The JIRD is a global journal with Central European roots. We have established a diverse editorial team of scholars from Europe and North America linked first by a commitment to publish highest quality scholarship in international relations (IR) and development, broadly conceived, regardless of substantive or methodological focus; and second by a common awareness of the contribution the Central and East European (CEE) experience can make to the study of international politics. We envision the JIRD as a globally relevant journal with a CEE touch. This does not mean dealing primarily with CEE themes, although the region will naturally remain more strongly in focus than in comparable IR journals. More profoundly, it means nurturing both CEE IR scholarship and also the broader transnational scholarly context in which it develops.

The renewed interest in the law of belligerent occupation probably reached its peak in 2009, when various monographs were published by distinguished authors as well as by younger scholars. The book under review originated from a doctoral thesis defended by Andrea Carcano at the University of Milan. His investigation focuses on the 2003 occupation of Iraq as the ideal test-case to verify whether the existing legal regime is adequate to address the challenges posed by present-day scenarios, including Afghanistan, Congo, and the Arab–Israeli conflict. The book is divided into three parts. The first one comprises two chapters, which present respectively the legal framework of belligerent occupation and the other applicable norms of international law. Chapter I takes a historical perspective on the legal concept of occupation, which the author considers functional to the subsequent analysis for two main reasons: to investigate the underlying values guiding the development of the law of belligerent occupation; and to compare current theories regarding the role of the law in such a situation with similar arguments upheld in the past (at 13). Carcano identifies three epochs, which modelled different concepts of occupation. The first one is valid until the Modern Age and is influenced by the Roman law tradition: occupation is considered as 'conquest and exploitation of the territory'. The modern notion of occupation, defined as 'administration and effective control', emerged during the 18th century, at the time of the consolidation of sovereign states in Europe. Whereas Vattel had already in theory identified the differentiation between sovereignty and private ownership, it was August Heffter, a century later, who first recognized the legal implications of the distinction between occupatio bellica and debellatio (at 24). Abstract:
The European Union has been trying to achieve its long-term goals through partnerships and cooperation with other like-minded global actors. Africa (through its regional institutional body, the African Union) has been the first and only multilateral entity with which the EU has forged a long-term partnership. Despite its rhetorical language, the Africa-EU Strategic Partnership is unlikely to upgrade the political and economic interaction between the two partners. In the past few years, serious rifts have grown between the EU and its African counterparts concerning trade agreements and development policies. Moreover, new actors have made significant inroads in Africa, providing an alternative to its long-standing dependence on Europe.

The development of International Relations theory (IRT) in China has been framed by three debates since 1979. The first was about China's opening up to the outside world. It started with the question of whether the world was characterized by 'war and revolution' or 'peace and development' between orthodox and reformist scholars and continued to focus on China's interest between orthodox scholars and the newly rising Chinese realists. It resulted in a wide acceptance of the reformist argument that peace and development characterized our era and of the realist view that China was a normal nation-state and should have its own legitimate national interest. The second started in the early 1990s and centered on the better way of realizing China's national interest. It was between Chinese realists and liberals. While the former emphasized national power, the latter proposed the alternative approach of international institutions. The third debate was on China's peaceful rise. It evolved at the turn of the century, when all the three major American IRTs, realism, liberalism, and constructivism, had been introduced into China and therefore the debate was more a tripartite contention. Realists believed that it was impossible for any major power to rise peacefully, while liberals and constructivists both supported the peaceful-rise argument. Liberals stressed more the tangible benefits derived from international institutions and constructivists explored more China's identity in its increasing interaction with international society. Although it was Chinese constructivists who explicitly discussed the identity issue, all the three debates and all the debating sides have reflected this century puzzle since the Opium War – China's identity vis-à-vis international society. These debates have helped push forward the IRT development in China and at the same time established Western IRT as the dominant discourse. A new round of debate seems likely to occur and may center on the question of the world order. This time it may help the newly burgeoning but highly dynamic Chinese IRT to develop and contribute to the enrichment of IRT as knowledge of human life.

Abstract:
The relationship between Turkey (and its predecessor, the Ottoman Empire) and Europe has been long, often tense or openly hostile, and is in some senses fundamental to the identities and development of each; this relationship also adds a considerable burden of suspicion to Turkey's current aim of joining the European Union (EU). This essay examines these propositions by providing an account of the history of the relationship and of Europe's recent, conditional approach to Turkish accession to the EU. While accepting that much remains to be done at the institutional level to bring Turkey into alignment with EU norms, this paper argues that Turkish accession is a historic opportunity for Europe that it should not squander. Despite mixed signals, further development of Turkey's democracy along the path to Europe is the most likely course. The story is not “never-ending”, but the end will not come quickly.

