- Eurojust is the new judiciary co-operation unit of the European Union. This article analyses the decision-making process behind its creation, explained in terms of 'institutional games'. The establishment of Eurojust illustrates the specificities of European institutional configurations and the interactions occurring in Brussels among officials, judges and ministers. Moreover, it elucidates the important role of the leadership of the General Secretariat of the Council, and the socialisation and specialisation of a group with a high level of intellectual resources, willing to participate to the 'noble' task of institutional innovation. This article defines the determining factors of intense interinstitutional competition, where the Commission and OLAF adhere to autonomous and parliamentary principles. Furthermore, it takes into account the specific work undertaken by the Presidency (or Presidencies), as well as the decisive role of the Intergovernmental Conference, which, through the means of a high level of decision-making, enables specific moves to be made in the games.

153. Land titling and tenure security in the context of inequality

- The stated goal of land titling and administration projects supported worldwide by development agencies like the World Bank is to strengthen property rights for the poor. Formal property rights, it is argued, lead to increased tenure security, which in turn encourages property rights holders to invest. Hence, strengthening property rights for the poor contributes to facilitate pro-poor economic growth and a more equitable development. However, the link between formal land titles and tenure security is assumed rather than based on empirical evidence. This DIIS-brief reviews this and other key assumptions underlying land titling and administration interventions. Findings from research that explores rural landowners' own perceptions of the factors that constitute tenure security highlight the importance of formal titles for perceived tenure security, but only in combination with other resources. Therefore, to single out formal titles as being equal to or the most important element in tenure security does not correspond with people's perceptions. Thus, promoting land titling as the policy intervention to strengthen tenure security does not appear to be a feasible strategy for addressing the highly complex problem of insecure land tenure for the rural poor. On the contrary, emerging evidence suggests that land titling tends to make land more readily available to a larger and more resourceful circle of potential buyers. Thus, rather than facilitating pro-poor and equitable development, land titling projects may clear the road for large-scale concentrations of land that gradually exclude the rural poor.

- In order to be simultaneously effective and liberal, governments must normally be able to count on voluntary compliance – which, in turn, depends on the support of socially shared legitimacy beliefs. In Western constitutional democracies, such beliefs are derived from the distinct but coexistent traditions of “republican” and “liberal” political philosophy. When judged by these criteria, the European Union – if considered by itself – appears as a thoroughly liberal polity which, however, lacks all republican credentials. But this view (which seems to structure the debates about the “European democratic deficit”) ignores the multilevel nature of the European polity, where the compliance of citizens is requested, and needs to be legitimated by member states – whereas the Union appears as a “government of governments” which is entirely dependent on the voluntary compliance of its member states. What matters primarily, therefore, is the compliance-legitimacy relationship between the Union and its member states – which, however, is normatively constrained by the basic compliance-legitimacy relationship between member governments and their constituents. Given the high consensus requirements of European legislation, member governments could and should be able to assume political responsibility for European policies in which they had a voice, and to justify them in “communicative discourses” in the national public space. This is not necessarily true of “non-political” policy choices imposed by the European Court of Justice. By enforcing its “liberal” program of liberalization and deregulation, the ECJ may presently be undermining the “republican” bases of member-state legitimacy. Where this is the case, open non-compliance is a present danger, and political controls of judicial legislation may be called for.

- Abstract:
- The “European social model” includes a welfare regime with generous social expenditure; high employment or income protection; a well-developed system of industrial relations; and involvement of social partners in policymaking. Within the Italian social model, however, one can find three major dividing lines. The first one stems from the coexistence of different models in different areas of the country. Second, an occupation-based principle in pensions and in unemployment benefits coexists with a citizenship-based one in health and education. Finally, core workers enjoy high job and income security, whereas outsiders are highly dependent on the market. These three dividing lines substantially endanger the legitimacy and social acceptance of the Italian social model: each of them profoundly affects the perceptions of workers and citizens, leading to widespread criticism of even those aspects that clearly benefit them and, at the same time, to fierce opposition to the several attempts at reforming it.

