Abstract:
This article analyses the interplay between politics and law in the recent attempts to strengthen the humanitarian commitment to saving lives in mare liberum. Despite a long-standing obligation to aid people in distress at sea, this so-called search and rescue regime has been marred by conflicts and political standoffs as states were faced with a growing number of capsising boat migrants potentially claiming international protection once on dry land. Attempts to provide a legal solution to these problems have resulted in a re-spatialisation of the high seas, extending the states' obligations in the international public domain based on geography rather than traditional functionalist principles that operated in the open seas. However, inadvertently, this further legalisation has equally enabled states to instrumentalise law to barter off and deconstruct responsibility by reference to traditional norms of sovereignty and maritime law. In other words, states may be able to reclaim sovereign power by becoming increasingly norm-savvy and successfully navigating the legal playing field provided by the very expansion of international law itself. Thus, rather than being simply a space of non-sovereignty per se, mare liberum becomes the venue for a complex game of sovereignty, law and politics.

Abstract:
This paper takes a closer look at the discourses of the EU and Russia in relation to the ground-breaking events in Kosovo (1999/2008) and the South Caucasus (2008) while digging deep into the discursive practices and contextual aspects of these conflicts. We will argue that, on a more abstract level, the EU and Russia were applying the same logic of discourse - either professing humanitarian concerns, including 'responsibility to protect', or emphasising 'obligation to refrain' - across these similar instances of intervention and secession declared to be exceptions by both. Across these cases, both actors were not only blurring the common understanding of these terms and the rules of their application in practice, but also advancing implicitly such blurring as, in fact, a norm. However, when the principles in relation to secession are blurred, it is easy to follow the examples of both Russia as well as the EU, depicting specific instances of secession selectively as exceptions and legitimating one's essentially arbitrary behaviour vis-à-vis the professed international norms.

Abstract:
This paper is concerned with Foreign Policy Analysis (FPA) and non-state actors (NSAs). Globalisation has brought NSAs back on the agenda of International Relations (IR). As a result of globalisation, we witness at least some shift of authority from the state to NSAs (the extent of which remains debated). Although most of the empirical studies focus on 'domestic' issues, there are good reasons to assume that foreign policy is equally affected by this trend. Not only are NSAs autonomous actors in world politics, they are also increasingly involved in the making of states' foreign policies. In this article, we ask to what extent FPA, IR's actor-centric sub-field, has taken into account this growing importance of NSAs. Given FPA's criticism of seeing the state as a unitary actor, one would expect FPA scholars to be among the first within IR to analyse decision making involving NSAs. However, a closer look reveals that FPA remains focused mainly on state actors, while ignoring private, transnational and international ones. Thus, FPA remains in a way state-centric. We close with an outline of possible directions for further FPA research.

5. Regional integration and the challenge of overlapping memberships on trade

Abstract:
Despite a plethora of policy and scholarly discussions on how overlapping memberships affect the implementation of rules of origin meant to facilitate trade within regional trade agreements (RTAs) of developing countries, there has yet to be any theory development or empirical test to verify these claims. This article re-examines these previous discussions and articulates and empirically tests a theoretical model on the effects that overlapping memberships have had on intra-RTA trade. Using measures of overlapping memberships at both the RTA and country levels of analysis, I find that overlapping memberships in RTAs involving developing countries have had a negative effect on intra-RTA trade levels. These findings shed light on steps developing countries can take to address overlapping memberships and strengthen regional integration at a time when there is a push for north-south trade agreements such as those the European Union is negotiating with several of these developing countries.

6. Practicality by judgement: transnational interpreters of local ownership in the Polish-Ukrainian border reform encounter

Abstract:
Local ownership has become a central norm of international statebuilding while its practice is seen as failure. This is explained either as an instance of organised hypocrisy where the norm is de facto circumvented or, in a critical vein, as a hegemonic projection of the neoliberal system of governance which by default erases local agency. Practitioners of statebuilding are seen as agents of moulding; social engineers in the policy discourse or conduits of the discursive structure from which they derive their 'professional reflex' and authority in the critical discourse. This article suggests that both designations misdiagnose the problem of action as being 'caused' by either norm transfer, or by norms being 'ingrained' in professional practices. It adopts a micro-perspective on the practice of embedded experts in a series of EU-sponsored projects to offer a contextual account of an on-the-ground interaction. The encounter between Polish and Ukrainian border guards highlights differential power relations and demonstrates the rich texture of the semantic field of 'local ownership'. The case nuances arguments about tacit institutional reproduction in transnational settings and the automaticity of norm diffusion among security professionals to illustrate instead a contingent role of 'practicality by judgement' in their action.

