Abstract:: The case of Muhammad Salah, a Palestinian-American grocer and Chicago resident, is the longest-running terrorism case in the United States. He was brought to trial on terrorism-funding charges in October 2006 after a thirteen-year saga that began with his January 1993 arrest in Israel as the "world commander of Hamas" and that continued in the United States following his release from Israeli prison in late 1997. Though acquitted of all terrorism-related charges by a U.S. federal jury in Chicago in February 2007, Salah was convicted on a single count of obstruction of justice. In this exclusive report for JPS, Salah's lawyers recount the unfolding of this landmark and labyrinthine case, analyzing its legal underpinnings and implications. His prosecution served to advance new standards governing the admissibility of coerced confessions at trial and the use of secret evidence, while at the same time establishing new procedures for preventing the cross-examination of key witnesses and closing the courtroom to the press and public during crucial testimony. Even before his U.S. trial, his taped confession extracted under Shin Bet torture served as the linchpin of the U.S. government's investigation and prosecution of persons it suspected of providing material support for Palestinian resistance to Israeli occupation. More broadly, the years covered by the case show the erosion of the rule of law in the United States, as well as the melding of the discourses, strategies, tactics, and aims of U.S. and Israeli law enforcement and intelligence bodies long before the post-9/11 launch of the "global war on terror." Part I of this two-part account lays the ground for the 2006-7 Chicago trial, covering the period of Salah's arrest, interrogation, and imprisonment in Israel and the investigations and legal proceedings against him upon his return. Part II will focus on the crafting of the case by the Justice Department under Pres. George W. Bush and the trial itself.

Abstract:: In awarding Sahar Khalifeh's Sura wa ayquna wa 'ahdun qadim (2002) the American University in Cairo's 2006 Naguib Mahfouz Medal, the jury aptly lauded this "narrative of loss par excellence . . . [as] simultaneously historiciz[ing] for the current Palestinian struggle while summoning a whole array of the symbolic." From its very title, The Image, the Icon, and the Covenant divulges its biblical symbolism, which will be made to bear here further layers of political allusion. Ostensibly the story of a doomed love and the desperate pursuit of its traces decades later, this is a novel of "national allegory," as in Fredric Jameson's formulation.

Abstract:: As minister of state in the Northern Ireland Office in 1994, Michael Ancram was the first British minister to meet with Sinn Fin and the Irish Republican Army (IRA) in 25 years, overseeing talks between Sinn Fein and the British government that began the peace process that ultimately resulted in the decommissioning of the Provisional Irish Republican Army in 2005 and the formal implementation of power-sharing in 2007. This is not only due to the revival of the Taliban, but also because little has been done to try to ensure that families, communities, and tribes - the fundamental units of Afghan society - get on better with each other. War has fractured the social fabric of the country and, in the context of severe and persistent poverty, local disputes have the potential to turn violent and to exacerbate the wider conflict. But there is no effective strategy to help Afghans deal with disputes in a peaceful and constructive way.

1106. Sri Lanka's Return to War: Limiting the Damage

Abstract:: Sri Lanka is in civil war again, and there are no prospects of a peace process resuming soon. On 2 January 2008, the government announced its withdrawal from a ceasefire agreement with the Liberation Tigers of Tamil Eelam (LTTE). This formalised a return to conflict that has been underway since 2006 but also presaged worse to come. The humanitarian crisis is deepening, abuses of human rights by both sides are increasing, and those calling for peace are being silenced. There is no present chance of a new ceasefire or negotiations since the government, despite pro forma statements in favour of a political solution, is dependent on hardliners and appears intent on a military decision. International actors must concentrate for now on damage limitation: protecting civilians from the war's worst effects and supporting those working to preserve Sri Lanka's democratic institutions.

1107. Political Murder in Central Asia: No Time to End Uzbekistan's Isolation

Abstract:: There are strong indications that Uzbek security forces murdered one of Kyrgyzstan's most prominent journalists, Alisher Saipov, in October 2007 during the build-up to Uzbekistan's end of year presidential elections, most likely because of his involvement in Erk (Freedom), a leading exile opposition party. If this is the case, it would appear that the security organs, which are the key to keeping President Islam Karimov in power, are increasingly willing to move against any perceived danger, even if it involves pre-emptive strikes in foreign territory. This may be a sign not only of the ruthlessness of the regime but also of its increasing fragility. At the least it underlines the need for the U.S. and the European Union (EU) to resist the temptation to respond to Karimov's dubious December 2007 re-election with efforts at re-engagement, in the apparent hope of regaining or retaining military bases for Afghanistan operations or of outflanking Russia.

1108. Afghanistan: The Need for International Resolve

Abstract:: Afghanistan is not lost but the signs are not good. Its growing insurgency reflects a collective failure to tackle the root causes of violence. Six years after the Taliban's ouster, the international community lacks a common diagnosis of what is needed to stabilise the country as well as a common set of objectives. Long-term improvement of institutions is vital for both state building and counterinsurgency, but without a more strategic approach, the increased attention and resources now directed at quelling the conflict could even prove counterproductive by furthering a tendency to seek quick fixes. Growing tensions over burden sharing risk undermining the very foundations of multilateralism, including NATO's future. The U.S., which is demanding more commitment by allies, must realise that its unilateral actions weaken the will of others. At the same time, those sniping from the sidelines need to recognise that the Afghan intervention is ultimately about global security and do more.

Abstract:: The violent crushing of protests led by Buddhist monks in Burma/Myanmar in late 2007 has caused even allies of the military government to recognise that change is desperately needed. China and the Association of Southeast Asian Nations (ASEAN) have thrown their support behind the efforts by the UN Secretary-General's special envoy to re-open talks on national reconciliation, while the U.S. and others have stepped up their sanctions. But neither incomplete punitive measures nor intermittent talks are likely to bring about major reforms. Myanmar's neighbours and the West must press together for a sustainable process of national reconciliation. This will require a long-term effort by all who can make a difference, combining robust diplomacy with serious efforts to address the deep-seated structural obstacles to peace, democracy and development.

