Abstract:: The strategic interests of Asian countries in the Arctic continue to grow despite the disruptions of the COVID-19 pandemic and the geopolitical fallout of Russia’s invasion of Ukraine. China and India have their eye on Russia’s Arctic energy resources, and China is further seeking to leverage Russian weakness to expand its operational presence in the Arctic Ocean. Japan, South Korea, and Singapore are less prominent in Arctic regional institutions, yet they have distinctive interests in Arctic science, governance, and resources and are resuming dialogue about Arctic matters amongst themselves. This policy brief reviews the key differences in how Asian states are approaching the Arctic through a survey of their strategic documents, public statements, and diplomatic and commercial activities.

2. India’s Regulatory Shift: An Examination of Five Agencies of the Post- Liberalisation Era

Abstract:: This paper explores the design of Indian regulatory agencies established post-liberalisation from an administrative perspective. Regulatory agencies were set up to replace state inefficiencies, and to discipline profligate state agencies, even as much as they were a response to state-market reorganisations and the challenge of privatization. Regulation provided an opportunity for upper levels of the Indian bureaucratic state to recast their power, with the idea that it would provide a framework for economic rationality, independence and technical specialization to take centre-stage. In actual practice however, the design of each of the regulatory agencies is shaped largely by pre-existing legal frameworks and institutions, and the agencies have remained quite tied in with their counterpart departments and on retired bureaucrats. However, in spite of these limitations, these agencies have some common features imbued by legislative mandate and organisational design which are unique in the context of the Indian state. They have focus and stability, a degree of functional independence, and most importantly, a concentration of power, which enables them to think through and implement complex policy transitions from multi-year and context-specific perspectives. The paper builds on learnings from a series of conversations with regulatory agency chairpersons in order to identify what regulatory governance is, in terms of the powers and mandate of the regulatory agencies and what makes them distinctive from the rest of public administration.

Abstract:: The presence of digital technology within urban governance in India is not new. Computerization and the use of enterprise software was encouraged in municipalities through the 1990s, followed by varied e-governance reforms in the early 2000s. These ranged from centralized policies like the National e-Governance Plan (NeGP), to projects such as the Jawaharlal Nehru National Urban Renewal Mission (JNNURM), and city and state initiatives such as online billing and certification services for citizens and GIS platforms for administrators. The Smart Cities Mission (SCM) launched in 2015, gave a substantial and centralized push for digital interventions by choosing 100 cities to create “smart solutions” for urban governance, planning, and digital infrastructures. These were seen as “lighthouse” cities, expected to create technology-centric solutions that could be emulated by other cities in the mission.

Abstract:: In the 15 years that have gone by, India has seen a significant transition in the social sector, and lived through a pandemic. At the Accountability Initiative, Centre for Policy Research, we have tracked the provision of welfare services and entitlements since 2008, in-step with the country’s evolution over these years. The year 2023 marks a moment to pause and reflect for us as we celebrate our 15th anniversary, and the Centre for Policy Research reaches its milestone of 50 years. But, aside from our legacy of evidence-based knowledge sharing, this reflection is important in one more way. In 2024, India will choose a new government. A lookback on welfare spending and outcomes is an essential first step to understanding future priorities and pathways to development. Drawing from previous Union Budgets, this Special Brief will dive into six major aspects. Firstly, reviewing the sources of funding available with the government. Secondly, analysing trends in expenditures including social sector allocations for key ministries and schemes. Thirdly, the devolution of funds to states who are primary spenders on welfare services. Fourthly, unpacking social sector schemes over the years. Fifthly, analysing select outputs and outcomes over time. Lastly, we offer our own experience by providing a snapshot of the changes in government Management Information Systems which are critical to monitoring welfare schemes, among other aspects. For the purpose of this Special Brief, we are covering the period from 2009-2023. Actual Government of India (GoI) expenditures have been used till Financial Year (FY) 2020-21. For FY 2021-22, figures are Revised Estimates (REs) and Budget Estimates (BEs) for FY 2022-23.

14. Cooperative Federalism in India: Statutory Regulatory Authorities and the Federal System in India

Abstract:: Since the 1990s, there has been a marked expansion of the regulatory state in India. Statutory Regulatory Authorities (SRAs) are empowered to create and enforce regulations in their respective fields and often have the authority to issue licenses, conduct inspections, and take enforcement action against individuals or organisations that violate their regulations. This essay recognises the twin-deficit issue with SRAs in India. It focuses on the federal deficit issue and resists exploring the more obvious democratic deficit in them. Our analysis shows that over the twenty-three-year period between 1999 and 2022, the Rajya Sabha (Council of States) has reviewed 4 regulations by SRAs. For context, the securities regulator has issued 661 regulations since its inception in 1992. Such a federal deficit of a lack of State representation disallows decentralisation and restricts means for individuals and communities to have a greater say in the decisions that affect their lives.

