Abstract:
The honeymoon between the Western oil industry and Russian President Vladimir Putin ended in mid-2003 when the Russian procurator's office began arresting Yukos executives. The Kremlin's seemingly sudden attack on private industry surprised the international business community that was expecting investment-friendly behavior from the Russian leadership. After assuming power in late 1999, Putin quickly signaled interest in developing a strong energy partnership with the United States, including increased opportunities for Western firms to invest in Russia's oil and gas industry.

Abstract:
Definitions of the rule of law fall into two categories: (1) those that emphasize the ends that the rule of law is intended to serve within society (such as upholding law and order, or providing predictable and efficient judgments), and (2) those that highlight the institutional attributes believed necessary to actuate the rule of law (such as comprehensive laws, well-functioning courts, and trained law enforcement agencies). For practical and historical reasons, legal scholars and philosophers have favored the first type of definition. Practitioners of rule-of-law development programs tend to use the second type of definition. This paper analyzes the challenge of effectively defining the rule of law, through an examination of both types of definitions, the historical background of each, and the implications of each for rule-of-law development efforts.

Economic growth in Africa, as in the rest of the world, depends on a vibrant private sector. Entrepreneurs in Africa, however, face daunting constraints. They are prevented from creating wealth by predatory political elites that control the state. African political elites use marketing boards and taxation to divert agricultural savings to finance their own consumption and to strengthen the repressive apparatus of the state. Peasants, who constitute the core of the private sector in sub-Saharan Africa, are the biggest losers. In order for Africa to prosper, peasants need to become the real owners of their primary asset—land—over which they currently have no property rights.

For more than 20 years, the United States has refused to become a party to the Law of the Sea Treaty. Advocates of the treaty, a comprehensive measure governing navigational rights on the sea and mineral rights on the seabed, claimed that U.S. failure to join the convention would result in chaos on the high seas. It has not. Very few Americans know anything about the treaty, and even advocates are hard-pressed to explain how the United States would benefit from its adoption.

The medical field of treating chronic pain is still in its infancy. It was only in the late 1980s that leading physicians trained in treating the chronic pain of terminally ill cancer patients began to recommend that the "opioid therapy" (treatment involving narcotics related to opium) used on their patients also be used for patients suffering from nonterminal conditions. The new therapies proved successful, and prescription pain medications saw a huge leap in sales throughout the 1990s. But opioid therapy has always been controversial. The habit-forming nature of some prescription pain medications made many physicians, medical boards, and law enforcement officials wary of their use in treating acute pain in nonterminal patients. Consequently, many physicians and pain specialists have shied away from opioid treatment, causing millions of Americans to suffer from chronic pain even as therapies were available to treat it.

Shoulder-fired anti-aircraft missiles, or MANPADS (man-portable air defense systems), have proliferated throughout the world. They can be purchased on the military arms black market for as little as $5,000. More than two dozen terrorist groups, including Al Qaeda, are believed to possess such weapons. The FBI estimates that there have been 29 MANPADS attacks against civilian aircraft resulting in 550 deaths. At least 25 of the reported attacks have been attributed to nonstate actors.

As Congress debates the reauthorization of the Higher Education Act, it should heed Friedrich Hayek's warning that democracy is “peculiarly liable, if not guided by accepted common principles, to produce over-all results that nobody wanted.” One result of the federal government's student financial aid programs is higher tuition costs at our nation's colleges and universities. Basic economic theory suggests that the increased demand for higher education generated by HEA will have the effect of increasing tuitions. The empirical evidence is consistent with that—federal loans, Pell grants, and other assistance programs result in higher tuition for students at our nation's colleges and universities.

On December 8th, 2003, the United Nations General Assembly adopted a resolution to submit the question concerning the legality of Israel's construction of a wall in the Occupied Palestinian Territory to the International Court of Justice for an advisory opinion. The Court accepted, and thus entered into the Israeli-Palestinian conflict - one of the most far reaching, difficult, and delicate disputes that the international community has faced. The purpose of this paper is two-fold. First, it analyzes the most relevant issues in the Wall case related to jurisdiction and merits. Second, it considers the position of the European Union in terms of the Middle East conflict, and specifically, concerning this advisory opinion.

