The position paper “Drug Policy in Colombia – The Road to a Just Regulation" presents the dynamics which have maintained Colombia hostage as the longest running, and most evident examples, of failed prohibitionist drug policies. The position paper explores the context leading to the 2016 Peace Agreement, as well as the shifts in political power that resulted in uneven and unsuccessful implementation efforts of the Agreement. It puts forward recommendations to support effective and humane drug policy reforms that enhance peace, health, security and development in Colombia.

This DIIS Working Paper elaborates how local consent to a huge industrial mining complex, including a port and a 150 km railway built in the 1980’s on indigenous arid lands, were created. Showing how both ‘hard’ and ‘soft’ security technologies were effective in preparing the complex, constructing the necessary infrastructure and securing the operation, the paper at the same time illustrates how corporate security practices have changed over time in the northern part of Colombia. The paper is based on extended ethnographic fieldwork in La Guajira, Colombia, carried out through 2018 and 2019 as well as historical written documents.

Abstract:
After the signing of peace in Colombia, attention has been directed to the difficult process of implementing the agreements. This complex scenario has downplayed the problem of Colombian military transformation. The basis of that transformation, the Damasco doctrine, the, has encountered resistance within the Colombian Military Forces. Through the application of a process tracing method, we infer that there is a non-linear process, but in progress towards the fulfillment of the objectives of the doctrine. Thus, we identify three drivers that are making this transformation progress: a renewed confrontation with Venezuela; the changing nature of the domestic conflict; and the Colombia’s NATO global partner status.

Abstract:
The purpose of the following article is to present the main dynamics of criminal activities and violence produced by the armed conflict in Colombia during the pandemic caused by COVID-19. After a review of the most relevant literature produced in 2020, this study presents trends in criminal violence, lato sensu, and those associated with the internal armed conflict. The situation of paralysis that the confinement produced has not translated into a mitigation of the phenomenon of violence. Thus, the massacres and murders of social leaders, activists, human rights defenders or ex-guerrillas of the FARC-EP has remained constant if not increasing during this time. This must also be related to a context of difficulty added to a Peace Agreement signed with the FARC-EP in November 2016. This must also be related to a context of added difficulty to a Peace Agreement signed with the FARC-EP in November 2016, which, in addition to governmental resistance and non-compliance, is overcome by an increasingly intense violence, which hinders the prospects of a peace-building scenario in the country./El propósito del siguiente trabajo es el de presentar cuáles han sido las principales dinámicas de las actividades delictivas y de la violencia producida por el conflicto armado en Colombia durante la pandemia ocasionada por la COVID-19. Tras una revisión de la literatura más relevante producida en 2020, se presentan las tendencias de la violencia delictiva, lato sensu, y las asociadas con el conflicto armado interno. La situación de parálisis que produjo el confinamiento no se ha traducido en una mitigación del fenómeno de la violencia. Así, las masacres y asesinatos de líderes sociales, activistas, defensores de derechos humanos o exguerrilleros de las FARC-EP se ha mantenido constante cuando no creciente durante este tiempo. Ello debe relacionarse, además, con un contexto de dificultad añadida a un Acuerdo de Paz suscrito con las FARC-EP en noviembre 2016, que además de por las resistencias gubernamentales e incumplimientos, se encuentra superado por una geografía de la violencia cada vez más intensa, que aleja los visos de un escenario de construcción de paz en el país.

Abstract:
The United Nations’ 2030 Agenda is a global action plan for sustainable development and a key priority for the UN and its member states. Within the 2030 Agenda, SDG 16 has a pivotal role highlighting the security-development nexus and emphasizing the need for strong institutions which adhere to good governance principles. The achievement of SDG 16 requires that national security sectors are well governed, subject to civilian oversight, and respectful of human rights and the rule of law. Against this background, this case study compilation circles in on parliaments, as key oversight actors, and questions how they contribute to SDG 16 through their role in security sector governance and reform. It is based on an explorative review of four country studies on Colombian, Georgia, Nigeria and the Philippines, written by regional experts. Their observations form the foundation for a comparative analysis of common challenges and effective practices of parliaments contributing to the achievement of SDG 16.

