201. Does Al Qaeda Central Still Matter?

Abstract:
This article examines whether Al Qaeda Central are still relevant or not. By investigating Al Qaeda Central’s activities, which are aimed at provoking violence in Afghanistan and Pakistan, as well as its continuous plots of direct attacks against the US, this article shows that Al Qaeda’s operational capability is stronger than anticipated by the US and other scholars. In addition, Al Qaeda affiliates maintain a close relationship with the group which in turn facilitates Al Qaeda Central’s resiliency. Moreover, Al Qaeda in the Arabian Peninsula (AQAP)’s aggressive support and contribution to the Al Qaeda network indicates that Al Qaeda Central’s longevity depends on its relationship with affiliates. The article concludes that under these conditions, Al Qaeda Central still has a place in global security discussions.

202. Nonviolent Struggle Versus the Islamic State: A Strategic Perspective

Abstract:
Attacking terrorism at its root, through slow and incremental cultural change, will pay off in the end, but this process is a difficult sell to those facing IS now. Such a long-term view neither benefits the people struggling to survive each day under IS’s murderous and authoritarian reign, nor does it equip the international security community concerned about IS’s immediate threat to regional stability. There is another solution. If what is needed is a relatively rapid rearrangement of social conditions that would cut off IS’s critical sources of power, then there may be no better route than collective nonviolent action undertaken by Iraqi and Syrian civilians. Collective nonviolent movements have been shown to be more effective than violent movements, even against highly violent or authoritarian opponents. Such a movement might take a page from IS’s own book, and tap into the same sources of power that have been indispensible to its success. After all, IS did not attract an army of nearly 30,000 fighters and capture a cumulative swathe of land larger than the United Kingdom merely because it had weapons. IS has flourished by successfully filling at least two critical power vacuums within Iraqi and Syrian society. It has seized upon a powerful narrative during a time of turbulence and confusion, and it has delivered necessary human services in places where the state has proved incompetent. However, a nonviolent collective movement of Syrian and Iraqi citizens could fill these power vacuums much more convincingly than IS, and in so doing, cripple IS’s power in the short term and impede the growth of new terrorist movements in the long term...

203. Paris 2015: Terrorism, Climate Change, and the Politics of Securitization

Abstract:
In the closing months of 2015, two separate events thrust the city of Paris into the epicentre of global security politics. On November 13th, the French capital was the site of a series of coordinated terrorist attacks. At least nine individuals claiming allegiance to the Islamic State in Iraq and Syria (ISIS) used suicide vests and assault weapons to target citizens and symbols of the Republic. The attacks, which took place in cafés, restaurants, the national soccer stadium, and a crowded music venue, killed more than 130 people and precipitated the largest state of emergency across France since the Second World War. Just two weeks later, the 21st Conference of the Parties to the United Nations Framework Convention on Climate Change (UNFCCC) convened in Paris. The conference, known as COP21, was a pivotal moment in the global effort to reach a multilateral agreement on global climate change. The juxtaposition of terrorism and climate change, two of the most pressing security issues of our time, encapsulate the complex and intertwined nature of contemporary threats to global security. The political and normative implications of the November events in Paris demonstrate the intricacies of securitization theory, a “radically constructivist” approach to understanding the nature of security threats.[1] This theory provides a framework for understanding the process through which political issues are transformed into security issues, while offering a series of cautionary warnings about the adverse consequences of security discourse and practices within democratic societies. The application of securitization theory lends a unique understanding to both the terrorist attacks and popular engagement in the climate summit. This framework also clarifies the resulting trade-off between renewed securitization of terrorism and democratic mobilization at COP21.

Abstract:
On November 5, 2015, authorities in the Molenbeek neighbourhood of Brussels, Belgium shut down Café del Beguines. The bar was frequently host to drug deals and other illicit activities, known to “[compromise] public security and tranquillity.”[1] The bar manager, Ibrahim Abdesalam, was one of the attackers involved in the Paris terror events in mid-November 2015. The attacks shook France and shocked the world, and at the year end, investigation of the events still posed many unanswered questions. French and international investigators have focused their efforts on exposing the source of funding for the attacks. Although an important part of any investigation, it must be understood that the funds necessary to plan and conduct attacks like these are minimal, often requiring less than $10,000[2] Unfortunately, terrorists have learned that small sums of money collected over time through the use of somewhat banal criminal activities can be effective, and even reliable, sources of funding.

