  • Abstract: Between 1981 and 2007, governments in eighty-eight countries established or supported more than three hundred armed militias to provide security to local communities. Such militias often directly engage in armed conflict and law-and-order activities. A number of state-supported civil defense groups make local communities less secure by refusing to respond to state direction, setting up security apparatuses in competition with state authorities, committing human rights violations, and engaging in criminal behavior. The doctrine of state responsibility and the application of international humanitarian law, international human rights law, and international criminal law obligate the state or states that establish or support civil defense groups to investigate, prosecute, punish, and provide reparations or compensate victims. In many cases, the domestic laws of states are ineffective at holding members of govern¬ments or civil defense groups accountable. Local law enforcement authorities also often fail to investigate or prosecute members of civil defense groups. At present there is no specific international legal instrument to guide the responsible management of relationships between states and civil defense groups. Thus, the international community should develop a legal instrument that specifies the rules and principles that apply to states and civil defense groups and that includes a due diligence framework that focuses on accountability and governance of both states and civil defense groups. Such a framework would enhance the protection and security of communities by setting accountability and governance standards, assisting in security sector reform by establishing benchmarks and evaluation processes, and contributing to the reinforcement of legal rules and principles that apply in armed conflicts. For fragile states or those in a post conflict phase of development, the better management of such forces is likely to build state legitimacy as a provider of security to vulnerable communities.

  • Abstract: Former U.N. peacekeepers are an emerging cadre within Pakistan's police who are precursors of professionalization and other positive changes in police culture. Given their peacekeeping experience, they are torchbearers of human rights protection in policing, and believers in gender equality and the rule of law. They have also shown an ability to resist undue political pressure by government ministers, politicians and interest groups. They form a resilient force when it comes to fighting the tide of militancy and terrorism in Pakistan. This pool of trained resources may be utilized by the United Nations Department of Peace-keeping Operations (DPKO) for the quick start of new peacekeeping missions. The Government of Pakistan could also utilize them for police-reform initiatives, imparting training and demonstrating best practices. Given the potential gains from police participation in U.N. peacekeeping, Pakistan's recent, self-imposed ban on police joining peacekeeping deployments in the future should be reversed.

  • Abstract: In 2006, a day of deadly riots in Kabul dramatized the need for an Afghan constabulary force capable of controlling outbreaks of urban violence. In response, the U.S. military and Afghan authorities created an elite gendarmerie, the Afghanistan National Civil Order Police (ANCOP). Although ANCOP was conceived of as a riot control force, it was assigned to the Focused District Development Program to replace district-level Afghan Uniformed Police who were away for training. The high demand and constant transfers required by this duty resulted in rates of attrition among ANCOP units of 75 to 80 percent. In 2010, ANCOP's superior training, firepower, and mobility were recognized in its assignment, along with a “surge” of U.S. military forces, to reverse the Taliban's hold on key areas in southern Afghanistan. In heavy fighting in Marja, Helmand province, ANCOP was demonstrably unprepared to serve as a counterinsurgency force, particularly in areas that had not been cleared by coalition and Afghan military forces. Subsequent improvements in training and partnering with U.S. forces improved ANCOP's performance in Kandahar, where ANCOP was used to hold areas that had been cleared by the military. By 2011, ANCOP had firmly established its place as an elite rapid reaction and counterinsurgency force with a positive reputation among coalition troops and Afghan citizens.