The aim of this article is to analyse the EU`s role in the developing world in relation to migration. To achieve that reasons behind the migration from developing countries to EU countries are discussed and the impact of migration on the development of poor countries is analysed. The common migration policy of the EU is introduced and EU`s policies to manage the migration flows are presented. The main argument of this article is that despite some attempts of the EU to manage migration relations between developing countries and the EU in favour of both sides, the Union still has a long way to go.

The restive Nile basin which has long been identified as a flashpoint prone to conflict embarked on a new path of cooperation with the launching of the Nile Basin Initiative (NBI). Anchored in a Shared Vision 'to achieve sustainable socio-economic development through the equitable utilization of, and benefits from, the common Nile Basin water resources', the NBI has provided a convenient forum for the negotiation of a Cooperative Framework Agreement (CFA) to set up a permanent, inclusive legal and institutional framework. Negotiation of the CFA has, however, faced a serious impasse as a result of the introduction of the concept of 'water security'. The introduction of this non-legal, indeterminate, and potentially disruptive concept is, indeed, a regrettable detour to a virtual blind-alley. The justifications for this fateful decision are totally unfounded and specious. The decision rather makes sense as an unwarranted move pushing into further obscurity the already intractable Nile waters question, at best, and a logical cul-de-sac in the decade-long negotiations which have arguably fallen prey to the hegemonic compliance-producing mechanism of 'securitization' sneaked in under the veil of 'water security', at worst. Resolution of the Nile waters question should thus first be extricated from the morass of 'water security' and then be sought nowhere but within the framework of international water law.

In this article we seek to answer three interrelated questions: First, how do Islamic, national and democratic forces in the Arab world perceive the Justice and Development Party (AKP)? Is it an Islamic or a secular movement? Second, how do Arab political elites perceive the party's foreign policy, especially its relationship with Israel, America and the European Union? In this regard, we specifically explore how they perceive the AKP's political role in mediating indirectly the Syrian-Israeli dialogue, and its attempts to mediate between the US and Iran. Third, what are the prospects for the realization of the AKP's political project? Is it likely that the AKP will succeed in transforming Turkey into an "economic tiger," profiting from the existing strategy of positive relationships with America, Israel and Europe?

Abstract:
This paper asserts that there is a tension between traditional development paradigms and the post-Cold War leitmotif of democratisation which is as yet unresolved within the present SSR discourse. This tension is identified between what the paper describes as the developmental objectives of SSR, and its inherent democratic articulation. The paper argues that democratic principles remain the organisational logic within which SSR processes are conceived as taking place; and that a democratic environment is supported in order for the purpose of SSR – development – to be achieved. The paper takes issue with this model, and advocates for two alterations in the present SSR discourse. First, that SSR should be viewed as a democratising endeavour, specifically focused upon the security and justice processes, but retaining democracy as its intended measurable output. Second, that the conceptual device of the 'social contract', that describes the citizen/state relationship, should become a pivotal consideration when conceiving and delivering support to SSR processes.

It remains a secret for many our compatriots, what prompted the two geographically remote nations to ally 300 years ago, when the fate of our independence was decided, and to be partners today, when the fate of Ukraine’s European future is at stake. Ukraine possesses vast land resources. As of January 1, 2009, its land stock amounted to 60,354.8 thousand hectares, or almost 6% of the European territory1 . In particular, farming land accounted for nearly 19% of the European, arable land – almost 27%. Per capita area of farming land in Ukraine is the highest among the European countries – 0.9 hectares, including 0.7 hectares of arable land (against the European average of 0.44 and 0.25 hectares, respectively). Black soil in Ukraine, according to different estimates, occupies from 15.6 to 17.4 million hectares, or nearly 8% of the world stock. By and large, at the beginning of 2000s, the standard monetary value of land resources in Ukraine was estimated at UAH 330 trillion2 . Meanwhile, the structure of the land resources and land use shows rather serious disparities whose deepening may pose a threat to the quality of the natural and life environment, and the effectiveness of the business activity, i.e., sustainable development of the national economy. For instance, Ukraine demonstrates an extremely high rate of development of the life environment: over 92% of its territory is involved in economic circulation, and only some 8% (4.5 million hectares) is in its natural state. The tillage rate of the territory is similarly high – over 54% (in developed European countries – no more than 35%). The actual forest rate of the Ukrainian territory is only 16%, which is insufficient for the environmental balance (European average – 25-30%). The territory under surface waters steadily goes down (from 1991 – by 12.5 thousand hectares), further aggravating the problem of shortage of water resources in Ukraine. There are problems in land relations, whose reformation, commenced in 1991, is not over. Respectively, creation of the land legislation, registers and databases necessary to ensure land ownership rights and effective control of observance of the norms and rules of proper land use remain unaccomplished. In such situation, the quality of the state land policy, its effectiveness, professionalism, correspondence to principles of proper management of the national land resources acquire particular importance. Discussed below are some features of the state land policy and its main problems hindering effective use of the main national wealth – land, free access to that wealth for individuals and legal entities, unconditional respect for ownership rights.