Abstract:
Although there are some shoals still to be navigated, the narrow pro-independence victory in Montenegro's 21 May 2006 referendum should, on balance, increase rather than diminish stability in the western Balkans. It is in the interest of the European Union (EU), now that its previous policy of keeping Serbia and Montenegro together has run its course, to welcome the new state and speed its accession to international institutions. Podgorica still faces significant challenges associated with transition, but none should affect regional stability, and all can be resolved as the country moves forward with the Stabilisation and Association process towards EU membership. Given the positive international response to the referendum, Montenegro can aspire to becoming a “boring” country moving toward integration with Europe. But its opposition, and Belgrade, need to be persuaded not to renege on their commitments to the EU to accept the referendum result, lest this generate new uncertainties in the region as a Kosovo status decision approaches.

The Muslim-majority region of southern Thailand continues to experience a relatively low-level insurgency but a state of emergency imposed on three provinces is no solution to the conflict that has claimed more than 1,000 lives since January 2004. The decree has deepened mistrust of the security forces, worsened public discontent with the government's approach to the insurgency and heightened the risk of human rights abuses. Prime Minister Thaksin Shinawatra should take immediate steps to moderate the decree or risk plunging the area into worse violence.

57425. The EU/AU Partnership in Darfur: Not Yet a Winning Combination

The African Union's (AU) intervention in Sudan's Darfur region tests the effectiveness of its own peace and security structures and those of the European Union (EU). The AU has taken the lead both in the political negotiations between the government and the rebels and in deploying a peace-monitoring mission, the AU Mission in Sudan (AMIS). It has had to rely on outside support for AMIS, with nearly two thirds of its funding coming from the EU's African Peace Facility. The results are mixed. If Darfur is to have stability anytime soon, and the two organisations are to fulfil their ambitions to be major players in crisis prevention and crisis resolution, AMIS must get more troops and a more proactive, civilian-protection mandate, and the EU needs to find ways to go beyond the present limitations of the African Peace Facility in providing assistance.

More than two years into the transition in the Democratic Republic of the Congo, the peace process remains at risk. As many as 1,000 people a day still die from war-related causes -- mainly disease and malnutrition, but also continuing violence. While the main belligerent leaders are all in the transitional government, their corruption and mismanagement threaten stability during and after the forthcoming national elections, now postponed from June 2005 to March 2006. The international community needs to maintain pressure on a wide front, making specific security sector reform, transitional justice and good governance measures prerequisites for the elections, not allowing them to be postponed until there is a new government.

57428. Weakening Indonesia's Mujahidin Networks: Lessons from Maluku and Poso

In the wake of a second terrorist attack on Bali, the need to understand Indonesia's violent jihadist networks is greater than ever. Two incidents in May 2005 -- the execution of paramilitary police in Ceram, Maluku, and the bombing of a market in Tentena, Poso -- offer case studies of how those networks are formed and operate. Weakening the networks is key to preventing further violence, including terrorism. In Maluku and Poso, sites of the worst communal conflicts of the immediate post-Soeharto period, one place to start is with programs aimed at ex-combatants and imprisoned mujahidin due for release. These men are often part of networks that extend beyond the two conflict areas, but if they can be "reintegrated" into civilian life, their willingness to support mujahidin elsewhere in Indonesia and engage in violence themselves might be lessened. Addressing broader justice and security issues would also help.

Settlement of the long running Nagorno-Karabakh conflict -- the most significant obstacle to stability in the South Caucasus -- remains elusive, despite more optimistic noises recently from Azerbaijan and Armenia. Eleven years after the 1994 ceasefire, burgeoning defence budgets, increasing ceasefire violations, and continuing demonisation by each side of the other side are ominous signs that time for a peace agreement is running out. But a compromise can now be constructed around an approach that, while addressing all the matters in dispute, leaves the core issue of Nagorno-Karabakh's ultimate status open for later resolution, after other measures have been put in place.

Insecurity in Darfur remains pervasive despite a decline in direct, large-scale fighting between the government and the two main rebel movements, the Sudan Liberation Army/Movement (SLA) and the Justice and Equality Movement (JEM). Maintaining the present uneasy status quo is not the answer. The Khartoum government continues to flout its numerous commitments to neutralise its allied proxy militia, the Janjaweed, and more than two million civilians displaced by the conflict will not return home without a comprehensive political settlement including security guarantees. But the problem is not just on the government side: discord within and between the rebel movements also needs to be resolved if there is to be a chance for sting peace.

