Abstract:: The now‑liberated areas of Azerbaijan are contaminated by mines and explosive remnants of war (ERW), the clearance thereof being one of Baku’s highest post‑conflict priorities. Before proceeding any further, we must provide proper definitions of these terms, since they are technical in nature and thus may not be familiar to the general reader. According to the Convention on the Prohibition of the Use, Stockpiling, Production and Transfer of Anti‑Personnel Mines and on Their Destruction that was adopted in Oslo in 1997 and entered into force in 1999 (it is colloquially called the AntiPersonnel Mine Ban Convention, or APMBC), an anti‑personnel mine “means a mine designed to be exploded by the presence, proximity or contact of a person and that will incapacitate, injure or kill one or more persons.” An antivehicle or antitank mine is effectually the same thing, except that it is designed to explode when triggered by a vehicle. Together, they fall under the catchall term mine, which the same document defines as a “munition designed to be placed under, on, or near the ground or other surface area and to be exploded by the presence, proximity, or contact of a person or a vehicle.” Furthermore, explosive remnants of war (ERW) are defined as explosive munitions left behind after a conflict has ended. They include unexploded artillery shells, grenades, mortars, rockets, air‑dropped bombs, and cluster munitions. If such weapons fail to detonate as intended for whatever reason, they are called unexploded ordnance (UXO); if, on the other hand, they have not been used during an armed conflict and have been left behind by the party that brought them to the battlefield, they are called abandoned explosive ordnance (AXO). Lastly, cluster bombs or cluster munitions, which are defined as weapons containing from several to hundreds of explosive submunitions. They are dropped either from the air or fired from the ground and are designed to break open in mid‑air, releasing submunitions and saturating an area that can be as wide as several football pitches. Based on past practice, the failure rate of cluster munitions to explode as intended stands at between 10 and 30 percent.

Abstract:: The oil and gas industry is regarded as one of the most dynamic, complex and controversial industrial sectors and involves activities that generate a whole range of diverse viewpoints. This has resulted because the industry has several stakeholders who can influence and, at the same time, be impacted upon by activities associated with the value chain of oil and gas oriented business. However, one extremely important stakeholder is the community. Many researchers (Orsini 2016; Wall 2012; Mascarenhas 2011; Kinslow 2014; Boladeras, Wild and Murphy 2016) agree that the viewpoints of communities where oil and gas operations are carried out should be given high priority due to their significant influence over industry activities in their region, as well as the fact that they are the entities most impacted by these activities. This research examined notable conflicts experienced between oil companies and host communities in Africa with the aim to identify means by which relationships between the two aforementioned parties could be made cordial and sustainable. An integrated literature based research method and a case study strategy were adopted for this research. Two frameworks that will support organisations in effectively engaging and establishing cordial relationships with stakeholders were developed by the author; and the key findings of this research are that an effective means of establishing sustainable cordial relationships with host communities in Africa is by involving them in the ownership of operations in their region. This will naturally instill in them some sense of responsibility over the operations, which will in turn enable oil and gas companies to gain the trust, cooperation and support of host communities, as well as the social license to operate in their region. This relationship can be sustained if both parties work collaboratively to determine ways in which benefits from the operations may be maximised.

5. Pipelines and Protests: Legacies of Struggle and Resistance in the Fight Against Environmental Racism in Canada

Abstract:: Canada was founded on enslavement and dispossession. This is most ex- emplified by its assimilationist ideologies and policies, by the displacement, subjugation, and oppression of Indigenous and Black peoples and cultures, and by the expropriation of Indigenous lands. The colonial theft of land and accumulation of capital have been foundational to Canada’s wealth. New op- portunities for Europeans to access resources prompted colonization in North America, which was followed by the creation of a global economy that came to be dominated by Spain, Portugal, Holland, France, and Britain. To access lands in the Americas, Europeans negotiated treaties, dispossessed Indigenous peoples of their lands, waged war to extinguish Indigenous populations, and eliminated or disrupted Indigenous landholding traditions.1 The unique ways in which Black and Indigenous people have been racialized and implicated in white set- tler nations and by capitalist expansion reveal the antithetical roles both groups have played in the formation of settler colonial societies. For example, while the reproduction of Black slaves in the United States was perceived as positive since it increased slave owners’ wealth, the growth of Indigenous populations was seen to jeopardize the accumulation of profit by slave owners because it made access to land more difficult.2

Abstract:: This paper attempts to analyze the political uncertainty surrounding environmental degradation by means of utilizing the game theoretical model. It challenges the popular opinion that views the political exchanges over climate change as a super game where players will eventually learn to cooperate through repeated interactions. Instead the paper argues that the climate change problem is essentially a case of ‘one-shot prisoner’s dilemma’ irrespective of the number of times the players interact with one another. To demonstrate the one-shot prisoner’s dilemma at play, it employs the comparative method to explain the climate politics between the major polluters of the world (US, China, Brazil and India). The debate is analyzed at two distinct levels: Intergenerational and Intragenerational level. Lastly, the paper notes the significance of ‘the immediate threat factor’, which it argues poses a fundamental challenge to the political resolution of the climate change problem.

9. PLAN E: A Grand Strategy for the Twenty-first Century Era of Entangled Security and Hyperthreats

Abstract:: A transdisciplinary research project investigated the idea of framing climate and environmental change (CEC) as a new type of threat: a hyperthreat. Traditional military analytical methods were used to assess the hyperthreat and its context and develop ideas about how an adequate response could be conceived. This approach contrasts to prior literature and longstanding geopolitical discourse that identify the risks of taking a securitization approach. Instead, the author argues that it is now riskier not to consider CEC within a mainstream geopolitical and nation-state security strategy. When the hyperthreat of CEC is centered as the main threat to be contained, and its relationship to other threats is analyzed, startling new pathways to stability emerge. The research developed a new theoretical approach called “entangled security” to develop an initial new “grand narrative” and “grand strategy” (PLAN E). This article offers a vision of how military theory can be reimagined to support new policy directions and security priorities.