15. Cooperative Federalism in Indi: Federal Aspects of India's Emerging Internal Migration Governance Frameworks

Abstract:: The exodus of millions of migrants during the 2020 Covid lockdowns resulted in an uptick in migrant-inclusive policy initiatives. Leaning on concepts developed in migration studies and organizational theory, this paper analyses emergent policy responses with a focus on the role of government. Without a coherent and explicit approach to governing migration from the Centre, State governments have actively worked towards improving governance responses to migrants. The location of initiatives outside of the nodal State labour department, convergence between departments and bilateral arrangements between States demonstrate how horizontal and vertical boundaries within the governance system were bridged innovatively by temporary orders, enterprising bureaucrats, state-society collaborations and by leveraging hitherto under-utilized provisions in existing schemes. The paper highlights migration governance as an example where the rearrangement of federal relationships under crisis conditions has offered new policy imaginations. A nascent transition away from a centralist model of migration governance has emerged, which can be accelerated and sustained by institutionalizing successful initiatives, including boundary-spanning mechanisms.

17. Organisation Through Neglect: Understanding Field Administration in India

Abstract:: This paper analyses the structure and processes of field administration in India and matches these with the outcomes on the ground. It highlights features of the administrative structure, human resources, and organisational culture that result in the sub-optimal delivery of social services and policy implementation. Recognizing the importance of historical antecedents, the paper provides a brief account of how field administration has developed over time. Subsequently, it presents the findings of a case study of a district situated in Madhya Pradesh. This is followed by a delineation of the key areas for reform and some possible strategies, though these need to be formulated after rigorous debate. The paper traces the roots of the present-day field administration to the colonial era, when the existing decentralised and diffused field administration system was changed to achieve the government’s goals to maximise revenue from land and forests and maintain order. The district became the key administrative unit in the field, and the district collector (DC) the overall administrative head. After Independence, government goals shifted dramatically, and socio-economic development became a central concern. However, the basic administrative structure was retained, while several departmentalorganisations were added.

18. Regulating Air Quality at an Airshed Level in India

Abstract:: Air pollution is a pan-India problem, and whether viewed in terms of pollution sources or exposure, there is no reason to continue an urban-focus in air pollution mitigation measures. It is imperative for air quality governance in India to transition from a city-centric approach to an airshed approach. As resources to address the pollution crisis are scarce, a coordinated effort across a region, that supports consistent and uniform measures against similar pollution sources, is likely to lead to greater gains in terms of air quality. In this Paper, we unpack some of the key issues relating to airshed-level governance and what is required to make that transition in India. The current regulatory set-up is designed to primarily focus on point sources, and the jurisdictional mandate of regulatory bodies aligns with state or city boundaries. To effectively regulate pollution and reduce pollution exposure, changes need to be introduced to this regulatory architecture, making it adopt an airshed-level approach. To begin with, airsheds have to be demarcated based on several criteria. However, there is sufficient literature available to initiate necessary reform measures, and the transition to an airshed or regional approach is not contingent on perfect airshed demarcation. We propose that airsheds be notified under the Air Act by the State Governments as ‘air pollution control areas’, and the Union Government may constitute, through notification, multi-stakeholder institutions for each airshed under the EP Act. We have outlined the composition of such an institution, its powers, roles, and responsibilities. It will be a focal point for standard setting, policy guidance, planning and knowledge generation for the airshed, while not being involved in enforcement. A key ingredient for successful airshed-level governance is effective accountability mechanisms that ensure compliance by actors across the region. We envisage a role for the Union Government under the EP Act as well as for the National Green Tribunal in this regard.

20. Activating Spaces, Scaling Up Voices: Community-based Monitoring and Planning of Health Services in Maharashtra, India

Abstract:: From 2007, the Indian government’s National Health Mission (NHM) supported civil society networks to carry out large-scale participatory monitoring to improve health service access and quality under the Community-based Monitoring and Planning (CBMP) program. In the state of Maharashtra, this social accountability initiative endured more than a decade and a half, despite constraints and unpredictable government funding. The CBMP program in Maharashtra supported state-wide civil society networks to enable active citizen participation in health oversight committees. It was rooted in a broad network of diverse community-based organizations and civil society organizations that work with socially excluded communities, led by Support for Advocacy and Training to Health Initiatives (SATHI). The CBMP network combined many social accountability tools into a multilevel strategy, using community assessments of health services and local meetings with clinic staff to inform problem-solving efforts at local, district, and state levels of the health system. This government-funded civil society initiative worked with local officials to convene public dialogues and to activate previously dormant official oversight bodies, animated by a parallel network of autonomous monitoring committees. This Working Paper presents SATHI’s analysis of the CBMP program’s strategy and institutional dynamics, and documents its lasting effects on two participatory oversight institutions: Village Health, Sanitation, and Nutrition Committees (VHSNCs)—part of local government, and Rogi Kalyan Samitis (Patient Welfare Committees)—part of the health system. Field research, carried out shortly before the pandemic, compared the activation of these hybrid oversight bodies in areas with and without a legacy of intensive CBMP action. Key findings include: Official participatory spaces for citizen engagement with the health system were much more active in districts where CBMP networks had intensively promoted grassroots capacity for voice. Frontline health system responsiveness to issues that could be addressed locally—identified as ‘CBMP-sensitive’—was very high. But the health system’s degree of responsiveness to problem-solving efforts decreased at higher levels. The period of intensive CBMP effort to build grassroots awareness and capacity was limited to six years. Nevertheless, that effort had lasting effects on the levels of activity of local hybrid health oversight bodies. The pandemic revealed additional evidence of the medium-term survival and institutional impact of CBMP-enabled social networks.

