Abstract:: At the opening of the COP27 summit in Sharm el-Sheikh, Egypt, on November 7, 2022, United Nations Secretary General Antonio Guterres told the representatives of the countries attending that they faced a choice: work together to cut greenhouse gas emissions or condemn the planet to climate catastrophe. “Humanity has a choice,” Guterres said. “Cooperate or perish. We are on a highway to climate hell with our foot on the accelerator.” Guterres called for the world’s richest and poorest countries to work together to speed up the transition from fossil fuels, and for the wealthy to help with funding to enable poor countries reduce emissions and deal with the negative impacts that they have already suffered due to climate change. “The two largest economies—the United States and China—have a particular responsibility to join efforts to make this pact a reality,” he went on to say. Left unsaid, but understood by most, is that China and the U.S. are also the world’s two largest emitters of greenhouse gases. While the U.S. and much of the rest of the world are still preoccupied with Russia’s invasion of Ukraine, rampant inflation, energy shortages, and the fallout from the Covid pandemic, the existential problem of climate change cannot be ignored.

Abstract:: People around the world are experiencing first-hand the growing impacts of climate change – more frequent and destructive hurricanes in Florida and the U.S. Gulf coast; devastating floods in Pakistan; accelerated melting of glaciers in the poles and mountain ranges around the world, to name just a few. The science confirms these trends, but the world is still not doing enough to combat climate change. In this article, I will describe where we are in global efforts to limit global warming; the important role of the private sector in those efforts; the vital role U.S. and other diplomats are playing to catalyze action; and how we might better institutionalize climate diplomacy at the State Department.

Abstract:: The coronavirus pandemic has caused far-reaching precautionary measures around the world. Governments’ attempts to get the coronavirus under control have led to the negligence of other important policy areas. Climate policy in particular has been significantly influenced and lost importance on the political agendas of states after the outbreak. Over time, the coronavirus will either disappear or lose its initial impact due to medical measures. Two years after the outbreak of the coronavirus, this paper aims to analyse and evaluate the short-term and long-term impacts of the coronavirus crisis on international climate policy. It is important to analyse how it has shaped international climate policy and what lessons can be learned for dealing with climate change. The analysis is based on the principles and regular functioning of the International Climate Change Regime.

Abstract:: This paper attempts to analyze the political uncertainty surrounding environmental degradation by means of utilizing the game theoretical model. It challenges the popular opinion that views the political exchanges over climate change as a super game where players will eventually learn to cooperate through repeated interactions. Instead the paper argues that the climate change problem is essentially a case of ‘one-shot prisoner’s dilemma’ irrespective of the number of times the players interact with one another. To demonstrate the one-shot prisoner’s dilemma at play, it employs the comparative method to explain the climate politics between the major polluters of the world (US, China, Brazil and India). The debate is analyzed at two distinct levels: Intergenerational and Intragenerational level. Lastly, the paper notes the significance of ‘the immediate threat factor’, which it argues poses a fundamental challenge to the political resolution of the climate change problem.

5. PLAN E: A Grand Strategy for the Twenty-first Century Era of Entangled Security and Hyperthreats

Abstract:: A transdisciplinary research project investigated the idea of framing climate and environmental change (CEC) as a new type of threat: a hyperthreat. Traditional military analytical methods were used to assess the hyperthreat and its context and develop ideas about how an adequate response could be conceived. This approach contrasts to prior literature and longstanding geopolitical discourse that identify the risks of taking a securitization approach. Instead, the author argues that it is now riskier not to consider CEC within a mainstream geopolitical and nation-state security strategy. When the hyperthreat of CEC is centered as the main threat to be contained, and its relationship to other threats is analyzed, startling new pathways to stability emerge. The research developed a new theoretical approach called “entangled security” to develop an initial new “grand narrative” and “grand strategy” (PLAN E). This article offers a vision of how military theory can be reimagined to support new policy directions and security priorities.

Abstract:: This article draws attention to the need of a reform of the environmental protection by means of international criminal law as enshrined in the Rome Statute of the International Criminal Court. After giving a short overview of the contemporary environmental protection in war- and peacetime offered by international criminal law, it becomes clear that international criminal law fails to succeed at offering sufficient environmental protection. This paper outlines that there is no convincing reason for a differentiated approach in international criminal law to environmental damage in wartime and in peacetime, and that a shift from an anthropocentric to an ecocentric approach would positively contribute to a more effective protection of the environment. It is therefore argued for the introduction of a new integral and ecocentric international crime against the environment in the Rome Statute. The paper then elaborates on existing proposals on such a new crime against the environment before some proper observations on the exact contours of the crime are made. A focus lies on the new crime’s threshold of seriousness as well as on the necessary mens rea requirements. The insufficiency of the contemporary legal framework and the merits of a new crime against the environment are exemplified by an archetype example of peacetime environmental damage, the Chevron/Texaco oil spill scenario in Ecuador.