Egypt's first multi-candidate presidential election, a response to U.S. pressure, was a false start for reform. Formal pluralism has never seriously limited the dominance of President Mubarak's National Democratic Party (NDP); extension to the presidential level is a token so long as the opposition is too weak to produce plausible candidates. If the further reforms Mubarak has promised are to be meaningful, they should be aimed at recasting state/NDP relations and, above all, enhancing parliament's powers. As a start, Mubarak should ensure free and fair November legislative elections. The legal opposition must make the case for these changes and overcome its divisions if it is to become relevant and be able to compete with the Muslim Brothers for popular influence. The U.S. and others should support judicial supervision of elections, refrain from pressing for quick, cosmetic results, and back a longer-term, genuine reform process.

The conflict between Azerbaijan and Armenia over Nagorno-Karabakh is the most significant obstacle to peace and stability in the South Caucasus. Eleven years into a ceasefire, the parties have been unable to sign a single document bringing them closer to a settlement. Whatever is being done at the internationally mediated negotiations, at ground level resumed war appears a real possibility. There is need to counter the hate propaganda and demonising engaged in by both sides and unlock the potential for confidence building and dialogue between average Azeris and Armenians before the memories of cohabitation fade and the divide becomes virtually unbridgeable.

The international community has properly decreed that Kosovo's final status must not involve division of its territory. But this declaration has not been followed by sufficient action. Belgrade's policy of pursuing some form of partition is far advanced in the restive northern city of Mitrovica and its hinterland, and a major security, political and financial effort is required to save the situation. Capacity should be built immediately, and its implementation should begin once the Contact Group has declared its support for Kosovo's future as a functional, conditionally independent state within its present borders.

Although the dangers are evident, the international community continues to support General Pervez Musharraf because of his perceived cooperation in the war on terror, ignoring unconstitutional constraints on the civilian opposition. They can be the most effective safeguard against the religious lobby's manifestly anti-Western agenda, but only if allowed to function freely in a democratic environment. From Saudi Arabia's establishment in 1932, its minority Shiite population has been subject to discrimination and sectarian incitement. Beginning in the early 1990s, with then Crown Prince Abdullah's active support, the government took steps to improve inter-sectarian relations. But the measures were modest, and tensions are rising. The war in Iraq has had a notable effect, strengthening Shiite aspirations and Sunni suspicions and generally deepening confessional divisions throughout the region. King Abdullah needs to act resolutely to improve the lot of the two-million strong Shiite community and rein in domestic expressions of anti-Shiite hostility.

Operation Murambatsvina (Restore Order) cost some 700,000 Zimbabweans their homes or livelihoods or both and otherwise affected nearly a fifth of the troubled country's population. Its impact, as documented in a scathing UN report, has produced a political shock that has returned Zimbabwe to the international spotlight and made the quality of its governance almost impossible for its regional neighbours to ignore, however difficult they find it to be overtly critical. While an immediate requirement is to reverse as thoroughly as possible the disastrous humanitarian effect s of the operation, action is urgently needed to address Zimbabwe's larger governance problem. This will require effort s on three parallel tracks -- the maintenance of overt international pressure, support for building internal political capacity and, above all, active regional diplomacy to facilitate political transition.

On 15 August the Indonesian Government and the Free Aceh Movement (Gerakan Aceh Merdeka, GAM) are to sign a peace agreement that offers the best hope yet of ending a conflict that has cost over 9,000 lives since 1976. But no one should underestimate the difficulties of bringing an end to a 30-year-old conflict. Deep reservoirs of fear and distrust remain. The demobilisation and disarmament phases will be critical, and they are scheduled to begin in a month. Release of GAM prisoners will happen even sooner. In formation, communication, and planning are in very short supply. Among the most urgent tasks are: finding appropriate channels for the widest possible dissemination of information about the agreement in Indonesian and Acehnese, with an explanation of how it differs from the failed 2002 agreement; coordinating the different agencies working on amnesty, disarmament, reintegration, monitoring and funding; ensuring that government promises of land, jobs, or social security to various groups are quickly kept; and protecting vulnerable groups, including those who report violations of the agreement.

