1. Two Years Of Repression: Mapping Taliban Violence Targeting Civilians in Afghanistan

On 17 August 2021, two days after the fall of Kabul, the Taliban held a press conference promising amnesty for former government officials, respect for women’s rights, and freedom of the press.1 Nearly two years later, it is clear that the Taliban has upheld none of these promises, instead conducting a violent campaign of repression. Since the takeover, the Taliban has targeted former government and security officials, carried out collective punishments in areas where anti-Taliban groups have emerged, and imposed ultraconservative societal restrictions – especially on women and journalists – aimed at maintaining control. ACLED records over 1,000 incidents of violence targeting civilians by the Taliban between the fall of Kabul on 15 August 2021 and 30 June 2023, accounting for 62% of all attacks on civilians in the country. This places the Taliban regime in Afghanistan2 among the world’s top government or de facto state perpetrators of violence targeting civilians domestically since August 2021, behind only the military junta in Myanmar. As Taliban rule reaches the two-year mark, this report examines patterns of violence targeting civilians under the regime, with particular attention to the top four most targeted groups: former government and security officials, prisoners, women, and journalists. Taken together, the Taliban’s retaliatory attacks, use of collective punishment, and broad crackdown on women and the press reveal the scale and severity of repression ongoing in Afghanistan. In particular, this report analyzes the continued targeting of former government and security officials, as well as violence against civilians in the country’s northeast, where armed anti-Taliban groups have been active. Both former officials and resistance forces are subject to violence when detained by the Taliban, accounting for a large number of incidents of prisoner abuse recorded by ACLED. Moreover, this report highlights persistent violence against women who oppose a return to the “gender apartheid” of past Taliban rule.3 Women have responded to increased restrictions on their daily lives by holding protests against Taliban policies, with demonstrations featuring women4 nearly doubling in 2022 compared to 2021. Finally, the report concludes with an accounting of attacks on journalists, who remain among the most targeted groups in the Taliban’s Afghanistan – creating further challenges for documenting violence in the country under the new regime.

2. The Return of the Foreign Fighters and Their Families to Their Homeland: Existing Practices and Considerations Regarding Security and Human Rights

Abstract:
The creation of Islamic State of Iraq and Syria (ISIS) has attracted an unprecedented flow of thousands of people from more than 100 countries all over the world to join their cause. After the fall of the so-called caliphate, the countries involved have to deal with the aftermath of the conflict and the future threat of the resurgence of ISIS or other terrorist groups. The people who volunteered and joined ISIS might pose a security threat in the future. This paper aims to examine the different approaches that countries have taken regarding the return of foreign fighters (FFs) and their families who joined ISIS to their homeland. This is a multidimensional and complex matter since it has legal, moral, and political implications, and therefore the decisions in this regard are never unanimous, nor do they come without criticism and opposition. On the one hand, it would be easier to just leave the FFs and their families there, prosecute them there and incarcerate them there. It would also be easier to collect evidence and to have testimonies of the witnesses and the survivors, and also it would keep the potential security threat away from their homeland. However, this would only be beneficial for the countries of origin and in the short term as it wouldn‘t solve the problem of radicalization. In fact, it might fuel it even more, and the proximity of the ISIS member in prisons or in camps could benefit them to rebuild their network and plan future attacks. Moreover, leaving them there would be against all human rights norms regarding the death penalty, fair trial, torture, rights of the child, and more. On the other hand, the return of the fighters and their families could indeed pose a danger to the security of the homeland. Not all of the returnees have committed punishable crimes and for those who have, very often there is not enough admissible evidence to the national courts. In fact, in the case of women and children, the countries are more reluctant to their return because they might have not taken part in the atrocities but that does not mean that they are innocent and bear no responsibility. Complicated is also the case of children and teenagers, some of whom have taken part in the atrocities willingly or unwillingly, some were brought by their families, some traveled alone in order to join ISIS, and some were born under ISIS control and risk statelessness.

