Abstract:
THE PROBLEM OF KNOWLEDGE IN RULE-OF-LAW PROMOTION, above all the basic question of whether Western rule-of-law aid programs are on the right track to help build the rule of law in recipient countries, is especially acute in the Arab world. Arab states generally share two features that render external rule-of-law aid particularly difficult—long-standing nondemocratic governments, and legal systems that graft Ottoman, European, and contemporary sources onto Islamic norms. We cannot presume that U.S. common-law practitioners can build the rule of law by transporting or transplanting their technocratic techniques into such different legal soil. Indeed, the very idea that people in Arab societies would be receptive to American guidance in legal reform is dubious in the current climate of broad, popular mistrust of the United States.

MIXED RESULTS FROM THE PROLIFERATION OF WESTERN RULE OF LAW assistance over the past twenty years has taught us much about what efforts do not work. Criminal justice reform in Russia offers a different type of lesson; it is a rare success story of rule of law promotion. In the 1990s, the U.S. government sought to promote the rule of law in many parts of the former Soviet Union and beyond, but few of these efforts outside Russia produced concrete results. Instead, lawlessness became a primary symptom of the apparent failure of many attempted rule of law reforms in the former Soviet Union.

Almost everyone agrees that the U.S. health care system is in dire need of reform. But there are differing opinions on what kind of reform would be best. Some on the political left would like to see us copy one of the government-run “single-payer”systems that exist in Western Europe, Canada, and New Zealand, among other places. Proponents of socialized medicine point to other countries as examples of health care systems that are superior to our own. They insist that government will make health care available on the basis of need rather than ability to pay. The rich and poor will have equal access to care. And more serious medical needs will be given priority over less serious needs.

Abstract:
The unique institutions that make up Germany's "unitary federal state," long considered part of the country's post-war success story, are now generally perceived as a "joint-decision trap" impeding effective policy responses to new economic and demographic challenges at both levels of government. Nevertheless, a high-powered bicameral Commission set up in the fall of 2003 failed to reach agreement on constitutional reforms. The paper analyzes the misguided procedural and substantive choices that led to this failure, and it discusses the possibility of asymmetric constitutional solutions that might enhance the capacity for autonomous action at both levels.

Abstract:
The ratification process of the Constitutional Treaty has taken some unexpected turns, since the publication of our initial report. The situation has changed especially dramatically in France: within only 10 days the 'yes' camp slid from a previously stable figure of around 60% to below 50%. Our report had concluded that “if the reasons for a particular European compromise are not made transparent to the citizens, issues can be used in a divisive way at the national level”. It therefore called for a stronger European dimension in the national debates and expressed the hope that politicians and the media would play their role in stressing the common European significance of the European Constitution.

Abstract:
Following the success of the EPIN survey on the European elections 2004 (EPIN Working Paper No. 11), the authors decided to use a similar approach for monitoring the current ratification process of the European Constitutional Treaty. Accordingly, the findings presented in this paper are based on the results of a survey conducted among national experts associated with the European Policy Institutes Network (EPIN). As such, they are inherently subjective, but nevertheless wellinformed. The report draws on survey data collected in 20 EU member states, supplemented by additional sources of information on the remaining countries where available. While the actual outcomes may prove our findings wrong in one respect or another, they do indicate interesting developments and differences in the respective member states. The added value of this EPIN survey lies in its broad comparative scope and analysis rather than its offering an in-depth assessment of each national debate. (For the latter, special country reports are envisaged at a later point in time.) The EPIN Ratification Monitor project plans to publish regular updates on the rapidly changing situation.

The proposed European Constitution, which was just voted down in France and the Netherlands, is technically a treaty containing far-reaching amendments to the present set of treaties governing the European Union. Article 48 of the EU treaty text currently in force specifies that any such amendments first be unanimously approved by the governments of the member states within an Inter-Governmental Conference framework and then ratified by each country. The first, intergovernmental step of ratification was completed October 29, 2004.

