Abstract:
The United Nations (UN) has become largely irrelevant to diplomatic efforts to resolve the Syria conflict. This report shows that the primary reason has been the fact that the main conflict parties never wanted to resolve the Syrian conflict by other than military means. Yet, the report also highlights secondary reasons within this unfavourable context, namely: the frames, methods and choices of the UN Special Envoy and his team at times misjudged or poorly corresponded with the realities of the conflict. Moreover, the capacity of the Office of the Special Envoy (OSE) remained too limited. The report suggests that the time is ripe for the OSE to reinvent itself as a principled thought leader and to develop an operational framework that brings a safe, calm and neutral environment (SCNE) closer as a practical conflict management modality.

This policy brief takes a comparative examination of how the United Nations has adopted a paradoxical interpretation of its guiding principles to address the complex humanitarian crises in Syria and Yemen. It offers approaches that could change the course of international humanitarian operations and protect them from further politicization, weaponization, and diversion. The consequences of the February 2023 earthquakes in Turkey and Syria extend far beyond physical destruction and loss of life, particularly in northwestern Syria (NWS). Immediately after the earthquake, extensive debates erupted within the local and international humanitarian community, criticizing the United Nations (UN) for its inadequate response. These debates quickly broadened to include concerns that UN humanitarian assistance had become a powerful tool for the Assad regime in its strategy to make political and military gains in war-torn Syria. The dilemma of international humanitarian assistance in Syria is not just a matter of timing or funding but, more importantly, of delivery mechanisms. Syria’s endless humanitarian nightmare revolves around the controversial interpretation of the guiding principles of the UN.

Threatening to reimpose old UN sanctions would likely have little practical effect on Tehran’s ability to trade oil and export drones, while the plethora of other potential complications suggest that it should be treated as a tool of last resort. In recent weeks, the United States, Britain, France, and Germany have argued that Iran’s sale of drones to Russia for use against Ukraine violates UN Security Council Resolution 2231, the backbone of the Joint Comprehensive Plan of Action (JCPOA). These allegations, combined with ongoing diplomatic deadlock over reviving that 2015 nuclear agreement, have led some to suggest pursuing “snapback,” a provision that would reimpose terminated UN resolutions on Iran and essentially scrub the JCPOA from the books. How would snapback work, and what political, economic, and security consequences would it have?

Abstract:
On 2 October 2022, the UN-mediated truce in Yemen came to an end as the warring sides rejected a proposal presented by UN Special Envoy for Yemen Hans Grundberg to extend and expand the agreement (Office of the Special Envoy of the Secretary-General for Yemen, 2 October 2022). The truce had first come into effect on 2 April 2022 and was renewed twice for two-month periods, in June and August. Among other things, it provided for a halt to offensive military operations by both the Houthi and Internationally Recognized Government (IRG)1 sides. Overall, the six months of truce brought several tangible benefits to the Yemeni population, including improved access to humanitarian aid (ReliefWeb, 31 May 2022), greater economic opportunities (ACAPS, 17 May 2022), and a significant reduction in violence and casualties countrywide. ACLED’s report on the first two months of truce found that April and May 2022 saw the lowest levels of reported fatalities from political violence in Yemen since January 2015. This trend continued for the whole truce period: reported fatalities from political violence between April and September 2022 were consistently lower than any other month since January 2015.

One in five children lives in a country affected by conflict (Save the Children 2019). Despite concerted international and national efforts to protect children, these 415 million children face grave human rights violations that continue to rise. More political will and resources are needed from governments and parties to the conflict to prevent such violence against children and protect children in armed conflict. However, research confirms that out of 431 ceasefire and peace agreements, less than 18 percent of peace agreements included child protection provisions (Watchlist on Children and Armed Conflict). Often, peace-related documents that mention child protection issues do not mention integrating children's participation into peace processes, which is essential to understanding and addressing children's needs during and after the conflict. To end the cycle of violence against children, a paradigm shift must be made in the way peace agreements address children’s issues and rights. Guided by the “Global Policy Paper on Youth Participation in the Peace Process,” commissioned by the United Nations Envoy on Youth, this paper recommends that mediators and child protection actors employ three integrated but non-hierarchical layers for including child protection issues and children’s participation in the peace process: “in the room,” “around the room,” and “outside the room” of formal peace negotiations. This multi-layered, inclusive approach may help achieve the desired results: preventing violence against children and reaching a sustainable peace.
