Abstract:
With little to no prospect for accountability within Iran’s domestic courts, victims and survivors of serious violations of international law are turning toward an increasing number of foreign jurisdictions—most commonly in Europe and North America, but also in Latin America, Africa, and other regions—to pursue justice for human rights violations carried out by the Islamic Republic of Iran. Under the principle of universal jurisdiction, certain domestic justice systems allow prosecutions in national courts for crimes committed abroad, regardless of the victim’s or perpetrator’s nationality. Universal jurisdiction stems from the concept that certain crimes are of such gravity that they harm the international community as a whole, so national courts outside the country where the violations took place may prosecute them to protect the international order. Although the crimes subject to universal jurisdiction provisions differ by state, they generally include crimes against humanity, torture, war crimes, and genocide. Limitations on universal jurisdiction also vary between states, however, as do the processes for filing complaints and procedures for investigations, trials, and appeals. As was shown by the trial and conviction of Hamid Noury in Sweden for his involvement in the massacre of Iranian political prisoners in 1988, national prosecutions of international crimes can be a fruitful avenue to justice for victims of the Islamic Republic. To this end, the Atlantic Council’s Strategic Litigation Project has compiled a guide to aid practitioners and independent investigators in navigating the legal systems of European states with the highest likelihood of prosecuting Iranian human rights violators. Focusing on five states—France, Germany, the Netherlands, Sweden, and Switzerland—this manual outlines the crimes and violations subject to universal jurisdiction, best practices for investigating and documenting crimes, and processes for requesting investigations and participating in prosecutions as a victim, witness, or NGO. For information that is beyond the scope of this manual, the annex includes printed resources to consult and organizations to contact for additional assistance.

4. THE DAY AFTER: Anticipating trouble in the event of a US withdrawal from Syria

With approximately nine hundred troops in northeastern and southeastern Syria, the United States ostensibly aims to prevent the reemergence of the Islamic State group (IS). The withdrawal of US forces from Afghanistan, initiated by the Trump administration and completed by the Biden administration, was followed by the rapid collapse of the pro-Western government of Afghanistan and its replacement by the Taliban. This has led to questions about what will happen if and when US forces withdraw from northeastern Syria. A new issue brief by Atlantic Council’s Senior Fellow Jomana Qaddour examines the social, political, and economic implications and the challenges to US presence in Syria. While the US military presence remains limited in number, this report also underscores how aggregate US influence is much more potent than a force number of nine hundred suggests. US troop presence has enhanced counterterrorism operations, obstructed IS and Iranian smuggling routes, and facilitated humanitarian aid and economic benefits to a population in Syria that would be languishing under even more dire conditions. It can be argued that it has also limited local violence and halted a resurgence of public IS activities. According to the most recent Syria policy review, US presence is limited to the goal of counterterrorism operations, which implies that it is a conditions-based, not calendar-based deployment. Those conditions should include local Syrian forces that can reasonably deny IS a safe haven from which to plot terrorist attacks against the United States and its allies. It is well known that the Assad regime is not likely to provide the necessary capability to assure the United States and its allies that it can prevent IS’s return. In reality, there is little room to positively read the reassertion of Syrian government control over northeastern Syria; and withdrawal from Syria would be a serious gamble for US national security concerns in Syria and the region.

A new report, Iraq: Implementing a Way Forward, authored by Atlantic Council staff and fellows C. Anthony Pfaff, Ben Connable, and Masoud Mostajabi lays out findings and recommendations to assist the Iraqi government and its international partners in improving political, social, economic, and security conditions to enhance national stability, stabilize Iraq’s democratic processes, and promote broad-based, Iraqi-generated economic growth. The report draws on two years of engagement with experts from Iraq, the United States, and Europe through a US-Europe-Iraq Track II Dialogue convened from March 2020 through December 2021. Convened by the Atlantic Council’s Iraq Initiative and the Konrad-Adenauer-Stiftung with support from DT Institute, the Dialogue consisted of a series of workshops to identify policies to help address Iraq’s political, socioeconomic, and security challenges. Dialogue participants included former and current high-level officials and experts, all of whom are committed to a better future for Iraq.