Abstract:: Although recognized as a political flashpoint, the Iraqi province of Kirkuk is suffering from a largely overlooked security crisis that has improved little since the beginning of the 2007 U.S. military "surge." The decline in reported insurgent attacks in Kirkuk has been relatively small, dropping from a monthly average of 169 violent incidents in 2007 to 122 in 2008. This 28 percent decline compares with 91 percent in Baghdad during the same period, and the per capita number of attacks in Kirkuk city is actually twice that of Baghdad. Considering these statistics, providing security support for the political process in the tense months and years to come has become a critical priority.

Abstract:: When Barack Obama assumes office on January 20, 2009, the president-elect will face many pressing issues. The strategic case for careful and active management of Iraq policy, however, remains strong. Iraq has at least 115 billion barrels of proven oil reserves (9.3 percent of the world total) and borders Iran, Syria, Saudi Arabia, and Turkey. This vital Middle Eastern country could become a terrorist thoroughfare and the scene of future regional wars or it could become a stable and prosperous U.S. ally. What matters now is not how U.S. presence in Iraq started, but how it will change in the next four years. It may be far more economical to finish stabilizing Iraq under the relatively favorable present conditions compared to the unknown and potentially unfavorable situation of the future. Iraq retains the potential to contribute to U.S. policy objectives in the Persian Gulf region and the broader Islamic world. It could yet emerge as a strong democratic state at the center of the Middle East.

Abstract:: Insurgency and counterinsurgency as types of warfare are currently subject to considerable attention due to the nature of the high-profile struggles underway in Afghanistan and Iraq. It is prudent to note that neither insurgency nor the strategy and tactics required to combat it represent new phenomena. A large body of experience and literature from the twentieth century and earlier exists that addresses both sides of the insurgent struggle. Some characteristics of insurgencies are largely immutable, since insurgency is ultimately a form of warfare that is adopted when a combatant has limited resources and limited choices for how to fight against a more powerful adversary. Today as in the past, these characteristics include employment of small-unit attacks, ambushes, assassinations, propaganda activity, and the development of covert infrastructure. Nevertheless, the primary insurgencies active in the twenty-first century are marked by important differences from earlier struggles, particularly in the areas of motivation and inspiration. Rather than being quintessentially political and interested in local or national grievances, many contemporary insurgencies are at their core linked to a particular interpretation of Islam. Thus, these insurgencies represent a war of religion, not of politics, economics, or ethnicity. Islamist insurgencies are likely to be uncompromising and averse to negotiation, absolutist and pan-national in their goals, and willing to justify the mass slaughter of non-combatants who do not share their religious vision.

Abstract:: The Russia-Georgia conflict has transformed the contemporary geopolitical world, with large consequences for peace and security in Europe and beyond. Moscow's initial moves into South Ossetia as large-scale violence broke out there on 7-8 August were in part a response to a disastrous miscalculation by a Georgian leadership that was impatient with gradual confidence building and a Russian-dominated negotiations process. But Russia's disproportionate counter-attack, with movement of large forces into Abkhazia and deep into Georgia, accompanied by the widespread destruction of economic infrastructure, damage to the economy and disruption of communications and movement between different regions of the country, constitutes a dramatic shift in Russian-Western relations. It has undermined regional stability and security; threatened energy corridors that are vital for Europe; made claims with respect to ethnic Russians and other minorities that could be used to destabilise other parts of the former Soviet Union, with Ukraine a potential target; and shown disregard for international law.

1123. Half Full or Half Empty: Assessing Prospects for Peace in Lebanon

Abstract:: On the surface, peace has broken out in Lebanon, bringing to an end the 18-month political impasse between the governing March 14th coalition and opposition March 8th parties. Following a week of sectarian violence in Beirut, Tripoli and the Chouf mountains—the worst since the end of Lebanon's 15-year civil war in 1990—the opposing sides agreed to undertake talks in Qatar to resolve their longstanding political stalemate. The Qatari-sponsored Doha Accord that broke the logjam paved the way for the May 25 election of former Army Commander Michel Suleiman as a consensus president, to be closely followed by the formation of a national unity government and the adoption of a revised election law. The re-invigoration of Lebanon's political institutions, the opening of parliament and ending of the presidential vacuum are welcome signs of a return to what passes for normalcy among Lebanon's confessional elites; they are not however a return to the status quo ante. For many months Arab League Chairman Amr Moussa, like French Foreign Minister Bernard Kouchner, had tried to cajole the Lebanese belligerents into a compromise deal based on the much-vaunted concept of "no victor, no vanquished". These efforts failed. The fact that Doha succeeded where others did not is a clear indicator that there were indeed winners and losers. Therein lies the potential for future conflict.

Abstract:: American society, it is now frequently stated, is more politically polarized than at any time in recent memory, and a prominent front in the ideological battle between left and right is foreign policy. Most notable is, of course, the war in Iraq, but divisions between Republicans and Democrats over the proper definition of the national interest have been a feature of the post-Cold War era since its inception. Democrats and the left direct most of their ire at the neoconservatives who, they argue, have masterminded America's grand strategy since the terrorist attacks of September 2001. This partisan conflict, a genuine ideological difference, has somewhat distracted from divisions within the right. Neoconservatives have also faced significant criticism from other factions within the Republican Party. Condemnation from both traditional conservatives and isolationists has been as strident and vicious as that of the left. This raises the question of whether there is any common set of fundamentals that defines the right's foreign policy in the United States, and if not, why these subgroups are considered to be on the same side of the political spectrum.