Once again a specter is haunting Europe—not in the shape that Marx saw it but in the form of outsourcing and offshoring, which allegedly will empty Europe of the highly skilled high-paying jobs of the future. This working paper argues that the specter needs to be dispelled. Today, Europe faces challenges in the form of low productivity growth and low labor utilization/high unemployment. Outsourcing and offshoring, far from being a blight, are powerful tools to help solve the productivity growth problem and may also—provided the right structural reforms are implemented—assist in solving Europe's low employment problem.

110. The Challenges of EU Accession for Post-Communist Europe

The accession of ten new member states in May 2004 and the prospective accession of several more in the near future will pose severe budgetary, administrative, and operational challenges for the European Union. But however great, the challenges of enlargement pale in comparison with the challenges of accession that will be faced by the new member states, especially those which until a decade ago were governed by Communist parties that presided over centrally-planned and predominantly-collectivized economies. This paper explores five of the most critical challenges that will face the new member states of post-Communist Europe: 1) administering the acquis; 2) deepening and extending the reform and transformation of the economy; 3) reducing the high levels of unemployment and large government, trade, and current account deficits; 4) financing accession in the face of the EU’s budgetary constraints and financial provisions; and 5) coping with all of those challenges in the face of low levels of support for enlargement in many of the member states and high levels of ambivalence and skepticism about membership in most of the new member states. The chapter concludes by noting the low levels of trust in the national government and satisfaction with the way democracy works that exist in most of the new member states and suggests that those low levels of trust and satisfaction will make it difficult for the governments in the new member states to address these challenges while also maintaining sufficient public support to retain office.

111. Russian Conservatism in the Putin Presidency

Abstract:
The article seeks to map the emergent discursive field of conservatism in Russian politics in the context of the reshapement of the political space in the Putin presidency. In the course of Putin's first presidential term 'conservatism' became a privileged mode of political selfidentification in the Russian discourse, functioning as the nodal point of the hegemonic project of the Presidency. Yet, in accordance with the Foucauldian understanding of discourse as a system of dispersion, the article demonstrates the way the conservative discourse is internally fractured into two antagonistic strands, identified by their practitioners as liberal and left conservatisms. While the liberal-conservative orientation supports and sustains the depoliticising project of the Putin presidency, which orders and stabilises the effects of the anti-communist revolution, left conservatism functions in the modality of radical opposition to the Putinian hegemony, thereby contributing to the pluralisation of political space in contemporary Russia. In the present Russian political constellation 'conservatism' is therefore less a name for a stable hegemonic configuration than a designator of the field of political struggle over the very identity of postcommunist Russia. The article concludes with a critical discussion of the relation the two strands of Russian conservatism establish to the period of the 1990s as the 'moment of the political' in the Russian postcommunist transformation.

This paper investigates the debate leading up to the joint Danish-Greenlandic decision to allow the US to upgrade its radar at Thule Air Base, ensuring its integration in the American missile defense. By analyzing how this debate is structured in the Danish Realm, the paper argues that the contentious history of the Air Base strengthens the moral position of the Greenlanders and provides them with valuable argumentative assets in the debate. This debate, the paper concludes, presents the Greenlanders with a window of opportunity facilitating negotiations with the Danish Government, the effect of which is further Greenlandic independence and increasing Greenlandic influence on security policy.

For over a thousand years, Ukraine\'s national strength and independence has been linked to democratic self-governance. In the Kyiv Rus, popular assemblies called \'vetches\' elected representatives and provided popular input into governmental policy. In the 15th and 16th centuries, Cossack hetman and foremen were elected by the Cossack Radas, which also debated and approved government policies. Beginning in the 14th century and lasting until the early 19th century, many Ukrainian towns and cities – Lviv, Kyiv, Vinnitsa, Zhytomyr, Chernigiv, Glukhov, Lubny, Poltava – flourished under the political and economic self-government provided by Magdeburg Law, which offered liberation from feudal duties, the election of city authorities, and rule of law. This link continues to the present; the modern Ukrainian state was born out of the convergence of movements for national independence and democracy that brought down the Soviet Union. Although neither of these attributes is yet fully consolidated in the young Ukrainian state, the country\'s best hope for success lies in its democratic elements: a system, albeit imperfect, of electing government officials and legislators, elements within the judiciary willing to uphold human rights and the rule of law, journalists and editors willing to take risks to report the truth, non-governmental organizations that provide a means for citizens to mobilize in order to advance their common interests.