Abstract:: This article aims to indicate the sources of problems in the field of governance and politics in the African Great Lakes Region. The countries of this region play an essential role in the global socio-political and economic system. Their development is hampered by numerous external and internal conflicts resulting from both the historical and contemporary problems of the countries. Colonialism had a major impact on the development of African countries. It manifested itself, among other things, in the spread of political domination. Adopting state management patterns from European culture and attempt to transplant them on African ground without understanding local cultural conditions contributed too much post-colonial fresh and modern conflict. Examples of this are failures to establish liberal democracy and its crises in the African Great Lakes Region.

Abstract:: It has been argued that the U.S. shale revolution, the Trump Administration’s energy policies, and the global shift towards low‑carbon energy sources and renewables have contributed to shape a new energy order—one that challenges the market power traditionally enjoyed by petro‑states. Nowhere are these developments more relevant than in Azerbaijan, as the country’s expensive investments in the Southern Gas Corridor come under increasing pressure. Unless Azerbaijani gas can be decarbonized at a competitive cost, it may risk becoming redundant within a couple of decades as Europe embraces a greener future. Geopolitics and Geo‑economics The Southern Gas Corridor (SGC) is a $45bn mega‑project ($25bn for the development of the Shah Deniz II field and at least $15bn for the delivery system) to supply natural gas from the Caspian Sea to Europe and, by so doing, reduce reliance on Russian imports. This is a priority that has taken on urgency in the wake of Russia’s 2014 annexation of Crimea and the sharp deterioration in relations between Moscow and Brussels that ensued. Currently, the SGC is made up of two pipelines to deliver gas from Azerbaijan’s Shah Deniz II field to Turkey and Europe—one called TANAP that is already operational and runs the length of Turkey, and another known as TAP stretching from Turkey’s border with Greece across Albania to Italy, which started pumping gas in late 2020. This is how a leading ADA University policy expert described the situation to me in October 2020, in light of technical delays in the pipeline’s inauguration and the big changes in energy markets described above: “the TAP pipeline is 90 percent completed and will be inaugurated soon. Unlike oil pipelines, whose flexible delivery to the end‑consumer can be sorted out once they are built— as oil travels via tanker, rail, etc.— gas pipelines are more rigid investment endeavors. [...] You don’t agree on a gas pipeline unless you have secured a buyer on the other end.” While natural gas supplies from Azerbaijan’s Shah Deniz field are already contracted, the project has seen numerus twists and turns since it was signed with great fanfare at the end of 2013. The SGC is an expensive endeavor and the institutions that lined up to finance it are a testament to the degree of strategic importance it carries for the EU. The project has, indeed, been designated as one of the EU’s “priority projects.”

Abstract:: Globalization, one of the important phenomena of today, has led to political, social and economic changes in both regional and national scale. These rapid changes seriously affect the phenomenon of migration, its target and the quality of life. Especially in EU and OECD countries, various policies have been implemented to prevent the increasing migration rate, fulfill the requirements of the global economy, and to eliminate the developmental differences between countries, regions and sub-regions. Thus, it is of great importance to investigate the causes of international migrant mobility that deeply affects the economic and social structure of nations. The present study aimed to determine the factors that affect international migration towards the OECD countries. A current data set consisting of 79 variables defining the social, economic, environmental structure was created and correlation and regression analysis methods were used to determine the factors that affected international migration in OECD countries. With this work; it has been observed that there are strong relationships between international migration and various economic and social development variables. Hence, it is envisaged to make a descriptive and statistically valid, reliable assessment, to make predictions, and to contribute to the scientific literature in the context of international migration policies.

Abstract:: This article draws attention to the need of a reform of the environmental protection by means of international criminal law as enshrined in the Rome Statute of the International Criminal Court. After giving a short overview of the contemporary environmental protection in war- and peacetime offered by international criminal law, it becomes clear that international criminal law fails to succeed at offering sufficient environmental protection. This paper outlines that there is no convincing reason for a differentiated approach in international criminal law to environmental damage in wartime and in peacetime, and that a shift from an anthropocentric to an ecocentric approach would positively contribute to a more effective protection of the environment. It is therefore argued for the introduction of a new integral and ecocentric international crime against the environment in the Rome Statute. The paper then elaborates on existing proposals on such a new crime against the environment before some proper observations on the exact contours of the crime are made. A focus lies on the new crime’s threshold of seriousness as well as on the necessary mens rea requirements. The insufficiency of the contemporary legal framework and the merits of a new crime against the environment are exemplified by an archetype example of peacetime environmental damage, the Chevron/Texaco oil spill scenario in Ecuador.