6. Attacks on Hospitals from Syria to Ukraine: Improving Prevention and Accountability Mechanisms

When Russia invaded Ukraine on February 24, 2022, it soon began implementing one of its frequent—and criminal—tactics that it had already been using in its military intervention in Syria: bombing healthcare and medical facilities. Syrian government forces first began targeting health workers in Syria in 2011 at the start of the Syria crisis, and Russia joined them in targeting the healthcare system upon its official entrance to the conflict in 2015. Over the course of the conflict, over 90 percent of 601 recorded attacks on medical facilities were attributable to either Syrian or Russian forces. In Ukraine, Russia has reportedly perpetrated more than 200 attacks on healthcare facilities and ambulances since the start of the invasion. The well-documented pattern of targeted attacks on healthcare in Syria and Ukraine undermines long-established and hard-won provisions under international humanitarian law intended to protect civilians during conflict. Despite the scale of the problem, which extends beyond Syria and Ukraine, there has been no prominent criminal prosecution of any alleged perpetrators of attacks on healthcare in any conflict, no establishment of a UN mandate dedicated to this issue, and no task force created by national governments specifically aimed at prevention of and accountability for these crimes. The international community’s failure to compel meaningful action to stop the criminal practice of targeting healthcare in conflict after conflict has resulted in continued deaths of health workers and civilian populations. In a new issue brief by the Atlantic Council Strategic Litigation Project‘s Elise Baker and Gissou Nia, the two propose recommendations to UN bodies, the World Health Organization, national governments and other institutions and decision makers for concrete actions to prevent future attacks and advance accountability for past ones.

The first time Russia invaded Ukraine in the twenty-first century, the Wagner Group was born. The now widely profiled private military company (PMC) played an important role in exercising Russian national power over the Crimea and portions of the Donbas—while giving Moscow a semblance of plausible deniability. In the near decade since, the Russian PMC sector has grown considerably, and is active in more than a dozen countries around the world. PMCs are paramilitary organizations established and run as private companies—though they often operate in contract with one or more states. They are profit-motivated, expeditionary groups that make a business of the conduct of war.1 PMCs are in no way a uniquely Russian phenomenon, yet the expanding footprint of Russian PMCs and their links to state interests call for a particularly Russian-focused analysis of the industry. The growth of these firms and their direct links to the Kremlin’s oligarch network as well as Moscow’s foreign media, industrial, and cyber activities present a challenge to the United States and its allies as they seek to counter Russian malicious activities abroad. As signals intelligence and offensive cyber capabilities, drones and counter-drone systems, and encrypted communications become more accessible, these technologies will prove ever more decisive to both battlefield outcomes and statecraft. More exhaustive research on these issues is necessary. The ongoing conflict resulting from Russia’s second invasion of Ukraine in this young century seems likely to shape the conduct of Russian foreign policy and security behavior for years to come—and these firms will play a part. The activities of these PMCs include high-intensity combat operations, as evidenced in Syria in 2018 and Ukraine in 2022, and a mix of population control, escort and close protection, and local direct-action activities, as seen in Libya, Mali, and elsewhere.2 Given the sourcing and dependence of Russian PMCs on Russian military service personnel and no small influence of Russian doctrine, the questions to reasonably ask include: How do changes in the Russian conduct of war and adoption of new technologies influence these PMCs? Moreover, how might these technological changes influence the role these PMCs play in Russian strategic goals and activity abroad?

The Kurdistan Region of Iraq (KRI) has proven gas reserves of over 25 trillion cubic feet—or 20 percent of Iraq’s total proven reserves. Syria is home to one of the world’s most complex conflicts. The chaos caused by the Syrian regime and its allies — within Syria, across the Middle East, and beyond — poses immediate and enduring threats. Considering its foreign policy promise to defend democracy and human rights, the Biden administration does not have the luxury of ignoring what happens in Syria. Accepting that there are fewer options for the United States today than there were ten years ago does not mean normalizing the Assad regime or turning a blind eye to Russian and Iranian efforts to tip the balance of power in the region. In a new issue brief from the Atlantic Council’s Syria program, “What Choices Remain for the United States in Syria?,” Nate Rosenblatt and Jomana Qaddour describe the challenges the United States faces in Syria, including Russia’s attempt to expand the UN Strategic Framework as well the struggle to keep the UN humanitarian border crossings open in northern Syria. The memo then lays out the three potential strategies in Syria: one prioritizing the withdrawal of US forces, a second protecting humanitarian access and ensuring progress on limited, critical files, and a third maintaining US support for, as well as coordination with, partners to dial up the pressure on the Syrian government and its allies. The paper ultimately argues that the Biden administration should seize this opportunity to establish a clear strategy in Syria by aligning its defense, development, and diplomatic capabilities with those of its global allies and partners to shape a better outcome in Syria.