This paper first discusses the meaning of civil society and, in particular, its strengths and limitations. The second section considers what civil society can add to the representative democratic process. In the remaining sections, I discuss how civil society interacts with the law in a democratic state. There are two distinct aspects to this. Firstly, there are the legal and constitutional pre-conditions that allow civil society to flourish. These include issues about group autonomy, freedom of the press and of protest, including the place of civil disobedience. Secondly, there are the specific ways in which civil society can use the legal process to further its ends.

The SALW Survey of the Republic of Montenegro was conducted by a team of researchers from the Small Arms Survey during September to December 2003. It was funded by SEESAC for two reasons: 1) to establish management information for the design of future SALW control intervention projects within the Republic of Montenegro; and 2) to field test the recently drafted SALW Survey protocols and draft Regional Micro-Disarmament Standard (RMDS) 05.80 - SALW Survey. As such, it is the first SALW Survey to be officially conducted in accordance with the SALW Survey protocols, although previous SALW surveys and 'needs assessments' have utilised similar methodologies.

We offer evidence that interest rate spreads on syndicated loans to corporate borrowers are economically significantly smaller in Europe than in the U.S., other things equal. Differences in borrower, loan and lender characteristics associated with equilibrium mechanisms suggested in the literature do not appear to explain the phenomenon. Borrowers overwhelmingly issue in their natural home market, and bank portfolios display significant home “bias.” This may explain why pricing discrepancies are not competed away, but the fundamental causes of the discrepancies remain a puzzle. Thus, important determinants of loan origination market outcomes remain to be identified, home “bias” appears to be material for pricing, and corporate financing costs differ in Europe and the U.S.

Abstract:
Using a general-equilibrium simulation model featuring nominal rigidities and monopolistic competition in product and labor markets, this paper estimates the macroeconomic benefits and international spillovers of an increase in competition. After calibrating the model to the euro area vs. the rest of the industrial world, the paper draws three conclusions. First, greater competition produces large effects on macroeconomic performance, as measured by standard indicators. In particular, we show that differences in competition can account for over half of the current gap in GDP per capita between the euro area and the US. Second, it may improve macroeconomic management by increasing the responsiveness of wages and prices to market conditions. Third, greater competition can generate positive spillovers to the rest of the world through its impact on the terms of trade.

122. The Optimal Degree of Discretion in Monetary Policy

Abstract:
How much discretion should the monetary authority have in setting its policy? This question is analyzed in an economy with an agreed-upon social welfare function that depends on the randomly fluctuating state of the economy. The monetary authority has private information about that state. In the model, well-designed rules trade off society's desire to give the monetary authority discretion to react to its private information against society's need to guard against the time inconsistency problem arising from the temptation to stimulate the economy with unexpected inflation. Although this dynamic mechanism design problem seems complex, society can implement the optimal policy simply by legislating an inflation cap that specifies the highest allowable inflation rate. The more severe the time inconsistency problem, the more tightly the cap constrains policy and the smaller is the degree of discretion. As this problem becomes sufficiently severe, the optimal degree of discretion is none.

The Brcko District of Bosnia and Herzegovina is small, with less than 100,000 people. In 2001, about 30 public companies were selected for privatization. At the outset, there were good reasons to ask whether the District would have any success in privatizing them. Many of the public companies had been shut down for up to ten years, while the rest were operating at a small fraction of their pre-1991 output. There was not a single company that was profitable enough to be sold successfully on the basis of its performance, none had adequate working capital or marketing arrangements, many were deeply in debt, some had too many nonworking “employees” and the equipment of most companies that was not damaged during the war was worn out or obsolete.