7. Neoclassical realism and international climate change politics: moral imperative and political constraint in international climate finance

Abstract:
In this article, I present a neoclassical realist theory of climate change politics that challenges the idea that cooperation on climate change is compelled alone by shared norms and interests emanating from the international level and questions if instead material factors also play a significant constraining role. Relative-gains concerns incited by the international resource transfers implicit in climate change policy may compel some states to be prudent in their international climate change efforts and conserve resources domestically for future contingencies, including their own adaptation and resiliency. Neoclassical realism recognises such systemic constraints while also identifying international and domestic factors—a 'two-level game'—that explain variation in state sensitivity to relative gains. As a preliminary test of this theory, I compare the latest data on the magnitude, distribution and financial 'additionality' of climate funds and carbon markets. Climate funds are found to be more vulnerable to systemic forces identified by neoclassical realism because they are largely drawn from existing official development assistance budgets despite international commitments that funds are 'new and additional'. Carbon markets engage a relatively broader number of states and, contrary to moral hazard concerns, have been used to a greater degree by states reducing emissions domestically. While there are concerns about whether carbon credits represent genuine emission reductions, the effectiveness of climate funds is equally, if not more, dubious. I conclude that, while imperfect, carbon markets have too often been unfairly compared with an ideal climate finance mechanism that assumes few political constraints on international resource transfers for climate change.

8. European integration and the problem of the state: universality, particularity, and exemplarity in the crafting of the European Union

Abstract:
The European Union is often presented as an entity that has 'moved beyond' the model of organising political life along the way of the modern sovereign state. This paper questions this understanding by engaging a set of texts that could be understood as exemplary of the EU's official discourse of Europe: EU's failed Constitutional Treaty and Javier Solana's collected speeches. A paradox is herein identified: the values that are said to sustain Europe's identity and upon which Europe is founded are simultaneously presented as distinctly European and universal. It is suggested that Europe is being crafted in a pendular oscillation between particularising and universalising the values upon which Europe allegedly rests. By drawing on critical International Relations theory, the paper suggests that this very contradictory oscillation between particularising and universalising Europe's values to an important extent mirrors modern statecraft. One should therefore think twice before announcing the construction of the European Union as something qualitatively different from, or 'gentler' than, modern statecraft.

Abstract:
The primary objective of this article is to theorise transformations of Western order in a manner that does not presuppose a fixed understanding of 'the West' as a pre-constituted political space, ready-made and waiting for social scientific enquiry. We argue that the Copenhagen School's understanding of securitisation dynamics provides an adequate methodological starting point for such an endeavour. Rather than taking for granted the existence of a Western 'security community', we thus focus on the performative effects of a security semantics in which 'the West' figures as the threatened, yet notoriously vague referent object that has to be defended against alleged challenges. The empirical part of the article reconstructs such securitisation dynamics in three different fields: the implications of representing China's rise as a challenge to Western order, the effects of the transformation of the North Atlantic Treaty Organisation (NATO) towards a global security actor, and the consequences of extraordinary renditions and practices of torture for the normative infrastructure of 'the West'. We conclude that Western securitisation dynamics can be understood as a discursive shift away from a legally enshrined culture of restraint and towards more assertive forms of self-authorisation.

Abstract:
This article develops a new conceptual framework of 'moral power' by arguing that the 'civilian'/'normative' power Europe paradigms are insufficient for understanding the essence of the conflict resolution policy of the European Union (EU) in the South Caucasus. Analysing the conflicts of Abkhazia, South Ossetia and Nagorno-Karabakh, the study reveals that until the August 2008 war, the EU was an incoherent actor in terms of the interplay among its institutions and member-states. The EU's policy has been devoid of a long-term peace-focused strategy, making it inconsequential; as a result, the EU has merely dealt with, rather than managed, the conflicts. Its rhetoric has been inconsistent with practice. Often the EU has subordinated its values to material and power-related interests. Moreover, the EU has hardly been normatively stable in its approach to the Nagorno-Karabakh conflict. Bypassing inclusiveness until the launch of the Geneva talks pertaining to the Abkhazian and South Ossetian conflicts, the EU has not enjoyed much legitimacy by the de facto states. Whereas the EU has largely failed to resolve the South Caucasian conflicts, it has achieved partial success by putting a halt to the 2008 hostilities between Russia and Georgia. Overall, having faltered as a 'civilian'/'normative' power it still has to fare as a 'moral power'.

Between the 1960s and the 1970s, Brazil and South Korea adopted similar strategies of development under authoritarian rule: an import substitution industrialisation (ISI) programme later replaced by export strategies (ES), namely, export promotion (EP) in Brazil and export-led growth (EG) in Korea. However, whereas Korea was successful, Brazil began the 1980s facing socio-economic crisis because of imbalances in external accounts. Through the analysis of institutions, organisations, and economic indicators, I conclude that the social-political structure (defined as the institutions and organisations within the economic, political, and social levels) of each nation shaped differently the opportunities given by changes in the organisation of the domestic economy and international contexts between 1945 and 1985. The social-political institutions, which last longer than organisations, come mainly from Portuguese (in the case of Brazil) and Japanese (in the case of South Korea) colonisation. Therefore, the impact of historical junctures, such as economic transformations influenced by changes at the international level, might be restricted to organisations at the domestic level as institutions related to pre-industrial periods persist and constrain the reach of modernisation.