Abstract:
With this article, we propose to reformulate the Regional Security Complex Theory, by Buzan and Waever, through a South American vision, with the time frame 2008-2016. To this end, we will analyse South America through Argentina, Brazil, and Colombia, and their forms of intra and extra-regional interaction, highlighting the Colombia-United States relations, and the South American Defence Council, of the Union of South American Nations. This article is divided into a first section marked by an understanding of the Regional Complex Theory, in which we present and discuss its theoretical elements and weaknesses, and propose theoretical changes that will guide our analysis. The second section contains information about the South American Complex in the academic view, focusing on the arguments of Buzan and Waever. In the third section, we present the South American Regional Security Complex restructured, as well as the analysis of its dynamics. The central argument of the article is the need to reformulate the Theory in question for a better understanding of the complexities and unique characteristics of South America.

In order to have a more nuanced understanding of inclusive peace processes, it is important to understand how civil society can connect to formal peace negotiations. The Colombian peace negotiation process is highly regarded as one of the most inclusive processes; involving civil society groups from diverse backgrounds, including both women’s and lesbian, gay, bisexual, transgender/ transsexual and intersex (LGBTI) groups. But how do these groups leverage influence among the main conflict actors, and what specific challenges and opportunities do they face? This paper applies a conflict resolution and negotiation framework to assess the involvement of women’s and LGBTI groups in the most recent Colombian peace negotiation process. In doing so, the suggested framework provides a practical application of conflict resolution and negotiation strategies that can further complement discussions on inclusion of marginalized groups in other peace negotiation processes.

The idea that men and women approach conflict resolution differently forms the back- bone of the international agenda on Women, Peace, and Security (WPS) and is supported by a growing body of scholarship in international relations. However, the role of women who represent insurgent groups in peace talks remains understudied, given the relatively rare appearance of such women in peace processes. The present study examines how men and women from the negotiating team of the Revolutionary Armed Forced of Colombia (FARC) engaged in public-facing discourse on Twitter leading up to a referendum on the peace accords in 2016. Using a mixed-methods ap- proach that includes computational analysis and a close reading of social media posts, I demonstrate that women in the FARC’s negotiating team were more successful social media users than their male counterparts and that they offered a distinct contribution to the discourse on peace, centring the relevance of gender and promoting issue linkages like the need to address LGBTI rights.

This report on Colombia examines WFP programming and interventions following the 2016 Colombian peace agreement and investigates the role that WFP plays as the country transitions out of more than 50 years of armed conflict. The report’s detailed findings are largely based on local field research involving qualitative assessment through in-depth interviews, focus group discussions and project site visits. Interviews were held with country office staff, project beneficiaries and other key stakeholders. The findings highlight the significant contributions of WFP programming to improving the prospects for peace, identify crucial conflict sensitivity concerns and suggest 15 actionable recommendations on how WFP’s contribution can be enhanced.

La corrupción es un delito que genera afectaciones políticas, específicamente a la construcción del Estado y la democracia. Es decir, restringe las habilidades de las instituciones para lograr el objetivo de promover el bienestar general a través de la creación de poderes secretos que entorpecen la idea de la democracia como poder público que se realiza ante el público. Así, la corrupción política crea un poder secreto, controlado por funcionarios públicos y políticos profesionales que favorecen diversas redes criminales asociadas a otros delitos y afectan las instituciones y el principio de publicidad en la democracia. El objetivo de la investigación es analizar la corrupción política en Colombia entre 2013 y 2018 desde la perspectiva del Crimen Organizado Transnacional (COT). Para esto se considera que para abordar la corrupción política como delito transnacional es necesario superar el fenómeno de narcotización del delito y reconocer que la corrupción política es también un delito relevante, que funciona en red y que se asocia con otras dinámicas criminales para buscar beneficios económicos del Estado o afectarlo. El enfoque metodológico fue cualitativo y se utilizó el método fenomenológico-hermenéutico en el análisis de la información histórica recopilada desde el siglo XVI que sirvió de contexto para establecer la relación de la corrupción con otros delitos en el país y de los diferentes casos de corrupción analizados en el período de estudio. Se aclara que solo se tienen en cuenta aquellos casos que se ajustan al análisis de corrupción transnacional por los vínculos con otras redes. Se evidencia que entre 2013 y 2018 hubo casos de corrupción política con nexos criminales asociados al narcotráfico, el lavado de activos, la prostitución, entre otros. No obstante, varios de estos hechos no parecen tener la misma relevancia informativa que los típicos casos de soborno, financiación ilegal de campañas o carteles de contratación. Esto se entiende como una oportunidad para seguir profundizando en este tipo de investigaciones.

