2. Is There Life in the Desert? Russian Civil Society After the Full-Scale Invasion of Ukraine

Abstract:: By the end of 2021, all leading independent NGOs and individual human rights activists had been completely suppressed, and all issues deemed inconvenient for the Kremlin had been removed from the agenda of those still operating. This report focuses on the state of Russian civil society at the outset of Russia’s full-scale military invasion of Ukraine, as well as on how it was affected by the war and what are the prospects for its development in the future. Since Vladimir Putin came to power, Russia has been moving along the path of creating a fully state-controlled civil society in which the political potential of independent civil activism would be completely undermined. To achieve this goal, the Kremlin pro-actively advanced its network of government-organised non-governmental organisations (GONGOs) while simultaneously limiting foreign funding for NGOs. Those who did not abide by the Kremlin’s rules were systematically discriminated against and persecuted under the so-called “foreign agent” laws. Meanwhile, local authorities have stopped all formal and informal interaction with “politicised” civil actors. Russia’s invasion of Ukraine added further impetus to these trends and strengthened the Kremlin’s resolve to root out any sources of potential defiance. The independent professional NGOs that remained were in a deep crisis. Since February 2022, they have switched to survival mode. In all likelihood, they will either be co-opted by the state through a centralised system of financial support or cease to exist in the near future. The niches that they have left – including in the field of human rights advocacy – are being quickly filled by GONGOs. With their colossal resources, wider media access, and connections in the government, GONGOs are able to attract more young people to join their ranks. In many regions, even the scanty of organised independent civic activism that existed before the war was neither there nor likely to re-emerge in the coming years. In Russia, the level of involvement in NGOs has always been low and the population at large indifferent to the problems of civil society. Therefore, one should be wary of inflated expectations when contemplating the future of Russian civil activism. Even if Putin’s regime collapses, one can hardly anticipate a quick transition towards a truly independent and vibrant civil society. The study was conducted on the basis of interviews with representatives of independent NGOs from various regions who, as of February 2022, were based in Russia. The geography of this survey was expanded as much as possible to make the study more reliable and better reflect the content of the processes underway in the country. This analysis also shows that representatives from Moscow, large provincial cities, and the North Caucasus differ significantly in their perception of the current situation with civil society, whereas their visions for the future diverge considerably. A profound lack of communication among them only amplifies the divisions and fragmentations in Russia’s civil society. The situation in the North Caucasus is of particular note. Albeit being severely weakened, local independent NGOs and activists are – in contrast with the rest of Russia – more disapproving of the war unleashed by Russia against Ukraine but more optimistic about the future of their home regions. They pin their hopes on the revival of indigenous languages and cultures with the help of diasporas abroad and the emergence of civil society.

3. Supporting Russian Civil Society: A Report of the Transatlantic Forum on Russia

Abstract:: Since Russia re-invaded Ukraine on February 24, 2022, repression inside Russia has worsened. The trend toward greater repression predates Moscow’s unprovoked invasion. The Kremlin had already increased its crackdown on all facets of Russian civil society, including targeting journalists and political opposition and tightening the country’s information environment ahead of its parliamentary election in September 2021. Since the invasion, the Kremlin has intensified its repressive efforts to shut down the possibility of dissent and insulate its hold on power from any blowback from the war. Experience from authoritarian regimes like Putin’s Russia suggests that high levels of repression are here to stay as long as Putin remains in power—authoritarian regimes are unlikely to walk back repression for fear that doing so would indicate regime weakness and embolden activists who advocate for political change. Rising repression inside Russia created immediate risks to journalists, activists, and other Russians who support a freer and more democratic Russia (as well as to their families). In the longer term, it also creates a potential barrier to a less confrontational relationship with a post-Putin Russia. As repression has risen, the Kremlin has doubled down on anti–United States and anti-Western rhetoric and shut down opportunities for exchanges between Russian scientists and academics and their Western counterparts. The Kremlin’s propagation of anti-Western messages and the lack of exchange between Russians and the West—exacerbated by a loss of economic ties amid Western sanctions—engender mistrust and misunderstanding, creating a long-term barrier to a less confrontational relationship. Steps to deny Russian tourists visas and other forms of collective punishment, while understandable, have the potential to sour Russian attitudes toward the West, hurting the prospects for any future improvement in relations with a post-Putin Russia. This policy brief identifies how the United States and Europe together can continue to support Russian civil society despite the dismal state of relations with Russia. It outlines the state of play of the Kremlin’s crackdown on Russian civil society, U.S. and European responses to date, shared interests in coordinated support, and recommendations for what the transatlantic community can do to support Russian civil society in this new era of relations with Russia. Given the barriers to supporting activists inside Russia, this memo’s recommendations focus on assistance to those Russians who have left the country.

Abstract:: The Troubles period in Northern Ireland (1968 to 1998) left victims, their families, and the region with a legacy of trauma that has remained unaddressed for the past 24 years. Despite various legislative proposals to provide victims with forms of recourse, leaders have yet to implement justice provisions detailed in political agreements. As a result of government inaction, victims and survivors have lived without the truth of the past and without the ability to seek criminal charges against perpetrators who inflicted violence against them and/or their loved ones. This paper explores why civil society organizations are the best option to meet victims’ needs in the absence of government intervention.

5. Ancillary Units as a Tool of Sublocal Governance in the Polish Major Cities

Abstract:: After the post-communist transition, decentralisation and subsidiarity have become one of Poland's major principles of political organisation. Moreover, especially the original 1990 reform and establishment of self-governing communes are regarded as a success story, not only in improving the quality of governance and public service provision but also in the civil society and citizen participation, as evidenced by the development of modern urban movements. The article explores legal possibilities for further decentralisation of municipalities, analysing the role of ancillary units in regional capitals. Ancillary units in Poland have developed differently in the countryside and urban communes. Relying on publicly available information and data provided by the respective municipal offices, the article describes the ancillary units' statutory role, competencies, and actual activities. The findings enable the assessment of the application of the sublocal decentralisation solution in Polish cities and the identification of its benefits and shortcomings.

