Abstract:: This year marks the 30th anniversary of the Paris Peace Agreement on Cambodia. That accord closed the door on years of war, during which the Khmer Rouge “Killing Fields” caused the deaths of up to two million persons (out of a population of seven million) and brought the 1,000-year- old civilization to the point of obliteration. When I landed in Phnom Penh in 1996 to begin my term as U.S. Ambassador, the country was in the fifth year of implementing that 1991 agreement. Looking back on this improbable diplomatic success offers a chance to assess the effectiveness of American diplomacy in the 1990s, and how, despite one extremely unfortunate regression, Indochina and Southeast Asia were irrevocably changed by that accord.

Abstract:: The terms “primary”, “mid-level” and “lower level” are employed to qualify perpetrators of mass atrocities, based on the magnitude of guilt and criminal responsibility. Could this classification be a misnomer? Could the relationship among perpetrators, or the roles they assume be more intricate, warranting a reassessment of the existing hierarchy? This paper explores the need to be more circumspect in penning perpetrators in categories, especially in complex scenarios of mass atrocity. To do so, the Non-Solitarist View of Human Identity and Framing Theory are used to explore the matter, with a focus on perpetrators of the Khmer Rouge era.

Abstract:: Evelyne Schmid’s new book, Taking Economic, Social and Cultural Rights Seriously in International Criminal Law, aims to provide a bridge between developing practice and existing knowledge. At the heart of her book lies the question of how, or to what extent, violations of ESCR are addressed in international criminal proceedings and transitional justice mechanisms. She criticizes the current marginalization of ESCR abuses in scholarship on international criminal law and bemoans the reality that ‘efforts to address the legacy of widespread human rights abuses display a bias towards civil and political rights’. While some have argued for an expansion of international criminal law to account more directly for violations of ESCR, Schmid claims such an expansion is unnecessary; in her view, such violations already fall within the scope of international crimes.

Abstract:: A recent survey of victims of violence reported that memorialization was prioritized as the second most valuable form of state reparations following monetary compensation (Brett, et al 2008, 2). In part, it is perhaps this impetus to bear witness to the suffering of victims that has given rise to a proliferation of memorials in recent decades, including those marking genocide in Rwanda, Cambodia, and Bosnia, violent repression in Argentina and Chile, wars of liberation in Bangladesh and Palestine, nuclear disaster at Chernobyl, and terrorism in Madrid and New York. As a form of transitional justice, memorials have too often been relegated to the domain of artists and architects whereas they represent a strategic resource in conflict and peace.
