Abstract:
On July 9, 2002, Governor Gray Davis signed the California Voting Rights Act (CVRA) into law. The intent of the CVRA was to build upon the voting rights protections embodied in the Federal Voting Rights Act (FVRA) by enhancing the influence of minority populations in local government elections. The CVRA has led to multiple legal challenges of at-large electoral systems in dozens of governments in California. This paper explores the impacts of the CVRA on local governments as well as potential impacts of recent changes to the CVRA.

Abstract:
Forecasts of future economic activity underlie any budget revenue projection. However, the forecasters in a government agency may face incentives or pressures that introduce forecast bias. For example, agency forecasters may be rewarded for a rosy growth forecast that allows politicians to avoid politically costly program cuts or tax increases. Similarly they may be penalized for underforecasting economic growth. Where a reward system is asymmetric, it would make sense to observe biased forecasts.

Abstract:
Infrastructure: U.S. Seaport Expansion BY KURT J. NAGLE U.S. seaports are in an enhancement and expansion mode. While the widening of the Panama Canal may serve as the catalyst for some of the anticipated $9.2 billion in annual facilities investment in the foreseeable future, this is only part of the story. Several other factors are propelling this huge investment of private capital into U.S. ports. One is the rebounding domestic economy: the value of U.S. exports has risen 70 percent and imports have increased by 53 percent since the first half of 2009. Another driver is the increasing overseas demand for U.S. exports, particularly among the growing middle class in Latin America and parts of Asia. In fact, in the next decade, total U.S. exports are projected to surpass imports for the first time in a generation. Yet another consideration is that manufacturing operations are returning to North America, a development known as “nearsourcing.” With rising labor costs overseas, a narrowing labor differential at home and long transit times to market, a Michigan-based AlixPartners survey conducted in 2012 found that 9 percent of manufacturing executives have already taken steps to “near-source” their operations, and 33 percent plan to do so within the next three years.

Abstract:
I want to thank C. Bradley Thompson for his excellent (and disturbing) article on government "education" ["The New Abolitionism: Why Education Emancipation is the Moral Imperative of our Time," TOS, Winter 2012-13]. Among the many disturbing facts Dr. Thompson reports, one that affected me personally concerns homeschooling in California. I have done (and continue to do) some homeschooling for local California families and was disturbed to learn that what I do was ruled illegal by some judge named Croskey. I was relieved to find by the end of the paragraph that Croskey (partially) reversed his ruling. What an abhorrent man and system! I, too, am an abolitionist.

5. The Audacity of the Texaco/Calasiatic Award: René-Jean Dupuy and the Internationalization of Foreign Investment Law

Abstract:
The Texaco Overseas Petroleum Company and California Asiatic Oil Company v. The Government of the Libyan Arab Republic awards refer to concession contract provisions and a political context that are now obsolete. Thus, this article argues on the one hand that the award on the merits, delivered in January 1977, provides an unparalleled opportunity to survey almost every facet of the world of international investment arbitration of the past. On the other hand, the award must nevertheless also be read as forward-looking. By fostering a shift from the traditional hegemony of national jurisdiction in international investment law to the internationalization of international contracts, the article underlines that the award on the merits remains the finest example of René-Jean Dupuy's long-lasting contribution to international law doctrine. By way of conclusion, it suggests that it provides the very best expression and point of entry into Professor Dupuy's understanding and shaping of what he coined 'la communauté'.

6. Will Oil Drown the Arab Spring?

Summary: No state with serious oil wealth has ever transformed into a democracy. Oil lets dictators buy off citizens, keep their finances secret, and spend wildly on arms. To prevent the “resource curse” from dashing the hopes of the Arab Spring, Washington should push for more transparent oil markets -- and curb its own oil addiction. MICHAEL L. ROSS is Professor of Political Science at the University of California, Los Angeles, and the author of the forthcoming book The Oil Curse: How Petroleum Wealth Shapes the Development of Nations. Even before this year's Arab uprisings, the Middle East was not an undifferentiated block of authoritarianism. The citizens of countries with little or no oil, such as Egypt, Jordan, Lebanon, Morocco, and Tunisia, generally had more freedom than those of countries with lots of it, such as Bahrain, Iraq, Kuwait, Libya, and Saudi Arabia. And once the tumult started, the oil-rich regimes were more effective at fending off attempts to unseat them. Indeed, the Arab Spring has seriously threatened just one oil-funded ruler -- Libya's Muammar al-Qaddafi -- and only because NATO's intervention prevented the rebels' certain defeat. Worldwide, democracy has made impressive strides over the last three decades: just 30 percent of the world's governments were democratic in 1980; about 60 percent are today. Yet almost all the democratic governments that emerged during that period were in countries with little or no oil; in fact, countries that produced less than $100 per capita of oil per year (about what Ukraine and Vietnam produce) were three times as likely to democratize as countries that produced more than that. No country with more than a fraction of the per capita oil wealth of Bahrain, Iraq, or Libya has ever successfully gone from dictatorship to democracy. Scholars have called this the oil curse, arguing that oil wealth leads to authoritarianism, economic instability, corruption, and violent conflict. Skeptics claim that the correlation between oil and repression is a coincidence. As Dick Cheney, then the CEO of Haliburton, remarked at a 1996 energy conference, "The problem is that the good Lord didn't see fit to put oil and gas reserves where there are democratic governments." But divine intervention did not cause repression in the Middle East: hydrocarbons did. There is no getting around the fact that countries in the region are less free because they produce and sell oil.