  • Abstract: Maritime security sector reform (MSSR) is a component of security sector reform (SSR). SSR is the complex task of transforming the institutions and organizations that deal directly with security threats to the state and its citizens. MSSR applies the same concepts to the maritime domain. It consists of comprehensive actions taken by littoral countries and a range of partners to improve the security, safety, and economic viability of maritime spaces by improving governance, infrastructure, and law enforcement capacity, creating a broader approach to SSR on the global stage. The globally connected economy relies on the oceans and adjoining littorals for fishing, access to natural resources, and the movement of much of the world's commerce. Effective governance of maritime spaces has become essential for both economic growth and regional security. Continued population growth in the coastal regions, or littorals, strains the maritime infrastructure and the capacity to govern, resulting in unmet security challenges from competing countries, transnational criminal organizations, and insurgent and terrorist groups that exploit instability in the maritime domain. MSSR may be undertaken to strengthen existing maritime governance, respond to specific instability or threats, or restore governance following conflict or natural disasters. MSSR involves a whole-of-government process to identify and address specific problems through collaborative approaches that coordinate the contributions of internal and external organizations. The MSSR process begins with a multidisciplinary assessment, ideally performed by representatives from private and public institutions. It must take into account a country's history, culture, and the aspirations of its citizens and government. MSSR is not the imposition of external organizations, plans, or processes. The U.S. government's role in MSSR, while often significant, must be closely coordinated with efforts by the United Nations, donor nations, nongovernmental organizations (NGOs), and the private sector. Achieving this level of coordination may be the most challenging aspect of successful MSSR.

  • Abstract: Civilian oversight ministries are essential to broader efforts to strengthen the performance and responsiveness of security and law enforcement forces. Ministries facilitate coordination among agencies, hold personnel accountable to law and policy, perform administrative functions, shield forces from political interference, and enable civilian oversight through the legislature, civil society, and other mechanisms. Failure to support these roles can undermine efforts to strengthen law enforcement and improve citizen safety in countries affected by conflict or instability. The European Union has extensive experience supporting oversight ministries, having prepared twenty-one ministries of interior to join the EU. The European Commission has assisted ministries in developing countries around the world, while the European Council has deployed civilian missions to crisis environments to establish security and the rule of law. Efforts to develop the laws, procedures, and organizational structures needed for effective oversight ministries face numerous challenges, from limited human capacity to political and organizational resistance, especially in countries transitioning from conflict or authoritarian rule.EU enlargement provided a unique incentive for countries to overcome obstacles to transforming their ministries and improving security sector governance. EU institutions helped translate this incentive into organizational changes by helping candidate countries define a clear structure and vision, deploying experienced experts from EU member states, and managing resistance through coordinated political engagement in support of clearly defined benchmarks. In crisis and stabilization countries, the EU has faced greater challenges. Without a strong external incentive, weak capacity and severe political tensions have undermined assistance efforts. The EU has been enhancing its capabilities for deploying skilled personnel to these environments and for leveraging member states' relationships with countries affected by conflict, to help them overcome political obstacles. Yet the EU has often struggled to achieve the coherence among member states and institutions necessary to support locally driven reforms. The United States can learn from the EU's successes and challenges by paying attention to the role of oversight ministries in the development of security and law enforcement forces overseas. To build its capacity to strengthen oversight ministries and other components of security sector governance, the United States should recruit personnel with broader sets of skills, improve coherence among agencies providing assistance, and deepen cooperation with the EU and other donor countries. Through collaboration in headquarters and in the field, the EU and the United States could complement each other's strengths and pursue common approaches to fostering institutional change in the security sector.