Arab countries, rich and poor, large and small, are rapidly approaching a moment of reckoning. A confluence of anachronistic governance, economic mismanagement, and disruptive technology, which has changed the dynamics of both the supply and demand for hydrocarbon fuels and raw materials, is pushing the region to a tipping point. Together, these factors spell an end of the welfare state and an irreversible break in the social compact that has been in place for the past five decades. 12. Generational Dynamics of Economic Crisis and Recovery: Prospects for Younger and Older Persons

Economic shocks affect young and older age groups disproportionately and highlight the insecurity of the youth labor market and volatility of older people’s savings. The COVID-19 pandemic exacerbated youth labor market challenges and caused young people to either lose jobs or work fewer hours. It also undermined the financial security of older people who tend to own small businesses given that half of the small businesses either closed down or lost significant revenue during lockdowns. Furthermore, COVID-19 exacerbated the digital divide between generations. While younger people are more likely to be technologically savvy, older generations often lack digital literacy to adapt to online work or virtual communications platforms. Dr. Goldin argues that to alleviate the disproportionate suffering experienced by young and elderly age groups during the pandemic, policymakers should increase targeting of social-protection measures, facilitate private-sector investment in education and training, invest in improving digital services and infrastructure, ensure access to financial services, and collect age-disaggregated data on economic and COVID-related indicators.

This year marks the thirtieth anniversary of diplomatic relations between China and Saudi Arabia. Over the past three decades, the bilateral relationship has transitioned from one of marginal importance for both countries to a comprehensive strategic partnership, largely on the back of a trade relationship founded on energy. This report begins with a brief historical overview of Sino-Saudi relations, describing how the two countries transitioned from mutual hostility to diplomatic relations, and then how political and economic cooperation strengthened the relationship to the point that they signed a comprehensive strategic partnership in 2016. It then discusses how the partnership has developed through the 1+2+3 cooperation pattern, especially through projects linking China’s Digital Silk Road with Saudi vision 2030, as well as nascent levels of security cooperation. It ends with an analysis of the bi- lateral relationship within the context of the US-Sino-Saudi triangle: How does it affect each state’s larger strategic interests, and can issues where their interests diverge put a ceiling on future Sino-Saudi ties?

The election of former Vice President Joe Biden in the United States presents the prospect of major changes in US foreign policy, especially toward Iran. These changes cannot begin to be implemented until after Inauguration Day in January of the new year, while an urgent need exists for other players to bridge the gap. None are better suited to this task than the US’s closest allies in Europe which have already played a significant role in the negotiations that led to the 2015 Joint Comprehensive Plan of Action (JCPOA). Britain, France and Germany – the E-3 – and the European Union have also worked tirelessly to keep the JCPOA alive in the face of the unilateral US withdrawal from the agreement in 2018, the imposition of draconian sanctions by the Trump administration and escalating tensions in the Middle East. A new report by Ellie Geranmayeh, Barbara Slavin, and Sahil Shah presents a series of recommendations for the E-3 and the EU to preserve the JCPOA, promote regional peace and development and boost people-to-people contacts with Iran in concert with the new US administration. Taken together, these steps would amount to a renewed transatlantic diplomatic agenda through which the United States and European allies can stabilize the nuclear file and then build on the resulting diplomatic momentum to address other concerns with Iran.

15. Turkey’s Refugee Resilience: Expanding and Improving Solutions for the Economic Inclusion of Syrians in Turkey

Since 2014, Turkey has not only hosted the world’s largest refugee population but has also modeled a best practice for the global refugee policy discussion. Turkey’s experience on the key issues such as jobs and employment should be examined as lessons for both refugee hosting countries and donor countries alike. The country has provided Syrians under Temporary Protection the right to access work permits and formal employment. Facilitating self-reliance for such a large number of refugees’ households remains a challenging task, even in the medium to long-term. This is especially the case in a context where increasing levels of unemployment in Turkey compounded by the socio-economic impact of the COVID-19 pandemic have posed a serious challenge to job creation and increased competition for available opportunities. Many Syrians living in Turkey experiencing partial or complete loss of income while incurring higher expenses, which is compounded for most households by a lack of savings. Addressing these challenges requires to draw lessons learnt at both policy and operational level to effectively support access to livelihoods opportunities. This notably involves fostering greater engagement and partnership with the private sector, on the one hand, and exploring innovative solutions such as e-work and online livelihoods opportunities on the other. The COVID-19 pandemic is proving to be an important test on the government’s and their international partners’ relevance and flexibility and their ability to quickly step up efforts in that direction. In this context, UNDP Turkey—a longstanding development partner and the co-lead of the Refugee and Resilience Response Plan (3RP)—joined hands with the Atlantic Council’s program on Turkey—”Atlantic Council IN TURKEY”—to explore policy options to foster socioeconomic inclusion among Syrians under Temporary Protection. Building on the experience and expertise of both organizations, our joint policy report : “Turkey’s Refugee Resilience: Expanding and Improving Solutions for the Economic Inclusion of Syrians in Turkey” aims at outlining pragmatic and innovative options to facilitate refugees’ access to decent employment so as to contribute to our common objective to #leavenoonebehind.