This paper employs an examination of BRICS Health Ministerial declarations and an analysis of power in International Relations to reflect on BRICS’ Global Health diplomacy during the Covid-19 pandemic, covering the key questions of vaccine research and development, vaccine nationalism, and travel bans. It finds that multiple dimensions of power matter in Global Health leadership.

(2020), in which they examine the consequences of the nation-wide scale up of reforms to the funds management system (e-FMS) in India’s national workfare programme, using a two-way fixed effects specification. They report a substantial 19 percent reduction in labour expenditures. We exploit the recent literature that highlights the limitations of the TWFE estimator in the presence of staggered roll out and effect a Goodman-Bacon decomposition of the TWFE coefficient, to pinpoint sources of identifying variation. We undertake a detailed examination of subsamples of six constituent and valid DiDs based on timing of treatment that are averaged into the TWFE coefficient to identify heterogeneity in treatment effects. This disaggregated subsample analysis does not support the conclusion of any reductions in MGNREGS labour expenditures, suggesting that the TWFE coefficient based on the full sample is indeed biased.

The Water Act1 and the Air Act2 prescribe up to fifteen members on the Board which is headed by a Chairperson and a Member Secretary. Who are these members and what are their qualifications? The laws require various constituencies to be represented: officials representing State Government departments, urban local bodies, and public sector corporations. Three members may be nominated to represent interests of agriculture, fishery, industry, trade or any other interest. The laws do not lay down the qualifications of these members, apart from the requirement under the Air Act that at least two persons on the board must have special knowledge or practical experience in the field of air quality management.

The environmental engineers and scientists of an SPCB form the backbone of the institutional structure for pollution regulation. They carry out the fundamental task of the SPCBs, namely the review and grant of approvals under the environmental law regime. They evaluate applications from industries, conduct inspections or inquiries, collect and evaluate air and effluent samples, and issue approvals where applicable. Through their work, they provide the structural underpinnings to the “command and control” approach to pollution management. Several earlier reports have highlighted the significant staff constraints under which SPCBs function, highlighting in particular the high rate of vacancies among technical staff (1–3). In the context of a rapidly industrializing State, and an evolving environmental regulatory regime, there is a need for SPCBs to be appropriately skilled and staffed.

Under the Water Act1 and the Air Act,2 important statutory functions of the Board are delegated to them, and they need to be qualified to perform these functions effectively. The Water Act and the Air Act provide limited guidance on the qualifications of persons who should hold these posts. The issue of who can lead a pollution control board has been discussed in several reports and government correspondence. Specific appointments to leadership positions in different states have been challenged in High Courts over the years. The most comprehensive judicial consideration of the issue was in a 2016 judgment of the National Green Tribunal (NGT).3 Although the final outcome of the NGT’s judgment was overturned by the Supreme Court, the Supreme Court shared the NGT’s anguish at the state of governance of these boards, and significantly, directed states to form rules or guidelines for the recruitment of qualified persons to these two posts.

Abstract:: The setting up of the Commission for Air Quality Management (CAQM) represents a significant milestone for air quality management in India. The Commission’s ability to perform its functions effectively and facilitate measures that will improve air quality in the NCR and adjoining areas for the long term will likely be impacted by several political, economic, technical, and social factors. In such a scenario, it is essential that the Commission enjoys sustained public trust as being non- partisan as well as a technically sound and socially sensitive body. The CAQM’s mandate is a statutory expression of the fundamental right of Indians to breathe air that is not harmful to their health. Its functioning should therefore reflect an inclusive and participative approach that allows citizens to claim and protect their right and prevent its encroachment when possible. At the Initiative on Climate, Energy and Environment (ICEE) at the Centre for Policy Research (CPR), we have been closely studying the functioning of various environmental regulators, and for the past four years have been working specifically in the area of air quality regulation and governance. Based on our research, we have identified five broad themes for the Commission to consider as it implements its statutory mandate: taking a holistic, long-term regional approach; tracking progress of NCAP implementation; ensuring transparency through proactive disclosure and timely reporting; developing enforcement protocols and grievance redressal mechanisms; and encouraging informed public consultation. We also suggest specific action points as illustrations under each of these themes.

