4501. North Korea’s Nuclear and Ballistic Threats and the Tailored Deterrence Strategy

Abstract:
North Korea’s nuclear weapons and ballistic missile programs threaten South Korea and its neighbors. Pyongyang’s engineers are likely capable of producing a warhead small enough to place it atop a missile. As its ability to engineer warheads for flight and reentry improves, North Korea increasingly endangers the United States. Deterring Pyongyang is extremely difficult given North Korea’s conventional, unconventional, and cyber capabilities. South Korean and American strategists have reponspded by developing a tailored deterrence strategy to address specific threats. At the operational level, this is supported by the Combined Counter-Provocation Plan. Ballistic missile defense, including the ability to detect, defend, disrupt, and destroy North Korea’s missiles, is critical to the success of the tailored deterrence strategy. South Korea opted to develop its Korean Air and Missile Defense and Kill Chain system. These systems are independent of American ballistic missile defense systems. The Korean systerms were conceived and developed amidst plans to transfer Wartime Operational Control from the U.S. to South Korea. Because transfer has been postponted, there is less rationale for maintaing separate systems. Despite the official desire to keep these systems independent, South Korea needs to develop options for enhancing interoperability with American missile defense systems to support the tailored deterrence strategy.

Relations between China and North Korea have deteriorated during the last year, but Beijing has not fundamentally changed its approach toward its neighbor because that approach serves vital Chinese interests. If the regime of Kim Jong Un should look like it might fail—and there are several reasons why it could—Beijing’s leaders will undoubtedly do all they can to effect a rescue. The Chinese state, however, is not as stable or as capable as it appears, and it may not be in a position to lend needed assistance.

Abstract:
When the next United States president is inaugurated on January 20, 2017, he or she may face one of the more challenging domestic political environments for international trade in the modern political era; at that time, the U.S. will need to make significant decisions regarding its economic relationship with East Asia, including South Korea. The most significant decision facing the next administration will be handling the Trans-Pacific Partnership (TPP). While there is still time for the U.S. Congress to pass the TPP prior to the next administration taking office, it is increasingly likely that the next administration will have to grapple with either passing or renegotiating the Asia-Pacific-wide agreement, as well as determining how to bring South Korea into the region wide agreement. Bringing Korea into the TPP will further solidify the U.S.’ economic relationship with South Korea, enhancing efforts to move toward a free trade area within the Asia-Pacific. While South Korea’s accession to the TPP will likely be the next administration’s major economic objective, they should also work to strengthen the economic relationship with South Korea by deepening cooperation on small and medium sized enterprises (SMEs), cyber security, the digital economy, energy, and New Frontier issues.

4504. Strength and Consistency: A Key to North Korean Nuclear Sanctions

Abstract:
Pyongyang's fourth nuclear test on January 6, 2016, the February 2 test launch of the Kwangmyongsong-4 satellite (which in fact was a longrange missile), and other provocative activities amply reminded the international community of the reasons for strong and consistent sanctions. Such activities again proved the Kim Family Regime (KFR) will not accept voluntary changes or engage in denuclearization dialogue. Instead, the regime declared de facto "Nuclear-First Politics," thus ruling out the possibility of denuclearization. If the KFR is allowed to continue unhampered nuclear weapons development, it will become a nuclear power with over 50 nuclear weapons within a decade. Its weapons will include atomic bombs, boosted fission bombs, and hydrogen bombs. The KFR will also possess increasingly formidable delivery vehicles, such as Submarine Launched Ballistic Missiles and Intercontinental Ballistic Missiles. This situation must be a nightmare particularly to South Korea. However, the current international sanctions headed by the UNSCR 2270, along with unilateral sanctions, are unlikely to bear fruit in the foreseeable future due to China’s conflicting policies. Beijing’s attitude towards North Korean nuclear program has alternated between ‘pressure and connivance;’ its military relationship with the United States determining China’s position on sanctions. China’s alternating position prevents effective sanctions against North Korea. While the international community should endeavor to make sanctions concerted, strong and consistent, South Korea and the U.S. should think about a Plan B that includes presenting China the threat of nuclear proliferation in East Asia.

Abstract:
The United States relies on its ability to project military power far forward of its shores in defense of national and allied interests. Yet the diffusion of technology, especially long-range and precision-guided munitions, poses profound challenges to this core assumption undergirding U.S. extended deterrence and alliance contingency response. The U.S. Department of Defense is seeking technological and operational innovations to deal with these unfavorable trends, largely through military modernization programs that are designed to preserve the United States’ capacity to deter aggression, dissuade adventurism, reassure allies, and defend allied and national interests in the event of conflict. Most analysis of America’s so-called “Third Offset Strategy” has focused on deploying leading-edge technologies to overcome China’s military modernization programs. Almost nothing has been written about a Third Offset Strategy through the prism of the Korean Peninsula. Yet the Third Offset Strategy can bolster the alliance’s response to North Korea, reinforce deterrence, and support regional security. This paper seeks to fill a gap in the analysis by assessing the emerging U.S. defense programs with respect to North Korea, Peninsula contingencies, and ROK–U.S. alliance cooperation on regional and outof-area security issues.

Abstract:
North Korea’s nuclear tests in 2016 rekindled a stronger voice for independent nuclear armament among South Korean conservatives. It is noteworthy that the pro-nuclear view is mainly driven by feelings of profound frustration and helplessness over North Korea’s growing nuclear threat. To assuage concerns, Washington should start seeking new methods of reassuring its partner of its intention to honor its security commitments. The challenges to the U.S.-ROK alliance sparked by North Korea’s nuclear test also came from the liberals’ fierce criticism of the Park government’s decision to start talks with Washington on THAAD deployment. Opponents of THAAD emphasized potential “security anxiety” associated with THAAD deployment, which they argued would escalate regional tensions and introduce a new Cold War, endangering peace on the Korean Peninsula. The THAAD issue has become a political hot potato that could easily entrap major presidential candidates. To avoid any backlash, the candidates will refuse to choose between China and the U.S. while placing the alliance with the U.S. at the center of South Korea’s foreign policy.

4507. Analyzing Japan’s Role in Korean Security within the Framework of the Quasi-Alliance Model

Abstract:
This paper assesses Japan’s role in Korean security using the quasialliance model. Developed by Professor Victor Cha, the quasi-alliance model to analyze the security relationship between Japan and the Republic of Korea, “two states that remain unallied despite sharing a common ally.” Cha defined the quasi-alliance model as “the triangular relationship between two states that are not allied, but share a third party as a common ally.” A key assumption is that the third state serves as the “great-power protector of the two states, and therefore exit opportunities for the two are limited.” While historical issues affected relations between Tokyo and Seoul, American security policies were the primary determinant of cooperation between Japan and Korea. American policy changes produced distinct “abandonment” or “entrapment” responses within the U.S.-Japan and U.S.-ROK security alliances: shared perceptions yielded cooperation, while differing views produced friction. This paper analyzes America’s East Asia policies during the Bush and Obama administrations to assess Japanese and Korean reactions. Analyzed through the quasi-alliance model, American policies produced asymmetric responses in Japan and Korea, inhibiting security cooperation between Tokyo and Seoul. Diverging views of China exacerbated inherent friction between Korea and Japan. Thus, Japan will play a limited role in Korean security.

It is rare to find a journal that examines women’s participation in South Sudan in one chapter and the exploitation of outer space resources in the next; that dissects the effects of Chinese investment in Sub-Saharan Africa and demystifies the Ferguson effect. But the Journal of Public and International Affairs is not your average journal. It represents the very best of what graduate-level public policy students have to contribute to the pressing policy debates of today. It is wide-ranging in subject matter and trenchant in its recommendations. Founded in 1990, but with an ancestor publication dating back to 1963, the JPIA is based on the notion that students of public policy have important things to say about public affairs and that careful analysis and targeted critique can pave the way for meaningful change and progress. The graduate students published in this year’s JPIA combine practical experience from around the world with intensive academic study. They have spent the last year diving deep into the issues they are passionate about and have all been challenged by the need to move past descriptive analysis and towards concrete solutions. 4509. The Paradox of Power Asymmetry: When and Why Do Weaker States Challenge US Hegemony?

Abstract:
Little is known about how, among weaker states, incentives to challenge the status quo are related to the expected response of the US as the system’s hegemon. In contrast to conventional wisdom that suggests militarized punishment can deter potential challengers, it is argued that weak but strongly motivated challengers can interpret the hegemon’s military intervention against adversaries as a window of opportunity to launch their own actions. Empirical results using Generalized Estimating Equations (GEE) and binary time-seriescross-section (BTSCS) models reveal that weaker states possess incentives to challenge the international status quo when the hegemon is preoccupied with prior foreign policy commitments, most notably war. In other words, weaker states dissatisfied with the status quo are more likely to challenge the hegemon when it is preoccupied with prior military commitments. They do so because war involvement distracts the hegemon, drains its capabilities and resolve, and opens up a window of opportunity for weaker states to issue challenges. In addition, weaker states that have an alliance portfolio dissimilar to that of the hegemon are more likely than others to initiate Militarized Interstate Disputes. Theoretically, this paper provides microfoundations to answer the question of why weaker parties instigate asymmetric conflicts when it might seem irrational to do so.

4511. Strengthening the ROK-US Nuclear Partnership

Abstract:
Over the last forty years, South Korea (or the Republic of Korea, or ROK) and the United States have become essential partners on nuclear matters. The United States provided the technology and knowhow necessary for Korea to establish a nuclear sector. Koreans mastered that technology and have worked to improve on it, with the twin goals of expanding their country’s energy independence and becoming a leading exporter of nuclear power production facilities. The two states’ nuclear energy industries have become intertwined. They cooperate on multiple initiatives to strengthen international nuclear security and nonproliferation measures. Collaborative research ties amongst nuclear scientists from both countries run deep. Arguably, each state is the other’s most important nuclear partner. As with all maturing relationships, there remain differences of view and priority that must be managed. Though unlikely, a disruption in ROK-US nuclear relations would have wide-ranging, deleterious effects on both states. For this reason, the conclusion in June 2015 of a new bilateral treaty, the Agreement for Cooperation Between the Government of the United States of America and the Government of the Republic of Korea Concerning Peaceful Uses of Nuclear Energy (hereafter referred to as the 123 agreement after section 123 of the Atomic Energy Act, the relevant US statute) is a critical milestone. The new agreement establishes the terms for nuclear cooperation for the next twenty years. It is expansive and forward-looking, providing the basis for unusually broad and deep nuclear ties. The 123 agreement will bring predictability to the relationship at a time when the global nuclear energy outlook remains in flux. However, the new nuclear agreement only managed to partially resolve several deep-seated differences between the two sides that were illustrated by the fact that negotiations on a new agreement lasted more than four years and required an extension to complete. The agreement creates a new political framework for managing divergent views over how to cooperate most effectively, but differences may yet re-emerge and frustrate cooperation. The challenge before the two governments now is to implement the new agreement in ways that can either resolve or remove these differences and solidify existing ties. In other words, the two countries should seek to build a nuclear partnership in deed, not just in word. This report articulates a vision for ROK-US nuclear partnership for the next two decades, a period which aligns with the duration of the new agreement for cooperation. It highlights challenges and opportunities and provides recommendations intended to deepen and expand the range of existing cooperation in ways that will support a stable and sustainable nuclear partnership. The objective of the report is to describe a desirable and stable end-state for the relationship—an enduring partnership—and to identify steps along the path to achieve it. It discusses multiple areas of cooperation, assesses strengths and weaknesses of existing ties, and identifies practical activities both parties can pursue toward building the partnership.

The continued growth of powerful transnational challenges poses grave and persis- tent threats to the security and well-being of the United States. America’s approach needs to be updated to include new foreign policy tools and new approaches. The heart of the new foundation for U.S. foreign policy should be an investment in the efforts of nations at risk of collapsing and unleashing global threats to build legitimacy and to escape the trap of repression followed by upheaval. International Compacts for Governance, Prosperity, and Security could transform how the international community works in partnership with fragile states to improve their legitimacy and security over time. The United States will need the political will and leadership to support steady, long-term, and carefully designed investments in fragile states. This will also require rebalancing U.S. foreign policy resources toward development, diplomacy, economic statecraft, and justice sector reform, while maintaining the world’s most powerful military. All of these tools are required to move from a focus on countering terrorism to a focus on defeating extremism and enabling other nations to build the legitimacy they need themselves. This is the strategy that will most effectively and sustainably ensure America’s national security—and, indeed, global security as well.