Europe, Germany in particular, may at first have indulged in a certain amount of schadenfreude to observe the abrupt fall from grace of the U.S. financial system. But not for long. As of November 2008, the euro zone is officially in a recession that continues to deepen. Germany's government was compelled to enact a 50 billion euro fiscal stimulus package. The Japanese economy, though perhaps among the least susceptible to the vagaries of the European and U.S. economies, followed soon after, with analysts fearing that the downturn could prove deeper and longer than originally anticipated. The U.S.—Europe—Japan triad, representing the world's three largest economies, is in simultaneous recession for the first time in the post-World War II era. - In the latter half of the 1990s, as the North Atlantic Treaty Organization (NATO) was preparing to expand its membership for the first time since the admission of Spain in 1982, Russian officials claimed that the entry of former Warsaw Pact countries into NATO would violate a solemn ''pledge'' made by the governments of West Germany and the United States in 1990 not to bring any former Communist states into the alliance. Anatolii Adamishin, who was Soviet deputy foreign minister in 1990, claimed in 1997 that ''we were told during the German reunification process that NATO would not expand.'' Other former Soviet officials, including Mikhail Gorbachev, made similar assertions in 1996—1997. Some Western analysts and former officials, including Jack F. Matlock, who was the U.S. ambassador to the Union of Soviet Socialist Republics (USSR) in 1990, endorsed this view, arguing that Gorbachev received a ''clear commitment that if Germany united, and stayed in NATO, the borders of NATO would not move eastward.'' Pointing to comments recorded by the journalists Michael Beschloss and Strobe Talbott, former U.S. defense secretary Robert McNamara averred that ''the United States pledged never to expand NATO eastward if Moscow would agree to the unification of Germany.'' According to this view, ''the Clinton administration reneged on that commitment . . . when it decided to expand NATO to Eastern Europe.''

- Following the end of violent conflicts, whether by military victory or negotiated settlement, international actors such as the European Union and the United Nations play an increasing role in peacebuilding, through a range of security, governance, and development activities. These may or may not be mandated by a peace agreement or other formal settlement, and may or may not follow or work in tandem with a peacekeeping mission. International, regional, national, and local actors may work in a more or less collaborative, or coherent fashion. Nonetheless, many of the key challenges of peacebuilding remain the same, and a familiar set of policies and strategies have emerged in contemporary practice to address these. Chief among the challenges of contemporary peacebuilding is that of addressing demands for some form of accountability, often termed transitional justice (discussed in section 3). However, as this guidance paper explains, the demands of transitional justice and its relation to broader peacebuilding activities, involve not just decisions about accountability, but a complex set of policy and institutional choices about security and governance as well. Thus, this guidance paper examines peacebuilding and transitional justice as a set of linked policies and strategies regarding not just accountability, but security sector reform (SSR), disarmament, demobilization and reintegration (DDR) of ex-combatants, and development of the rule of law.

It can be profitable only when exercised from within.” Typically, authoritarian regimes exert control over what can and cannot be published or broadcast by requiring news content to be submitted to a censor prior to publication, by seizing control of media outlets or by intimidating or arresting journalists and media company owners. In many countries, censorship of the news media now manifests itself in far more subtle ways, phenomena sometimes referred to collectively as “soft censorship.” This report explores the spread of these indirect means of censorship and examines possible remedies that might be employed to attack the problem.

- This article analyses Georgia's post-Rose Revolution progress in the process of democratic transition up until the August 2008 war. The focus is on the role that the incumbent administration plays in this process, and on the internal pressures that the leadership currently faces. In the light of some important studies in the democratisation field, this article considers the extent to which President Saakashvili and his government represent a clear change in the political order vis-à-vis his two predecessors. With regard to the crises in November 2007 and August 2008, this period in Georgia's development as a nation will have a profound impact on its population, its neighbouring countries and an area of the world in close proximity to the EU. While Saakashvili has made admirable progress overall, he still retains a surfeit of power detrimental to Georgian democracy.