  • Abstract: In 2004, the U.S.-led coalition and Iraqi security forces faced a growing challenge from insurgents and militia groups as the country drifted toward civil war. In street battles with heavily armed insurgent and militia groups, Iraq's fledgling police units mutinied under fire and resigned en masse, pointing out shortfalls in the U.S. police training program. In response, the U.S. government transferred leadership of the U.S. police assistance program from the State Department to the Defense Department, which created heavy police tactical units capable of dealing with armed groups. At the same time, the Iraqi interior ministry independently organized police commando units composed of former Iraqi soldiers that successfully fought alongside U.S. military forces. In 2005, the installation of a new Iraqi government and the escalation of sectarian violence brought a change in the composition of the Iraqi police commando units. The new interior minister, a senior Shiite party official, enabled members of Shiite militia groups to take over the police commando units and engage in the kidnap, torture, and murder of Sunnis. To control police death squads, the U.S. military combined all of Iraq's heavy police and police commando units into a new entity, the Iraq National Police (INP). In October 2006, the U.S. military began a program to retrain police commando units that were engaged in sectarian violence. Over the following year, Iraq's new interior minister, Jawad al-Bolani, undertook a program to reform the INP, appointing a new commanding general, purging the officer corps, and inviting a training team from the Italian Carabinieri to provide advanced instruction for INP units. In 2007, INP units successfully partnered with U.S. combat brigade teams that were deployed to Baghdad as part of President Bush's surge of U.S. military force into Iraq. Over the next two years, the valor of Iraqi constabulary units and their acceptance in both Sunni and Shiite areas brought a new name, the Iraq Federal Police (IFP), and the deployment of an IFP unit to every province in the country. Lessons learned in the development of an indigenous police constabulary in Iraq should be applied to current and future stability operation.

  • Abstract: Embedded provincial reconstruction teams (ePRTs) were small State Department- led units inserted into U.S. combat brigades in Iraq from 2007 to 2010 to support military counterinsurgency efforts at the local level. During major combat operations in 2007 and into 2008, ePRTs provided important support to military counterinsurgency efforts. As U.S. combat units wound down these efforts and withdrew from towns and cities, ePRTs did useful-but harder to quantify-work in mentoring local officials. Combat brigades and ePRTs generally worked well together. However, some units were unsure of how best to employ civilians. The military and civilians also sometimes had differing views on issues of short-term versus long-term goals. Despite problems, ePRT veterans believe that they had a positive effect in both supporting military counterinsurgency efforts and helping local Iraqi officials prepare for self-reliance. Interviewees identified a variety of operational problems that detracted from ePRT mission accomplishment. The Iraq ePRTs are now history, but as the United States continues to use civil-military teams in Afghanistan, these observed lessons need to be learned and acted upon.

  • Abstract: Police corruption is an international problem. Historically, police misconduct has been a factor in the development of police institutions worldwide, but it is a particular problem in counterinsurgency and peacekeeping operations, such as the U.S.-led North Atlantic Treaty Organization police training program in Afghanistan. There, police abuse and corruption appear endemic and have caused some Afghans to seek the assistance of the Taliban against their own government. The most reliable and extensive knowledge about police corruption in the world's Englishspeaking countries is found in the reports of specially appointed blue-ribbon commissions, independent of government, created for the sole purpose of conducting investigations of police corruption. To reduce police corruption, the commissions recommend creating external oversight over the police with a special focus on integrity, improving recruitment and training, leadership from supervisors of all ranks about integrity, holding all commanders responsible for the misbehavior of subordinates, and changing the organization's culture to tolerate misbehavior less. The remedies proposed by the commissions, however, rely on a set of contextual conditions not commonly found in countries emerging from conflict or facing serious threats to their security. This report suggests triage and bootstraps as strategies for reducing police corruption in countries with security threats. Triage involves targeting assistance in countries where there are solid prospects for tipping police practice in the desired direction. Bootstraps involves using reform within the police itself as a lever to encourage systemic social and political reform in countries in crisis or emerging from conflict.

  • Abstract: The 2011 Conference on Disarmament (CD) began contentiously when Ambassador Zamir Akram, Pakistan\'s permanent representative to the United Nations, criticized United States\' support of India\'s membership in export organizations that would allow it to engage in nuclear trade. Pakistan believes such membership would further favor India and accentuate the asymmetry in fissile materials stockpiles of the two states. Strategic and security concerns drive Pakistan\'s commitment to block negotiation of a fissile material cutoff treaty. Progress during the CD seems unlikely if the United States and Pakistan remain entrenched in their respective positions.