In every state and in every industry across the United States, immigrants—authorized and unauthorized—are contributing to the U.S. economy. Immigrant labor and entrepreneurship are believed to be powerful forces of economic revitalization for communities struggling with population decline. Estimates suggest that the total number of unauthorized immigrants currently residing in the United States is approximately 11.3 million, or about 3.5 percent of the total 2015 resident population of 324.4 million. Of those 11.3 million, we estimate that 7 million are workers. What is the economic contribution of these unauthorized workers? What would the nation stand to lose in terms of production and income if these workers were removed and returned to their home countries?

The Center for American Progress and the China Institutes of Contemporary International Relations, or CICIR, have partnered often over the years, working regularly on areas of cooperation between China and the United States and on options for managing areas of competition and tension. Together, CAP and CICIR have held or participated in many conferences, workshops, and symposiums that bring together Chinese and U.S. officials and scholars; we have worked on joint publications; and we believe that we have helped enable substantial cooperation between the United States and China. Mistrust complicates U.S.-China relations and can obscure areas where cooperation might be possible and beneficial. Negative dynamics also obscure from others the depth of U.S.-China cooperation in a wide range of areas. In this report, we try to cut through these dynamics and offer new options. In 2014, CAP and CICIR began to discuss how U.S.-China tensions might be obscuring areas of mutual interest in Southeast Asia, a region of tremendous importance strategically and economically to the entire region and the world. Prior to this project, in our respective organizations, the people who work on Southeast Asia did not work closely with colleagues working on U.S.-China bilateral relations. In most cases, our bilateral experts had spent little or no time in Southeast Asia, yet the tensions at play in the region featured prominently in their day-to-day work. Both the United States and China, meanwhile, were making investments and building new partnerships with Southeast Asian countries. Was Southeast Asia to be an arena of competition for China and the United States, or could there be areas of cooperation with members of the Association of Southeast Asian Nations, or ASEAN, that brought benefit to all? The potential for research by our teams with Southeast Asian counterparts was clear. It was our friend and colleague Nina Hachigian who proposed the concept that would make this a groundbreaking project. Now the U.S. ambassador to ASEAN, Hachigian is a diplomat and scholar of rare skill and creativity. She noted that CAP and CICIR could only do productive work in this area by doing two things: First, the organizations needed to join their stovepiped research teams into a single group with expertise on both Southeast Asia and U.S.-China relations. Second, CAP and CICIR had to partner with scholars in the region who study the United States, China, and ASEAN. And rather than holding a conference, why not travel through the region with local hosts?

The geopolitical landscape that emerged after the end of the Cold War is facing recent strains from an unprecedented wave of global migration, climate change, and a more assertive Russia and competitive China—and the Middle East has emerged as a focal point for many of these challenges. The administration of the next U.S. president will face a Middle East challenged by regional power tensions; multiple civil wars; state collapse driven by political legitimacy crises; threats from rapidly evolving terrorist networks; record numbers of refugees; and escalating economic and human development pressures. These challenges, along with a new wave of regressive authoritarian forces limiting basic freedoms, will require the next administration to take a proactive and long-term approach to the Middle East. Dynamics in the Middle East have understandably caused many Americans to question the value of U.S involvement in the region. Indeed, this skepticism is supported by the track record of the past 15 years, particularly the fallout from the 2003 Iraq war. But recent events and trends in the Middle East—from the rise of the Islamic State to the refugee crisis spilling over into Europe—demonstrate that the United States has important stakes in what happens in the region. Because of the threats that the Middle East presents for the homeland and the danger that continued conflict in the region poses to global stability, the United States needs to work closely with regional partners to adopt a long-term approach to the region that advances America’s interests and values.

Abstract:
Carbon pricing is flourishing in North America. Canada, for example, has announced a national price to take effect in 2018, while Mexico has announced a 12-month cap-and-trade pilot that will evolve into a national program. These developments join a network of established pricing instruments, including a carbon tax in Mexico and subnational systems in California, the northeast United States, and several Canadian provinces. Once unlikely, it now seems probable that carbon pricing will proliferate not only across Canada and Mexico but also in the United States. Carbon taxes and cap-and-trade programs have found a diverse set of U.S. proponents, including from the private sector and from across the political spectrum, who view carbon pricing instruments as effective and efficient methods of curbing greenhouse gas emissions and the disruptive effects of climate change.

The Americas affect U.S. national and homeland security, economic prosperity, and stability perhaps more than any other region in the world. Collectively, they are the destination for more than 40 percent of all U.S. exports,1 the source of 65 percent of all U.S. energy imports,2 and the region of origin or heritage for 17 percent of the U.S. population.3 As the next administration looks to the Americas, it will have a fundamental choice: It can embrace the partnership model that seeks to work with those in the region willing and capable to engage on the wide range of bilateral, regional, and global issues that have predominated the past eight years. Or, in contrast, the administration can unreasonably attempt to wall the United States off from its closest neighbors.

On October 16, 2016, the U.S. Director of National Intelligence James Clapper and Secretary of Homeland Security Jeh Johnson issued an extraordinary statement, indicating that the “U.S. Intelligence Community is confident that the Russian Government directed the recent compromises of e-mails from U.S. persons and institutions, including from U.S. political organizations.”1 The release of this hacked information was all directed at the Democratic presidential campaign and its affiliates, with no hacked information leaked regarding the campaign of the Republican presidential nominee, and now president-elect, Donald Trump. These senior U.S. intelligence officials pointed out that Russia, under President Vladimir Putin, had used similar tactics across Europe and Eurasia to bolster right-wing nationalist parties and that “[t]hese thefts and disclosures are intended to interfere with the U.S. election process.” Director Michael Rogers, head of the National Security Agency, noted, “There shouldn’t be any doubt in anybody’s minds, this was not something that was done casually, this was not something that was done by chance, this was not a target that was selected purely arbitrarily. This was a conscious effort by a nation-state to attempt to achieve a specific effect.”2

The detritus of the U.S.-Soviet Union relationship remains a part of the U.S.-Russian relationship. During the Cold War, U.S. policy went from containment to détente to confrontation. Today, the vicissitudes of Russian President Vladimir Putin’s engagement with the United States range from the productive—the Iran nuclear deal is one example—to confrontation—Ukraine is a good example—to doing a bit of both—Syria is an example of this. Putin wants Russia to not only have a seat at the table where decisions are made about global international issues but also wants the seat once held by the former Soviet Union.1 In other words, Putin wants a return to the great power politics of the Cold War and a free hand in the territory that was part of the Soviet Union. In this regard, Putin needs the United States as an adversary, though not necessarily as an enemy.2 This sort of dynamic allows him to maintain political support at home—he is protecting Russia from an outside threat—which allows him to avoid fixing an economy that is faltering3 and addressing the corruption that is a significant part of the political scene.4

Syrian immigrants and refugees have frequently been in the news over the past year, and not always in a positive light. President-elect Donald Trump lashed out against Syrians coming to the United States during his campaign, promising a ban on immigration from countries “compromised by terrorism,” calling for “extreme vetting” of immigrants from Muslim and Arab nations, and saying of people already granted refugee status who fled Syria, “If I win, they’re going back.”1 Considering this negative rhetoric, it may come as a surprise to some that immigrants from Syria who live in the United States are in fact doing very well. They are learning English, getting good jobs, owning homes, and starting businesses at impressive rates. These findings are reassuring and should provide the basis for more informed and thoughtful consideration of how to think about current and future Syrian immigrants and refugees. The Syrian immigrants in the study conducted for this issue brief are overwhelmingly people who came to the United States before the recent refugee crisis. Their success is a positive sign that the United States is a place that can provide opportunity for a wide range of people and shows that immigrants from Syria, like other immigrants, are making a real contribution to local economies around the country. Their success is also encouraging as the United States continues to accept refugees fleeing the horrific Syrian war zone. Those refugees will find that it can help to have a receiving community that includes people who speak the same language; share cultural and, in many cases, religious backgrounds; and understand both sides of the transition that ref

4523. How and Why Government, Universities, and Industry Create Domestic Labor Shortages of Scientists and High-Tech Workers

Abstract:
On June 2, 1965, under a mandate established by Title VII of the Civil Rights Act of 1964, the U.S. Congress created the Equal Employment Opportunity Commission (EEOC) to enforce federal anti-discrimination laws related to employment. The expectation was that African Americans would be prime beneficiaries of the EEOC. There was no assumption that the EEOC, on its own, could reverse deep-rooted employment discrimination against blacks. But in the late 1960s there was optimism that, in combination with equal educational opportunity and the strong demand for unionized workers in the well-paid manufacturing jobs that marked the post-World War II decades, the EEOC could help to ensure that an ever-increasing number of blacks would ascend to the American middle class. African Americans as a group are better educated than they were in the 1960s, and, as discriminatory norms and practices have lessened, large numbers of college-educated blacks have experienced upward employment mobility into professional, technical, and administrative occupations. But the promise of a large-scale ascendancy of blacks to middle-class status, characterized by secure and well-paid employment, has not been fulfilled. Our basic thesis is that, in combination with the institutions of racism which remain widespread in American society, the erosion of secure and well-paid employment opportunities is a major reason for the persistence since the 1980s of African Americans as disproportionately disadvantaged. Our contribution to the larger debate on the economics of race is to focus on the role of corporate resource allocation as the prime determinant of the quantity and quality of employment opportunities in the economy. The decline of middle-class employment opportunities has adversely affected the majority of the U.S. labor force of all races, ethnicities, and genders. African Americans, however, have been more vulnerable than other demographic groups to this decline. U.S. institutions of corporate governance vest power over major resource-allocation decisions in the hands of senior executives, supported by their hand-picked corporate boards. Given the enormous size of the major business corporations and their centrality to economic activity, the resource-allocation decisions made by senior executives of major U.S. corporations profoundly influence the operation and performance of the economy as a whole—including the availability, or not, of secure and well-paid employment opportunities. The failure to include an analysis of corporate resource allocation and how it has changed over the past half century in the policy debate on income inequality is what we call the “equal employment opportunity omission.”

4524. The Value-Extracting CEO: How Executive Stock-Based Pay Undermines Investment in Productive Capabilities

The business corporation is the central economic institution in a modern economy. A company’s senior executives, with the advice and support of the board of directors, are responsible for the allocation of corporate resources to investments in productive capabilities. Senior executives also advise the board on the extent to which, given the need to invest in productive capabilities, the company can afford to make cash distributions to shareholders. Motivating corporate resource- allocation decisions are the modes of remuneration that incentivize and reward the top executives of these companies. A sound analysis of the operation and performance of a modern economy requires an understanding of not only how much these executives are paid but also the ways in which the prevailing system of executive pay influences their decisions to allocate corporate resources. In the United States since the last half of the 1980s the overriding goal of U.S. corporations has been to “maximize shareholder value,” with corporate performance measured by a company’s “total shareholder return”: percentage stock-price appreciation plus dividend yield. Also since the 1980s, the most important components of the total compensation of senior executives have been modes of stock-based pay in the forms of stock options and stock awards. This stock-based pay is structured to incentivize executives to make corporate allocation decisions that will boost the stock prices of the companies that employ them and reward them for achieving that objective. There are three drivers of stock prices: innovation, speculation, and manipulation. The first critical question that this paper addresses is which of these drivers, individually or in combination, contribute to a company’s stock-price performance. Then we can ask the second critical question: Does executive compensation reflect the success of the company in value creation, or the power of senior executives to engage in value extraction? The “value- extracting CEO” hypothesis posits that, in the United States, a significant portion of senior executive compensation rewards them for making decisions that foment speculation and manipulate stock prices, and thereby extract value for their own personal gain. In section four of the paper, I invoke the theory of innovative enterprise to support this hypothesis and debunk the dominant ideology that companies should be run to “maximize shareholder value.” Finally, I elaborate the policy implications for controlling the power of the value-extracting CEO, including a) banning stock buybacks, b) requiring executive compensation that rewards innovation rather than speculation and manipulation, and c) placing stakeholders representing households as taxpayers, workers, and consumers on boards of directors of publicly listed companies, along with shareholders who represent households as savers. An intellectual precondition for these reforms is the rejection of the ideology that companies should be run to maximize shareholder value, which means replacing agency theory with innovation theory as a mode of analyzing how the operation of an economy, supported by the strategies and structures of the business enterprises within it, can attain the objectives of stable and equitable economic growth.

