continued creation of new constituencies and the allocation of parliamentary seats for special-interest groups. Proponents of this development say it reflects citizens’ demands, but critics describe it as part of a political strategy to protect and grow the ruling party’s seat share in Parliament by increasing the number of constituencies in NRM strongholds (Nakatudde, 2020; Tumushabe & Gariyo, 2009). This debate has now entered a new phase with the recent ruling by the country’s Constitutional Court that Parliament and the Electoral Commission violated articles 51 and 63 of the Constitution by creating new constituencies that do not meet the population quota, based on data from the 2002 and 2014 census counts. The upshot of this ruling are proposals to downsize Uganda’s Parliament and redraw constituency boundaries (Barigaba, 2022). Third, the operating costs of the growing Parliament (MP and staff salaries, allowances, etc.) have increased drastically over the past two decades. Today Ugandan MPs’ salaries (35 million Uganda shillings, or about USD 9,700, per month) surpass those of most MPs elsewhere in Africa and in the European Union (BusinessTech, 2017; Olukya, 2021; Tumushabe & Gariyo, 2009). The cost of running Uganda’s 11th Parliament was expected to increase by more than 50 billion Ugandan shillings (USD 14.1 million), a substantial increase compared to the previous Parliament (Mufumba, 2021). Fourth, the share of MPs who return to Parliament after their first term in office continues to decrease. While about 50% of MPs did not return for a second term in the 6th (1996-2001) and 7th (2001-2006) Parliaments, this rate has increased to 53% (2006-2011), 55% (2011-2016), and 58% (2016-2021) in subsequent Parliaments. Most recently, of the 457 MPs in the 10th Parliament, 319 were not voted back to the 11th Parliament (2021-2026), while 31 did not contest or chose to run for other offices, and only 107 MPs returned (Kasfir & Twebaze, 2009; Forum for Women in Democracy, 2016; Independent, 2021). How do these changes affect 1) how citizens relate to their elected representatives and 2) how MPs address the needs of ordinary citizens? More broadly, are citizens being served by their MPs? To answer these questions, this policy paper begins by clarifying the foundations of the citizen-MP relationship and outlining the four key roles that MPs are generally expected to fulfil. The subsequent sections assess their performance in these roles against citizen expectations and other indicators. We find that Ugandans are becoming increasingly aware of their role in holding their MPs accountable. Most citizens are dissatisfied with how their MPs are doing their jobs, perceive them as corrupt, and say MPs don’t listen to constituents’ concerns. Residents of the Central region and Kampala are particularly critical of their MPs’ performance, probably due at least in part to high constituent-to-MP ratios in those areas. Citizens’ assessments of MP performance are associated with MPs’ perceived responsiveness and corruption as well as whether citizens have had contact with their MPs. In contrast, citizens’ demographic characteristics and views about democracy do not seem to drive their views of their elected representatives. There are two clear policy implications of these findings. First, at the institutional level, it is important to even out the citizen-to-MP ratios across the country. This is in line with the recent constitutional court ruling to base the creation of constituencies on census data. The second policy implication of our findings is that MPs have it in their own hands to change how citizens view their performance by improving on how they engage with them.

The aim of the bipartisan and international CSIS Ukraine Economic Reconstruction Commission is to produce a policy framework that will help attract private sector investments to support Ukraine’s future economic reconstruction. To support the commission, CSIS will convene a series of working groups to examine a range of issue-specific areas that are critical for reconstruction and modernization of the Ukrainian economy, including in agriculture, energy, and transportation and logistics, as well as addressing the impact of corruption on private sector investment. Ukraine experienced significant human and economic losses in the first six months of Russia’s unprovoked invasion. In July 2022, the Ukrainian government estimated the cost of recovery at $750 billion. That figure continues to grow due to ongoing missile strikes and artillery shelling, population displacement, and disruptions of exports. Given the scale of Ukraine’s losses, private sector investment will be critical to the country’s recovery and transformation. But concerns about corruption threaten the flow of much-needed funds. Ukraine has undertaken significant anti-corruption reforms in recent years, but it will need to show additional progress to maximize the potential for foreign investment.

Too often viewed as a monolithic state, Nigeria has complex subnational governance systems that can have outsized impacts on its trajectory. The state is covered with a vibrant but frayed political quilt, consisting of three layers: the federal government in Abuja, thirty-six state governments, and 774 local governments. Frequently overlooked, Nigeria’s local governments are disproportionately important; if they functioned well, they would be best positioned to meet people’s basic needs and to build their resilience to cope with everyday challenges. Matthew T. Page Matthew T. Page is a nonresident scholar at the Carnegie Endowment for International Peace. In reality, however, “no local government [in Nigeria] works for the people.”1 Instead, “every household is its own local government,” sourcing its basic needs—water, electricity, education, and healthcare—however it can.2 Exhausted by local government kleptocracy—a system in which those who govern steal from the governed—Nigerians understand that they must fend for themselves. While local government corruption is a global problem not unique to Nigeria, it is nevertheless crucial to address. It fuels democratic backsliding, communal conflict, and poverty. By hurting governance outcomes at the subnational level, local government corruption is quietly hobbling Nigeria, Africa’s largest economy and most populous nation.

37. Amidst Disinformation and Geopolitical Rivalry, Bulgaria Returns to the Polls July 11th

In the opinion surveys leading up to the elections, the same three biggest parties as in April enjoy support somewhere between 16 and 23 percent each, with another three-four trailing far behind and one hovering just at the 4 percent threshold. Few observers believe that the outcome will differ much from that produced on April 4th, which distributed 240 parliamentary seats among six parties. Ostensibly, the main problem in current Bulgarian politics arises from the unnecessarily sharp disagreements and mutual recriminations among the leaderships of the three main parties competing for power, aggravated during electoral campaigns. When the results were in, each of the three parties decided to reject cooperation with the other two and thereby precluded the establishment of a government tolerated by the parliamentary majority. The two top contenders are Boyko Borisov’s center-right GERB party, which has ruled the country almost uninterruptedly since it garnered 40 per cent of the popular vote in mid-2009, and There Is Such a People (Ima takav narod or ITN), run by TV personality Slavi Trifonov. The electoral campaigns ahead of either poll have largely revolved around Trifonov’s sweeping accusations of corruption directed at Borisov and his party, with the ongoing pandemic and the country’s weak economic performance featuring as issues more in the periphery. The corruption charges were also directed at the third frontrunner, the Bulgarian Socialist Party (BSP) with roots in the old communist elite. After Trifonov’s ITN party had reiterated that it would under no circumstances work with the BSP, two of the smaller parties with anti-corruption platforms similarly refused even initial consultations. From that point on the BSP was out of options as well. At a deeper level Bulgaria’s troubles stem from being a relatively small country with the lowest GDP per capita in the European Union (EU), frequently exposed to cross-pressures from Brussels, Moscow, Ankara, Washington DC and Berlin. This especially applies to the energy sector, where the country’s geographic location in the corner of southeastern Europe makes it a significant player. While the EU and NATO have repeatedly urged Sofia to align with collective approaches designed to reduce the continent’s reliance on individual providers, Russian energy corporations have skillfully utilized regional relationships and ties to Bulgaria’s political class to assertively negotiate terms that above all are favorable to Moscow. Germany, a sponsor of the Nord Stream I-II pipelines, has not been in a position to object.