Abstract:: Although the war in Congo officially ended in 2003, two million people have died since. One of the reasons is that the international community's peacekeeping efforts there have not focused on the local grievances in eastern Congo, especially those over land, that are fueling much of the broader tensions. Until they do, the nation's security and that of the wider Great Lakes region will remain uncertain.

Abstract:: Spanish playwrights in the period between the French Revolution and the Spanish War of Independence became increasingly sensitized to militarization and conflict. Manuel José Quintana's ground-breaking Pelayo (1805) drew on tropes from Spain's historical past to discuss current and coming events. A new reading of Quintana's play suggests that he, among others, marked this rapidly changing cultural and political milieu with works that projected a growing nationalism and defense of Spain against the threats from north of the Pyrenees.

Abstract:: Since their 2005 inception in Iraq, PRTs have struggled to fully define their mission, overcome structural problems, learn to work alongside their military counterparts and assist Iraqis down the path to self-governance and stability so that U.S. forces can withdraw. While the concept was born in the Afghan conflict, PRTs in Iraq bear little resemblance to their Afghan cousins, which are led and largely staffed by military officers. PRTs in Iraq are largely civilian-led and are required to address a host of issues including local governance, economic and women's development, health, agriculture, rule of law and education. In this respect, they resemble mini development task forces, harnessing civilian expertise sourced from the U.S. and augmented by military civil affairs officers.

Abstract:: The following U.S. interests underlie any U.S. consideration of policy toward Iraq and should guide the Obama administration: Restore U.S. credibility, prestige and capacity to act worldwide. Improve regional stability. Limit and redirect Iranian influence. Maintain an independent Iraq as a single state. Prevent Iraq from becoming a haven or platform for international terrorists. These interests cannot be fully achieved without continued U.S. engagement, even as the level of American forces needed to maintain security declines. Iraq is important to the U.S. Ignoring or hastily abandoning Iraq could risk a collapse with catastrophic humanitarian and political consequences that the new Administration would not be able to ignore.

Moreover, an accurate accounting of past crimes applies pressure to remove perpetrators from power and raises awareness toward preventing future abuse.

After earning his doctorate from the University of Florida in 1966, he taught at Florida's Jacksonville University and then at the University of Jordan in Amman. Hallaj returned to the West Bank in 1975, where he served as dean of social sciences and later as academic vice president of Birzeit University before becoming the first director of the Council for Higher Education in the West Bank and Gaza. While taking a leave to go to Harvard University as a visiting scholar in 1983, Hallaj was denied a visa to return to the West Bank. Among the positions he has held since then have been editor of Palestine Perspectives (1983-1991), member (and subsequent head) of the Palestinian delegation on Refugees to the multilateral peace talks following the Madrid conference (1991-1993), and executive director of the Palestine Center and the Jerusalem Fund. At the request of JPS, Dr. Hallaj shared his memories of the 1948 war and its aftermath, which he experienced as a high school student in Jaffa, and then in Qalqilya and Tulkarm.

Abstract:: Analysts, policy makers and experts are now accepting that the conflicts in Chad and Sudan have mutually reinforcing dynamics. Chad's internal political instability is having devastating consequences on the peace processes in Sudan and the Central African Republic (CAR). The U.N. Security Council Sanctions Committee Panel of Experts on Sudan stated that Chad supports Sudanese insurgent groups with arms, ammunition, vehicles, food, training and safe haven Violations of humanitarian law and international human rights continue unabated in the region and violators in eastern Chad operate in an environment of almost total impunity. A new U.S. Government strategy must be created to stabilize Chad and bring to an end the continued degradation of conditions in the region. This strategy must work in parallel with the peace process for Sudan and with the efforts led by the “Contact Group” to normalize Chad-Sudan relations.

Abstract:: Sun Tzu seems more popular than ever. The Bush Administration attributes its successful invasions of Afghanistan and Iraq to tactics in The Art of War such as “shock and awe” and “decapitation.” However, neither exists in Sun Tzu's manual. More seriously, this misappropriation reinforces an imperial hypermasculinity in US foreign policy given its neoliberal logic of “conversion or discipline” for Self/Other relations. Rival camps of imperial hypermasculinity arise in reaction, thereby rationalizing the US Self's resort to such in the first place. Locking the world into ceaseless rounds of hostility between opposed enemies, we argue, contradicts Sun Tzu's purpose. The Art of War sought to transform, not annihilate, the enemy as mandated by the cosmo-moral, dialectical world order that governed Sun Tzu's time. In misappropriating Sun Tzu, then, the Bush Administration turns The Art of War into mere kitsch.

Abstract:: Human rights observers have a tendency to look at humanitarian crises as if they were frozen in time. Many unfolding genocides have gone unrecognized and unprevented because each death, each massacre, was treated as if it were a photograph, a snapshot to be compared in that instance against the definition of genocide. Genocide, however, is not an event. This paper will argue that genocide can be waged with a wide array of methods beyond direct and violent murder. In fact, there are more protracted, more ambiguously lethal means of extermination than machetes, guns or gas chambers. Many victims of historical genocides die from slower indirect and less immediately deadly methods of annihilation than outright murder. Genocide is a process that can unfold over several years, even decades. This paper proposes a notion of genocide by attrition that takes the usual linear (causal) accounts of mass death as its starting point and expands on them to suggest a more complex picture of genocidal processes. More specifically, this study aims to illuminate the concept of genocide by attrition in its proper legal and historical contexts, and identify indicators thereof through the lens of existing international human rights laws and obligations so as to assist legal, humanitarian and political actors in the difficult task of genocide identification and prevention. The paper will draw on empirical evidence from various cases of genocide by attrition to identify a set of attributes that allow a fresh rethinking of the process of genocide.