Abstract:: Issues concerning global climate change – by objective criteria, one of the most serious environmental threats of our time – have for many years been filling the top slots of the international agenda, and the political tem- perature of debates on this topic remains at the highest degree. Soon a new milestone will be reached on the thorny path of the inter- national climate process: on December 31, 2020, the Doha Amendment to the kyoto Protocol of the united nations Framework Convention on Climate Change (unFCCC) comes into force.1 this document extends the time frame of the kyoto Protocol from 2013 to 2020 (hence its unofficial title, kyoto-2) and contains a whole set of amendments to the kyoto guidelines, including updated quantitative criteria for greenhouse gas emission reductions for developed countries. Climate activists will probably schedule their next mass marches for this date, in order to mark this "historic" stage in the fight against global warming. Leaders from a number of states are expected to make bold new calls to “set the bar high” for the sake of averting a global climate col- lapse. But what remains hidden behind the scenes? Abstract:: The climate-security century is here. With global temperatures rising, climate change is poised to massively destabilize the physical environment. This century may well be defined by our ability (or inability) to reduce our collective greenhouse gas emissions. We must also adapt and respond to climate change’s multivariate security impacts. From raging wildfires in Australia and California to melting ice sheets and permafrost in the Arctic, climate change acts as both a threat accelerant and a catalyst for conflict. Climate change is also unlike any other traditional security threat. It accelerates and exacerbates existing environmental stressors—such as sea level rise, extreme weather, drought, and food insecurity—leading to greater instability. Climate change impacts are already taking center stage this century, forcing us to think more broadly about climate change’s relationship with human security and national security. Complicating matters, climate-driven temperature increases do not rise in a neat, uniform fashion around the globe. The pace of climatic change unfolds unevenly and erratically. Some parts of the world—such as the Arctic—are warming at a rate two to three times faster than the rest of the world. Three specific climate-security “hotspots” foreshadow greater destabilization and serve as climate “canaries in a coal mine”—a sneak preview of our climate-destabilized future.

18. Impact of Institutions in the Aftermath of Natural Disasters

Abstract:: The number and impact of natural disasters are increasing because of climate change and more people living in urban areas (Sanderson and Sharma 2016). The mechanism is simple, at least when considering climatic events: higher temperatures lead to higher rates of water evaporation, which increases the chance of flooding events (Wallace et al. 2014; IPCC 2001). The number of hot days has increased and the number of cold days has decreased in land areas, with model projections indicating that extreme precipitation events will continue to increase, resulting in more floods and landslides. At the same time, mid‐continental areas will get dryer, which will increase the chance of droughts and wildfires (Van Aalst 2006). The course of action taken by humanity in the next decades will likely play a pivotal role since extreme differences in projections are expected if global temperatures rise 2°C in comparison to 1.5 °C above preindustrial levels (Allen et al. 2019). What are the economic impacts of natural disasters? This question has been addressed to a large extent in the literature, but it still does not have a conclusive response. The seemingly natural reasoning that destruction cannot lead to a net benefit for society was explained almost two centuries ago by Bastiat (1850) in his famous broken window fallacy. A shopkeeper’s son, Bastiat relates, breaks a pane of glass in his father’s store. The father, angry due to the boy’s careless action, is offered consolation by the spectators, who claim that the event is positive for the economy since it provides labor to glaziers. While Bastiat acknowledges that the accident brings trade to the glazier since the shopkeeper has to replace the window, regarding the event as wealth‐increasing conveys a narrow perspective. The shopkeeper ends up poorer since he cannot spend the same money elsewhere, and if the boy had not broken the window, then the labor and other materials that were used to repair the damage would have been used elsewhere, potentially making the tangible wealth of the community grow.