We examine whether personal wealth interests affect politicians’ decisions about stabilizing financial markets. We use the setting of the government’s support of financial institutions under the 2008 Emergency Economic Stabilization Act. We find that the personal wealth interests of politicians are positively associated with voting in favor of the EESA. We implement several analyses to show that personal wealth interests rather than unobservable beliefs in the financial sector explain our result.

4526. The Mismeasure of Mammon: Uses and Abuses of Executive Pay Data

On April 7, 2016, the Wall Street Journal ran an article headlined “CEO pay shrank most since financial crisis,” while on May 27, 2016, a similar New York Times story declared “Top CEO pay fell – yes, fell – in 2015.” Unfortunately, both the Journal and the Times mismeasured the actual take-home pay of each and every one of these CEOs in 2014 and 2015. The reason for this mismeasure is that both articles relied on “fair value” estimates of the stock-based pay of these CEOs as reported in the Summary Compensation Table of the definitive proxy statement (Form DEF 14A) that each publicly listed company files annually with the U.S. Securities and Exchange Commission (SEC). Yet the very same proxy statements also report the actual realized gains of these CEOs in the Option Exercises and Stock Vested Table. It is the realized gains on stock-based pay, not fair-value estimates, that enter into the total compensation that a CEO actually takes home and reports as income in his or her income-tax return. Moreover, including actual realized gains instead of estimated fair value of stock– based pay in the measure of total executive compensation can make a big difference. In 2014 average total compensation of the 500 highest-paid executives named on corporate proxy statements based on actual realized gains was $34.3 million, with 81 percent coming from stock-based pay. But average total compensation of the 500 highest paid based on estimated fair value was $19.3 million, with 62 percent attributable to stock- based pay. The excess of total actual realized-gains compensation over total estimated fair-value compensation was greatest in those years when the stock market was booming. Why would the Wall Street Journal and the New York Times report estimates of executive pay when they could be reporting the CEOs’ actual pay? In this paper, we answer this question by explaining the origins of the “fair value” estimates of stock-based pay and how the obsession with these estimates by the SEC, relying on the business-run Financial Accounting Standards Board (FASB), has relegated to statistical obscurity executives’ readily available, accurate, and actual realized gains from stock-based pay. We use Standard & Poor’s ExecuComp database to document that a) stock-based pay, in the forms of realized gains from stock options and stock awards, dominates both the size of and the changes over time in the total compensation of the highest-paid senior executives; and b) the fair-value estimates of stock-based pay tend to understate, often substantially, the realized gains from stock-based pay that these executives actually receive. An irony is that even critics of excessive executive pay, most notably the AFL-CIO on its Executive Paywatch website, use the fair-value estimates when the actual CEO compensation numbers would reveal a much larger ratio of CEO pay to the earnings of the average worker. Indeed, as we discuss in the conclusion to this paper, as mandated by the Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010, this mismeasure of executive pay has become institutionalized in U.S. government policy in the SEC’s Pay Ratio Disclosure Rule, which beginning in 2017 requires every company to publish the ratio of CEO to median-worker pay. Under this rule, the SEC requires companies to use the fair-value measure of CEO pay. The Pay Ratio Disclosure Rule is supposed to provide the public with a company-level indicator of income inequality. Instead it will tend to underestimate inequality, substituting fictitious estimates for actual known amounts of income that CEOs put into their bank accounts and declare in their income-tax returns.

Abstract:
Using a unique dataset provided by the Center for Responsive Politics (CRP), we document a direct channel through which financial institutions contribute to the net worth of members of the U.S. Congress, particularly those sitting on the finance committees in the Senate and the House of Representatives. These individuals report greater levels of leverage and new liabilities as a proportion of their total net worth, relative to when they are not part of the finance committee or relative to other congressional members. Politicians increase new liabilities by over 30% of their net worth in the first year of their finance committee membership. We do not find similar patterns for members of non-finance powerful committees. We find no evidence that finance committee members arrange new personal liabilities ahead of their appointments to the committees. Finance committee members also report liabilities with lower interest rates and longer maturities. Finally, focusing on banks that lend to U.S. Congress members, we find that the weaker performing financial institutions lend to more finance committee members and provide more new debt to these politicians. Our findings suggest that lenders may create political connections with finance committee members in an attempt to obtain regulatory benefits. !

Abstract:
We analyze the roots of politicians’ preferences for redistribution by exploring whether early life experiences have persistent, long-run effects on U.S. Members of Congress’ voting records. We study whether having experienced an economic recession during early adulthood affected their positions on redistribution-specific bills during the period 1957–2012. We find that politicians who experienced a recession hold more conservative positions on redistribution, even compared to members of the same party in the same legislature. We rule out alternative accounts and show that experiencing a recession directly affects future politicians’ personal preferences. In light of recent empirical evidence showing that voters become more supportive of redistribution following a recession, our findings suggest that macroeconomic shocks have a polarizing effect: recessions can create an ideological wedge between voters and their future representatives.

Donald Trump’s Republican presidential nomination and the Brexit have shocked and somehow caught by surprise the entire world. A growing sense of concern or even alarm is now spreading across Western countries and is putting traditional democratic processes to the test. In particular, when looking at the political landscape in Europe, populism may turn out to be an unprecedented game-changer. Populists parties came to power in Poland and Hungary, they are in coalition governments in Switzerland and Finland, top the polls in France and the Netherlands, and their support is at record highs in Sweden. Not to mention the recent rise of Alternative für Deutschland in Germany and the successful story of Syriza, Podemos and of the FSM in Southern Europe. The Report explores the rise of populism in Europe and the US by analyzing its root causes, the rationale behind its success, its impact on traditional political parties and, more broadly, on Western democracies. It also draws some policy recommendations to tackle this widespread challenge.

Abstract:
This study examines the hedging effectiveness of portfolio investment diversification between developed and developing economies; with focus on the Nigerian stock asset vis-à-vis the stock assets of the United States (US) and United Kingdom (UK). Its main contribution is in the analysis of optimal portfolio diversification using optimal portfolio weight (OPW) and optimal hedging ratio (OHR). Empirical findings show that the OPW and OHR are low, which indicates impressive potential gains from combining Nigerian stock assets in an investment portfolio with US and UK stock assets. In addition, exchange rate volatility is found to pose stern limitation on the potential benefits of this portfolio diversification arrangement. It is therefore recommended that the monetary authority in Nigeria should pursue policies towards reducing exchange rate volatility to the barest minimum. This will possibly attract more investors from developed economies who might be willing to combine Nigerian stock in their investment portfolio to minimize portfolio risk.

Washington and Tokyo made significant progress on two new initiatives this fall – Japan’s implementation of legislation for the exercise of collective self-defense and the conclusion of negotiations with other participants in the Trans-Pacific Partnership (TPP). With Japanese Upper House elections in the summer and US presidential elections in the fall, trade, military strategy, and US-Japan security cooperation will be part of the political discourse in both countries. Along with the ratification process for the Trans-Pacific Partnership trade deal, two challenges for Washington and Tokyo that will continue into the new year are how to respond to Chinese land reclamation in the South China Sea and how to deal with local opposition to Tokyo’s plans for building a new airfield to replace the Futenma facility on Okinawa. Two challenges to Washington and Tokyo will continue into the new year. The first is how to respond to Chinese land reclamation in the South China Sea. Military leaders from Japan and the US discussed China’s accelerated building in the Spratly Islands, and the Japanese role in a regional response was on the agenda when Prime Minister Abe and President Obama met on the sidelines of the APEC meeting in Manila. The USS Lassen’s freedom of navigation operation near Subi Reef on Oct. 27 was welcomed by Tokyo, but there is no suggestion yet that Japan is willing to conduct similar operations in the South China Sea. The second challenge is far from new, but local opposition to Tokyo’s plans for building a new airfield to replace the Futenma facility operated by the US Marines has risen again. The central government filed a legal suit directed at Okinawa in November, and then Gov. Onaga Takeshi filed his own civil suit against the central government in December. This battle in the courts over new base construction in Oura Bay is the second legal showdown between the prefecture and Tokyo over who has the authority to control decision making on base consolidation in Okinawa.

Despite growing friction between the US and China on a number of issues, Xi Jinping’s state visit to the US in September was mostly positive and produced important outcomes on climate change, cyber security, and avoiding accidents between military aircraft. Tensions persisted in the South China Sea with China unwilling to stop its construction and militarization of terraformed reefs. The USS Lassen, a US Navy guided-missile destroyer, exercised international rights of freedom of navigation by sailing within 12nm of Chinese-occupied Subi Reef. The Obama administration notified Congress of its intent to sell a $1.83 billion arms package to Taiwan prompting Chinese objections, but no suspension of bilateral military exchanges. Presidents Obama and Xi met again on the margins of the Paris climate change conference in late November. They also conferred by phone, helping to conclude an historic, ambitious, global, agreement to reduce emissions at COP21.

The final months of 2015 saw hedging around South Korea’s relationship with China, strong support for the US-ROK alliance in the face of DPRK threats, a US-ROK summit, and heightened concern as North Korea prepared for a fourth nuclear test, which came on Jan. 6. With the US and South Korea watching closely for signs of a missile or nuclear test, North Korea marked the 70th anniversary of its Workers Party on Oct. 10 without incident. The US-ROK presidential summit appeared solid, with a joint statement against the North Korean nuclear and missile threats and shared concern over DPRK human rights violations. The US again took up the issue of DPRK human rights violations at the UN Security Council in December as reports of possible purges in North Korea continued to attract US and ROK attention. The US was pleased in late December by an agreement between South Korea and Japan on “comfort women.”

Militarily, the freedom of navigation voyage of the USS Lassen past China’s artificial islands occurred while the Department of Defense announced a $425 million five-year military aid program for Southeast Asian states and the White House committed an additional $259 million in military support for Indonesia, Malaysia, and the Philippines. Diplomatic engagements included visits to the region by the president, the secretaries of state and defense, and a number of senior aides to attend multilateral meetings. Commitment to the economic pillar led to the conclusion of negotiations for the Trans-Pacific Partnership (TPP) trade agreement. If ratified by the signatories, the TPP would be the most comprehensive trade and investment arrangement in the world, though a number of obstacles in many of the countries do not portend a quick or easy confirmation.

North Korea mixed things up a bit in early 2016, this time starting with a nuclear test – its fourth – and then following up a month later with a missile test/satellite launch; usually the order is reversed. Other than that it was déjà vu all over again, only worse. There were also a number of shorter-range ballistic missile launches and the usual threats (with graphic video), while the prospects for dialogue seemed to dim even further. Meanwhile, Chinese activities in the South China Sea (SCS) are being described by everyone (except Beijing) as further militarization of its artificial islands, as everyone (except Beijing) eagerly awaits the ruling by the Permanent Court of Arbitration in The Hague on a case the Philippines has brought against China’s SCS claims – Beijing has already preemptively rejected the Court’s jurisdiction, so no happy ending appears in store for anyone. The G7 also weighed in on the SCS issue, much to China’s dismay. It’s for certain the G20 won’t (since China is host this year). The AIIB is taking shape, with most worries not being realized. Finally, after eight months of listening to pundits predict that the Trump phenomenon was sure to fade, Donald Trump has become the “presumptive” Republican nominee. His opponent seems likely to be former Secretary of State Hillary Clinton, in what is shaping up to be a battle of the known versus the unknown (and largely unpredictable).