In January 2020, Russian President Vladimir Putin proposed a set of constitutional amendments, aiming to secure the continuity of his power in the years to come. At the same time, the amendments allowed ideological visions on national identity to be inscribed in the Constitution. Since summer 2020, the Constitution has enhanced the symbolic status of the Russian language, which is now not only the state language but also the language of those who speak it (i.e. of “ethnic” Russians or “Russian-speakers”), implicitly referred to as the state-founding people. These provisions, together with support for compatriots abroad, not only continue the turn observable since the 2010s in Russia’s nation-building from a civic vision towards an ethnic vision of nation, but also challenge the existing interpretations of state borders. The provisions on safeguarding the “historical truth” and establishing a single framework for education hinder the republics from pursuing their identity policies. This Working Paper argues that the amendments both adjust the earlier changes and signal new ones in the official discourse and nationalities policy.

The country is home to key strategic interests for the EU, which does not want another failed state on the Mediterranean. France has made an effort to resolve the crisis by negotiating with the political elite – but Lebanon’s leaders will never engage in genuine reform. The Lebanese people are already self-organising to fill the gaps in public service provision left by the government. The EU and other international bodies are right to withhold funding for high-level state institutions until real reform takes place. Political, business, and cultural elites from around the world have a strong affinity for the United Kingdom (UK) education system. Nowhere is this truer than in West Africa, where some families in Nigeria and Ghana have a long tradition of sending their children to private boarding schools and universities in the UK. These institutions are especially popular destinations for the offspring of prominent politically exposed persons (PEPs) from the region. Immigration officials, admissions staff, and UK law enforcement are not likely to scrutinize the conditions under which the children of PEPs enroll in British schools, even though the PEPs themselves may have modest legitimate earnings and opaque asset profiles that in other circumstances would raise serious financial concerns. This relative lack of review has allowed some West African PEPs to channel unexplained wealth into the UK education sector. It is not easy to estimate the overall value of this flow, yet it likely exceeds £30 million annually.1 Most of these funds emanate from Nigeria and, to a lesser extent, Ghana; compared with these two countries, only a handful of students from elsewhere in West Africa seek an education in British schools. Tackling this small but significant illicit financial flow should be a priority for UK policymakers. In doing so, they would be helping to realize the UK’s global anticorruption objectives, advance its International Education Strategy, and close a troublesome anti–money laundering (AML) loophole. Failing to do so would exacerbate existing corruption challenges both at home and abroad and increase the UK education sector’s reputational liabilities.

Assessed for the first time, Lebanon’s governance of its nascent oil and gas sector scored 53 out of 100 points in the 2021 Resource Governance Index. While Lebanon is not yet an oil and gas producer, its government has begun to establish an institutional framework to govern the sector before production begins. Lebanon received a “satisfactory” score of 73 points in terms of its ability to realize value from its sector according to the RGI, with the Lebanese Petroleum Administration (LPA) displaying signs of best practice in terms of extractive sector transparency. Nonetheless, “weak” revenue management and a “poor” enabling environment are causes for concern for the future of Lebanon’s resource governance.

This study aims to assess the effects of corruption on Nigerian enterprises performance using data from the World Bank's Enterprises Survey, (Panel Data) for the years 2007, 2009, 2014. The Pooled Regression Model was applied. The corruption measured by six indicators divided into two groups, graft incidence and perceived need to make bribe payments. Graft incidence measures enterprises experienced request for a bribe payment across five types of applications, namely (1) an electrical connection, (2) water connection, (3) phone connection, (4) construction-related permit, and (5) total annual informal payment to public officials. While the perceived need to make bribe payments based on the answer to the question: (6) It is said that establishments are sometimes required to give gifts to public officials to ‘get things done’. The study found that the enterprises experienced a statistically insignificant bribe payment for the water connection and construction-related permit are statistically insignificant. Meanwhile, the level of firms expected to give gifts to public officers "to get things done", especially related to the sale and purchase of fixed assets significant and positively affect the enterprises' performance. As for the total payments to the public officers is significant and has negative effects, which indicates the medium or long terms impacts. This may be explained by the fact that developing economies are characterized by formal institutional flaws such as ineffective public administration and weak rule of law. It can also be explained by the theory of transaction cost, which states that the high transaction cost leads to a decrease in profits and thus poor performance. Unlike other studies, this study indicates that corruption represents an obstacle to Nigerian enterprises’ performance. The argument is that public authorities should move away from increasing the costs of corruption by improving the performance of public officials and implementing standards of transparency. Entrepreneurs also must search for alternatives to avoid paying bribes, such as leasing financing and so on.

Corruption in the extractive industries represents one of the main obstacles to ensuring that natural resources contribute to sustainable development. The heightened corruption risks across the sector are well documented, with many of the most prominent global corruption cases in recent years involving actors in oil, gas and mining. High-profile corruption scandals have occurred in several EITI countries. In Colombia, a former EITI supporting company has faced investigations over alleged illegal political campaign financing. Two large oil companies and their executives face criminal trial in Italy over a controversial oil deal in Nigeria. In Iraq, a “fixer” company bribed officials to help its clients secure oil industry contracts. EITI reports are silent on these and many other alleged cases of corruption. This has raised critical questions, particularly among civil society actors and academics, about the relevance of EITI in addressing the sector’s most pressing challenges. Although EITI reports rarely speak directly about corruption, they are nevertheless an important resource for anticorruption actors. As the EITI considers how it can more effectively play a role in addressing corruption, the authors of this report aim to shed light on how EITI’s current reporting can help oversight actors understand and address corruption risks. The authors identify best practices in how EITI countries disclose corruption-related information, highlighting the strengths and weaknesses of the initiative and providing insights that can help EITI maximize its relevance to future anticorruption efforts. Based on a review of EITI documents from 17 countries, the authors identify trends in how reporting presents corruption-related information.

The Biden administration has a historic opportunity to unify U.S. domestic and foreign policy through an aggressive mission to combat corruption and kleptocracy. Middle-class Americans are frustrated by perceptions of corruption at home, while authoritarian regimes are organized as oligarchies weaponizing corruption around the world. While these trends have fueled passionate discourse in recent years, the Biden administration should seek a legacy of achieving actual results by institutionalizing anti-corruption reforms throughout U.S. and international financial, diplomatic, and legal systems, including a formidable raft of new policies and commitments to be showcased at the Summit for Democracy, which Biden has pledged to host in his first year in office. The administration should start with powerful regulatory action to root dirty money out of the U.S. financial system. Within the first 100 days of this anti-corruption reform initiative, Treasury should take ten initial steps, the two strongest being finalizing a 2015 proposal to make private equity and hedge funds identify their customers and publishing the first-ever National Corruption Risk Assessment. After the first 100 days but within the first year of this effort, Treasury should take another seven steps, such as regulating more enablers and writing strong rules for the new beneficial ownership registry. The White House should also work together with Congress to eliminate dark money from politics and work with the Justice Department (DOJ) to deliver and communicate tangible policy and enforcement outcomes that most Americans would see as truly “draining the swamp.” The White House, in consultation with Treasury and partners at the Organization for Economic Cooperation and Development (OECD) and the Financial Action Task Force (FATF), should push for a landmark international agreement to end offshore financial secrecy, including commitments around public beneficial ownership registries, automatic exchange of tax information, a cross-border payments database, and steps toward a global asset registry, as well as sanctions to motivate cooperation with all the above. The United States Agency for International Development (USAID) should scale up support for anti-corruption activists. The Department of State should integrate an anti-corruption action fund into pre-existing efforts, recommit to international anti-corruption initiatives that languished under Trump, and strengthen internal coordination and capacity-building efforts. Law enforcement should pressure kleptocrats by publicizing confiscated assets and banned individuals while reforming global mechanisms suffering from abuse (e.g., EB-5 golden visas, mutual legal assistance treaties, Interpol, etc.). The ambitious 100-point anti-corruption agenda described in this report is achievable, but only if the White House supports it as a top policy priority, including the commitment of resources needed to dedicate a small team to coordinate the work, which could take the form of either a standalone directorate at the National Security Council (NSC) or a task force of staffers drawn from several White House components. To energize Treasury, State, USAID, DOJ, and other departments and agencies at a high level, this team should be run by a White House senior director dedicated exclusively to anti-corruption and a designated senior leader such as the Vice President, coordinating efforts across the areas of democracy and human rights (DHR), international economics (Intecon), the Domestic Policy Council (DPC), and other White House offices. This White House anti-corruption team should be staffed with at least three directors, each dedicated to one priority area: building a global coalition, rooting out dirty money, and showing compelling results to the American people.