Abstract:: In light of the science and evidence on hazards and climate risk, and the scale and breadth of large-scale disasters witnessed around the world, it is time for states and other actors to begin developing national and local frameworks on planned relocation. While planned relocations have had a poor record in terms of their socioeconomic effects, it is precisely for these reasons that proactive action is necessary. Planned relocation has the potential to save lives and assets, and consequently to safeguard or augment the human security of populations living in areas at high risk for disasters and the effects of climate change. Among the challenges hampering better outcomes for people, however, are the lack of national and local frameworks, community-driven decision making, and sufficient lead times to plan and implement appropriate interventions that promote human security. Relocation of populations is referenced in global frameworks on disaster risk reduction (DRR) and climate change adaptation (CCA) because it is a tool that will become increasingly important as a preventive and responsive measure to reduce the risks of disasters and displacement. This article recommends that national and local DRR and CCA strategies and development plans begin to incorporate planned relocation among the options under consideration to protect people and their human security. It argues that planning for relocations is an expression of a government’s responsibility to protect the human security of its people.

Abstract:: The phenomenon of climate change, observed for years and constantly intensifying, has had a negative impact on health, significantly deteriorating the quality of life of people in many regions of the world, including Poland. Already now we are dealing with increasingly frequent extreme weather phenomena; hurricanes, storms and increasingly longer heat waves no longer surprise us. Unfortunately, this is merely the beginning of the negative effects of climate change. Others will come before long. In the coming years, many other new threats will be observed, such as flooding of ocean islands, desertification of areas exposed to water scarcity or serious loss of biodiversity, which will translate into food security. Unfortunately, it does not end there.1 The greenhouse effect is a process by which radiation from the Earth’s atmosphere warms the planet’s surface to a temperature above what it would be without this atmosphere. We can differentiate short-term solar radiation (0.15-4.0 nm) and long-term radiation. Thermal radiation escapes into the cosmic sphere and heat radiation returns to the ground, being stopped by a layer of GHG – greenhouse gases (CO2, CH4, N2O, SF6, water vapor etc.), which warm up Earth’s athmosphere to a dangerous level – even a 1°C degree increase (in comparison to pre-industrial level, when emissions stared to rise) in the average world temperature can be detrimental to human health and change the conditions of life on this planet (Figure 1). However, we currently face a risk of global warming even up to 3°C degrees, unless GHG emissions are significantly reduced. Any further rise of the global temperature will have deteriorating impact on people and whole humanity, as well as staying at the current level of emissions.

Abstract:: Traditional economic growth models damage natural resources to which humanity depends, causing important environmental, social and economic problems, especially climate change. Today, it is understood by countries that a new growth approach should be applied in order to ensure the sustainable use of scarce natural resources, combatting negative effects of climate change and reduce poverty while realizing economic development. The view that environmentally friendly investments aren’t cost effective is changing and countries want to take advantage of the opportunities offered by green growth. However, this process also requires a just transition. The aim of this study is to evaluate green growth, just transition and decent work concepts in the context of sustainable development and combatting climate change. In the study, it is concluded that if green growth and just transition processes are well managed, they provide significant opportunities for realizing UN-SDGs, combatting climate change and the creation of decent works.

Abstract:: Abundant affordable energy has built the world in which we live today. Machines and the chemical energy that drives them have made it possible for a small percentage of the population to produce enough food for many of us to be scientists, engineers, artists, and authors. We are only able to pursue our diverse interests because available energy multiplies human effort many times over. With all the good that has come with access to energy resources extracted from the Earth, there is also an environmental price, which impacts our land, water, and air. My intent here is not to debate the merits of our current energy system; it is the reality in which we exist. Humans and human society have become de- pendent on energy in so many ways that we cannot simply undo what we have and flip overnight to alternatives that we believe preserve the benefits without the costs. The scale of our global energy use is enormous, and the infrastruc- ture we have built to deliver that energy and convert it to useful work has been developed over more than a century. It will realistically take several decades for energy alternatives to grow to replace the major sources of primary energy that we utilize today; similarly, it will take many decades to rebuild our energy infrastructure to efficiently utilize new sources of primary energy.1

Abstract:: The article concludes that all proposals for funding climate action through entities created under the UNFCCC should be screened according to the gender policies and plans of the climate funds, including the GEF and the GCF, and the results should be available publicly to provide transparency and build trust and accountability. Broader inclusion of women in decision-making and the requirement of evidence of a gender perspective prior to approving financing for climate change projects will contribute to the normative element of sustainable development and its implementation. The intersection of gender justice and climate justice in reducing the dangerous effects of climate change means allocating adequate financial resources to women leaders and projects generated and administered by women at international, regional, national and local levels, for large and small projects and programs alike.

