In the last several years, national courts and international institutions have increasingly begun to treat conservative or climate-adverse actions by states as violations of their obligations under international law and human rights. This has been followed by some countries more affected by climate change and engaged in international bodies to put more pressure on Global North states to protect the climate. The sympathetic attitude of international courts towards such complaints may, in the long term, force the need for increased climate ambition or even compensation payments by, among others, Poland.

El presente estudio aborda el derecho humano a la seguridad desde el enfoque de la Prevención del Extremismo Violento. La Prevención del Extremismo Violento (PEV) es una estrategia en el marco de Naciones Unidas enfocada a fortalecer el respeto de los derechos humanos. La PEV aborda el extremismo violento que conduce al terrorismo desde el enfoque de la prevención y de los derechos humanos. Lo más relevante de esta perspectiva es su innovación para garantizar la seguridad como derecho humano. Es más, la PEVsurge como respuesta a las políticas de seguridad antiterroristas que se consideran insuficientes para erradicar este fenómeno. Las medidas de acción de la PEV, por tanto, van más allá de lo que en sentido estricto se conoce como política securitaria. La educación y la cultura tiene así una función importante en la PEV, como también ponen de relieve las políticas de la UNESCO. El análisis que se desarrolla expone una propuesta de espacio dialógico que aplica la medida de educación, cultura y sensibilización a través de la literatura. Se reflexiona así, a partir del diálogo con Vida y destino de Vasili Grossman, sobre el extremismo violento y los derechos humanos.

3. Prior Rebel Experience Of Leaders And Its Influence On Physical Integrity Rights

Abstract:
Previous research shows that leaders’ prior experiences influence their policy decisions. The existing human rights literature focuses mainly on country-level factors, such as economic development, regime type and the conflict situations to explain violations of rights. This research contributes to a flourishing literature on leaders’ role in upholding rights by theorizing why and how the prior experiences of leaders affect the propensity to violate physical integrity rights. It is argued in this article that leaders with a rebel experience, and who have experienced victory in rebellion are less likely to respect human rights, while those who have suffered defeat are more likely to do so. Both types of leaders have demonstrated a willingness to take risks, but in the former case, victory reinforces their belief in taking risks, leading them to keep risk-taking, whereas in the latter, defeat teaches leaders to become more risk averse. Infringing on human rights is indeed risky, potentially leading to negative consequences such as a damaged reputation, accountability, and social upheaval. The empirical analysis of the research demonstrates that having a rebel background alone does not inherently influence a leader’s behavior regarding human rights; what matters is the outcome of the rebellion. The probability of showing respect for rights decreases when a rebellion is won, while it increases when there has been a previous loss in rebellion. The article highlights the importance of using leaders, rather than just states, as a unit of analysis to explain why certain countries commit human rights violations.

4. Proposing a Relative Enforcement Mechanism for the Treaty on Business and Human Rights

Abstract:
An Intergovernmental Working Group is established by the Human Rights Council to adopt a treaty on Business and Human Rights. According to the draft treaty the enforcement mechanism relies on a treaty body working through a reporting-based mechanism. In this article the enforcement mechanism of the treaty is analysed through the progressive model of accountability presented by Gupta and Van Asselt. It also takes further the analysis based on the progressive model by Nadia Bernaz of the enforceability measures adopted within the treaty. The enforceability of the treaty is further discussed in this article and a relative enforcement mechanism is proposed. The proposal includes structural changes within the treaty body and inclusion of the role of non-state entities for more efficient enforcement.

5. The UN Agenda for Protection: Policy, Strategic, and Operational Priorities

In his 2020 Call to Action on Human Rights, UN Secretary-General António Guterres committed to developing an “Agenda for Protection.” The agenda provides an opportunity for the UN to reaffirm that the protection of crisis-affected populations is fundamental to its purpose and values. To be effective it should address the lessons learned from previous efforts to bring about a system-wide approach to protection, particularly the Human Rights up Front initiative. Critically, it should address the systemic and structural shortcomings of the UN to effectively respond to protection crises by providing strategic coherence to the fragmented ways in which the different UN entities contribute to protection. This policy paper analyzes the policy, strategic, and operational priorities for the forthcoming Agenda for Protection. It focuses on how the UN system can reform the way it addresses protection crises while remaining mindful that its role is heavily influenced by member states. It argues that without a transformative and comprehensive approach that brings together the fragmented ways the different UN entities contribute to protection, the Agenda for Protection is likely to suffer the same fate as previous unsuccessful efforts, further undermining the organization’s credibility. The paper concludes by providing several recommendations for the UN to consider as it drafts the Agenda for Protection: Establishing a clear vision statement and a commitment to protect; Setting out a common framework of protection measures to be implemented; Designating and resourcing a system-wide lead entity on protection; Outlining procedures to scale up the response in the event of a protection crisis; Developing an implementation plan and accountability framework; and Consolidating the reporting of protection results.