Abstract:
In America and the Rogue States, Thomas Henriksen lays out the relationships that exist, and have existed, between America and the states that made up George W. Bush's 'Axis of Evil.' Henriksen outlines the history of the interactions between the United States and North Korea, pre-invasion Iraq, and Iran, and through this draws out a number of themes. He also shows that the ways the relationships have played out are highly situational and there is no one-size-fits-all solution. In the last chapter, Henriksen explores American relationships with a number of states that were either once considered rogue or could become rogue, like Libya, Syria, and Cuba, referring to them as either “lesser rogues” or “troublesome states.” These states have remained “a puzzle for US foreign policy” (1) and are characterized by three things: autocratic governance, sponsorship of terrorism, and pursuit of weapons of mass destruction (WMD). There is no clear definition provided by Henriksen for what can be considered a rogue state, making it difficult to judge what other states, if any, could be considered rogue. Henriksen seems to arbitrarily decide who is rogue and who is not: Cuba is a rogue state, while Myanmar is merely troublesome. Instead of synthesizing a clear definition of the term, something that could then be applied to other states in order to judge their 'rogueness,' Henriksen uses the Bush administration's criteria (the term itself was coined by President Bill Clinton in a 1994 speech in Brussels), which was outlined in the National Security Strategy of 2002 (NSS-2002). These were “brutality toward their own people; contempt for international law; determination to acquire weapons of mass destruction (WMD); advanced military technology; sponsorship of terrorism; rejection of human rights values; and hatred for the United States and 'everything it stands for'”. The use of the NSS-2002 definition allows for the 'Axis of Evil' to fit neatly into the term, which constitutes a problem of tautology, at least for the Bush administration. Further compounding this was that, according to Henriksen at least, the administration was set on going to war in Iraq prior to assuming office. This creates a situation in which it is hard to determine whether the idea of rogue states was created to justify this desire, or it informed the desire prior to the administration taking office.

206. Reconfiguring the Law of Non-Refoulement: Procedural and Substantive Barriers for Those Seeking to Access Surrogate International Human Rights Protection

Abstract:
Both geographic and normative constraints restrict access to surrogate international human rights protection for those seeking a haven from serious human rights abuses. Primary among territorial restrictions has been the fall-out from the US Supreme Court's decision in Sale v. Haitian Council Centers in which the court explicitly ruled that nothing in US statutory law, or in the 1951 Convention on Refugees or its 1967 Protocol, precluded the interdiction of Haitian refugees in international waters and their return to the country of origin without an effective interview on their protection clams. This ruling is in transparent contradiction to the general international law norm of non-refoulement according to modern scholarship and emerging case law. This paper concludes that Sale should be overturned by statute as should related pre-screening practices. A new standard of “jurisdiction” should be adopted which does not depend on territorial access to a signatory state but on whether the state is exercising power in fact. Similar concerns exist with respect to safe third country agreements which often offend the international customary right of the asylum seeker to choose where his or her claim will be filed. This paper argues that the right of choice should be recognized and onward travel and admission to the country of destination allowed. This result is especially called for where return of the alien by the country of first contact raises serious concerns under the law of non-refoulement. Imbalances noted in this paper include those generated by the new terrorism related grounds of inadmissibility in the United States and the summary denial of children's asylum claims flowing from gang violence. Other questions are raised in this paper concerning work authorization and detention of asylum seekers. Access to an employment authorization Journal on Migration and Human Security document for those filing colorable claims should be recognized by statute to render US practice consistent with that of most other states. Release from detention, on the other hand, for asylum seekers has now been broadly recognized by the US Department of Homeland Security where the asylum seeker's identity can be ascertained and the claim is non-frivolous in nature. This approach is largely consistent with international law, although there have been unnecessary delays in implementing it. On the substantive law, the international customary norm of non-refoulment has been expanded considerably through the development of opinio juris by scholars and the practice of states. This paper traces efforts in Europe to develop a law of temporary refuge for those fleeing civil war situations characterized by humanitarian law violations. Similarly, case law under the European Convention of Human Rights has now come to focus on the harm the claimant would suffer as the result of conditions in the country of origin without identifying an explicit agent of serious harm. Related to these developments has been the notion of complementary protection under which relief can be conferred where the alien would suffer serious harm upon return to the home state but not for a Convention reason. These approaches have now received approval in the European Union Asylum Qualification Directive so that international protection may now be conferred either because the alien would suffer serious harm on account of the intensity of human rights violations taking place in the country of origin, or those conditions, taken in conjunction with the claimant's personal situation, support a finding that the claimant would be impacted. This paper argues that this latter standard has now been made a part of the customary norm of non-refoulement and that it should be recognized by statute as a basis for non-return and coupled with status where the new standard can be met. Such a measure would help restore the nation's commitment to human rights and humanitarian concerns.