Abstract:
The post-crisis administration of Néstor Kirchner (2003-2007) saw significant changes in the political economy of Argentina. After characterising these changes this article attempts to place the evidence within an appropriate meta-theoretical interpretation. The article concludes that while elements of historical forms of political economy exist in Néstor Kirchner's regime - elements of populism, elements of neoliberalism - in its entirety, one must look to other explanations not traditionally associated with Latin America, that is, the developmental regime. Such a conclusion facilitates both an enhanced understanding of post-crisis Argentine political economy, and an opportunity to further develop a developmental regime approach.

14. Local orders in international organisations: the World Health Organization's global programme on AIDS

In 1990, the World Health Organization (WHO) started to downsize its renowned Global Programme on AIDS, despite continued donor and member state support. This turnaround has decisively contributed to WHO's loss of leadership in HIV/AIDS politics. From the viewpoint of both rationalist and constructivist theories of international organisation (IO) agency, an IO engaging in 'mission shrink' is a striking irregularity. In order to account for such apparently self-defeating behaviour, this article adopts an open systems view of IOs and identifies trans-organisational coalitions as important agents of IO change. I argue that subunit dynamics rather than systemic conditions drive IO behaviour, in particular where member states' material power and their formal control of organisational veto positions do not coincide. This approach will be used to retrace the changes in subunit coalitions that drove WHO's erratic HIV/AIDS programme and thus to solve this puzzle of 'mission shrink'. On the basis of insights from the WHO case, the article concludes by offering a heuristic of trans-organisational coalitions and the types of IO change associated with them.

15. Democracy, social welfare and political violence: the case of Latin America

Abstract:
The return of democracy in Latin America has been associated with a decline in political violence, but also with a failure to redress welfare troubles or restore social justice. This essay provides an exploration of these problematic relationships. It argues that the impact of democracy on social welfare and internal civil violence is complex, develops unevenly and is mediated by a host of contributing factors. The bearing of democracy on political violence has been especially weak. In some countries democratic elites played a role in reducing or eliminating armed conflicts by offering a series of political concessions to the opposition, in particular communication channels with the government and social and political rewards. However, political violence survived or intensified under democracy elsewhere, while it was eradicated by force and (less frequently) by concessions in a number of authoritarian settings. Democracy has also affected welfare policies, through the appearance and progressive strengthening of social organisations and political parties that favoured channelling benefits towards the less advantaged. Yet, welfare protection also took place under populist and authoritarian governments, and it was influenced by a series of additional economic, political and social factors.

This article examines the concepts of globalisation and imperialism, both in terms of their explanatory status, and in the light of changes in the international order since the end of the Cold War. It does so both through detailed theoretical and empirical analysis, and in part through focusing on a key contributor to this debate, Justin Rosenberg. It is argued that Rosenberg's theoretical post-mortem for globalisation is correct. However, it is also argued that Rosenberg's historical post-mortem is far less convincing, not least when related to his subsequent attempts to draw on the concept of uneven and combined development in order to explain the reality of geopolitical conflict in the international order. It is here that the concept of imperialism enters the picture, and the article suggests that attempts to update theories of geopolitical competition based on Lenin and Bukharin's work on imperialism are unconvincing, as they fail to take full account of the changes in the international order since 1945. These changes - the internationalisation of capital and rise of global production networks, the rise of manufacturing in the developing world, the internationalisation of the state, cooperation between developed capitalist powers, and US hegemony - are well described, if not necessarily explained by the concept of globalisation. However, this does not mean that the concept of imperialism is no longer of use, and the idea is defended through a discussion of the hierarchies associated with the globalisation of production. It is further illustrated by relating liberal military intervention to this continued reality of global hierarchy and inequality in the international order. The article concludes by defending the ideas of imperialism and uneven and combined development, but argues that these cannot be used to explain the nature of the international state system (or geo-politics), but rather the hierarchies associated with the international capitalist order (or political economy).

Abstract:
In this article, we examine the formation of Russia's energy policies vis-à-vis Europe and the Far East. As energy policy is a very complex field, we propose a new structurationist analytical model to deal with that complexity. Our model highlights the practices by which actors acquire information of their policy environments, which are conceptualised as structures enabling and constraining their actions. These practices involve intentions, interests and schemata. In our case analyses - the Nord Stream pipeline project and the Sakhalin Island's energy politics - we find that profit interests, as part of a wider business frame, most centrally guide Russian actors. The often-hyped energy superpower frame is found to be ambiguous. It generally does not bring the intentions of Russian actors together well, even if such a frame resonates with some of Russia's European customers. Energy security frames are found to be prevalent among Russia's customers and are highly differentiated. Environmental frames are mostly instrumentally deployed. Russian energy actors are capable of displaying collective intentionality, but are incapable of fully controlling the various dimensions of the complex policy environment.