InDecember 2021, the UN Human Rights Committee(‘HRC’)published its views in a ground-breaking case (Communication No2918/2016),1finding that the Netherlands had violated a child’s right to a nationality by registeringthem as having‘unknown nationality’in theircivil records. The HRCreasoned that, in so doing, the Netherlands hinderedthe child’s access to international protection as a stateless child.This was the first time that the HRChas ruled on the right of a child to acquire a nationality under art 24(3) of the International Covenant on Civil and Political Rights(‘ICCPR’).FACTSThe case revolved arounda petition by DZ, a child born in Utrecht in 2010 to a Chinese mother. In 2004, she was trafficked to the Netherlands as a minorbut managed to escape her traffickers at the Schiphol Airport in Amsterdam. She then applied for asylum, but her application was unsuccessful. In 2006, DZ’s mother was forced into prostitution. Two years later, she broke out of her captivity and reported the situation to the police, which gave her the right to a temporary status while the investigation was undergoing. 8. Multilateralism Index: Pilot Report

In the past several years, there has been a much-discussed rise in strain on multilateralism. However, there have been few efforts to quantifiably assess the state of the multilateral system. This Multilateralism Index (MI) report is the first known attempt to do so. It focuses on developments in the system over the past decade, providing a snapshot of its relative strength in 2020 compared to 2010. It seeks to answer questions including: What is the state of the multilateral system? What is working? What is not? And how has the multilateral system changed over time? The MI examines five domains of multilateral coordination: Peace and Security, Human Rights, Environment, Public Health, and Trade. Each domain is evaluated across three dimensions: Participation, Performance, and Inclusivity. Analysis of sixty-five indicators across these domains and dimensions reveals several trends in multilateral cooperation over the past decade: Participation scores for Human Rights, Public Health, and Trade have improved, while the scores for Peace and Security and Environment have deteriorated. Performance scores have deteriorated in four out of five domains. Inclusivity scores have improved across all five domains. These trends shed light on the nature of the crisis of multilateralism. Rather than decreased international cooperation and widespread exit from multilateral institutions, we are seeing a battle over the nature and purpose of the multilateral system—not decay, but transformation. The MI provides a basis for tracking this transformation and informing decision making on the future of multilateralism.

Este estudiopretende realizar una reflexión, desde una aproximación esencialmente político-jurídica internacional, sobre la pobreza como un vector susceptible de generar amenazas a la seguridad, tanto desde una perspectiva global como interna de los Estados. Sin desdeñar un enfoque de este tenor (especialmente, si es un enfoque desde el prisma de la seguridad humana), se entiende que la securitización de la lucha contra la pobreza no es demasiado útil para abordarlos problemas que genera y potenciar el desarrollo. Se aboga por orientar la centralidad político-jurídica de la lucha contra la pobreza desde su comprensión como un asunto de interés público global, al que el planteamiento programático de los ODS y el Derecho internacional de los derechos humanos ofrecen una base regulatoria sólida (sin perjuicio de las dificultades reales de llevar a cabo este programa y ejecutar las normas jurídicas internacionales sobre derechos humanos). Asimismo, no se ha querido dejar de lado la importancia colateral, pero propia, de la desigualdad.

En este trabajo examinamos el impacto que la introducción de las tecnologías digitales y la inteligencia artificial está teniendo en materia de igualdad y discriminación. El análisis de la arquitectura global de gobernanza existente, y de las propuestas para su remodelación, demuestra que existen numerosos aspectos que aún no se encuentran lo suficientemente desarrollados, lo que produce el riesgo de exacerbar las desigualdades y perpetuar las discriminaciones. La regulación de las actividades de las empresas multinacionales para anticipar y mitigar los impactos negativos sobre los derechos humanos que se derivan de las mismas y para que rindan cuentas por posibles daños, se presenta como elemento esencial en este contexto. Igualmente se precisa la adopción de acuerdos internacionales que se apliquen con carácter general a aquellas tecnologías que, por su propia naturaleza, tienen el potencial de poner en riesgo la paz y la seguridad internacionales. Este proceso debe perseguir el objetivo de ofrecer igualdad de oportunidades a los ciudadanos, la protección de los valores compartidos entre los Estados y, en definitiva, el bien común de la humanidad.

Arrests and prosecutions for consensual same-sex sexual acts, or for diverse gender expressions, continue unabated across the world. And yet, they are considerably under-reported. Our Identities Under Arrest is a brand-new publication by ILGA World offering a global overview of the enforcement of laws criminalising consensual same-sex sexual acts between adults and diverse gender expressions. The report reviews hundreds of cases in which law enforcements subjected LGBT and gender-diverse persons to fines, arbitrary arrests, prosecutions, corporal punishments, imprisonments and more – up to (possibly) the death penalty. Governments often argue that criminalising laws are ‘dormant’, but this report offers evidence that such claims are largely inaccurate. How – and how often – they are enforced can vary abruptly and in unpredictable ways, making both our communities on the ground and asylum seekers who managed to flee live perpetually under threat. The Our Identities under Arrest report will be of great value to the advocacy work of human rights defenders. It will assist asylum seekers and the legal experts working on their cases. And it will provide researchers, media outlets, governmental and global agencies with the necessary information to build a holistic picture of how the criminalisation on the grounds of sexual orientation, gender identity, and gender expression really looks like.