The surprise election of Mahmoud Ahmadi-Nejad, who is being sworn in as president this week, has given rise to dire predictions about Iran's domestic and foreign policies and relations with the U.S. and the European Union. There are reasons for concern. Based on his rhetoric, past performance, and the company he keeps, Ahmadi-Nejad appears a throwback to the revolution's early days: more ideological, less pragmatic, and anti- American. But for the West, and the U.S. in particular, to reach and act upon hasty conclusions would be wrong. Iran is governed by complex institutions and competing power centres that inherently favour continuity over change. More importantly , none of the fundamentals has changed: the regime is not about to collapse; it holds pivotal cards on Iraq and nuclear proliferation; and any chance of modifying its behaviour will come, if at all, through serious, coordinated EU and U.S. efforts to engage it.

While the world focuses on Gaza, the future of Israeli-Palestinian relations in fact may be playing itself out away from the spotlight, in Jerusalem. With recent steps, Israel is attempting to solidify its hold over a wide area in and around the city, creating a far broader Jerusalem. If the international community and specifically the U.S. are serious about preserving and promoting a viable two-state solution, they need to speak far more clearly and insistently to halt actions that directly and immediately jeopardise that goal. And if that solution is ever to be reached, they will need to be clear that changes that have occurred since Israelis and Palestinians last sat down to negotiate in 2000-2001 will have to be reversed.

The January 2005 Comprehensive Peace Agreement (CPA) formally ended war between the Khartoum government and the insurgent Sudan People's Liberation Movement/Army (SPLM/A), Africa's longest civil conflict. Yet as SPLM Chairman John Garang was sworn in as 1st Vice-President on 9 July, implementation lags badly. The main obstacles are the old regime's lack of will to embrace genuine power sharing and elections, and ultimately allow a southern self-determination referendum after the six-year interim period and lack of capacity in the South to establish and empower basic structures of governance. To keep the accords on track, the international community must focus on broadening participation and transparency, particularly handling of oil revenues, promote SPLM dialogue with the government-allied militias and quickly deploy the UN peace support mission, whose monitoring operations will be key to breaking the links between Khartoum and those southern proxies.

Swaziland has been an absolute monarchy for more than 30 years, with a royal leadership that ignores worsening social ills and a small elite that is often openly corrupt. A new constitution that further codifies broad royal powers and privileges is in the final stages of preparation. Political violence is still more talked about than actual but frustration is building. Multilateral African institutions, the EU and key countries like South Africa and the U.S. have been too willing to accept the royalists' line that any change must come very slowly. More pressure from the outside is needed to help pro-reform elements inside the country bring back a constitutional monarchy and genuine democracy that are the best guarantees Swazi instability will not eventually infect the region.

But away from the spot light, a quiet, dirty conflict is being waged in Somalia: in the rubble-strewn streets of the ruined capital of this state without a government, Mogadishu, al-Qaeda operatives, jihadi extremists, Ethiopian security services and Western-backed counter-terrorism networks are engaged in a shadowy and complex contest waged by intimidation, abduction and assassination. The U.S. has had some success but now risks evoking a backlash. How Israel for the first time evacuates settlements in the Palestinian Occupied Territories will have profound implications for Israeli-Palestinian relations, but also for Israeli society. Regardless of one's assessment of the settlers and their enterprise -- regarded internationally as illegal, by many Israelis as irresponsible and by others as the embodiment of the Zionist project -- it is bound to be a traumatic event for Israel. If it should be mishandled, accompanied by violent settler resistance or Palestinian attacks, the prospects for subsequent peace would be much bleaker. The international community's interest is to press for complete disengagement and then a credible follow-on political process.

The international community is failing in its responsibility to protect the inhabitants of Darfur, many of whom are still dying or face indefinite displacement from their homes. New thinking and bold action are urgently needed. The consensus to support a rough doubling of the African Union (AU) force to 7,731 troops by the end of September 2005 under the existing mandate is an inadequate response to the crisis. The mandate must be strengthened to prioritise civilian protection, and a force level of at least 12,000 to 15,000 is needed urgently now, not in nearly a year as currently envisaged.

