Abstract:: While some degree of competition is present in many authoritarian regimes, the implications of such controlled competition on international issues have not received much consideration, including towards international environmental accords. We attempt to rectify this through a framework where we focus on internal political competition in a hybrid, nondemocratic system where national elections are held regularly. Specifically, we argue that the presence of multiple actors competing in elections in nondemocratic settings results in them assuming positions on various issues, justifying their positions, and attempting to mobilize their supporters with considerable implications for international environmental policies. We display our argument in the context of Iranian debates on the ratification of the Paris Climate Accords. Our findings demonstrate that the competing Iranian sides rely on different justifications for their environmental positions, resulting in extensive (negative) competitions of rhetoric where the international dimension emerges as an important feature in the internal competition. Overall, we show that political competition within non-democracies is likely to add to the complexity of international (environmental) negotiations and cooperation.

Abstract:: In 2014, the Houthis, a Zaydi Shia armed group from the Sa’ada region of northern Yemen, aligned with former President Ali Abdullah Saleh, who had been removed following the Arab Spring uprisings. Together, they defeated the government led by President Abd Rabbuh Mansur Hadi, and established control over the Yemeni capital of Sana’a and the entirety of northern Yemen. At that time, Iran began to progressively increase its support for the Houthis, seeing partnership with the group as an opportunity to advance its revisionist agenda in the region and establish its influence in the southern Red Sea, an area of immense strategic significance. Threatened by aggressive Iranian expansionism at its doorstep, in March 2015, Saudi Arabia entered the war alongside Hadi. As Iran sided with the Houthis and Saudi Arabia sided with Hadi, Yemen became the battlefield of both a domestic competition for power between different local factions and a regional competition for influence between Teheran and Riyadh.

Abstract:: After a hiatus of over five months, negotiations to restore the Joint Comprehensive Plan of Action (JCPOA), commonly known as the Iran nuclear deal, have finally resumed in Vienna. Struck in July 2015 by Iran and a group of six powers – France, Germany and the UK plus China, Russia and the US, as well as the EU (E3/EU+3)–, the JCPOA placed limits on Iranian nuclear activities, while also introducing a highly intrusive inspection regime by the International Atomic Energy Agency (IAEA). The deal is in a comatose state due to former US President Donald Trump’s decision to unilaterally pull out of the agreement and re-adopt all sanctions on Iran in May 2018. In response, since May 2019 Iran has progressively reduced its compliance with its non-proliferation obligations under the deal.

Abstract:: The Iranian Foreign Minister Mohammad Javad Zarif, has proposed the possibility of settling disputes over the nuclear deal by adopting the ‘simultaneous’ approach, meaning that Iran will once again comply to the deal in return for US lifting sanctions imposed on it. On February 2, during his interview with CNN network, Zarif responded to the question by Christian Amanpour, about whether Iran is still demanding that the US act first, saying that the necessary steps can be synchronized. He also suggested the EU mediate to settle the disputes and remove any obstacles against Washington's return to the agreement. This may imply that Iran made early concessions in its position, regarding the adherence to strict conditions, similar to: the US returning to the agreement first, lifting sanctions and providing compensation for the losses incurred. However, these may not be major concessions impacting the general attitudes of the Iranian leadership, nor may they necessarily indicate Iran's intention to make significant changes in its policy regarding the nuclear deal. To be precise, this new approach announced by Zarif may simply be a tactical change in the Iranian policy aiming to enhance the access to understandings and to avoid early problems with the US administration, at a time when Iran appears to be in dire need of lifting US sanctions.

In this paper, we briefly outline the five most likely pathways ahead, each of which has strengths and challenges: Return to the JCPOA as it was. Return to the JCPOA plus new commitments that address other security concerns with Iran. Restore the JCPOA as it was plus a set of confidence-building measures to address other security concerns. Formally link a requirement for Iran to address our other concerns as a pre-condition for further talks. Return to the pre-JCPOA Middle East, where US and allies work to rollback Iran’s nuclear program and actively deter its regional actions by confrontation, punishment, and isolating measures. Each path carries risk and opportunity for restoring American leadership in the world, and congressional Democrats should remember the perfect deal does not exist. Members of Congress would be wise to measure the next deal against the status quo ante: an unconstrained, belligerent Iran again racing to a bomb.