Abstract:
Why do new democracies comply with international human rights obligations? We analyze Paraguay’s compliance with all reparation measures requested by the Inter-American Human Rights System over the past two decades. In contrast to most studies, which focus on reparation measures ordered by a single organ in the system, our study covers all orders resulting from friendly settlements, reports published by the Inter-American Commission on Human Rights, and rulings by the Inter-American Court of Human Rights. We provide a novel classification of human rights cases, and evaluate three competing explanations for compliance: legal factors, international pressures, and domestic political will. Our analysis of 1,426 reparation-years underscores the importance of changes in political will over time.

The inclusion of the gender perspective in military operations is now a legal requirement. This exigency is mainly consequence of the doption of the UNSCR 1325. But it is also an operational requirement derived from the need to take into account in decision-making processes the human factor in all its dimensions, to ensure that military actions are adapted to the reality of the scenario in which they take place. This article tries to show that, in the process of integrating this aspect in operations, decision makers tend to only consider the legal aspects of this issue, ignoring the operational benefits that it entails. The official documents of organizations such as the UN or NATO, recognize this duality but, in practice, do not develop this perspective in their operating procedures. All this creates significant problems for those responsible for integrating the gender perspective in operations and requires the introduction of regulatory changes along these lines./Integrar la perspectiva de género en la conducción de las operaciones militares es una exigencia jurídica derivada principalmente de la RCSNU 1325. Pero es también una exigencia operativa derivada de la necesidad de tener en cuenta en los procesos de toma de decisiones el factor humano en toda su extensión, para garantizar que las actuaciones propias se adaptan a la realidad del escenario en el que se desarrollan. A lo largo de este trabajo se evidencia que, en la integración de este aspecto en las operaciones, se tiende a incidir únicamente en los aspectos jurídicos de esta cuestión, pasando por alto los beneficios operativos que conlleva. Los documentos oficiales de organizaciones como la ONU o la OTAN, reconocen esta dualidad pero, en la práctica, no la desarrollan en sus procedimientos operativos, lo que supone un problema para los responsables de integrar la perspectiva de género en las operaciones y hace necesario introducir cambios normativos en esta línea.

Editor’s note: The author was the Indian Ambassador to the UN 2013-2015. Calls for “reformed multilateralism”[1] at the UN’s 75th anniversary session in September 2020 stressed the need for equal participation by member-states in UN decision-making. Five years earlier, when adopting Agenda 2030, the United Nations General Assembly (UNGA) acknowledged the inter-linkage between peace, security, and development.[2] With its universal scope, Agenda 2030 on Sustainable Development has become the central focus of the United Nations (UN) for the foreseeable future. Agenda 2030 requires a paradigm shift in the approach of UN member-states to global issues and underscores the imperative for an inclusive human-centric approach through the participation of multiple stakeholders in UN activities. This would enable the UN to pool resources through partnerships to meet the major challenges in all its three “pillars” – political, human rights, and socio-economic development.

17. How the United States Can Support Nascent Political Parties

Supporting democracy and human rights overseas is front and center in the Biden administration’s foreign policy. The White House has committed to hold a “summit for democracy” this year, vocally condemned human rights abuses by China, and called for budget increases in foreign assistance and diplomacy critical to execute its democracy agenda abroad. As the Biden team designs this agenda, it will take stock of existing democracy assistance approaches and toolkits to make sure they address the current landscape of threats (i.e., a rise in Russian and Chinese malign influence) and changing needs of democracy partners on the ground (i.e., training on new technology). One area that is in desperate need of an update is how the U.S. helps strengthen political parties abroad, something it has done since the 1980s. The U.S. approach to supporting parties has not kept pace with the evolution of these organizations over the last ten years. Increasingly, political parties are taking novel forms that arise from so called “people power” movements and often focus more on mobilizing voters than formulating policy. One of the four most common types of parties today are those that emerge from mass protest movements and widespread latent dissatisfaction with traditional parties. Examples include the Five Star Movement in Italy, the Union to Save Romania, the New Conservative Party in Latvia, and Semilla in Guatemala. Getting support to this party type ‘right’ is important because many of the countries where these entities are emerging matter for U.S. interests. In both the Czech Republic and Slovakia – NATO allies on the front line of countering Russian and Chinese influence – new, anti-establishment parties are running the government, as traditional parties have struggled with accusations of corruption and failure to meet citizen needs. In Mexico and Brazil, both major strategic partners of the United States, emergent political organizations have taken power. In Iraq, citizens protesting government corruption and inefficiencies have formed several new parties to contest the October 2021 elections and challenge the political establishment. Yet in these and other contexts, the United States lacks an approach to structure its support of such nascent parties. Here, we outline recommendations for selecting which parties to support and then a framework to maximize effectiveness of U.S. assistance to them.