The US-Japan relationship was relatively steady in the early months of 2016 until the US presidential primaries began to stir things up. For the first time in decades, Japan became the focus of debate on the campaign trail when Donald Trump began to single out Japan on trade and on security cooperation. There was also a setback on the Futenma replacement facility when construction was halted following a compromise between the central government and Okinawa that calls for a court decision on how to proceed. Nevertheless, the two governments continued to refine alliance coordination in the face of North Korea’s nuclear test and missile launches and pursued maritime cooperation as Beijing’s behavior in the South China Sea continued to roil regional waters. With major elections on the horizon, both countries are likely to be consumed by politics in the coming months. The United States and Japan continued to refine alliance coordination in the face of North Korea’s renewed nuclear testing and missile launches. Tokyo and Washington also continued their maritime cooperation as Beijing’s behavior in the South China Sea continued to roil regional waters. Japan suffered an unexpected setback in its cooperation with Australia, however, as its bid to provide Canberra with its next-generation conventional subs was outdone by the French offer. The Futenma base standoff with Gov. Onaga took an unexpected turn when Prime Minister Abe Shinzo announced suddenly that he and the governor had agreed to a compromise settlement. Tokyo would halt construction and Naha would agree to merge the court cases and would fully comply with the court decision on how to proceed. Politics now consume both countries as both Japan and the US face elections later this year. Anticipation that Abe would call a double election this summer ended after Chief Cabinet Secretary Suga Yoshihide declared that only the regularly scheduled Upper House election would be held so that the government could concentrate on recovery efforts in Kumamoto Kyushu, the site of a deadly earthquake. Economic growth continues to elude the Abe Cabinet, and the prime minister still confronts the prospect of an additional consumption tax hike in the spring of 2017. In the US, the primaries are winding down with Donald Trump the expected nominee for the Republican Party and Hillary Clinton in the lead for nomination by the Democratic Party. The US-Japan alliance seems already to be suffering from “Trump shocks” even before the election decides the next US president.

The South China Sea remained the most contentious issue in the US-China relationship in the early months of 2016. North Korea’s fourth nuclear test and missile launches posed both a challenge and an opportunity. After two months of intense consultations, the US and China struck a deal that led to unprecedentedly tough sanctions on Pyongyang. Xi Jinping attended the Nuclear Security Summit in Washington DC at the end of March and met President Obama. Their joint statements called for cooperation on nuclear security and climate change. Relations between the militaries hit a snag as Secretary of Defense Ashton Carter postponed a planned visit to China and Beijing rejected a request for a US aircraft carrier battle group to visit Hong Kong. Talks continued on a bilateral investment treaty, but China failed to submit a new “negative list,” leaving prospects uncertain for concluding a BIT by the end of Obama’s term.

US and South Korean concerns spiked in early 2016 as North Korea demonstrated worrying advances in nuclear weapon and missile technology. Despite a rather placid New Year address, Kim Jong Un raised international alarm with the DPRK’s fourth nuclear test on Jan. 6. A month later, North Korea launched a three-stage rocket, a direct violation of a UN missile ban. The US Congress passed more rigorous sanctions legislation, seeking to stem financial flows and punish second-party facilitators. On March 3, UN Security Council Resolution 2270 calling for tougher sanctions passed unanimously. Seoul added its own unilateral sanctions on March 8. Meanwhile, Kim Jong Un’s display of a nuclear device and reentry technology, failed intermediate-range missile tests, and a successful submarine-launched ballistic missile test added to growing concerns. ROK President Park Geun-hye called for additional multilateral efforts. While North Korea is pushing back hard, some suggest its provocations and rhetoric may be for foreign consumption in the lead-up to the highly anticipated Party Congress in May, a first in 36 years.

The mid-February ASEAN-US Summit was the Obama administration’s effort to show ASEAN’s central role in the US rebalance to Asia. It was only partially successful. Several new business initiatives were inaugurated to link US and ASEAN entrepreneurs. However, security cooperation hardly advanced. While maritime security was included in the joint declaration, there was no mention of US freedom of navigation (FON) patrols or the South China Sea disputes. In January, the Philippine Supreme Court cleared the way for the Philippine-US Enhanced Defense Cooperation Agreement, allowing US forces rotational access to several Philippine military bases and enhancing interoperability. Washington plans to increase the frequency and “complexity” of FON patrols near the artificial islands built by China, and the US has begun joint patrols with Philippine ships. Washington also announced a Southeast Asian Maritime Security Initiative that includes a $425 million multi-year appropriation for regional capacity to improve maritime domain awareness and patrols.

Abstract:
Relations in early 2016 were dominated by China’s unremitting efforts to expand its control in disputed territory in the South China Sea in the face of complaints, maneuvers, and challenges by regional governments and concerned powers. US-led challenges to Chinese expansion included expanded military presence and freedom of navigation operations accompanied by strong rhetoric from US defense leaders warning of Chinese ambitions. The constructive outcome of the US-China meeting on March 31 reinforced indications that neither Washington nor Beijing sought confrontation. Against that background, the responses of Southeast Asian governments remained measured. They followed past patterns of ambiguous hedging against China’s assertiveness, demonstrating some increased criticism of China, and greater willingness to link more closely with the US to dissuade China’s disruptive expansionism.

The rule of law took a few huge hits during the year’s second trimester, as Beijing chose to ignore the UNCLOS Arbitral Tribunal’s ruling that negated many of its South China Sea claims, while Pyongyang displayed its usual disdain for the latest UN Security Council Resolution 2270 with a series of ballistic missile launches, highlighted by a submarine-launched ballistic missile test. There were also a number of significant multilateral forums addressing regional security and economic issues, or both. Most in some form also touched upon the South China Sea and Korean Peninsula, even as ASEAN danced around the Tribunal’s ruling. Meanwhile in the battle of who gets to make trade rules, the Chinese-backed Regional Comprehensive Economic Partnership (RCEP) seemed to fare only slightly better than the US-driven Trans-Pacific Partnership (TPP), the objection to which seems to be the only thing the two US presidential candidates agree upon.

President Obama and Prime Minister Abe traveled to Hiroshima, where Obama took the opportunity to speak of the devastating consequences of war in the nuclear era. The summer months that followed were full of politics, with an Upper House election in Japan in July and the Republican and Democratic Party conventions in the US kicking off the general election campaign for president. The Obama administration continued to work toward congressional passage of the Trans-Pacific Partnership at the end of the year. With less political contention but growing skepticism over Washington’s ability to ratify the agreement, the Abe Cabinet decided to postpone Diet discussions on the topic until after its election. Regional relations continue to shape the US-Japan alliance agenda with Chinese maritime activity in the East China Sea and South China Sea and ongoing North Korean provocations garnering the most attention. The summer months that followed were full of politics, with an Upper House election in Japan in July and the Republican and Democratic Party conventions in the US kicking off the general election campaign for president. The Republican nominee, Donald Trump, continued to take aim at trade deals and US alliances, but the Democratic Party had its “anti-trade” moment when its convention took aim at the Trans-Pacific Partnership (TPP), the trade pact concluded by 12 Pacific nations. The Obama administration continued to work toward a Congressional vote in the lame duck session at the end of the year. With less political contention but growing skepticism over Washington’s ability to ratify the agreement, the Abe Cabinet decided that it would postpone Diet discussions until after its election. Regional relations continue to shape the US-Japan alliance agenda. In July, the UN Convention on the Law of the Sea Tribunal announced its arbitration ruling in a case brought by the Philippines on Chinese behavior in the South China Sea. Beijing was quick to condemn the ruling, but its neighbors in Asia largely welcomed it. In August, Chinese fishing vessels inundated the waters near the Senkaku Islands, prompting Japan’s Vice Minister of Foreign Affairs Sugiyama Shinsuke to call in Chinese Ambassador Cheng Yonghua for a harsh protest. A diplomatic opening came when Foreign Minister Wang Yi traveled to Tokyo on Aug. 24 for a trilateral meeting with the foreign ministers of Japan and the ROK, the first trilateral meeting held in Japan in 11 years. North Korea heralded this Japan-ROK-PRC meeting by testing a ballistic missile launch from a submarine. Pyongyang yet again interrupted regional diplomacy when it launched three missiles into the Sea of Japan during the G20 meeting hosted by Beijing, prompting renewed UN condemnation of North Korea and a hasty set of meetings between the leaders of Japan, South Korea, and the US. A full agenda of Asian multilateral meetings ended the summer, offering plenty of opportunity for diplomacy. For this summer, at least, there seems little reason to believe that diplomacy alone can bridge the growing differences over how to resolve the region’s growing security tensions.

Senior US and Chinese officials publicly emphasized positive developments in the bilateral relationship at the eighth US-China Strategic and Economic Dialogue, while privately raising concerns. The second US-China Cybercrime and Related Issues High-Level Joint Dialogue convened a week later. The South China Sea persisted as a major area of tension as an UNCLOS Tribunal ruled in favor of the Philippines in its case against China. National Security Adviser Susan Rice traveled to Beijing in late July to prepare for the US participation in the G20 Summit in Hangzhou and what is likely to be the last meeting between Xi Jinping and President Obama. Bilateral military ties maintained an active pace with a visit by the US chief of naval operations to China in July, a port visit by a US guided-missile destroyer to Qingdao in August, and Chinese participation in the Rim of the Pacific (RIMPAC) military exercises in Hawaii.

The United States and South Korea entered the summer months with growing concern over North Korean missile capabilities. The DPRK Workers’ Party Congress in May signaled solidarity in Kim Jong Un’s reign, replacing the National Defense Commission with a new State Affairs Commission, and appointing Ri Yong Ho as foreign minister. Mid-summer, the US sanctioned Kim Jong Un and 10 other individuals and entities for human rights violations, and the US and ROK agreed to deploy the THAAD system against North Korea. Angered, the DPRK severed the New York channel. The US and South Korea joined together in military exercise Ulchi Freedom Guardian. Pyongyang responded by threatening to turn Seoul and Washington into a “heap of ashes through a Korean-style preemptive nuclear strike.” Finally, South Koreans expressed growing concern over the course of the US presidential campaign.

The Obama administration has achieved only a portion of its Asian rebalance strategy in Southeast Asia. Washington is repositioning elements of the US Navy to the Pacific, engaging in “freedom of navigation patrols,” and providing assistance to Vietnam and the Philippines to monitor and defend their maritime territories. US leaders are regularly attending ASEAN-based meetings to demonstrate US commitment to Asia. President Obama regularly promotes the Tran-Pacific Partnership (TPP). Despite these advances, US presidential electoral politics are presenting new obstacles. Meanwhile, the US has urged caution with respect to the UNCLOS Arbitral Tribunal’s decision on the South China Sea. Human rights concerns continue to trouble US relations with Hanoi as well as Bangkok, Nay Pyi Taw, Vientiane, and Phnom Penh.

4547. Countering Adverse Tribunal Ruling

Tensions over South China Sea territorial disputes dominated relations throughout the summer months of 2016. Fearing that the UNCLOS Arbitral Tribunal case would go against China, Beijing took remedial steps in the lead-up to the July 12 ruling to show resolve to domestic Chinese constituencies and to counter international pressures. With the Tribunal’s award even more negative for China than most anticipated, Beijing’s attacks on the arbitral panel and warnings to neighbors and the US intensified. They were accompanied by shows of force in the South China Sea. Given the restraint of others, after a few weeks registering intense indignation, Chinese officials and commentary also moderated their rhetoric. Whether the Chinese shift to moderation was tactical or strategic remains to be seen. The Chinese onslaught was met with restraint and moderation in the region and on the part of other concerned powers. In contrast to the high tempo of large-scale US and US led-naval exercises and other military maneuvers in the South China Sea prior to the decision, there were no military actions signaling pressure on China in the weeks following the decision. Japan and Australia joined the US in restricting reactions mainly to official statements approving of the tribunal’s decision. The Philippines, the initiator of the case, inaugurated a new government on June 30 that was much more interested in seeking common ground with China. Given the restraint of others, after a few weeks registering intense indignation, Chinese officials and commentary also moderated their rhetoric. Whether the Chinese shift to moderation was tactical or strategic remains to be seen. Construction of hangers that could be used by military as well as civilian aircraft continued on the newly created land features now hosting modern aircraft landing strips on Chinese-controlled rocks and reefs in the Spratly Islands. Other infrastructure for Chinese occupation continued to be built. Chinese leaders from President Xi Jinping on down strongly reaffirmed China’s determination to defend its territorial claims, with China’s most senior foreign policy spokesperson, State Councilor Yang Jiechi telling Chinese media on July 14 that China “cannot lose one centimeter of inheritance left by ancestors.”