- In recent years, the problem of political corruption has become especially pressing in Ukraine. The scale of that phenomenon in governmental and political institutes lets us describe political corruption as an attribute of their everyday activity. Political corruption poisoned all branches and institutes of state governance, local self-government, and presents the main obstacle on the road of Ukraine’s development into a truly democratic state. Political corruption may be identified as the main reason for the political crises of 2006-2009, and in more general terms, did not let Ukraine use its chance of fundamental internal modernisation and approach to EU standards in different sectors that arose after the presidential elections in 2004. Ukraine’s political elite proved unprepared to accept an incorrupt model of politics and governance, and therefore unprepared for large-scale and, most of all, effective fighting political corruption. As a result, accusations of political corruption became only a tool of political struggle and public rhetoric of politicians. Meeting no effective counteraction, political corruption gradually evolved from deviant behaviour into a norm of relations in the state and political circles. “Hierarchic corrupt pyramids” and “closed corrupt cycles” were created in the system of governance, involving representatives of different institutes of governance. Political corruption is nourished by the activity of the most potent financial and industrial groups, and structures of the shadow economy that have enough resources to finance politics behind the scene and influence the authorities in that manner. Political and state figures secured themselves against political responsibility. Channels of public influence on the authorities are effectively obstructed. The system of parliamentary elections and most of local self-government bodies bars voters’ influence on its personal membership. Exercise of the citizens’ right to organisation and conduct of referendums, accomplishment of the procedures of presidential impeachment or bringing members of the parliament to criminal responsibility are next to impracticable. The structures primarily called to oppose corruption – courts and law-enforcement bodies – proved the most vulnerable to it. Internally corrupt, affected by varied managerial and political influences, they cannot effectively discharge their functions of fighting political corruption. The peculiarities of such inability are, on one hand, failed attempts of prosecution of top officials in cases of corruption, on the other – persecution of political opponents under invented pretexts. Further spread of political corruption in Ukraine endangers its national security, since it impairs the effectiveness of the authorities, undermines their public legitimacy, promotes legal nihilism in society, disappointment about the values of democracy and the rule of law. This results in impairment of the country’s competitiveness on the world scene, its ability to effectively counter inner and outer challenges. This study by Razumkov Centre was intended to identify the specificities and scale of political corruption in Ukraine, the fields and reasons of its growth, to provide the basis for formulation of the optimal strategy of countering that phenomenon.

The very fact of their emergence is a symptom of profound new shifts in the global financial order. To head off potential jingoist reactions against the proposed buy-ins by these new investors, there is a need to probe a set of questions about how these funds work and about whether rules can be reached – by mutual agreement – to ensure that the funds prove compatible with global capital movements.

Universities in North America and Europe now routinely advertise for positions in ''global governance,'' a term that few would have heard of a decade ago. Chapters on cosmopolitanism and governance appear in many current international relations (IR) textbooks. Leading scholars are wrestling with the topic, including Alexander Wendt, perhaps now America's most influential IR theorist, who has recently suggested that a world government is simply ''inevitable.'' While some scholars envision a more formal world state, and others argue for a much looser system of ''global governance,'' it is probably safe to say that the growing number of works on this topic can be grouped together into the broader category of ''world government''—a school of thought that supports the creation of international authority (or authorities) that can tackle the global problems that nation-states currently cannot.

- The European Court of Human Rights (ECtHR) is the crown jewel of the world's most advanced international system for protecting civil and political liberties. In recent years, however, the ECtHR has become a victim of its own success. The Court now faces a docket crisis of massive proportions, the consequence of the growing number of states subject to its jurisdiction, its favourable public reputation, its expansive interpretations of individual liberties, a distrust of domestic judiciaries in some countries, and entrenched human rights problems in others. In response to this growing backlog of individual complaints, the Council of Europe has, over the last five years, considered numerous proposals to restructure the European human rights regime and redesign the European Convention on Human Rights (ECHR). This article argues that these proposals should be understood not as ministerial changes in supranational judicial procedure, nor as resolving a debate over whether the ECtHR should strive for individual or constitutional justice, but rather as raising more fundamental questions concerning the Court's future identity. In particular, the article argues for recognition of 'embeddedness' in national legal systems as a deep structural principle of the ECHR, a principle that functions as a necessary counterpoint to the subsidiary doctrine that has animated the Convention since its founding. Embeddedness does not substitute ECtHR rulings for the decisions of national parliaments or domestic courts. Rather, it requires the Council of Europe and the Court to bolster the mechanisms for governments to remedy human rights violations at home, obviating the need for individuals to seek supranational relief and restoring countries to a position in which the ECtHR's deference to national decision-makers is appropriate.

- According to J. Rawls, 'in a constitutional regime with judicial review, public reason is the reason of its supreme court'; it is of constitutional importance for the 'overlapping, constitutional consensus' necessary for a stable and just society among free, equal, and rational citizens who tend to be deeply divided by conflicting moral, religious, and philosophical doctrines. The European Court of Justice (ECJ), the European Court of Human Rights (ECtHR), and the European Free Trade Area (EFTA) Court successfully transformed the intergovernmental European Community (EC) treaties and the European Convention on Human Rights (ECHR) into constitutional orders founded on respect for human rights. Their 'judicial constitutionalization' of intergovernmental treaty regimes was accepted by citizens, national courts, parliaments, and governments because the judicial 'European public reason' protected more effectively individual rights and European 'public goods' (like the EC's common market). The 'Solange method' of cooperation among European courts 'as long as' constitutional rights are adequately protected reflects an 'overlapping constitutional consensus' on the need for 'constitutional justice' in European law. The power-oriented rationality of governments interested in limiting their judicial accountability is increasingly challenged also in worldwide dispute settlement practices. Judicial interpretation of intergovernmental rules as protecting also individual rights may be justifiable notably in citizen-driven areas of international economic law protecting mutually beneficial cooperation among citizens and individual rights (e.g. of access to courts). Multilevel economic, environmental, and human rights governance can become more reasonable and more effective if national and international courts cooperate in protecting the rule of international law for the benefit of citizens (as 'democratic principals' of governments) with due regard for human rights and their constitutional concretization in national and international legal systems.