18. The Rise of Global Islamophobia and the Uyghur Genocide

Abstract:
The world is observing one of the worst humanitarian crises of this century: the Uyghur genocide, a colonial project that uses modern surveillance and widespread concentration camp apparatuses. At the heart of this genocide is a fundamental “otherization” of the Uyghur people that relies on Islamophobic policy and rhetoric to dehumanize the indigenous population of East Turkistan, known to China as Xinjiang. The Chinese Communist Party (CCP) employs Islamophobia to over-police Muslim populations and curtail their civil liber- ties. Islamophobic rhetoric has also driven surges in hate crimes against Muslim communities. The United Nations notes that this trend continues today as Is- lamophobic incidents continue to rise globally.1 The genocide in East Turkistan is the defining human rights atrocity of the twenty-first century thus far. The CCP has remolded a global trend of Islamophobia to fit their own needs—a new chapter in a horrific history. Though the motivations of the Chinese state in East Turkistan are varied, economic gain, cultural unification, and national consolidation all rank highly. Specific policies targeting the practice of Islam have allowed for a brutal crackdown on cultural norms in the region. Meanwhile, a global trend toward Islamophobia has given the genocide some political cover in the global sphere.

Realists have always held that armed humanitarian crusades are an irrational, dangerous, and counterproductive extravagance likely to cause more problems than they solve, and at great expense.1 In a world full of autocracies and communities that define their values very differently from one another, re- alists argue, the forceful pursuit of “liberal hegemony” is likely to produce only “a perpetual state of war.”2 Critical thinkers have always suspected that a thinly veiled Western liberal imperialism lay behind what some described as the “new military humanism.”3 Its confidence in Western perfidiousness was briefly shaken by revelations of its misplaced faith in the Khmer Rouge and Slobodan Milošević but restored with gusto by the false pretexts for war with Iraq in 2003. English School pluralists value international order over individual rights;4 legal positivists lament the illegality of humanitarian intervention;5 post-colonial scholars, states, and other critical writers believe humanitarian intervention is the thin end of a neo-imperial wedge to erode hard-won self-determination and sovereignty;6 pacifists complain that humanitarian war is still, after all, war, and highlight the tragic irony of taking lives in order to save lives.7 More recently, Samuel Moyn situated humanitarian intervention within a broader politics by which “endless war” has been normalized as humane at the expense of war prevention.8 So intense is global antipathy that prominent advocates of the “responsibility to protect,” like Gareth Evans, carefully distinguish the principle they champion from humanitarian intervention. Samantha Power, meanwhile, was chastened by a painful experience in Libya into doubting whether humanitarian goals could be achieved by military force.9

The Chinese government’s treatment of the Uyghurs has gone from a relatively obscure issue in the international press to a central one. It has become the subject of discussion and policymaking in the halls of governments around the world and has gained widespread awareness among the general public. This is because Uyghurs are subject to some of the worst human rights abuses in the world; in many respects, their treatment meets the accepted definition of geno- cide. The fact that these abuses are being perpetrated in the People’s Republic of China (PRC), a nation widely expected to have a major role in shaping the twenty-first century, has contributed to the urgency of the issue. The Uyghur community has welcomed the long overdue response from some governments. An increasing number of parliaments have condemned the Chinese government’s actions as genocide, and some are developing legislation aimed at addressing issues such as forced labor in the supply chain and transnational repression di- rected at Uyghurs living abroad. Although the Chinese government denounces these as attempts to meddle in their internal affairs, the repression of Uyghurs has a global dimension that requires a global response.

Article 1 of the UN Charter embodies a well-known tension that exists in international law. On the one hand, it sets out perhaps the most fundamental purpose of the UN: the maintenance of international peace and security. This principle underpins the operation of the post-World War II rules-based inter- national order. It is reflected in Article 2(4) of the UN Charter, which prohibits the “threat or use of force against the territorial integrity or political indepen- dence of any state.”1 Such prohibition, while routinely flouted by states, stands as an intransgressible rule of international law.2 On the other hand, Article 1 establishes what appears to be an equally foundational principle: promoting and encouraging respect for human rights and fundamental freedoms. Indeed, the burgeoning body of international human rights law that has arisen since the signing of the Charter has increasingly placed human rights and human security at the center of international concern.

In recent years, pervasive physical violence perpetrated by police forces across the world has come to light. From São Paulo to Cape Town, from Hong Kong to every major U.S. city, the public has witnessed—mostly through media images—policing through the use of excessive force, such as beatings, assaults, false arrests, verbal abuse, and terrorization. These acts shock us and may even make us feel unsafe. However, they are not directed toward all groups equally. The experiences of Black people fighting for justice in the United States; poor residents protesting extreme social inequality in Ecuador and Chile; Muslims in India facing violence for their religious beliefs; women in Mexico City and Santiago protesting gender-based violence; and anti-government protesters in Hong Kong demonstrate a clear pattern: vulnerable groups who oppose the state or its policies, or who seek to redress past state violence, are the primary targets of police violence.