3. Is There Life in the Desert? Russian Civil Society After the Full-Scale Invasion of Ukraine

By the end of 2021, all leading independent NGOs and individual human rights activists had been completely suppressed, and all issues deemed inconvenient for the Kremlin had been removed from the agenda of those still operating. This report focuses on the state of Russian civil society at the outset of Russia’s full-scale military invasion of Ukraine, as well as on how it was affected by the war and what are the prospects for its development in the future. Since Vladimir Putin came to power, Russia has been moving along the path of creating a fully state-controlled civil society in which the political potential of independent civil activism would be completely undermined. To achieve this goal, the Kremlin pro-actively advanced its network of government-organised non-governmental organisations (GONGOs) while simultaneously limiting foreign funding for NGOs. Those who did not abide by the Kremlin’s rules were systematically discriminated against and persecuted under the so-called “foreign agent” laws. Meanwhile, local authorities have stopped all formal and informal interaction with “politicised” civil actors. Russia’s invasion of Ukraine added further impetus to these trends and strengthened the Kremlin’s resolve to root out any sources of potential defiance. The independent professional NGOs that remained were in a deep crisis. Since February 2022, they have switched to survival mode. In all likelihood, they will either be co-opted by the state through a centralised system of financial support or cease to exist in the near future. The niches that they have left – including in the field of human rights advocacy – are being quickly filled by GONGOs. With their colossal resources, wider media access, and connections in the government, GONGOs are able to attract more young people to join their ranks. In many regions, even the scanty of organised independent civic activism that existed before the war was neither there nor likely to re-emerge in the coming years. In Russia, the level of involvement in NGOs has always been low and the population at large indifferent to the problems of civil society. Therefore, one should be wary of inflated expectations when contemplating the future of Russian civil activism. Even if Putin’s regime collapses, one can hardly anticipate a quick transition towards a truly independent and vibrant civil society. The study was conducted on the basis of interviews with representatives of independent NGOs from various regions who, as of February 2022, were based in Russia. The geography of this survey was expanded as much as possible to make the study more reliable and better reflect the content of the processes underway in the country. This analysis also shows that representatives from Moscow, large provincial cities, and the North Caucasus differ significantly in their perception of the current situation with civil society, whereas their visions for the future diverge considerably. A profound lack of communication among them only amplifies the divisions and fragmentations in Russia’s civil society. The situation in the North Caucasus is of particular note. Albeit being severely weakened, local independent NGOs and activists are – in contrast with the rest of Russia – more disapproving of the war unleashed by Russia against Ukraine but more optimistic about the future of their home regions. They pin their hopes on the revival of indigenous languages and cultures with the help of diasporas abroad and the emergence of civil society.

4. Against All Odds: Supporting Civil Society and Human Rights in Taliban-Controlled Afghanistan

Eighteen months after taking power, the Taliban is intensifying its repression of Afghan civil society and cracking down on the rights and freedoms of all Afghans, especially those of women and girls. The Taliban’s harsh approach to governing the country is repressing millions of people and fueling civil unrest, promoting extremism, and laying the foundation for the reemergence of a terrorist hotbed that will almost undoubtedly become a threat to global peace and security in the years to come. Humanitarian needs in Afghanistan remain immense, and the country will require large amounts of international aid for the foreseeable future to avoid famine and other health challenges. Twenty-three million Afghans (or nearly 60 percent of the population) currently require food assistance, and unusually cold winter temperatures this year have caused further hardship and death. The Taliban’s December 2022 order barring Afghan women from working for nongovernmental organizations led some international humanitarian organizations to suspend operations, complicating aid distribution, especially to women-headed families. The abolition of democratic institutions—the Parliament, judiciary, free press—and key government ministries and departments charged with protecting human rights demonstrates that the Taliban is adhering to the same extremist policies that marked their first stint in power from 1996 to 2001. The Taliban rules by fear and intimidation; torture, kidnapping, illegal detention, and extra-judicial killings are part of daily life in Afghanistan. The Taliban’s rollback of women’s rights has been swift and comprehensive. Among the most devastating anti-female policies, which will have far-reaching negative impacts on Afghanistan’s social and economic development and relations with the world, are the edicts forbidding girls from attending secondary school or university. Women and girls in today’s Afghanistan also are prohibited from accessing parks or gyms, leaving home without a male companion, and working outside the home—except in the health sector—and have been publicly flogged for not adhering to the strict behavioral edicts. Women demonstrators have been arbitrarily jailed and subject to torture and death.

