1. The Future of Arms Control: Ready to (Dis)Agree?

Abstract:
Having been crumbling already for years, international arms control architecture is now in a perilous state. Existing arrangements have either been losing their effectiveness or outright failing due to Russia’s non-compliance, whilst Russia’s aggression against Ukraine might have delivered the final blow to this system. Even after the war in Ukraine has ended, it will take years to re-establish the level of trust necessary to, again, engage with Russia on arms control. The return to the pre-war ‘business as usual’, where the dialogue will resume as if never interrupted, is unlikely. Arms control dialogue with Russia ‘at any cost’ cannot produce an acceptable result. Arms control as we have known it, with its legally binding and verifiable agreements, may have come to an end. The trends emerging from the expert discussions are more focused on a different set of instruments, such as political commitments, risk reduction, or transparency and confidence building measures. Development of new technologies, proliferation of new weapon systems, the rise of China as a global player, and increasing role of non-strategic nuclear weapons in Russian and Chinese military doctrines will all have an impact on global arms control. The fate of the New START Treaty will have a decisive effect on the future of arms control and the prospects of the nuclear non-proliferation regime already under immense pressure. This report attempts to summarise the developments in arms control architecture over the last decades and accentuate the trends that might be consequential when designing the arms control system of the future. The year 2023 has already demonstrated that arms control is less relevant in Russia’s security thinking. Moscow exploits the existing arrangements mainly as leverage to influence the US and NATO’s policy towards Ukraine or obtain concessions regarding its proposals on the new European security arrangements. The role of arms control in European security might be in decline, but the key elements of European security architecture are still in place, and most states continue to implement them. NATO allies – when discussing and designing arms control or confidence-building measures – shall consider how these instruments advance the security of allies. Under the current circumstances, the priority is to strengthen defence and deterrence of the Alliance. This is the only way to lay the groundwork for a constructive arms control dialogue with Russia.

Abstract:
After Russia’s withdrawal from the Treaty on Conventional Arms Forces in Europe (CFE Treaty) formally enters into force on November 7, 2023, the remaining twenty-nine member states need to decide whether they want to keep the Treaty or dissolve it for good. The CFE Treaty no longer corresponds to the present state of European security, but its transparency and verification regime can still provide limited security advantages for NATO members and strengthen deterrence. A formal dissolution of the Treaty would undermine Western normative commitments to military transparency. In the long run, it could lead to a loss of expertise on how to conduct inspections and information exchange, which might become relevant again in the context of ending Russia’s war against Ukraine.

Abstract:
This paper focuses on countries under extended nuclear deterrence arrangements, or ‘umbrella’ states. The paper explores the ways in which umbrella states both in the Asia-Pacific region and in Europe have supported prevailing nuclear deterrence practices or distanced themselves from such practices. While there is a tendency for these countries to side with their nuclear-armed patron on matters related to nuclear weapons and nuclear disarmament norms, at times they have taken steps away from the allied mainstream position by advocating for anti-nuclear weapon policies. As long as extended deterrence has a nuclear dimension, allies will need to balance between normative pressures to support nuclear disarmament and alliance commitments that require at least passive support for nuclear deterrence practices.

Abstract:
The invasion of Ukraine by Russian forces in February 2022 has entirely transformed the European security landscape, bringing war to the European Union’s doorstep. Importantly, the war features a nuclear dimension that manifests itself in consequential ways, including Moscow’s nuclear sabre-rattling and its denunciation of the last surviving nuclear arms control treaty. This unleashed intriguing reactions, like a surprisingly tough resort to sanctions by the EU, or the shrinking of neutrality on the continent. However, while support for nuclear deterrence has increased in some NATO countries, support for arms control remains strong too. Meanwhile, nuclear disarmament advocates have not shifted their stance as a result of the crisis.

5. Blockchain Technology: An Innovative Policy Tool for Enhancing Conventional Arms Control and Verification

Abstract:
Blockchain represents an unprecedented opportunity for enhancing conventional arms control (CAC) and verification. Based on the principles of transparency, verifiability, and predictability, this state-of-the-art technology could build confidence and facilitate the implementation of arms control mechanisms. Blockchain-based so-called “smart contracts” have advantageous practical implications for CAC. They could improve the verification of countries’ compliance with their CAC obligations by enhancing monitoring procedures and could strengthen arms export controls by improving treaty signatories’ ability to monitor weapons and ammunition supply chains. Reinforcing the Organization for Security and Cooperation in Europe (OSCE) framework for conventional ammunition control with a permissioned blockchain would provide greater confidentiality and improve monitoring and data verifiability, thus strengthening the OSCE’s CAC regimes.