The new institutionalist theory, unlike the (old) institutionalism, emphasizes the importance of informal structures and values of institutions, beside formal and legal structures. European Union (EU) institutions determine and direct the development of interest representation by using their competens and values. Therefore, the new institutionalist theory can be useful to understand development of interest representation in the EU. Development of interest representation (and lobbying) in the EU, largely, depends on two factors. First one is the changes of the competences of of the EU institutions in EU decision-making process in accordance with the EU treaties. The second one is the changes of the EU institutions' initiatives and attitudes towards the lobbbies. Consequently, the particular changes of the EU decision-making process and the attitudes of the institutions towards the lobbies in the framework in which institutions have competences, resulted followings. The number of lobies has increased, route of interest representations activities has shifted to the EU-leved and a different (pluralistic) model of interest representations has been adopted. The pivotal role of institutional values has become apparent as indicated in the theory of new institutionalism.

Strongly marked by the weight of the past, the French approach to State-Religion- Society relations has distinct qualities, and especially a strong confrontational and emotional dimension. This essay address the evolution of these relations and their tensions by focusing on three subjects that make manifest the relationship between politics and religion in important ways, namely, schools, sects, and Islam. The arena of the school is especially significant in three respects: the link between public and private schools; the question of what should be taught about religion, and the display of religious expression by students. The essay considers these matters within the context of wider transformations in religion (secularization) and politics (disenchantment and changes in the state's role in society). It concludes by situating recent developments in the context of globalization and especially Europeanization.

Recent years witnessed calls for the intensification of surveillance and the monitoring of people globally. This article will examine this intensification of surveillance in the European Union, by analysing legislation requiring carriers to transmit to immigration authorities passenger data, an agreement between the Community and the US on the transfer of passenger name records (PNR) to US authorities, and EU plans to introduce biometrics in passports and visas and enhance the interoperability of EU databases (such as SIS and VIS). These developments, justified by a 'war on terror' discourse, widen the net of surveillance and raise a number of questions regarding legitimacy, democracy and the protection of fundamental rights in the EU. They also appear to be at odds with the concept of the EU as a borderless area. The article will address these issues by analysing the negotiations, content and implications of these initiatives. Ces dernières années les demandes d'intensification de la surveillance et des contrôles du mouvement des personnes au niveau mondial se sont développées. Cet article examine cette intensification de la surveillance au sein de l'UE en analysant la législation obligeant les transporteurs à fournir les données personnelles des passagers aux services d'immigration, un accord entre l'UE et les Etats-Unis sur le transfert des « passenger name records » (PNR) aux autorités américaines, et les plans européens d'introduction de données biométriques aux passeports et visas et d'amélioration de l'interopérabilité des bases de données européennes (SIS et VIS notamment). Ces développements, justifiés par un discours de « guerre au terrorisme », élargissent le réseau de la surveillance et soulèvent un certain nombre de questions sur la légitimité, la démocratie, et la protection des droits fondamentaux dans l'UE. Ils apparaissent également en décalage avec le concept de l'UE comme espace sans frontières. In France as in Brazil, violence and its modes of usage are thesubject of vivid and intense debates. The acts of violence inquestion have, however, little in common. The authors of this newissue of Cultures Conflits propose to examine the terms of thesedebates that feature and combine in complex shapes myths of nationaldemocracies, media representations, and the (in)abilities of thestate to effectively regulate the social sphere. These Franco-Brazilian dialogues on violence and democracy are part of a largercultural exchange linking since long Latin America and Europe - as Glauber Rocha and Roberto Rossellini remind us. An asymetricexchange, if any, marked by the feeling of being perpetually trappedin an unfinished development.