Since relations were reset following President Obama’s visit to India in January 2015, there have been three visits to the US by Prime Minister Modi. The US and India have also conducted two iterations of the Strategic and Commercial Dialogue (S&CD), exchanged multiple Cabinet-level visits, and announced new initiatives to broaden and deepen dialogue and produce outcomes. Over the past year and a half, the absence of drama has allowed for notable progress in the area of defense relations, but just as notably little progress on key trade and investment issues even as bilateral trade and investment grows. After three decades and three US presidents with strong commitments to the bilateral relationship, it remains to be seen whether a new US president will reciprocate Modi’s expressed and demonstrated interest in strong US-India relations. Since then, there have been three further visits to the US by Prime Minister Modi – in September 2015 for meetings at the United Nations as well as outreach to the Indian-American community and US business community, in April 2016 to attend the Nuclear Security Summit, and in June 2016 for a final summit with President Obama and a speech to a joint session of Congress. The US and India have also conducted two iterations of the newly-launched Strategic and Commercial Dialogue (S&CD) modeled on the US-China Strategic and Economic Dialogue, exchanged multiple Cabinet-level and senior officials visits, and announced new initiatives (e.g., upgraded UN and Multilateral Dialogue, Maritime Security Dialogue, consultations on Africa) to broaden and deepen dialogue and produce outcomes. During the period under review (March 2015 to September 2016), there have been no dramatic events similar to PM Modi being “unbanned” from visiting the US. The absence of drama has allowed for notable progress in the area of defense relations, but just as notably little progress on key trade and investment issues even as bilateral trade and investment grows. After three decades and three US presidents with strong personal and policy commitments to the bilateral relationship, it remains to be seen whether a new US president will reciprocate Prime Minister Modi’s expressed and demonstrated interest in strong US-India relations. Unlike divergences between the current two US presidential candidates on a host of foreign policy issues and in particular relations with the Asia-Pacific, statements and indications by the Clinton and Trump campaigns suggest a strong commitment to continued improvements in US-India relations. Both party platforms specifically address the importance of India, though it is noteworthy that the Republican platform raises issues about India’s commercial openness and the country’s treatment of religious minorities.

Since our founding in 1982, the work of the Korea Economic Institute of America (KEI) has progressed to reflect the evolving nature of United States-Republic of Korea relations. Though many of the issues on which we seek to raise public discourse have transformed over the years, the same natural convergence of values continues to underpin the understanding and trust between our two peoples. Upholding our commitment to positive change based on a strong foundation of shared interests, KEI was excited to have a new partner in 2016 for our Academic Symposium, through which we strive to be a bridge between the academic and policy communities. This year, KEI traveled to Atlanta, Georgia to host part of our Academic Symposium at the International Studies Association (ISA) conference. The annual conference features international affairs scholars from around the world with a wide range of research interests and regional specializations to present papers and discussions on contemporary issues in their fields. We were pleased to contribute two panels on recent significant developments in Northeast Asia. Moreover, for the first time as part of our Academic Symposium, two panels were held in our Washington, D.C. office along with the two in Atlanta. Although the setting for this year’s Academic Symposium may have changed, KEI again turned to the skills and insights of Dr. Gilbert Rozman, the emeritus Musgrave Professor of Sociology at Princeton University, to serve as the Editor-in-Chief for this Joint U.S.- Korea Academic Studies volume and as an advisor to KEI’s programs at the ISA conference. This collaboration has once more brought together an excellent group of scholars and practitioners. The experts in this volume have thoughtfully addressed large, challenging themes that are pervasive throughout Asia and important for the U.S.-Korea alliance. China’s rise has garnered much attention, yet in the academic literature Beijing’s security intentions in Northeast Asia have tended to be overshadowed, a topic addressed in the first section. Major developments in South Korea-Japan relations over the past year, particularly the December 2015 agreement to address the “comfort women” issue, have led the authors in the second section to explore how the interaction with the other country factors into the national identity of each. Over the past year we have witnessed an increase in provocations by North Korea, met with increasingly punitive measures from the international community targeting its access to outside markets. Key to understanding how effective these efforts can be are the economic relationships the DPRK has with its neighbors, discussed in the third section. The final section looks to how the regional economic architecture in East Asia might be shaped in the future, a particularly timely discussion as the fate of the Trans- Pacific Partnership remains uncertain as this volume goes to print.

At the Korea Economic Institute of America (KEI), we take pride in being able to connect people and ideas. In a globalized, networked world, connections are made constantly. It is often the ability to sustain those contacts, then collaborate and develop products or programs that makes meetings worthwhile. For KEI, one of our goals is to be a bridge between the academic community and the policy community. We want to be as an organization where information and ideas flow back and forth between the two sides. A main way we accomplish this goal is through our Academic Symposium. This year, KEI traveled back to my home state of Illinois for our annual Academic Symposium in conjunction with the Association for Asian Studies (AAS) conference. More and more, in a globalized, interconnected world, conversations about the importance of Korea and Asia are no longer just bridged between in Washington, DC and Seoul or any other foreign capital. Now various cities, states, and even Congressional districts can no longer ignore the trends in a rising Asia. Each year at our Academic Symposium, KEI tries to focus on key developments that are important for all of us to better understand. KEI again turned to the skills and insights of Dr. Gilbert Rozman, the emeritus Musgrave Professor of Sociology at Princeton University, to serve as the Editor-in-Chief for this Joint U.S.-Korea Academic Studies volume and as an advisor to KEI’s efforts with the AAS conference. This collaboration has once more brought together an excellent group of scholars and practitioners for this project. Both at the conference and in this volume, these experts have intelligently addressed large, challenging themes that are pervasive throughout Asia and important for the U.S.-Korea alliance. A major issue is how countries in Asia address their relationships with China and the United States. Often, China is the main economic partner for these countries while the U.S. provides the security and stability they need to thrive in a competitive Asia region. Another challenge is with North Korea creating more instability, causing the militaries in the region to make new calculations about North Korea’s capabilities and its capacity to create tensions that could quickly escalate into dangerous conflicts. Yet, even with the troubles North Korea provides at the nation-state level, we also wanted to better understand the growing implications for policy from the lives of the individual people living and interacting on the Korean peninsula and across the DMZ. This volume also discusses Korea’s and Japan’s development assistance efforts in Southeast Asia, which still raise questions about the ability for East Asian interaction and progressing in a way that benefits the countries themselves and the whole Asia region in a positive way. The connection between the academic and policy communities through the distribution of information about key issues in Asia permeates through this volume. Whether our connection with you is new or continuing, we hope you enjoy the 26th edition of the Joint U.S.-Korea Academic Studies volume and the excellent work inside.

An extraordinary series of meetings took place in 2016 to respond to perceptions of an unprecedented global refugee crisis. This policy brief traces the context and the results of these meetings and explores the common themes that emerged over the course of the year. The meetings examined include: the Supporting Syria and the Region Conference, held in London in February; the High-Level Meeting on Global Responsibility Sharing through Pathways for Admission of Syrian Refugees, held in Geneva in March, the World Humanitarian Summit, held in Istanbul in May; the Summit on Refugees and Migrants, held in New York on 19 September; and the United States (US) Leaders’ Summit, held in New York on 20 September. Although not all these meetings were technically ‘summits’, they all sought to mobilise attendance and commitments at the highest political level, and for this reason are referred to in this policy brief as ‘the summits of 2016.’ Four specific contextual factors set the stage for the summits of 2016. First, the United Nations (UN) had scored major successes in summits focused on development, climate change and disaster risk reduction in 2015. Secondly, the growing carnage in Syria and the inability of the international community to address it was a vivid backdrop to all of the summits. A third and related trend was the dramatic increase in requests for humanitarian funding. Donors had tripled their contributions to humanitarian appeals over a decade – and yet it still was not enough. Finally, the summits took place at a time of political change. The United Nations Secretary-General’s term was coming to an end. There were nasty politics in Europe with the rise of right-wing populist parties and the United Kingdom (UK)’s decision to leave the European Union. Xenophobic politics in the United States had led to a vociferous reaction to the resettlement of Syrian refugees. These all contributed to a sense that the system itself was not fit for purpose.

China is further developing its anti-access/area-denial (A2/AD) capabilities, particularly its submarine fleet and cruise missiles launched from land-based aircraft, to defeat an approaching enemy fleet. In addition to developing A2/AD capabilities, the People’s Liberation Army Navy (PLAN) is making concerted efforts to become a blue water navy. However, the PLAN faces some difficult challenges—both geographical and operational—in becoming an ocean-going navy. This paper considers the challenges the PLAN faces in the open ocean and the implications of these challenges for U.S.-Japan alliance cooperation.

In May 2014, the United States Department of Justice (DOJ) announced indictments against five Chinese People’s Liberation Army (PLA) officers on charges of cyber espionage directed against U.S. firms. According to the indictments, the five officers were assigned to the Third Office of the PLA General Staff Department (GSD) Technical Reconnaissance Department (alternatively known as the Third Department) Second Bureau. While assigned personnel may well engage in cyber espionage, a survey of Second Bureau infrastructure indicates a much broader communications intelligence mission.

In 2009, a militant Islamist group commonly known as Boko Haram began a campaign of terror across northeastern Nigeria with the main purpose of removing all Western influences and replacing the national government with an Islamic state. For more than a decade, the U.S. government has worked extensively with foreign governments to counter these types of acts around the world, often with mixed results. As such, interoperability, or the capacity of one element of the government to work with another, has become a critical component of America’s international relations and national security policies. As we transition from U.S. involvement in ground wars in Iraq and Afghanistan to monitoring civil unrest throughout the Middle East and Africa, American forces must continue to apply the fundamentals of counterinsurgency (COIN) and cultural operations to their roles within the evolving battlespace.

4561. Military Highly Enriched Uranium and Plutonium Stocks in Acknowledged Nuclear Weapon States

Plutonium and highly enriched uranium (HEU), called “fissile materials,” were first produced in large quantities for use in nuclear weapons. Starting in World War II, and for over two decades afterwards, almost all the plutonium and HEU in the world was produced for these immensely destructive weapons. This production was centered almost exclusively in five states: Britain, China, France, Russia, and the United States. In the Nuclear Non-Proliferation Treaty (NPT) these five countries are designated as “nuclearweapon states” because all five had manufactured and exploded a nuclear weapon prior to January 1, 1967. To this day, they remain the only acknowledged nuclear weapon states. Although other countries possess nuclear weapons, the acknowledged states have gained a special status in international affairs. As part of that status, however, these five states also committed to work towards nuclear disarmament, in particular steps accompanied by the elimination of their own stocks of fissile material for nuclear weapons. At the end of 2014, these five states had military stocks totaling about 238 tonnes of plutonium and 1,330 tonnes of HEU, mostly weapon-grade uranium (WGU is defined as HEU enriched over 90 percent). Table 1 provides a summary of the results. Tables 2 and 3, located at the end of the report, provide official declarations or detailed estimates of each country’s military plutonium and HEU holdings. These tables provide extensive endnotes describing official declarations, other sources, and the derivation of the various estimates. In addition to aggregate totals, tables 2 and 3 provide partial information about the various types of military stocks held by these five countries, including fissile material dedicated to nuclear weapons activities and naval propulsion programs, and declared excess to defense requirements.

Over the past five years, there have been repeated academic and media calls for greater Canadian engagement in the Asia-Pacific, with the Royal Canadian Navy taking the lead. Such engagement, it was claimed, was needed to reflect Canada’s increasing economic links, rapidly-growing personal ties to the area, and the deteriorating security climate, especially in the South China Sea. Despite government claims that Canada “gets it” as to the importance of the region, little of consequence has occurred and our Navy’s Atlantic dominance remains. For this and other reasons, Canada is now widely considered “absent” from the region. This paper argues that this cannot safely continue as both our security and our access to the rapidly growing Pacific economies will be at risk. The paper then examines our history in the area, the 2011 U.S. “Pacific pivot,” our own weak “mini pivot,” and the current security situation before providing detailed recommendations for greater Canadian naval engagement.

The last decade has seen serious setbacks to the global role of the United States. Iraq, Afghanistan and the 2008 economic crisis provoked deep partisan debates about American policy but little in the way of consensus on how to respond. Meanwhile, America’s rivals have gained strength and a new south-south economy of investment and trade has emerged. There is little disagreement that the U.S. has lost its relative power to influence developments around the world. Is this Canada’s moment to extend our global influence? Canada’s privileged geography gives us freedom to choose where and how to engage beyond North America. We have opportunities across the Atlantic and across the Pacific, as evidenced by our simultaneous negotiations at the CETA and TPP tables. But freedom of choice means we have trouble committing to relationships beyond North America. Unlike, say, Australia, which must engage in the Pacific, we face no natural imperative to be “all in” in Asia. Moreover, even though Canada does not have a history as a colonial power, we are often ambivalent about engaging with the new global south. We prefer to deal with emerging economic powers through clubs we already belong to - the G-20, the Commonwealth and the Francophonie. But as south-south institutions displace the influence of the “world America made”, the room for Canada to exercise global influence has declined. We were once welcome as a dependable joiner of international clubs, but we are having trouble joining newer, more dynamic clubs like the Pacific Alliance.