207. From terrorism to 'radicalization' to 'extremism': counterterrorism imperative or loss of focus?

Abstract:
This article argues that there has been an increasing convergence of the discourses of terrorism, radicalization and, more lately, extremism in the UK and that this has caused counterterrorism to lose its focus. This is particularly evident in the counterterrorism emphasis on non-violent but extremist ideology that is said to be 'conducive' to terrorism. Yet, terrorism is ineluctably about violence or the threat of violence; hence, if a non-violent ideology is in and of itself culpable for terrorism in some way then it ceases to be non-violent. The article argues that there should be a clearer distinction made between (non-violent) extremism of thought and extremism of method because it is surely violence and the threat of violence (integral to terrorism) that should be the focus of counterterrorism. The concern is that counterterrorism has gone beyond its remit of countering terrorism and has ventured into the broader realm of tackling ideological threats to the state.

Abstract:
Relationships between entities form an important element of warfare. In the current conflict in Iraq and Syria, the military alignment (or lack thereof) of states will likely be a key determinant in the eventual outcome. However, states are not the only actors within Iraq-Syria that are forming and evolving in their relationships with others. Over the past several months, one interesting facet in regards to relationships between actors involved in the conflict has been how the Islamic State has received and accepted a number of pledges from other organizations and groups in its quest to establish and expand its caliphate.

209. “Divine Violence” After the Kharotabad Killings

Abstract:
In 2011 the law enforcement agencies of Pakistan killed a group of foreigners traveling across Pakistan-Afghanistan border. The agencies then tried to cover up the incident by calling it a potential suicide-bombing attack. However, they could not succeed in the cover-up plan primarily due to a photograph of one of the killed aliens—a woman—that appeared on local media. In this photograph the alien woman is shown lying on the ground near a sandbag-covered check-post waving for mercy/justice. The photograph becomes viral on both electronic news and social media and impels the government to order an inquiry. In this article, I engage the concept of “divine violence” and explore the photograph’s politics of aesthetics, which I argue contextualizes the photograph’s meaning during a creative moment for human rights.

210. The Terrorist Threats Against Russia and its Counterterrorism Response Measures

Abstract:
As of mid-2015, the primarily Islamist-based terrorist threats against Russia and its counterterrorism response measures continued to be in the spotlight. These Islamist terrorist threats, it must be pointed out, were unrelated to Russia’s other national security problems emanating from its intervention in Ukraine, which will not be discussed in this article. As with other Western countries, the latest phase of the terrorist threats against Russia has become even more complicated than before, with large-scale involvement by a reported 1,700 “homegrown violent extremists” (HVE),[1] primarily North Caucasus-based, many of whom have travelled to Syria and Iraq to join the Islamic State’s insurgents and to fight the Moscow-supported Bashar al-Assad government as well as the Shi’ite government in Baghdad (which is also backed by Tehran – Russia’s close ally), with their violent extremism also directed against the Russian state. As part of this phase, although unrelated to the involvement of the aforementioned Russian Islamists in Syria, Russian airpower was deployed in Syria in September 2015 to support the besieged al-Assad regime against the Islamic State. The earlier phase of the terrorist threats against Russia was highlighted by the April 15, 2013 Boston Marathon bombings, which were perpetrated by two brothers of ethnic Chechen origin (one of whom was reportedly monitored by Russia’s security services during his stay in Dagestan), as well several significant terrorist attacks in late 2013 during the lead-up to the Sochi Winter Olympics, which were held in February 2014 without a terrorist incident. Overall, the primary terrorist threats against the Russian Federation are presented by the Islamist insurgents in the North Caucasus, who are organized into several groups that are loosely allied with al-Qaeda’s global Jihad. Fortunately for Russia, in their most significant threat over the past several years, these Islamist militants were thwarted in their intent to exploit the worldwide media attention associated with the February 2014 Olympic sporting events, which were located close to the North Caucasus, several hundred miles from the Republic of Dagestan, where they were mounting an insurgency to establish an Islamic state in that region. In response, Russia greatly boosted its counterterrorism measures in the North Caucasus republics as well as in other parts of the country, thereby preventing these insurgents from succeeding in their terrorist plots. Nevertheless, the attraction of jihadi groups such as the Iraq- and Syria-based Islamic State in radicalizing hundreds of Russian Islamists into joining their insurgency expanded the geographical scope of the terrorist threats against Russia, particularly upon the return of some of them to Russia to carry out attacks in light of Moscow’s support of the Syrian and Iraqi regimes and their call to establish an Islamist caliphate in the North Caucasus.