6. 2021 Civil Society Organizations Sustainability Index

Abstract:: On 15th of December 2022, the Institute for Democracy and Mediation presented the key findings of the 2021 Civil Society Organizations Sustainability Index (CSOSI). This annual index, presents the status and development trends of civil society in 74 countries around the world, focusing on the legal environment, organizational capacity, financial sustainability, advocacy, service provision, sector infrastructure and public image. The 2021 CSOSI on Albania provided an assessment of the enabling environment for the civil society sector by analyzing a number of important developments that took place during 2021. Although the overall sustainability of CSOs did not change, there were slight deteriorations in the legal environment, advocacy and public image dimensions. The legal environment suffered a decline due to some changes in the legal framework affecting CSOs. Prolonged restrictions on gatherings, limited transparency, and the lack of opportunities to consult with the government hindered CSO advocacy initiatives, while the public image of the sector slightly deteriorated as a result of ongoing attacks on CSOs and activists. Other dimensions of CSO sustainability remained largely unchanged. The report on Albania was written by IDM in partnership with FHI 360 and International Center for Not-for-Profit Law, with the support of USAID. It is based on discussions with a panel of Albanian experts, primary data gathered through qualitative research methods, as well as data gathered from a survey administered with local CSOs.

7. Children of War: The Ukrainian Case

Abstract:: The war in Ukraine has imposed considerable physical, mental, and emotional damage on children. It is critical to provide mental health and psychosocial support (MPHSS), as well as to reinforce psychological and social infrastructure—in Ukraine and countries hosting refugees—to help them cope with the immediate trauma of war and promote resilience for future reconstruction efforts. Severe damage to civilian infrastructure has left many children without access to schools, healthcare resources, and support networks within care facilities, while those who have fled Ukraine risk falling victim to human trafficking and exploitation. Moreover, children are targets of the Kremlin’s efforts to erase the Ukrainian identity, brutally executed through oppressive policies such as forced school curriculum in the occupied territories and atrocious practice of ’filtration’, with children separated, abducted, and then put up for adoption in Russia. Inside and outside of the country, Ukraine’s youth are left extremely vulnerable to abuse, with the consequences to their mental health to last for generations—and to affect the nation’s post-war recovery—if not taken care of already today. Without developing proper coping mechanisms in children and adolescents now, the trauma imposed on the young generation will hinder rebuilding efforts and undermine societal institutions. It is thus imperative to support MHPSS initiatives and contribute to a resilient society in post-war Ukraine.

8. The City and the Citizen: Breaking Down Barriers to Active Citizenship

Abstract:: Ideally, democracies are built on the ability of all segments of society to participate in civil society to enhance their community’s well-being or to claim rights. Participation in civic and political activities is a key feature of equal citizenship. Sociopolitical features of a city may influence participation, developing different citizenship practices at the local level. Cities will differ in the types of CSOs that thrive, the particular grievances that CSOs address and the types of civic activities that prevail. This study examines how different sociopolitical settings in Turkey impact the development of active citizenship practices among participants in civil society organizations (CSOs). The conditions under which CSO participation may develop active citizenship is key to understanding the potential transformation of hierarchical and passive conceptualizations and practices of citizenship at the national level in Turkey. The study is based on semi-structured interviews conducted in three cities in Turkey. Findings reveal that sociopolitical differences foster the development of different dimensions of active citizenship at the urban level and hence challenge different legacies of citizenship in Turkey.

Abstract:: The anti-gender movement has been gaining prominence since the 2000s, supporting the idea that gender theory is wrong and unscientific. Conservative civil society organizations (CSOs) have played a leading role in promoting the ideas and demands of the movement. Recent studies have elaborated on the relationship between right-wing populism, Church and anti-gender movement; however, it is still significant to further the studies focussing on the involvement of conservative CSOs in the movement. To serve this aim, this paper will analyze the role of conservative CSOs in the anti-gender movement in Eastern Europe, with particular focus on three conservative groups in Croatia, Slovakia and Poland, providing a ground against gender equality politics. The online presence of three groups – “Vigilare”, “Aliancia za rodinu”, and Centrum Wspierania Inicjatyw dla Życia i Rodziny" will be investigated with thematic analysis. This study argues that contrary to the linear relationship between civil society and democratization established by the mainstream liberal view, conservative CSOs operating within anti-gender movements work to the detriment of democracy.

13. Turning a new vision into reality: What next for the EU’s role in health?

Abstract:: In response to the COVID-19 pandemic, health has become a top priority for EU leaders. The first steps to revamp and strengthen the EU health agenda have been taken. However, to ‘build back better’ and make the most out of EU action in health, Europe must now lay the foundations for more resilient national health systems while centering the recovery on people’s well-being. All of this should be underpinned by a serious reflection on how the EU can bring added value. In this Policy Brief, Simona Guagliardo proposes how this vision can turn into reality: Despite its limited competences, the EU can support member states in making their national healthcare systems more effective, accessible, and resilient, for instance, by encouraging them to prioritise investments in health system reforms in the context of the 2021 European Semester and the Recovery and Resilience Facility. People’s health and well-being should be at the core of all policymaking. The EU must move away from only measuring progress in terms of economic growth. A reflection on the feasibility and desirability of transferring some health competences to the EU level can no longer be ignored. The Conference on the Future of Europe should serve as a platform to engage with citizens and civil society and start the debate on levelling up the EU’s role in health policy. The COVID-19 pandemic will not be the last pandemic Europe will ever have to face. Any tangible progress that the EU27 achieves in building a robust Health Union will not only be invaluable for managing today’s crisis, but also for preparing for future – and perhaps even more severe – health challenges.