Abstract:
In order to make peace processes more inclusive, increased participation by women and other excluded groups has been emphasised for decades, as well as the need to adopt a gender perspective within peace processes. However, the discussion has tended to focus on counting women and treating women’s participation as synonymous with a gender perspective. Defining what a gender perspective is and how it could be applied throughout a peace process has remained largely unexplored. This paper seeks to address these lacunae by drawing on current frameworks, proposing a definition of a gender perspective in peace processes and introducing a way of operationalizing this definition. The suggested indicators are used to assess two recent peace processes: the Colombian peace process and the Mindanao peace process in the Philippines. This assessment provides a practical application of the conceptual framework and raises new questions about how the concept can be further measured and assessed.

Abstract:
The election of a new Congress in Colombia in March 2018 provided an opportunity to work on security sector governance and strengthen the role of Congress in overseeing the security sector in a way that helps the country face its current and future challenges. International experiences from other countries can provide relevant technical and conceptual lessons that can enrich the work of the Colombian Congress in matters of security. In this context, the Geneva Centre for Security Sector Governance (DCAF), the Friedrich Ebert Stiftung in Colombia (FESCOL), the Folke Bernadotte Academy (FBA) and the Swedish Embassy in Colombia organised a forum on legislative experiences in security sector governance. The forum took place on the 6th of December 2018 in the Hall of the Constitution of the Colombian Congress in Bogotá and was attended by members of the Colombian Congress as well as parliamentarians from Sweden, Germany and the Philippines. The purpose of this event was to enable participants to partake in the debate over the role of the legislative vis-à-vis the security sector, allowing members of the Colombian Congress and their international counterparts to share lessons learned and promote good practices in security sector oversight. The event was moderated by the Honourable Senator Rodrigo Lara Restrepo, who was the Speaker of the House of Representatives (2017–2018). This Event Report summarises the presentations and discussions of the event and includes two Think Pieces produced by Dr. Mario J. Aguja for this event.

As Colombian President Juan Manuel Santos visits the United States this week, Colombia stands on the brink of a historic peace agreement that, if successfully reached and implemented, will bring an end to the longest-running internal armed conflict in the Western hemisphere. This reality is a far cry from where the country stood just 15 years ago, when it was on the edge of total state collapse. Although Colombia’s ability to overcome what many believed was a hopeless situation rests squarely upon the sacrifice of blood and treasure made by the Colombian people and its public forces, this promising new chapter in Colombia’s history also stems in part from the most successful, bipartisan U.S. foreign policy effort undertaken to date in the 21st century—Plan Colombia. As the United States encounters growing instability in other regions of the world, it is instructive to look back at the U.S. role in fostering the most successful counterinsurgency effort in recent history to understand what worked and what remains unfinished. President Santos’ visit also provides an important opportunity to look forward to how the United States and Colombia can solidify Colombia’s remarkable gains while becoming true strategic partners.

Latin America's oldest guerrilla organisation, the Revolutionary Armed Forces of Colombia (FARC), is under severe stress. Close to seven years of the Uribe presidency have hurt the FARC's capability and morale. Several top commanders have been captured, killed in combat, murdered by their own men, or died of natural causes, as in the case of Manuel Marulanda, the FARC's historic leader. Thousands of foot soldiers have deserted, bringing the guerrillas' troop strength down by almost half, to perhaps 10,000 today. Still, under its new leader, Alfonso Cano, the FARC has shown renewed internal cohesion and continued capacity to adapt to changes in the security environment. The Uribe government remains wedded to its hardline military approach until the FARC has no option but to negotiate surrender, but this strategy is problematic. President Uribe should keep military pressure up but emphasise devising a political strategy capable of drawing a weakened but still largely intact FARC into peace talks. Priority should also be on strengthening rule of law, protecting human rights and increasing citizen security.

Abstract:
Colombia has experienced conflict for decades. In the 1990s it was a paradigm of the failing state, beset with all manner of troubles: terrorism, kidnapping, murder, drug trafficking, corruption, an economic downturn of major scope, general lawlessness, and brain drain. Today the country is much safer, and the agents of violence are clearly on the defensive. Nonetheless, much work lies ahead to secure the democratic system. Security and the rule of law are fundamental to the task. As the monopoly over the legitimate use of force is established, democratic governance also needs the architecture of law: ministry of justice, courts, legislative scrutiny, law enforcement agencies, regulatory bodies, public defenders, police, correctional system, legal statutes, contracts, university level academic education to train lawyers, judges, and investigators, along with engagement with civil society to promote a culture of lawfulness. Security without the rule of law puts a society at risk of falling into a Hobbesian hell.