The purpose of this paper is to address two questions associated with Lithuania's political crisis in 2004. First, what were the domestic circumstances that led to the impeachment of Lithuania's President, Rolandas Paksas? Second, what evidence is there that Russia has played a significant role in the crisis and what are the motives behind Moscow's meddling in Lithuania's internal affairs? Answers to these questions are pertinent to the fate of countries throughout post-communist Europe, given their common history and geography. In addition, they provide the framework for addressing a third question that must be answered by the European Union (EU), NATO and the United States: what can be done about these two-fold threats to the newest members of the Western alliance?

125. Majority Rules and Incentives—International voting affects domestic policies

A “majority rule” defines the number of club-members that must approve a policy proposed to replace the status quo. Since the majority rule thus dictates the extent to which winners must compensate losers, it also determines the incentives to invest in order to become a winner of anticipated projects. If the required majority is large, the members invest too little because of a hold-up problem, if it is small, the members invest too much in order to become a member of the majority coalition. To balance these opposing forces, the majority rule should increase in the level of minority protection (or enforcement capacity) and the project's value but decrease in the ex post heterogeneity. Strategic delegation turns out to be sincere exclusively under this majority rule. Externalities can be internalized by adjusting the rule. With heterogeneity in size or initial conditions, votes should be appropriately weighted or double majorities required. The analysis provides recommendations for Europe's future constitution.

Some of the propositions underlying the way we regard the practice of the craft date back to the 18th-century “age of reason;” others are as current as yesterday's Wall Street media deal. “Journalism” is a historical hybrid— more an evolving social construct than a fixed point of reference. As such, it conveys contradictory associations: on one hand a band of swashbuckling iconoclasts daring to “speak truth to power;” on the other hand considerably more temperate, disinterested professionals gathering content to distribute through the “information division” of giant corporations. Abstract:
Theories of institutional development have tended to view discretion, or the leeway to act within institutional bounds, as an often unintended consequence of agency design and institutional specification. Yet the post-communist states show that discretion is a fundamental goal of institutional creation among competing elites. In turn, while political competition has been identified as a key constraint on discretion in institutional creation, widely-used indicators of political competition are inadequate. As post-communist democracies show, the number or seat share of political parties matters far less than what parties do in parliament. The key factor is a robust opposition: a clear, credible, and contentious threat to governing parties. Such opposition leads to the rise of formal institutions that both minimize the discretion necessary for rent-seeking, and favor equitable distributional outcomes.

Democratic theory tells us that competition between political parties fosters more responsive government by disciplining elected leaders. Yet party competition may not always attain the levels desirable for holding leaders accountable, notably at the sub-national level. This paper hypothesizes that variations in competition-induced accountability affect regional, or state, government behavior, and that this variation is reflected in citizen satisfaction with regional government performance. The hypothesis is confirmed using survey data from sixty-eight German state election studies. Specifically, a widening of the gap between the two main parties of each state is shown to affect subsequent individual-level satisfaction negatively. This finding presents a conjecture that should be generalizable to other countries with strong sub-national units.

During the past decade of European economic integration vastly worse standards have emerged in work conditions, industrial relations, and social welfare in Eastern Europe than in the West. Area scholars explain this divide by labor weakness caused by the ideological legacy of communism, and do not problematize the impact of transnational capital. In contrast, this essay argues that the reason why the European social model has not traveled to the East is that its socio-economic foundations, the industrial building blocks of the historical compromise between capital and labor, have not traveled either. In the West, the compromise had been rooted in capital-intensive consumer durables industries, such as car-manufacturing, and their suppliers. These sectors brought together organized and vocal labor with businesses willing to accommodate workers' demands, because for them labor had been less a problem as a cost-factor and more important as factor of demand. However, the main driving force of the eastward expansion of European capital has been the relocation of labor-intensive activities where business relies on sweating masses of workers, whose importance as consumers is marginal, and who are weak in the workplace and the marketplace. With this general conceptualization of how the emerging new European division of labor constrains the social aspects of East European market societies as a background, the essay studies the cases of Hungarian electronics and Slovak car industries in order to better understand how particular features of various leading sectors mediate the general pattern.