Abstract:: Scientific prognoses have shown that by the year 2100, several low-lying island states such as Tuvalu and Kiribati will disappear due to rising sea levels. The submergence of whole territories will have consequences including the displacement of a huge number of islanders. In that context, the question of how to protect their human rights in their future host states is of great importance. In fact, their human rights protection will most likely prove even more difficult if disappearing island states are considered to have lost statehood. Without the nationality of any state, those displaced islanders will be stateless under international law. In this article, the author assesses whether displaced island populations are sufficiently protected by existing international law norms or whether the international community is called upon to create new rules addressing these future challenges.

Bu çalışmada, çevre koruma harcamaları ve çevre kirliliği arasındaki ilişki yüksek gelir grubundaki 23 OECD ülkesi için incelenmektedir. 1995-2017 dönemine ait yıllık veriler kullanılarak panel veri analizi gerçekleştirilmiştir. Analizlerde yatay kesit bağımlılığını dikkate alan ikinci nesil testler tercih edilmiştir. Çalışma sonuçlarına göre çevre kirliliği ve çevre koruma harcamaları arasında uzun dönemde eşbütünleşme ilişkisi vardır. Bununla birlikte, çevre koruma harcamalarından çevre kirliliğine bir nedensellik ilişkisi söz konusudur.

Abstract:: The end of the Cold War coincided with the beginning of global awareness about the risks of climate change. This paper analyzes a thirty-year period beginning with the establishment of the Intergovernmental Panel on Climate Change (IPCC) in 1988 and the fall of the Berlin Wall in 1989, and ending in the present year of 2018. This period is characterized by unprecedented social, political, economic and climatic shifts, as well as first-time technological change-including improvements in our ability to predict future changes in the climate and their implications for international security.1 Importantly, while some of these changes have caught the international security community off-guard, we have seen the climate risks coming for many decades. The combination of unprecedented risks and foresight underscore a “Responsibility to Prepare.” This involves taking all possible steps to avoid an unmanageable climate, and climate-proofing of our security institutions at national, regional and international levels.

Abstract:: The European Union (EU) has increasingly interconnected energy and climate policy, with the formulation of the Energy Union as one notable — if yet incomplete — step in this direction. In addition to the linkages between energy policy and efforts to reduce greenhouse gas emissions to meet climate goals under the Paris Agreement, the EU has been increasingly vocal about the link between climate and security, and under- taken (at least rhetorical) efforts to incorporate climate security concerns into broader externally focused policy areas. This shift toward a focus on climate security, however, raises questions of how energy security and climate security relate, the impact of the former on the latter, and how the Energy Union fits into this shift, as well as how the EU characterizes climate risk and how this relates to geopolitical risks in its broader neighborhood. It also begs the question of how to go beyond identifying and conceptualizing the security risks posed by climate change to addressing them. This paper charts changes in the EU’s energy and climate security discourse, focusing on their intersection in the Energy Union and the EU’s promotion of the energy transition to lower carbon forms of energy, and the relevant risks in the European neighborhood. Abstract:: The Middle East has several features that distinguish it from the rest of the world. Apart from sitting on the largest proven oil and gas reserves, the region is famous for its complicated politics, challenging demographics and fragile economic structures. For oil- and gas-rich states, limited economic diversification is acute; this is where we find government dependence on hydrocarbon revenues reaching as high as 95 percent in countries like Iraq. This is also where we find a poorly diversified primary energy mix, which is heavily reliant on oil and gas, in a sharp contrast to the norm elsewhere where local energy needs are met by diverse sources of energy, mainly oil, gas, coal, nuclear, and renewable energy. The lack of diversification – both in terms of the economy and energy mix – brings serious challenges for the region. The economic performance of the oil- and gas-rich states has simply mimicked the volatile and unpredictable movement in oil prices: when oil prices are high, these economies grow rapidly, but when oil prices go in the other direction, they shrink in tandem. Additionally, the dependence on oil and gas to meet local energy needs has caused two problems: first, the trade-off between the more lucrative exports and the highly subsidized domestic market, and second, the higher carbon footprint because of the absence of greener sources of energy. In a world where international competition for global market share in oil and gas and the fight against climate change intensify, the region’s leaders seem to be increasingly convinced that the old model of governance is simply not sustainable...