16. United G20 must pave the way for robust post-COVID-19 recovery

The world is facing unprecedented health and economic crises that require a global solution. Governments have locked down their economies to contain the mounting death toll from the COVID-19 pandemic. With this response well underway, now is the time to move into a recovery effort. This will require a coordinated response to the health emergency and a global growth plan that is based on synchronized monetary, fiscal, and debt relief policies. Failure to act will risk a substantial shock to the postwar order established by the United States and its allies more than seventy years ago. The most effective global forum for coordinating this recovery effort is the Group of 20 (G20), which led the way out of the global financial crisis (GFC) in 2009, the closest parallel we have to the current catastrophe. Eleven years ago, world leaders used the G20 meeting in London as the forum to deliver a unified response and a massive fiscal stimulus that helped stem economic free fall and prevented the recession from becoming a second Great Depression. A decade on, it is clear that the G20 is the only body with the clout to save the global economy. This does not mean that the G20 should be the only forum for actions for its member states. The United States, for example, should also work closely with like-minded states that support a rules-based world order, and there are many other fora where it can and must be active with partners and allies. But no others share the G20’s depth and breadth in the key focus areas for recovery. The other multilateral organizations that could take up the challenge lack either the substance or membership. The United Nations may count all countries as members but is too unwieldly to coordinate a response. The International Monetary Fund (IMF) has the resources but requires direction from its 189 members. The Group of Seven (G7), which once oversaw financial and economic management, does not include the fast-growing emerging economies. The G20 represents both the world’s richest and fastest-growing countries, making it the forum for international collaboration. It combines that representation with agility.

17. Troubled vision: Understanding recent Israeli–Iranian offensive cyber exchanges

Reported Iranian intrusions against Israeli critical infrastructure networks and alleged Israeli actions against Iranian proliferation-associated targets pose substantial new challenges to understanding ongoing competition and conflict in the Middle East. These cyber exchanges may be interpreted through two distinct lenses: as the struggle to achieve deterrence using the instrument of cyber operations, or as the contest for initiative in order to establish conditions for relative security advantage in a cyber-persistent environment. Either way, these ongoing incidents are best understood not as “bolt out of the blue” attacks, but rather fleeting glimpses of continuing cyber campaigns leveraging previously disclosed and newly developed capabilities as each side grapples to anticipate cyber vulnerability and shape the conditions of exploitation. The opaque nature of these interactions is further complicated by potential bureaucratic politics and interservice rivalries, as well as unknown dynamics of a counter-proliferation campaign to slow, disrupt and potentially destroy Iranian nuclear capacity. In the end, observed cyber actions may not represent reflections of accurate strategic calculation, and even if aligned to the operational environment they may not lead to intended outcomes. Two years ago, US President Donald J. Trump walked into the White House Diplomatic Reception Room and announced his intention to withdraw the United States from the Joint Comprehensive Plan of Action (JCPOA). The Trump administration reimposed sanctions on Iran and has adopted a policy of “maximum pressure” to compel Iran to change its behavior and to deny the Iranian regime the resources to engage in its destabilizing activities. However, he also promised he was ready, willing, and able to make a new and lasting deal with Iran. In “Trump’s JCPOA Withdrawal Two Years On – Maximum Pressure, Minimum Outcomes” author David Mortlock, Senior Fellow at the Atlantic Council, evaluates the policy outcomes of President Trump’s withdrawal from the JCPOA. The author walks readers through the timeline of President Trump’s decision to withdraw from the JCPOA, the subsequent implementation of the maximum pressure campaign on Iran, and the policy outcomes relative to stated objectives. In sum, Mortlock concludes that although the maximum pressure campaign has been effective in inflicting economic harm on Iran, it has had minimum effect in other areas. Therefore, Mortlock believes the Trump administration should seize the opportunity to pivot from maximum pressure to an approach focused more on policy outcomes.

Almost fourteen years since the 2006 war, Hezbollah and Israel seem to be drifting closer to war than at any time in the last decade. Even as Lebanon and Israel grapple with the COVID-19 pandemic, neither the Israeli military nor Lebanon’s Iran-backed Hezbollah are allowing the disease to distract from their long-running enmity. With the military buildup on both sides, the mutual destruction would be far reaching. Given the risks at hand, the Atlantic Council has released a new report, “Counting the Cost: Avoiding Another War between Israel and Hezbollah,” authored by Nicholas Blanford, a Beirut-based nonresident senior fellow in the Atlantic Council’s Middle East programs, and Brig. Gen. (Res.) Assaf Orion, senior research fellow at the Institute for National Security Studies in Tel Aviv. The authors examine the current force posture of the Israel Defense Forces and Hezbollah, identify potential triggers that could lead to a war, analyze how the next war would be fought by both sides, and offer recommendations to at least maintain the current relative calm and avoid a conflict that could cost thousands of lives and bring unprecedented ruin to both Lebanon and Israel.