  • Abstract: With U.S. military forces scheduled to depart Iraq in December of this year, the State Department and other civilian agencies are being asked to assume a scale of operational and programmatic responsibilities far beyond any other embassy in recent memory. The capacity of the U.S. civilian agencies to assume these responsibilities does not now fully exist. Notably, securing and moving U.S. civilians will require more than 5,000 security contractors. A limited U.S. military contingent post-2011 may well be more cost-effective than private security guards and could also relieve State and other civilian agencies of logistical and security responsibilities. This would enable them to focus on their comparative advantages: diplomacy and development assistance. Planning for the post-2011 U.S. mission in Iraq, however, remains hampered by uncertainty as to whether the Iraqi government will request an extension of the American military presence in the country. A small follow-on U.S. military force would appear to safeguard Iraqi stability and make the achievement of U.S. strategic objectives in Iraq more likely, but cannot be counted on. Should such a request not be received from the Iraqi government, the U.S. may need to reduce the planned scale and scope of its operations and goals in Iraq.

  • Abstract: Consolidating the legitimate use of force in the hands of the state is a vital first step in post-conflict peacebuilding. Transitional governments must move quickly to neutralize rival armed groups and provide a basic level of security for citizens. Two processes are vital to securing a monopoly of force: disarmament, demobilization, and reintegration and security sector reform. Disarmament, demobilization, and reintegration (DDR) involve disbanding armed groups that challenge the government's monopoly of force. Security sector reform (SSR) means reforming and rebuilding the national security forces so that they are professional and accountable. U.S. experience in Afghanistan, Iraq, Liberia, Haiti, Bosnia, and Kosovo yielded three crosscutting lessons: go in heavy, tackle DDR and SSR in tandem, and consolidate U.S. capacity to implement both tasks in a coordinated, scalable way.

  • Abstract: Faced with difficulties establishing legitimate, effective rule of law and the predominance of informal or traditional justice mechanisms in Afghanistan, the Afghan government and the international community have increasingly focused on engaging informal justice systems to resolve both civil and criminal disputes. While informal systems vary across the country, they are generally based upon restorative justice and the preservation of communal harmony. They currently resolve the vast majority of legal disputes and other conflicts in the country, particularly in rural areas. Engagement with informal systems and linking such systems to state institutions present some of the more effective opportunities for resolving conflicts and increasing access to justice for all Afghans because they are familiar, locally available, and involve relatively low costs. Such engagement, however, also faces significant logistical, cultural, political, and legal challenges. When engaging informal systems and/or implementing programs to link them to the state, it is important to have sound understanding of local power dynamics and how local dispute resolution systems function. The United States Institute of Peace (USIP) has been working on informal justice in Afghanistan since 2002 and has run pilot projects in six districts that test ways of designing or strengthening links between the state and informal systems to increase access to justice. Some of the best practices identified from the pilot projects include the importance of regular and substantive communication between informal and state justice actors, the promotion of the use of written records of decisions by informal systems, and the monitoring of decisions to ensure applicable Afghan laws and international human rights standards are upheld.

  • Abstract: An initiative by the Ministry of Public Health in Afghanistan to expand health services throughout the country, including rural communities, and supported by donors including USAID, has vastly expanded access to primary health care services, significantly reduced child mortality, and increased the capacity of the Afghan government to provide an essential service to its people. The program is based on principles of equity, national ownership, community engagement, and women's equality, and it warrants continued development. Many challenges remain, not least expanding services in insecure areas, and a more stable environment could better enable the Ministry of Public Health to achieve its goals. The U.S. military has supported health services development for the Afghan army and also offers significant emergency care services to civilians in insecure regions, training for health workers, construction of health facilities and other health-related programs. The military's civilian health initiatives, largely disconnected from the Ministry of Public Health, are short term, ad hoc, and unsustainable, and to date have lacked a consistent rationale or strategy, and have not been subject to evaluation. U.S. counterinsurgency strategy seeks to mesh development and security objectives through activities that enhance the legitimacy of the Afghan government in the eyes of its people. In the field of health, there are considerable tensions between counterinsurgency and development strategies, which must be addressed to increase the capacity of the government and meet health needs of the people.