Studies on the changing labor relations in post-communist countries have flourished in recent years, such that a review and analysis of what has been reported is overdue. Yet, interestingly, these studies have not reached a consensus on what they seek to explain. Indeed, some of the main questions remain under contention. First, is labor in post-communist societies weak, or (in at least some countries) strong? What should the referent be in determining strength or weakness? To the extent labor is weak, what would explain this weakness? If labor's power varies throughout the region, what would explain this variation? There have been a number of answers posed to these questions to date, but not a thorough testing of rival hypotheses. This paper will demonstrate, using a variety of measures, that labor is indeed a weak social and political act or in post-communist societies, especially when compared to labor in western Europe. This general weakness is rather surprising when one examines it against the now considerable economic and political diversity that exists in the post-communist world. The paper will then examine a number of hypotheses that have been proposed to explain labor's weakness, concluding that the institutional legacies of post-communist trade unions, and the ideological legacy of the discourse of class, best explain this overall weakness. However, the concept of legacy is itself found wanting, since it is unable to account for the extent of this weakness or the trends that have occurred in the region over time.

This study tests competing hypotheses about popular support for European integration. It introduces anti-immigration sentiments as a key variable for understanding reluctance towards integration. Drawing on survey data, it is found that anti-immigration sentiments, economic considerations, and the evaluation of domestic governments are the strongest predictors of both support for integration and individuals' propensity to vote “Yes” in a referendum on the enlargement of the EU. When extrapolating the findings to future referendums on issues of European integration, it may be predicted that such referendums will result in a “No” outcome under the conditions of high levels of anti-immigration sentiments, pessimistic economic outlooks, and/or unpopularity of a government.

Democratic legitimacy for the EU is problematic if it is seen as a future nation-state. If instead the EU were seen as a regional state—with shared sovereignty, variable boundaries, composite identity, compound governance, and a fragmented democracy in which the EU level assures governance for and with the people through effective governing and interest consultation, leaving to the national level government by and of the people through political participation and citizen representation—the problems of the democratic deficit diminish for the EU level. But they become even greater for the national level, where the changes to national democratic practices demand better ideas and discourses of legitimization. A further complicating factor results from problems of “institutional fit,” because the EU has had a more disruptive impact on “simple” polities, where governing activity has traditionally been channeled through a single authority, than on more “compound” polities, where it has been more dispersed through multiple authorities.

This article suggests that the academic emphasis on rational choice and political-sociological approaches to party development has led to a misleading impression of convergence with Western patterns of programmatic competition and growing partisan identification in the Central European party political scene. As an alternative thesis, the author argues that the very character of 'transition' politics in Eastern Europe and the necessarily self-referential nature of the parliamentary game has structured party systems in those countries, and that the differences between the party systems in this region are critically related to experiences under communism (–a political-historical explanation). The paper argues that, in order to cope with a practical lack of public policy options in major areas such as the economy, parties have had little choice but to compete over operating 'styles,' rather than over substantive (ideologically based) programmatic alternatives. The development of parties incumbent in government since 1989 may be compared to the development of catch-all parties in Western Europe in terms of the competitive logic of weakening/avoiding ideological positions in order to embrace a large constituency. However, successful parties in Eastern Europe lack the 'baggage' of an ideological past and the history of mass membership and a class or denominational clientele – their defining characteristic is that they try to appeal to all of the people all of the time.