5. Instead of Politicizing Afghanistan, Stand Up for Women and Girls

Ahuman rights calamity is unfolding in Afghanistan. In its latest move to repress half of the country’s population, the Taliban mandated that Afghan women can no longer work for the United Nations Assistance Mission in Afghanistan (UNAMA). The United Nations (U.N.) condemned the Taliban for forcing the international organization to make an “appalling choice” between continuing its operations without employing Afghan women, which would violate the U.N. charter, or withdrawing from the country, which would deepen the humanitarian crisis.1 Following a U.N.-led international meeting in Doha in early May, U.N. Secretary General António Guterres signaled that the U.N. would likely continue operating in Afghanistan despite the harsh Taliban edict.2 This follows several other outrageous Taliban edicts, including keeping girls out of secondary school and young women from attending university; preventing women from leaving their homes without a male companion; and prohibiting women from going to parks or gyms or holding jobs, except in the health sector.3 Yet rather than stand up for Afghan women and girls in the face of such repressive policies, American leaders—Republicans and Democrats alike—are busy in a blame game about which political party is responsible for the U.S. failure in Afghanistan. Republican congressional leaders have held hearings on Afghanistan that focus on the Biden administration’s poor handling of the August 2021 withdrawal but largely ignore what is happening to women and girls in the country. One exception to Republican leaders’ inaction on the plight of Afghan women was Congressman Mike McCaul’s chairing of a roundtable on the issue that featured remarks by former Afghan Ambassador Roya Rahmani.4 For its part, the Biden administration recently published a review of the Afghan withdrawal that laid blame on the Trump administration for the Biden administration’s own failures.5 For instance, the Biden administration chose to bind itself to the Trump-era Doha deal made between the United States and the Taliban that called for U.S. troop withdrawal by May 2021. The Biden administration could have delayed a troop withdrawal and negotiated a harder bargain with the Taliban. The administration would better serve American interests by focusing on implementing policies that support women and girls, like conditioning engagement with the Taliban on the reopening of schools and universities to women.

6. Advancing Victims’ Rights and Rebuilding Just Communities: Local Strategies for Achieving Reparation as a Part of Sustainable Development

This comparative study examines strategies used by local actors to facilitate the operationalization of reparations for victims of widespread human rights violations, while highlighting the synergies between these efforts and sustainable development. The study is based on the fieldwork of ICTJ and its partners in four contexts—Colombia, The Gambia, Tunisia, and Uganda. These countries represent a range of different situations, where the progress made, challenges faced, and overall political and institutional contexts vary significantly. Nonetheless, comparison of the approaches used across the cases offers valuable insights for those working in these and other contexts. In The Gambia, the truth commission and legislation for reparations have created expectations among victims, but a program has yet to be implemented. In Uganda, the legal and policy framework for reparations exists, but there is no enabling legislation or mechanism to provide them as a result of stalled political will. In Tunisia, the truth commission recommended reparations, but the political and economic situation make operationalization unlikely. In Colombia, challenges faced by reparations have informed the design of restorative sanctions that include reparative projects but are yet to be implemented. The major insights gained from this comparative study relate to the specific ways in which reparations can contribute to individual and community well-being and development; innovative and effective approaches to ensuring victims and communities receive reparations and support, including through collective action, engagement with government, and grassroots initiatives; the integration of victims’ needs and priorities into development policies and models; and the reparative elements of complementary accountability and reform measures that are participatory, address corruption and marginalization, and contribute to gender justice and equality. The report offers practical guidance and policy recommendations for advancing reparations as an integral element of broader societal efforts to facilitate inclusion, justice, peace, and development.

