11901. China's Data Strategy: Creating a state-led market

Abstract:
In 2019 and 2020, the European Union, the United Kingdom and the United States issued strategy papers on data governance acknowledging the importance of data to their economic development and national security. With different emphases, four competing objectives dominate these data strategies: innovation (using data to create new business models and boost economic growth); security (ensuring that sensitive data is not used by a hostile foreign power); privacy (protecting citizens from abusive use of personal data); and surveillance (using data to monitor and control citizens’ and companies’ behaviour). In the past two years, China has been defining its own data strategy and governance regime and, while juggling the same four competing objectives as its Western counterparts, is taking an innovative approach. While the specific data governance framework is still being debated among scholars, policymakers, industrial lobbyists and state institutions, local pilot regulations on data and stakeholders’ public positions have already hinted at its future characteristics. This Brief aims to shed light on these debates over China’s emerging data governance framework. It starts by describing the objectives of the framework, then summarises the debates around the new data rights that Chinese policymakers are establishing and analyses China’s first local pilot regulations defining those rights. The Brief then focuses specifically on health data to illustrate how China'sdata governance regime is designed to work. Finally, the Brief gives an overview of the challenges that China’s data governance framework presents for EU governments and companies. Ultimately, China’s data governance regime will have important implications for the protection of EU citizens’ data and creates a risk of data protectionism. It is therefore crucial that the EU understands early enough the direction that China is taking, so that it can respond appropriately.

11902. Creativity Wanted: Countering the extraterritorial effects of US sanctions

Scarcely familiar with sanctions as a policy tool, much of the European public has followed the headlines about international sanctions with some puzzlement. After the UN lifted sanctions on Iran following the conclusion of the Joint Comprehensive Plan of Action (JCPOA), why was it necessary to create a channel for bilateral trade, the Instrument in Support of Trade Exchanges (INSTEX), following the US withdrawal from the deal in 2018? Why is Iran insisting that the US lift sanctions ‘in practice, not verbally or on paper’? How did the US Senate approval of new legislation targeting Nord Stream 2, a pipeline under construction between Russia and Germany, bring work to an immediate standstill in late 2019? Why do European banks and private companies fear the US Department of the Treasury’s sanctions enforcement agency, the Office of Foreign Assets Control (OFAC)? If sanctions regimes are endowed with humanitarian exemptions, why do humanitarian agencies report difficulties in getting aid to places like Syria ? As it turns out, these are ramifications of the same phenomenon: the extraterritorial effects of US sanctions. The present Brief examines these effects, describing why they pose a challenge to the EU. It then outlines the responses that have been activated or are being contemplated to counter them, explaining why an effective remedy remains elusive. The Brief concludes by indicating possible ways forward.

11903. Pivoting to African Conflict Prevention? An Analysis of Continental and Regional Early Warning Systems

Abstract:
Early warning systems (EWS) are at the heart of conflict prevention strategies, particularly as a component of operational prevention. EWS support decision-makers with timely information, analysis and response options. Although the first generation of EWS have been around since the 1970s and 1980s, they did not come to prominence until the 1990s. In the aftermath of the war trauma in Somalia and the Mano River region (Liberia and Sierra Leone) and the 1994 Rwanda genocide, African EWS – in particular those of the Organisation of African Unity, its successor, the African Union (AU), and the Economic Community of West African States (ECOWAS) – were developed to address threats to human security. These EWS have served as a strong foundation for early warning and early action (EWEA) in the continent. Many lessons have been learned in particular from West Africa’s experience, namely from the ECOWAS Early Warning and Response Network (ECOWARN), launched in 2003. ECOWARN has the capability to reform institutions from within the organisation and take grassroots perspectives into account, positioning it as the most advanced regional EWEA system in Africa. Creating the AU in 2002 marked a shift from non-intervention to non-indifference at the continental level. The African Peace and Security Architecture (APSA) was an opportunity for African states to display strong political will to develop conflict prevention and resolution mechanisms, by establishing the Continental Early Warning System (CEWS) as one of the APSA’s five components. Over the years, multiple reinforcements have provided African institutions and member states with human, logistical and financial capacities to monitor, analyse and develop tailored and timely responses and policy options to address security challenges. Yet the EWEA gap, at both continental (CEWS) and regional (ECOWARN) levels, remains substantial and affects the full operationalisation of the prevention agenda. Why have political decision-makers not implemented those preventive tools adequately? How can closer relationships between regional and continental EWS in Africa bridge the EWEA gap? To answer these questions, this Conflict Series Brief investigates the challenges and opportunities of cooperation between ECOWARN, the most sophisticated African regional EWEA system, and CEWS, a continental hub for data collection and analysis. It begins by analysing the impact of a lack of clear and systematic collaboration between regional and continental organisations on the development of the overall African EWS. While challenges remain in the institutional division of labour between the AU and ECOWAS, there has been progress in designing their EWS and implementing data collection and analysis. The second part of this Brief argues that the persistent EWEA gap lies in three main challenges on which CEWS and ECOWARN have focused their efforts: the lack of regular interaction between early warning (EW) officials and decision-makers, the unpredictability of conflict dynamics and the political dimensions of conflict responses. The Brief concludes by presenting some lessons learned for Africa’s prevention agenda.

