Abstract:
The Responsibility to Protect populations from genocide, war crimes, crimes against humanity and ethnic cleansing has emerged as an important global principle since the adoption of the UN World Summit Outcome Document in 2005. Since the conception of R2P, individual states and regional organizations, the UN, civil society, and experts around the world have worked to establish what implementation of R2P and the prevention of mass atrocity crimes means in practice. The Global Centre for the Responsibility to Protect and the Asia-Pacific Centre for the Responsibility to Protect have developed a guide for states on steps to take to protect populations from atrocity crimes, at home and abroad. “A Framework for Action for the Responsibility to Protect: A Resource for States” consolidates and builds upon existing expertise from published works and best practice from states, regional organizations and the UN on how to prevent and respond to atrocity crimes. We encourage all states to utilize this framework to assess gaps and identify opportunities to address atrocity risks in their own countries, as well as to understand options available for responding to risks in their region and around the world.

UN Special Procedures, including Special Rapporteurs or Independent Experts, and Human Rights Council (HRC)-mandated investigative mechanisms, such as Commissions of Inquiry (CoI) or Fact-Finding Missions, often apply a gender lens when looking at situations at risk of, or experiencing, atrocity crimes. However, this practice is not yet systematic across the UN human rights system. Since women and girls are uniquely affected and targeted in many situations where atrocity crimes are being perpetrated, the systematic application of a gender lens would enhance holistic atrocity prevention strategies and improve the effective implementation of the Responsibility to Protect (R2P). The following recommendations aim to provide a framework to further strengthen and institutionalize the gender lens in HRC mechanisms and procedures.

The Responsibility to Protect (R2P) concept sought to confront both the Rwanda tragedy and the Kosovo dilemma by stipulating that states have an obligation to protect their citizens from mass atrocity crimes; that the international community will assist them in doing so; and that, should the state be “manifestly failing” in its obligations, the international community is obliged to act. R2P seeks to ensure that the international community never again fails to act in the face of genocide, ethnic cleansing, war crimes and crimes against humanity. By accepting a collective responsibility to protect, the international community issued a solemn pledge that it cannot lightly ignore.

Today, 11 June 2021, the UN General Assembly elected Albania, Brazil, Gabon, Ghana and the United Arab Emirates to the UN Security Council for the period of 2022-2023. With their election, 9 of the 15 members of the Council in 2022 will be “Friends of the Responsibility to Protect” – having appointed an R2P Focal Point and/or joined the Group of Friends of R2P in New York and Geneva. Albania, Brazil and Ghana all co-sponsored and voted for the recent UN General Assembly resolution on R2P. The United Arab Emirates also voted in favor of the resolution while Gabon did not participate in the vote. Despite its role as the UN body responsible for the maintenance of international peace and security, all too often the Security Council has been unable to take timely action on mass atrocity situations due to deep political divisions inside the Council over human rights, conflict prevention and national sovereignty. In recent years this has had a debilitating effect on the Council’s capacity to respond to atrocities in Myanmar, Syria, Yemen, Ethiopia and elsewhere. It is therefore more important than ever for Council members to work in creative ways to ensure that the international community is able to take timely, practical action to prevent atrocities and protect vulnerable populations. Since 2005 the Security Council has adopted 92 resolutions and 21 presidential statements that refer to the Responsibility to Protect, including with regard to situations in the Central African Republic, South Sudan, Syria and eight other country situations, as well as a number of thematic issue areas. It is our hope that the Security Council will consistently uphold their commitment to R2P by taking decisive action to avert emerging crises and halt atrocities wherever they are threatened. The Global Centre has compiled basic profiles on each of the newly elected Security Council members. These provide an overview of their engagement with R2P, including whether they have appointed an R2P Focal Point, their respective contributions to UN peacekeeping operations, and their status with relevant international legal regimes, including the Genocide Convention and Arms Trade Treaty.

The Responsibility to Protect is a political commitment made by heads of state and government at the 2005 UN World Summit aimed at preventing and halting four mass atrocity crimes, namely genocide, war crimes, crimes against humanity and ethnic cleansing. In doing so, states agreed that governments have the primary responsibility to protect populations within their borders from atrocity crimes, that the international community should help states in building the capacity to uphold this responsibility, and that when a state is unwilling or manifestly failing to do so, the international community must be prepared to take timely and decisive collective action in accordance with the UN Charter. Atrocity crimes do not occur in a vacuum, nor are they isolated or random incidents. Rather, they are typically the consequence of a broader process. In order to adequately prevent and respond to the threat of atrocity crimes, there is a need to understand the early warning signs, risk factors and aggravating conditions that may culminate in the perpetration of such grave crimes. Systematic or widespread human rights violations and abuses often serve as one of the key early warning signs of possible atrocity crimes. This briefing paper aims to examine the relationship between mass atrocity crimes and human rights violations and abuses, highlighting that such violations and abuses may precede and significantly elevate atrocity risks and may also constitute atrocity crimes themselves if certain thresholds or conditions are met.