11. Community Health Workers as Rights Defenders: Exploring the Collective Identity of the Mitanins of Chhattisgarh, India

This Working Paper discusses the Mitanin program, a state-run community health worker program in Chhattisgarh state, India. It is based on a year-long reflection and action research exercise by the implementing organization, the State Health Resource Centre (SHRC). It argues that the collective identity of these community health workers (Mitanins) is central to their work defending the social and economic rights of their community. Collective identity often plays an important role in social movements for people’s economic and political rights. However, government-funded workers rarely get involved in such movements. The authors wanted to understand whether collective identity plays a role in driving the multi-issue activism of community health workers. A composite definition of this collective identity emerged from the research. Throughout the interviews and discussions, the Mitanins described their collective identity as a sense of solidarity that all Mitanins share with the community they serve and belong to, and a feeling of sisterhood with other women and each other. It is the shared experience of being a group of empowered women with a common mission who must use their knowledge and compassion to support the people they serve. The value system underpinning their mission dictates that people should not be denied their rights. The Mitanins’ collective identity is layered; they are not merely frontline health workers, but women who care deeply about their community. They are problem-solvers, activists, and community leaders. Their collective action and collective identity as women leaders in solidarity with the community is mutually reinforcing, and has enabled them to undertake multi-issue activism and transform themselves into frontline rights defenders. The authors conducted a state-wide survey along with focus group discussions and in-depth interviews. The survey (n=558) aimed to establish what proportion of Mitanins are involved in multi-issue activism. It found that in the preceding three years, 84 percent had taken rights-based action in at least one of three domains: food security and nutrition (68 percent); healthcare (56 percent); and gender-based violence (21 percent). They refer to these actions as ‘rights-based’ because they involve negotiation and confrontation with local elites and government officials, as well as writing formal complaints to government officials. Other than rights-based actions, Mitanins also provide information to community members about their rights and entitlements to health programs, food security, and nutrition under government programs—information that is often not readily accessible to poor people in India. This paper analyzes the patterns of autonomous collective action through discussion, interviews, and the rights-based songs and slogans written by Mitanins. The authors argue that the Mitanins’ collective identity was formed due to two main factors: the program’s movement-building approach; and the degree of autonomy enjoyed by Mitanins. The movement-building approach nurtured the activist tendencies of Mitanins, and the voluntary nature of their work allowed them to retain their autonomy vis-à-vis the health system bureaucracy

The death of Mahsa Amini in the custody of Iran’s so-called morality police sparked protests that continue to spread across the country, posing the most serious challenge to Tehran’s theocratic dictatorship in years. The demonstrations have focused on opposing the compulsory wearing of the hijab, but Iranians are also venting anger at a regime that has lost legitimacy after decades of political repression, economic mismanagement, and systemic corruption. Policymakers in the United States are rightly focused on constraining Iran’s nuclear program and state sponsorship of terrorism. Sanctions and other measures targeting the regime’s illicit financial networks tend to reflect these urgent priorities. But Iran’s theocratic regime is also a sprawling, deeply entrenched kleptocracy against which the US should apply more pressure. This brief examines the prevailing forms of corruption within Iran, the implications for US policy, and how the US can intensify efforts to expose and target the regime’s kleptocracy.