Enlargement today is a priority on the European agenda. Examining Portugal and Greece from a comparative perspective with respect to Poland, this Study analyzes the original and specific paths each of these national configurations have taken as regards administrative and institutional changes, particularly through the regional dimension, policy reorientations and modes of government. Given the large body of acquis communautaire that must be integrated, the nature of Commission involvement and the highly regulatory nature of European directives, this dimension emerges as the most significant in the process of Europeanization: public administration acts as a filter in this dynamic and nation-states are paradoxically strengthened by European integration. This comparison is an opportunity to underscore the importance of innovations and the singularity of modes of government, suggesting that certain arrangements put into practice in cohesion countries may provide sources of inspiration for the new entrants, which are faced with similar problems of administrative competence, bureaucratic blockages and political and state legacies that are remote from the European model of public administration, civil service organization and rules. With the effect of European constraints, a threefold dynamic is at work: a dynamic of delegation, or privatization, through the creation of agencies, offices and institutes, a dynamic of politicized (re)centralization, and a dynamic of political, institutional and social innovation. Thus components of these models are constantly borrowed and reshaped, hybrid constructions are formed and configurations take shape that are no less European than what can be found in the "heart" of Europe.

The financing of EU-led crisis management operations is a somewhat neglected yet nevertheless crucial factor affecting the external effectiveness and internal consistency of the Union's foreign and security policy. Until recently, CFSP's operational acquis has been minimal, its legal underpinning limited and tortuous, its budgetary fundament ludicrous, and its administrative practice mostly contradictory and often fraught with inter-institutional turf battles between Council, Commission and Parliament. With the launch of the first ESDP operations proper (EUPM in Bosnia and Herzegovina, Concordia in FYROM) in 2003, the forthcoming Operation Artemis in the Democratic Republic of Congo and the possible takeover of SFOR after 2004, it has become all the more important and urgent to devise more appropriate arrangements and incentives for common action. The European Convention and the ensuing Intergovernmental Conference represent additional opportunities to be seized. In this respect, the main issues to be addressed regard: a) the speed and readiness of budgetary allocations, on the one hand, and their long-term sustainability, on the other; b) the coherence of the relevant provisions, in both institutional and functional terms, and their consistency with the peculiarities of the EU as an international actor; and c) the degree of transparency, accountability and internal fairness compatible with the imperatives of crisis management. The experience of other international organisations operating in this field (NATO, OSCE, UN) can also be taken into consideration with a view to selecting rules and modalities that may be helpful in tackling the problems highlighted here. First and foremost, it is desirable that the current fragmentation of CFSP expenditure in separate EU budgetary lines be overcome. The appointment of an EU 'Minister for Foreign Affairs' (or whatever title is given to the new foreign policy supremo) is expected to help solve this problem and reduce some inter-institutional tensions and bottlenecks. For example, it is desirable for all expenditure related to civilian crisis management (with the possible exception of the salaries of seconded national personnel) to be borne by the EU bud- get in a more transparent fashion. To this end, the relevant procedures have to be made less tortuous and more flexible. Secondly, expenditure for operations 'having military or defence implications' — in so far as it will remain distinct and separate from the rest — should be pooled in a more systematic, sustainable and explicit manner. Neither the current 'ad hocery' (as exemplified by EUPM and Concordia ) nor the minimalist approach adopted by the Convention's Praesidium (with the proposal of a subsidiary 'start-up' fund) address the essential issues. In fact, if a subsidiary budget has to be set up, then it should be more ambitious and create a long- term basis for covering all the 'common costs' arising from military operations. Such an EU Operational Fund could usefully draw upon the precedent of the European Development Fund and adopt a distinct 'key' for national contributions. Such a 'key' should take into account e.g. the member states' ability to pay but also their ability to contribute in kin through the actual involvement of personnel and equipment in EU operations. It should also be periodically adjustable and help overcome potential 'burden-sharing' disputes inside the Union by setting agreed criteria against which to measure and assess national contributions without resorting to the crude GDP scale. At the same time, the Fund's financial cycle should be the same as that of the EU budget. And, in perspective, the “common costs” thus covered should include also accommodation and transportation costs, especially if the Union develops common capabilities in the fields of strategic lift and logistics. By doing so, the EU would eventually have two main modalities for common operational expenditure at its disposal: the EU budget for all non-military aspects, and the Operational Fund. Both would guarantee a reliable financial perspective. If the separation between civilian and military aspects were ever to be bridged, their merger would not represent a problem. Thirdly, the European Parliament could consider reimbursing those member states who participate in ESDP operations a fixed somme for faitaire to cover partially the per diems of their seconded personnel (civilian as well as military). Such reimbursement could be made through the EU budget annually, ex post facto, with no political conditions attached. On the one hand, it would prove that the EU budget covers not only internal benefits (agriculture and structural funds) but also external commitments. On the other, it would add transparency to ESDP in that the Parliament could organise hearings with experts and officials as well as plenary debates. For their part, the member states would gain an additional incentive – however modest – to provide adequate human resources for external operations. Finally, participating 'third' (and especially remaining and future candidate) countries could well be associated with all these arrangements, either case by case or more systematically. And none of the proposals outlined here necessarily require treaty change, although it would be preferable to insert some 'enabling' clauses in the Constitutional Treaty. All proposals, however, would require collaboration — rather than competition — between EU institutions.