- During recent years, transport and infrastructure development has acquired the status of a 'topic to be mentioned by the president' and other high-level state officials in their public appearances. The rise of transport from almost complete oblivion into the sphere of state strategic interests has been rapid, and it is a subject which is likely to maintain a high profile in the years to come. Success in implementing the current plans for infrastructure development is considered critical in order to generate further economic growth. From the longer-term perspective, it will also be critical in ensuring the diversification of the economy and securing Russia's place amongst the most advanced economies in the world. The modernization of the transport infrastructure is also seen as a lever with which Russia can reposition herself as a power-house in Eurasia. In actual fact, Russia is not a bridge but the dead-end of Eurasia. The country is faced with the enormous task of modernizing its transport infrastructures and implementing structural reforms that have been postponed for years. This would pose a tremendous challenge even in the best possible external circumstances, never mind against the backdrop of inflation and uncertainty in the world markets which exists at present. Something which has changed is that Russia now has the resources and the appropriate legislation in place to carry out these tasks. Yet, even if considerable effort has gone into defining strategic priorities, infrastructure investments are still implemented in an ad-hoc manner. The country is in dire need of massive construction projects. If the quality of the state apparatus in managing government spending does not improve – and there are few signs of that materializing – infrastructure development will become the Trojan horse of the Russian economy.

It thus needs to be radically reformed if it is to reflect the priorities of an expanding and deepening Union. Over 40% of spending still supports agriculture, a declining sector; spending for research and innovation, recognised as the main driving force of productivity growth, is too low, and there is no room in the budget for the new public goods of domestic and external security that the public demands. However, the budget is determined through an inter-governmental negotiation in which no entity defends the over-arching European interest since all countries (rationally) care only about their 'net balance'.

- The recent proposals of the European Commission for a European Border Management Strategy are based on an almost blind faith in the use of large-scale databases, identification measures and biometrics for immigration and border control purposes. It is clear that these measures entail a risk to the protection of not only the right to privacy and the right to data protection, but also to the freedom of movement and the principle of non-discrimination. This paper by Evelien Brouwer, lecturer at the Law School of Utrecht University, considers the human rights implications of the Schengen Information System (SIS). Describing the case of Mr. and Mrs. Moon, who have been reported as “inadmissible” in the SIS for more than ten years, the difficulties for third country nationals trying to remedy a false or unlawful SIS report are highlighted. The Moon case illustrates that the outcome of national proceedings dealing with an SIS alert can be very different. The author concludes with recommendations to guarantee individuals' rights to effective remedies and to improve the position and powers of national courts.

- Today's market turbulence and global imbalances prompt the question whether economic and regulatory policies are poorly designed or just badly implemented. The question is urgent for Europe, which has its own asset booms and imbalances to worry about as well as the backwash of US problems. The imbalances in Europe's economies in large part reflect favourable shocks, such as falling interest rates and growing financial integration. But the 'growth crisis' in Portugal underscores the fact that there can be hard landings, even without a financial crisis, if fiscal policy is unwise and if productivity fails to take off. The current global imbalances and turbulence also have a common backdrop in the long period of unusually easy liquidity and low risk premia during which today's problems built up. This suggests that central banks should be prepared more often to 'lean against the wind' in times of asset price exuberance, and that politicians should not cut taxes or boost spending permanently on the back of revenue gains that result from transient financial booms. Banks and supervisors have many lessons to draw. Some involve going 'back to basics' on issues such as liquidity, off-balance-sheet operations, and the ability to close and reopen banks. Others require a careful look at incentives – in executive pay, rating agency roles and loan production systems. Supervisors also need to take better account of boom-bust cycles when they assess risks, and address cross-border issues in EU banking. Moral hazard has been partly addressed by pain inflicted on bank managements and shareholders. But at the macro level it may be building up as policy-makers act to limit losses in a setting where they cannot trace the ultimate fallout from risks. In future, their discretionary interventions need to be truly exceptional and much more symmetrical, or the money supply and the public debt will ratchet up amid serious resource misallocation.