Abstract:
The creation of parliamentary bodies for regional organisations such as Association of Southeast Asian Nations (ASEAN) or Mercosur seems to be at odds with the intergovernmental logic on which these organisations rest. We approach this puzzle from the perspective of norm diffusion theory. In the article we argue that transnational legislative bodies in Southeast Asia and South America have been primarily established to retain the respective organisation's 'cognitive prior', which in both cases rests upon deeply entrenched corporatist norms and ideas. We test our theoretical claims by a comparative study on the emergence and evolution of the ASEAN Inter-Parliamentary Assembly and the Mercosur Parliament.

19. Actor-networking the 'failed state' - an enquiry into the life of concepts

Abstract:
Concepts such as the 'failed state' are jointly produced by academics and political actors and hence connect academia and global politics. Little attention has been spent to study such concepts and the practices that create them and sustain their relevance. We develop an innovative framework for studying concepts. Relying on actor-network theory, we suggest studying concepts as effects of relations between different actors building an actor-network. We introduce actor-network theory and demonstrate its value for international relations (IR) research. Our empirical case study of the concept of failed states combines bibliometric analysis and qualitative text analysis. We show how various actors have brought the concept of failed states to life; analyse how actors transformed because of their participation; and investigate the persistent struggles to define and homogenise the concept. In summary, this is an article about the life of the failed state, the discipline of IR and its relations to other actors, and an introduction of the actor-network theory toolbox to the sociology of IR.

The purpose of this article is to expand upon Hedley Bull and Adam Watson's work The Expansion of International Society (1984a), initially theoretically and thereafter through empirical illustrations. The premise is that Bull and Watson's approach can only take study of the expansion so far, as it creates silences that neglect aspects of international history that were central to the expansion process. As such, I initially focus on three features of Bull and Watson's theoretical approach that are thought to create these silences and a problematic Euro-centrism: historical periodisation, a neglect of non-European regions and the system/society distinction. I thereafter argue that the original Expansion's periodisation scheme needs to be broadened, that research into non-European regions before European contact is necessary and that interaction at the world society level should be considered. The benefits of this new approach are then illustrated, first in a study of the West African international society in its own right, and then in a study of the Afro-European interaction that took place in the context of that society. Ultimately, this new approach suggests that the expansion process was driven largely by the exchange of norms and ideas at the world society level and by the emergence of mutually constructed institutions over the course of several centuries.

This article seeks to systematise and advance the theoretical debate on the causes and conditions for the privatisation of security. Drawing on previous research on private military and security companies (PMSCs) and theories from International Relations and Comparative Politics, it reconstructs functionalist, political-instrumentalist and ideationist explanations for why and under what conditions even 'strong' and democratic Organisation for Economic Co-operation and Development states (extensively) use PMSCs. An analysis of inter-temporal and cross-national (United States, British, German and French) patterns of security privatisation indicates that all the three theoretical models point out causes and conditions that are relevant for a comprehensive explanation, but none is sufficient alone. Therefore, the article uses both the models and the empirical evidence to propose a synthetic perspective, which treats different explanatory conditions and logics as complementary, rather than rival. Going beyond the atheoretical conclusion that a multitude of disconnected factors are in some way relevant for a comprehensive explanation of security privatisation, I develop a thin and a thick synthesis that rely on a domain-of-application approach and sequencing, respectively. The thin synthesis spells out how different explanatory factors operate in specific domains, whereas the thick synthesis elaborates how different conditions and mechanisms apply to different phases of security privatisation and how they interrelate.

Abstract:
'Human Nature' is back—and not only in JIRD, which had a special Symposium on the topic several years ago (Freyberg-Inan 2006; Hall 2006; Mercer 2006; Sterling-Folker 2006). Two reasons seem particularly relevant for the discussion here and now. First, and for quite a while now, our normative discussions struggle with or indeed vacillate between a universalism with problematic foundations and a pluralism suspect of relativism. Second, our theories of action smuggle in assumptions about human nature upon which the impetus for a certain behaviour is to be understood, but which are often conveniently left out of the analysis. For instance, with the advent of constructivism in International Relations, the existence and explanatory status of 'rump materialism' is again up for discussion. More fundamentally, the classical dichotomies of 'mind/body' and of 'reason/emotion' have been found wanting. In this context, finding some kind of foundation in a potentially universal Human Nature would be a help welcomed by many.