The Responsibility to Protect is a political commitment made by heads of state and government at the 2005 UN World Summit aimed at preventing and halting four mass atrocity crimes, namely genocide, war crimes, crimes against humanity and ethnic cleansing. In doing so, states agreed that governments have the primary responsibility to protect populations within their borders from atrocity crimes, that the international community should help states in building the capacity to uphold this responsibility, and that when a state is unwilling or manifestly failing to do so, the international community must be prepared to take timely and decisive collective action in accordance with the UN Charter. Atrocity crimes do not occur in a vacuum, nor are they isolated or random incidents. Rather, they are typically the consequence of a broader process. In order to adequately prevent and respond to the threat of atrocity crimes, there is a need to understand the early warning signs, risk factors and aggravating conditions that may culminate in the perpetration of such grave crimes. Systematic or widespread human rights violations and abuses often serve as one of the key early warning signs of possible atrocity crimes. This briefing paper aims to examine the relationship between mass atrocity crimes and human rights violations and abuses, highlighting that such violations and abuses may precede and significantly elevate atrocity risks and may also constitute atrocity crimes themselves if certain thresholds or conditions are met.

Sexual orientation, gender identity and expression, and sex characteristics (SOGIESC) have been on the UN’s agenda for more than twenty-five years. Many of the earliest developments took place in the UN human rights mechanisms and Human Rights Council. Increasingly, however, UN agencies, funds, and programs are also integrating SOGIESC into their policy and programming. This paper explores what these UN entities have been doing to respect, protect, promote, and fulfill the rights of lesbian, gay, bisexual, transgender, and intersex (LGBTI) people. It looks at how the UN’s work on SOGIESC has intersected with its work on human rights, global public health, development, humanitarian affairs, peace and security, and gender. It also assesses what has been driving forward policy and programming on SOGIESC and the barriers that have held back further progress. The paper concludes with recommendations for the UN Secretariat, UN agencies, funds, and programs, supportive UN member states, and LGBTI activists across five areas: Building the human resources needed to institutionalize the UN’s work on SOGIESC; Making the UN a safe and accepting workplace for LGBTI people; Mainstreaming and coordinating work on SOGIESC; Strengthening partnerships between the UN and other actors; and Continuing to expand policy and programming on SOGIESC into new areas.

26. Considering the Protection of Civilians during UN Peacekeeping Transitions

In contrast to recent transitions, the next wave of UN peacekeeping transitions is set to occur in contexts where civilians continue to face threats of physical violence. These transitions are likely to have major implications for the protection of civilians (POC), which should be a key consideration for the UN when planning these missions’ exit strategies. As the mandate of a UN peacekeeping operation draws to an end and the UN reconfigures its presence, the strategic goals of POC will evolve. To ensure sound exit strategies, missions should revise their protection priorities and approaches as countries move from crisis management toward peacebuilding. This requires shifting from a military-dominated to a civilian-led approach to POC in coordination with humanitarian, development, and other peace actors. It also requires defining the target end state for POC—a difficult task due to political sensitivities and the technical challenges of assessing ongoing threats to civilians. In addition, exit strategies need to focus on enhancing national ownership and leadership of POC, as states ultimately have the primary responsibility for protecting their civilian population. Beyond these strategic considerations, the UN also needs to reconfigure its operational approach to POC both during peacekeeping transitions and after a mission’s closure. Under tier 1 of the UN Department of Peace Operations’ (DPO) POC concept (protection through dialogue), the UN needs to prioritize political engagement with host states and ensure that the mission’s followon presence continues to address POC in its political strategy and has adequate capacity in areas such as human rights monitoring. Under tier 2 (provision of physical protection), transferring tasks to host-state authorities without falling off a “physical protection cliff” requires delicate negotiations and significant capacity building. Finally, tier 3 (establishment of a protective environment) increases in importance as the strategic goals of a mission shift toward enhancing national ownership of POC and addressing the root causes of threats to civilians. Twenty years on from the Security Council first mandating a UN peacekeeping operation to protect civilians, the UN’s approach to POC is entering a new phase in which missions are being called upon not only to respond to threats to civilians but also to plan for their exit and a shift toward peacebuilding. To avoid the premature departure of UN peacekeeping operations when civilians continue to face threats, the UN should develop a system-wide strategy to ensure smooth and sustainable peacekeeping transitions.