Abstract:: The state of Odisha has made unprecedented strides in increasing access to individual toilets from 14% in 2011 to a purported 100% in 2019 under the Swachh Bharat Mission - Gramin. In light of the clarion call of a ‘Swachha Odisha, Sustha Odisha’, and the national imperatives set by the National Rural Sanitation Strategy, 2019-2029, the state has created a systematic framework towards the achievement of total sanitation in the form of the Odisha Rural Sanitation Policy, 2020. To inform the creation of the Policy and shape its contours for responding optimally to ground realities, we undertook a rapid assessment of the prevailing sanitation practices in three districts of the state. The present report discusses the resulting findings relating to varied aspects of rural sanitation - ranging from trends in toilet use and on-site sanitation systems to the availability and state of Solid and Liquid Waste Management (SLWM) infrastructure.

29. The Pandemic and Public Administration: A survey of Indian Administrative Service (IAS) Officers

Abstract:: The Covid-19 pandemic has caused extraordinary hardship since India’s first case was reported in Thrissur, Kerala in January 2020. Individuals and communities have since then made drastic changes to their behaviours, daily routines and lives, quite often in response to announcements or regulatory direction provided by the state. Officers of the Indian Administrative Service (IAS) are important actors at the forefront of framing, implementing and evaluating the state’s response to the pandemic, and uniquely positioned between the political executive and India’s massive frontline state. Their views on the state’s response, preparedness, the public and stakeholders in governance, and their positions on important normative debates underlying policy formulation and implementation therefore offer useful insights into both how the Indian state governs, and how it might govern better in the future. This report presents the results of a representative survey of over 500 IAS officers conducted between August and September 2020, 7-8 months into the pandemic. The survey sought to engage members of the IAS in reflecting on the critical challenges, decisions, and trade-offs that confronted public administrators charged with managing the state response at different levels. In doing so, it revealed both widely shared and sharply contested views on a range of subjects, including the role of the civil servant, executive and bureaucratic functioning in a crisis, and perceptions of and relations between the state, the public, and other important actors and institutions. The report finds that on the one hand, IAS officers are remarkably consistent in expressing high levels of motivation and public service commitment and endorse the view that the Indian state and bureaucracy galvanise resources and deliver reasonably well in times of crisis. On the other hand, there is a consistent tension between some strongly expressed ideals and the realities of administrative action, especially on engagement and communication with, and trust in the public. Finally, there is significant diversity among IAS officers when it comes to perceptions of key stakeholders (civil society, international agencies and the media) and a striking distrust of the private sector. The report also highlights the diversity in responses of officers across state cadres and seniority in several places through disaggregated analysis. This report, by the State Capacity Initiative at the Centre for Policy Research is part of a larger body of work on understanding the norms and values underpinning different state institutions in India. As we develop this body of work over the coming years, our goal is to continue to probe not just how the state performs, but how it perceives its own capacity, why and how it makes choices, imagines possibilities for governance, and engages with citizens.

30. Building a Climate-Ready Indian State: Institutions and Governance for Transformative Low-Carbon Development

Abstract:: This brief lays out a new approach to Indian climate governance. We suggest India’s institutional structure should be aimed at generating and adopting low-carbon development pathways. Doing so implies going beyond energy and emissions policies to also look at deeper economic structures such as patterns of urbanisation, industrialisation, and job creation. We propose a new, independent, non-executive, multi-stakeholder Low-Carbon Development Commission backed by law, to bring both analytical credibility and mechanisms to ensure policy relevance. We further propose the Commission interface with an enhanced set of bodies within the executive branch, interacting through a set of annual reporting requirements and incentives for climate action. By laying out a set of principles, institutions, and mechanisms for interaction, we suggest a path to analytical credible and policy relevant Indian climate governance.

31. Responding to COVID: a Mobility Based Surge Capacity Framework

Abstract:: It would appear, based on the experience over the past year, that at a given point in time, CoVID-19 affects a part of the country and not the whole nation. What does this imply for the sharing of resources between more affected areas and less affected areas? What does it imply for where reserves of resources need to be maintained to meet sudden surges in caseload? This note looks at these questions, by examining the spatial pattern of the epidemic over time and the nature of the resources, i.e., the extent to which their supply can be increased, the ease with which they can be moved, etc., including, where possible and necessary, the movement of patients in addition to mobile resources. Our analysis based on current transmission dynamics, points out that there are a small set of areas permanently at risk for repeat surges. These are areas where health infrastructure may need to be augmented locally. For other areas, while increases in health infrastructure would be needed, inter-district and interstate coordination can ensure that additional critical services can be made available through resource sharing. However, such a mobility-based surge capacity framework, as we have proposed, requires enabling governance structures that builds trust and facilitates coordination across district and state administrations, based on real time data analysis as well as formal institutional structures.