In the late 1960s, the Mexican government launched a series of counternarcotics campaigns characterized by the militarization of drug production zones, particularly in the northwestern region—the so-called Golden Triangle, epicenter of both production and trafficking of marijuana and opium poppy since the 1930s. Operations Canador (1969–1975) and Trizo (1976) served as a laboratory for methods to curb drug production, ranging from harassment of drug growers to the aerial defoliation of illicit crops. Operation Condor (1977–1988) combined and enhanced these strategies, wreaking havoc on communities of alleged drug growers, but without entirely disrupting the drug industry. This paper explores the role of the US government in the militarization of Mexico’s anti-drug policy, underscoring how the ruling party (the Institutional Revolutionary Party, PRI) took advantage of this shift to tackle domestic issues and reassert its hegemony. I argue that Operation Condor functioned as a counterinsurgency campaign oriented to thwart both social and armed movements, eliminate competitors in the narcotics market, and reorganize the drug industry to protect successful drug lords. Operation Condor also caused the decentralization of the drug industry from the northwest and created a new clientelistic pact between drug lords and national security agencies, such as the Federal Security Directorate (DFS), the Office of the Attorney General of Mexico–Federal Judicial Police (PGR-PJF), and the Secretariat of National Defense (SEDENA), which benefited from drug proceeds. Finally, the de facto state of siege imposed in the Golden Triangle produced thousands of victims of harassment, torture, rape, murder, forced-disappearance, and displacement; massive human rights abuses that authorities either concealed or denied.

The first section introduces the level of trust expressed by respondents on the relevant institutions (justice, security and municipal institutions), as well as the direct contact of the surveyed respondents with these institutions during 2018. Similar to previous years, security institutions are leading when it comes to public trust when compared to other institutions analysed in this special edition. The second section of the report interprets key security threats and risks in Kosovo. Given that corruption has been ranked as the highest problem to Kosovo’s national security, this section is focused on views of respondents towards corruption in the relevant institutions. Apart from general interpretation of data on corruption in Courts, Prosecution, Kosovo Police and Municipalities, the report offers cross-tabulated data analysis based on regions, rural/urban areas, gender balance, and ethnic composition of respondents for all targeted institutions. While, the third or final section of the report provides a detailed interpretation of open-ended and closed-ended questions of the 2018 survey of Kosovo Security Barometer on main issues harming police integrity in Kosovo. Accordingly, results presenting opinions of respondents on corruption within sectors of the Kosovo Police mirror a better understanding on what are the most and the least corrupted police sectors in Kosovo. Furthermore, data analysis through cross-tabulated results (based on regions, areas, gender balance, and ethnic background) provides an exhaustive elaboration of respondents’ attitudes towards police corruption in Kosovo. Given that the Kosovo Security Barometer’s survey was conducted in the second half of 2018 (September-October 2018), thus it does not reflect some of the developments that have occurred from November 2018 to March 2019.

Abstract:
As the world continues to recover from the devastating fallout of the COVID-19 pandemic, navigating the harms of misinformation and disinformation remain at the forefront of global conversations on paving the path forward. Preventing the dissemination of false information—particularly during a time where the ways in which we engage with information environments have fundamentally changed—is increasingly complex. Social media platforms have enabled users to not only engage with media but become distributors of it themselves. When coupled with bad actors, limited repercussions, and poor content regulation, social networks are easily weaponized. At all scales of governance misinformation and disinformation campaigns pose a multidimensional threat. In Myanmar and China, disinformation campaigns were leveraged to target minority groups, while in Central and Eastern Europe, they serve as the cornerstone of destabilizing operations between adversarial states. In yet another facet, countries like Turkey, China, Russia, and Iran have embraced digital authoritarianism and restrict policies on internet accessibility under the pretext of stemming the spread of “fake news.” This year’s issue seeks to shed light on the nature of these evolving threats from a variety of innovative and understudied perspectives. This issue explores the causes and effects of the spread of misinformation and disinformation throughout different parts of the world and will be timely for years to come given the ever-increasing role and breadth of new technologies infiltrating people’s everyday lives.

Abstract:
The professionalization of the anticorruption field has produced a cadre of capital-based NGOs with the technical expertise to be formidable government watchdogs. But at what cost? Corruption-fueled political change is occurring at a historic rate—but is not necessarily producing the desired systemic reforms. There are many reasons for this, but one is the dramatic dissipation of public momentum after a transition. In countries like Armenia, the surge in civic participation that generated 2018’s Velvet Revolution largely evaporated after the new government assumed power. That sort of civic demobilization makes it difficult for government reformers, facing stubbornly entrenched interests, to enact a transformative agenda. The dynamics in Armenia reflect a trend across the anticorruption landscape, which is also echoed in other sectors. As the field has become more professionalized, anticorruption nongovernment organizations (NGOs) have developed the legal and technical expertise to serve as excellent counterparts/watchdogs for government. Yet this strength can also be a hurdle when it comes to building credibility with the everyday people they seek to represent. The result is a disconnect between elite and grassroots actors, which is problematic at multiple levels.

65. Dubai Property: An Oasis for Nigeria’s Corrupt Political Elites

For politically exposed persons (PEPs) with ill-gotten wealth, Dubai in the United Arab Emirates (UAE) is an alluring destination for investing their gains. Although certainly not the only place to stash money, Dubai—dubbed the commercial capital of the Middle East—exercises minimal oversight and has few legal or logistical obstacles to transferring large amounts of cash or purchasing property. PEPs, defined as individuals who are or have been entrusted with a prominent public function, are at higher risk of involvement in unlawful activity due to their positions of influence and access to assets.1 In some cases, government officials and associates who succumb to the temptation become front-page news, but in many other cases, their activities go undetected or uncorroborated, despite the efforts of local authorities and intergovernmental bodies such as the Financial Action Task Force. As a result, billions of dollars are siphoned away to the detriment of both prosperous and struggling economies and societies. The case of Nigeria—home to Africa’s largest economy and the world’s seventh most populous country—offers valuable insights into this phenomenon.2 For Nigerian PEPs in particular, Dubai is an accessible oasis far away from the political drama in their capital, Abuja, or the hustle and bustle of their biggest city, Lagos. But a dearth of specific information about Nigerian PEPs’ property in Dubai has long precluded a deeper analysis of the share of illicit financial outflows from Nigeria; that is, until 2016, when the Center for Advanced Defense Studies (now known as C4ADS) acquired the data of a private database of Dubai real estate information (dubbed the “Sandcastles” data). At least 800 properties were found to have links to Nigerian PEPs or their family members, associates, and suspected proxies. With such information and continued monitoring, Nigerian and Emirati authorities and national and international actors could ramp up their scrutiny on high-end property transactions involving Nigerian elites to ensure that these purchases are not being made with pilfered public funds. The two countries could also deepen bilateral law enforcement cooperation by sharing information and assisting investigations more responsively and routinely. For their part, Western governments, the United Nations, and other international organizations could press the UAE to make its property and corporate records more transparent.