14. Will the EU’s positive agenda on Turkey amount to anything more than wishful thinking?

Abstract:: One year on, it remains to be seen whether the EU’s positive agenda (PA), an effort to establish a new modus vivendi with Turkey, will bear fruit. Turkey is one of the EU’s most important neighbours and a crucial partner on numerous issues, including migration, counterterrorism, energy and trade. Yet relations have always been challenging, with honeymoon periods few and far between. Bickering and animosity have become the norm. In 2020, escalating disputes in areas from human rights to maritime claims and military interventions brought the relations to a major crisis. Looking ahead, Ankara’s domestic and foreign policy ahead of crucial elections in 2023 (or earlier), the Cyprus problem, Germany’s leadership change, the 2022 French presidential election and Paris taking over the EU Council Presidency will all impact relations. Amanda Paul gives a concise state of play of EU-Turkey relations, what we can expect and what should be avoided, and areas for improvement. While Turkish membership of the EU seems highly unlikely, neither Ankara nor the EU is ready to call it quits. With no functioning accession process, EU–Turkey relations need a new framework that reduces the chances of further rupture and creates a new dynamic. Implementing the PA should be the starting point of this framework. In which case, the EU should consider the following four recommendations: green-light the talks to update the Customs Union; enhance migration dialogue; continue support for Turkish civil society and independent journalism; and revitalise foreign policy dialogue. 2022 will likely be a testing year. If the two parties are to move away from years of distrust and muddling through, they will have to exhibit political will and acquire a truly strategic vision for the future.

Abstract:: The international community has significantly increased its focus on the improvement of justice systems around the world, in recent years. With the increase in effort and interventions in the sector, there has been a need to create tools to assess justice systems, to identify the main elements affecting the workings of the justice machinery. In a context of increasing interest and engagement in justice systems reform, the ability of citizens to access justice institutions to address their needs has come to be seen as an essential element of development, human rights, democracy, and the rule of law. The Republic of North Macedonia has been dedicated in a certain amount to improving the access to justice following these global trends. However, the pandemic has brought to the surface many obstacles in the realization of these efforts and imposed serious issues that need to be further solved. In this paper, we will elaborate on the present situation in North Macedonia from the personal experience of law clinics and civil society organizations that work and contribute closely on this issue. Furthermore, we will identify particular points that need to be advanced and relevant stakeholders to be engaged, to improve the situation, and bring justice closer to everyone.

17. Russia Meets Climate Change: The Domestic Politicization of Environmental Issues and External Pressure to Decarbonize

Abstract:: Russia’s role in international climate policy is central. Russia is the fourth largest emitter of carbon dioxide and has vast potential for developing renewable energy. However, its fossil fuel-based economy and the legitimacy it creates for the Kremlin make climate action inherently difficult. Thanks to the growing politicization of environmental issues, the relevance of climate change may increase in the Russian public debate. The effects of climate change, such as melting permafrost and the Siberian forest fires, could catalyze this process. Climate-sceptical populism may sometimes feature in the rhetoric of the political elite, but its proliferation in society is unlikely. Most Russians are concerned about climate change, even if less so than Western Europeans. However, Russia’s decision-making on climate policy is highly centralized, with little or no input from civil society actors. The energy transition in Europe can eventually deprive Russia of its main market for fossil fuel exports, but it also creates new prospects for cooperation in green energy development.

18. Anti-money laundering in Albania: What role for civil society?

Abstract:: Topics related to money laundering and terrorist financing are not new to civil society, academia and especially the media in Albania. While the latter (media) has often reported on the phenomenon , law and economics researchers have addressed both topics, although they have done so less frequently in the context of research initiatives. Civil society, on the other hand, has been more passive regarding the phenomenon and measures against money laundering (AML), or those against terrorist financing (CFT). Except for several research organizations engaged in the field of security, anti-corruption or prevention of violent extremism, concepts such as AML / CFT became widely known to civil society actors a few years ago, when Albania took additional steps to meet the standards of Recommendation 8 of the Financial Action Task Force (FATF). Specifically, this recommendation suggests that FATF member countries should improve the legal framework for non-profit organizations to prevent their misuse for financing terrorism. Furthermore, the issue of money laundering is most frequently addressed in public discourse and various research reports mainly in the context of confiscation of assets and illicit proceeds generated by organized crime. However, money laundering is yet to be examined in the context of high-level corruption and state capture, increased reporting on organized crime, illegitimate interests intertwined in politics, economics and beyond. The fight against law enforcement institutions against criminal groups and other “traditional” or contemporary challenges (e.g. cryptocurrencies) suggest that the AML / CFT capacities of state institutions need additional support, new skills, in-depth analysis and alternative sources of knowledge.

Abstract:: Danish civil-society organisations have initiated a multitude of tech and innovation projects in recent years. Now is the time to focus efforts on clear strategic objectives in order to generate tangible impacts. RECOMMENDATIONS ■ Strategically align innovation work around the core priorities of the organisation, rather than pursuing a shotgun approach that chases disparate innovations across a field of interests. ■ Expand the scope of innovation beyond radical technology to include operational approaches, methodologies and theories of change as well. ■ Localize innovation by involving local partners and beneficiaries not just in needs assessments but in innovating solutions.

Abstract:: Civil society is a crucial ally in safeguarding and upholding the European Union's (EU) values. And although the EU, and in particular the European Commission, has made a conscious effort to support civil society organisations (CSOs) across Europe, it has not been enough to counter the phenomenon of 'shrinking spaces' effectively. As the COVID-19 crisis is likely to harm civil society across Europe, through the growing restrictions on civil liberties and the subsequent economic recession, the need for better and more comprehensive support has never been more urgent. Within the realm of the Treaties, the EU institutions could take a range of measures to improve its civil society support. It could come up with a more comprehensive strategy outlining its approach towards civil society; provide adequate and flexible financial resources to respond to the needs of CSOs; and improve its dialogue processes, to 'CSO-proof' its legislation but also to benefit from the bridge-building function of civil society, thereby linking the EU's support for civil society to its attempts to improve democratic participation. While the newly presented recovery instrument and the revised proposal for the next Multiannual Financial Framework (MFF) are important steps to provide the necessary help for European societies and economies to recover, civil society support does not seem to be a priority. This is a dangerous omission. The EU must recognise the value of civil society in safeguarding democratic principles and upholding the Union's core principles. If it fails to better support CSOs through this challenging time, the EU will be able to do little else but stand and watch as democratic backsliding intensifies across member states and, in some cases, will eventually tip over into a downward spiral towards authoritarianism.