Air pollution is the second largest risk factor for public health in India, behind only child and maternal malnutrition. Although there has been an increase in the visibility of the issue in the media, public concern and government response, a coherent national policy strategy remains in its nascent stages. How could the ecosystem of actors engaging with air quality in India work towards a collective strategy that leads to sustained improvements throughout the country? This paper outlines the contours of such a strategy here, and has been written keeping a diverse audience in mind, along with pointed suggestions for domestic and global philanthropies working on air quality in India.

Abstract:: It is on the precarious and ever-shifting terrain of Indian federalism that a modern edifice of climate governance must be built. Where is the firm ground? Are there enduring characteristics of centre-state relations that let us arrive at a relatively stable description of Indian climate governance? In this working paper, we arrive at a synthetic account of the constant forces shaping climate governance in India’s federal architecture, building on descriptions of environmental federalism and state actions in climate policy. We argue that the highly asymmetric nature of Indian federalism — a federal government holds the reins of state finances and constitutes the bulk of planning and bureaucratic capacity — makes compensatory relations between centre and states inescapable in climate governance. Emergent practices have involved the use of institutional channels of fiscal transfer and federally mandated planning processes to help catalyse climate activity across India’s states. States have taken fragments of the national agenda and adapted them to local political contexts that are hitherto innocent of ‘climate’ politics phrased as such. They play the role of marrying broader mitigation and adaptation concerns to local development. In the process, they contribute to the compensatory dynamic by creating a stream of policy ideas that then come to define the national response through channels of federal diffusion.

34. An Analysis of the Binding Constraints on Digital Financial Inclusion in India Using a Decision Tree Methodology

Abstract:: The past decade has seen significant innovation and growth in the volume and value of digital payments in India. However, we find that the associated gains have been heavily concentrated in favor of wealthier and urban customers and have had less impact on lower income and rural populations. While some customers now have a far greater selection of quick, cheap, and convenient digital payments methods, as much as 65 percent of the population remains effectively excluded. Using a decision tree framework, we test a range of factors on the supply and demand sides that could be binding constraints on further digital finance penetration. We find that an unlevel playing field in favor of the (primarily state-owned) banking sector results in a lack of effective competition that could be inhibiting greater innovation and outreach in favor of lower-income and marginalized people. This unlevel playing field is potentially a function of institutional weakness combined with the nexus of control of the government and the banking sector, which is reinforced by the position of the National Payments Corporation of India. This control may also be viewed by the government as necessary to protect economic stability in a very dynamic market. To the extent that institutional deficiencies are the root cause of regulatory barriers to the entry of new providers and the scope of digital financial services offered, they are a binding constraint on advancing digital financial inclusion. Under this market structure, the outreach and inherent business models of digital payments and transfers do not provide sufficient perceived benefits to attract large segments of the population. Further, a lack of trust in providers combines with the perception of low benefits to generate an additional binding constraint, preventing the market from reaching a critical mass at which the bulk of the population would have the means and the incentives to use the system. Therefore, the market remains at an equilibrium below its potential.

35. Women Left Behind

Abstract:: Using administrative data on over 4 million hospital visits, we document striking gender disparities within a government health insurance program that entitles 46 million poor individuals to free hospital care in Rajasthan, India. Females account for only 33% of hospital visits among children and 43% among the elderly. These shares are lower for more expensive types of care, and far lower than sex differences in illness prevalence can explain. Almost two-thirds of non-childbirth spending is on males. We combine these data with patient survey, census, and electoral data to show that 1) the program is unable to fully offset the costs of care-seeking, which results in disparities in hospital utilization because some households are willing to allocate more resources to male than female health; 2) lowering costs does not reduce disparities, because males benefit as much as females do; and 3) long-term exposure to village-level female leaders reduces the gender gap in utilization, but effects are modest and limited to girls and young women. In the presence of gender bias, increasing access to and subsidizing social services may increase levels of female utilization but fail to address gender inequalities without actions that specifically target females.

36. The Political Economy of India’s Transition to Goods and Services Tax

Abstract:: What kept the Goods and Services Tax (GST) from becoming a reality in India for a quarter of a century after the adoption of the structural adjustment programme in 1991? What made it possible in 2016? To what extent the Indian model of GST reflects a compromise between the need to keep fiscal federalism intact and to respond to a more global economic imperative? To what extent India’s transition to a concurrent dual GST has brought about a change in the principles, rules, frameworks, and institutions guiding intergovernmental fiscal interactions? This paper investigates these issues and shows that the shifts in the indirect tax regime in India since independence have taken place within the structural context of constitutional rules, the economic policy paradigm and political dynamics. Party congruence after 2014 helped to facilitate the introduction of the GST, but the shape thereof was strongly marked by path-dependent logics and the role of state governments as institutional veto players. In addition, the paper examines the ways in which India’s transition to a concurrent dual GST has brought about a fundamental change in the principles, rules, frameworks, and institutions guiding intergovernmental fiscal interactions.