Abstract:: En los últimos años, el concepto de “Antropoceno” y sus implicaciones teórico-prácticas han permeado la Teoría de las Relaciones Internacionales, y muy especialmente los estudios centrados en la seguridad internacional. Todavía escasas, la mayor parte de las reflexiones se circunscriben a trabajos de orientación teórica, aunque cada vez son más los que exploran su potencial para comprender casos, desafíos y conflictos concretos. Partiendo de la aceptación de que la actividad humana tiene un variado y profundo impacto sobre la ecología y la geología del planeta y, al mismo tiempo, del convencimiento de que la comprensión de la seguridad internacional contemporánea exige analizar la conflictividad con una nueva mirada que se haga eco de esta realidad, este artículo ofrece una aproximación eco-crítica a la dimensión medioambiental de los conflictos del Mar de China meridional. El análisis arroja dos conclusionesprincipales. La primera es que la naturaleza no sólo no está siendo objeto de protección en el Mar deChina meridional, sino que a menudo está siendo sacrificada en aras de acciones ligadas a la conflictividad (como la construcción de islotes artificiales o la militarización) y, lo que resulta más paradójico, de iniciativas orientadas al fomento de la cooperación y la resolución de los conflictos existentes (como los acuerdos para la explotación conjunta de las reservas pesqueras o de los recursos de petróleo y gas natural). 25. Climate Politics and the Crisis of the Liberal International Order

Abstract:: The election of Donald Trump brought disarray to the climate change regime. The changes in what was up to then a promoter of the liberal international order (LIO) exacerbated existing tensions while creating new ones. This paper investigates how that challenge impacted the behaviours of Brazil, China and the European Union (EU) by comparatively analysing their dissimilar positions with respect to three indicators before and after Trump’s coming into power. These indicators are individual pledges and climate-related policies; approaches to climate finance; and the principle of common but differentiated responsibilities and respective capabilities (CBDR-RC). The analysis first shows how the US started eroding the broader LIO and the climate change regime to then delve into the behaviours of the three respective key players concerning climate talks. I sustain that the EU, despite its inner divisions, is already counteracting Washington, whereas China is combining a pro-status quo position based on a rhetorical condemnation of the United States. Soon a new milestone will be reached on the thorny path of the inter- national climate process: on December 31, 2020, the Doha Amendment to the kyoto Protocol of the united nations Framework Convention on Climate Change (unFCCC) comes into force.1 this document extends the time frame of the kyoto Protocol from 2013 to 2020 (hence its unofficial title, kyoto-2) and contains a whole set of amendments to the kyoto guidelines, including updated quantitative criteria for greenhouse gas emission reductions for developed countries. Climate activists will probably schedule their next mass marches for this date, in order to mark this "historic" stage in the fight against global warming. Leaders from a number of states are expected to make bold new calls to “set the bar high” for the sake of averting a global climate col- lapse. But what remains hidden behind the scenes? This study argues that traditional international relations theories and practices are ineffective in discussing and analyzing climate migration as a new global security problem. Abstract:: Since the Fifth World Parks Congress in Durban (2003) and the Seventh COP on Biological Diversity in Kuala Lumpur (2004), the definition of protected areas has evolved. Now, the definition incorporates principles of participation and inclusion, as well as traditional and local knowledge. This newfound recognition on the international scene shed light on the role of non-state actors, including indigenous peoples and local communities, as guarantors of conservation, and marked a decisive turning point in the evolution of international policies on this issue. Despite the growing awareness of the importance of biodiversity conservation and the role played by local communities to this end, national legislation and policies in Morocco do not yet give due recognition to areas conserved by local communities. Developed around the case study of a traditional natural resource management regime—the agdal—practiced by communities of the Moroccan Atlas, this piece highlights the extent to which traditional modes of managing common-pool resources (CPR) are compatible with a government’s strategy to decentralize natural resource management. Despite the benefits that community conserved areas and territories represent for maintaining ecosystems, traditions, and livelihoods, as well as their advantages in terms of decentralization, these practices are under threat due to a lack of policies and programs directly supporting or recognizing communities' agency over local natural resources.

Abstract:: Managing and adapting to flood risk is an increasing concern of policymakers globally, as anthropogenic climate change contributes to sea level rise and the rising intensity and frequency of coastal storms. Moreover, it is critically important that policymakers design and implement equitable adaptation processes that are based in environmental justice principles. In the United States, the primary instrument for flood risk management is the National Flood Insurance Program (NFIP)—but the program already suffers from debt, low participation rates, outdated flood risk assessments, and myriad other structural issues. By integrating several models of policy development, this analysis offers explanations for why NFIP reform attempts of the past decade have repeatedly failed and offers the present moment (in the early months of the Biden Administration and as the pandemic crisis continues) as a potential policy window for realigning reform efforts. Achieving true NFIP reform remains crucial to ensuring that all coastal residents have affordable options for low-risk housing, despite the expected growth in high-risk flood zones.

Abstract:: This paper discusses Brazil’s role in climate governance, methodologically and metaphor- ically comparing it to chess pieces moves, based on national and regional official documents, com- mitments and data. Unlike other IR studies, our proposal suggests different behaviours at different levels of analysis for the same country. Nationally, the country played the role of pawn. Regionally, there is no unitary behaviour: in international cooperation (carbon pricing case), it moves like a queen; in the regional integration process (energy integration case), like a king. The current scenario raises doubts about these roles, suggesting that Brazil has been presenting an increasingly moderate and conservative behaviour in the past years.

Abstract:: The agricultural sector is seriously affected by changes in many economic, social, or environmental factors. Hence, the necessity of supporting the sector by governments in various ways has become an indisputable reality. However, regional characteristics must be taken into account in order for these supports to reach their goals. Using a dataset spanning from 2002 to 2020, the current study comparatively analyses the changes in the agricultural support and agricultural production, income, and the value of products in two agricultural regions of Turkey, Central Anatolia and Southeast Anatolia regions. The results highlight that the increase in agricultural income is very low in both regions compared to the substantial changes in agricultural support policies. Additionally, the increase in the values of agricultural products in both regions is much higher than the increase in agricultural income, suggesting that the costs in agricultural activities are too high in the analysed regions.