Relations between Japan and North Korea continue to deteriorate due to concerns over Pyongyang's nuclear weapons program and past abductions of Japanese citizens. Nearly a decade and a half of efforts at normalising relations between the countries have faltered due to Pyongyang's unwillingness to give up that program or come clean over the abductions. For Japan, normalisation would help preserve regional stability and represent one more step toward closure on its wartime history; for North Korea, it would potentially produce the single greatest economic infusion for reviving its moribund economy. Indeed, the prospect of normalisation with Japan is one of the leading incentives that can be offered to North Korea in a deal to end the North's nuclear programs.

Nepal is in the grip of a constitutional crisis. The drafters of the 1990 Constitution hailed it as "the best constitution in the world", ending three decades of absolute monarchical rule by enshrining a multi-party system under a constitutional monarchy. But the nine- year-old Maoist insurgency has cruelly exposed the inherent weaknesses in that settlement, and the royal coup of 1 February 2005 has dealt it a near fatal blow. The international strategy for Bosnia and Herzegovina risks derailment. There are several studies on recent developments in collective bargaining in Eastern Europe, but there is still a debate about the extent to which collective bargaining practices resemble those in continental Western Europe. This paper aims to contribute to this debate, by examining primary data on collective bargaining practices in Romania using an actor-centred institutionalist approach. It focuses on collective bargaining in four large chemical companies. Comparisons are made to other countries in order to highlight the developments in Romanian cases. Unexpectedly, the study's findings point to an increase in state intervention in establishing the terms and conditions of employment after 1989, due to the state’s new roles during the transformation process that affected job security. The study suggests a considerable increase in the influence of top managers in determining pay and working conditions, while trade unions retained the considerable influence over social benefits in large companies. The findings show continuance of certain pre-1989 practices, such as a persistence of high state intervention and a limited independence of the trade unions from the management. This paper contributes to a deeper understanding of institutional changes in the context of a shift from a centrally planned economy to a market-based economy.

The shift from centrally planned economies to market-oriented economic models presented trade unions in Eastern European countries with crucial choices in relation to their roles as industrial relations actors. This paper investigates whether (and why) unions have chosen adversarial and/or co-operative relationships with the employers, based on a strategic choice conceptual framework. It focuses on trade union relations with employers at national, sectoral and company levels in Romania. It is argued that adversarial and co-operative relations between unions and employers developed simultaneously after 1989, but co-operation was the prevalent approach. Evidence suggests that ideological legacies, former institutions and the initial decision to participate in the macroeconomic transformation played a key role in shaping unions' choices towards co-operation with employers. Although this paper confirms the widespread view that labour is rather weak in Eastern Europe, it indicates that unions can be proactive and shape their own future if they have the capacity to mobilise their members and union leaders have the skills and willingness to use both conflict and co-operation in their relationships with employers. The comparison of evidence from Romania with other Eastern European countries reflects on the stage of Romanian transformation and also illustrates a wider possible applicability of the theoretical framework employed for the study.

International regimes have come to occupy an increasing space and importance within both politics among nations and the literature on international relations. Although the founding treaties of the European Communities were not declared as the founding treaties of a legal community, they had the features of a constitution from the beginning onward. The constitutional features of the founding treaties were concrete facts especially regarding principles of state of law included in the treaties. But the order of law that stemmed from the current founding treaties was complex. That development came into being without the will of the European peoples. The ultimate goal of the EU Constitution today is to complete the process of constitutionalization with the contribution of European peoples. The more the constitution stresses upon the priority of law, democracy, fundamental rights, freedoms as constitutional principles and the more it shapes institutional structure on democratic foundations, the faster the constitutionalization process will be complete and the discussion about the legitimacy of the EU will come to an end. That will make the acceptance of the EU law beyond any doubt.

One of the constant fundamental principles of Turkish foreign policy during the republican era has been its “Western orientation”. In spite of this fact Turkey faced an “Eurasian alternative” in the last decade. Turkey, after negligence for 70 years, has tried to develop (to have friendly relations) with Central Asian and southern Caucasian states after they had acquired independence. The attempt of the last ten years can be called as failure of the last ten years. Since the State and the Ministry of Foreign Affairs remained ineffective in the process of determining policy and implementing it, this vacuum was filled by extreme nationalists who are inclined to see themselves as “big brother” and also by religious fundamentalists. Moreover, reasons stemming from the region and international environment played a role in the failure of Turkish policies as well. In the second decade Turkey should determine the related factors and head toward to cooperate with regional countries and Russia in order to become successful in the region.