7. Estimating ObamaCare's Effect on State Medicaid Expenditure Growth

Unless repeal attempts succeed, the Patient Protection and Affordable Care Act of 2010 (ObamaCare) promises to increase state government obligations on account of Medicaid by expanding Medicaid eligibility and introducing an individual health insurance mandate for all US citizens and legal permanent residents. Once ObamaCare becomes fully effective in 2014, the cost of newly eligible Medicaid enrollees will be almost fully covered by the federal government through 2019, with federal financial support expected to be extended thereafter. But ObamaCare provides states with zero additional federal financial support for new enrollees among those eligible for Medicaid under the old laws. That makes increased state Medicaid costs from higher enrollments by "old-eligibles" virtually certain as they enroll into Medicaid to comply with the mandate to purchase health insurance. This study estimates and compares potential increases in Medicaid costs from ObamaCare for the five most populous states: California, Florida, Illinois, New York, and Texas.

9. The California Coastal Commission: A Case Study in Governmental Assault on Property Rights

Imagine the following: 1. A couple improves their oceanside backyard with tables and benches, a barbecue pit and kitchenette, an outdoor shower and restroom, and a beautiful flower garden. Thirty years later, government officials inspect the yard and declare that the amenities are ugly and out of character with the surrounding area, and that, because the amenities underscore the fact that the yard is private, they have a detrimental psychological effect on the public traversing the adjacent beach. The government orders the couple to clear out their yard and restore it to its "natural" condition, or face stiff penalties. 2. A man purchases a vacant lot along the Pacific coast with the dream of building his residence there, but when he submits his building plans to the local government, he is told that the size and location of his structure would sully boaters' views of the coastline. The government demands that he reduce the size of his proposed home to one-quarter its planned size and place it in a geologically hazardous corner of the lot. 3. A family that has been cramped for years in a mobile home on their 143-acre ranch wants to build a house large enough to accommodate them, but when they apply for a building permit, the government tells the family that, in exchange for permission to build, they must agree to a perpetual agricultural easement over almost all of their land-an "agreement" that would force the family and future generations to farm the property forever. Unfortunately, we need not imagine any of these scenarios, because they are true stories of real people suffering at the hands of a real tyrant. Even as you read, these and other such abuses are occurring in California. The tyrant in question is the California Coastal Commission, a state bureaucracy with near-limitless authority over people's property and, thus, their lives. Although the Commission's power to dictate how property owners may use their property is limited to certain regions in California, similar commissions exist in other states, and the Commission's endeavors provide an ideal case study regarding how and why governmental bodies at all levels across America are increasingly violating property rights. Let us begin our study by looking at the history and nature of the Commission. . . . 10. The Assault on Energy Producers

"We've got to go after the oil companies," says President-elect Barack Obama in response to high oil and gasoline prices. "We've got to go after [their] windfall profits." Explaining the purpose of recently proposed energy legislation, Senate Majority Leader Harry Reid says: "We are forcing oil companies to change their ways. We will hold them accountable for unconscionable price-gouging and force them to invest in renewable energy or pay a price for refusing to do so." Calling for government seizure of private power plants, California Senate Leader John Burton insists: "We have to do something. These people have got us by the throat. They're making more money than God, and we've got to fight back-not with words, but with actions." This attitude toward energy producers, which is practically unanimous among American politicians today, is wreaking havoc not only on the lives and rights of these producers, but on the lives and rights of Americans in general. It leads to laws and regulations that prohibit producers and consumers from acting on their rational judgment with respect to energy. It causes energy shortages, brownouts, and blackouts that thwart everyone's ability to be productive and enjoy life. And it results in higher prices not only for energy, but for every good and service that depends on energy-which means every good and service in the marketplace, from food to transportation to medical care to sporting events to education to housing. Energy producers, like all rational businessmen, are in business to make money. Profits are what motivate them to exert the requisite brain power, to engage in the necessary research, and to invest the massive amounts of money required to produce and deliver the energy we need to light, heat, and cool our homes, and to power the factories, workplaces, and tools required to produce the goods on which our lives depend. Their profit motive is to our benefit. Moreover, energy producers, like all human beings, have a moral right to act according to their own judgment so long as they do not violate the rights of others. They have a moral right to use and dispose of the product of their effort as they see fit. They have a moral right to contract with customers by mutual consent to mutual benefit. In other words, they have a moral right to life, liberty, property, and the pursuit of happiness. And it is only by respecting these rights that we can expect energy producers to produce energy. So let us examine the assault on these producers, count the ways in which this assault is both impractical and immoral, and specify what must be done to rectify this injustice. . . .

Immigrant integration is now a key issue for communities across the nation. States and communities that had seen few immigrants as recently as 1990 are now welcoming new arrivals in unprecedented numbers. Although new immigrants continue to settle in the traditional U.S. centers of immigration—including California, Florida, New York, and Texas—the states with the currently fastest growing immigrant populations have not seen similar inflows for almost a century, if ever. According to the 2000 Census, these new destination states include North Carolina, Georgia, and Tennessee (at the top of the list) and other states in the Southeast, as well as states across the Midwest and up into the Pacific Northwest.

Abstract:
Recent research has shown that regulatory competition does not necessarily lead to downward pressures on regulation, but may at times also push the level of regulation upwards. Extending David Vogel's "California effect" argument, this paper shows that such upward pressure may not only result directly from the dynamics of the competitive process but also from international cooperation. Evidence from two case studies on international capital market regulation is used to identify the conditions under which cooperation in the shadow of regulatory competition is likely to succeed or fail. The successful multilateral standardisation of banking capital requirements in the BIS is compared to failed attempts to harmonise interest taxation across EC member states.