Abstract:: On September 9, 2021, the German Federal Prosecutors Office issued an arrest warrant for a German-Iranian citizen, Alexander J., who is accused of illegally exporting a multitude of laboratory equipment, including four spectrometers, in three separate cases, exports that appear to have also violated the Joint Comprehensive Plan of Action (JCPOA).1 The total value of all the goods exported to Iran is 1.1 million euros. The defendant, Alexander J., is accused of violating the Foreign Trade Act (AWG) and Regulation (EU) No. 267/2012 of March 23, 2012, as amended in October 2015 in response to the establishment of a special Iranian procurement channel in the JCPOA, which places restrictive measures on certain Iranian entities and equipment for export (and related activities, such as brokering). In the first two cases, Alexander J. is alleged to have exported items to an Iranian national whose Iran-based companies were EU-sanctioned front companies procuring laboratory equipment for Iran’s nuclear and ballistic missile programs at the time. Alexander J. further supplied the sanctioned entity with two spectrometers listed in Annex II of this EU regulation, which lists items that are not on the EU dual-use control list (Regulation (EC) No 428/2009 of 5 May 2009) but that could contribute to sensitive activities, including enrichment-related activities, reprocessing or heavy-water-related activities.2 These items require a license on a case-by-case basis. In addition, Alexander J. violated the regulation by providing goods to an embargoed entity. In the third case, Alexander J. exported two listed spectrometers to a different, unspecified Iranian entity, also without the required license.

20. Europe Needs a Regional Strategy on Iran

Abstract:: The rift between Europe and the United States over Iran is deepening. To regain leverage, the Europeans should engage all eight Gulf states in talks about regional security and nonproliferation. The rift between Europe and the United States over Iran is deepening. Two years of U.S. maximum pressure on Tehran have not yielded the results Washington had hoped for, while the Europeans have failed to put up enough resistance for their transatlantic partner to change course. Worse, the U.S. policy threatens to destabilize the broader Persian Gulf, with direct consequences for Europe. To get ahead of the curve and regain leverage, the European Union (EU), its member states, and the United Kingdom have to look beyond their relations with the Islamic Republic and address wider regional security challenges. The United States’ incipient retreat as a security guarantor and Russia’s increased interest in the region make it necessary for Europe to engage beyond its borders. Despite being barely alive, the 2015 international nuclear deal with Iran offers a good starting point. The Europeans should regionalize some of the agreement’s basic provisions to include the nuclear newcomers on the Arab side of the Gulf. Doing so would advance a nonproliferation agenda that is aimed not at a single country but at the region’s broader interests. Similarly, the Europeans should engage Iran, Iraq, and the six Arab nations of the Gulf Cooperation Council in talks about regional security. Rather than suggesting an all-encompassing security framework, for which the time is not yet ripe, they should pursue a step-by-step approach aimed at codifying internationally recognized principles at the regional level.

21. Europe Is Creating an Opportunity for Iran Talks, and Washington Should Take It

Abstract:: By triggering the nuclear deal’s dispute resolution mechanism, Britain, France, and Germany are opening diplomatic space that could help the United States and Iran return to the negotiating table. In a press conference following the assassination of Qasem Soleimani, President Trump reaffirmed his administration’s “maximum pressure” policy against Iran and asked, once again, for European countries to leave the nuclear deal. Meanwhile, Tehran announced what it called a “fifth and final remedial step” away from its commitments under the Joint Comprehensive Plan of Action. In response, the British, French, and German foreign ministers stated on January 14 that they would trigger the JCPOA’s dispute resolution mechanism (DRM). At the same time, however, the E3 clarified that they are not joining the Trump administration’s maximum pressure campaign, which has steadily intensified ever since the United States withdrew from the JCPOA and reimposed unilateral sanctions in 2018. Contrary to U.S. claims, the European decision will not immediately provoke “snapback” UN sanctions on Iran (though that scenario could unfold later if the E3 plan fails and Iran’s violations go before the UN Security Council). Instead, Europe is maintaining its evenhanded position somewhere between Washington and Tehran in order to preserve the possibility of new negotiations, on both the nuclear program and other regional issues.