Conventional wisdom is that trade policy is often guided by geopolitical security considerations. A growing body of research addresses the security–trade linkage as a plausible cause for executive negotiations over the Korea–US Free Trade Agreement (KORUS FTA) in 2007. Yet, the approval of a trade deal with the Asian ally by America's legislature in 2011 features not only ‘security ties’ but also ‘electoral connections’. This paper seeks to examine the question of whether alliance relationships would inevitably translate into domestic commitments. Bringing domestic politics into consideration, this article also fills the gap in the literature on Congress-focused research of the KORUS FTA and sheds light on how lawmakers strike a balance between the principle of US foreign policy and the reality of conflicting domestic interests.

“A rising India offers one of the most substantial opportunities to advance American national interests over the next two decades,” asserts a new Independent Task Force report sponsored by the Council on Foreign Relations (CFR), Working With a Rising India: A Joint Venture for the New Century. Over the past ten years, India, the world's largest democracy, has lifted more than 130 million people out of poverty. The country has rebounded from a recent economic growth slump, surpassing China this year to become the world's fastest-growing major economy. “If India can maintain its current growth rate, let alone attain sustained double digits, it has the potential over the next two to three decades to follow China on the path to becoming another $10 trillion economy,” notes the Task Force. With Indian Prime Minister Narendra Modi's prioritization of economic growth and foreign policy revitalization, the country now has a window of opportunity to either make the necessary reforms or risk being left behind. “[India] will have to decide whether it wants to become a major part of global trade flows and deeply integrated into global supply chains. Doing so would boost India's efforts to grow its manufacturing sector and its economy; choosing not to will make that ambition harder to achieve.” Because India does not seek an alliance with the United States and closely guards its policy independence, U.S.-India relations will not resemble those Washington has with its conventional allies. For that reason, the Task Force recommends that “U.S. policymakers [should] explicitly emphasize a ‘joint-venture’ model for U.S.-India relations, focused on a slate of shared pursuits on which interests converge—and with clear mechanisms for coordinating and managing the known and expected disagreements.” The bipartisan Task Force is chaired by Charles R. Kaye, co-chief executive officer of the private equity firm Warburg Pincus and former chairman of the U.S.-India Business Council, and Joseph S. Nye Jr., distinguished service professor and former dean of the Harvard Kennedy School. Directed by CFR Senior Fellow for India, Pakistan, and South Asia Alyssa Ayres, the Task Force is composed of sixteen prominent experts from government, academic, nonprofit, and other sectors.

Abstract:
In the years preceding the 2007-2009 financial crisis, forward-looking indicators of bank risk concentrated and suggested unusually low expectations of bank default. We assess whether the ex-ante (i.e. prior to the crisis) cross-sectional variability in bank characteristics is related to the ex-post (i.e. during the crisis) materialization of bank risk. Our tailor-made dataset crucially accounts for the different dimensions of realized bank risk including access to central bank liquidity during the crisis. We consistently find that less reliance on deposit funding, more aggressive credit growth, larger size and leverage were associated with larger levels of realized risk. The impact of these characteristics is particularly relevant for capturing the systemic dimensions of bank risk and tends to become stronger for the tail of the riskier banks. The majority of these characteristics also predicted bank risk as materialized before the financial crisis.

Abstract:
Relationships between firms and their foreign suppliers are the foundation of international trade, but data limitations and reliability concerns make studying such relationships challenging. We evaluate and enhance supplier information in U.S. import data and present new facts about importer-exporter relationships. Count of foreign exporters from U.S. import data tends to exceed those from source country data, especially from China. The pattern of U.S. imports from origin countries changes substantially by tracing trade back to the supplier's location instead. Related-party relationships trade more, while larger countries have more relationships.

Pakistan relations with China remain a cornerstone of Pakistan’s foreign Policy. Their common views, perceptions, approaches, and policies at the regional and global level made them a durable friends, allies and partners. Their hostility towards India, their support each other in wars against India, and the conclusion of different agreements further strengthened their bilateral mutual relations between these two countries. And above all, China’s moral, diplomatic, political, financial, and military support since 1971 proved a great source of consolation and encouragement to Pakistan in the difficult hours. In the changing global scenario since 9/11, witnessed drastic improvement in Sino-Pak military and strategic relations. Exchange of visits by high leaderships and other dignitaries, their growing coordination in Indian Ocean, Arabian Sea, Persian Gulf and Gwadar, the signing of naval and military agreements, their missiles and nuclear cooperation, provided both the countries with opportunity to counterweight India’s growing hegemony and supremacy. On her part, India is trying its best to frustrate the growing Sino- Pak Defence nexus by using a variety of tactics in order to protect and safeguard her interest in the region.

In 2014, the Syrian conflict that has so beguiled the international community spilled over into Iraq, with the swift and shocking rise of the Islamic State in Iraq and al-Sham (ISIS). ISIS is causing the ever-complex alliances in the region to shift in peculiar ways. In Iraq, US airstrikes provide cover for Iranian-backed militias fighting ISIS; while in Yemen, the United States supports a Saudi intervention against a different Iranianbacked armed group that has taken control of the Yemeni capital. Meanwhile, simmering political disputes in Libya escalated into a full-blown civil war, sparking concern in neighboring Egypt, where the old authoritarian order remains in control despite the country’s popular revolution. The Gulf countries contemplate their responses to record-low oil prices, continuing negotiations between the United States and Iran, and the threat of ISIS. And Tunisia remains one of the region’s only bright spots. In November, Tunisians voted in the country’s first free and fair presidential elections. This year’s Journal brings new analysis to many of these complex events and broader regional trends. We begin with the positive: an exclusive interview with former Tunisian Prime Minister Mehdi Jomaa. Tamirace Fakhoury points out a blind spot in the study of the Middle East and North Africa: how large diaspora communities affect political dynamics in their home countries. Farouk El-Baz takes us to Egypt, where he proposes a grand economic plan to pull the country out of poverty and set it on a path toward longterm growth. From Egypt, we move west to the oft-neglected country of Algeria, where Kheireddine Bekkai argues for more inclusive education policies on national identity. Finally, Amira Maaty comments on the region’s desperate need for robust civil societies, while Sarah McKnight calls for improvements in Jordan’s water policies.

The role of seapower in nurturing American security and prosperity has long been exaggerated, if not wholly misrepresented. Throughout the nineteenth century, the nation’s first generations of leaders exhibited a healthy skepticism toward free trade and the maritime hegemony of the British Empire. By focusing on domination of the country’s littoral space during the Civil War, the U.S. Navy succeeded in shielding the Union from European interference. It was not the assumption of the British mantle that safeguarded the nation; rather, U.S. preeminence was secured by rejection of maritime overreach. Strong anti-British tariffs and industrial protectionism were the cornerstones of sustained commercial growth and genuine national independence. The unique problem with seapower, even in the contemporary period, is how easily we can glorify it. We love the sea, and mighty ships, and we tend to flaunt what we love, but this relationship has no place in a grand strategy that acknowledges the limited historical contribution of free trade to the American economy.

Over the last 14 years of war, our military developed incredible relationships both within and outside the Department of Defense. The concept of the Joint Force reached its full potential as we relied on one another in places such as Iraq and Afghanistan. We learned how to effectively integrate the talents of our Special Operations Forces and conventional forces on the battlefield. We integrated with other government agencies on the battlefield, ranging from the CIA to USAID, moving the concept of “one team, one fight” forward. We even worked closely with non-governmental organizations (NGOs) and humanitarian organizations, often finding ourselves in similar areas with similar goals. As we continue to downsize in Afghanistan and our efforts in Iraq remain at the advisory level, my biggest fear is that we forget the lessons we have paid for with the blood and sweat of our brothers and sisters. It is absolutely critical that the military retain the myriad lessons learned from these 14 years for future conflicts. Toward the goal of capturing important lessons learned, Transparency International UK’s Defence and Security Programme has published the valuable handbook, “Corruption Threats and International Missions: Practical Guidance for Leaders.” This well-written and easy-to-use document will be invaluable to leaders of any organization conducting operations in areas where corruption exists, but especially for our military leaders of today and tomorrow.

​ The United States and Saudi Arabia lavished money and weapons on unsavory characters during the anti-Soviet jihad of the 1980s, giving little thought to the possibility of a blowback or boomerang effect—that they would in effect be funding and arming their future enemies. It is indeed ironic that the principal bankrollers of the jihad later became the main targets of offshoots of that jihad. A non-negligible part of the money and weapons sent by the United States to Iraq, in particular as part of the “Sunni awakening”, is now in the hands of extremists.With the near-exclusive focus on military developments, the financial front of the war on terror is all but ignored. This article traces the evolution of checkbook diplomacy in conflicts involving the Islamic world.

The U.S. Strategic Rebalance to Asia – also known as the “Asia Pivot” – has been a cornerstone of the Obama administration’s foreign policy since 2011. Hillary Clinton offered a detailed explaination of the concept in a 2011 Foreign Policy article.[1] The basic idea behind the Rebalance is that many U.S. core economic and security interests are increasingly centered in the Asia-Pacific region, so the United States needs to allocate more diplomatic, economic, military, and other assets towards the region. The Strategic Rebalance would do just that. The Defence Strategic Guidance relaeased by the Defence Department in January 2012 made supporting the rebalance a key Pentagon objective. The Obama Administration accordingly plans to increase the percentage of naval assets in the Pacific to 60 percent by 2020[2] in addition to stationing 2,500 Marines in Darwin, Australia, and 4 littoral combat ships in Singapore.[3][4] Given the region’s economic importance, this makes sense. The Asia-Pacific region accounted for 40 percent of global economic growth in 2013. In 2012, the U.S. exports to the region totaled $555 billion, which supported 2.8 million U.S. jobs.[5]

4582. Accountability for Armed Contractors

On 16 September 2007, the accountability of private armed contractors became a global concern. A team of armed guards from the US company Blackwater Worldwide, operating on a US State Department contract, opened fire that day in Baghdad’s Nisor Square, killing seventeen Iraqi civilians and injuring an additional twenty. It took more than seven years before four of the individuals responsible were ultimately convicted of either first degree murder or voluntary manslaughter by a jury in a U.S. Federal District Court. A fifth member of the Blackwater team had previously pleaded guilty to manslaughter.[1] The initial lack of consequences and the slow speed of justice provided the watchful world with strong evidence that armed contractors operate in a zone of legal twilight, devoid of accountability. ​ The rise of private armed contracting was one of the most distinctive operational developments of the wars in Iraq and Afghanistan. Erik Prince, founder of Blackwater, famously stated: “Our corporate goal is to do for the national security apparatus what FedEx did to the postal service.”[2] Throughout both conflicts, the hiring policies of several Western governments, particularly those of the United States, helped Blackwater and numerous other companies move toward that goal. By December 2008, for example, 69% of the United States’ total force in Afghanistan was comprised of private contractors, roughly 15% of which were armed.[3] While there are no reliable statistics on the size of the global private armed security industry, there is little doubt that it has grown and contracted with the surge and decline of Western engagement in armed conflict. New conflicts on the horizon, however, suggest the possibility of a resurgence of the industry, reigniting concerns about accountability. The proliferation of private armed security companies has coincided with a proliferation of initiatives aimed at developing accountability for the industry. Numerous codes, standards, mechanisms and proposals – developed by governments, international organizations, civil society groups, private companies, trade associations, individuals, academics and multi-stakeholder bodies – have sought to address different issues surrounding armed contractors. Most of them, however, have been developed in response to incidents that already occurred. This reactive approach to accountability, while useful for addressing past problems, may leave the industry exposed to future problems. In other words, a code, standard or mechanism set up to prevent another Nisor Square incident may be very effective in doing so, but may fail to prevent a different and even more worrying incident in the future. This article begins with a brief overview of the most credible accountability initiatives, suggesting that the resulting collection forms a patchwork, rather than a framework for governing the conduct of armed contractors. The analysis then focuses on the process of selecting contractors, with a particular emphasis on the US Government. While cost has been a key factor in determining selection, the various initiatives discussed have made it possible for accountability and quality to be added as essential metrics. Ultimately, however, the failure of the accountability initiatives to remain current, much less forward-looking, means that the objective determinants of ‘accountability and quality’ may not be fit for purpose as the US and other Western powers begin to engage the services of armed contractors for assistance in new conflicts...