As the COVID-19 pandemic has increased reliance on digital technologies, it has highlighted the growing digital divide between and within societies. Universal access to the digital world has become more urgent than ever, and failure to achieve it could undermine progress toward the Sustainable Development Goals. While closing the digital divide and increasing connectivity are among the UN secretary-general’s priorities for 2021, this goal remains elusive and faces many obstacles. One challenge is the lack of a shared understanding of what universal connectivity means. It is not just a technical challenge; it also requires addressing questions related to adoption, usage, accessibility, and the relevance and veracity of content. Another challenge is that funding for digital connectivity is uncoordinated and not easily accessible by those who need it most. There is also a lack of concerted leadership and coherent governance structures at all levels. Moreover, getting the framing right is key. National, global, and local leaders need to establish clear and compelling links between universal connectivity and the 2030 Agenda with its message to “leave no one behind.” Addressing these challenges requires a human-centered, human rights–based approach. Connectivity comes with risks, including privacy issues, misinformation and hate speech, and online violence and sexual harassment. While discussions on universal connectivity have gained momentum, these human rights considerations often remain an afterthought. Governments, businesses, and civil society need to understand connectivity as a right whose protection is their shared responsibility. Ultimately, bridging the digital divide requires a stronger and more inclusive multilateral system. Geopolitics, a lack of shared understanding, knowledge gaps, and suspicion between actors continue to hold back digital cooperation at the UN. Governments need to meaningfully include private sector and civil society actors in formal decision-making processes. In parallel, the UN should create informal platforms to build trust among stakeholders. To achieve meaningful and sustainable progress toward digital inclusion, all actors need to commit to working through a multi-stakeholder platform.

To complete the construction process, they hired migrant domestic workers, and in the process they have violated human and workers rights, putting workers at risk of death, and betraying the terms and conditions under which the workers had been hired. Since the start of the construction project there has been a massive turn for the worst in migrant worker’s rights, as they continue to be abused.

Aglobal contest between democracies and autocracies is raging on the digital front. Technology stands to alter the balance between free, open societies and closed, repressive regimes. Nation states in direct competition with the United States seek to project global influence by shaping an existing digital order to their will. Impulses toward illiberal use of technology at home threaten to curtail individual liberties, constrict opportunity, and erode a truly open society. Democracies do not yet have a model for how to confront this. In the United States, a roadmap for a solution must start with the fundamental question: How should U.S. technology companies, with the help of the U.S. government, respond to the illiberal use of technology by authoritarian actors abroad? This report contends with this question by identifying concrete actions and threat-mitigating strategies that contain the input of government, the tech sector, civil society, and academia. It provides starting points to address the systemic risk inherent in dealing with authoritarian regimes and also examines cost imposition on those complicit in tech-enabled human rights abuses. Yet a strategy aimed only at staunching the illiberal use of technology will fail in the long term. Instead, the U.S. government and tech companies alike must recruit democratic allies to purvey an affirmative agenda that promotes digital freedom across the globe. This report proposes an agenda that stresses privacy leadership by the United States and its technology companies. It identifies areas of collaboration for U.S. allies and democratic partners, like digital trade, foreign law enforcement requests for data, and technical standards. This report’s affirmative agenda also contains an imperative for U.S. tech companies to build commercial norms toward digital freedom and incentivize transparency within their own ranks. For digital freedom to prevail over authoritarian uses of technology, democracies must present something better. Together, they must establish an alternative model for the use of technology globally. These recommendations build that democratic case, starting with the United States.

The 20th century has been regulated with a conservative principle due to the fact that states could not be able to solve their national and international problems on their own, and therefore should embrace the concept of global cooperation. That is the reason why state sovereignty has been the subject of many discussions until today. When peace emerged as a human right in the form of solidarity, it was taken into consideration in the literature together with the concept of humanitarian intervention. Furthermore, after that, its validity was discussed in the context of state sovereignty. While all these discussions are taking place, many philosophers/academics, who focus on the problematic of state right or human right and whose ideas evolve to peace studies over the inevitability of wars and reach a stalemate between the subject or state over the right of intervention, bring the old concepts back to the agenda and produce new ideas for the new order. The United Nations and its partner agencies have pledged to focus on the problem and eradication of early, child, and forced marriage. On November 12, 2018, the United Nations General Assembly passed a resolution on child, early, and forced marriage. As part of this resolution, the General Assembly highlighted the need for better data collection and disaggregation of that data for improved analysis and learning. This report is a comprehensive and user-friendly concept note for a database on child marriage in humanitarian settings, a first step in eradicating the problem. The report identifies the existing knowledge and data on child marriage in humanitarian settings, gaps in that evidence base, and provides recommendations for moving forward with the creation of a comprehensive database. The authors interviewed key stakeholders on child marriage across program, policy, and academia in combination with a comprehensive literature review. The report was commissioned and funded by Save the Children U.S.

‘Conversion therapy’ is a term describing pseudo-scientific and harmful practices used to attempt altering a person’s gender expression, gender identity or sexual orientation. In 2020, ILGA World has released a ground-breaking report on the issue: Curbing Deception is an extensive global research into laws banning ‘conversion therapies’ both at the national and subnational level. The report explores the vast field of techniques used for the purpose of attempting to alter lesbians, gays and bisexuals’ sexual orientation, to prevent trans youth from transitioning or make trans people de-transition, or to force our gender expressions and roles to align with the social binary stereotypes of masculinity and femininity. It also analyses strategies beyond legal reform to restrict these harmful practices worldwide. Experimentation and abuse have long taken place under the legitimising cloak of medicine, psychology and science. As the report details, gruesome practices – including electroshock ‘therapies’, forced internments in ‘clinics’ and exorcisms – are still applied in numerous countries, pushing people of diverse sexual orientations, gender identities and expressions to living self-loathing lives, up to the extreme consequences of committing suicide. Protection from similar ineffective and cruel treatment is as urgent as ever: our report also exposes how - thanks to the tireless advocacy of activists, survivors and grassroots organisations – States, health professionals and international human rights bodies across the world are speaking up against so-called ‘conversion therapies’.

