2. "Their Priority Is Not The People": Civilian Views On Peace Operations In Africa

- “Their priority is not the people of Somalia,” a Somali woman who had recently fled to the Dadaab refugee camp in Kenya said about peacekeepers in her home country. “It is the government and themselves.” Unfortunately, this view is not unique. Civilians in countries with peace operations often experience a wide gap between them and those missions. Yet, at a time when peacekeeping is at a crossroads—again—and under increasing financial pressure, it is more important than ever to solicit and acknowledge the views of the citizens who are affected by peace operations. Their suggestions on how to bolster results should be taken into account in the ongoing debates about successes, failures, and costs of peace operations. However, despite an acceptance in the ever-quoted HIPPO report that “engaging with host countries and local communities must increasingly be regarded as core to mission success” and despite the acceptance of protection of civilians as a core norm for UN peacekeeping, realities on the ground demonstrate that too little has been done to access or include these voices. Between October 2015 and April 2017, International Refugees Rights Initiative (IRRI) conducted close to 200 interviews with civilians in South Sudan, Sudan (Darfur) and Somalia about how they perceive the peace operations in their countries. The three missions in those countries, all of which are mandated by the UN Security Council, embody the range of different options available to implement the strategic partnership between the African Union and the UN, from a fully-fledged UN mission in South Sudan (UNMISS), to a joint AU-UN mission in Darfur (UNAMID) and an AU-operated mission in Somalia (AMISOM). While all three operate in significantly different contexts, they all have “little peace to keep” and have been often criticized for their limitations in implementing their mandate, especially when it comes to the protection of civilians. All three missions have also been reviewed this year. UNAMID has been restructured and its troop numbers have been seriously reduced; the UN and AU have just concluded a joint review of AMISOM and strengthened the focus in its mandate on withdrawal and handover to Somali security forces. UNMISS faces some minor budget cuts and a review, even as reinforcement by a Regional Protection Force is slowly being implemented. While much of what was talked about by the Somalis, South Sudanese, and Darfuris interviewed during the course of the research was specific to their context, a number of similarities and trends emerge from their responses, despite the strategic, operational, and contextual differences between the three missions. These trends are important, not only for any new rounds of high-level policy debates, but also for addressing the strategic challenges for protection of civilians and the rock-bottom popularity of peacekeepers among the civilians they are supposed to protect.

- Serious shortcomings in Sudanese laws and practices contribute to the lack of protection of victims of rape in Sudan. There is need for comprehensive legal reform, particularly of Sudan's Criminal Law of 1991. The categorisation of rape as a form of adultery does not result only in the virtual impossibility of convicting a rapist, but may even lead to the incrimination of the female victim of rape instead. This is particularly problematic considering the widespread use of sexual violence in the Darfur conflict. One of the encouraging consequences of the international attention on war rapes in Darfur is that women activists are increasingly positioning sexual violence against women as a concern on the national political agenda. Several legal reform initiatives are under way within the country among both state and non-state actors alike. The comprehensiveness of the reforms suggested differs in substance, but there is a consensus among both government and civil society actors that there is a need to differentiate between rape and adultery in current law. This consensus is extremely important, especially considering the sensitive and increasingly politicised and polarised debate on the topic. Although women face serious challenges in the Sudanese legal system, it is important to highlight how women activists are launching reform initiatives in order to bring justice to rape victims and to end the system of impunity for rapists. International donors can contribute a great deal in terms of supporting these reform initiatives and facilitating dialogue forums.

- Norway's five-year experience as the lead nation of the Provincial Reconstruction Team This policy paper is a practically-oriented comparative analysis of the work of the International Criminal Court in Kenya, Uganda, Sudan, and the Central African Republic, and the policy implications for its work for Norway, States Parties, civil society, and key states. The paper argues that all actors, including Norway, should more seriously engage these African states – and key stakeholders within them – to facilitate the work of the ICC to stem impunity. Without such support, the paper concludes, the ICC's objectives in Africa will not be realised.