Abstract:: Demographic changes connected with aging of Polish society shall determine the situation in the labor market to an ever-growing extent. The increase of average lifespan in combination with limited options of early retirement and smaller supply of employees shall lead to higher percentage of personnel aged 60 and more inside organizations. All these factors signify that more and more frequently contemporary companies shall function with personnel characterized by a truly large age gap. Undoubtedly, age of employees significantly influences their attitude to work, system of values, loyalty toward both the co-workers and the employer, as well their professional ambitions. In spite of these major differences, individuals from various generations will be forced to cooperate in the same teams. This article presents partial results of empiric studies dealing with the issue of generational diversification of human resources conducted in local labor market of the city of Ruda Śląska, both among the employees and employers. Opinions of employees and employers concerning the quality of mutual cooperation of individuals characterized by large age differences have been analyzed and simultaneously potential opportunities for mutual learning of employees belonging to different age groups have been presented.

Abstract:: Following the Euromaidan protests and the annexation of Crimea in 2014, Ukraine has witnessed continued violence in the east of the country, with approximately 13,000 people killed, including more than 3,300 civilians, and as many as 30,000 wounded. After a period of stalled negotiations, 2019 brought new momentum to the peace process: Ukraine’s new president, Volodymyr Zelensky, and his political party ‘Servant of the People’ won an unprecedented majority in the 2019 elections, gaining full control over the executive and legislative branches of power with more than 70% of all votes cast across the country. One of the instrumental factors for President Zelensky’s victory was his promise to end the war in Donbas. To this end, he agreed to revive negotiations in the Normandy Format (between France, Germany, Russia and Ukraine) and reactivated direct communication channels with the Kremlin. The president’s message regarding reconciliation with the separatist, Russia-backed ‘People’s Republics’ of Donetsk and Luhansk appears to resonate with the majority of Ukrainians: more than 50% of citizens believe that Kyiv should negotiate a peace deal with separatist leaders and more than 70% support the Ukrainian president’s engagement in direct dialogue with Russia.

This would go beyond recommendations to cleanse the rule of law toolbox from inefficient political instruments, and strengthen legal ones. Abstract:: The EU Code of Practice on Disinformation (COP) produced mixed results. Self-regulation was a logical and necessary first step, but one year on, few of the stakeholders seem fully satisfied with the process or outcome. Strong trust has not been built between industry, governments, academia, and civil society. Most importantly, there is more to be done to better protect the public from the potential harms caused by disinformation. As with most new EU instruments, the first year of COP implementation has been difficult, and all indications are that the next year will be every bit as challenging. This working paper offers a nonpartisan briefing on key issues for developing EU policy on disinformation. It is aimed at the incoming European Commission (EC), representatives of member states, stakeholders in the COP, and the broader community that works on identifying and countering disinformation. Abstract:: Over the course of the last decade Russian foreign policy has taken critical turns, surprising not only the entire international community but also Russia’s own foreign policy experts. Arguably, the most notable turn came in March 2014 when Russia annexed the Crimean peninsula, setting in motion developments that are continuously shaping Russia, its neighbors, and, to a certain degree, global affairs. Clearly, Russia’s post-Crimean foreign policy does not exist in a vacuum. Its ramifications are colliding with regional and global trends that are effectively destabilizing the post-Cold War international order, creating uncertainties that are defining the contemporary international moment. In this report, we deal with those whose job it is to explain the logic of Russia’s foreign policy turns and to analyze global trends and their meaning for Russia and the rest of the world. Although these experts, as a rule, do not directly influence political decision-making, their debates, as Graeme Herd argues, “set the parameters for foreign policy choices” and “shape elite and public perceptions of the international environment” in Russia.1 Especially in times of crisis and rapid change ideas produced at some earlier stage by experts and think tanks external to the state bureaucracy can suddenly obtain instrumental value and direct policy options. In Part 1, we briefly discuss the role of think tanks in Russian foreign policymaking and present the landscape of Russian think tanks working on foreign policy issues. We distinguish among three basic institutional forms: academic and university-based think tanks, private think tanks, and state-sponsored think tanks. Highlighting the diversity of organizations, we then focus on four state-sponsored think tanks whose size, political contacts, and financial means allow them to dominate the think tank scene in Russia and that represent different ideological angles of a broad, yet also comparatively volatile mainstream: the Council on Foreign and Defense Policy (SVOP), the Valdai Discussion Club, the Russian International Affairs Council (RIAC), and the Russian Institute for Strategic Studies (RISI). Part 2 follows this selection by looking at Russian foreign policy debates since 2014. We consider how experts writing for these four organizations have approached three major themes: the evolution of the concept of Greater Europe and European Union (EU)-Russia relations, the establishment of the Greater Eurasia narrative in the context of Russia’s declared pivot to the East, and the concepts of multipolarity and the liberal world order.

In this short article I deal with the question of what civil society actually is and whether the idea of civil society as a motor of democratization is still a valid presumption. Civil society is an often mentioned but essentially contested concept. As the term is characterized by a plurality of different meanings that depend on the historical, cultural and legal context, there is no single, generally accepted concept that defines civil society. It remains rather unclear whether civil society includes any form of non-governmental organiza-tion (NGO), such as business people’s associations, syndicates or trade unions. Is the media part of civil society or does the concept refer exclusively to NGOs that address specific societal issues? Does the concept only refer to institutionalized and licensed organizations and associations or are social movements, thematic platforms, informal networks and other un-institutionalized forma-tions also part of civil society? After all, they do often fulfill the same functions as civil society organizations (CSOs). And how about religious organizations, are they also part of civil society?

Abstract:: Along with Vladimir Putinʼs third presidential term, intensified repression has manifested itself in line with the countryʼs increasing economic challenges. The starting point for this political trend was the so-called Bolotnaya Affair in May 2012. Since then, the regime has tightened the screws: non-governmental organizations receiving foreign funding must register as ‘foreign agents’; there are numerous restrictions on the use of the internet, as well as conditions for organizing demonstrations. The regimeʼs policies aim to send signals to the rest of society about the serious consequences that unwanted political and civic activities might cause. However, measures become inflated when the repressive deterrent targets too many. By 2019, along with the changed social mood, unparalleled solidarity against repressive policies, particularly around the regional elections in Moscow, has forced the authorities to retreat from some of their initial repressive goals. The Kremlin duly has to re-evaluate the usage of its repressive deterrent against the political opposition and civil society.