37. Airing Differences? Reading the Political Narrative on Air Quality Management in India

Abstract:: Air pollution exposure is a year-round, nation-wide public health crisis in India. This paper presents a careful reading of nearly eleven hours of discussions on air pollution that took place in the upper and lower Houses of Parliament in November 2019. The discussions provide unique insight into the emerging political narrative around air quality governance in India. The parliamentarians constructed an overly peak-oriented and Delhi-centric view of the problem. Contrary to the long-held scepticism of the environment ministry, parliamentarians across political parties cited global evidence on the adverse health impacts of air pollution exposure, especially on children. In addition, they drew on themes like intergenerational responsibility, equity, and Indian cultural heritage while signaling the need to act with urgency. As the discussions were dominated by crop residue burning, the Delhi government received significant criticism for blaming farmers, and parliamentarians across the board expressed solidarity with farmers as they proposed various alternative interventions to penalties. Legislators highlighted a variety of institutional, legal, and financial opportunities to strengthen Indian air quality governance, but demonstrated relatively limited engagement with the nuances of sectoral mitigation measures. Reflecting on an issue of growing political salience in India, this paper also offers insight into significant developments and gaps in the political discourse on air pollution in the two years since these discussions, and into the present day.

38. Civil-Military Relations in Pakistan: Positive Evolution or More of the Same?

Abstract:: Civilian governance in Pakistan has never lasted longer than eleven years. 2019 is the eleventh year since General Pervez Musharraf resigned the presidency and fears of a coup may exist, but one is not probable—at least not in the near-term future. In fact, two recent Chiefs of Army Staff (COAS)—Generals Kayani and Raheel in 2009 and 2014, respectively—considered taking, but decided not to take, direct control of the government. These decisions demonstrate that military rule is no longer necessary because the Army has already attained its major goals of de facto control of the country’s nuclear and missile programs, key foreign relationships, the military budget, and national security decision-making. In effect, the military has achieved what I have previously termed a “coup-less coup.” Instead of the traditionally fraught civil-military relationship, it seems that, for the first time in Pakistan’s turbulent history, the government and military agree on the three major issues facing Pakistan: domestic politics, the economy, and India. However, key variables, such as economic stability, could quickly change the course of this relationship.

39. Can the Revenue Department Remain Urban Agnostic in India?

Abstract:: The spatial morphology of Indian cities mirrors a disconnect between the urban statutory spatial plans and Revenue records. The Revenue Department instituted during the colonial times had an overarching mandate to collect land taxes and, till today, is referred to as the "custodian of the land." This was a key institution that prepared robust cadastre maps to support the revenue collection. Post-independence, these spatial records are not updated. The institutional disconnect between the Revenue and Registration departments and Urban Land Administration Institutions in the urban and peri-urban areas coupled with poor land records affect the overall confidence in the land administration system. This further limit the nurturing of a robust land market. 42. Comments on the Draft EIA Notification 2020

Abstract:: The Ministry of Environment, Forest and Climate Change has proposed a new notification to supersede the Environment Impact Assessment (EIA) Notification 2006 that is currently in force. The Ministry has sought comments from the public on this draft EIA Notification 2020. Shibani Ghosh, Fellow, CPR, in her comments to the Ministry has highlighted that there is a crying need to overhaul the EIA Notification 2006 and the regulatory framework built around it – not only to address its various inherent weaknesses that have been identified over the years, but also to put in place systems and processes that respond to the steadily degrading environmental quality in the country. However, the draft EIA Notification 2020 fails to do so. According to Ghosh, in its current form, the draft Notification is legally untenable as it does not conform to its parent Act – the Environment (Protection) Act 1986, and is in the teeth of various judgments of the Supreme Court, High Courts and the National Green Tribunal. It dilutes the already weak processes of environmental impact assessment, expert scrutiny and public consultation, and wrongly condones violations and illegalities. The comments are divided into two sections. Section I discusses four specific reasons why the draft notification is legally untenable and Section II highlights five major concerns that arise from the proposed regulatory design.

43. Hunger, COVID-19 and The Indian Administrative State

Abstract:: COVID-19 produced an acute and widespread crisis of hunger across India, which was felt most acutely by migrant workers and those who were outside the reach of India’s highly organised but rigid Public Distribution System (PDS). The hunger was incidental to the actual disease itself, but severe enough to be considered a crisis of governance on its own as it brought the Indian state face-t0-face with one of its oldest and most enduring challenges: how to ensure that essential supplies of food reach those in need of it? Could the Indian government simply have ‘universalised’ the PDS, and made it accessible to all? It was pointed out that the Indian state had adequate buffer stocks of food grain to make this feasible. However, for reasons that were never articulated, this option was never seriously considered by the government of India. Instead, governments tried to extend the reach of the PDS delivery mechanism, and to devise ways to deliver relief outside of the PDS framework. These strategies were however quite challenging for the risk-averse, (nominally) rule-bound Indian state that is disinclined to allow for discretion in spending of government funds, making purchases and allocation of largesse. Typically, the Indian state is all the more reluctant to delegate power to exercise discretion to lower levels of government. For this reason, the Indian state governments (who were at the frontline of this response) seemed to need to devise a framework of rules for the identification of beneficiaries, even in the middle of a humanitarian crisis. As a related problem, the states also did not necessarily have the organisational wherewithal to take up rapid, decentralised and locally grounded interventions. The organisational wherewithal, so to speak, could come in various forms. Some examples of this, which we saw at play, were decentralised government, the capacity to make non-state collaborations and institutionalised systems for the ‘continuous updating’ of beneficiary lists. More fundamentally, however, what is needed is the capacity for high levels of government to be able to formulate responsive policy and to be able to trust in the ability of their subordinate ranks to carry out new interventions, often in case-specific and individualised ways. 44. Evaluating Recent Proposals to Reform the Power Sector in India