Abstract:: A condition of underdevelopment has marked the nations of the Global South since the Second World War. The search for development and for economic growth has made countries in the Global South dependent on global markets and international investment, and have made their environment and nature hostage to capitalist exploration. The process of development and of economic growth, coupled with the history of colonization and dependency present violent processes and structures that are source to conflict and instability all over the Global South. This article critically assesses the relationsh ip between underdevelopment and the exploitation of the environment in the Global South and the violent outcomes that it reproduces. It finds that conflict and violence are inherent to the capitalist model of development, instead of anomalies to the system. Abstract:: This study aims to analyze the dynamic effect of renewable energy use and globalization on the environmental quality in Turkey by utilizing quarterly time series data spanning the period 1990- 2017. After identifying the series order of stationarity by utilizing ADF test, this study makes use of SVAR model. The reason is that SVAR is powerful method in testing contemporaneous and past shock among the variables. In addition, SVAR is the powerful in variance decomposition and the possibility of observing long run forecast. The results disclose that environmental quality reacts negatively to the shocks in hydro energy and economic growth, while the globalization seems positively impact the degradation of the environment. These outcomes are consistent with relevant theories and empirical findings. The only striking result is the positive impact of biofuel and waste energy on the environment. Although Turkey has recently implemented a range of energy policies to promote renewables but some challenges still there, future policymaking should enhance the development in renewables and create more competitive environment for investment in the renewables market.

Abstract:: The article’s purpose is the multidimensional analysis of the evolution of Australia and India’s maritime policies and their impact on the endeavors to develop their maritime cooperation in the 21st century. Two research questions are to be answered in that connection: what changes and why India and Australia introduced to enhance their maritime security doctrines in the 21st century and why those changes contributed to the more in-depth cooperation in the second decade of the 21st century. The hypothesis based on those questions argues that not only the rise of China but also global processes in maritime affairs - such as the growing number of state and non-state actors, as well as the interdependence between the fields of human activities at sea - pushed the littorals like India and Australia to turn their maritime strength from coastal to oceanic and convinced them too to cooperate. That process was accompanied by the convergence of the security perceptions by both countries (India and Australia) and the mutual understanding of common interests in all the elements of modern maritime security. The Christian Bueger’s matrix serves as an explanatory framework to highlight the dynamics and broader context of the changes in India and Australia’s maritime security doctrines in the 21st century. It provides the conceptual framework for explaining closer cooperation between these two countries. The article analyzes India and Australia’s maritime strategies, focusing on four variables from Bueger’s matrix: national security, economic development, marine environment, and human security. In those dependent variables, particular elements of their activities serving as sub-variables are highlighted: in national security - shaping the seapower; in economic development - Illegal, Unreported, and Unregulated (IUU) fishing; in the marine environment - climate change mitigation; in human security - the fight against piracy and human trafficking. The choice of the mentioned elements is justified by their role in Australia and India’s activities within maritime strategies and their influence on other elements of the maritime security matrix. The article starts with a description of Bueger’s matrix in the context of the evolution of the maritime security concept in international relations. The second part outlines the centrality of the Indian Ocean in Indian and Australian modern military and economic security. The third part explores and explains the roots of Indian maritime security thinking, and the fourth investigates the evolution in Australia’s attitude toward maritime affairs. The final part presents the developments in Indo-Australian bilateral cooperation in the 21st century.

Abstract:: Prior to the advent of so-called scientific knowledge and systems, indigenous knowledge was the single-most important aspect of human development utilised by communities across the world to sustain their well-being. With the advance of technology, indigenous knowledge is often mistakenly labelled as unscientific, illogical, irrational, traditional and a development impediment.1 Such conceptions of indigenous knowledge resulted in the favouring of scientifically driven approaches, which are mainly Eurocentric, as the main solutions to the development–democracy challenges of underdeveloped nations. Indigenous knowledge is also usually viewed as valueless to sustainable development. Consequently, newly independent states in Africa, South America and Asia have followed the adoption of a “one-fits-all” approach to development. Unfortunately, the adoption of foreign-born and -grown development and democracy models without integration into indigenous development and values creates political and development uncertainties in Third World countries. Policymakers and development planners have thus failed to achieve sustainable development. A dependency syndrome of developing states on Western fabricated development models has thus emerged. Nevertheless, the last three decades have witnessed a paradigm shift from the total sidelining of indigenous knowledge to the importance of promoting, empowering and linking it to solutions. A new area of interest is indigenous natural resource management mechanisms. As mentioned previously, conservationists and policymakers downgraded indigenous resource management mechanisms. According to Zelealem and Williams:2 “[R]ecent interest by conservationists in indigenous resource management systems, however, has arisen from the failure of many other types of conservation initiatives and the search for viable and sustainable alternatives to current models for managing resource use.” In this regard, Ethiopia is very rich in indigenous knowledge systems, practice, knowledge creation (such as Qine), architecture, medicine, agriculture, cottage industry, conflict resolution, governance, natural resource management mechanisms, terracing experience (of the Konso people) and building (of houses from stone in North Shewa and Tigray). However, these indigenous knowledge systems and practices are not systematically identified, studied, documented and utilised in a manner that meets sustainable development goals and improves quality of life. The indigenous knowledge system in Ethiopia is an unseen, underutilised and neglected resource with incomparable potential for development.