The publication is accompanied by a series of maps and charts illustrating where criminalisation, protection and recognition laws exist.

Humanitarian intervention and the Responsibility to Protect (R2P) are currently limited and encumbered by a pervasive absence of a political will. In states’ calculations, political considerations are constantly winning-out over the moral considerations of saving at-risk segments of our planet. While institutional and legal reforms undoubtedly play a role in addressing this challenge, such reforms and structures have existed for generations now, and have largely failed to bridge this gap from ‘moral necessity to political action’. What has been lacking is a moral understanding of humanitarian crises that is capable of reliably motivating the international community to undertake remedying actions, rather than merely expressions of concern. Such a moral foundation is achievable through institutional cosmopolitanism, an understanding of humanitarian intervention as satisfactions of our negative duties, and specifically the work of Thomas Pogge.

In December 2018, the Council of the European Union initiated discussions about the creation of a new sanctions regime designed to address gross human rights violations, following a proposal from the Netherlands. So far, the EU only operates three thematic sanctions regimes: those targeting terrorism, cyberattacks and chemical weapons attacks. Unlike classical sanctions packages addressing crises in specific countries, such as Guinea or Venezuela, horizontal sanctions regimes apply to individuals and entities considered to have committed severe human rights abuses. Once approved, the planned blacklist is set to become the EU’s fourth horizontal sanctions regime, enlarging its vast body of autonomous sanctions regimes, i.e. restrictions adopted in the absence of a United Nations Security Council (UNSC) mandate. Over a year after the initial Dutch proposal was tabled, the sanctions regime is still under discussion, which contrasts with the rapid adoption of previous thematic regimes. On first inspection, the slow pace of preparations is puzzling: the vast majority of EU sanctions regimes were traditionally imposed in response to human rights breaches.3 Most EU autonomous sanctions regimes currently in force cite human rights violations as the rationale for their adoption. Indeed, the emphasis on human rights as a key motivation for the imposition of sanctions sets EU autonomous sanctions apart from the practice of other international sanctions senders like the United Nations (UN).4 Given that the promotion of human rights is a centrepiece of EU foreign policy, consensus among member states in support of such a regime should be forthcoming. If human rights breaches constitute the dominant motivation for the imposition of EU autonomous sanctions, what is holding up the approval of the prospective regime? Designing a horizontal sanctions regime in the EU is a much harder task than meets the eye. The present Brief aims to unravel the challenges that make it difficult for this regime to take shape, and suggests ways in which the obstacles identified may be surmounted or, at the very least, mitigated.

But celebrations recognizing this historical landmark will occur at a time when the entire post-1945 structure of human rights, humanitarianism and multilateral diplomacy are under threat. Not since the UN was first formed have so many people been displaced by persecution, conflict and war. Not since the peak of the Cold War has the UN Security Council appeared so bitterly divided and incapable of decisive action. And as a new decade begins, there are renewed threats to international peace and security, and fresh assaults on human dignity.

Transnational solidarity movements have typically flowed from a central point located in the West, particularly in the United States, to the East and the Global South. Shadi Mokhtari describes this phenomenon as the “traditional West-to-East flow of human rights mobilizations and discourses.” Viewed individually, this phenomenon is not problematic in all cases. However, as Mokhtari argues, this one-directional flow of human rights politics precludes non-Western non-governmental organizations (NGOs) from weighing in on human rights violations committed in the United States. Human rights violations in the United States are typically experienced by marginalized communities, from the mass incarceration and disenfranchisement of African-Americans to the detention and ill-treatment of immigrants, migrants, and refugees. For a truly global human rights movement to emerge—one that is not grounded in Western paternalism and perceived moral superiority—this must change.

The effectiveness of UN peace operations depends on the “operational readiness” of their personnel, which refers to the knowledge, expertise, training, equipment, and mindset needed to carry out mandated tasks. While the need to improve the operational readiness of peacekeepers has been increasingly recognized over the past few years, the concept of “human rights readiness”—the extent to which consideration of human rights is integrated into the generation, operational configuration, and evaluation of uniformed personnel—has received less attention. This policy paper analyzes opportunities and gaps in human rights readiness and explores ways to improve the human rights readiness of peacekeepers. A comprehensive human rights readiness framework would include mechanisms to integrate human rights considerations into the operational configuration and modus operandi of uniformed personnel before, during, and after their deployment. This paper starts the process of developing this framework by focusing on the steps required to prepare and deploy uniformed personnel. The paper concludes with concrete recommendations for how troop- and police-contributing countries can prioritize human rights in the force generation process and strengthen human rights training for uniformed peacekeepers. These actions would prepare units to uphold human rights standards and better integrate human rights considerations into their work while ensuring that they deliver on this commitment. Ultimately, improved human rights readiness is a key determinant of the performance of UN peacekeepers, as well as of the UN’s credibility and reputation.