22. Dealing Preventively with NPT Withdrawal

Abstract:: Since it came into force in 1970, the Treaty on the Non-Proliferation of Nuclear Weapons (NPT) has worked remarkably well to prevent the horizontal proliferation of nuclear weapons. The one major exception is North Korea, which withdrew from the NPT in 2003. Despite this track record of success, the stability of the current non-proliferation regime could be significantly undermined by further withdrawals by countries such as Iran. The right of states to withdraw from the NPT is clearly stated in the Treaty. Article X.1 provides that: “Each Party shall in exercising its national sovereignty have the right to withdraw from the Treaty if it decides that extraordinary events, related to the subject matter of this Treaty, have jeopardized the supreme interests of its country. It shall give notice of such withdrawal to all other parties to the Treaty and to the United Nations Security Council three months in advance. Such notice shall include a statement of the extraordinary events it regards as having jeopardized its supreme interests.” Since it is impossible to deny the right of states parties to withdraw from the NPT, it is all the more important to put in place appropriate preventive measures to dissuade withdrawal from the Treaty. The urgency of dealing preventively with NPT withdrawal increases as more nonnuclear-weapon states are poised to become “nuclear threshold states.”1 As the IAEA reported in 2008: “Much of the sensitive information coming from the [Abdul Qadeer Khan] network existed in electronic form, enabling easier use and dissemination. This includes information that relates to uranium centrifuge enrichment and, more disturbing, information that relates to nuclear weapon design.”2 and: “a substantial amount of sensitive information related to the fabrication of a nuclear weapon was available to members of the network."3 The widespread dissemination of this type of scientific and technical information raises the prospect that more states will acquire the capability to manufacture nuclear weapons and their means of delivery, thus increasing the

23. The Impact of the EAEU-Iran Preferential Trade Agreement

Abstract:: The preferential trade agreement between the Eurasian Economic Union (EAEU) and Iran on mutual trade entered into force in October 2019. In this report we estimate its expected impact at aggregate and sectoral levels using the gravity model of trade based on the global sample of bilateral trade flows at the HS 6-digit level. The analysis suggests that the implementation of the agreement will boost mutual trade for both trading partners, with relatively greater gains expected for the EAEU’s exports to Iran. On aggregate, the total gains in mutual trade are estimated to reach almost USD 46 million, with exports from the EAEU to Iran expected to increase by 9.7%, compared with a rise in exports from Iran to the EAEU of up to 4%. The difference in the impact will also be significant across the five EAEU countries as well as across sectors, with the major export gains expected to accrue in the chemicals and agri-food sectors, especially trade in miscellaneous fruits and vegetables, as well as in the textile, polymer production and metals sectors.

Abstract:: Two years ago, US President Donald J. Trump walked into the White House Diplomatic Reception Room and announced his intention to withdraw the United States from the Joint Comprehensive Plan of Action (JCPOA). The Trump administration reimposed sanctions on Iran and has adopted a policy of “maximum pressure” to compel Iran to change its behavior and to deny the Iranian regime the resources to engage in its destabilizing activities. However, he also promised he was ready, willing, and able to make a new and lasting deal with Iran. In “Trump’s JCPOA Withdrawal Two Years On – Maximum Pressure, Minimum Outcomes” author David Mortlock, Senior Fellow at the Atlantic Council, evaluates the policy outcomes of President Trump’s withdrawal from the JCPOA. The author walks readers through the timeline of President Trump’s decision to withdraw from the JCPOA, the subsequent implementation of the maximum pressure campaign on Iran, and the policy outcomes relative to stated objectives. In sum, Mortlock concludes that although the maximum pressure campaign has been effective in inflicting economic harm on Iran, it has had minimum effect in other areas. Therefore, Mortlock believes the Trump administration should seize the opportunity to pivot from maximum pressure to an approach focused more on policy outcomes.