11904. Digital Technologies and Civil Conflicts: Insights for peacemakers

Most attention relating to digital technologies and conflict has focused on cyber or information operations between states.1 Yet, it is civil conflicts that have increased in number and become more protracted over the past decade due to a number of factors, including their increasingly internationalised character.2 Moreover, it is in these contexts that societies are more vulnerable and likely to be more affected by the misuse of digital technologies; and it is in these contexts that states show less restraint in their behaviour and can cause more harm to civilians. Mediating or facilitating a solution to civil conflicts, already an enormously difficult task, is compounded by the ways in which numerous actors use digital technologies to disrupt or delay conflict resolution efforts. For mediators and others engaged in peacemaking efforts, understanding these challenges is critical to designing already charged engagement strategies. This Conflict Series Brief attempts to shed light on some of the risks associated with the use of digital technologies that can negatively impact mediation or negotiation efforts in civil conflicts, and examines how peacemakers might address them. Hence, rather than elaborating on the positive uses these technologies offer to mediators, which are already addressed by an emerging literature, we focus on clarifying the additional challenges conflict parties’ use of digital technologies impose on peacemakers. Specifically, this Brief: highlights how digital technologies can undermine peacemaking efforts; summarises the international law, norms and other such measures applicable to the behaviours of the conflict parties in their uses of digital technologies; and suggests a broader approach to stakeholder analysis. On this basis, we illustrate and visualise an analytical framework (see page 4) suggesting how these three main aspects might be flexibly addressed depending upon the specific context. The final section offers some concluding remarks and recommendations.

Abstract:
Over the last few decades, analysis of international relations and strategic issues has developed rapidly in China, both within the Chinese Communist Party– state apparatus and in think tanks and universities. However, the richness of this field of study is in stark contrast to the absence of any real open reflection on the question of foresight. If, like other nations, China is committed to understanding the world in which it is evolving and to identifying possible changes, the function of foresight has not been conceptualised or institutionalised to the same degree as in the West. Foresight analysis in China is marked by several salient features: firstly, it remains almost non-existent in Chinese institutional frameworks dedicated to the analysis of international relations; secondly, the concepts of the ‘black swan’ and the ‘grey rhino’ have made a significant breakthrough, particularly in economics, before being cannibalised and politicised by the Party; and thirdly, the reading of the horizon remains essentially informed by the Party’s vision, fears and obsessions.

11906. Curse or Blessing? How cheap oil influences conflict dynamics

Abstract:
When the price of oil goes down, there is often a sigh of relief among oil-importing countries, as cheap oil means a boost for the economy and increased savings for consumers and businesses. As a result, most of Europe tends to notice price shocks only when prices go up: consumers are squeezed while producers accumulate enormous wealth. Yet, for oil-exporting countries cheap oil means increased poverty and tighter budgets – a recipe for instability and conflict. This Conflict Series Brief analyses the effects of the recent pandemic-induced oil price shock on three vulnerable, conflict-affected countries. This is done by testing the two competing theories of the resource curse and of the rentier state, each offering a different interpretation of the oil-conflict nexus: The resource curse theory posits that an abundance of natural resources, and in particular oil, raises the probability, frequency, and intensity of conflict. The rentier state theory sees the presence of oil as having a positive effect on peace, as regimes use revenues to either buy off political opposition or suppress it. The recent price crash and its effects on conflicts in South Sudan, Libya and Iraq provide empirical support to the analysis. This Brief argues that both the stabilising and destabilising mechanisms identified in the two grand narratives are simultaneously at play in oil-rich countries. It shows that oil prices occupy a central role in determining which theory provides the most accurate outcome prediction. As a result, we hope to get a better understanding of the often-counterintuitive role that the resource plays in the onset of civil war. Building on the experience of the 2020 pandemic price plunge, the Brief ends with an overview of the future challenges that cheap oil will entail for producers and for Europe as oil demand peaks and the world moves away from fossil fuels.