The concept of diaspora, which was incorporated into the literature on politics in the 1960s, has become a significant notion in current international politics. This study aims to present a theoretical assessment of the diaspora concept, followed by the organisation and the evolution of the Caucasian diaspora(s) in Turkey, which include Armenians, Azeris, Georgians and other North Caucasian peoples. It discusses their transformations from emigrants to diaspora, their views regarding each other as well as the changes that took place within these groups after the collapse of the Soviet Union which had a dramatic impact on their relations with their homelands. Following the collapse of the USSR, Turkey acquired a new opportunity concerning its foreign policy: Caucasus. In this whole region and especially in the southern Caucasus composed of three independent states, Armenia occupied the most critical and the most sensitive issue. Turkey, despite the historical negative legacy, tried to establish a different base for its relations with Armenia, succeeding the dissolution of the Soviet Union. According to this, it is possible to observe positive steps undertaken by the two sides under the presidency of Petrosian, but the Nagorno-Karabakh question became the decisive factor of the bilateral relations during this same period. During the presidency of his successor Kocharian, other than Nagorno-Karabakh problem, Diaspora communities gained influence. This led the so-called “genocide” issue to constitute an important subject of the international agenda in bilateral relations as well as in other international platforms. Despite the Kocharian's hawkish rhetoric in the beginning, which caused the deterioration of the bilateral relations, during the second term of his presidency, a certain détente has been observed. Apart from official relations and negotiations, the Turkish-Armenian Peace Commission, founded in 2001 with the intention to establish a positive, peaceful and free of prejudice platform constitutes an important step.

This article aims to analyze the relations between Turkey and Tajikistan in the aftermath of the dissolution of the Soviet Union. The relations between these two countries remained rather limited in the period of 1991-1994 because Tajikistan was not Turkic, faced negative economic conditions, went through a civil war, and had closer ties with Iran and Russia. Between 1995 and 2003, however, these relations improved as Turkey better realized the fact that Tajikistan was both an inseparable part of Central Asian geography and critical for regional stability. Furthermore, in this period, Tajik Civil War ended with an important political reconciliation. It is concluded that although there has been a relative improvement in Turkish-Tajik relations since Tajikistan's independence, it has not yet reached to a satisfactory level.

An increasingly accepted argument holds that terrorism has become a cheap enterprise. Louise Richardson, executive dean of the Radcliff Institute for Advanced Study at Harvard University, made just that case while testifying before the Senate Committee on Banking, Housing, and Urban Affairs in 2003. "The crucial point to bear in mind about terrorism, of course, is that it is cheap," Richardson said. She went on to argue that although the September 11 attacks cost $500,000, "It takes a great deal less to buy some fertilizer, rent a truck, and use them to bring down a building." If terrorism is cheap, as Richardson contends, then logic follows that financial counterterrorism measures are largely powerless to prevent terrorist attacks.

The August 3 bloodless military coup in Mauritania that removed president Maaouiya Ould Taya from power took place in one of the world's most impoverished nations, situated on Africa's northwest coast between Arab North Africa and black sub-Saharan Africa. The coup had all the familiar trappings of an African military overthrow of a corrupt and detested civilian regime. Mauritania has supported the American-led war on terror and actively supports Washington's counterterrorist and training operations in the trans-Sahara region. It is also among only three Arab League members (along with Egypt and Jordan) that maintain full diplomatic relations with Israel. The July 23 bombings at Sharm al-Shaykh offered a harsh reminder that Egypt remains vulnerable to Islamists who see terrorism as their only viable means of affecting political change. Anatolian Eagle is one of the largest and most complex joint air force exercises in the world, paralleled only by Red Flag, held periodically at Nevada's Nellis Air Force Base, and the annual Maple Flag exercise in Canada. The Turkish Air Force (TUAF) is now preparing for the multinational leg of the next Anatolian Eagle, scheduled to take place September 12-23. Anatolian Eagle has obvious public relations value for Turkey and its air force as hosts of the event. Moreover, as an exercise mimicking realistic aerial war minutes away from the U.S. forces, it also serves as an important component of U.S.-Turkish military cooperation.