25. Coming out and breaking out: The US, Iran and Europe go nuclear

Abstract:: On the eve of the US elections, the nuclear deal (JCPOA) stands on the edge of the precipice. The US strategy of ‘maximum pressure’ has not (yet) achieved its implicit objective of 'regime change' but tanked Iran’s economy, caused its government to dig in and increased regional instability. The geopolitical consequences of US sanctions, EU prevarication and Iran’s deep presence throughout the Middle East have been equally profound. At the global level, they include nudging Iran towards China/Russia, the US alienating its European ‘partners’ and encouraging them to develop greater strategic autonomy. At the regional level, US sanctions risk creating an alternative economic regional order, ensuring Yemen remains a protracted war and making a regional security initiative more necessary, but less likely. It is not yet too late to turn the tide. The focus should now be on reducing regional tensions and especially the stress that sanctions have put on Iran’s population and government. Radical action looks more inviting when one stands against the wall, but the Middle East does not need more conflict than it already has. To do so, the EU should first support Iran with a large-scale Covid-19 humanitarian economy recovery package. As such measures are already sanctions-exempt, they will create few new tensions. An economic initiative should follow that grants preferential access to the EU’s internal market for industrial and agricultural goods from the entire Middle East (for Iran via an upgraded INSTEX). Such interventions will not resolve existing security dilemmas but can show there is an alternative to confrontation.

Abstract:: After 11 September, Iran's nuclear energy program turned into an international crisis. However, Iran did not give up its nuclear energy program despite the pressure on it in the world public opinion. This crisis, which occurred in the early 2000s, did not cause a negative impact on relations between Iran and Russia. Russia continued to help Iran to develop its nuclear program. One of the main points of the Joint Comprehensive Plan of Action (JCPOA) signed between P5+ 1 countries and Iran in 2015 is that Iran limited its nuclear energy development for ten years. However, Iran could be a regional rival for Russia, especially in terms of energy and gas exports, after a decade. In this context, the focus of the study is to analyse whether there was any change in the good relations between the two countries after JCPOA. The study seeks answers to specific questions: How does Russia look at JCPOA? Why does Russia stand for a rival Iran? Are there any changes in the relations between Russia and Iran in the post-2015 period? According to the results, JCPOA did not have any negative effect on Russia-Iran relations. | 11 Eylül sonrası İran’ın nükleer enerji programı uluslararası bir krize dönüşmüştür. Abstract:: When and how do domestic politics influence a state's nuclear choices? Recent scholarship on nuclear security develops many domestic-political explanations for different nuclear decisions. These explanations are partly the result of two welcome trends: first, scholars have expanded the nuclear timeline, examining state behavior before and after nuclear proliferation; and second, scholars have moved beyond blunt distinctions between democracies and autocracies to more fine-grained understandings of domestic constraints. But without linkages between them, new domestic-political findings could be dismissed as a laundry list of factors that do not explain significant variation in nuclear decisions. This review essay assesses recent research on domestic politics and nuclear security, and develops a framework that illuminates when and how domestic-political mechanisms are likely to affect nuclear choices. In contrast to most previous domestic arguments, many of the newer domestic-political mechanisms posited in the literature are in some way top-down; that is, they show leaders deliberately maintaining or loosening control over nuclear choices. Two dimensions govern the extent and nature of domestic-political influence on nuclear choices: the degree of threat uncertainty and the costs and benefits to leaders of expanding the circle of domestic actors involved in a nuclear decision. The framework developed in this review essay helps make sense of several cases explored in the recent nuclear security literature. It also has implications for understanding when and how domestic-political arguments might diverge from the predictions of security-based analyses.

Abstract:: On November 5th, 2018, the Trump administration re-imposed severe sanctions on Iran. These sanctions, which President Obama called the “toughest sanctions ever faced by the Iranian government,” were lifted by the 2015 Joint Comprehensive Plan of Action (JCPOA), also known as the Iran Deal. The JCPOA was signed with a view to blocking Iran’s alleged pursuit of nuclear weapons, allowing international inspectors into Iran in return for sanctions relief. Withdrawing the United States (US) from the deal was a prominent promise of Donald Trump leading up to the presidential elections of 2016. In a May 2018 speech that described the deal as rooted in “fiction,” President Trump made good on his promise to leave the JCPOA and to move to unilaterally re-impose sanctions on Iran.

Abstract:: Attempts to achieve a zone free of weapons of mass destruction (WMD-Free Zone) in the Middle East have become even more complicated than in the past. This Policy Forum issue provides a fresh look at the topic in order to offer common ground for positive discussions on Middle East disarmament. Its main novelty is to look at the security threat as perceived by Israel in the context of an Israeli-Egyptian-Iranian triangle that complements the old paradigm of an Israeli-Egyptian dyad. The Joint Comprehensive Plan of Action (JCPOA or agreement/accord) with Iran is a challenge for some regional actors but at the same time could form a basis for bridging the disarmament gap, especially with its unprecedented robust verification regime. From a purely strategic angle, the JCPOA is beneficial to Israel’s national security interests. It is therefore to be hoped that this multilateral agreement will withstand the Donald Trump administration’s attempts to dismantle it.