- Absent a change in current trends, further political violence in Sudan will be hard to avoid. Lack of governance capacity in the South and failure to resolve key issues between the North and South are important factors that can lead to political violence surrounding the referendum, slated for 2011, on whether the South secedes or remains part of a united Sudan. The parties need a shared sense of confidence about post-2011 futures. The North should be encouraged to cooperate in the referendum process and accept the outcome. The Government of Southern Sudan (GOSS) should devote more energy and resources to governance and service delivery rather than building military capability. The international community needs an assistance strategy focused on enhancing the GOSS's capacity to deliver services through local governments. The United States and the international community should pressure and assist the parties to promptly pass referendum legislation and address fundamental issues (e.g., oil and boundaries) before the referendum.

Violations of humanitarian law and international human rights continue unabated in the region and violators in eastern Chad operate in an environment of almost total impunity. A new U.S. Government strategy must be created to stabilize Chad and bring to an end the continued degradation of conditions in the region. This strategy must work in parallel with the peace process for Sudan and with the efforts led by the “Contact Group” to normalize Chad-Sudan relations.

- The debate over humanitarian intervention has tended to focus on the conditions under which the resort to armed intervention is permissible while paying less attention to which actors are best suited to engage in such a complicated and demanding undertaking. The purpose of this paper is to explore characteristics that affect the ability of potential agents of humanitarian intervention to effectively undertake this operationally and politically demanding task. While the military wherewithal of the intervener is fundamental, I argue that a potential intervener's legitimacy as an agent or enforcer of humanitarian norms is also crucial in determining whether and the extent to which it is a suitable agent. In other words, the efficacy of a potential intervener depends not only on its military wherewithal, but also on certain non-material factors than can affect its ability to effectively exercise this power. Using a consequentialist ethical framework, this paper examines the various material and non-material factors that can militate either for or against the suitability of certain actors undertaking humanitarian intervention in various parts of the world. I ultimately use this framework to examine the suitability of various possible agents of a potential humanitarian intervention in Darfur, Sudan.

11. Sudan: Darfur Humanitarian Emergency

- The humanitarian emergency in Darfur is a direct result of violence and harassment directed toward the Fur, Zaghawa, and Masaalit civilian groups by Government of Sudan (GOS) forces and GOS-supported militia groups collectively known as Jingaweit. In early 2003, the Sudanese Liberation Movement/Army (SLM/A) stated that they would engage in armed struggle to achieve full respect for human rights and an end to political and economic marginalization in Darfur. On April 24 and 25, 2003 the SLM/A attacked GOS military forces at El Fasher in North Darfur. Following this attack, GOS military forces and Jingaweit militia initiated a more coordinated campaign of violence against civilian populations, including aerial bombardments to kill, maim, and terrorize civilians who the GOS claimed were harboring opposition forces. Conflict-affected populations have described recurrent and systematic assaults against towns and villages, looting, burning of buildings and crops, destruction of water sources and irrigation systems, gang rape, and murders. Throughout late 2003, armed conflict intensified, as GOS military and Jingaweit clashed with the two main opposition groups – the SLM/A and the Justice and Equality Movement (JEM) – in Darfur. Following U.S. Government (USG) and European Union (EU) facilitated negotiations in N'Djamena, Chad, the two main opposition groups and the GOS signed a renewable 45-day humanitarian ceasefire on April 8 that took effect on April 11. This agreement included a GOS commitment to disarm Jingaweit militia groups and a protocol on providing humanitarian assistance in Darfur. The ceasefire agreement was renewed on May 22. Despite the ceasefire, Jingaweit violence against civilians continues in all three states of Darfur resulting in increasing displacement. Because the victims are displaced and vulnerable, they become targets of further violence. Even in villages where there is nothing left to burn, the fear of further violence continues to paralyze displaced populations, preventing voluntary returns. This cycle prevents many internally displaced persons (IDPs) from safely returning home, trapping them in camps or informal settlements for the foreseeable future. Out of an estimated population of 6.5 million in Darfur, approximately 2.2 million people are affected by the crisis, including more than 1 million IDPs and approximately 158,000 refugees who have fled into neighboring Chad. Humanitarian access to conflict-affected populations outside of the state capitals of Geneina, El Fasher, and Nyala was extremely limited until late May due to GOS impediments that blocked humanitarian access and relief operations. As a result of intense international pressure, the GOS lifted some of the restrictive travel regulations and announced a series of measures, effective May 24, to facilitate humanitarian access to Darfur. USAID's Disaster Assistance Response Team (USAID/DART) and other humanitarian agencies have deployed additional staff to Darfur to increase emergency response capacity. However, several obstacles remain, including continued delays in obtaining visas for relief personnel, travel restrictions within Darfur, difficulties in clearing essential relief supplies and equipment though customs, and GOS interference in relief activities that address protection of civilians and human rights abuses.