- This paper analyzes major changes in the regulation of the financial sector in Europe over the last three decades. Focusing on the pattern of change across five countries (Britain, France, Germany, Italy and Spain), the paper identifies two major periods of regulatory change: first, the shift away from postwar patterns of credit regulation in the 1970s and 1980s, and second, the intensification of state supervisory powers and the introduction of new regulatory structures from the 1990s to the present. In both cases, the authors point to the way in which different models of financial sector regulation affect the political consequences of macro-economic policy for political elites as an explanation for choices that governments have made in the regulatory arena. More specifically, while regulatory change in the first period may be largely explained by the way in which different postwar models of credit regulation impinged upon a government's political ability to impose disinflation, choices in favor of different regulatory structures in the second period (single regulator in Britain and Germany versus multiple regulators in the other countries) can be related to differences in the area of pension reform. By focusing on the political implications that different modes of financial regualtion can have for elected officials in the context of different macroeconomic scenarios, the authors offer an explanation of regualtory change that differs from accounts which emphasize the primacy of financial market forces in driving such change.

- This paper provides an overview of the negotiated Nordic labor market regimes and their various paths of adjustment from bust to boom in recent decades. Developed in small, open economies, the Nordic labor regimes are often associated with strong centralized agreements and associations, high union density, and extensive worker representation, which have been embedded in social models based on close interaction between working life policies, the welfare state and macroeconomic policies. In leaner forms these features have undoubtedly contributed to the high Nordic levels of mobility, equality and employment in recent years (“flexicurity”), but an often overlooked part of the story is the increased scope for product market competition and the supply-side reforms undertaken in the Nordic countries since the crises in the 1980-90s. Another distinction of the revitalized Nordic models is the growing importance of management-union negotiations and dialogue at the company level. A key argument in this paper is thus that the capacity for negotiated flexibility and adjustment in Nordic labor markets has been critically reliant on the multilevel, single-channel pattern of articulation between centralized coordination and decentralized negotiations linking restructuring, training, productivity and pay issues.

- The rejection of the Lisbon Treaty by the electorate on 12 June 2008 has presented the Irish government with the most serious crisis in external relations since the Second World War. This was the third such referendum on Europe held in Ireland since the millennium and the second plebiscite in three to result in a rejection of an EU Treaty following the failed Nice poll in 2001. There is no obvious solution to the dilemma the government faces and no obvious pathway to achieve ratification. There is however a clear consensus amongst the political parties that ratification constitutes both a clear political priority and a fundamental national interest. At the October European Council summit in Brussels, Taoiseach Brian Cowen promised to come back to the December meeting “with a view to our defining together the elements of a solution and a common path to follow”. But the external context is now clear – EU leaders indicated an unwillingness to re-negotiate any part of the Treaty: it will be up to Ireland to find an Irish solution to this European problem. Thus the opportunity cost of the No vote has become somewhat clearer: Ireland faces marginalisation and isolation in Europe if a solution to the Lisbon dilemma is not found. The domestic context is also somewhat clearer now that we have access to extensive data that sheds light on the reasons for the No vote in the 12 June poll. In assessing the options for ratification this paper draws upon that data, presented in among other sources, the post-referendum Eurobarometer survey and the government-commissioned Millward Brown IMS research findings.

- Whereas the European Union (EU) favors a formal, binding, output-oriented, and to some extent supranational approach to cooperation, the Association of Southeast Asian Nations (ASEAN) is based on informal, non-binding, process-oriented intergovernmental forms of cooperation. This article addresses the question of whether these differences between European and Asian cooperation norms or cultures can account for interregional cooperation problems in the areas of democracy and human rights within the institutional context of EU-ASEAN and the Asia-Europe Meeting (ASEM). The author argues that a clash of cooperation cultures basically occurs in both forms of interregional collaboration between Asia and Europe, with slight differences due to the institutional context: while disagreements over the question of democracy and human rights between the EU and ASEAN have led to a temporary and then a complete standstill in cooperation, the flexible institutional mechanisms of ASEM seem, at first glance, to mitigate the disruptive effects of such dialogues. Yet informality does not remove the issues from the agenda, as the recurrent disputes over Myanmar's participation and the nonintervention norm favored by the Asian side of ASEM clearly indicate. Antagonistic cooperation cultures thus play a significant role in explaining the obstructive nature of the interregional human rights and democracy dialogue between Asia and Europe.