Abstract:: The September 2001 attacks on the United States facilitated the formation of an effective domestic consensus on post-Cold War US globalism – a goal that had eluded the Clinton administration. The centerpiece of that consensus is the "war on terrorism." This puts US global engagement in a "war-fighting" framework, which has strong institutional, cultural, and ideological resonances in the American polity. And it admits both neo-conservative and neo-liberal varieties. However, the attendant surge in US military activism has proved both fabulously expensive and largely counter-productive. Moreover, it has helped undermine America's already-troubled hegemonic position within the Western and allied camp.

Das Papier besteht aus zwei Teilen. Zunächst erläutert der Autor im Rahmen einer Fallstudie die relevanten internationalen, nationalen und lokalen Akteurskonstellationen in der Zielregion und bettet die Ergebnisse der quantitativen Befragungen ein in den Kontext der qualitativen Untersuchungsergebnisse zu lokalen gesellschaftlichen und politischen Entwicklungen. Anschließend wird detailliert das methodische Vorgehen erläutert, welches auf kreuzperspektivischer Analyse der quantitativ und qualitativ erhobenen Daten gründet. Die Analyse zeigt, dass im heutigen Afghanistan Sicherheit und Entwicklung als Ergebnis transnationaler Governance entstehen können. Diese Governance-Leistungen sind auf die lokale Ebene beschränkt; sie erreichen nicht die regionale oder gar die nationale Ebene. Abstract:: Augustine and Morgenthau are examples of classical political realists who base their arguments on the nature of man. Both believe that man is born evil but they differ on the question if man can improve. Augustine also believes that the statesman has a moral purpose while Morgenthau believes that the consequences of man's nature can only be counterbalanced. This difference is rooted in Morgenthau and Augustine's different views of the meaning of peace. To Morgenthau, peace is power balance and stability and a permanent peace cannot be achieved. Augustine, however, describes two kinds of peace, the earthly peace and God's peace. The article discusses these differences and how it impacts their views on moral and war. These different views have similarity with the different views that led to the Reformation in the 1500's and their difference is as great.

Abstract:: Israel's current Gaza operation represents the strongest attack on Hamas since summer 2006, and the Israel Defense Forces (IDF) are creating the conditions for broader military action. Although it is unclear how far the IDF will take the current operation, its attacks are already posing a significant challenge to Hamas. The Palestinian group has no means of defending against Israel's air raids and can take measures only to reduce the effects. Similarly, Hamas's offensive options, while potentially painful for Israel, cannot prevent the destructive air attacks. Although Operation Cast Lead may not aim directly at toppling Hamas, it will certain weaken the organization's military and police capability and hence its capacity to enforce its rule in Gaza.

Abstract:: The measure of success in the Iraq war has undergone a curious progression. Early on, the Bush administration held up the vision of a peaceful, prosperous, pro-Western Iraq as its benchmark. But the torture chambers of Saddam Hussein were replaced by the horrors of a sadistic sectarian war and a fierce insurgency that consumed thousands of American lives. And the post-invasion Iraqi regime, it turns out, is led by Islamist parties allied with religious militias and intimately tied to the belligerent Iranian regime. The benchmark, if we can call it that, then shrank to the somewhat lesser vision of an Iraqi government that can stand up on its own, so that America can stand down. But that did not materialize, either. So we heard that if only the fractious Sunni and Shiite factions in the Iraqi government could have breathing space to reconcile their differences, and if only we could do more to blunt the force of the insurgency, that would be progress. To that end, in early 2007, the administration ordered a "surge" of tens of thousands more American forces to rein in the chaos in Iraq. Today, we hear John McCain and legions of conservatives braying that we are, in fact, winning (some go so far as to say we have already won). Why? Because the "surge" has reduced the number of attacks on U.S. troops to the levels seen a few years ago (when the insurgency was raging wildly) and the number of Iraqis slaughtering their fellow countrymen has taken a momentary dip. Victory, apparently, requires only clearing out insurgents (for a while) from their perches in some neighborhoods, even though Teheran's influence in the country grows and Islamists carve out Taliban-like fiefdoms in Iraq. The goals in Iraq "have visibly been getting smaller," observes John Agresto, a once keen but now disillusioned supporter of the campaign (p. 172). Iraq, he argues contra his fellow conservatives, has been a fiasco. "If we call it 'success,' it's only because we've lowered the benchmark to near zero" (p. 191). . . .

Abstract:: During World War II, the prime source of information for Americans about the war overseas was the dispatches of foreign correspondents-men who put their lives on the line in war zones to report the truth. George Weller was a giant among such men. Captured by the Nazis and traded for a German journalist, Weller watched the Belgian Congolese Army attack Italians in Ethiopia, saw the invasion of Crete, interviewed Charles de Gaulle in South Africa following an escape through Lisbon, and overcame malaria to report on the war in the Pacific. He was the first foreign correspondent trained as a paratrooper, and he won a Pulitzer Prize for his report of an appendectomy on a submarine. He wrote the book Singapore is Silent in 1942 after seeing the city fall to the Japanese, and he advocated a global system of United States bases in his 1943 book Bases Overseas. After witnessing Japan's surrender on September 2, 1945, he broke General Douglas MacArthur's order against travel to Nagasaki by impersonating an American colonel and taking a train to the bombed-out city. In a period of six weeks, he sent typewritten dispatches totaling some fifty thousand words back to American newspapers through official channels of the military occupation. Under MacArthur's directives, they were censored and never made it into print. Weller died in 2002 thinking his dispatches had been lost. Months later his son, Anthony Weller, found a crate of moldy papers with the only surviving carbon copies. Anthony Weller edited the dispatches and included his own essay about his father, resulting in this priceless addition to our information about World War II in the Pacific, and the birth of the atomic age. The importance of the dispatches, however, extends far beyond the value of the information from Nagasaki. George Weller is a voice from a past generation, and the publication of his censored dispatches raises a series of deeply important issues and, in the process, reveals an immense cultural divide between his world and ours today. On September 8, 1945, two days after he arrived in Nagasaki, Weller wrote his third dispatch concerning Nagasaki itself. He described wounded Japanese in two of Nagasaki's undestroyed hospitals, and recorded the question posed by his official guide: Showing them to you, as the first American outsider to reach Nagasaki since the surrender, your propaganda-conscious official guide looks meaningfully in your face and wants to know: "What do you think?" What this question means is: Do you intend writing that America did something inhuman in loosing this weapon against Japan? That is what we want you to write (p. 37). What would many reporters today write if asked this question by bombed enemy civilians? . . .