Abstract:: In 2018, the U.S. Embassy in Tbilisi initiated people-to-people (P2P) exchanges to the United States for agricultural scientists and university leaders from the Russian-occupied Georgian territory of Abkhazia. An initial study tour in the spring of 2018 focused on mitigating the devastating agricultural damage from the Brown Marmorated Stink Bug (BMSB), and a second tour in the fall of 2018 focused on higher education leadership. Despite political sensitivities and logistical hurdles, such people-to-people programs increase participants’ understanding of the United States and give them an unbiased, first-hand experience of American civil society, its culture of innovation and democratic values. For otherwise isolated Abkhaz thought leaders, these experiences directly counter Russian anti-Western propaganda and demonstrate the benefits of Georgia’s pro-Western choice.

Abstract:: As the domain of civil society burgeoned in the 1990s and early 2000s—a crucial component of the global spread of democracy in the developing and postcommunist worlds—many transnational and domestic actors involved in building and supporting this expanding civil society assumed that the sector was naturally animated by organizations mobilizing for progressive causes. Some organizations focused on the needs of underrepresented groups, such as women’s empowerment, inclusion of minorities, and LGBT (lesbian, gay, bisexual, and transgender) rights; others addressed broader societal issues such as economic justice, social welfare, and antipoverty concerns. In many countries, the term “civil society” came to be associated with a relatively bounded set of organizations associated with a common agenda, one separate from or even actively opposed by conservative political forces. However, in the past ten years, this assumption and outlook are proving increasingly incorrect. In many countries in the developing and postcommunist worlds, as well as in long-established Western democracies, conservative forms of civic activism have been multiplying and gaining traction. In some cases, new conservative civic movements and groups are closely associated with illiberal political actors and appear to be an integral part of the well-chronicled global pushback against Western liberal democratic norms. In other cases, the political alliances and implications of conservative civil society are less clear. In almost all cases—other than perhaps that of the United States, where the rise of conservative activism has been the subject of considerable study—this rising world of conservative civil society has been little studied and often overlooked. This report seeks to correct this oversight and to probe more deeply into the rise of conservative civil society around the world. It does so under the rubric of Carnegie’s Civic Research Network project, an initiative that aims to explore new types of civic activism and examine the extent to which these activists and associations are redrawing the contours of global civil society. The emerging role and prominence of conservative activism is one such change to civil society that merits comparative examination. Taken as a whole, the report asks what conservative civic activism portends for global civil society. Its aim is not primarily to pass judgment on whether conservative civil society is a good or bad thing—although the contributing authors obviously have criticisms to make. Rather, it seeks mainly to understand more fully what this trend entails. Much has been written and said about anticapitalist, human rights, and global justice civil society campaigns and protests. Similar analytical depth is required in the study of conservative civil society. The report redresses the lack of analytical attention paid to the current rise of conservative civil society by offering examples of such movements and the issues that drive them. The authors examine the common traits that conservative groups share and the issues that divide them. They look at the kind of members that these groups attract and the tactics and tools they employ. And they ask how effective the emerging conservative civil society has been in reshaping the political agenda.

Abstract:: The decision to be a whistleblower is not easy. Mental trauma, the risk of retaliation, the potential loss of employment or ostracization by work colleagues—not to mention the impact on one’s personal life—all weigh heavily on the individual who decides to speak out for the common good. But when potential whistleblowers feel too vulnerable to act, it's society itself which suffers. In this report, whistleblowers from eight European countries describe what they experienced after they took a stand. Additionally, civil society experts weigh in on how the EU can craft policies to better protect whistleblowers. The question of how to define whistleblowing—does it apply to sexual harassment, can NGOs be considered whistleblowers, and so on—is also explored. The report ultimately recommends an EU-wide directive on whistleblowing, which it argues would give whistleblowers the protection they need to step forward. The report also argues that a multi-level, multi-stakeholder approach would emphasize the value of whistleblowers and the crucial role they play in a healthy open society.

In particular, respondents cited issues regarding the independence of the judiciary, a lack of tolerance by the ruling party as reflected in perceived xenophobic and discriminatory language, a growing deficit in transparency, and a lack of inclusion with respect to political processes. Finally, interviewees noted the government’s increasingly centralized control and perceived politicization of funding for Civil Society Organizations (CSOs), especially with respect to traditional human rights CSOs. This report provides recommendations to CSOs, donors, the U.S. government, and Europe on how to help build the capacity of civil society, be that through new business models, funding streams, or fostering global and regional networks.

Abstract:: Parliamentary oversight refers to the ongoing1 monitoring, review, evaluation and investigation of the activity of government and public agencies, including the implementation of policy, legislation and the expenditure of the state budget. Parliamentary oversight is one of the most important manifestations of the separations of powers in a democracy. Parliamentary oversight must extend to all areas of government, including intelligence and security services. Intelligence services work in secrecy and have the authority to make use of special powers that potentially are highly invasive of human rights. Communications interception and secret surveillance are only two of such powers. For these reasons, intelligence services are regarded by the public with suspicion and lack of confidence. Therefore, the need for legality, legitimacy and accountability is even higher for intelligence services than for other government agencies. As the lawmaker, parliament is responsible for enacting clear, accessible and comprehensive legislation establishing intelligence services, their organisation, special powers and limits. Parliamentary oversight activities review, evaluate and investigate how laws are implemented and how intelligence operations are in line with the constitution, national security policy and legislation. Parliament also approves the budget of intelligence services and can play a strong role in scrutinizing expenditure. Effective parliamentary oversight ensures a bridge between intelligence and the public and brings benefits to all: intelligence community, parliament itself and most importantly, the citizens.