Abstract:: Human trafficking is a horrendous crime: it degrades human security and undermines the rights of people around the globe. Although the exact number of victims worldwide remains elusive, the extent of human trafficking stands to increase in coming years for several reasons, including the accelerating rate of climate change. A warming world will almost certainly bring more disasters that result in greater displacement of people from their homes and livelihoods. This, in turn, puts them at greater risk of trafficking. Human trafficking is a highly lucrative crime, with few perpetrators successfully prosecuted and transnational criminal and terrorist groups repeatedly using it as a source of revenue. These factors, in combination with worsening climate change impacts will, in all likelihood, yield ever more human trafficking victims. At its core, human trafficking involves forcing another against his or her will to work, perform sex acts, or succumb to debt bondage. Despite its name, the crime does not necessarily involve movement: the key element is coercion. Over 170 nations have signaled their opposition to human trafficking by joining the United Nations Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children, and virtually all countries have registered official opposition to trafficking in humans. Despite these pronouncements, human trafficking occurs with staggering frequency. While precise estimates of the number of persons trafficked are difficult to obtain, the U.S. Department of State speculated in its 2017 Trafficking in Persons Report that there may be “tens of millions” of victims worldwide.[1] Other international organizations “estimate that about 25 million people are victims” of human trafficking in the world.[2] In all likelihood, those numbers will grow due in part to the increasing effects of climate change...

Abstract:: Projecting the precise outcomes of climate change on the health and economic well-being of humans is integral to conceiving a coherent climate policy, yet forecasts are often associated with uncertainty. Given the complex nature of the problem: as Anthony McMichael points out in his book – Climate Change and the Health of Nations – famines, fevers, and the fate of populations “the Earth system’s behavior is less amenable to exact description and measurement, and behavior under future unfamiliar conditions cannot be confidently estimated.” As countries work hard to meet their commitments under the Paris Agreement, this unpredictability has become a reason for a dead- lock among nations who are finding it challenging to negotiate the finer, disputable aspects of the Agreement. The issue of “loss and damage” compensation to the more vulnerable regions of the world in particular, has become a bone of contention. It is in this context that McMichael’s book is unique. Instead of being focused on the clichéd discussions surrounding the science and politics of climate change, it provides an account of how humans have evolved, survived, and struggled in an ever changing global climate. In doing so, he views climate change through a historical lens. The book begins by exploring how the ever-so-restless global climate has played a pivotal role in shaping many historical events and the fate of various life forms on the planet. McMichael explains how extreme climate conditions have been responsible for most of the natural extinctions and catastrophic transitions since the Cambrian explosion of new life forms around 540 million years ago. In separate chapters, he throws light on how changing climate conditions have coincided with the rise and fall of human civilizations: from the European Bronze Age to the fall of Rome, the Mayans, and the Anasazi to the little Ice-Age that gripped Europe and China. Throughout the book, McMichael emphasizes how temperature anomalies have proven to be a bane for food supply, human health, and economic well-be- ing, and how they have resulted in the evolution of various infectious agents and vectors. The intriguing nature of changing temperature becomes evident as one is exposed to the many natural extinctions that have been followed by either a rapid cooling or a rapid warming period. McMichael also attempts to associate such naturally occurring warming and cooling with the evolution of some human species and de-evolution of others over time. He quotes John Hooker in saying that “every modification of climate, every disturbance of soil, every interference with the existing vegetation of an area, favors some species at the expense of others.”...

Abstract:: Sooner rather than later, policymakers around the world will need to confront an uncomfortable reality: that despite the best efforts of national governments and thousands of mayors and other civic leaders, we can no longer contain global average temperatures to below 1.5–2 degrees Celsius above preindustrial levels through mitigation of carbon emissions alone. It is widely acknowledged that even if the world stopped all emissions today, there would still be a rise in global temperatures to a level that would stay for hundreds of years (the lifetime of the carbon dioxide already in the atmosphere) before temperatures began to drop, thus constituting a temperature “overshoot.” For many experts the question is no longer whether the world can keep the temperature rise below the goals stipulated in the Paris Agreement, but by how much will the world miss that target and how long will the overshoot last. The acknowledgement of this temperature overshoot—alongside a growing appreciation of its devastating impact on people’s lives, the global economy, and the environment—may mark a new inflection point in our efforts to manage the risks of climate change.1 When you add to this the U.S. president’s announcement in June 2017 that the nation would withdraw from the Paris Agreement, it comes as no surprise that a growing number of scientists are thinking about additional approaches to managing the risks of an overshoot. Perhaps most dramatically, we have seen a resurgent interest in a field that once resided at the fringes of science or on the pages of sci-fi novels, but which is now being taken quite seriously in academic circles: geoengineering. As this interest develops, it is becoming more likely that a group of countries or cities or even one or more wealthy individuals might decide to deploy geoengineering technologies during the coming decades. We need to be ready for any such eventuality; and being ready means considering a host of pressing questions. How would we govern such actors? Who assesses the balance of risks and rewards when deploying geoengineering technologies? What safeguards and what compensation mechanisms need to be built in? If we start deliberately altering global temperatures, who controls the global thermostat? It was to address these questions that the Carnegie Climate Geoengineering Governance Initiative was born: to bring the profoundly complex issues of geoengineering governance and ethics to a much wider audience.2 We are potentially at the dawn of an age of geoengineering. It is time for policymakers to start discussing whether geoengineering is to go forward and, if so, how.