Abstract:: In August 1919, three white men brutally beat John R. Shillady in broad daylight outside his hotel. Shillady, also white, had come to Austin, Texas, as executive secretary of the NAACP to persuade state officials not to suppress its local branch. One of his attackers, a county judge, claimed that "it was my duty to stop him" because Shillady was there to "sow discontent among the Negroes" (pp. 105-106). In 1920, Shillady would resign from the NAACP, expressing despair for his cause: "I am less confident than heretofore . . . of the probability of overcoming, within a reasonable period, the forces opposed to Negro equality" (p. 109). And yet, not even a century later, the United States has elected its first black president-in an election in which race was hardly an issue. How did racial equality in America progress so far in so short a time? This is the remarkable story that Adam Fairclough relates in Better Day Coming: Blacks and Equality, 1890-2000. Fairclough succeeds in making his introduction to the struggle for black equality accessible to the general reader in two ways. First, he concentrates on events in the South, wherein particularly harsh forms of racial domination made it the logical focus of black efforts to achieve equality. Second, he follows the lead of fellow historian John W. Cell and classifies the approaches taken by various figures in his narrative as either "militant confrontation" (defiantly opposing racial oppression), "separatism" (working toward the creation of an all-black society here or abroad), or "accommodation" (gradually securing improvements from within the system of white supremacy) (pp. xi-xii). It is from this perspective that the book's chapters examine prominent individuals, organizations, events, and periods of the civil rights movement. Fairclough begins his narrative at a time when blacks were "more powerless than at any other time since the death of slavery" and had been "purged from the voting rolls" of the former Confederacy (pp. 15-17). He proceeds to examine the many different ways in which blacks fought against discrimination and oppression: from the intransigent, confrontational approach of Ida B. Wells, who campaigned against lynching in the 1890s; to the accommodation of Booker T. Washington, whose emphasis on black self-improvement over confrontation is characterized by Fairclough as "a tactical retreat in order to prepare the way for a strategic advance" (p. 63); to the separatism of Marcus Garvey, who proposed that blacks fight for an independent, united Africa (p. 126). Fairclough continues this kind of analysis throughout subsequent chapters, where we learn, among other things, about the involvement of the labor movement and the Communist party in the civil rights movement during the 1930s, the evolution of the NAACP's strategy to include legal challenges to discrimination in education after World War II and then mass civil disobedience after 1955, and the rise and fall of the "Black Power" movement. . . .

Abstract:: War is one of man's most destructive activities (only dictatorship has ruined more lives), and it is not surprising that thousands of books have been written about it. Yet, paradoxically, books on war itself-books concerned with war as a phenomenon, rather than focused on strategy, tactics, or some particular war-have been relatively few. This is due in part to the focus by modern scholars on the minutiae of human affairs, and their reluctance to deal with broad generalizations; but the failure to come to grips with the abstract principles of war goes back to the dawn of historical writing. The ancient Greek historian Thucydides, a soaring intellect obsessed by the great war between Athens and Sparta, identified "honor, security and interest" as causally important principles that motivate men "for all time." But even Thucydides did not examine the philosophical foundations of these factors; he took them as given in human nature, which left the study of war mired in the vagaries of human desires and without philosophical grounding.1 As a result, important questions remained unanswered: What are the principles of war; what are their philosophical foundations, and what methods of waging war do they imply? In ancient China, a thriving culture of thinkers tried to answer such questions. They derived principles of warfare from ideas that were fundamental to their own philosophies and applied those principles to the practical needs of military commanders. The extant remains of these works have been compiled into the so-called seven Chinese military classics, the best preserved of which is Art of War by Sun-tzu, who lived sometime between 450 and 250 BC, about the time of classical Greece.2 This was approximately the "Warring States" period of Chinese history, when China was divided among military warlords, iron was first used in weapons, armies grew to more than one hundred thousand men, and commanders needed expert guidance to help them organize their huge forces. Ralph Sawyer has produced a lively translation, with a historical essay and explanatory notes, of Sun-tzu's classic work. Sawyer also includes new supplementary material, found in graves and carved on bamboo stalks, that adds to our knowledge of ancient Chinese thought. . . .

Abstract:: Peace operations have an important role to play in fighting organised crime for two reasons: Organised crime can act as a significant peace spoiler by undermining peace processes and endangering human security following conflict and in fragile states. The criminalised components of conflict help to sustain the material basis for war-fighting and reduce the incentives for a turn towards peace. Organised crime operating in conflict situations thus creates a more challenging operational environment for peace operations and peace processes.