Abstract:: Reforms designed to address core issues and their sequencing and timing would be critical to ensure the eventual success of the latest initiatives in the power sector. Lessons from the experience of earlier sectoral reform programmes and recommendations regarding the general architecture of central interventions, would need to be taken on board. Through a simple scenario building exercise, this paper concludes that the parlous financial position of the distribution utilities after lockdown requires that “reforms” follow “recovery”. The concurrent roll out of stringent reform measures on several fronts during a period of severe financial stress could seriously impair the prospects of a viable power sector in the near future. This, in turn, will not only hamper our planned promotion of renewables-based electricity but act as a brake on the entire process of economic recovery.

45. PROPERTY AND SOVEREIGNTY: Creating, Destroying, and Resurrecting Property Rights in British India (1600-1800)

Abstract:: This paper, the first in a series of three papers, constitutes the first systematic legal attempt since the late nineteenth century to describe the changing configuration of property rights of zamindars (landlords) and ryots or raiyats (peasants) relative to the English East India Company in colonial India over a period of two hundred years from 1600 to 1800. This period begins with the Company’s first arrival in India to the court of the Mughal Emperor Jehangir in 1600 as merely a trading company. It ends with the introduction of the Permanent Settlement in Bengal by Lord Cornwallis, the Governor General of Bengal in 1793, pursuant to the Company’s exercise of sovereign authority over the provinces of Bengal, Bihar, and Orissa. As described in the paper, during this period of great political upheaval, scandal, and intrigue, as the East India Company gradually transitioned from a monopoly trading company to a conquering and then an administering power, Company officials, including the Governor General, and later the Supreme Council of Bengal, created, destroyed, and resurrected property rights of landlords and tenant cultivators. Following a series of experiments with land revenue administration and the lives of zamindars and raiyats, with the sole objective of maximising revenue for the East India Company, Lord Cornwallis introduced the Permanent Settlement of Land Revenue in 1793, which completely destroyed the rights of peasant cultivators in favour of zamindars, and wreaked great injustice and misery upon the people of Bengal. It would take nearly seventy years for British government to begin to reverse this injustice through tenancy protection legislation enacted in 1859, and this reversal in law would only be completed following land reforms introduced by provincial governments post India’s independence in 1947. These later developments will be the subject of the next two papers in this series.

46. Improving Housing for Urban Poor: Learnings from BLC Implementation in Kerala

Abstract:: The Government of Kerala dovetailed its state housing programme with the national scheme of Pradhan Mantri Awas Yojana in 2015 to realise the vision for ‘Housing for All’. The State Poverty Eradication Mission of the Government of Kerala, or Kudumbashree, is the state-level nodal agency for implementing the scheme in Kerala. The PMAY (U) is converged with the LIFE Mission (Livelihood, Inclusion and Financial Empowerment), the comprehensive housing scheme of the Kerala government, and is implemented as PMAY (U)-LIFE. In Kerala, the PMAY’s Beneficiary-led Individual House Construction or Enhancement (BLC) vertical emerged as the most preferred vertical, owing to an increased subsidy outlay by the Government of Kerala. Further, recognising the lack of state-owned land as a significant hindrance to the uptake of the BLC scheme, the state government converged the implementation of the BLC scheme with the third phase of the LIFE Mission in 2017. This convergence provided an additional subsidy to the landless households to purchase private land, thereby enabling their inclusion under the ambit of the BLC scheme in the state. This report is based on a primary assessment of the state of habitat improvement in Kerala, under the ambit of PMAY (U)-LIFE, through a quantitative household survey in three cities of Kerala – Kochi, Trivandrum and Mukkam. It finds that the State’s interventions towards the Housing for All agenda have underscored the importance attributed to the landless and the homeless in the state, rather than slum dwellers exclusively. The State’s interventions have also successfully demonstrated an approach towards enabling livelihoods through housing and imbibing financial empowerment among women. While the Kerala model has exhibited various successful interventions to achieve a higher uptake of the BLC under PMAY, Kerala now needs to focus on adopting a city-wide, inclusive spatial planning approach. This report concludes by advocating for the provision of allied basic civic infrastructure across the new and existing housing in the state and for a spatial integration of the beneficiaries, to ensure habitat improvement.