- For more than 20 years, Sudan has been adversely impacted by armed conflict, famine, and disease, largely associated with the civil war between the Government of Sudan (GOS) and the Sudan Peoples' Liberation Movement/Army (SPLM/A). Since war began in 1983, more than 2 million people have died, approximately 628,000 Sudanese have sought refuge in neighboring countries, and more than 4 million people have been displaced, creating the largest internally displaced person (IDP) population in the world. Until April 2003, when violence increased dramatically in western Sudan, conflict had mainly affected southern Sudan and the transition zone between North and South. In 1989, the United Nations (U.N.) established Operation Lifeline Sudan, a tripartite access agreement among the GOS, the SPLM/A, and the U.N. Under this framework, U.N. agencies and non-governmental organizations (NGOs) provide humanitarian and rehabilitation assistance to vulnerable southern Sudanese. Since 1983, the U.S. Government (USG) has provided more than $1.9 billion in humanitarian assistance to Sudan.

14. Darfur Rising: Sudan's New Crisis

The rapid onset of war in its western region of Darfur has created one of the world's worst humanitarian crises -- thousands dead and some 830,000 uprooted from homes. Meanwhile, the IGAD (Intergovernmental Authority for Development) peace talks in Naivasha, Kenya between the government and the insurgent Sudan People's Liberation Movement/Army (SPLA) threaten to deadlock. It is urgent that these talks succeed and that, simultaneously, a parallel process begins to address both the humanitarian and political crises in Darfur.

- In its first annual report issued May 2000, the U.S. Commission on International Religious Freedom (the Commission) found that the government of Sudan was the world's most violent abuser of the right to freedom of religion and belief. The Commission also found that religion was a major factor in the ongoing civil war, and that religion and religious–freedom violations were intertwined with other human rights and humanitarian abuses in Sudan. In the Commission's view, the Sudanese government was committing genocidal atrocities against civilian populations in the southern part of the country and in the Nuba Mountains. In light of these conditions, the Commission recommended, among other things, that the Clinton administration launch a comprehensive program of diplomatic and economic pressures to stop human rights abuses in Sudan. Moreover, the Commission was disturbed by the reported connection between oil development and the Sudanese government's abuses, as well as by an initial public offering in the U.S. by a subsidiary of one of the government's joint–venture partners in the development of Sudan's oil fields. Therefore, the Commission recommended that foreign companies engaged in the development of Sudan's oil and gas fields be prohibited from raising money in U.S. capital markets.

- The Commission considerably broadened its activities in its second full year, monitoring religious-freedom violations worldwide and increasing the number of countries it would study in depth. In July, the Commission wrote to the Secretary of State to recommend that Laos, Democratic People's Republic of Korea, Saudi Arabia, and Turkmenistan be added to the list of “countries of particular concern” as provided for in the International Religious Freedom Act of 1998 (IRFA). It also recommended that Burma, China, Iran, Iraq, Sudan, the Milosevic regime in Serbia and the Taliban in Afghanistan remain on the list. In addition, it wrote that India, Pakistan, Uzbekistan, and Vietnam are serious violators of religious freedom deserving careful State Department monitoring; it also expressed concerns about sectarian violence in Indonesia and Nigeria.