42. A decisive year for the EU’s re-engagement with the Western Balkans

Abstract:: After years of taking the Western Balkan region for granted, the EU has woken up to the dramatic deterioration of democratic standards in its nearest neighbourhood. Author Erwan Fouéré argues that the EU now has a chance to reassert its leadership in the debate about the future of the Western Balkans and should seize it to renew its commitment to the region. He offers a number of policy recommendations in this regard: The European Commission’s forthcoming Enlargement Strategy Paper should: i) set out a vision for the long term to transform the countries of the region into functioning democracies, with accountable governments and viable economies. ii) address the root causes of the deep malaise facing the Western Balkans, in particular the ‘state capture’, and prioritise the principles of rule of law and fundamental rights that lie at the heart of the accession process; iii) put forward meaningful initiatives for the benefit of society at large, such as in the areas of – integrated education in multi-ethnic societies; – reconciliation programmes and local efforts towards transitional justice, including the financing of international investigative experts; iv) set out a clear commitment to a more consistent and direct support for civil society at all levels and at all times. It should also promote more direct and public support for independent media, including more financial support for targeted projects; v) assume a proactive role in bilateral disputes by promoting targeted cooperation with both the OSCE and the Council of Europe; vi) support civil society’s role in resolving bilateral disputes, particularly in cross-border areas; vii) propose a substantial increase in pre-accession funding to the region, including a possible merging of funds with the International Financial Institutions, and open access to EU structural funds. Also, the Communication on Enlargement (April 2018) should include recommendations for the opening of accession negotiations with both Macedonia and Albania, assuming the reform programmes in both countries proceed as planned. It should also recommend the opening of a screening process in chapters 23 and 24 of the accession process with all the remaining countries. The EU-Western Balkan Summit in Sofia (May 2018) should confirm the renewed momentum for the EU’s commitment to the region, and should become the first of yearly summits.

Abstract:: This article explores the use of crowdsourced volunteer battalions by the Ukrainian government in response to Russian aggression in the Donbas region. It examines the weakness of the Ukrainian Armed Forces, contributions of civil-society, and the creation, development, and combat operations of volunteer battalions. The use of crowdsourcing provided the emergency military force that the Ukrainian Government needed to stabilise the Donbas region in the face of the 2014 Russian-backed separatist offensive. The article concludes by raising concerns that the negative consequences of crowdsourcing war, while mitigated by actions taken by the Ukrainian Government, have the potential to return if the situation in Ukraine deteriorates.

The Brussels conference should also set the foundation for inclusive and meaningful participation of Syrian NGOs and civil society, including youth and women’s groups, as key partners in ensuring effective post-agreement planning that captures the needs and desires of the people of Syria and supports local community rebuilding and resilience.

Abstract:: Reform is a word that is used frequently with respect to the democratic transformation of Ukraine following the change of regime after the manifestations and demonstrations in the Maidan square around the change of the year 2013/14. Unfortunately, very few analysts consider ethno-cultural governance and national minority protection important aspects of the reform efforts. Establishing permanent and functioning inter-ethnic structures receives little attention, except in the small circle of human rights defenders. Although a breakout of inter-ethnic tensions is on everybody’s mind, establishing lasting legal and political institutions for stable and peaceful inter-ethnic relations remains absent from most of the international debate on the future of Ukraine. Indeed, it has been argued that reforms with high relevance for the country’s future, such as territorial and administrative reforms have been largely ‘ethnically neutral.’ This Issue Brief discusses four pathways towards sustainable ethno-cultural governance and stable inter-ethnic relations in Ukraine and proposes institutionalized and open dialogue as well as awareness campaigns as a cross-cutting tool to avert tension.

Abstract:: Russia’s military aggression gave rise to many spontaneous social and economic developments in Ukraine. At this critical moment, and against the backdrop of a series of dramatic events – the Revolution of Dignity in 2013–2014, the subsequent annexation of Crimea, and the armed conflict in the east of the country that developed from artificially provoked separatist sentiments directed from outside the region – people showed a strong will to self-organise, albeit for a short period of time. Thus, one can say that the birth of the mass volunteer movement played a decisive role in preserving the integrity of the Ukrainian state, thereby meeting the demands of the period of crisis. The patriotically-minded population, aware of the significant dangers posed by ongoing events, sought to fill the gaps of leadership that existed not only in political and socio-economic realms, but also in defence and national security. The voluntary movement thus partly assumed several functions of a government that had shown itself unable to respond effectively to hybrid threats – making it a unique phenomenon in the history of modern Europe. But just who were these volunteers? What motivated them and brought them together? How could ordinary people spontaneously organise themselves to contain the military threat – and to be first on the front lines? To explore such questions, ICDS established an interdisciplinary research team to study the involvement of volunteers in defending Ukraine against Russia’s aggression. Recognising that our study cannot cover every single aspect of this complex phenomenon, our objective instead has been a more modest one: to provide the public with an outside perspective that can foster deeper understanding of how a volunteer military movement can be formed during a chaotic period of active military operations. We hope that this analysis will be also useful to the Baltic states, where volunteers are already extensively involved in national defence. As expected, when we started the project we found that the phenomenon of military volunteers in Ukraine had been rather thinly studied. It is thus welcome that some publications covering and highlighting this topic have been released during our research period. It should also be noted that the personal stories of those who were “first on the front lines” still carry enormous emotional weight. In a country that is de facto still at war, it is difficult to track, fully understand, or reliably analyse complex processes such as the volunteer movement. Accordingly, our work required the development of an effective and objective approach to analysing the processes of creating, developing and integrating volunteer units. We hope that this report will serve as a starting point for further research and expert discussion.

With the growing tension between East and West, and with the rejection by Russia of common international rules, the question how the post-Soviet states should construct their foreign relations remains of utmost importance. Armenia, a landlocked country in the South Caucasus, has yet to accomplish its transition from socialism to democracy and market economy. Moreover, efforts along these lines have regressed, and the authorities do little to implement reforms or to establish a healthy system of checks and balances. In recent months the country has been overwhelmed by protests. The authorities neither address domestic problems nor satisfy protestor demands. Instead the Armenian government frequently resorts to disproportionate use of police forces against peaceful protestors. With political prisoners and hundreds of detained civil activists, journalists and politicians, it will be impossible to build an independent and prosperous country. Armenia has a rich history and culture, but at the same time it has experienced dark historical periods. The Armenian Genocide of 1915 and the unresolved Nagorno-Karabakh conflict shape Armenian identity. However, such historical issues have been instrumentalized by the Armenian government. Instead of building the future, Armenian authorities emphasize the past. Policies based on past grievances lead the Armenian government to become more and more dependent on Russia. Armenia needs to tackle corruption, falsified elections, a corrupt judiciary and many other problems -- and Western partners whose efforts are based on democratic values, free and fair elections, and respect towards human rights have a crucial role to play. This chapter offers background on Armenia's relations with various actors, historical matters that shape Armenian identity, and the failure and lack of will to improve the country's current situation. It then discusses the role of the West and its importance for Armenia. We seek to answer why Armenia slowed down its reform efforts, what the West needs to do to improve the situation in Armenia.