Abstract:: Traditional economic growth models damage natural resources to which humanity depends, causing important environmental, social and economic problems, especially climate change. Today, it is understood by countries that a new growth approach should be applied in order to ensure the sustainable use of scarce natural resources, combatting negative effects of climate change and reduce poverty while realizing economic development. The view that environmentally friendly investments aren’t cost effective is changing and countries want to take advantage of the opportunities offered by green growth. However, this process also requires a just transition. The aim of this study is to evaluate green growth, just transition and decent work concepts in the context of sustainable development and combatting climate change. In the study, it is concluded that if green growth and just transition processes are well managed, they provide significant opportunities for realizing UN-SDGs, combatting climate change and the creation of decent works.

Abstract:: THe RAPID DeVeLOPMeNT of the nuclear industry in the 20th cen- tury, the widespread use of radioactive isotopes in medicine and in mili- tary programs, the usage of nuclear submarines, as well as the operation of radiochemical plants, factories, nuclear power plants, and scientific research centers all around the world are accompanied by a constant accu- mulation of radioactive waste (RW) and spent nuclear fuel (SF). Mishandling of RW and SF could possibly inflict significant damage on the whole planet, not merely a single nation. Thus, the question of plac- ing RW and SF in storage is the main component of an environmental issue shared by the whole planet due to the use of nuclear energy. Disposal of RW is a touchy issue for any nation that has a nuclear industry. Handling RW and SF – i.e., obtaining them, ensuring safe and final safe isolation (disposal), transportation, warehousing, and storage – all require specific legal regulation and control, on the part of both the state and the international community via international organizations. What is most crucial are the actions of specific individuals, companies, transnational corporations (TNCs), state corporations and state entities, and international organizations (eURATOM, IAeA, UN, CIS), as well as laws and juridical acts on the national level and international treaties.

Abstract:: The aim of this article is to examine two treaties which are often presented by scholars as potential models for a maritime regime in the South China Sea, namely the Svalbard Treaty and the Antarctic Treaty System. The work concludes that even though both of the treaties have resolved equally complex territorial disputes, their importance as a role model for the SCS is limited due to the unique political condition in the Asia-Pacific. However, the solutions within the sphere of environmental protection and the structure of decision-making institutions developed by the abovementioned treaties present a valuable lesson and a potential example for the countries involved in the South China Sea dispute to emulate. The article argues that cooperation within environmental protection and fisheries management, as a low-profile endeavour, is easier to be put into practice than the joint development of highly contested hydrocarbon resources of the SCS. Furthermore, it can potentially lay foundation for the future high profile collaboration. The paper also presents a model of a maritime regime for the South China Sea.

43. Enhancing the Protection of the Environment in Relation to Armed Conflicts – the Draft Principles of the International Law Commission and Beyond

Abstract:: n 2011, the UN International Law Commission (ILC) took up the topic Protection of the Environment in Relation to Armed Conflicts.1 The decision was triggered by a joint report issued by the UN Environment Programme and the Environmental Law Institute in 2009 recommending the ILC to “[...] examine the existing international law for protecting the environment during armed conflicts [...] [including] how it can be clarified, codified and expanded [...]”.2 Since the inclusion of the item on the ILC’s agenda, the Commission has published five reports3 by the two special rapporteurs, Dr. Marie Jacobsson (2011-2016) and Dr. Marja Lehto (2017-). In 2019, the plenary adopted 28 Draft Principles on first reading.4 The ILC has touched on highly controversial issues such as reprisals,5 corporate liability,6 indigenous peoples’ rights,7 among others. Nevertheless, it was clear from the beginning that the ILC would not be able to exhaustively deal with the topic for two main reasons. First, the Commission has a limited mandate that is restricted to “[...] initiate studies and make recommendations for the purpose of [...] encouraging the progressive development of international law and its codification [...]”.8 Enhanced legal protection of the environment, as one of the purposes of the Draft Principles,9 must therefore be based on existing customary international law and its progressive development. The Commission decided to also include recommendations to account for the uncertain legal status of some of the Draft Principles.10 Second, some related issues touch upon controversial and political matters, as mentioned earlier. Consequently, the ILC has been reluctant to include some of these issues in its workflow.11 Therefore, the adoption of the Draft Principles should be regarded as a starting point for shaping and developing the legal framework for environmental protection in relation to armed conflicts. As a part of that process, Hamburg University and Lund University organized an international workshop in March 2019 in Hamburg. Several members of the ILC, including two special rapporteurs, academic legal experts, and practitioners, attended the workshop to discuss the Draft Principles. The discussion also focused on some issues not covered by the ILC, such as the implications for gender and climate security. The engaging dialogue in Hamburg has inspired the publication of this Special Issue of the Goettingen Journal of International Law (GoJIL) to ensure that the outcomes and ideas of the workshop reach a wider audience. It has also contributed to maintaining the momentum of this topical area of international law by inviting contributions from researchers not present during the workshop in Hamburg.12

Abstract:: The paper examines the concept of belligerent reprisals and assesses the legality of attacking the environment by way of reprisals. The instances of lawful recourse to reprisals have been considerably limited, since their application is either explicitly prohibited against certain protected persons and objects, including against the natural environment, or is subject to stringent conditions according to customary International Humanitarian Law (IHL). Despite its narrowing scope, the doctrine of reprisals remains a valid concept under the existing legal framework. For one, the state of affairs under customary international law with respect to reprisals directed at civilian objects (including against parts of the environment), subject to certain rigorous conditions, remains unclear. To complicate matters even further, any proposition on the status of reprisals in the context of a non-international armed conflict (NIAC) is shrouded in controversy, as there is no relevant treaty provision. In this regard, the present author endorses the approach espoused in the International Committee of the Red Cross (ICRC) Study on Customary IHL, namely to altogether prohibit resort to reprisals in the context of a NIAC. Turning to the status of reprisals against the natural environment under customary IHL, it is argued that a prohibition of attacks against the natural environment by way of reprisals is in the process of formation with respect to the use of weapons other than nuclear ones. All things considered, the International Law Commission (ILC) was confronted with an uncomfortable situation in the context of its work on the ‘Protection of the Environment in Relation to Armed Conflicts’. By sticking to the verbatim reproduction of Article 55(2) of Additional Protocol I, the ILC chose the proper course of action, since any other formulation would not only undercut a significant treaty provision, but might also result in the normative standard of conduct being lowered.