Abstract:: The Middle East and its security remains a vital ingredient in international security. The region's tensions, conflicts and stability are of fundamental concern to a wide range of actors, whose interests or proximity make it a priority. The novelty today is the increasing inter-relations of these conflicts and instability and the limitations of outside power influence. This, together with the appearance of new actors in the region, namely India and China, seems likely to transform diplomacy in the future. Regional dynamics, which are increasingly resistant to outside power influence or control, continue to shape the strategic environment. These dynamic forces, ranging from terrorism, sectarianism, and on-going conflicts, intersect and add to the region's instability and fragmentation. The conflict zone (from the Levant to Iran) overlaps the “energy ellipse” (in the Gulf), that is, the dependence of much of the world on this region for energy supplies. Superimposed on this is the related feature of the region, namely the emergence in the GCC of the 'super rich' states, carving out a new niche and economic identity with their newfound wealth. The region is thus complex: unstable, vulnerable, and wealthy in parts. Weak, shattered, or embryonic states (Iraq, Lebanon, Palestine) co-exist with strong states like Egypt, cautious ones like Saudi Arabia, and ambitious ones, notably Iran. What seems clear from the perspective of 2008 is the continuing need for international engagement, combined with a recognition that this engagement must be constructive and cannot substitute for local initiatives or substitute for local forces, which at best, can only be harnessed, not controlled.

Abstract:: Since the end of World War II, Canadian security policy has maintained a highly adaptive quality. New circumstances and emerging threats have continually challenged the evolutionary capacity of the Canadian military. The repeated success of Canada's defense can be attributed to a sound capacity to anticipate security needs, generate appropriate approaches to combat and foster strategic partnerships with close allies. Now more than ever Canada must modernize its security policy. Major players in global politics have largely finished reshaping the post-Cold War geo-strategic environment. Most notably, the United States has taken an assertive role in the fight against terrorism. In this stasis of new global order, Canada has aligned itself with NATO members to combat the Taliban in Afghanistan and has been committed to implementing the Canada-U.S. 2001 Smart Border Declaration. Clearly, Canada has demonstrated a sovereign interest in building closer security relations with the United States.

Abstract:: The issue of contaminated frozen gyoza moved to the bilateral front burner during the quarter. In his meeting with President Hu Jintao on the sidelines of the G8 summit at Lake Toya, Hokkaido and again during the opening ceremonies of the Beijing Olympics, Prime Minster Fukuda Yasuo emphasized the importance of making progress on the six-month old case. Hu promised to accelerate efforts to identify the source of the problem and in mid-September, Japanese media reported that Chinese authorities had detained nine suspects at the Tianyang factory. The commemoration of the end of World War II on Aug. 15 passed quietly with only three Cabinet ministers visiting the Yasukuni Shrine. Meanwhile, joint Japanese and Chinese public opinion polling data revealed markedly different perceptions on the state and future course of the bilateral relationship. In early September, Japan's Ministry of Defense released its Defense White Paper 2008, which again expressed concerns about China's military modernization and its lack of transparency. Later in the month, the Maritime Self-Defense Force sighted what was believed to be an unidentified submarine in Japanese territorial waters. Reacting to Japanese media speculation, China's Foreign Ministry denied that the submarine belonged to China's Navy.

Abstract:: The Protection of Civilians (PoC) concept is a prevalent buzzword in the contemporary security-development nexus and comes as a response to new modes of warfare that have made civilians the main causality of war. Just about all actors from the military, development and humanitarian segments relate to the PoC concept in conflict-situations. Although there is a presumably mainstreaming and general infusion of the concept within the international community, there exists no coherent and comprehensive understanding of what the concept really means and what kind of practices it comprises and entails. The concept’s seminal thinkers and proponents fail to provide a clear and unambiguous definition of the concept. Rather it seeks to infuse a culture of protection among international actors operating in contexts which see grave human right violations and direct and indirect targeting of civilians. This report addresses the protection discourse as perceived by various actors in the field, and approaches the discourse in the nexus of PoC and culture of protection. The present paper demonstrates that whereas a narrow definition of PoC runs the risk of repelling actors from the protection-agenda, mainstreaming a culture of protection drawing on wider principles seems worthwhile in order to be comprehensive in terms of including as many actors as possible. A negative facet of such an approach, however, is that PoC becomes open to various actors’ interpretation. Although in line with the implementation of PoC on case-by-case basis, this might not be sufficient to engender an inclusive culture of protection as PoC always will be interpreted at the backdrop of organisations’ embedded mandate and institutional culture, leading to a general conceptual dilution. This paper explores the PoC concept and the culture of protection in the context of Sudan.

1164. Kosovo: What Can Go Wrong?

Abstract:: At the end of the NATO/Yugoslavia war almost eight years ago, the Albanian-majority Serbian province of Kosovo was removed from Serbia's governance and placed temporarily under a United Nations protectorate, administered by the UN Mission in Kosovo (UNMIK). Last summer, UN Special Envoy Martti Ahtisaari was tasked by the Security Council with resolving the question of Kosovo's future status, with support from U.S. and European Union envoys (Frank Wisner and Stefan Lehne respectively). Ahtisaari's effort is now drawing to a close. He has delivered to both Pristina and Belgrade a plan that explicitly allows a great deal of protection for Serbs and their religious monuments in Kosovo but implicitly ends Belgrade's sovereignty. His plan opens the prospect of a sovereign and independent Kosovo under continuing international supervision. It is anticipated that Ahtisaari will take his plan, with some revisions, to the UN Security Council this month. This USIPeace Briefing discusses potential drivers of conflict in Kosovo during the status decision and in the period thereafter. These drivers of conflict arise from the international community, the Kosovo Albanians, Serbia and the Kosovo Serbs. They have the potential not only to make Kosovo dysfunctional but also to destabilize the region.

Abstract:: In the State of the Union address this year, President Bush joined calls for a U.S. civilian reserve corps that could rapidly deploy to restore public order and begin reconstituting the institutions of governance so desperately needed in states emerging from conflict. The Office of the Coordinator for Reconstruction and Stabilization (S/CRS) at the U.S. Department of State was created in part for this purpose, but it has never received adequate resources. The current challenge of locating qualified and willing civilians to join Provincial Reconstruction Teams in Iraq and Afghanistan has given renewed impetus to initiatives aimed at overcoming this chronic shortcoming.