Abstract:: This Policy Forum issue analyses the 2004-2006 initiative to establish a sub-regional zone free of weapons of mass destruction (WMD) in the Gulf (GWMDFZ) as a tool to prevent Iran from becoming a nuclear-weapon state. The initiative’s gradual approach which aimed at the ultimate goal of encompassing the entire Middle East (including Israel) was innovative, and the assertive role of some smaller Gulf states in expressing their security concerns/interests and verification standards that Tehran would have had to meet was unprecedented. But the entire sub-regional idea remained confined to the declaratory level. In contrast, the Joint Comprehensive Plan of Action (JCPOA or greement/accord) – endangered as it currently is – struck between the E3/EU+3 and Iran exceeds some of the concerns of the earlier initiative, yet misses others. We conclude that new – and ultimately sustainable – regional forums as communication mechanisms are needed to tackle these issues without touching on the JCPOA. The challenges go beyond Iran and include the nuclear activities of the United Arab Emirates (UAE) and even more so of Saudi Arabia. Our Cooperative Idea emphasises that moving beyond the purely declaratory policy of the GWMDFZ initiative could also help to overcome the current stalemate regarding a zonal disarmament arrangement for the whole Middle East/Gulf region.

In a stalemated situation resembling efforts to negotiate a zonal arrangement, the JCPOA after more than 12 years of negotiations succeeded in striking a multilateral deal among adversaries with diverging capabilities and agendas who doubted each other’s intentions and were reluctant to make concessions.By establishing an incentive-based mechanism that encouraged and facilitated cooperation, the JCPOA succeeded in trading various issues to reach common ground in an incremental step-by-step approach of carefully sequenced quid pro quos. Framed as an agreement among equals and safeguarded by multiple compliance mechanisms, the JCPOA (or aspects of it) could serve as a toolbox for zonal negotiations on disarmament, help to link hardened actors, and break up entrenched interest structures and dogmatic policy positions.

37. Against All Odds - Decreasing the Saudi-Iranian Rivalry for Regional Hegemony through and in the Wake of the JCPOA

Abstract:: The dangerous spiralling of the rivalry between the Kingdom of Saudi Arabia and the Islamic Republic of Iran for hegemony/supremacy in the Middle East/Gulf is the factor that has the most negative impact on the entire region. The authors make the case for using the specific features and successful negotiations of the historic Joint Comprehensive Plan of Action (JCPOA) as a way to downgrade this bilateral rivalry. This agreement was the focal point of (pre-)negotiations especially between the United States and Iran that de-escalated the tensions between the two enemies and turned them – at least during the administration of President Barack Obama – into adversaries with an interest in selective cooperation. The agreement is living proof that formerly incompatible interests can be overcome. It is true, however, that, despite its complexity, the JCPOA can only have a limited influence on developments in the region. This is why the authors identify the roots of the intensifying Saudi Iranian rivalry at the domestic, regional and international levels – with corresponding recommended steps to de-escalate this struggle. The prospects for such a positive scenario appear to be particularly promising if elites in both Riyadh and Tehran – especially since they are facing increasing domestic challenges to regime/government stability – opt to slow down or even reverse their countries’ current course. A more assertive population, especially among women and the youth, has become a new factor for serious change. This may incentivise these elites to pursue less costly foreign policy approaches – including finding appropriate forums for serious dialogue, with de-escalating the mutually demonising rhetoric as the first step.

His decision has increased the risk of war and a nuclear arms race in the Middle East and beyond. He has undermined attempts to limit the proliferation of nuclear weapons through multilateral diplomacy, as unilateral withdrawal equals non-compliance with a legally-binding UN Security Council resolution. This is a rejection of the UN as arbiter of international peace and security, as well as of international law as a lynchpin of international relations. The steps that Europeans now take will have serious consequences for their alliance with the US, for security in the Middle East, as well as for their relations vis-à-vis China, Russia and the wider world.