Abstract:: China is currently experiencing its fifth epidemic of “bird flu,” or avian influenza H7N9, since 2013 when it was first noted to cause human infections. The virus, which is mainly transmitted from poultry to humans, is also prone to limited human-to-human transmission. To date, there have been 1,258 human cases, with one-third of those cases (460) occurring during this year’s epidemic alone.[1] There are many “subtypes” of avian influenza circulating in birds around the world and most of these viruses cause limited or no human infections. However, two avian influenzas subtypes causing high human mortality have jumped from birds to humans in the last decade, H5N1 and then H7N9. The significant potential of this class of viruses to cause a human pandemic is a global public health concern, particularly because the conditions leading to the rise of these infections are becoming more favorable — for the viruses.

Abstract:: The year of 2015 was an important milestone in terms of new progresses in development and climate change areas. Adopted Sustainable Development Goals (SDGs) and the Paris Agreement for climate change were two successful issues because of country-driven and comprehensive processes. SDGs which replaced to Millennium Development Goals (MDGs), includes 17 goals and 169 targets. The Paris Agreement aims to reduce greenhouse gas emissions. There are significant direct and indirect interconnections between SDGs and the Paris Agreement. Due to negotiations of the Paris Agreement under the United Nations Framework Convention on Climate Change (UNFCCC) and SDGs continued in different platforms, both the Agreement and SDGs could not sufficiently provide input for each other. There is still room to ensure alignment between these two processes and outcomes while implementation, monitoring and reporting of the Paris Agreement and SDGs. In this paper, the key elements of the Paris Agreement, namely, adaptation, mitigation, finance, capacity building, technology transfer, cooperation and partnerships are determined, then these elements are tracked under the SDGs in order to analyze the connections and missing parts between SDGs and Paris Agreement. Countries should nationalize their own SDGs targets and respective indicators in order to integrate climate change issue in their national development agenda. The findings present that the direct linkages between SDGs and Paris Agreement were not strong but, there are substantial and implicit interconnections among the Agreement and SDGs. Abstract:: Nearly half of the claims brought under the Energy Charter Treaty1 raise issues related to the modification of the Renewable Energy Support Schemes (RESs), but only two decisions have been published: Charanne and Eiser. This paper evaluates these decisions in light of the existing general practice on expropriation and Fair and Equitable Treatment, as well as from a pragmatic perspective in the context of climate change. The article concludes that tribunals should recognize reinforced stability to RESs under the ECT.