59. Minority Rights Governance: Avoiding the Pitfalls of Equal Treatment when Budgeting for Education

Abstract:: When governments are faced with economic crises, the education sector is often the first sector to experience budget reductions. This may hit educational programmes for minorities disproportionally harder, if austerity measures are applied equally across the board, as positive measures adopted as a result of minority protection schemes are more costly than regular educational programmes. Minority educational programmes incur higher cost per pupil due to additional and extra-curricula topics and activities aimed at preserving and promoting minority cultures. Cutting special programmes may inadvertently or perhaps deliberately lead governments to discriminate against minority pupils, who have enrolled in minority schools or programmes. Unfortunately, there is little guidance for policy makers and school principals in this regard. International human rights law instruments prescribe positive measures without explaining how these should be safeguarded during economic hard times. Only two international soft law documents provide some guidance with regard to education for minorities. This Issue Brief will examine the standards and guidance available in international law and put these in a perspective of actual practice of education for minorities in Europe. The main argument is that equal treatment or equal reductions across the board do not secure equality; equitable processes protecting positive measures are needed.

Abstract:: This article discusses three credible attempts by African governments to restrict the jurisdiction of three similarly situated sub-regional courts in response to politically controversial rulings. In West Africa, when the Court of the Economic Community of West African States (ECOWAS) upheld allegations of torture by opposition journalists in Gambia, that country’s political leaders sought to restrict the Court’s power to review human rights complaints. The other member states ultimately defeated Gambia’s proposal. In East Africa, Kenya failed in its efforts to eliminate the East African Court of Justice (EACJ) and to remove some of its judges after a decision challenging an election to a sub-regional legislature. However, the member states agreed to restructure the EACJ in ways that have significantly affected the Court’s subsequent trajectory. In Southern Africa, after the Southern African Development Community (SADC) Tribunal ruled in favour of white farmers in disputes over land seizures, Zimbabwe prevailed upon SADC member states to suspend the Tribunal and strip its power to review complaints from private litigants. Variations in the mobilization efforts of community secretariats, civil society groups and sub-regional parliaments explain why efforts to eliminate the three courts or narrow their jurisdiction were defeated in ECOWAS, scaled back in the EACJ and largely succeeded in the SADC.

Abstract:: This working paper aims to support the ongoing efforts of the Palestinian executive authorities, security forces, independent institutions, civil society organisations (CSOs) and the media to strengthen the Palestinian complaints system. It identifies deficits in the complaints system of the Palestinian security sector and proposes recommendations to rectify them. It particularly stresses the need to improve coordination between the vast number of complaints units and calls for greater clarity on the role of civil society and the media. It hopes to raise awareness for these issues among Palestinian decision-makers and citizens and international actors. When fully functioning, the complaint handling system can be an effective source of information for the government to improve its performance and develop its services. The paper builds upon the discussions of the complaints working group, consisting of Palestinian government officials and representatives of the security forces, civil society and the media. DCAF presented the recommendations to senior Palestinian decision-makers in late September 2016, providing these with cases of international best practice.

Abstract:: In the period between September 2015 and March 2016 Croatia was faced with a refugee crisis during which over 700 000 people passed through its territory on their way to Western Europe. Croatia was just one of the transit countries on the so called Balkan route. This study, authored by Senada Šelo Šabić and Sonja Borić, presents an analysis of the situation in the four countries along the route: Macedonia, Serbia, Croatia and Slovenia, taking into account the wider European context. The analysis of each country includes an overview of procedural solutions, relevant legislative framework, political discourse, media reports and the role of the civil society in the crisis.

Abstract:: In the early part of the twentieth century, the small group of revolutionaries who became the Russian Bolsheviks developed an alternative theory of civil society. Burke, Tocqueville, and even Russian intellectuals believed that civil society was fundamental to democracy; Lenin believed that the destruction of civil society was crucial to totalitarian dictatorship. But by attempting to control every aspect of society, totalitarian regimes would eventually turn every aspect of society into a potential source of dissent, as in the cases of Czechoslovakia and Poland. Yet in many other societies heavily influenced by Soviet ideology—those in Belarus, Central Asia, China, Cuba, parts of Africa, and much of the Arab world—those in power remain attached to the old Bolshevik idea that independent civic institutions are a threat to the state.

Abstract:: The EU’s “eastern neighbourhood” is an increasingly complicated and contested space. The challenge of Russia’s resurgence and regional elites’ resistance to reform are forcing the EU to reevaluate its policies. With the launch of its Eastern Partnership six years ago, the EU was ready to offer its neighbors to the east—Armenia, Azerbaijan, Belarus, Georgia, Moldova, and Ukraine—integration into the EU market, mobility of people, and close political ties in exchange for rule of law and democratic and economic reforms. Today, it questions whether this policy has secured its strategic interests and political influence. The Eastern Partnership reinforced domestic constituencies for change in at least three partners—Georgia, Moldova, and Ukraine—that in 2014 signed association agreements. It has not lost the potential to contribute to democratic processes and support reformers in the other three: Armenia, Azerbaijan, and Belarus. The Eastern Partnership remains the EU’s most effective foreign policy instrument to build accountable and stable institutions and states, and uphold the EU’s commitment to its neighbors’ sovereignty and right to make independent foreign policy choices. This policy paper—the result of extensive discussions with experts and civil society leaders—highlights local concerns and expectations about the EU’s role in the region and its support for stability and democracy. As the EU rethinks its policies in the area, this paper offers recommendations on how to make the Eastern Partnership more effective and relevant to people, societies, and government, and to secure the EU’s interests in an increasingly polarized and unstable region.