6. The Art of the Possible: Minimizing Risks as a New European Order Takes Shape

Russia’s war on Ukraine is poised to bring into being a new European security order. Although the last eight months have been full of surprises, that new order may very well be marked by unstable standoffs, buildups, and dangerous activities and incidents between both Ukraine and Russia and Russia and Ukraine’s Western backers. These will risk ever more dangerous crises, all with the threat of nuclear war looming. The last eight years of military deployments, near-simultaneous exercises, and other proximate activities by Russia and NATO offer some hints as to what this future may look like. These, notably, were undertaken not to prevent an escalation in Ukraine but to deter NATO from attacking Russia and vice versa. During this time, discussions about a return to conventional arms control in Europe to mitigate the dangers of military activities gained little traction with policymakers, and the agreements and arrangements that had been in place continued to deteriorate and dwindle. In late 2021, as Russian forces massed on Ukraine’s borders, the West offered Russia a return to conventional arms control solutions. Russia countered with demands that NATO return to its 1990s-era force posture and eschew any further enlargement, and then proceeded to roll its tanks into Ukraine. During the tense months prior to Russia’s invasion, the conventional arms control mechanisms that remained, such as the Vienna Document, made it possible to call out Russia’s buildup, but not reverse it or prevent attack. Although there is little logic and less appetite for new arms control deals now, an end to fighting in Ukraine will create new imperatives to make Europe safer than it is today. While sanctions can limit Russian capacity to some extent, they may well be inadequate to prevent substantial buildups. For this reason, NATO members and their partners should be thinking in advance about how they could limit Russian capabilities via negotiated arrangements with robust verification measures and repercussions for violations. Once the shooting stops in Ukraine, deals such as these could make a more secure Europe, bolstered by more reliable deterrence, attainable.

7. CSIS European Trilateral Track 2 Nuclear Dialogues

Abstract:
The European Trilateral Track 2 Nuclear Dialogues, organized by the Center for Strategic and International Studies (CSIS) in partnership with the Royal United Services Institute (RUSI) and the Fondation pour la Recherche Stratégique (FRS), have convened senior nuclear policy experts from the United Kingdom, France, and the United States (P3) for the past 13 years to discuss nuclear deterrence, arms control, and nonproliferation policy issues. By identifying areas of consensus, the group seeks to improve collaboration and cooperation among the three nations across a range of challenging nuclear policy concerns. The majority of the experts are former U.S., UK, and French senior officials; the others are well-known academics in the field. Since the Dialogues’ inception, currently serving senior officials from all three governments have also routinely participated in the discussions. The United States, the United Kingdom, and France hold common values and principles directed toward a shared purpose of sustaining global peace and security, as well as an understanding of their respective roles as responsible stewards of the nuclear order. While each of the three nations has unique perspectives and policies regarding nuclear issues and the nature of today’s security environment, as the three nuclear weapons states in the North Atlantic Treaty Organization (NATO) alliance, they play a unique and enduring role in the stewardship of international alliances and partnerships, especially in matters of nuclear deterrence, nonproliferation and arms control. In 2021, the group’s discussion addressed a range of growing challenges in the international security environment and beyond, prompting the group’s Track 2 participants to issue this statement reflecting their consensus after two rounds of meetings (one virtual and one in person). Moreover, recent events in Ukraine, including Russia’s violent cross-border aggression, endangerment of nuclear power sites, and blatant nuclear saber-rattling drive home the inescapable risks of war that occurs under a nuclear shadow and the enduring importance of close collaboration and solidarity of the United States, the United Kingdom, and France as responsible nuclear weapons states and NATO alliance members. All signatories agree to this statement in their personal capacities, which may not represent the views of their respective organizations.

Abstract:
Before the Russian invasion of Ukraine, the Biden administration insisted in arms control talks with Russia that a follow-on agreement to the New Strategic Arms Reduction Treaty (New START) should cover all nuclear weapons and that such an agreement should focus on the nuclear warheads themselves. This would represent a significant change from previous agreements, which focused on delivery vehicles, such as missiles. The United States has been particularly interested in potential limits on nonstrategic nuclear warheads (NSNW). Such weapons have never been subject to an arms control agreement. Because Russia possesses an advantage in the number of such weapons, the US Senate has insisted that negotiators include them in a future agreement, making their inclusion necessary if such an accord is to win Senate approval and ultimately be ratified by Washington. In the wake of Russian nuclear threats in the Ukraine conflict, such demands can only be expected to grow if and when US and Russian negotiators return to the negotiating table.

Abstract:
Ammunition diverted from legal to illicit markets is a central concern in small arms control, but its impact is understudied. A new Briefing Paper from the Small Arms Survey and the UN Office for Disarmament Affairs explores how authorities can go about better monitoring the role it plays in violent crime. Extracting Evidence: Opportunities and Obstacles in Assessing the Gendered Impacts of Diverted Ammunition unpacks the challenges involved in trying to assess the true costs of ammunition diverted from official stockpiles. The study describes contextual background, notes the limitations of ammunition profiling research to date, and presents findings from a pilot case study on ammunition profiling in Kosovo* as well as insights from ammunition marking policy in Brazil. It finds that authorities struggle to identify what materiel among seized ammunition has been diverted from official stockpiles, which in turn prevents the ability to truly assess the impact it has on men, women, boys, and girls. The study identifies measures for overcoming such monitoring challenges, including special marking practices for state-destined ammunition, headstamp data collection guidelines, and information sharing protocols between relevant agencies for ammunition recovered from crime scenes.