Abstract:: The British-Russian Convention of 1907 was seen as a joint effort by Britain and Russia to reconcile their areas of influence in Asia but apart from this purpose, it represented the last ring of the emerging tripartite blog that included France against Germany and its allies. The agreement, which mainly came into agenda for partitioning Iran, was handled by the Ottoman Foreign Affairs as a text about Asian affairs. The Ottoman statesmen, who considered only the part of this agreement concerning Afghanistan, Tibet and Iran, couldn’t realize that this was an important part of the polarization politics that pushed world to a general war.

41. Iran Nuclear Deal Procurement Channel Update: Is it being bypassed?

Abstract:: The procurement channel set up under the Joint Comprehensive Plan of Action (JCPOA), or Iran nuclear deal, appears to be considering fewer proposals than expected and is altogether unused by a traditionally illicit conduit to Iran’s nuclear, missile, and non-nuclear programs, namely China. The procurement channel was designed to regulate Iran’s imports of nuclear and nuclear-related dual-use goods for nuclear or non-nuclear use. Given that Iran’s non-nuclear industries have often imported nuclear dual-use goods, this finding raises the question of whether the procurement channel, and its associated Procurement Working Group (PWG), is simply not being used, but illicit, nuclear dual-use supplies are still going to Iran. Although no evidence has emerged of banned sales going from the United States, Europe, or Japan, which have often been targets of Iranian illicit procurement networks, there is concern that banned sales could be going from parts of Asia. In particular, Chinese entities may be continuing to make sales of nuclear dual-use goods to Iran without using the channel. The United States and its allies should augment efforts to detect and intercept the flow of any strategic goods from China to Iran and from other potentially illicit supplier countries to Iran. China needs to reach out to suppliers or distributors of dual-use goods operating on its territory and ensure that they are informed about China’s export control laws and PWG requirements governing the sale of nuclear dual-use goods to Iran’s industries, whether they be nuclear or non-nuclear.

Accordingly, the EU has adopted, over the past months, countermeasures to protect its economic interests with Iran and to sidestep US sanctions. Abstract:: Although President-elect Donald Trump’s position on the Iran nuclear deal remains unclear, he and his allies in the Congress are expected to at least better enforce and strengthen the Iran deal. They should start by focusing on the deal’s heavy water loophole, whereby Iran can store offshore in Oman heavy water it owns and controls in excess of the nuclear deal’s limits, awaiting its eventual sale. To date, if the stocks in Iran and Oman are counted together (a reasonable view since Iran owns and controls both stocks), Iran has far exceeded the nuclear deal’s stated limit of maintaining a stock of only 130 metric tons of heavy water. Yet, this loophole was sanctioned by the executive body of the Iran deal, the Joint Commission. Despite such generous treatment, Iran has even so twice violated the narrow limit of 130 metric tons of heavy water it can hold inside Iran since the deal started in January 2016. Iran should no longer be facilitated in its overproduction of nuclear-related heavy water. Oman would do the world a favor by halting its willingness to accept Iranian heavy water and send any back to Iran for downblending. The return of the heavy water and its blending down would dramatically signal to Iran that violations of the Iran deal are no longer going to be tolerated, or worse, facilitated. Moreover, any further overproduction should be seen by the United States as a violation of the deal. It should work to end the Oman loophole and mitigate damage caused by a U.S. purchase of Iranian heavy water.

Abstract:: On January 20th, the International Atomic Energy Agency (IAEA) confirmed that Iran had been implementing its commitments as part of the Joint Plan of Action (JPA) agreed by the E3+3 in Geneva on November 24th of last year. In particular, the Agency confirmed that Iran had not installed new centrifuges, that it had stopped enriching uranium above 5%, that it had disabled connections between cascades being used to enrich up to 20%, and that it had begun the process of diluting half of its stockpile of 20%, while the other half is to be converted to oxide over the next six months. Over the next six months, the IAEA will continue to monitor Iranian enrichment, and activities at Arak, Fordow and Natanz. Immediately following the IAEA announcement, the US and EU suspended some of the sanctions currently imposed on Iran. Sanctions relief, quantified at $7 billion, comprises both the suspension of some sanctions and the repatriation of $4.2 billion of oil revenues in tranches.