In Norway, monitoring of the secret services (EOS services) is carried out by a parliamentary monitoring body, the Committee for Monitoring of Intelligence, Surveillance and Security Services. The Committee conducts continuous monitoring of the Norwegian Police Security Service, the Norwegian Intelligence Service and the Norwegian National Security Authority (NoNSA). The monitoring arrangement is independent of the EOS services and the remainder of the administration. The Committee's members are elected by the Storting (the Norwegian parliament), and the Committee reports to the Storting annually. The arrangement was established in 1996. The continuous monitoring takes the form of regular inspections of the secret services. The Committee also deals with complaints from private individuals and organizations that believe the secret services have committed injustices against them.

There is a widespread belief that security policy is a 'natural' task for the executive as they have the requisite knowledge and ability to act quickly. The decision to go to war, to contribute troops to multinational peace support operations, to conclude international treaties or to raise defence spending, to mention just some of the most important governmental security responsibilities, are regarded to be executive decisions. The stubborn perception exists that parliaments should be kept out of these decisions. Parliament tends to be regarded as a less suitable institution for dealing with security issues, especially given its often time-consuming procedures and lack of full access to the necessary expertise and information. Additionally, parliaments are regarded as ill-suited institutions for keeping classified information secret. However, this is a misperception. The past teaches us that parliaments do play a major role in matters of security in democratic states, both in times of war and peace. In the times of the Roman Republic, the Dutch Republic in the sixteenth century, Great Britain in the Second World War, or, more recently at the outbreak of the Second Gulf War, Parliaments across the globe have debated, influenced and exercised oversight over security policy and security sector reform, even in the middle of war.

Good governance of the security sector, when considered from a disarmament perspective, indicates linkages between two principal issue-areas in contemporary international politics, i.e. those of 'security' and 'governance'. These two issue-areas are closely intertwined, contributing to evolving definitions of the terms themselves. During the bipolar period, security was generally defined in 'hard' military terms. Following the end of the Cold War, the concept was broadened to include 'soft' and human security concerns. This was paralleled by a broadening of the concept of confidence-building measures to include, inter alia, the role of security forces in the society. The fundamental principles of good governance include transparency and accountability of the exercise of state power. The implementation of good governance of the security sector (including military, paramilitary, internal security forces, police, border guards, and intelligence services) is a long and often difficult process, and whether this can be achieved is dependent on the capability and willingness of the individual countries.

A widening gap between rich Western countries and their poor neighbours in Eastern and South Eastern Europe represents another serious danger, as well as do uncontrollable corruption in politically and economically weak regimes, the inability of states to protect their borders efficiently against trafficking, smuggling, illegal immigration and weapons proliferation, including weapons of mass destruction. Information warfare which results in serious damage being caused by attacks on the information systems of developed countries represents another relatively new security threat. Expertise in security political decision-making has become very important, and thus in the future, a shortage of competent specialists in governmental and parliamentary structures could affect states' ability to anticipate threats and make an adequate decision.
