The Turkish-Syrian border is divided into separate areas of control—under the Syrian Democratic Forces in northeast Syria, Hay’at Tahrir al-Sham in Idlib, and Turkey in several cantons—which sustain contradictory political projects. Yet these border areas constitute a single political-security ecosystem, one connected to southern Turkey and regime-held Syria. As such, only a peace agreement that treats the border areas as an indivisible whole and delimits the major powers’ zones of influence can lead to a stable long-term arrangement.

The negotiation of multilateral agreements has stalled at the World Trade Organization (WTO). The action is among groups of like-minded WTO Members, either regionally or in open plurilateral agreements (OPAs) in Geneva at the WTO. There is currently no consensus among WTO Members to include plurilateral agreements officially in the set of WTO agreements. Many additional challenges require multilateral—that is, global—agreements: the pandemic, food security, and climate change, among them. A breakthrough is needed to get WTO negotiations back on track.

During the last few decades Saudi Arabia had exercised a role of a regional coordinator between various Middle Eastern states and between them and the USA. Twice in the past it had put on the table a peace initiative that was aimed at finding an acceptable solution for Palestinian-Israeli conflict, and both times these initiatives didn’t take off for various reasons. The reality of the Arab spring and Iran domination, as well as the rise of the crown-prince Muhammad Bin-Salman and Abraham accords had radically altered the regional dynamic, and during the last few years Saudi Arabia moved closer to Israel, especially since it became more preoccupied with Iranian threat and domestic reforms. How can Saudi Arabia facilitate peace or contribute for peace-making between Israel and Palestinians, openly or behind the scenes, and what needs to happen first to allow this scenario?

Abstract:
Following the recent September escalations along the Azerbaijan and Armenian border, in a way towards achieving a sustainable peace deal and long-lasting security in the Caucasus, the quadrilateral meeting in pragmatic terms is deemed to play a significant role in this vein putting an end to hostilities. The President of Azerbaijan and the Prime Minister of Armenia met in Prague on 6 October 2022 in the margins of the first European Political Community at the invitation of the President of the French Republic and the President of the European Council. Both sides reiterated their commitment to the Charter of the United Nations and the Alma Ata 1991 Declaration through which both recognize each other’s territorial integrity and sovereignty which will act as a legal basis for the work of the border delimitation commissions.

6. The EU–Ukraine Association Agreement after Ukraine’s EU membership application: Still fit for purpose

Abstract:
In an extraordinary session of the European Parliament on 1 March 2022, Ukrainian President Volodymyr Zelensky requested from a bunker in Kyiv, while Russian missiles bombarded Ukraine, the EU to give the war-ravaged country a clear path towards EU membership. The day before, Ukraine had submitted its official application to the EU, followed shortly by Georgia and Moldova. The European Parliament already supported Ukraine’s membership application and called on the EU institutions to work towards granting Ukraine EU candidate status, in line with Article 49 TEU. Offering such a status would be a historic token of support for Ukraine in its self-defence against Russian military aggression. The Versailles declaration, adopted by the heads of state or government of the EU member states on 10 and 11 March, acknowledges that Ukraine belongs to the ‘European family’ without explicitly mentioning the country’s candidate status. Nevertheless, the Council already invited the European Commission to submit its opinion in accordance with Article 49 TEU. Despite this support for – and recognition of – Ukraine’s application, the road to EU membership remains a long one. Several member states have concerns about Ukraine’s readiness and eligibility for the pre-accession process, the EU’s absorption capacity, and the geopolitical consequences of the Union’s further eastward enlargement. Moreover, the economic consequences of the war will also complicate Ukraine’s concrete progress in its accession process. With Russian tanks and missiles still on Ukrainian soil, discussing actual membership is arguably premature. This may create unrealistic expectations and lead to frustrations in the applicant countries. It will therefore be important to remain clear and transparent about the EU accession procedure and offer concrete and credible incentives for reform and gradual integration in the Union throughout the long and winding pre-accession procedure. Paired with an unprecedented assistance package and new forms of sectoral integration in key EU policies (e.g. the twin green and digital transitions), the current EU–Ukraine Association Agreement remains the most appropriate instrument to develop this bilateral relationship further. The dynamic nature of the agreement, combined with its open-ended accession perspective, implies that both the EU and Ukraine can reorient it to new and more ambitious forms of political association and economic integration and accommodate it to a pre-accession context on the basis of a staged approach.

Abstract:
Before the Russian invasion of Ukraine, the Biden administration insisted in arms control talks with Russia that a follow-on agreement to the New Strategic Arms Reduction Treaty (New START) should cover all nuclear weapons and that such an agreement should focus on the nuclear warheads themselves. This would represent a significant change from previous agreements, which focused on delivery vehicles, such as missiles. The United States has been particularly interested in potential limits on nonstrategic nuclear warheads (NSNW). Such weapons have never been subject to an arms control agreement. Because Russia possesses an advantage in the number of such weapons, the US Senate has insisted that negotiators include them in a future agreement, making their inclusion necessary if such an accord is to win Senate approval and ultimately be ratified by Washington. In the wake of Russian nuclear threats in the Ukraine conflict, such demands can only be expected to grow if and when US and Russian negotiators return to the negotiating table.