Abstract:: MCU Press (MCUP) proudly offers readers this special issue of MCU Journal (MCUJ) that focuses on the past, present, and future impact of climate change and policy. While it is not our intent to take a political or philosophical stance on the issue, we do intend to use this medium to inspire discussion on how U.S. agencies and Service branches address the subject based on operational demands, political pressure, and public opinion. Readers might wonder how this global topic impacts the U.S. Marine Corps; however, the two are not such disparate concepts, particularly when we consider the connection between climate change impacts and humanitarian aid and disaster relief operations the Corps has supported as early as 1895. This special issue of the journal also represents the strategic direction of the new editorial board and MCUP staff who intend to address topics of value to the Marine Corps, Marine Corps University, and the larger Department of Defense community. Our priority, in addition to timely and relevant content, is to engage civilian scholars and analysts, such as J. Brooks Flippen at Southeastern Oklahoma State University; Michael Reis at History Associates Inc.; our partners at CNA, Ralph Espach, David Zvijac, Ronaldo Filadelfo, Catherine Schkoda, Shawna Cuan, and E. D. McGrady; and professional military education instructors, such as Edward Erickson at MCU and Rebecca Pincus at the U.S. Coast Guard Academy. Future issues of MCUJ also will include articles written by military personnel who understand the value of their perspectives and the importance of that knowledge not being lost once a deployment or active duty ends. Abstract:: Inclusion of the topic ‘protection of the atmosphere’ in the current work programme of the UN International Law Commission (ILC) reflects the long overdue recognition of the fact that the scope of contemporary international law for the Earth’s atmosphere extends far beyond the traditional discipline of ‘air law’ as a synonym for airspace and air navigation law. Instead, the atmospheric commons are regulated by a ‘regime complex’ comprising a multitude of economic uses including global communications, pollutant emissions and diffusion, in different geographical sectors and vertical zones, in the face of different categories of risks, and addressed by a wide range of different transnational institutions. Following several earlier attempts at identifying cross- cutting legal rules and principles in this field (by, inter alia, the International Law Association, the UN Environment Programme, and the Institut de Droit International), the ILC has now embarked on a new codification/restatement project led by Special Rapporteur Shinya Murase – albeit hamstrung by a highly restrictive ‘understanding’ imposed by the Commission in 2013. This article assesses the prospects and limitations of the initial ILC reports and debates in 2014 and 2015, and potential avenues for progress in the years to come.

Abstract:: The effectiveness of international environmental regimes is a subject that is becoming more and more important within the International Relations discipline. While one of the reasons of that is the increasing interest of the international community in environmental issues, the other reason is that the environmental issues have turned into a problem that has a direct impact on the relations among the states. However, there is no consensus on approaches about the assessment of the effectiveness of the environmental regimes. This study aims to consider the different approaches and views that are important in terms of the assessment of the effectiveness of environmental regimes. In this framework, the approaches related to regime effectiveness are assessed, and the outlines of theoretical and methodological framework that can be used in the analysis of regime effectiveness are tried to be defined.

Abstract:: “Procedures and Mechanisma on Compliance Under the Kyoto Protocol” was adopted by the Kyoto Protocol First Meeting of Parties at Montreal in 2005. The Compliance Committee which constitutes of Facilitative Branch and Enforcement Branch, started to operate in 2006. While the Enforcement Branch deserves a special attention due to its innovative quasi-judicial characteristics, the mandate of the Facilitative Branch have many similarities with the Non-Compliance Procedures which is already applicable for various Multilateral Environmental Agreements, predominantly the Montreal Protocol. The outcomes of the ongoing climate change negotiations for post-2012 will possibly shape and guide the necessary changes to the Kyoto Protocol compliance regime as well. Thereupon, the purpose of this article is to shed light on the structure and functioning of the compliance mechanism; the mandates used by the Facilitative and Enforcement Branches; the legal nature of the decisions taken by the Compliance Committee.

48. Science, Public Policy, and Global Warming: Rethinking the Market‐Liberal Position

Abstract:: A survey of market-liberal or libertarian publications and websites finds a large and growing literature on the issue of global warming. Almost without exception, this literature conveys a comforting message: Our planet is in good health. The markets that regulate resource use are working well. The only real dangers come from ill-considered policy initiatives that, if implemented, would do more harm than good. It would seem that the message is well received by its audience—it is repeated, embellished, and applauded with little variation. In this article, I take a contrarian position, not so much with respect to the science of climate change as with respect to the arguments used by market liberals in support of their message of comfort and complacency. One problem area concerns the proper use of scientific evidence in reaching conclusions regarding public policy. It seems to me that market liberals are often reckless in the degree of certainty they professes regarding climatological hypotheses that are, in fact, still controversial and in early stages of development. A second problem concerns the use of cost-benefit analysis. Market-liberal writers are prone to make cost-benefit arguments regarding climate policy that they would never accept in other contexts. Third, the literature on global warming is often weakly rooted, if rooted at all, in the core principles of classical liberalism from which modern market liberalism has evolved. Instead, it is, for the most part, indistinguishable from what is said by conservatives. It might even be said that there is no market-liberal position on this issue—only an echo of arguments made by Republican patriots and the carbon lobby. In short, the whole issue of global warming policy, as viewed by market liberals, needs to be revisited. This can best be done by going back to some of the classical liberal sources, particularly Friedrich Hayek and John Locke, from which modern market-liberal thought is derived.