Despite welcoming signs from the recent EU-Ukraine Summit, the underlying problems still loom large in this special relationship. The EU is running out of tools to incentivize more difficult reforms, and Ukraine is running out of arguments why it is unable to tackle corruption, oligarchs, and consolidate rule of law. With growing geopolitical turmoil in the region, a further strengthening of this partnership should be a priority. The risk of an increasing anti-Western backlash in Ukraine should not be underestimated.

La corrupción es un delito que genera afectaciones políticas, específicamente a la construcción del Estado y la democracia. Es decir, restringe las habilidades de las instituciones para lograr el objetivo de promover el bienestar general a través de la creación de poderes secretos que entorpecen la idea de la democracia como poder público que se realiza ante el público. Así, la corrupción política crea un poder secreto, controlado por funcionarios públicos y políticos profesionales que favorecen diversas redes criminales asociadas a otros delitos y afectan las instituciones y el principio de publicidad en la democracia. El objetivo de la investigación es analizar la corrupción política en Colombia entre 2013 y 2018 desde la perspectiva del Crimen Organizado Transnacional (COT). Para esto se considera que para abordar la corrupción política como delito transnacional es necesario superar el fenómeno de narcotización del delito y reconocer que la corrupción política es también un delito relevante, que funciona en red y que se asocia con otras dinámicas criminales para buscar beneficios económicos del Estado o afectarlo. El enfoque metodológico fue cualitativo y se utilizó el método fenomenológico-hermenéutico en el análisis de la información histórica recopilada desde el siglo XVI que sirvió de contexto para establecer la relación de la corrupción con otros delitos en el país y de los diferentes casos de corrupción analizados en el período de estudio. Se aclara que solo se tienen en cuenta aquellos casos que se ajustan al análisis de corrupción transnacional por los vínculos con otras redes. Se evidencia que entre 2013 y 2018 hubo casos de corrupción política con nexos criminales asociados al narcotráfico, el lavado de activos, la prostitución, entre otros. No obstante, varios de estos hechos no parecen tener la misma relevancia informativa que los típicos casos de soborno, financiación ilegal de campañas o carteles de contratación. Esto se entiende como una oportunidad para seguir profundizando en este tipo de investigaciones.

Desde los años ochenta el Perú es una pieza clave en el escenario internacional del tráfico de drogas. Segundo productor de cocaína del mundo y uno de los países donde se cultiva el principal insumo, la hoja de coca, el puerto de El Callao, siendo uno de los principales puertos de América Latina por su volumen, se presume que es desde donde salen importantes cargas de esa droga. La interceptación de las comunicaciones en 2018 para investigar el crimen organizado violento que se desarrollaba en esa Provincia, desveló una red de jueces, fiscales, congresistas, empresarios, que colaboraban con los narcotraficantes favoreciéndoles con la impunidad. No es el primer intento de captura del Estado peruano por el narcotráfico. En la década de los noventa, el gobierno de Fujimori-Montesinos, utilizó el dinero del narcotráfico –entre otros- para sobornar a las más altas autoridades del país: jefes militares, Corte Suprema, Fiscal de la Nación, medios de comunicación, empresarios, todos afines al gobierno. Los “narcoindultos” del segundo gobierno de Alan García son otro síntoma de la gravedad de la colaboración de autoridades de las más altas esferas del Estado con los poderosos narcotraficantes. Se pone en evidencia la “doble moral” de la Política Criminal peruana contra el tráfico internacional de drogas, fuerte para los débiles y débil para los fuertes: penas altas para los pequeños traficantes e impunidad para los que se encuentran en el vértice de las organizaciones criminales. Además, resulta preocupante la enorme capacidad corruptora del dinero proveniente del narcotráfico (blanqueo de dinero) para capturar miembros de los poderes del Estado: Ejecutivo, Legislativo y Judicial. El caso “cuellos blanco del puerto” es una muestra empírica de la intersección de la corrupción judicial –y sus adláteres- dentro del Estado peruano y las organizaciones del crimen organizado. Para conjurar estas alianzas, es preciso poner el acento en la punición de los delincuentes de cuello blanco del narcotráfico y sus colaboradores: abogados, jueces, fiscales, etc., que utilizan su profesión como tapadera para enriquecerse personalmente, en desmedro del bien común.

Special interest influence via lobbying is increasingly controversial and legislative efforts to deal with this issue have centered on the principle of transparency. In this paper we evaluate the effectiveness of the current regulatory framework provided by the US Lobbying Disclosure Act (LDA). Specifically, we study the role of ex-Congressional officials who join US lobbying firms in positions that could be related to lobbying activity but without officially registering as lobbyists themselves. We find that firm lobbying revenues increase significantly when these potential ‘shadow lobbyists’ join, with effects in the range of 10-20%. This shadow lobbyist revenue effect is comparable to the effect of a registered lobbyist at the median of the industry skill distribution. As such, it is challenging to reconcile the measured shadow lobbyist effect with the 20% working time threshold for registering as a lobbyist. Based on our estimates, the contribution of unregistered ex-Congressional officials could explain 4.9% of the increase in sectoral revenues, compared to 24.0% for the group of registered officials.

Abstract:
The debate regarding the influence of corruption on economic growth is increasing. Therefore, this study examines the impacts of corruption on economic growth of developing South Asian Economies between 2002-2017 period. The study uses fixed effects, random effects and robust least square estimators for the empirical estimation. The outcomes show that in developing South Asian countries corruption is working like grease and enhancing the economic growth. Nevertheless, the study based on the theoretical and empirical literature recommends these countries to formulate policies to lower corruption as it harms the institutional quality, adversely affects the investment decisions of the firms, system of meritocracy, and is considered globally as a moral decay of the society. These all in turn, in the long run adversely affects the economic growth.

Large oil, gas and mining projects are usually associated with a few big names such as Shell, Exxon, Rio Tinto, Gazprom and Codelco. These are rights holders—companies that receive licenses from host governments to extract resources. Typically, however, lower-profile companies do much of the work to take natural resources out of the ground. These are suppliers—companies that provide the goods and services that make extraction happen. They range in size from multibillion-dollar international conglomerates to specialized or local firms that may only have a handful of employees. This report makes the case for greater oversight of extractive industry suppliers. It explains the economic significance of extractive industry suppliers and identifies the main stakeholders involved in supplier governance. It considers policy areas where the impacts of poor supplier governance play out and reviews how governments, rights holders, state-owned enterprises (SOEs) and suppliers are beginning to share information on the economic impacts of suppliers, how these disclosures feature in global transparency and reporting initiatives and what more can be done.