This year the world will celebrate the 75th anniversary of the adoption of the Charter of the United Nations. But celebrations recognizing this historical landmark will occur at a time when the entire post-1945 structure of human rights, humanitarianism and multilateral diplomacy are under threat. Not since the UN was first formed have so many people been displaced by persecution, conflict and war. Not since the peak of the Cold War has the UN Security Council appeared so bitterly divided and incapable of decisive action. And as a new decade begins, there are renewed threats to international peace and security, and fresh assaults on human dignity.

Fifteen years since the adoption of the principle of the Responsibility to Protect (R2P), I would like to reflect on what it is, at its core. R2P is essentially about preventing and protecting people from the most heinous atrocity crimes – genocide, war crimes, ethnic cleansing and crimes against humanity. This essence is sometimes undermined by debates in which criticisms about implementation deficits are used to discredit the entire principle. The disconnect between the UN World Summit in 2005, when UN member states unanimously committed to protect populations from atrocity crimes, and the disparity in its implementation is highly problematic, as it leaves open the door for atrocity crimes to continue to be committed, while effective national, regional and international action is displaced by what are essentially political arguments about lack of conceptual consensus. The grim reality of today’s ongoing crises is a stark reminder of the need to redouble efforts to effectively implement the responsibility to protect.

Today and yesterday, 17-18 June 2020, the UN General Assembly elected India, Ireland, Kenya, Mexico and Norway to the UN Security Council for the period of 2021-2022. To mark the 15th anniversary the Global Centre is publishing a series of reflections by key actors in the development of R2P. In this piece, Ambassador Ivan Šimonović shares lessons he learned regarding the prevention of atrocity crimes while serving as the UN Assistant Secretary-General for Human Rights and as UN Special Adviser on R2P. While reflecting on various country situations, Ambassador Šimonović explains what can be achieved through “atrocity crimes prevention diplomacy.”

According to the UN Human Rights Council-mandated Independent International Fact-Finding Mission on Myanmar (FFM), the treatment of the Rohingya population during the “clearance operations” amounts to genocide, crimes against humanity, and war crimes, the commission of which evoke specific obligations and responsibility under international law. In its final report, published in September 2019, the FFM concluded that “the State of Myanmar breached its obligation not to commit genocide” and found that Myanmar “continues to harbor genocidal intent” towards the Rohingya, emphasizing the need for accountability. This fact sheet answers fundamental questions about the ongoing ICJ case, Myanmar’s responsibility for genocide and its impact on the Rohingya population. Since April 2019 Syrian government and Russian forces have carried out a brutal offensive in northwest Syria, resulting in the deaths of over 1,500 civilians. As the bombings intensified in mid 2019, international outrage grew as airstrikes regularly hit health facilities, schools, displacement centers and other civilian objects, including those on a “deconfliction” list established by the UN to help facilitate their protection. Any joint action by the UN Security Council (UNSC) in response to these attacks was actively blocked by China and Russia, the latter of which was directly involved in the military offensive. Amidst frustration that perpetrators were being systematically shielded from accountability, and faced with few other diplomatic options, ten members of the UNSC issued a démarche to the UN Secretary-General requesting an investigation into attacks on civilian objects.

Today, 13 October, the UN General Assembly elected Bolivia, China, Côte d’Ivoire, Cuba, France, Gabon, Malawi, Mexico, Nepal, Pakistan, Russia, Senegal, Ukraine, United Kingdom and Uzbekistan to the Human Rights Council (HRC) for the 2021-2023 term. With the elections of Côte d’Ivoire, France, Mexico, Senegal and United Kingdom, 16 of the 47 Council members during 2021 will also be members of the Group of Friends of the Responsibility to Protect in Geneva. The Human Rights Council and its mechanisms – including the Universal Periodic Review (UPR), special procedures and treaty bodies, as well as the technical assistance provided by the Office of the High Commissioner for Human Rights (OHCHR) – all play an essential role in providing early warning of the risk factors that can lead to crimes against humanity, ethnic cleansing, war crimes and genocide.

The Responsibility to Protect was adopted unanimously and without equivocation by the UN General Assembly in 2005. States accepted that each of them had a responsibility to protect their populations from genocide, war crimes, ethnic cleansing, and crimes against humanity – hitherto referred to as ‘atrocity crimes.’ They acknowledged their responsibility to assist one another to fulfil this primary responsibility. They declared they had a collective responsibility to protect populations in other countries using diplomatic, humanitarian and other peaceful means, and they promised to work through the UN Security Council to protect populations when national authorities were failing and peaceful means inadequate.