On the eve of the Second World War, the noted journalist John Gunther could still maintain that: “Great Britain, as everyone knows, is the greatest Asiatic power.”[1] The British Empire in Asia controlled a vast territory and large population, sweeping in a great arc from New Zealand and Australia in the South Pacific, to Southeast Asia and South China, and on to India and the Middle East. Britain stood as a superpower with economic interests and security commitments stretching around the globe, much as the United States stands today. That position of leadership, however, was endangered. The emergence of major new industrial great powers was transforming the international landscape. These challengers, as they converted their growing economic strength into military power, confronted Britain’s leaders with uncomfortable strategic choices. In Asia, one of those rising challengers, imperial Japan, posed a dangerous threat to Britain’s standing as a world power after it embarked on a policy of expansion. We know the outcome of Japan’s challenge: war and the catastrophic breakdown of Britain’s standing in Asia. The collapse of British power was in part brought about by dynamic changes in technology and the lethality of modern weaponry, particularly the advent of naval aviation, which shifted the naval balance in Japan’s favor. On the eve of war, Britain sought to deter Japan by forming a naval force in the Pacific, known to history as Force Z, consisting of the battleship Prince of Wales and battle cruiser Repulse. Even as Force Z steamed eastward, the Admiralty could spare none of its aircraft carriers, to protect it from air attack. Nor did the Royal Air Force have enough modern aircraft based in the Far East to offer adequate protection for Force Z. Britain’s inability to control the skies meant the Royal Navy could not command the seas, and this permitted the Japanese to land ground forces in Malaya and seize Singapore, the strategic pivot of British defenses in Asia. Not since Yorktown had Britain suffered such a crushing setback. The world’s leading naval power had been bested by a challenger that exploited innovations in technology and doctrine to gain a marked qualitative edge in fighting power.

4584. North Korea: The Myth of Maxed-Out Sanctions

On December 19, 2014, President Obama publicly blamed North Korea for the cyberattack against Sony Pictures and for the subsequent cyberterrorism against the American people, and promised to "respond proportionally." Almost immediately thereafter, one could hear a familiar narrative repeated, typified by New York Times correspondent David Sanger, who wrote that "North Korea is under so many sanctions already that adding more seems futile." One could have heard similar arguments in 2006, after North Korea's first nuclear test, and in 2013, after its third nuclear test. A variation of this argument is that “Washington … can do little ... without the cooperation of China.” ​ For years, journalists have quoted “experts” who insisted that U.S. sanctions options against North Korea were exhausted and had failed as an instrument of policy. As a matter of both fact and law, however, that is false; it even suggests that these experts have not read and understood the sanctions authorities. Why does this view persist, then? Some scholars may accept and propagate it because they oppose sanctions as a matter of policy. Others have simply ceased to question a myth that has entered the received wisdom. A true understanding of the potential effectiveness of sanctions first requires an understanding of what these sanctions are, what they are not, and how they work. This article will first summarize the sanctions authorities – U.N. Security Council resolutions, and the U.S. sanctions that should be an important part of the effective enforcement of the measures that the U.N. Security Council has adopted. It will also explain the role of the Treasury Department in regulating the international financial system, and the power this gives the United States to isolate the North Korean government from that system. It will explain which U.S. and U.N. sanctions against North Korea have succeeded and failed, and why. Finally, it will explain what current U.S. national sanctions do, and what they do not do. Only after one understands how little the current sanctions do – and how much they could do – can one begin to understand how to strengthen them into an effective part of a coherent foreign policy... ​

Professor Martel, author of Grand Strategy in Theory and Practice: The Need for an Effective American Foreign Policy, offers three guiding principles for U.S. grand strategy: rebuilding domestic foundations of power; exercising American leadership to restrain sources of disorder that directly threaten U.S. vital interests; and forging both alliances and partnerships to confront the most pressing threats to global stability.[2] The last of Martel’s three principles foreshadows the three cyber security activities at the heart of the newly released U.S. Department of Defense Cyber Strategy. The three activities around which the new U.S. DoD cyber strategy revolves are: Information sharing and interagency coordination; building bridges to the private sector; and building alliances, coalitions, and partnerships abroad.[3] These three coordinating and collaborating activities are the key to building relationships between actors influencing the development of the cyber domain, and are necessary to identify and counter threats. To advance global cyber security, the Cyber Strategy suggests the U.S. must “build and maintain robust international alliances and partnerships to deter shared threats and increase international security and stability.”[4] As part of this effort, the United States seeks to build security relationships to respond to shifts in the international environment, including sources of disorder. These relationships are built upon trust and cooperation of many actors with varied interests and objectives in cyberspace. The Cold War ended rather suddenly in 1991. With it went the model on which the United States’ maritime strategy of the 1980s had rested. Driven by individuals like John Lehman, President Ronald Reagan’s long-time Secretary of the Navy, that series of strategic documents promulgated a forward, offensive, counter-force approach and the famous ‘600-ship Navy’ force structure. With the formal dissolution of the Soviet Union on December 25, 1991, the sole challenger to U.S. naval power vanished practically overnight. Red Fleet warships were rusting away in port or dismantled altogether. In the United States, the military lost significant human capital through a number of force reduction rounds, which reflected how the U.S. Navy could and would take on the post-Cold War world intellectually. In the wake of this strategic recalibration, allied militaries and their navies—such as the Federal German Navy, soon to be renamed German Navy—also underwent substantial transformations. These were often guided by the shifting geopolitical landscape as well as the popular desire to reduce the inflated defense budgets of Cold War days in order to obtain a peace dividend. This analysis will focus on the Eurasian theater—very broadly speaking, the waters that surround the European and Southwest Asian landmasses[1]—in U.S. and German naval strategy between 1991 and 2014. The maritime sphere has become increasingly important as a domain of emerging security since the end of the Cold War, yet comparatively little time and resources are being devoted to research on naval strategy and relationships between allies at sea. As a result, the use of naval force for political and diplomatic ends and the dynamics of maritime geopolitics have suffered. This essay seeks to underline the challenges that have confronted the U.S. Navy in the past generation and analyze their long-term effects. While the U.S. Navy’s geographic focus and operational interests have increasingly shifted from Europe to the Middle East and Asia, and from control of the “blue water” high seas to the littorals, these key interests should not be overlooked. In the view of the author, the fall of the Soviet Union and the implication that allies like Germany would do more to patrol their own maritime neighborhood provided the U.S. Navy with a convenient reason to de-emphasize their previously highly valued naval hub in the Mediterranean Sea. In rebalancing from the Sixth Fleet area of responsibility (AOR) to other regions of the world, the U.S. Navy accepted the consequences for fleet design and ship numbers, perhaps willingly using it as a bargaining chip for force reduction rounds in Washington, D.C. Implicitly, European allies and the U.S. Air Force[2] were expected to fill the gap left behind in terms of naval presence and crisis response, in particular after the successful campaigns in the Adriatic Sea in responding to unrest and war in the Balkans. European allies, however, were largely uninterested in stepping up to the plate; they considered their near abroad safe enough. Most importantly, they were somewhat wary of delivering a combined ‘pocket Sixth Fleet’ of their own. Finally, they were preoccupied with managing German unification, enlargement of the European Union, and establishing a common market and currency, among other things. Accordingly, this paper sheds a light on some key German strategic documents for a time when the reunited country sought its new place in the security environment of the post-Cold War world. By taking a unique view from Germany, one of the U.S. Navy’s premier NATO allies, this analysis also considers the transformation of the Bundesmarine from an escort navy to an expeditionary navy.[3] It seeks to conceptually explain how Germany’s security policy addressed the maritime challenges of the new era. The German Navy was principally drawn south- and eastward geographically after 1991, usually in close cooperation with other allied and friendly navies (and mandated by NATO, the EU, or the UN).[4] It was increasingly asked to address maritime security challenges to which the U.S. Navy no longer, or only in a supporting role, responded. The German Navy went into the breach with what were essentially Cold War assets and a mindset fundamentally dominated by the inability to think strategically. This paper is split into two sections. The first section discusses the 1991-2001 timeframe and the second section covers the period from 2001-2014. 2001 marked the inauguration of President George W. Bush in January and the terrorist attacks on September 11 eight months later. On March 12, 2003, a week before the invasion of Iraq, a Principals Committee meeting of the National Security Council was held at the White House to formally decide the fate of the Iraqi Army.[1] The participants, having all received extensive briefings on the subject prior to meeting, voted unanimously and with little discussion that after disbanding the Republican Guard, the “regular soldiers” of the Iraqi Army would be called “back to duty.”[2] In spite of this decision, on May 23, 2003, L. Paul Bremer III—President Bush’s “special envoy” in Iraq—announced Coalition Provisional Authority Order No. 2, “Dissolution of Entities.” Among the relevant entities to be dissolved by the decree was the Iraqi Army.[3] In an interview with the journalist Robert Draper at the end of his presidency, President Bush commented on this apparent dissonance when he remarked, “The policy was to keep the army intact; didn’t happen.” When asked further of his reaction when he found out about the decree, Bush replied, “Yeah, I can’t remember, I’m sure I said, ‘This is the policy, what happened?’”[4] Having endured significant criticism over CPA Order No. 2, Mr. Bremer was quick to defend himself, providing letters to The New York Times to and from the president “in order to refute the suggestion in Mr. Bush’s comment that Mr. Bremer had acted to disband the army without the knowledge and concurrence of the White House.”[5] Such a puzzling exchange over such an important topic serves to illustrate a larger point. That is, despite its centrality to America’s involvement in Iraq, from the emergence of the insurgency onward to its current conflict with ISIS, it still remains unclear how and why the decision to disband the Iraqi Army was made. In this paper, I demonstrate that the impetus for CPA Order No. 2 came from the prominent Iraqi exile Ahmad Chalabi, and was carried out under the authority of Vice President Richard “Dick” Cheney by a small group of Chalabi’s supporters in the Office of the Vice President and the Pentagon. I do so first by establishing the lengths to which those in the vice president’s office, in concert with like-minded officials at the Defense Department, were willing to go in order to support Chalabi, who favored disbanding the army. For at least a generation, conflict resolution has been predominantly the domain of international development practitioners seeking to use their skills and tools to avert war and reduce the suffering of civilian populations. More recently, the U.S. military added similar exercises to its planning efforts, primarily for the strategic purpose of reducing its own potential future deployments around the world. Working occasionally in parallel and at other times seemingly at cross-purposes, the military, donors and non-governmental organizations have begrudgingly come to accept that in any given crisis each can play a role. The nature and extent of each actor’s role depends on the circumstances and the severity of the situation. As the military concludes the longest war in U.S. history in Afghanistan, and as pressure mounts to intervene in additional conflicts in the Middle East, it is worth examining what role development can play in reducing that pressure, who should be responsible for providing that assistance, and what form it should take. For the past two decades, the United States military and the national security apparatus have focused their energy and capabilities on confronting Islamic terrorism as a kinetic target. Much of U.S. counterterrorism policy today consists of lethal raids and unmanned aerial vehicle strikes against targeted individuals. The U.S. government has come to rely heavily on the Special Operations Forces (USSOF) in particular for lethal raids, also termed “Direct Action” assaults, one of the ten “Core Activities” that Title X identifies for USSOF. Unfortunately, Direct Action has come to overshadow the broad array of missions that USSOF was originally intended to conduct. Unconventional Warfare, for example, is a core USSOF mission intended to prevent radical ideology from taking root in a society with a range of activities to build local good will towards friendly forces and animosity towards extremists. The U.S. can more effectively incorporate USSOF into a “whole-of-government” approach to counterterrorism by refocusing attention on non-kinetic, counter-ideology operations. To move beyond the recognized battlefields of the past decade, U.S. officials must embrace a multidimensional operating environment that requires simultaneous focus along multiple lines of effort. Future warfare will include complex, adaptive systems of ideology, economy, physical infrastructure, governance, and energy — which cannot be defeated through kinetic operations alone. The USSOF will need to transform its operations accordingly. During the last two decades of the twentieth century, a paradigm shift occurred in the realm of transnational terrorism and how nations responded to it. Shifting away from a focus on political goals, transnational terrorist groups began using religion as a motivating factor — both in their operations and in their recruitment. This new form of terrorism required a shift in response from the international community. It took the West almost a decade to recognize this shift and adjust its response to the emergent threat. Following 9/11, the United States fully engaged Special Operations Forces and paramilitary elements to actively counter this new religious ideology. SOF and paramilitary units were tasked to conduct raids against members of radical extremist groups. However, after almost 15 years of continuous warfare, the U.S. has arguably experienced limited success with its counterterrorism efforts as groups continue to conduct attacks and grow, gaining notoriety and establishing affiliated movements around the globe. Kinetic actions have created an entire generation of potential radicals who are victims of our counterterrorism “successes.” Populations sensitive to radicalization are also vulnerable to state-level terror in the form of unexpected and unpredictable military strikes. The battle against terrorism to date leaves the question, “As the United States looks to the future operating environment, can the Special Operations community find a more effective method to counter the ideology that creates the modern Islamic terrorist?” Since 2001, the West has increasingly focused on lethal targeting of individuals within religious-based extremist organizations. This method of conducting kinetic operations — either through direct action assaults by military or paramilitary units, or through the use of missile strikes from aerial platforms — has become the public face of the United States counter-terrorism effort. While the United States military has arguably raised man-hunting of individuals from an imprecise task to a methodical science, targeted lethal actions are nonetheless perceived as little more than indiscriminate state-level terror within the populations in which the operations are conducted. Looking to the future operating environment, the current policy of countering terrorist actions with targeted killing is unlikely to sway the underlying ideology in Americans’ favor. As such, it is necessary to develop a sustainable counterterrorism strategy that considers the human domain of local opinion as the future battlefield. The Special Operations Forces of the U.S. military will play a central role in any long-term strategy to counter violent extremist organizations; they are specifically designed to create a counter-ideology within the scope of unconventional warfare. Before looking at the role of U.S. Special Operation Forces within this emerging strategy, an understanding of the changing nature of warfare within a complex environment is necessary. Moving forward in the concept of developing a long-term counterterrorism strategy beyond the use of kinetic operations, we must understand that Islamic extremism is rooted in an ideology the West has displayed overt ignorance of and has been unprepared to counter. As stated by Patrick Sookhdeo, “Equally damaging has been the desire for a quick-fix and the reluctance to engage in a long-term struggle against the ideological struggle that nourishes and promotes Islamist terrorism.”