72. Holding to Account: How Publishing Facts about Foreign Corruption Creates Accountability

The complex, secretive nature of foreign corruption calls for a collaborative, all-hands-on-deck approach. Corrupt actors go to great lengths to hide their wrongdoing, using layers of legal entities, transactions, secrecy jurisdictions and middlemen. No one response can detect and prevent every bad act, and different anticorruption actors have their own unique interests, mandates and abilities. In many cases, they may struggle even to learn the facts of what went wrong. Prosecuting a corruption crime generates reams of valuable information. This can include the names of bribe takers and payers; the industries, countries and public institutions involved; how the proceeds of crime changed hands; and who facilitated or turned a blind eye. Who should get to see this information? Thought leaders on anticorruption, from Transparency International (TI) to the Organization for Economic Cooperation and Development’s Working Group on Bribery (OECD WGB), have long endorsed greater transparency in foreign corruption cases. They argue, for example, that access to information raises awareness, gives guidance to anticorruption practitioners, encourages cooperation with prosecutors and boosts confidence in law enforcement. Conversely, opacity in corruption cases can weaken the deterrent value of prosecutions, open doors for prosecutorial misconduct and thwart efforts to make victims whole. These concerns are particularly keen in cases that settle via tools like deferred prosecution agreements (DPAs) or plea bargains. Many governments share evidence from corruption cases confidentially, through formal legal instruments and close working relationships. But how does public disclosure of facts from corruption cases, whether by courts or other law enforcement bodies, aid the broader fight against corruption? Put differently: At a time when enforcement of anticorruption laws remains low in many countries, could more transparency help anticorruption efforts by regulators, companies, the media, civil society and others? To answer this question, the authors of this briefing analyzed materials from foreign corruption cases that have arisen since the inception of laws banning foreign bribery. During the past four years, they also conducted over two dozen interviews with experts government, the private sector, civil society and the press. From this work, they found instances in which other anticorruption actors used published facts from court cases to do their jobs more effectively. Although they undertook this research as part of the Natural Resource Governance Institute’s (NRGI’s) programming aimed at reducing corruption risks in the oil, gas and mining sectors, they did not limit themselves to cases in the extractive industries. Accordingly, their findings and recommendations apply broadly to corruption in other sectors.

The global transition from fossil fuel-powered vehicles to electric vehicles (EVs) will require the production of hundreds of millions of batteries. The need for such a massive deployment raises questions from the general public and critics alike about the sustainability of the battery supply chain, from mining impacts to vehicle carbon emissions. Growing demand for the mineral inputs for battery production can provide an opportunity for mineral-rich countries to generate fiscal revenues and other economic opportunities. But where extraction takes place in countries with weak governance, the benefits expected by citizens and leaders may not materialize; in some cases extraction might even exacerbate corruption, human rights abuses and environmental risks. Many EV proponents and suppliers are aware that supply chain governance problems pose a challenge to the evolution of the EV industry, but outstanding questions remain about how these challenges materialize. This brief, jointly published by UC Berkeley School of Law’s Center for Law, Energy & the Environment (CLEE) and the Natural Resource Governance Institute (NRGI) provides basic information on the EV battery supply chain and key battery minerals, such as cobalt and lithium, and addresses the following questions: What does the supply chain for EV batteries comprise? How do carbon emissions from EVs compare to traditional internal combustion engine (ICE) vehicles? What are the most significant challenges in managing the mineral extraction necessary for the EV supply chain, and what sustainability and human rights initiatives apply?

In 2020, Lebanon should be celebrating its centenary. It is not. Instead, it is close to terminal collapse as a polity, an economy, and even as a society. Lebanon is under Iranian occupation, although ascertaining this condition may demand some attentive consideration from the uninitiated. Iran’s proponents assess it as a confirmation of the “Axis of Resistance” against imperialism and Zionism; its detractors ascribe it to a deliberate plan of Iranian expansion across the region. However, the Iranian occupation of Lebanon may be rooted in Lebanon’s own tumultuous history rather than in Tehran’s designs. Iran in Lebanon may be more an artifact of history than a product of strategy. In fact, the outcome of Lebanon’s present course may not yield Iran any tangible advantage. And it certainly seems to be on the verge of destroying Lebanon.

The explosion in the Port of Beirut on August 4 caused domestic reverberations throughout Lebanon. With close to 200 people killed, over 6,000 wounded and damages estimated at over $15 billion, the public outrage toward the ruling elite was immediate and damning (Daily Sabah, August 12). The political classes were already subjected to heavy criticism for an ongoing economic crisis that has left 55 percent of the population living below the poverty line, while remnants of the October 2019 protests against political corruption remain active (Middle East Monitor, August 20). In the aftermath of the explosion, public ire accelerated swiftly. No group has come under more scrutiny, or been blamed more directly, than Hezbollah.

Unless Washington and its allies respond to the protestors’ legitimate demands for reform, the group will survive through measures such as expanding its smuggling activity, promoting its financial institutions, and selectively scapegoating corrupt politicians. When IMF officials visited Lebanon late last month amid its accelerating economic freefall, many wondered whether these developments might alter the behavior of Hezbollah, the designated terrorist group that has a deep financial stake in the country’s public and private sectors. During a previous funding crisis—the increase in U.S. sanctions against the group’s chief underwriter, Iran—the “Party of God” and its foreign sponsors formulated a new strategy to evade these measures and create alternative sources of funding. Such sources allowed Hezbollah to make further inroads into government agencies following the 2018 parliamentary elections. For example, the group’s leaders insisted on controlling the Health Ministry, which commands Lebanon’s fourth-largest budget at $338 million per year; they also gained more access to the Ministry of Public Works and Transport, the Agriculture Ministry, and the Ministry of Energy and Water, whose assistance was used to fund their affiliated projects and businesses. That worked until Lebanon’s own economy began its current nosedive. Unemployment has hit a record high of 40 percent, and the lira has slumped by about 60 percent on the parallel market, hiking inflation. Officially pegged to the dollar, the currency has plummeted 40 percent on the black market as local banks ration dollars necessary for imports of food, medicine, and other essential goods. Meanwhile, Lebanon has one of the highest debt-to-GDP ratios in the world (over 150 percent) and may not be able to pay $1.2 billion in Eurobonds this month. As with the Iran sanctions, however, Hezbollah has a strategy to survive this domestic pressure, at least in the near term.

The latest crackdown appears to have targeted senior defense and interior officials, spurring speculation that they are linked to previously detained princes rumored to be plotting a coup. On March 15, Saudi Arabia announced that 298 individuals have been arrested for bribery, embezzlement, wasting public funds, and other corruption offenses. Although none of the detainees has been named, they reportedly include high-ranking officers in the Defense and Interior Ministries, adding to rumors that recent royal crackdowns may be related to a planned coup.