- We recently lost one of the most respected figures in Europe, just at a time when he would have been most needed. Bronislaw Geremek, who died in a car accident in Brussels in July, was a former Polish foreign minister and then a distinguished member of the European Parliament. Historically, he was a pivotal figure in the fight of the Solidarity movement to end Communist rule in Poland and one of the leading statesmen of the democratic era that followed. A professor of history who had become Minister of Foreign Affairs of Poland before being elected to the European Parliament, at 76, Geremek was in full stride as a man who had distilled personal and political wisdom from his involvement in history both as an historian and as an actor in European developments. He was a friend of the United States and one of the most ardent supporters of the European Union, who was Chairman of the Jean Monnet Foundation in Lausanne. I remember meeting him by chance as we were both literally running down the street in the center of Warsaw on the 14th of July 1997, trying to reach in time the place where President Bill Clinton was going to address a huge crowd a few minutes later. All the buildings were decorated with American flags, and the crowds were full of excitement. It struck me that this high official - recognizable to everyone with his white beard - could walk freely in a public street, without a limousine or bodyguards: at every corner in the old city, people of all walks of life greeted him naturally. On his visits to The European Institute in Washington, he always conveyed his dedication to the goal of turning politics into a noble art. A difficult challenge, but perhaps not impossible. At this juncture, amid confusion about how to surmount the crisis for the EU caused by the negative vote of the Irish electorate on the Lisbon Treaty, it is worth remembering the advice given by Professor Geremek in an article that appeared in Le Monde almost simultaneously with his death.1 He stressed that every effort should be made to ensure that the treaty be ratified in all the other EU countries where it is signed. Don't ask the Irish people to vote on this again, Geremek said in substance, because the outcome of the Irish referendum should be respected and governments should not try to bypass the popular will. He recommended that the other 26 governments should do their best to ratify the treaty: whatever else, the result will be a text signed and ratified in a majority of the other 26 member states. In effect, a majority will have approved the Lisbon treaty, and that will add legitimacy for the European Council to proceed, together with the European Commission and the European Parliament, to implement some measures which do not require changes in the existing treaty. For instance, the Council can decide that the High Representative for the Common Foreign and Security Policy (now Javier Solana) will from now on permanently chair the Council of Foreign Ministers and be responsible for a newly created European Foreign Service. Similarly, the European Council could decide that the President of the European Commission will chair the meetings of the European Council. While not fully representing the EU abroad, the President of the European Commission would represent the European institutions. The European Council could also propose that the European Parliament be recognized as having the right to propose legislative initiatives on the basis of public petitions (that garner, for example, one million signatures). The European Parliament could also be encouraged to take initiatives to reinforce its cooperation with the national parliaments in preparing European legislation. Increasing the rights of the European Parliament could be done by unanimous decisions of the European Council. Of course, there are changes that cannot be accomplished without a new treaty, particularly with regard to the voting system in the Council. Geremek was particularly firm that the principle of unanimity should be changed. It reminded him of a similar historical disposition in 18th-century Poland, the liberum veto that had led the country to political disaster. For the EU now to produce a new, more practical majoritysystem and to decide one or two questions that cannot be settled with the existing treaties, he suggested a new approach. Instead of bundling texts of existing treaties into a complex new proposal to be put to the public, two or three clear questions should be submitted to voters in all 27 EU member countries at the same time - for instance, on the election days for the European Parliament in June 2009. Such a process would be consistent with democratic principles. Moreover, at a moment when Russia's actions press the Old Europe and the New Europe to agree among themselves and with the United States, the West cannot afford to cling blindly to institutional arrangements that everyone knows are inadequate to the needs of the situation. Enlargement has not reduced the EU's ability to make decisions as much as many expected, but the rules of the treaty of Nice from 2001, which was supposed to be temporary and short-lived, must be improved. Both Europe and the United States feel the need for an efficient decision-making machinery in the EU at a juncture when both face the same challenges - defining relations with Russia, China, and the emerging economies; ensuring energy security; boosting economic growth; fighting terrorism and poverty; stabilizing the Middle East. It is tempting for sovereign European nations and for the powerful United States to let the role of the European institutions be minimized. But Europeans and Americans would be better served if they sought to share an ambitious vision of what the European Union should be able to provide - and how.