Abstract:: In response to the national housing scheme, the Pradhan Mantri Awas Yojana (PMAY), the Government of Odisha designed the Odisha Urban Housing Mission – Awaas in 2015 to realise the goal of housing for all in the state. With an additional outlay as subsidy from the state government and the Centre to the economically weaker sections for building houses on their own land, the Beneficiary-led ‘Individual House’ Construction or Enhancement (BLC) vertical emerged as the most preferred. During the initial days of implementation, the lack of documentary evidence for the land occupied by slum dwellers continued to exclude the majority from the purview of the BLC subsidy. To address this impediment and to enable a wider traction of the scheme, the State introduced the Odisha Land Rights to Slum Dwellers Act, 2017, entitling the urban poor to rights on the land parcels they had been residing on, depending on the tenability. After the completion of the pilot phase of the Act, the Hon’ble Chief Minister of Odisha launched the JAGA Mission, to expand the land rights programme and to transform the existing slums into liveable habitats, with the provision of all essential civic urban infrastructure. Against this background, this report aims to understand (a) the impact of the distribution of Land Rights Certificates (LRCs) among the urban poor on their ability to leverage the housing subsidy under BLC and (b) the existing conditions and challenges in the construction of houses through BLC under PMAY in Odisha. For this purpose, a stratified sample survey of 250 households was carried out in three cities of Odisha – Dhenkanal, Gopalpur and Berhampur – in addition to Key Informant Interviews (KIIs). The study finds that the dissemination of land rights to the urban poor, after the commencement of the JAGA Mission, enhanced the potential beneficiary base in the state for leveraging available BLC housing subsidies. However, the ensuing ‘house only’ approach in the State and the limited focus on improving access to basic services require urgent redressal. While the steps adopted by the Government of Odisha are vital to address the issues of urban planning and housing for slum dwellers, there is now a looming need to adopt a multi-pronged approach towards ensuring an overall habitat improvement and an integration of slums into the city fabric.

50. Unblocking Barriers to Inclusive WASH: Learnings from Slums in Bhubaneswar

Abstract:: Urban sanitation in the Indian policy space received focused attention only after the mid2000s with the introduction of a slew of programmes such as Jawaharlal Nehru National Urban Renewal Mission (JNNURM), followed by National Urban Sanitation Policy (NUSP), Swachh Bharat Mission (SBM), Atal Mission for Rejuvenation and Urban Transformation (AMRUT) and the National Policy on Faecal Sludge and Septage Management (FSSM). However, there remains limited literature based on empirical research on urban sanitation in India from the perspective of inclusion. While India made considerable physical progress in sanitation infrastructure creation in the last decade, it continues to grapple with ground realities that are causing widespread social inequalities in accessing water and sanitation. These inequalities differently affect marginalised groups – women, adolescent girls, transgender and persons with disabilities – in accessing water and sanitation, and act as barriers to opportunities for them. For the country to fulfil the commitment to the global Sustainable Development Goals (SDGs) based on the principle of ‘Leave no one behind’, it is imperative for it to place marginalised groups at the centre of programme and policy research. Often, those who are left behind face multiple marginalisations, as they live in poverty, under precarious conditions, with limited access to safe water and sanitation services. Against this backdrop, this study was conducted in 2018-19 across ten slums in Bhubaneshwar (Odisha) to explore to what extent marginalised groups access benefits of sanitation schemes and programmes. The government of Odisha has introduced a range of water and sanitation policies and strategies. These include the Odisha State Water Policy 2007, Odisha Urban Sanitation Strategies 2011 which was revised in 2017, Odisha Urban Sanitation Policy 2017, and Odisha State Urban Water Supply Policy 2013 that deal with provisioning of water and sanitation facilities for the urban poor. While this provides a conducive policy/ legal environment, it is critical to identify both the enabling mechanisms for inclusive sanitation and the barriers to inclusion that exist for marginalised groups in slums in the state. In this context, the study examined tangible and intangible effects of SBM-Urban at both household and community levels. At the household level, the study attempted to understand whether the programmes had a transformative impact on the gendered division of labour within the domestic sphere, particularly concerning water and sanitation roles and responsibilities. At the community level – in this case the slum level – the study examined whether the government programmes strengthened the participation of the most marginalised groups in decision-making processes of planning and implementation. The research proposes recommendations to support the government, Civil Society Organisations (CSOs), researchers and academics in developing inclusive sanitation policies and programmes as well as promoting inclusive approaches on urban sanitation. Some of the key recommendations include developing a framework and guideline for inclusive sanitation, initiating inclusive WASH budgeting, and upgrading the design of existing community toilets (CTs) and public toilets (PTs) to cater to specific needs of transgender and persons with disability.