79. Corruption Crossroads? Rising Perceptions of Graft Weaken Citizen Trust, Threaten Botswana’s Democratic Standing

Corruption is widely considered one of the greatest impediments to sustainable development in African countries (United Nations Economic Commission for Africa, 2016; Bratton & Gyimah-Boadi, 2016). Corruption hinders macro-economic growth by weakening governance structures and diluting the positive effects of investments. At the micro level, corruption can trap the poorest, who are least likely to have alternatives to state provision of services, in a downward spiral (Peiffer & Rose, 2014). Botswana has long been considered one of Africa’s least corrupt countries and top performers in democratic practice and good governance. But while Transparency International’s (2019) Corruption Perceptions Index continues to rank Botswana as best on the continent, other observers have questioned this reputation (Mogalakwe & Nyamnjoh, 2017; Good, 2017). Allegations have focused on, among other things, high-level corruption in military procurement contracts under former President Ian Khama, close ties between members of the ruling party and the agricultural sector, and charges that well-connected suspects are often cleared by the courts (Motlogelwa & Civillini, 2016; Konopo, 2017; Good, 2017; Norad, 2011; Sebudubudu 2014; Gasennelwe, 2018). Recent corruption scandals have reached the highest levels of government, including the alleged looting of the National Petroleum Fund (Kgalemang, 2019; Motshegwa, Mutonono, & Mikazhu, 2019), and are still before courts of law (Shuma, 2020). In this paper we use Afrobarometer survey data to explore citizens’ perceptions of corruption in Botswana. We find that far more people see corruption increasing than decreasing and that perceptions of corruption in the Presidency and Parliament have risen sharply over the past decade. Fewer Batswana approve of how the government is handling the anti-corruption fight, and while many believe ordinary people can help fight corruption, a majority say that people risk retaliation if they report corruption to the authorities. A correlation analysis suggests that perceptions of corruption, especially in the Presidency, are strongly associated with less popular trust in public institutions and less satisfaction with democracy.

Preventing Government Corruption in Crises, the fifth paper in the International Foundation for Electoral Systems’ (IFES) COVID-19 Briefing Series, looks closely at this question and offers guidance for democracy and governance practitioners, policymakers and supporters. Corruption undermines the efficiency and efficacy of government, which, in the short term, can derail the response to a public emergency. It also drives distrust in democratic institutions, including legislatures, executive agencies and courts. As a result, corruption by bad actors in public office – whether for personal or political gain – has the potential to damage the credibility and integrity of governments long after the immediate crisis has passed. The long-term ill effects of political corruption must not be ignored, given the potential for state capture and the entrenchment of incumbent regimes. This risk is especially concerning as many elections have been postponed and modified as a result of the health crisis, subverting the ultimate accountability measure for governments. The unprecedented volume of funds being deployed to address the COVID-19 crisis and bolster economies creates new opportunities for exploitation and undermining of accountability mechanisms in several key areas.

While their role is not always acknowledged directly, independent institutions that undergird the democratic process — anti-corruption agencies, human rights institutions, supreme audit institutions and election management bodies, among others — have important roles to play in responding to all of the challenges presented in this series. When functioning properly, they can ensure safe, secure and trustworthy elections; bolster government transparency and information integrity; protect political rights; provide checks on government; and ensure the continuation of democratic processes during a crisis. When they lack the independence, resources or accountability mechanisms to be effective, they may be unable to play this essential role, now or over the longer term of crisis recovery. While these independent institutions usually operate in complex and often politicized environments, by design, they have faced unique challenges during the pandemic that impact their autonomy and accountability.

The recent protests in Iraq and Lebanon are driven by the effects of inadequate governance, which itself is a result of years of corruption, nepotism, and the appropriation of public authority and resources for sectarian purposes and self-enrichment. The governance model of both countries – sectarian quasi-democracy – is increasingly proving to be a long-term dead end. Both countries stare into the abyss of public bankruptcy, crumbling social services, growing poverty levels, and the lingering threat of renewed violence. Yet, the Lebanese and Iraqi political elites are stubbornly refusing to make more than token concessions to the protesters’ demands. The reform protesters seek are ambitious due to the many mechanisms that have entrenched elite capture of public authority and budgets in both countries over the past decades. These include, in particular: (1) the deep institutionalization of consociationalism that prevents more radical reform; (2) the pervasiveness of public/private arrangements that political elites use to dominate socioeconomic interactions to their benefits; and (3) the steady courting by many domestic political parties of foreign alliances that sustain the sectarian status quo. Notwithstanding the roadblocks to reform thrown up by these three mechanisms, this paper argues that today’s mix of political and economic crises offers opportunities bring about change. This is because these crises starkly expose the deep failure and unsustainability of current governance and development mechanisms in Lebanon and Iraq. Faced with resilient, stick systems that feature many veto players, reform is inevitably bound to be a gradual, long-term process that slowly and painfully strengthens and changes political structures. Key ingredients of such a path are the capacity of civil society structures to influence and guide decision making, the extent to which the international community is ready to challenge the status quo via conditions and incentives for genuine reform, and the ability to protestors to keep pressing for and prioritizing domestic agendas despite geopolitical tensions.

For centuries, protests have been used to mobilize citizenry in efforts to bring about sweeping change in different parts of the world. Protestors have protested to convey their discontent, to demand a moral response, and to speak truth to power. In 2010, antigovernment protests in Egypt inspired similar uprisings in other Arab countries, which became known as the Arab Spring. This year, the killings of Ahmaud Arbery, Breonna Taylor, and George Floyd have led people in the US and across the world to march against racism and police brutality. Despite a global pandemic, thousands have taken to the streets to demand justice for Black lives, demonstrating that the principle of equality, a common moral good, is worth risking both health and life. “Human Rights: An Uprising,” the second issue of our twenty-first volume, sheds light not only on the right to protest itself, but the human rights that have inspired them. Mahmood Monshipouri explores the variations and similarities in contemporary protest while discussing the Black Lives Matter movement. Joudie Roure addresses gender-based violence and LGBTQI rights in Puerto Rico, especially the murder of trans women. Debra DeLaet explains the importance of soft law approaches in making progress toward the realization of gender-based human rights and LGBTQI rights. Randolph Persaud and Jackson Yoder apply the concept of homo sacer to examine differential rights within two key areas: migrants/refugees/asylum seekers in Europe and the effects of COVID-19 on African Americans in the US. Nicholas McMurry argues that the right to be heard is developing in human rights law as expounded in the practice of the UN treaty bodies. Kathleen Mahoney discusses Indigenous rights in Canada. Morten Andersen argues that an investigation of the relationship between corruption and human rights is best viewed as a framework of socially constructed norms, political power, and the complex interrelation of political, legal, economic, and social systems. Finally, David Johnson writes about the origins, causes, and contemporary implications of extrajudicial killings in the Philippines. This issue sheds light on the strata of protests and human rights. It further affirms the growing political salience of human rights and the power of social movements to overcome the tyranny of exclusion, greed, and special interests which have always undermined them.

An uprising of unprecedented scope has rocked Lebanon as the country’s economy tumbles deeper into recession. Poverty and unemployment could lead to violent unrest. Donors should put together an emergency package but condition further aid upon reforms to tackle corruption, a major grievance driving protest. What’s new? The impact of the COVID-19 pandemic on Lebanon’s economy, which was already slowly imploding, has brought it to the brink of total collapse. Since October 2019, popular protests have pushed for greater accountability from an elite that, having engorged itself, seems incapable of instituting critical reforms. Why does it matter? The accumulation of crises is driving ever greater numbers of Lebanese into absolute poverty. While the lockdown is gradually easing, the loss of jobs and purchasing power triggered new protests that are turning violent and may prefigure the disintegration of state capacity and institutions. What should be done? Lebanon will need emergency external assistance to ward off the worst social consequences of the crisis. Beyond that, external actors and donors seeking to help the country exit the crisis should focus on efforts geared at rooting out corruption and clientelism.