Winning a war requires the capacity to wage a war and an understanding of an end-state that equates to winning. These fundamental concepts, however, are not well defined. This essay draws from recent historical examples, contemporaneous strategy documents, and formal game theory to provide some additional degree of conceptual clarity that will enhance the debate about winning without war. In the past two decades, the U.S. has developed a demonstrated capacity to win with war. Victory in kinetic war fighting is nearly assured and can be accomplished with limited cost. Despite this, in the modern context, war has evolved to the point that war is not worth winning. It is far from the case that there are no wars to be fought, but the political and economic constraints of the international system have transformed the environment in which the U.S. operates militarily. Evidence of this is found in the strategic outlook of the U.S. military as documented in the revised U.S. naval strategy, especially when compared to earlier maritime strategy. To inform this discussion, game theoretic explanations of strategic interactions are helpful. The assumptions underlying recent U.S. naval strategy can be understood by applying the basic construct of a “game of strategic entry." Applying this construct, one finds that war is not worth winning– a conclusion that has substantive consequences for designing, organizing, and employing naval forces.

The United States and the People’s Republic of China (PRC) are firmly entrenched in what will be a long and intense strategic competition for dominance over the Pacific Rim. American strategists Andrew Marshall, Robert Kaplan, and Aaron Friedberg began foretelling of this great power struggle over a decade ago.[1]. They recognized before anyone else that there are strong forces underpinning the U.S.-China rivalry. The two countries’ political systems and national interests stand in fundamental opposition. This is why, despite Washington’s reluctance to officially admit it, strategic competition between the U.S. and the PRC is unavoidable. ​ The United States, while an imperfect democracy, is an inspiration to people everywhere who yearn for the freedom and dignity that comes from having a representative government, independent legal system, and market economy. In the PRC, on the other hand, power is monopolized by the Chinese Communist Party (CCP), a political organization that is directly responsible for more human suffering than possibly any other regime past or present, anywhere in the world.[2] Numerous State Department reports detail the past and continuing human rights violations occurring under the watch of the CCP.[3] ​ For all its much ballyhooed economic reforms, China’s economy is still largely controlled by massive state-owned corporations, making it a mercantilist country, not a capitalist one.[4] Much of Beijing’s economic power ultimately stems from its remarkable ability to lure foreign business elites with promises of access to its huge market. Once the hook is set, China pockets their investments, steals their intellectual property, and undercuts their market competitiveness.[5] ​ Yet it is not the PRC’s unsavory political or economic practices that will ensure sustained U.S.-China competition over the coming decades, although future American presidents, like Barack Obama, will undoubtedly be tempted to paper over ideological differences for expedience sake. Rather, Beijing’s insecure and aggressive nature is at the root of the problem. In recent years, China has stoked maritime tensions with Japan and the Philippines, both treaty allies of the United States; provoked border clashes with India, a democratic nation and American security partner; and enabled nuclear missile proliferation amongst its friends: North Korea, Pakistan, and Iran.[6] Track records tell a compelling story. As early as March 2011, the journal Aerospace America featured an article with the title “China’s Military Space Surge,”[1] which warned that there had been a rapid increase in China’s capability to conduct warfare in space. Such capabilities would then in turn threaten and jeopardize the ability of the carrier battle groups of the United States to conduct operations in the Pacific. This article was soon translated into Japanese and published in Space Japan Review. This and other high profile articles highlight the anxieties on the part of the U.S. and Japan about China’s increasing ability to militarize space, and also their concerns about its implications for the peace and security of East Asia and the entire Pacific Asia region. On December 31, 2015 China announced the creation of three new branches of armed forces to be added into the reformed People’s Liberation Army (PLA): Army General Command, Strategic Support Force, and the PLA Rocket Force. While the PLA Rocket Force replaced the old Second Artillery Corps, what is even more intriguing is the mission of the new Strategic Support Force. According to Chinese media, the Strategic Support Force will be responsible for overseeing intelligence, technical reconnaissance, satellite management, electronic warfare, cyberwarfare, and psychological warfare. It is no coincidence that Gao Jin (高津), the newly appointed commander of the Strategic Support Force, is also an expert on rocket science, which has further fueled media speculations that the Strategic Support Force has been created for the purpose of conducting future space warfare.[2] In fact, China has been increasing the focus on the military applications of space since the end of Persian Gulf War in the 1990s. During that war, the United States mobilized dozens of satellites to aid the American-led coalition forces, enabling them to defeat Iraqi forces with extraordinary efficiency and ease. The Persian Gulf War greatly shocked PLA observers at the time, and served as a reminder that the conduct of modern warfare had been transformed by the arrival of a new generation of technology. Chinese military theorists then began to study the concept of “space warfare.” The most influential was Chang Xian-Qi (常顯奇), who categorized space warfare into three distinct phases based on his observations of U.S. planning: the “Entry into Space,” the “Utilization of Space,” and the “Control of Space.” “Entry into Space” is represented by the delivery of a military-purpose spacecraft into its designated orbit path. “Utilization of Space” is to harness the power of existing space assets to aid military operations across the land, naval, and air domains. For example, such power can manifest in the forms of using space sensors to conduct surveillance and gather intelligence for Anti-Access/Area Denial (A2/AD) against potential foes, to provide ballistic missile early warning, satellite navigation and communications, among other purposes. The “Control of Space” phase focuses on establishing “space superiority” with the missions of: (1) increasing survivability of one’s own military satellites and systems; (2) disrupting, sabotaging, or destroying opposing countries’ satellites and their systems when necessary; and (3) directly using space-based weapons to aid in combat operations on the ground.[3]...

4597. China’s United Front Strategy and its Impacts on the Security of Taiwan and Asia-Pacific Region

In 1949, Mao Zedong, leader of the Communist Party of China (CCP), defeated Chiang Kai-shek’s Kuomintang (KMT) troops and succeeded in establishing the communist dictatorship of the People’s Republic of China out of the “barrel of a gun.” At the beginning of its rule, the CCP believed that the use of violent instruments as provided by the People’s Liberation Army (PLA) was in and of itself sufficient to both suppress “reactionaries” at home and defeat “invaders” from abroad. ​ In this vein, during the Korean War of the early 1950s, the CCP regime sent a million-strong “Volunteer Army” into the Korean Peninsula and fought against the U.S.-led United Nations forces, thus cementing the political division of Korea and its complications that linger to this day. Between 1958 and 1960, PLA troops heavily bombarded the Chiang Kai-shek-controlled island of Kinmen, resulting in significant casualties on both sides. Between the 1960s and 1980s, the PLA and militia troops engaged in a series of border conflicts and clashes with the Soviet Union, India, and Vietnam. Throughout this period, the CCP regime still believed that military force alone was sufficient to serve as the primary bargaining chip and policy instrument in its dealing with other states.[1] ​ However, from the late 1980s to 1990s, the collapse of Soviet Union and Eastern Bloc marked the end of Cold War and the confrontation between two global superpowers. The CCP’s strategy in the international arena evolved from an overreliance on hard military force to one that utilizes both “soft power” and the “carrot and stick.” ​ From the Chinese perspective, the concept of “soft power” encompasses the exploitation of any policy or tool outside the traditional definition of “hard” military power to achieve its desired political, economic, and diplomatic objectives. Such exploitation takes place via political, societal, commercial, economic, legal, psychological, cultural, and other means. Mass media and even tourist groups could all be used as a means of penetration to funnel and support Chinese agents deep inside enemy territory and to create conditions that are conducive to achieving China’s desired outcome. This is the essence of China’s strategy of the “United Front.” ​ This article examines the United Front strategy and the ways in which China’s deployment of this strategy impacts the national security of Taiwan as well as neighboring countries such as Japan, Vietnam, the Philippines, and even the United States.[2] The article concludes with proposed policy recommendations for how Taiwan can counter such strategies...

While an ongoing struggle for dominance over the Northern Sea Route and Northwest Passage and competing continental shelf claims may reflect these tensions, tit-for-tat military exercises and plans for expanded military infrastructure in the Arctic certainly do. The Russian government recently announced completion of a new military base in Franz Josef Land capable of supporting 150 soldiers, as well as its intention to rebuild six existing airfields. While such a nominal increase in military personnel posted to the Arctic may merely be seen as a posturing act, taken in context with Russia’s recent actions in Europe and the Middle East, it might also be seen as a bold move to project power from a previously overlooked region.

Abstract:
Until last year, drilling for oil in the Arctic was the subject of considerable discussion focused not only on the potential impacts of Arctic resources on the oil market, but also on the environmental and geopolitical implications of opening this area to development. Prospects for Arctic drilling dimmed considerably in 2015 when Shell decided to abandon its ambitious drilling efforts in the Burger Field in the Chukchi Sea, writing off several billion dollars in the process. The recent collapse in oil prices has probably put a stop to Arctic drilling for the time being, and this pause may prove useful in resolving some of the outstanding issues.

Abstract:
Over the weekend of November 21st, 2015, Russia flew 141 sorties over Syria, hitting 472 targets in eight different provinces throughout the country.[1] While the deployment of the Russian Air Force over Syria has been in full affect since last September, the events of November 20th proved to be unique. Two of the TU-160 blackjack bombers that participated in the weekend’s campaign took flight not from a base in southern Russia, but rather from Olenegorsk Airbase on the Kola Peninsula of the Russian Arctic.[2] The two bombers traveled southwest along the coast of Norway, skirting United Kingdom airspace, turning east through the straits of Gibraltar, and achieved their goal of firing cruise missiles on Syria from the eastern Mediterranean. After their mission was complete, they flew northeast over Iran and the Caspian Sea to their home base in Engles, Saratov Oblast, in Southern Russia.[3] In total, the flight lasted 16 hours, with the aircraft traveling 8,000 miles, while motivating Norway[4] and Britain,[5] among other nations, to scramble fighter jets in the process. Presumably, the Russians chose such a circuitous route along the edges of Europe to demonstrate its long range bombing capabilities. In doing so, the Russian Federation also showed the rest of the world that its capabilities might rival those of the United States, proving that Russia too could attack targets all throughout the world. This use of an Arctic airbase for active bombing missions also marks a turning point in history; not even during the Cold War did the Russians demonstrate Arctic-based military capabilities with such expansive reach.[6] While this mission did not focus on targets within the Arctic, the use of an Arctic base for active bombing missions draws attention to Russia’s military buildup in the region...