Abstract:: Afghanistan supplies more than 90 percent of the world's opium. Despite concerted efforts to tackle the drug problem in Afghanistan, the industry continues to grow at an alarming rate, particularly in the south, where reconstruction efforts lag amidst poor security. Afghanistan's opium crop grew 59 percent from 2005 to 2006, according to UN reports, and officials expect a crop equal to if not greater than the 2006 crop in 2007. Overall, the industry accounts for nearly one-third of the country's economy and remains one of the chief threats to Afghanistan's security and development, as it becomes increasingly linked to corrupt Afghan officials and the Taliban.

Abstract:: In over 30 conflict zones today there are estimated to be upwards of 300,000 children used to support military activities as porters, sentries, sex slaves, spies, and combatants. On June 1, 2007, the United States Institute of Peace (USIP) hosted an event on the use, prevention, and reintegration of child soldiers around the world. The event featured experts working in the field, each of whom approached the issue of child soldiers from a different perspective. These differing perspectives underscored the complexities inherent to the child soldier problem, as attempts to curb the use of child soldiers, to prevent their recruitment, and to successfully reintegrate ex-combatants into their communities continue to challenge practitioners and advocates.

1173. Kosovo: Breaking the Deadlock

Abstract:: Kosovo was left at the end of the NATO/Yugoslavia war in 1999 in limbo. It is still there, despite Security Council Resolution 1244, which foresaw a process for deciding its status. That process has occurred, but because of a threatened Russian veto, the Security Council failed to approve the plan prepared under the leadership of former Finnish President Marti Ahtisaari, which provides for Kosovo's independence under international supervision with extensive protection for its Serb population. The UN Secretary General invited the Contact Group—France, Germany, Italy, Russia, the UK and the U.S.—to pursue further, direct negotiations between Pristina and Belgrade, but with little prospect of movement on either side. Belgrade continues to insist on maintenance of its sovereignty over Kosovo, and Pristina continues to insist on independence. On December 10, the Contact Group will report to the UN Secretary General, who in turn will report to the Security Council (UNSC). A small group of experts with long Balkans experience met at USIP September 5 to discuss the situation and suggest ways forward. Others (consulted electronically) join in associating their names with this paper. Listed at the end, all believe that Kosovo's independence must happen without further delay, in order to prevent regional instability. Abstract:: Although baseline data for post-conflict situations are frequently unavailable, there is a clear deterioration in the health conditions of populations during and following conflict. Excess mortality and morbidity, displaced populations, and vulnerability to communicable diseases during and following conflict all call for immediate relief and restoration of basic services. Abstract:: On 21 March each year, the people of Afghanistan celebrate the Spring festival of Nawruz. Families gather to mark the onset of the new season, and to wish each other well for the coming year. Yet this year, Nawruz is overshadowed by a gathering sense of apprehension. All the available evidence suggests that the opponents of the Karzai government and of its Coalition supporters are positioning themselves for their fiercest attacks ever. As the snow melts and ground becomes passable again, hundreds of foreign fighters are poised to strike against both the instrumentalities and symbols of the state, and the large proportion of the Afghan population that remains committed to the transition inaugurated by the Bonn Agreement of December 2001. This is not, however, a threat just to the security of Afghanistan. In a very real sense, it reflects a recrudescence of the al-Qaeda network and its affiliates, and thus challenges those countries and peoples who have fallen victim to al-Qaeda's brand of globalised terrorism. Afghanistan is the front line in confronting these forces, and if the wider world allows the struggle for Afghanistan to be lost, it could pay a heavy price.

1176. Uganda's Civil War and the Politics of ICC Intervention

Abstract:: With its 2003 ''Referral of the Situation Concerning the Lord's Resistance Army'' to the International Criminal Court (ICC), the Ugandan government launched a legal process that, it claimed, would bring peace and justice to war-torn northern Uganda. The ICC prosecutor officially opened an investigation in response to the referral in July 2004, and in October 2005 the ICC unsealed arrest warrants, its historic first warrants in its historic first case, charging five of the top commanders of the rebel Lord's Resistance Army (LRA) with war crimes and crimes against humanity. For two decades, Uganda north of the Nile has been ravaged by a brutal civil war between the LRA and the Ugandan government, so any possibility of productive change is to be warmly welcomed. The sanguine predictions proffered by the Ugandan government and by the ICC's supporters, however, are called into question by doubts about the court's ability to achieve peace or justice in Uganda, doubts stemming from the specific way the ICC has pursued the Ugandan case, and because of more inherent problems with the ICC as a legal institution.

1177. Liability and Just Cause

Abstract:: This paper is a response to Jeff McMahan's "Just Cause for War" (Ethics International Affairs, 19.3, 2005). McMahan holds, as many have, that there is a just cause for war against group X only if X have made themselves liable to military force by being responsible for some serious wrong. But he interprets this liability requirement in a very strict way. He insists (i) that one may use force against X for purpose Y only if they are responsible for a wrong specifically connected to Y; and (ii) that one may use force against an individual member of X only if he himself shares in the responsibility for the wrong. This paper defends a more permissive, and more traditional, view of just war liability against McMahan's claims. Against (i) it argues that certain 'conditional just causes' such as disarming an aggressor, deterring future aggression, and preventing lesser humanitarian crimes can be legitimate goals of war against X even if X have no specific liability connected to them. Against (ii) it argues that soldiers who have no responsibility for X's wrong may nonetheless be legitimately attacked because in becoming soldiers they freely surrendered their right not to be killed by enemy combatants in a war between their and another state, so killing them in such a war is not unjust. Though initially a criticism of McMahan, the paper makes positive proposals about conditional just causes and the moral justification for directing force at soldiers.