  • Abstract: More than seven years after U.S. forces entered Afghanistan, important gains made in bringing stability and democracy to Afghanistan are imperiled. While there have been some positive developments in such areas as economic growth, the Taliban and other insurgent groups have gained some ground in the country and in neighboring Pakistan, the drug trade remains a significant problem, and corruption has worsened in the Afghan government. According to United Nations data, insurgent incidents have increased every year since the 2001 overthrow of the Taliban regime. The situation in parts of Afghanistan's south and east is particularly concerning because of the twin menace of insurgent and criminal activity. Despite these challenges, the insurgency remains deeply fractured among a range of groups, and most have little support among the Afghan population. This presents an opportunity for Afghans and the international community to turn the situation around.

  • Abstract: At this time of the U.S. Treasury's Department's extraordinary prominence in domestic affairs, it is possible to overlook the critical functions that the Treasury performs in U.S. international policy. This would be a significant oversight at any time, as Treasury has long made more international contributions, of greater importance to U.S. policy, than has often been widely understood. It is even more of an oversight in the post-9/11 international environment, which has presented new challenges that have sorely tested many of the United States' more well-known foreign policy and national security institutions.

  • Abstract: In seven years, the Afghan National Police forces have grown to 68,000 personnel, with a target end strength of 86,000. The ANP includes the uniformed police force, which is responsible for general police duties, and specialized police forces, which deal with public order, counternarcotics, terrorism, and border control. Despite the impressive growth in numbers, the expenditure of $10 billion in international police assistance, and the involvement of the United States, the European Union, and multiple donors, the ANP is riddled with corruption and generally unable to protect Afghan citizens, control crime, or deal with the growing insurgency. The European Union has replaced Germany as the lead partner for police reform, but the United States has the largest police program, which is directed by the U.S. military. Putting soldiers in charge of police training has led to militarization of the ANP and its use as a counterinsurgency force. Using improperly trained, equipped, and supported ANP patrol men as “little soldiers” has resulted in the police suffering three times as many casualties as the Afghan National Army. Police are assigned in small numbers to isolated posts without backup and are targeted by the insurgents. Beyond funding the Taliban, the explosion in Afghan narcotics production fueled widespread corruption in the Afghan government and police. Drug abuse by police officers became increasingly common as did other forms of criminal behavior. Challenges facing the ANP were further compounded by a proliferation of bilateral police assistance programs that reflected the policing practices of donor countries. These efforts often were not coordinated with the larger U.S. and EU programs, creating confusion for the ANP. The Obama administration has acknowledged the importance of the police and announced its intentions to expand and improve the ANP as a key part of its plan for stabilizing Afghanistan. It should do this as part of a broader international community approach to police assistance that embraces a comprehensive program for security sector reform and rule of law.

  • Abstract: While the U.S. and world economies are slowing markedly, Security Sector Reform (SSR) is a growth industry for the private sector. U.S. government employees may set SSR policy and design projects, but implementation is extensively outsourced to private contractors. With the forthcoming surge of U.S. military forces into Afghanistan, the U.S. Army has announced contracts worth $1.1 billion for the construction of military bases and training centers for Afghan military and police. Private firms supply everything from construction materials to trainers and administrative staff. Private contractors operating in Pakistan and Afghanistan are required to provide their own security. Up to 15 percent of the cost of construction will go to private security firms, which guard convoys, facilities and personnel.

  • Abstract: International actors in Security Sector Reform (SSR) are increasingly taking on roles as “advisors” to Ministries of Interior, Defense, and Justice. Rather than directly implement changes necessary for SSR, these advisors must persuasively articulate suggestions to their local counterparts. Advisors' success depends on their ability to convey recommendations in a manner that makes change acceptable to their advisees. Ministerial and governmental advising is not the exclusive purview of any one entity. Rather, advising is undertaken by a diverse range of individuals from U.S. and foreign governments, militaries, NGOs, private contractors, and U.N. agencies.
