- THE PROBLEM OF KNOWLEDGE IN RULE-OF-LAW PROMOTION, above all the basic question of whether Western rule-of-law aid programs are on the right track to help build the rule of law in recipient countries, is especially acute in the Arab world. Arab states generally share two features that render external rule-of-law aid particularly difficult—long-standing nondemocratic governments, and legal systems that graft Ottoman, European, and contemporary sources onto Islamic norms. We cannot presume that U.S. common-law practitioners can build the rule of law by transporting or transplanting their technocratic techniques into such different legal soil. Indeed, the very idea that people in Arab societies would be receptive to American guidance in legal reform is dubious in the current climate of broad, popular mistrust of the United States.

- BETWEEN 2002 AND 2004, THE UNITED STATES ACCORDED new prominence to political and economic reform and democratization as policy goals in the Middle East. Continuing that trend and translating rhetoric into effective strategies both depend on whether reform and democratization become fully integrated into the U.S. policy agenda in the region. Can the United States promote change at the risk of instability in the region while it remains dependent on petroleum from Arab countries? Can it pursue Arab–Israeli peace and democratization at the same time? Can the United States still secure needed military and counterterrorism cooperation if it antagonizes friendly regimes by promoting democratization as well? Is it feasible for the United States to promote democratization effectively amid widespread grievances against the war in Iraq and serious questions about U.S. human rights practices there and in Afghanistan?

- Fulvio Attiná examines the concept of “regional security partnership” both theoretically and in the context of Euro-Mediterranean region-building. He argues that this partnership is an intermediate venture on the road to the possible appearance of a Euro-Mediterranean security community. By discussing the difficulties of negotiating a security partnership in the framework of the Euro-Mediterranean Partnership, Attiná highlights the security culture divide on both sides of Mediterranean. The differences in the security culture between European and Arab states have deepened in recent years in view of regional and global developments, constituting a major obstacle to the implementation of a security partnership. Attiná argues, however, that the interaction between the two shores of the Mediterranean in coping with globalization-driven problems may prevail over the factors that have led to a deepening of the security culture divide in recent years.

25. Practices and their Failures: Arab-Israeli Relations and the Barcelona Process

- Joel Peters focuses on the failed peace-making practices of the Middle East multilateral track process launched at Madrid in 1991. He thus uses the dynamics within Arab-Israeli relations to inform an assessment of the Euro-Mediterranean Partnership. Peters shows that conflicts of interests and rivalries among the participating parties emerged as soon as the multilateral peace talks moved from the discussion of ideas to the stage where decisions on the actual implementation of cooperation projects had to be reached. Thus, the demise of the multilateral talks and the subsequent slowdown in the Israeli-Palestinian peace process were underway before the launching of the EMP. The failure of developing peace-making practices within the multilateral Arab-Israeli peace talks inevitably spilled over to the EMP from the outset.

26. What Happened to the Iraqi Marsh Arabs and their Land?

- In the aftermath of the 2003 war against Iraq, the newspapers are full of stories about the monstrosities of Saddam Hussein's regime. One example is the destruction of the Iraqi marshlands leading to severe consequences for the human and wildlife population. While the responsibility for the atrocity against the Marsh Arabs is Saddam Hussein's, the desiccation of the marsh environment can be ascribed to a number of the hydro-political decisions made in the catchment area of the Euphrates and Tigris Rivers. Based on an analysis of the discourses of the destruction, it is demonstrated how these have changed after the war and are used in the battle to legitimise the war. This has led to a simplified image of the marshes and the Marsh Arab way of life. As the paper shows, a more complex approach towards the processes leading to this human and environmental disaster is required, if repatriation and rehabilitation of the area are to stand a chance.

- Both Saudi Arabia's security situation, and the Saudi security apparatus, are undergoing major changes. Saudi Arabia no longer faces a major threat from Iraq, but must deal with the growing risk that Iran will become a nuclear power. This confronts Saudi Arabia with hard strategic choices as to whether to ignore Iran's efforts to proliferate, seek US military assistance in deterring Iran and possibly in some form of missile defense, or to acquire more modern missiles and its own weapons of mass destruction.

- It was Turkish membership in the European Union that the Viennese social worker quoted in the Guardian was against. As the Commission of the European Union has recently delivered a report that suggests the opening up of EU accession negotiations with Turkey, old fears seem to be awakening on the continent; “Turcophobia”, as the Guardian calls it. The liberal Viennese news weekly Profil the same week described the prospect of Turkish membership as “not so much a risk as a danger” in an editorial titled “The Turks at the Gates of Vienna.” But not only Turks are experiencing a resurrection of animosities that many thought were long since buried. In the aftermath of the attacks on September 11, anti-Arab sentiments surged along with verbal and physical attacks on Muslims in both Europe and the U.S. Perhaps the secretly held view of too many in Europe and the “West” is that of Britain's Robert Kilroy-Silk. According to his column in the Sunday Express on September 25 of this year, Arabs are no more than "suicide bombers, limb-amputators, women repressors". This essay digs deep to find the historical roots of today's images of Turks, Arabs, and Muslims.

- Until the break-up of the Soviet Union, dominant intellectual and educational cultures in Europe worked primarily with national concepts. In the twentieth century, nationalist ideologies have, of course, lost some of their glamour due to the impact of two disastrous world wars. But while leading European intellectuals over the past 50 years developed a research program that transcended the national spirit, they nonetheless remained bound by the concept of “modernity,” which comprises the concept of the modern nation state and the modern nation state system. Steeped in this cultural unconscious, Europe has neglected the systematic study of alternative modernities and alternative systems of governmentality -- including systems of democratic governmentality in the internet age -- especially as these alternative modernities relate to the influx of Muslim populations.

- The Iraq crisis has been a disaster for the Common Foreign and Security Policy (CFSP) of the European Union (EU). Member countries are very visibly split in their position towards the war against the regime in Baghdad. EU institutions have been unable to agree on more than the unconditional implementation of the relevant United Nations resolutions leaving the door open for widely diverging interpretations. The challenge of the Iraq crisis does not bode well for the future of a cohesive European Foreign Policy, and the CFSP requires a fresh approach.