Abstract:: After the events of 9/11/01, the United States rallied around President George W. Bush. An administration that was initially weak and semi-legiti-mate came to directly control the executive and legislative branches of government and gradually strengthen its influence over the judiciary. Bush and the Republican majority in Congress attained hegemony domestically as well as internationally. Having acquired the power to ignore the rules, they often proceeded to do so. A semi-idealistic “winning is everything” approach to foreign policy led the United States into a quagmire in Iraq. An unempirical “winning is everything” approach to domestic policy, which often distorts the rules (law, science, and standard economics) and ignores the “referees” (the GAO, the CBO, the IMF), has created potentially disastrous medium and long-term problems for the United States.

1190. "Making Riflemen from Mud": Restoring the Army's Culture of Irregular Warfare

Abstract:: Prior to World War II, the Army had a deeply ingrained facility with and acceptance of what we now term unconventional warfare—raising, training, advising, and cooperating with tribal militias, local paramilitaries, and other non-state armed groups. This culture of irregular warfare was attributable to nearly 300 years of American military tradition from the colonial period until 1941, including extensive experience in cooperating with Native American tribes and individual scouts during the expansion of the western frontier. These traditions of unconventional war reached maturity in the years of fighting on the western plains after the Civil War, and were given ultimate expression in the creation of the Philippine Scouts at the beginning of the 20th century. Since World War II, the wider military has lost this expertise in and comfortable familiarity with unconventional operations, with the Special Operations community taking on the sole proprietorship of this role. Given the variety of political environments in which today's conventional soldiers may find themselves and the current nature of conflicts ongoing and likely to occur in the world, the Army culture as a whole can and must readapt itself to the new old realities of irregular war.

Abstract:: This paper focuses on the interrelationship among national interests, stated ends, means to achieve those ends, and the strategies required to tie all of them together into a cohesive and effective vision for the commitment of U.S. forces. The introduction addresses the current U.S. debate regarding proposed actions in the Iraq War and postulates that the lack of true strategic discussion, particularly by our national leadership who instead prefer to focus on far less appropriate discussions such as tactics and techniques, inhibits the development of a comprehensive and effective overarching vision and ultimately is to blame for the setbacks that the U.S.-led coalition has experienced in Iraq. This lack of strategic foresight, however, is not surprising and has become endemic to American foreign policy since the end of the Cold War. The fact that so much of U.S. post-Cold War foreign policy involves interventions merely exacerbates the difficulties a lack of strategic foresight engenders. The U.S. inability—or unwillingness—to connect strategic ends and appropriate means to accomplish clearly defined goals has occurred so often over the past 15 years that one could make a credible argument that it has become a disturbing and pervasive characteristic of the modern American way of war.

Abstract:: Preemption has been, and remains, a leading concept of this decade. But despite its ubiquity in public discourse and its policy relevance, it is a source of great confusion. The term is misused, in some cases deliberately one suspects, but it must be admitted that strategic theorists have offered very little worthwhile reading on the subject. This monograph clarifies the meaning of preemption and distinguishes it from prevention and precaution. It critically reviews the principal charges levelled against preventive warfare and uses that analysis to provide at least the bare bones of strategic theory, more strictly of an alternative to theory relevant to such warfare. The analysis concludes with a set of policy and strategy relevant implications for the United States.

Abstract:: In a report on the United Nations-supervised disarmament process in Sierra Leone, veteran Washington Post correspondent Douglas Farah described the pathos of the ragged Revolutionary United Front (RUF) fighters: many were barely into their teens, straggling into a processing center in the diamond-rich eastern district of Kono with little more than ill-fitting rags draped over their emaciated bodies (Farah 2001). There was little evidence that these broken youths had, just a short while earlier, been part of one of the most brutal and effective insurgencies in the world, one whose strategy was predicated on terror in its most primordial expression. Farah's piece was headlined, “They Fought for Nothing, and That's What They Got,” a succinct description of a conflict that struck many as senseless, despite its heavy toll in lives and property.

Abstract:: Violent conflicts are concentrated in the countries farthest behind in achieving the MDGs. Much work has been done to develop a better understanding of conflicts and their relationship to development, but the development community has yet to engage fully with the need for new policy approaches that can help prevent conflict. Structural conditions that increase vulnerability to political violence and conflict are rarely addressed by current conflict prevention policy work. Without addressing the root causes, sustainable peace cannot be achieved. Surprisingly few studies have analyzed the contribution of aid to the full human security agenda and the current aid policy framework still favors countries with institutional and policy characteristics that are deemed to generate good growth performance. As a consequence, many fragile states (who are also the most vulnerable) have ended up with limited little donor support. A systematic study of aid in relation to conflict prevention is proposed as a policy objective to help fill a significant dimension of the current knowledge gap. Specifically, this project will seek to demonstrate that only by targeting structural risks and state fragility will development cooperation achieve human security. Engagement with fragile states requires a coherent combination of aid and non-aid policies in areas such as international trade and debt.

Abstract:: Efforts to predict the future of peacekeeping almost always prove to be unsuccessful. In 1958, United Nations Secretary-General Dag Hammarskjöld reported to the General Assembly on the lessons of the UN Emergency Force deployed to Egypt during the Suez crisis two years before. He surrounded his observations with qualifications, as some “circumstances are of such a nature that it could not reasonably be expected that they would often be duplicated elsewhere. Nor can it be assumed that they provide a sufficient basis to warrant indiscriminate projection of the UNEF experience in planning for future United Nations operations of this kind.” Sure enough, when the UN began to deploy to the Congo two years later, the 1958 report was to prove “not especially pertinent” to the task at hand.