In the context of modern information and communication systems, present study was designed to examine the information and communication imbalances among the developed and under developed countries in tweets of international news agencies during 2010-16. Theoretically, the study takes roots from world system theory and structural imperialism theory. Methodologically, the triangulation of method is used. Firstly, the content analysis was performed on purposively selected tweets of four international news agencies; AFP, AP, Reuters and Xinhua about the 15 sample countries for the period of 7 year from 2010-2016. Further, the social network analysis technique was used to examine the network structures of international news determinants and world countries. This study revealed that core and semi-periphery countries are shared more and framed positively, while periphery countries are shared less and portrayal negatively not only by the international news agencies but also by their followers. Further, it was also found that Reuters’ tweets agenda about core, periphery and semi-periphery countries is different from other news agencies specifically from Xinhua. Moreover, study also found that in the tweets of international news agencies the core and semi-periphery countries are covered and shared in context of foreign relations, trade, economy, entertainment, and human interest, while periphery countries are covered and shared with reference to conflicts, disasters, and human rights violations.

Fifteen years since the adoption of the principle of the Responsibility to Protect (R2P), I would like to reflect on what it is, at its core. R2P is essentially about preventing and protecting people from the most heinous atrocity crimes – genocide, war crimes, ethnic cleansing and crimes against humanity. This essence is sometimes undermined by debates in which criticisms about implementation deficits are used to discredit the entire principle. The disconnect between the UN World Summit in 2005, when UN member states unanimously committed to protect populations from atrocity crimes, and the disparity in its implementation is highly problematic, as it leaves open the door for atrocity crimes to continue to be committed, while effective national, regional and international action is displaced by what are essentially political arguments about lack of conceptual consensus. The grim reality of today’s ongoing crises is a stark reminder of the need to redouble efforts to effectively implement the responsibility to protect.

Today, 13 October, the UN General Assembly elected Bolivia, China, Côte d’Ivoire, Cuba, France, Gabon, Malawi, Mexico, Nepal, Pakistan, Russia, Senegal, Ukraine, United Kingdom and Uzbekistan to the Human Rights Council (HRC) for the 2021-2023 term. With the elections of Côte d’Ivoire, France, Mexico, Senegal and United Kingdom, 16 of the 47 Council members during 2021 will also be members of the Group of Friends of the Responsibility to Protect in Geneva. The Human Rights Council and its mechanisms – including the Universal Periodic Review (UPR), special procedures and treaty bodies, as well as the technical assistance provided by the Office of the High Commissioner for Human Rights (OHCHR) – all play an essential role in providing early warning of the risk factors that can lead to crimes against humanity, ethnic cleansing, war crimes and genocide.

The Responsibility to Protect was adopted unanimously and without equivocation by the UN General Assembly in 2005. States accepted that each of them had a responsibility to protect their populations from genocide, war crimes, ethnic cleansing, and crimes against humanity – hitherto referred to as ‘atrocity crimes.’ They acknowledged their responsibility to assist one another to fulfil this primary responsibility. They declared they had a collective responsibility to protect populations in other countries using diplomatic, humanitarian and other peaceful means, and they promised to work through the UN Security Council to protect populations when national authorities were failing and peaceful means inadequate.

Over the twelve years during which Cuba had a seat at the UN Human Rights Council, the regime has been systematically complicit in the grave human rights violations perpetrated in other parts of the world. This can be inferred from the recorded votes, opposing to resolutions condemning dire human rights violations and calling the world into action. They have been constantly abetting and siding with autocratic governments across the world. In the bid to join the Human Rights Council during the 2021-2023 term, the one-party system stated that «should Cuba be elected to the Human Rights Council, it would continue to support its long-standing initiatives». Global democracies, especially those in Latin America who strive to consolidate the respect for human rights, shall oppose to the candidacy of Cuba and any other autocracies to the Human Rights Council, and they must do so publicly and actively in order to avoid the weakening of the International system for human rights protection.

The country report of China in the Bertelsmann Transformation Index (BTI) 2020 shows little change for the continent-sized Asian country since the last report of 2018. Structural challenges continued to intensify and the CCP’s single-party leadership does not consider democratic transformation as an objective to be pursued. On the contrary, the administration of President Xi Jinping continued to oppress opponents and dissidents while intensifying ideological indoctrination and surveillance. The deprivation of civil liberties, the concentration of power and the lack of political participation are the main reasons for classifying China in the BTI as a hard-line autocracy. At the same time, the BTI warns that China is becoming increasingly isolated from the world’s liberal democracies and loses their confidence. Human rights violations in so-called “re-education camps”, where it is estimated that more than one million Uyghurs are held, caused widespread criticism among Western democracies and lead to even more concern over China’s candidacy for the UN Human Rights Council elections in October this year.