Abstract:: It has often been cited that major armed conflicts (>1,000 casualties) afflicted two-thirds (23) of the world’s recognized biodiversity hotspots between 1950 and 2000.1 In 2011, the International Law Commission (ILC) included in its long-term work program Protection of the Environment in Relation to Armed Conflict.2 This led to the adoption of twenty-eight Draft Principles, including designation of protected zones where attacks against the environment are prohibited during armed conflict.3 Protected zone designations apply to places of major environmental and cultural importance, requiring that they “[...] shall be protected against any attack, as long as it does not contain a military objective.”4 Most research on armed conflict and protected areas has focused on impacts to wildlife and less on how to protect these natural habitats from the ravages of armed conflict.5 This article highlights some of the gaps in the ILC Draft Principles towards protecting protected zones in bello. It uses transboundary protected areas (TBPAs) formalized through multilateral agreements to illustrate challenges on the ground. TBPAs are internationally designated “[...] protected areas that are ecologically connected across one or more international boundaries [...]” and sometimes even established for their promotion of peace (i.e., Parks for Peace).6 There is little legal research on how to design TBPA agreements for conflict resilience, conflict sensitivity, and ultimately positive peace.7 The research draws from two case studies in Africa’s Great Rift Valley: the Greater Virunga Landscape (GVL) between the Democratic Republic of the Congo (DRC), Rwanda, and Uganda, and the Kidepo Landscape, which forms part of the broader Landscapes for Peace initiative between South Sudan and Uganda. Both suffer from armed conflicts of various types and present two of the only TBPAs in the world that have incorporated environmental peacebuilding into their transboundary agreements.8 The case studies illustrate different approaches to TBPA design and the pros and cons of each modality in the context of conflict resilience and conflict sensitivity. This guides us on how to better protect protected areas in bello, ensuring that protected zones endure on the ground and not just in principle.

Abstract:: The protection of the environment in relation to armed conflict, in particular during armed conflict is a complex problem as it involves at least two different fields of international law, the law of armed conflict (international humanitarian law) and international environmental law. Their mutual relationship is a delicate issue. International humanitarian law is not necessarily lex specialis. Three principles deserve particular attention in this connection: as to general international environmental law, the principle of prevention and the precautionary principle, as to international humanitarian law the duty to take precautions. The terms prevention and precaution are used in different contexts in environmental law (both national and international) and in the law of armed conflict. The duty, imposed by international humanitarian law, to take precautions has much in common with, but must be distinguished from, the precautionary approach of general environmental law. This paper shows what these principles mean and how they relate to each other. It answers the question to what extent the rules based on these concepts are effective in restraining environmental damage being caused by military activities. The application of these principles in peace and war serves intergenerational equity and is thus an important element of sustainable development.

Abstract:: This paper concentrates on a particular example of cooperation between European cities and indigenous peoples of the Amazon river basin, namely that of Climate Alliance. The New Urban Agenda adopted at the UN Habitat III conference in October 2016 emphasizes that cities and other human settlements should meet the challenges and take advantage of the opportunities for current and future sustainable and economic inclusive development. Cities should also take measures to address climate change and protect and manage their ecosystems, water resources, the environment and biodiversity. Indigenous peoples, just like cities play a crucial role in the fight against climate change. 80 % of the territories with high biodiversity level are indigenous lands. Their indigenous ecological knowledge may serve as a valuable tool in initiatives aimed at fighting climate change. The aim of the paper is to show whether there are any benefits of such cooperation and what is its significance in the fight against climate change. The main research question is: what are the forms of cooperation between European cities and Amazonian indigenous peoples in the framework of Climate Alliance? In which way can European cities support indigenous peoples in their fight for their rights and consequently for the nature’s preservation? The hypothesis is that European cities may learn from indigenous peoples of the Amazon how to combat climate change.

Abstract:: Scientific prognoses have shown that by the year 2100, several low-lying island states such as Tuvalu and Kiribati will disappear due to rising sea levels. The submergence of whole territories will have consequences including the displacement of a huge number of islanders. In that context, the question of how to protect their human rights in their future host states is of great importance. In fact, their human rights protection will most likely prove even more difficult if disappearing island states are considered to have lost statehood. Without the nationality of any state, those displaced islanders will be stateless under international law. In this article, the author assesses whether displaced island populations are sufficiently protected by existing international law norms or whether the international community is called upon to create new rules addressing these future challenges.

Abstract:: The problem of human-wildlife conflict (HWC) in Africa – meaning the interaction between humans and wildlife that results in negative effects for both humans and wildlife – poses risks to the preservation of livelihoods as well as wildlife conservation. HWC affects the food security of people, it decreases their physical and psychological well-being and increases their workload.1 In Botswana, for example, where the largest concentration of elephants on the continent can be found (estimated at 126 114 in October 2018),2 the significant number of elephants is not only putting pressure on the ecosystem, but has also led to increased HWC. The wildlife numbers pose a threat to human life, with official statistics indicating that between February 2018 and June 2019, 20 deaths by elephants and several injuries were recorded.3 Elephants encroach on communities, not only killing people but also destroying crops, thereby impoverishing the rural communities who rely on farming for their livelihood. Hidden costs in the form of diminished psychosocial well-being and disrupted social activities raise additional concerns.