The more than 155,000 victims of Colombia's conflict registered to date with the attorney general's Justice and Peace Unit (JPU) – mostly those who suffered from the paramilitaries – are mainly onlookers to, not actors in, a lagging transitional justice process. Over three years after passage, implementation of the Justice and Peace Law (JPL) is stymied by the relative disinterest in promoting victims' rights of the Uribe government and much of political and civil society. The problems are exacerbated by serious operational and financial bottlenecks in the judicial process and assistance and reparations to victims, as well as the persistence of armed conflict with the Revolutionary Armed Forces of Colombia (FARC) insurgents and the emergence of new illegal armed groups (NIAGs) and paramilitary successors.

26. Colombia: Making Military Progress Pay Off

Almost six years of intense security operations against the Revolutionary Armed Forces of Colombia (FARC) by the administration of President Álvaro Uribe are beginning to produce tangible results. Government forces killed several important rebel field commanders in 2007 and two members of the central command in March 2008, including second-in-command Raúl Reyes, and have severely disrupted insurgent communications, prompting a loss of internal cohesion and decreasing illegal revenues. However, this progress has come at the cost of severely deteriorating relations with Ecuador and Venezuela and increased risk of political isolation after the controversial bombing raid on Reyes's camp inside Ecuador. Military gains can pay off only if combined with a political strategy that consistently pursues a swap of imprisoned insurgents for hostages in FARC captivity, reestablishes much needed working relations with neighbours along borders and strongly advances integrated rural development to consolidate security and broaden Colombia's international support.

Abstract:
This working paper analyzes recent peacemaking efforts between the Colombian government and two of the remaining armed guerrilla groups—the Colombian Revolutionary Armed Forces- Popular Army (FARC-EP) and the National Liberation Army (ELN). It evaluates the demobilization process with the paramilitary umbrella organization known as the United Self- Defense Forces of Colombia (AUC), and current efforts to implement the Justice and Peace law that regulates the paramilitary process. The paper analyzes the roles of third-party actors— primarily the church, civil society more broadly, and the international community—in peace initiatives. In Colombia, these roles include pressuring for peace, setting the stage for peace accords, establishing spaces for dialogue and democratic discussion, creating the mechanisms for conflict resolution necessary for a sustainable peace, facilitating or mediating peace processes themselves, and implementing and monitoring peace agreements.

In Latin America and the Caribbean, the end of the Cold War coincided with transitions to democracy in Brazil and the Southern Cone, and the peaceful resolution of armed conflict in Central America. These developments, along with the intensification of globalization processes worldwide, inaugurated a hopeful era of “democratic peace” or “no war” suggesting a decreasing importance for traditional security matters. Although a series of bilateral border disputes continue to simmer in the region, the most intransient ones have been resolved. Indeed, since the 1995 war between Peru and Ecuador, interstate conflict has been all but erased, and military competition has been reduced dramatically. With the exception of Colombia's entrenched civil war and Haiti's faltering state, internal conflicts characterized by significant episodes of political violence have also become a distant memory.

In February 2004, the Revolutionary Armed Forces of Colombia (FARC), the major insurgent group, announced creation of a three-member negotiation commission and a "diplomatic offensive" aimed at obtaining the release of hundreds of its imprisoned members in exchange for about 60 military and political hostages it holds. This has raised hope among the relatives of hostages and kidnap victims that a "humanitarian exchange" could happen in the not too distant future.

More than any of his predecessors, President Alvaro Uribe has made combating the insurgents the overriding priority and defining objective of the Colombian government. Through modest achievements on the ground a sense of public security has begun to be re-established. However, Uribe's "Democratic Security Policy" (DSP), the long-term strategy promised to lend coherence to the security effort, has been stalled for nearly a year by political infighting and fundamental arguments over how best to bring the 40-year conflict to a close. Without some serious modifications, it is doubtful that it will achieve its goal.