Since the principle of the Responsibility to Protect (R2P) was unanimously adopted at the 2005 UN World Summit, the international community has looked to the UN Security Council in New York to respond when a government has been unwilling or unable to protect its population from war crimes, crimes against humanity, genocide or ethnic cleansing. Paragraphs 138-139 of the World Summit Outcome Document recognize the Security Council’s unique role with regard to upholding the international community’s responsibility to protect as the body primarily responsible for the maintenance of international peace and security. However, the Human Rights Council (HRC) and other Geneva-based mechanisms are also essential for preventing atrocity crimes. Since systematic or widespread human rights violations serve as early warning signs of possible atrocities, Geneva-based mechanisms are often the first to raise the alarm regarding situations where violations and abuses threaten to deepen or deteriorate. Such mechanisms play an important role in enabling the international community to assist states in preventing mass atrocities (R2P’s Pillar II) and respond in a timely and decisive manner to atrocity risks (Pillar III).

The eleventh report of the UN Secretary-General on the Responsibility to Protect (R2P) emphasizes the important role of prevention. The report takes stock of a range of measures that individual states and the international community can undertake while upholding their preventive responsibilities based upon best practices since the adoption of R2P at the 2005 UN World Summit. While acknowledging a growing number of contemporary atrocity situations around the world, the Secretary-General cautions that “there is a growing gap between our words of commitment and the experience of protecting vulnerable populations.” The report offers a number of practical policy suggestions based upon experiences of the last decade and serves as a call to action for member states and international institutions.

The 39th regular session of the Human Rights Council (HRC) was held in Geneva between 10 and 28 September 2018. As the primary international human rights body, the Human Rights Council has the capacity to prevent and respond to mass atrocity crimes, as systematic violations and abuses of human rights can be potential indicators of genocide, war crimes, crimes against humanity or ethnic cleansing. Today the UN General Assembly elected Argentina, Austria, Bahamas, Bahrain, Bangladesh, Bulgaria, Burkina Faso, Cameroon, Czech Republic, Denmark, Eritrea, Fiji, India, Italy, Philippines, Somalia, Togo and Uruguay to the Human Rights Council (HRC) for the 2019-2021 term. When it was adopted by the United Nations (UN) system in 2005, the doctrine of the Responsibility to Protect (R2P) was meant to provide an implementation mechanism for the international community to respond to governments that were perpetrating the mass atrocity crimes of genocide, war crimes, ethnic cleansing, and crimes against humanity. As R2P is now in its second decade of existence, it is important to evaluate past implementation of R2P by the UN Security Council — the UN body charged with taking collective action when all other preventive efforts have failed and atrocity crimes are being committed or are imminent. This briefing paper is a summary of a more detailed law review article recently published in the University of Chicago Journal of International Law.

Abstract:
During the 2005 United Nations World Summit, heads of state and government accepted the responsibility of every state to protect its population from four crimes: genocide, war crimes, crimes against humanity and ethnic cleansing. The first three crimes are legally defined in various international legal documents, such as the 1948 Convention on the Prevention and Punishment of the Crime of Genocide, the 1949 Geneva Conventions and their 1977 Additional Protocols, and the 1998 Rome Statute of the International Criminal Court. Their status as international crimes is based on the belief that the acts associated with them affect the core dignity of human beings, both in times of peace and in times of war.

When we think of the Holocaust our mind slips inexorably to dismal images of cattle cars stuffed with people, or to gas chambers, crematoria and the cruel irony of the “Arbeit Macht Frei” gate. But of the six million Jews killed during the Holocaust over a million were shot with rifles and other small arms. They were not killed in concentration camps, but were murdered in fields or forests and pitched into mass graves outside villages in Nazi-occupied Eastern Europe. Before Auschwitz, Sobibor or Treblinka, the Holocaust began with bullets. The same is true of most mass atrocities carried out since 1945. From the killing fields of Cambodia to the burnt villages of Darfur, most of the killing was done with rifles and other small arms. It is for this reason that there is an enduring connection between preventing atrocities and confronting the international arms trade. The AK-47, or Kalashnikov, is the most popular weapon in the world today, with an estimated 70 million currently in existence. Numerous countries manufacture local variants of the ubiquitous assault rifle and while a new Chinese-made AK-47 might cost you $500, you can easily purchase one in many former conflict zones for as cheap as $50. When I lived in Johannesburg during the mid-1990s, leftover AK-47s from the civil war in Mozambique were still making their way through the townships and some entrepreneurial gangs were even renting out their AK-47s to other aspiring criminals at an hourly rate.

Abstract:
The United Nations faces an existential crisis. The norms that bind and ‘safeguard humanity’ are currently under threat. The deliberate bombing of hospitals and the indiscriminate killing of civilians has become almost routine in Syria and several other conflicts. Numerous governments and murderous non-state actors (like isis or Boko Haram) are defying international humanitarian and human rights law. This article argues that the solution to the current global exigency and a central challenge facing the next Secretary-General is to achieve an equilibrium shift away from crisis response and towards conflict prevention. This is especially true with regard to preventing mass atrocity crimes (genocide, war crimes, crimes against humanity and ethnic cleansing). Historically, no single issue has done more to tarnish the reputation of the un than the failure to halt atrocities. Under a committed Secretary-General, the un has unique capacity to prevent these crimes.