91. Truth, Accountability, and Asset Recovery: How Transitional Justice Can Fight Corruption

On March 2 and 3, 2020, two weeks before the World Health Organization (WHO) declared a COVID-19 global pandemic, transitional justice and anti-corruption policymakers, experts, and activists from the Gambia, Kenya, South Africa and Armenia met with their counterparts in Tunisia for a two-day conference entitled, “Truth, Accountability and Asset Recovery: How Transitional Justice Can Fight Corruption,” organized by ICTJ with the support of Tunisia’s National Anti-Corruption Commission (INLUCC) and the Government of the Federal Republic of Germany. This diverse group of leaders came together to share solutions to a common problem: How can countries emerging from dictatorship, war, or political transitions hold corrupt ex-rulers accountable, recover their ill-gotten assets, and ensure that those harmed the most by human rights violations and large-scale corruption can achieve justice, obtain reparations, and overcome marginalization? For many countries pursuing transitional justice, including those represented by participants in the conference, the health and economic impact of the pandemic has made it more urgent to find and design solutions that advance accountability for both human rights violations and corruption. In Kenya, for example, citizens questioned the government’s use of $12 million in COVID-19-related aid from the World Bank, “amid reports that the lockdown intended to curb the spread of the virus had worsened poverty, even forcing a mother to cook stones to make her eight children believe she was preparing food for them.” In Tunisia, INLUCC “identified 11 instances of suspected corruption and conflicts of interest” related to a government deal to acquire millions of facemasks. At the conference, participants brought up the role of the World Bank and the International Monetary Fund (IMF) in enabling corruption during dictatorship or in facilitating state capture through privatization. Ninety-seven human rights and anti-corruption groups have jointly reminded the IMF, which has offered loans to pandemic-hit countries even as it continues to set austerity as a condition, that “transparency and accountability are key to making sure the money the IMF is disbursing actually goes to protecting lives and livelihoods.” This report gives an overview of the conference and its five panel discussions. It presents the thematic questions posed in each panel and summarizes the panelists’ statements and the comments and questions from moderators, other panelists, and participants in the audience. By design, the premise of the conference was clear: The practice by mainly global South countries of including accountability for corruption in their transitional justice processes has settled the debate over whether accountability for corruption should be part of transitional justice. In 2008, the Kenya Truth, Justice and Reconciliation Commission began investigating land-grabbing, large-scale corruption, and violations of economic and social rights. Soon after the Arab Spring in 2011-2012, Tunisia took the most significant steps when it established the Truth and Dignity Commission (TDC) with a mandate that covered violent political repression as well as corruption under former President Ben Ali. In its recently released final report, the commission examines the extent of the corruption and how the development policies and austerity measures imposed by international financial institutions such as the World Bank and the IMF enabled it. In 2016, the post-dictatorship government in the Gambia created a truth commission to examine human rights violations as well as a separate commission of inquiry to investigate ex-dictator Yahya Jammeh’s corruption and identify his ill-gotten wealth. The latter commission is now considering using part of those assets to fund reparations. Although corruption was excluded from the mandate of South Africa’s Truth and Reconciliation Commission, activists in 2017 created the People’s Tribunal on Economic Crime that linked the continuity of post-apartheid corruption to the failure to address it in earlier transitional justice processes. In 2018, the South African government then created the Judicial Commission of Inquiry into Allegations of State Capture to investigate specific economic crimes during and after apartheid. After the 2018 revolution in Armenia that ended a decade of authoritarian rule in the post-Soviet state, the new government embarked on prosecutions for corruption and human rights violations and is now considering a truth commission that would examine specific cases of corruption and human rights violations since 1991. These processes informed the conference, and the panelists who were directly involved in them discussed the challenges, successes, and lessons learned. This report’s original intent was to highlight the most important lessons from these experiences and promote South-South exchanges on transitional justice and accountability for corruption. However, the unprecedented global pandemic during which the conference took place has given it another equally relevant purpose. As ICTJ pointed out in a recent special report on COVID-19, “The pandemic is bringing to the surface underlying inequalities, including the unequal access to health care.” With this in mind, the author hopes this report will also offer policymakers practical approaches to transitional justice that can help address those underlying inequalities, such as measures aimed at improving access to health care for the most vulnerable, and initiatives to use recovered ill-gotten assets to fund reparations for victims.

92. Dead at the Root: Systemic Dysfunction and the Failure of Reform in Lebanon

Lebanon is in crisis and its people are tired of decades of endemic corruption, mismanagement, and impunity and of moving from one disaster to the next without making any progress on long-awaited reforms. They have been left with a local currency that is rapidly declining in value, thus eroding their savings and livelihoods. The massive explosion in the capital on August 4, 2020, was only the latest tragedy, the result of decades of systemic dysfunction that perpetuates injustice for victims of all types of human rights violations in Lebanon and inflicts enduring harms on Lebanese society. During the 15-year civil war (1975–1990), more than 150,000 people died, 300,000 were injured or disabled, more than one million were displaced, and more than 17,000 went missing. Although the 1990 Ta’if Agreement effectively ended the armed conflict, it failed to address the human rights abuses committed during the war, a shortcoming that has also meant a failure to uphold victims’ rights. Rather than curbing sectarianism, one of the root causes of the war, the agreement strengthened it by establishing a system of power sharing among the different warring factions along sectarian lines. Today, nearly half of Lebanon’s population is living below the poverty line, with limited services and high economic insecurity. Since the war, the elite class in Lebanon has consistently blamed the country’s dysfunction on others, including neighboring countries and the international community, which have interfered in different ways in the politics and finances of the country. That narrative is no longer sufficient. It is clear that the problems Lebanon is facing today have deep-rooted causes that were never addressed at the end of the war. People will continue to find themselves victims of a corrupt and unjust system until that system is uprooted entirely, and a new, more just, equal, inclusive, and nonsectarian structure is set up in its place.

94. Continuity and Change in Iraq’s Sunni Politics: Sunni Arab Political Trends, Factions, and Personalities Since 2014

The year 2014 was a horrible one for Iraq. The national election held in April was preceded by two ominous trends: an increasingly strong, armed insurgency from the Sunni Arab population and an increasingly sharp sectarian conflict within the mainstream political system, driven by actions of both the Shia Islamist-dominated government and Sunni Arab political leaders. A divisive election with a disputed result was followed by a strong insurgency, and while both pan-Arab and Iraqi Sunni media tended to frame it as a “revolution” driven by oppressed Sunni tribesmen, the self-proclaimed Islamic State (ISIS), a brutal terrorist group with a globalist Salafi-Jihadist ideology, was its primary driver. The crucible event of the year was the fall of Mosul, Iraq’s most populous Sunni-majority city in the northwest province of Nineveh, to ISIS jihadists on June 10. The city did not fall without resistance, as is sometimes said, as federal police units fought a four-day gun battle for the city, while army divisions, including two garrisoned right outside the city, watched on. Once resistance in the city collapsed, several Iraqi army divisions, weakened by sectarian divisions and riddled with corruption, collapsed almost overnight, and terrorists overran much of northern and western Iraq. These events were a watershed for Iraq, and especially for its Sunni Arab population, and it is Sunni Arab politics since 2014 which is the focus of this chapter.

Abstract:
Following the November 2020 election, Georgia conducted a risk-limiting audit (RLA) of the presidential race. This audit constituted the largest hand tally of an election race in U.S. history. The Carter Center, which has observed more than 110 elections in 39 countries, was the only nonpartisan organization credentialed by the Office of the Secretary of State to provide an impartial assessment of the implementation of the audit process. The Center had the same access provided to the political party monitors who were present throughout the state. In deploying independent monitors to observe the Georgia RLA, The Carter Center hoped to bolster voter confidence in Georgia’s electoral process by assessing the state’s efforts to improve the transparency of its elections.