Abstract:: The protracted conflict since 2003 in Darfur, Sudan, has resulted in massive loss of human lives and assets, disrupted livelihoods and led to severe food insecurity in some areas. Some 1.6 million internally displaced persons (IDPs) are registered as living in camps. For unregistered IDPs – that is, displaced people living in rural settlements and urban areas – estimates vary considerably, especially as there is no systematic registration of displacement outside of camps.1 IDPs and their host communities have limited livelihood options and often rely on unsustainable coping strategies, such as unmanaged cutting of trees and shrubs for fuelwood and charcoal production. This places an additional burden on Darfur’s fragile ecosystem and related livelihoods.2

Abstract:: Transnational networks of non-state actors are using ILO Convention No. 169 as a powerful instrument of environmental governance. The treaty promotes the norm of Free, Prior and Informed Consultation (FPIC), empowering local communities to influence infrastructure projects that impact their livelihoods and natural resources. However, there is a disconnect between the Brazilian government’s discourse and the effective implementation of this norm. Using document analysis and process tracing, this article investigates this rhetoric-practice gap. It argues that these transnational networks are diffusing the FPIC norm through Consultation Protocols, slowly bridging the gap.

Abstract:: Four years after the Paris Agreement, atmospheric carbon dioxide (CO2) concentration continues to rise at the same speed as it did before, reflecting unabated growth in global CO2 emissions. In the meantime, CO2 concentration reached 415 parts per million (ppm), a level not found on Earth for15 million years, since the Miocene era, when the average global temperature was at least 4 degrees Celsius higher and sea levels were at least 25 meters higher than today. Further rises in global temperature are unavoidable. The speed and maximum reached will, however, depend on how successful humankind is in achieving carbon neutrality within the coming years and decades. Many cities and towns, especially in subtropical and tropical climate zones, are already being confronted with the devastating effects of climate instability manifested in more frequent, widespread or intense droughts, wildfires, floods, heatwaves, storms and other phenomena, which lead to crop failure, water scarcity, economic devastation and socio-political and security instability. Cities and towns in Europe and other moderate climate regions will soon be confronted with similar situations, and these will make it difficult to fulfil the needs at the base of the Maslow pyramid of human needs. Now is the time for deep climate adaptation and resilience building, while European societies are still rich and stable. The failure to understand the causes and consequences of the climate crisis brings with it the risk of widespread disasters, including the potential collapse of urban centers.

Abstract:: This paper explores the engagement and mobilization of an affluent community in relation to a known environmental hazard. It extends our understanding of individual responses to environmental risk and provides at least one response to the long-unanswered question: how would affluent communities respond to hazardous sites? Despite the contention that these resource-rich communities will respond differently than the less affluent communities that traditionally have these environmental hazards, we find no meaningful difference in their mobilization and engagement. Despite their perception of risk associated with the Ascon landfill in Huntington Beach and relatively little trust in government to clean up the site, the community is largely unwilling to engage in activities related to site cleanup. This is an important contribution to our understanding of what generates individual action for environmental hazards and compels us to re-examine our understanding of what (if any) role socio-economic status plays in an individual’s response.

And climate change is just one of about five topics I talked about in that book, but it's a particularly useful case to make the main point of the book, and that is that it's not enough in these days to talk about rights. Analizlerde yatay kesit bağımlılığını dikkate alan ikinci nesil testler tercih edilmiştir. Çalışma sonuçlarına göre çevre kirliliği ve çevre koruma harcamaları arasında uzun dönemde eşbütünleşme ilişkisi vardır. Bununla birlikte, çevre koruma harcamalarından çevre kirliliğine bir nedensellik ilişkisi söz konusudur.

While environmentalists have sounded the alarm about the risks to the environment in the region, there is an ever-growing security danger that faces the Arctic. With ice caps melting and retreating to unprecedented levels, the arctic seabed is now open for nations to explore its reported vast amount of natural resources. This article will identify issues that will shape the twenty-first century of the Arctic. The scope of the article is not meant to be exhaustive of the problems and challenges but offer a thematic overview of the problems. There are three broad categories covered in this article. Crucially, they divert attention from several uncomfortable truths with profound policy implications: First is that the nexus of militancy in wildlife trafficking constitutes only a sliver of the global wildlife trade and countering it will not resolve the global poaching crisis. Second, counterterrorism and counterinsurgency forces, even recipients of international assistance, also poach and smuggle wildlife and use anti-poaching and counterterrorism efforts as covers for displacement of local populations and land grabbing. Third, corruption among government officials, agencies, and rangers has far more profound effects on the extent of poaching and wildlife trafficking. And finally, local communities are often willing participants in the global illegal wildlife trade.

65. Conflict Implications of Coal Mining and Environmental Pollution in South Africa

Abstract:: Globally, mining and combustion of fossil fuels, especially coal, have resulted in various environmental problems. The adverse effects of these industries on human health, agriculture and the general ecosystem, and how they could result in conflict, have been widely reported. Firstly, this study examines the current state of environmental pollution at a few places in South Africa, and how it could possibly result in environmental conflict between the affected communities and the polluting industries. Secondly, using Nigeria as a case study, it suggests pre-emptive measures that can be taken to forestall such conflict. The issues raised in this study are supported by findings from previous studies conducted at Emalahleni, in the Mpumalanga Province of South Africa. This study used a mixed-methods approach involving interviews with relevant stakeholders and scientific analysis to prove the levels of pollution in the Emalahleni area. The levels of certain air pollutants which are commonly linked with coal combustion and mining activities were assessed at five different schools around mines. Based on these scientific and qualitative results and other issues raised in this study, a number of recommendations are made. It was found that air pollution is a problem which cannot be ignored and immediate action should be taken to avoid future problems.