Abstract:: As efforts intensify to bring the Iran nuclear negotiations to a successful conclusion by November 24, the issue of breakout continues to occupy center stage. Setting limits on Iran’s nuclear program to dissuade the leaders in Tehran from breaking out of the nuclear Nonproliferation Treaty and possibly building nuclear weapons is a central objective of the P5+1 powers (China, France, Germany, Russia, the United Kingdom, and the United States). Consideration of the effect of agreed limits on the time it would take Iran to build nuclear weapons is, therefore, a necessary step in formulating the P5+1 negotiating position, but is not sufficient for navigating the appropriate course toward a comprehensive agreement. Relying on the narrow definition of the term “breakout”—obtaining enough weapons-grade uranium gas for one bomb—does not fully capture the path that would have to be traveled. It is also necessary to consider “effective breakout”—the time needed to build a credible nuclear arsenal—in order to ensure that the proper balance between verification and limitations can be achieved.

With sufficient fissile material and a warhead design, Iran could use its existing ballistic missiles to pose a credible nuclear threat throughout the region. Consequently, after repeatedly directing Iran to suspend uranium enrichment, the UN Security Council decided in 2010 that Iran also had to halt all activities related to ballistic missiles capable of delivering nuclear weapons. Now that serious negotiations are under way to curtail Iran's ability to dash for a bomb, seeking ballistic missile limits as part of a comprehensive nuclear deal would be unwise. Getting adequate and verifiable constraints on Iran's nuclear program remains the highest priority. The best way to address Iran's potential to exploit nuclear-capable missiles is to ensure that Iran's nuclear program is sufficiently limited and transparent. To also demand severe limits on conventional weapons that Iran regards as vital to its self-defense would jeopardize the negotiations' key objective.

Abstract:: Far too much of the analysis of Iran's search for nuclear weapons treats it in terms of arms control or focuses on the potential threat to Israel. In reality, Iran's mix of asymmetric warfare, conventional warfare, and conventionally armed missile forces have critical weaknesses that make Iran anything but the hegemon of the Gulf. Iran's public focus on Israel also disguises the reality that its primary strategic focus is to deter and intimidate its Gulf neighbors and the United States – not Israel. It has made major progress in creating naval forces for asymmetric warfare and developing naval missiles, but it has very limited air-sea and intelligence, surveillance and reconnaissance (IS) capabilities. It lacks modern conventional land, air, air defense and sea power, has fallen far behind the Arab Gulf states in modern aircraft and ships, and its land forces are filled with obsolete and mediocre weapons that lack maneuver capability and sustainability outside Iran. Iran needs nuclear weapons to offset these facts.

Abstract:: As negotiations are poised to resume between Iran and the six powers seeking to rein in Iran's nuclear program, it is difficult to avoid a sense of déjà vu. For years now, the UN Security Council has demanded Iran suspend uranium enrichment. Tehran continues to expand its nuclear program and insists it will never compromise its right to enrich, the United States continues to tighten sanctions on Iranian trade and finances, and alarms are raised about Iran being able to sprint to a nuclear bomb with little warning. Yet, with a new Iranian president and negotiating team, there are grounds for cautious optimism that talks this time can be different. Although Iran continues to enrich uranium and add to its nuclear complex, time remains to negotiate an agreement that adequately guards against Iran building nuclear weapons.

71. Understanding the IAEA’s Mandate in Iran: Avoiding Misinterpretations

Abstract:: Much attention has focused on Iran's advancing nuclear program, on the peace and security concerns which that program has raised, and on the international policy debate over how to respond to that program. Far less attention has been paid to the various legal-sounding arguments used by Iran and a few academics to call into question the mandate of the International Atomic Energy Agency (IAEA) to investigate and make determinations about actual or suspected violations of Iran’s legal obligations. Although arguments used by Iran and these academics to undermine the legitimacy of IAEA activities regarding Iran are patently false, they are nevertheless dangerous to both current and future nonproliferation efforts. Unless these arguments are clearly countered, and their fallaciousness clearly demonstrated for all the world to see, these arguments may decrease the chances of Iran agreeing to comply with its international legal obligations, could provide a fig leaf to those countries disinclined to hold Iran accountable, and might undercut the IAEA's and the United Nations Security Council's potentially pivotal roles in facilitating a peaceful resolution to disputes over the nuclear programs of Iran and future proliferators. It is in that light that we have chosen to address the dangerous claim published on September 13, 2012 by Daniel Joyner, a law professor at the University of Alabama, that the IAEA has exceeded its legal mandate in applying safeguards in Iran in accordance with a comprehensive safeguards agreement (CSA) under the Nuclear Non-Proliferation Treaty (NPT). In view of the importance of the IAEA's activities regarding Iran, the persistent efforts by Iran to call into question the legitimacy of those IAEA activities, and our concern to ensure that there is no misunderstanding as to the agency's mandates, we are writing to discuss those mandates and explain why Joyner is incorrect.