Abstract:
The main finding of this study is that the Serbian public have conflicting views on national and personal security and their relationship with the country’s institutions. On the one hand, people instinctively recognise that the main security threats are internal and are related to poor governance – such as organised crime and corruption and low levels of trust in institutions that serve the interests of politicians – which is why they rely on themselves and their own good conduct, from which they derive a sense of personal security. On the other hand, under the influence of media messaging and dominant narratives about threats to national security, presenting a maelstrom of great power rivalry and adversarial actors in the region, they continue to believe that hard power is the best response to security issues. Therefore, they see solutions mainly in the continued strengthening of the country and investment in the security sector. Moreover, it is important to bear in mind that public opinion is diametrically opposed to the threats and risks defined by the official National Security Strategy and Defence Strategy adopted last year. Both documents place (the relatively unlikely events of) armed aggression and separatist tendencies within the country in first place on the list of threats to Serbia’s security – threats that only appear in the lower half on the list of priorities in the eyes of the public, who see human security issues as the priority problems. This discord between public perception and the strategic documents is a consequence of the almost complete lack of public debate during the adoption process of these documents. At the same time, it is testimony to the wrongheaded priorities of Serbia’s security policy, which is clearly at odds with the needs of the public, even though the National Security Strategy cites their subjective feelings in defining national security.

Abstract:
This article analyzes the interplay of incumbent, political dynasty and corruption in Indonesia from the perspective of good governance. In the last local elections held in Indonesia, three interesting issues came into the limelight: the increasing incumbent power, political dynasty phenomena, and corruption at the local level. Based on the qualitative data analysis, this research shows that the direct local head election provided greater opportunities for incumbents to build their political dynasties to perpetuate their power. Some analysis considered that political dynasties are the cause of corruption. Nevertheless, corruption at the local level is performed by both dynastic and non-dynastic local head. Thus, minimizing corruption is not achieved by the restriction of political dynasties but by strengthening the control of the government. There are five key points in the supervision process to strengthen the control on the government, namely supervision in the political recruitment in the election process, bureaucratic neutrality, transparency and accountability in budgeting, and supervision of local policies to avoid pork barrel policy.

98. Treasury’s War on Corruption: A U.S. Treasury Department Strategy to Fight Kleptocracy and Root Dirty Money Out of the U.S. Financial System

Abstract:
The incoming Biden administration has signaled through speeches, articles, and interviews that one of its top policy priorities will be combating corruption and kleptocracy.1 With Russia and China’s increasing usage of strategic corruption and malign finance as geopolitical weapons, and with publics around the world—including in the United States—angry about economic inequality and perceived corruption at home, anti-corruption offers a unique opportunity to unify U.S. foreign and domestic policy. Diplomats and lawmakers agree that cracking down on corruption may be the most viable way to restore American leadership by meeting demands for accountability from citizens all over the world.2 Corruption will be the topic of a dedicated special session of the UN General Assembly in June.3 The issue should get support from leaders at a G7 summit in the U.K. around the same time.4 Fighting corruption will also be one of the three areas for new country commitments at the Summit for Democracy that President-elect Joe Biden plans to host during his first year in office.5 At that summit, the U.S. commitment will be a “presidential policy directive that establishes combating corruption as a core national security interest and democratic responsibility.”6 Making this U.S. and international anti-corruption campaign a lasting success will require more than words. In the months ahead, while the administration’s top leadership and the nation’s public health and economic experts are focused on ending the pandemic and rebuilding the economy, the U.S. national security and financial enforcement community should get to work laying the groundwork for a raft of powerful anti-corruption executive actions to be announced in time for the Summit for Democracy. Concurrently, U.S. diplomats should leverage those plans to insist that countries attending the summit make similarly hard commitments, setting a high bar for admission.7 Regulatory rulemaking by the U.S. Treasury Department could usher in several landmark reforms that have been recommended for many years by financial enforcers, multilateral standard-setting bodies, and anti-corruption watchdogs. This policy opportunity is possible because the reforms never overcame opposition by special interests during the period before corruption became a leading national security threat roughly five years ago, and then they were generally not prioritized by the Trump administration. The most potent achievable action available would be for Treasury to set rules requiring several types of professional service providers that enable corruption to institute anti-money laundering controls whereby they would have to identify their ultimate customers and start alerting Treasury of suspicious activity, as is required of U.S. banks.8 Of the industries enabling corruption by helping wealthy clients hide money, ten could be regulated immediately by revoking regulatory exemptions to the Bank Secrecy Act, including real estate agents, private equity and hedge funds, sellers of yachts and airplanes, and seven other types of exempted financial institutions.9 Other key enablers would require new regulatory determinations with strong legal and political backing, such as lawyers, accountants, company formation agents, and art dealers. Treasury’s Financial Crimes Enforcement Network (FinCEN), which administers the Bank Secrecy Act, must write stringent regulations to implement the newly mandated beneficial ownership registry, resisting pressure by special interests to water it down. Treasury should also leverage concerns about the recently leaked “FinCEN Files” to work with Congress on a major investment in FinCEN, potentially on the scale of the seven-fold jump in budgetary resources needed by Treasury to implement recent reforms to the Committee on Foreign Investment in the United States (CFIUS).10 Treasury should publish its first-ever National Corruption Risk Assessment about the financial networks of kleptocracies and oligarchs, reviewing case studies and methods to assess vulnerabilities and risk. Treasury should create a cross-border payments database and make financial institutions scrutinize politicians’ accounts more closely. Treasury should continue supporting two policy initiatives that have developed strongly to pressure kleptocracies in the past couple years by internationalizing Global Magnitsky sanctions and collaborating with the International Monetary Fund on corruption engagement. The U.S. Treasury Department is uniquely positioned to roll out these and other policy, regulatory, enforcement, and diplomatic actions in the fight against corruption, because it is the only part of the U.S. government with a foothold in each area of domestic and international finance that will be key to rooting dirty money out of the global financial system and applying pressure on kleptocrats and their oligarch proxies. Many of Treasury’s most highly developed capabilities have grown out of past fights against top national security threats, such as terrorist financing. The two months following the September 11 attacks witnessed one of the most energetic and well-coordinated performances in Treasury Department history. With Treasury not yet organized and coordinated around anti-corruption, achieving anything like past feats would require Treasury to start by establishing a small team devoted exclusively to this new mission. Specifically, the Treasury Under Secretary for Terrorism and Financial Intelligence (TFI) should appoint a counselor dedicated to developing and advancing anti-corruption initiatives, from expanding the coverage of the U.S. anti-money laundering regime to prioritizing the threats of strategic corruption and malign finance across Treasury’s policy, intelligence, and enforcement efforts. Some of these projects could bear fruit in 2021, while others need longer-term development of capabilities to find kleptocrats’ money hiding within the financial system and prepare policy options to confiscate, sanction, or reveal it. The TFI anti-corruption counselor, who should be designated as early as possible in the administration, should have a staff of two and a mandate to coordinate with and leverage resources across the four principal TFI offices, while also cooperating with Treasury’s Office of International Affairs. And while the White House National Security Council should lead the overall fight against kleptocracy and corruption, the TFI anti-corruption counselor should serve as Treasury’s senior working-level point of contact for collaboration between Treasury and the rest of the U.S. government, as well as with international partners, civil society, and Congress. Combating corruption and kleptocracy will be one of the top priorities of the Biden administration, and Treasury has the resources to start delivering major results quickly. But to do so it must coordinate throughout the Treasury Department and with external partners to roll out big executive actions in 2021.