The United States is a highly polarised society. Over the past decade, any consensus about how it views itself or its future has broken down despite the country having well-grounded capabilities on foresight which could help steer it towards a united vision and the steps needed to realise its desired future. It is unclear whether the Biden administration can project a vision that appeals to most Americans, binding together a nation deeply split in its view of America and its role in the world. At the tactical level, foresight tools and mechanisms remain in use throughout the bureaucracy even if they have not been able to reconcile contrasting societal perspectives. 2016 was a dramatic turning point in which the US Intelligence Community – the leading foresight practitioner in the US government – fell out of favour with the president and many of his senior advisors. Biden’s vision for the country embraces diversity and renewed US leadership in the world. Biden’s Secretary of State Antony Blinken talks about humility and confidence being “the flip sides of America’s leadership coin”,1 repudiating Trump’s America First stance.

11908. In Russia's Hands: Nagorno-Karabakh after the ceasefire agreement

Nearly five months have passed since the 9 November 2020 ceasefire that ended the second Nagorno-Karabakh war. The conflict broke out as a culmination of tensions that had been mounting for years, and had already resulted in two smaller flare-ups (one in April 2016 and another in July 2020). The war took a heavy toll on the lives of Azerbaijani and Armenian civilians, as well as claiming the lives of altogether more than 5,000 fighting personnel, and resulted in the displacement of approximately 70,000 Armenians from Nagorno-Karabakh. This Brief analyses to what extent the ceasefire agreement has provided the ground for a lasting, stable and sustainable settlement. While the overall stability of a post-conflict situation may depend on a range of factors, this analysis focuses on three main variables that could affect the resilience of the post-war status quo in the medium and long run. The first and second of these – the stability of the present post-war territorial configuration and the uncertain future legal status of the parts of Nagorno-Karabakh that continue to be administered by the separatist de facto authorities – constitute underlying, inherent weaknesses of the ceasefire agreement. The third and probably most important factor is the Russian peacekeeping contingent deployed to Azerbaijan in order to maintain the ceasefire, because it brings in Russia’s political will as an independent variable that could fundamentally shape the overall settlement process. The deployment of Russian troops into Azerbaijan deserves special attention, because there is a theoretical possibility that it may lead to a new ‘freezing’ of the Nagorno-Karabakh conflict resolution process, instead of politically settling the conflict itself. The core problem is that should Moscow decide to keep its troops on Azeri soil even after their original five-year mandate expires, it is unlikely that Azerbaijan could prevent such a scenario. The Brief is structured as follows: in the first section, the weaknesses of the ceasefire agreement are analysed, while in the following section the role and potential future outcomes of the Russian peacekeeping mission are examined. The concluding section offers a forward-looking perspective on the post-war status quo.

11909. Securing the Heavens: How can space support the EU's Strategic Compass?

It may be customary to begin an analysis on space by referencing famous sci-fi productions such as Star Trek. Yet terms such as ‘final frontier’ or ‘to boldly go where no man has gone before’ are outdated. Today, space is used for countless civil and military applications and it is an increasingly contested and congested political and technological arena. While it is true that space is not yet home to photon torpedoes or deflector shields, reality is starting to catch up with the sci-fi world. Consider that the United States took the decision in December 2019 to create a ‘Space Force’ and in September 2020 France created an ‘Air and Space Force’, which followed on from the creation of a Space Command in 2019. Germany too took the decision in September 2020 to create an ‘Air and Space Operations Centre’. A month later, NATO created its first-ever Space Centre in Germany and in 2021 it was decided that France would host the new NATO Centre for Excellence in military space. Additionally, other EU countries such as Italy have established space-defence capacities and on 8 March 2021 France started its first-ever military space exercise, Aster X 2021.

11910. How the Islamic State Sees the Future: Why the end of times does not mean the end

One would not exactly think of the Islamic State (IS) as a future-oriented organisation: it uses medieval-sounding language and barbaric methods and preaches an archaic lifestyle. In reality, however, it is very much a forward-looking organisation with clear ideas not just on what the future will bring, but on what it should bring. In fact, it is this attitude towards the future that has not only enabled its past successes, but also allowed the organisation to persist and endure since losing its territory in Syria and Iraq – and, most importantly, what will determine its next steps and ambition. Understanding how IS conceives its own future will enable law enforcement authorities to take the necessary precautions ahead of time. This Brief first outlines why it is crucial to understand how the future as an organising principle shapes the strategy and posture of terrorist organisations, and shows that terrorist organisations lacking such a concept will lose traction faster than those that do. It goes on to examine IS’s future concept pre-and post-loss of its territory and to elaborate why it was and is an attractive future. Lastly, it seeks to anticipate the future trajectory IS will take based on its articulation of an eschatological vision of the future.