Abstract:: Reflecting upon the ambiguous relationship between international civil servants and international law in both theory and practice, this review essay examines several recent books that address the life and legacy of Dag Hammarskjöld, the second Secretary-General of the United Nations. Drawing upon recent theoretical work regarding international organizations, the essay argues that the authority of international civil servants should be understood as operating through three distinct yet interconnected modalities of discourse and practice: legal, moral and expert. Moreover, a comprehensive account of the authority exercised by international civil servants must take account of how they respond to any tensions that arise between their bases of authority as well as of their shifting relations with other ‘global governors’. The essay considers the depiction of Hammarskjöld by each of the books under review, highlighting the sometimes overlooked interconnections between the different sources of authority upon which he drew and suggesting some starting points for an alternative, integrated account of his thought and practice.

Abstract:: The return of geopolitics to Europe from the East together with the publics‘ reaction to the spectre of immigration from the South has finally dawned on EU’s politicians. It is no longer possible to pretend that the „outside“ and the „inside“ can be kept apart. Europe‘s identity is being questioned with surprising intensity and in unexpected ways. Reactionary East- West political and cultural alliances are being forged, feeding and fed by nationalism, populist radicalism and antiliberal conservatism with Eurasian flavour. At the same time European citizens volunteer to take part in wars abroad, mirrored by and linked to acts of terrorism and violence in European countries. With state, institutions, parties and democratic politics in decline, what are the chances for peace and European democracy? We have to understand what is going on. Europeans inside the Union have to know how they are seen by our neighbours East, Southeast and South. What are their expectations? What do they want to achieve by joining the EU? What are they ready to sacrifice to reach that goal? On the other hand, we need to be clear what defines Europe’s own attitude towards others. Is it trade, economic interests, security or moral values? Can Europe still define its own ways or has it lost the initiative to others? Who can and should take action? The Ukraine crisis is forcing Europe to recognise that its post-Cold War order has reached its limits and needs to contend with harsh facts. Europe has to acknowledge the real world beyond its borders while focusing its energies on consolidating its own political space, which now also includes Ukraine.

Abstract:: This paper contributes to the debate on the role of democratic participation in complex systems of governance. It takes a process-oriented constructivist approach asking how transnational activism over time contributes to the construction of access and voice from below and uses the Asia-Europe Meetings (ASEM) to analyze how interactions between civil society and global governance institutions shape concrete forms of participation. The paper shows that transnational activism triggers both discursive and institutional changes within the official ASEM process leading to an informal, fragmented, and fragile institutionalization of civil society participation. However, the paper reveals a division between civil society organizations with some, such as business representatives, having preferential access and voice in comparison to more contentious organizations. The paper explains this fragmented form of democratization as the result of three interrelated processes: the particular history and economic origins of the ASEM; international developments particularly in the ongoing economic crisis; and domestic developments within individual countries (in particular China) which have begun to favor controlled access for civil society participation.

Abstract:: The recent protests in Bosnia-Herzegovina (henceforth, Bosnia) have once more shown the extent of the remaining challenges in the country. However, while many commentators have examined the political, economic and social roots of the protests, less attention has been paid to the role of the police in these events. Police confusion, their inability to respond to the street protests in a timely and professional manner, and allegations of the use of excessive force against protestors represent clear evidence that the stalled police reform in the country needs to be re-examined. After almost two decades of international assistance, first by the United Nations (UN) and later the European Union (EU), police reform in Bosnia remains incomplete. Since the 2012 closing of the EU police mission (EUPM) in Bosnia, the issue of police reform has been put on hold. Bosnia's multiple police services remain fragmented and lack transparency. More importantly, the lack of harmonization, coordination and civic oversight leads to political interference in policing.

Abstract:: The European Parliament election results show a rise in apathy and hostility towards the EU. A fundamental rights strategy could help to boost the Union’s legitimacy in the eyes of the public. EU institutions should jointly adopt a strategy that highlights the benefits for citizens of rights conferred at EU level. A strategy would allow the Union to meet its overarching goal of improving the well-being of its peoples and improve its credibility when promoting human rights with third countries. The strategy should be structured around measures to respect, protect and promote fundamental rights to the fullest extent allowed by the Union’s powers. To develop and implement the strategy, the institutions should engage in regular and structured dialogue with the United Nations, Council of Europe, Fundamental Rights Agency, and civil society organizations.

Abstract:: The Justice and Development Party (JDP) has been in power in Turkey since 2002, consolidating its electoral support among an array of social groups ranging from broad appeal among the popular classes to business leaders and a growing middle class. The success of the JDP is a consequence of the manner in which the party inserted itself into certain economic and social sectors. While the party has internalized the principles of reducing the public sphere and outsourcing to the private sector, it has not restricted the reach of government intervention. On the contrary, it has become increasingly involved in certain sectors, including social policy and housing. It has managed this through an indirect approach that relies on intermediaries and private allies such as the businesses and associations that is has encouraged. In this way, the JDP has developed and systematized modes of redistribution that involve the participation of conservative businessmen who benefit from their proximity to the decision-makers, charitable organizations, and underprivileged social groups. These public policies have reconfigured different social sectors in a way that has strengthened the Party’s influence.

Abstract:: Corruption in Southeast Europe has been in the news, in the focus of public debate, and on the policy agenda of national and international institutions so often and for so long that its scrutiny hardly needs to be justified. It is precisely because it has proven to be such an intractable issue that innovative approaches to its understanding – and hence its reduction – are warranted. The EU accession prospects for the countries in the region – though distant – provide an enabling framework for action but it is local stakeholders, and in particular civil society who can bring about sustained progress in anti-corruption. The Southeast Europe Leadership for Development and Integrity (SELDI) has made the in-depth diagnosing and understanding of corruption and governance gaps in the region one of its main priorities, as a requisite condition for its advocacy of knowledge-driven anticorruption policies. This SELDI report fits in the development and implementation framework of the emerging regional anticorruption policy and infrastructure as exemplified by the SEE2020 Strategy’s Governance Pillar run by the Regional Anti-Corruption Initiative.