Abstract:
This ICG report argues that it is paramount that much more decisive action be taken immediately to confront Colombia's humanitarian crisis. Massive human hardship and suffering has become a constant feature of life as the armed conflict has expanded and intensified. The government's humanitarian policy has encountered many difficulties, largely because of the magnitude of the crisis, the lack of state capacity, the reluctance to divert fiscal resources from military to social programs, and the wide gap between policy planning and reality.The launching of the Inter-agency Humanitarian Action Plan (HAP) by the UN in 2002 reflects a growing international awareness that more coordinated and effective action is urgently needed. But even more needs to be done, including achieving better coordination between the government and humanitarian organisations and increasing current levels of international humanitarian aid.

34. Colombia and its Neighbours: The Tentacles of Instability

While the Colombian armed conflict has deep roots in history, increasingly it is fuelled by the inflow of weapons, explosives and chemical precursors and financed by an outflow of drugs. The tentacles of instability criss-cross the 9000 kilometres of land and water that separate Colombia from and link it to its five neighbours, Ecuador, Peru, Brazil, Venezuela and Panama. Those borders are largely uncontrolled, and the Colombian government has stepped up its demands for fuller regional cooperation. The neighbours are greatly reluctant, partly because of internal crises and partly because of their view of the conflict. Yet, Colombia needs more help from them to make progress in ending that conflict, while peace in Colombia would give them a better chance to solve their own serious domestic problems.

Alvaro Uribe was inaugurated President of Colombia on 7 August 2002 with a strong electoral mandate to fulfil his pledge to enhance the state's authority and guarantee security. In his inaugural address, Uribe promised to search for a negotiated solution to the long-standing armed confrontation with both insurgent groups, the National Liberation Army (ELN) and the Revolutionary Armed Forces of Colombia (FARC) as well as with the paramilitary United Self-Defence Forces of Colombia (AUC). However, in stark contrast to his predecessor, Andrés Pastrana, he conditioned new negotiations on a ceasefire and complete suspension of hostilities.

On 10 March 2002, little more than two weeks after the end of the peace process with the insurgent Fuerzas Armadas Revolucionarias de Colombia-Ejército del Pueblo (FARC), Colombians elected a new House of Representatives and Senate. Despite heightened apprehension among the electorate and the government about violent interference by the guerrilla and paramilitary organisations, the polls took place in an atmosphere of relative calm and good order. In part this was due to the large-scale deployment of military and police forces across the country to guarantee voter security.

This presidential election (first round on 26 May 2002; second round, if needed, on 16 June) will be crucial for the future of Colombia's democracy and its struggle against insurgents and paramilitaries, drugs and widespread poverty. Social and economic distress is now widespread. Public frustration with the ill-fated peace process of the Pastrana Administration over the past three years, its definitive rupture on 20 February 2002, and increased attacks by the main rebel group, the Fuerzas Armadas Revolucionarias de Colombia- Ejército del Pueblo (FARC) on civilians and infrastructure since mid-January have made “war/peace” and “violence” the key vote- determining issues. The failure to negotiate a solution to the longstanding civil war over the past three years has polarised the electorate.

In February 2002, negotiations to end the most dangerous confrontation of Colombia's decades of civil war collapsed. Nearly four years earlier, the newly-inaugurated President Andrés Pastrana had opened talks with the country's major remaining rebel groups, the Fuerzas Armadas Revolucionarias de Colombia-Ejército del Pueblo (FARC) and the Ejército de Liberación Nacional (ELN), with great enthusiasm and hope. But the fighting never ended while the talks sputtered on, and the country now appears headed for a new round of violence in its cities and against its infrastructure. The international community is concerned about the implications not only for Colombia's people and its democratic institutions, but also wider regional stability.

In the past, it was common for nations to believe that promoting conflict in neighboring states could somehow enhance their security, but in the twenty-first century it has become increasingly obvious that conflicts in one nation constitute a security threat to all who share common borders. Today, it is more often the weakness rather than the strength of states that threatens to disrupt the search for peace and stability.

Abstract:
Congressional criticism of 'Plan Colombia's' military component, and the advent of a new administration in Washington, are likely to lead to a strategic review of US policy. The outcome may be a policy that is less military focused, more regionally oriented, and based on closer cooperation with other aid donors. It has become increasingly clear that Plan Colombia can only be implemented if the EU and its member states are prepared to increase their financial contribution. This will give the Europeans considerable leverage, and they are likely to use it to insist on a less militarised approach. However, even with a change in policy emphasis, the prospects of success will remain poor.