8. The Ethnic Chapter of Colombia’s Peace Agreement Five Years On: An Independent Assessment

In 2016, the Colombian Peace Agreement included an Ethnic Chapter designed to ensure the representation of and oversight by indigenous and Afro-Colombian social organizations in the implementation process. This recognition of ethnic rights as a cross-cutting agenda set a precedent among international peace-building processes. But failures in the implementation have meant that armed conflict and systematic violence against ethnic peoples and their territories have raged on. In this Accountability Note, Helmer Eduardo Quiñones Mendoza presents an assessment of the implementation of the Ethnic Chapter of the peace agreement. The assessment was carried out by the advisory team to the High-Level Forum with Ethnic Peoples (IEANPE), the main mechanism for monitoring and promoting the Ethnic Chapter, and presented to the Colombian government in 2021. Together with a preface by Armando Wouriyú Valbuena (Secretary of the Ethnic Commission, Technical Secretary of the IEANPE, and distinguished indigenous leader), an introduction by Jonathan Fox (ARC Director), and an afterword by Gimena Sánchez-Garzoli (Washington Office on Latin America), this note assesses implementation against each of the agreement’s six pillars, identifies entry points for improvement, and lays out an agenda for building a new future for Colombia’s ethnic minorities by fully implementing the Ethnic Chapter of the 2016 agreement.

The rate at which states are joining the 2013 Arms Trade Treaty (ATT) has naturally slowed. Universalization efforts have been carried out through a variety of different frameworks, both within the ATT regime—including the Working Group on Treaty Universalization (WGTU), a sponsorship programme and the Voluntary Trust Fund (VTF)—and by the United Nations, regional organizations and civil society. Universalization of the ATT contributes to the development of standards and norms in the international arms trade. If a party flouts the treaty’s require­ments, it undermines the treaty and makes universal­ization less meaningful. Thus, universalization means both expanding the number of states parties and ensuring that they live up to their obligations. The scope of the 2013 Arms Trade Treaty (ATT) refers to the conventional arms, ammunition/munitions, and parts and components that are covered by the treaty. ATT stakeholders are providing guidance and assistance for states parties to implement provisions on scope contained in Articles 2–5 of the Treaty. ATT Article 17(4) provides for the Conference of States Parties (CSP) to review the treaty’s scope to take into account relevant technological developments in the field of conventional arms. Now is an opportune moment to explore mechanisms to review the scope of the Treaty to keep it in line with, at least, the coverage of the United Nations Register of Conventional Arms (UNROCA). The 2013 Arms Trade Treaty (ATT) has a number of attached processes and forums that are aimed at enabling and promoting both the effective implementation of the treaty by states parties and its further universalization. In order to operate effectively these processes and forums need to be designed and operated in ways that reflect the ATT’s unique status as a trade treaty with a core humanitarian objective. The ATT states parties must consider the current support architecture and the challenges that it faces. These include effectively transitioning from a negotiation to an implementation framework; avoiding inherent risks to the treaty’s objective; implementing the risk-mitigation clause; maintaining the balance between exporters and importers; preserving transparency; and implementing possible good practice options. The provision of international assistance is key to achieving the effective implementation of the 2013 Arms Trade Treaty (ATT). Assistance instruments include the ATT’s own Voluntary Trust Fund (VTF), mechanisms established by the United Nations and the European Union (EU), and efforts by other international and regional organizations and non-governmental organizations (NGOs). The donors, implementers and ATT states parties should reflect on the role played by the assistance instruments in improving implementation of the treaty. To strengthen the role of international assistance in supporting implementation of the ATT, the ATT Secretariat and ATT-related processes and assistance programmes should enhance the sustainability and effectiveness of assistance efforts and further improve coordination. In contrast to early last year, marked by a “border crisis” that erupted after the Turkish President finally put into action his long-standing threat to “open the border” for Syrian refugees, the year 2021 had a more promising start. The intense tensions in the Aegean Sea and the Eastern Mediterranean that followed the “border crisis” appear to be subsiding. The European Council statement of March 25 offers a possible framework for dialogue and diplomacy to take over from what was an annus horribilis in Greek-Turkish and EU-Turkish relations. Within this framework, room is also made for revisiting the EU-Turkey statement adopted in March 2016 to manage the aftermath of the European migration crisis that had seen a mass displacement of refugees and migrants primarily from Turkey to Greece and on to Europe. The statement has had many opponents and its implementation has faced multiple grievances and recriminations from both sides. Addressing and overcoming these challenges will call for extensive diplomatic effort, good will and take considerable time. In the interim, however, the emerging positive climate offers the possibility to explore expanding cooperation in a relatively successful but inadequately appreciated part of the EU-Turkey statement known as the Facility for Refugees in Turkey (FRIT). FRIT has been instrumental in supporting Syrian and other refugees in Turkey. It has been an important manifestation of burden-sharing with Turkey and has benefitted refugees in concrete terms. Advancing cooperation in this area would also help contribute to mutual confidence building and have a positive spill over into other more complicated issue areas in the migration domain and broader bilateral relations.

20. The EU–UK relationship: It is what it is

The EU–UK Trade and Cooperation Agreement might have pulled both sides back from the brink of a no-deal cliff edge, but it remains a shaky foundation for the next stage of EU–UK relations. Both sides must invest in the relationship and rebuild trust to prevent any conflict from escalating into a tit-for-tat. Or else, they risk the collapse of the deal and the return to a no-deal-like state. In the first months of its new phase, the relationship is already off to a rocky start. The rows over the diplomatic status of the EU mission in London and the Commission’s (now reversed) decision to trigger Article 16 of the Northern Ireland Protocol expose the volatility of the relations and the importance of good communication and trust. The hope for a deal came with the expectation that it would provide the foundation upon which a closer relationship could be constructed over time. It now seems more likely that it will be the basis for a diverging – and at times conflicting – relationship, with little prospect for a significantly closer economic relationship anytime soon. There seems little political appetite on both sides to build on the economic settlement meaningfully, which would require a significant shift of red lines. Previous expectations that a deal would pave the way for outstanding issues, such as the EU granting equivalence for financial services, have also diminished. Given both the political climate and many red lines, the agreed thin economic settlement may be the most we can expect.