72. Submarine Nuclear Reactors: A Worsening Proliferation Challenge

Abstract:: A long submerged flaw in the nuclear Non-Proliferation Treaty (NPT) surfaced conspicuously in June when Iran announced it intended to build a nuclear-powered submarine. The treaty does not ban a non-nuclear weapons state's production of weapons-grade uranium if it is to be used to power a naval reactor. What many now consider a proliferation loophole in the NPT was first seen as theoretical because only nuclear weapons states had nuclear-powered submarines when the treaty was negotiated. Now, as more and more countries initiate or announce intentions to initiate nuclear-powered submarine programs, this excuse for enriching uranium to levels beyond the needs of civilian power reactors intensifies the challenge of achieving U.S. nonproliferation goals. The United States should adjust its policy by: 1) choosing a reactor for the Ohio-class SSBN follow-on that does not require weapons-grade fuel and 2) pushing for multilateral action to close or at least narrow the NPT loophole that allows for non-nuclear weapons states to produce highly enriched uranium for naval reactors.

Abstract:: After the first Indian nuclear explosive test in 1974, seven nuclear supplier governments were convinced that the Nuclear Non-Proliferation Treaty (NPT) alone would not halt the spread of nuclear weapons—a view that developments in Iran, Iraq, North Korea, and elsewhere would later underscore. The seven governments formed the Nuclear Suppliers Group (NSG), and over the course of more than three decades, it has become the world's leading multilateral nuclear export control arrangement, establishing guidelines that govern transfers of nuclear-related materials, equipment, and technology. Yet, as a voluntary and consensus- based organization of 46 participating governments, the NSG today faces a host of challenges ranging from questions about its credibility and future membership to its relationship to the NPT and other multilateral arrangements.

Abstract:: With the participation of the foreign ministers of Turkey and Brazil along with Turkish Prime Minister Recep Tayyip Erdogan and Brazilian President Luiz Inácio Lula da Silva, Iran has signed a joint declaration on May 17, 2010 with Brazil and Turkey "in which Iran agreed to send low-enriched uranium to Turkey in return for enriched fuel for a research reactor.” This joint declaration was considered a very serious one by specialists closely following the nuclear negotiations. However, instead of responding positively to the agreement, the US and the overall reaction of the West had fixated on making sanctions against Iran a reality, although the content of the deal was what the US sought from Iran. This has materialized itself with the new UN Security Council decision which brings new sanctions on Iran. On June 9, 2010, the UN Security Council passed Resolution 1929, imposing a complete arms embargo on Iran, travel bans on certain Iranian figures, banned Iran from any activities related to ballistic missiles, the freezing of all assets to the Iranian Revolutionary Guard, and Iran Shipping Lines, and to inspect all Iranian cargo or financial institutions, such as banks, on their territory.

Abstract:: Although Iran has formally accepted the U.S. offer to meet on October 1, expectations are low, particularly since Tehran has made clear that the nuclear issue is not negotiable. The United States and its allies have already begun to prepare for the possibility of failed negotiations by developing potential sanctions packages that could be imposed on Tehran. Unfortunately, due to Chinese and Russian opposition, pushing a strong resolution through the UN Security Council appears unlikely. Washington, however, can adopt other multilateral approaches to increase the pressure on Iran, such as ramping up its anticorruption enforcement efforts against companies doing business in Iran, and encouraging other countries to do the same. Given the widespread corruption in Iran, and the powerful anticorruption legislation in place in many countries worldwide, this approach could have a significant impact on the regime.

Abstract:: On May 21, after five days of mediation, Qatari officials announced a compromise solution to the Lebanese crisis between the pro-Western government and Hizballah-led opposition backed by Iran and Syria. According to preliminary reports, the negotiations centered on presidential elections and electoral reform, yet avoided the critical issue of Hizballah's weapons. Although details are still emerging, the broad outline of the agreement suggests that Hizballah has translated, at least temporarily, its May 7 military victory into a political victory. But given the potential outcome of the 2009 parliamentary elections, the Shiite group's victory may be short lived.