66. An Opportunity for President Trump to Lead

Abstract:: Every day, in countries around the planet, government employees are working on plans that will reduce greenhouse emissions, as each nation promised to do at the 2015 United Nations Climate Change Conference in Paris. Here in Washington? No one has such an assignment. Global leadership used to be an American staple. In fact, we were in the vanguard a couple of years ago when 195 nations assembled in Paris to finalize the climate change accord. In a 180-degree reversal, President Donald Trump opted to withdraw from this pact. But since the rules do not allow that withdrawal to become official until November 4, 2020, there is time for our government to regain its leadership role as the world struggles to meet this fundamental challenge. And the President can do so in a way that strengthens the global competitiveness of the U.S. economy. How? Ask almost any economist what is the quickest, most efficient and least expensive way to reduce greenhouse gas emissions, and he or she will say, “a carbon tax.” Carbon has benefited from a subsidy from day one. Yes, fossil fuels have played a critical role in U.S. prosperity, but they also have driven up the rates and severity of lung cancer, asthma, heart disease and other ailments. In addition, they are the leading cause of climate change, which scientists have concluded is running up the frequency and intensity of wildfires, superstorms and other natural disasters. Yet the price we pay for carbon does not cover any of these costs; all of us pick up that tab. If the price of carbon incorporated such costs, then clean energy sources such as the wind, the sun and nuclear energy could compete on a level playing field. It is true that tax incentives have helped renewable sources develop, and loan guarantees have helped nuclear energy, but each has had less help than fossil fuels have received in direct and indirect subsidies. And yet despite the unlevel playing field, renewables have been a tremendous source of job growth in recent years. Solar now employs over 260,000 in the United States, enjoying a double-digit rate of growth in recent years, and wind energy employs over 100,000. Wind already provides 30 percent of Kansas’ electricity. Though Governor Sam Brownback is a longtime member of the GOP’s right flank, he is a true believer in renewables. Wind energy has drawn $7 billion in capital investment to the state and supports, directly or indirectly, 5,000 to 6,000 jobs.

67. Getting to Know Jane Goodall

Abstract:: My wife Barbara and I, and our children, were fortunate to work closely with Dr. Jane Goodall during our 1987-1991 tour in the Democratic Republic of the Congo (DRC). In 1989 Goodall called on Secretary of State James Baker in order to enlist him in her new cause of trying to save chimpanzees in the wild. After discussing her many years of groundbreaking chimpanzee research in Gombe, Tanzania, Goodall explained that, in addition to destruction of habitat, a major problem was the bushmeat trade. She noted that ten adult chimps were killed in the wild protecting every infant captured, and only one out of ten infant chimps survived the journey to the marketplace after being taken from their mothers. Secretary Baker offered the Department’s assistance to her effort. As the largest chimpanzee population was in the DRC, Kinshasa was her first stop in this new endeavor.

At CNA, Goodman also served as Senior Vice President and General Counsel and was the founder and Executive Director of the CNA Military Advisory Board, whose landmark reports include National Security and the Threat of Climate Change (2007), and National Security and the Accelerating Risks of Climate Change (2014), Advanced Energy and US National Security (2017), and The Role of Water Stress in Instability and Conflict (2017), among others. Previously, she served as the President and CEO of the Consortium for Ocean Leadership. From 1993-2001, Goodman served as the first Deputy Undersecretary of Defense (Environmental Security).

Abstract:: This paper analyses the gendered organisational practices of Environmental Non-Governmental Organisations (ENGOs) in the United Kingdom (UK) and Turkey and the possible outcomes of these practices on gender compositions in senior roles. Since gender is an important element in organisations, it is expected to have implications for policies of ENGOs. The research on which this paper is based was undertaken as part of a Ph.D. which examined the gendered nature of ENGOs in Turkey and the UK. The research revealed how and why ENGOs are gendered especially in positions of power and influence. This is an important question because of pressure groups’ influence on environmental decision-making, and yet it has largely been neglected until now. This research revealed that while the ENGO sector is dominated by young single middle-class female employees, white, middle class men are in charge of the decision-making. It showed that the ENGOs reflect the rest of the society and its dominant patriarchal values. The research concluded that gender-biased working practices such as culture of long working hours, lack of formal recruitment and promotion procedures and short-term contract work relations limit career progression of women. This is due to the gendered roles and the traditional division of work in society (the gender division of labour), where triple workload of women remains invisible as a result of patriarchal and capitalist relations existing in both societies.

71. Domestic Politics and the Design of International Institutions

Abstract:: Scholars are increasing focused on how and why states design international institutions. International relations theories have historically guided research on these institutions, but have not provided adequate insights into the theoretical bases for their design. Rationalists’ theories of domestic politics offer an alternative approach to understanding institutional design. This study utilizes the positive theory of public bureaucracies to examine the design of an international institution, the North American Commission on Environmental Cooperation (CEC), and contends that the institutional choices states make are ultimately strategic choices about anticipated institutional outcomes. Research results demonstrate that institutional choices for bureaucratic structure, organizational mandates, and decision-making authorities for CEC are consistent with the theory of public bureaucracies. Politicians, interest groups, and bureaucrats sought or supported specific institutional features that were driven by their preference for the content and direction of policy that would emerge out of the institution.