14. Cybersecurity and Human Rights in the Western Balkans: Mapping Governance and Actors – Case Study Serbia

Abstract:
Despite a solid legal framework, Serbia’s fight against cyber attacks and crime progresses slowly due to the chronic lack of qualified staff, as well as the politicized priorities of the competent institutions. This is one of the conclusions of the latest publication on the cybersecurity context in Serbia. Official statistics indicate an increasing trend in the number of cyber attacks and cybercrime cases in Serbia. About 26 million significant cyber attacks on information and communication technology (ICT) systems occurred in 2020 – the most common of which involved attempted intrusions into ICT systems and unauthorized data collection. Serbian citizens also witnessed massive violations of their right to privacy and personal data during the pandemic, as well as an increase in the number of attacks against human rights defenders and political dissidents in the digital and physical space. In late 2021, the idea of using biometric surveillance to counter terrorism and organized crime was reintroduced. However, due to the rapid backsliding of democracy and the rule of law, citizens fear that the new face recognition technologies will be directed against them, rather than against criminals and potential terrorists. Since the beginning of 2022, there have been several attempts to commit internet fraud and steal the identities and data of users of the Raiffeisen Bank and the Post of Serbia. In the most recent incident, a hacker attacked the country’s cadastre and shared electronic reports about bombs planted in various public and private institutions, causing widespread concern in society and temporarily disabling the day-to-day work of the institutions affected. Threats to journalists via social networks have also become more frequent. Cyber attacks are now a part of daily life in Serbia, and threats posed by the internet and social networks are likely to intensify and become more complicated in the future. It is therefore important for state authorities to be prepared to respond to any challenge, risk, or threat quickly and effectively, while respecting human rights and the rule of law. The Belgrade Centre for Security Policy addresses the topic of cybercrime from the perspective of human rights and the rule of law. In this context, the centre conducted a baseline analysis and 22 interviews with governmental and non-governmental stakeholders in Serbia, from mid-January to end March 2022, to assess the level of legal and institutional development of the competent authorities in the area of information and cyber security, as well as the challenges facing cybersecurity and human rights in the country. This publication is part of the larger report that focuses on mapping cybersecurity-related human rights opportunities and challenges, and represents an area that is under-explored in the region. There are six chapters in total, one for each economy in the Western Balkans. Each begins with essential conceptual background information regarding the cybersecurity and human rights contexts of each economy. They then each explore four core thematic issues: cybersecurity and the right to privacy, cybersecurity and freedom of expression, cybersecurity and freedom of peaceful assembly (and, where relevant, freedom of association), and cybersecurity and anti-discrimination. Finally, they present ways forward, with concrete recommendations for stakeholders. The study as a whole aims to offer recommendations for the inclusion of human rights standards in cybersecurity governance and for better implementation of cybersecurity norms within the human rights frameworks of the Western Balkans region.

In the fourth essay in the series—covering public opinion on democracy and human rights in Arab states—Catherine Cleveland and David Pollock note a cooling toward democratic institutions, a trend undoubtedly driven by failures in Tunisia, Lebanon, and Iraq. They discuss corresponding distrust in legislative bodies and high frustration with corrupt governance. Islamist leaders, they observe, come in for increasingly sharp critique. All in all, the findings emphasize a strong public demand for better governance outcomes and, in turn, the benefits as well as limits of U.S. democracy and human rights promotion in the region.

17. Cultivating friendly forces: The Chinese Communist Party’s influence operations in the Xinjiang Diaspora

The Chinese Communist Party (CCP) has committed well-documented and large-scale human rights abuses against the Uyghurs and other indigenous minorities in the Xinjiang Uyghur Autonomous Region (XUAR) that amount to crimes against humanity. Through its complex united front system, the CCP is actively monitoring members of the diaspora, including Uyghurs, creating databases of actionable intelligence, and mobilising community organisations in the diaspora to counter international criticism of its repressive policies in Xinjiang while promoting its own policies and interests abroad. These organisations are powerful resources in Beijing’s ongoing efforts to reshape the global narrative on Xinjiang, influence political elites abroad, and ultimately control the Chinese diaspora, but they’re also poorly understood. These organisations purport to represent and speak on behalf of ‘Xinjiang’ and its indigenous peoples. They subsume Uyghur and other minority cultures and identities under a nebulous yet hegemonic ‘Chineseness’, which is defined by and connected to the Han-dominated CCP. In reality, these organisations and their leaders play important roles in muting alternative and independent voices from the community while amplifying CCP messaging and spreading disinformation. They exploit the openness of democratic and multicultural countries while assisting the CCP and its proxies to surveil and even persecute members of the Xinjiang diaspora community or individuals who are critical of the CCP’s Xinjiang policies. Like united front work more broadly, the activities of these groups and their links to the Chinese Government are often overlooked and can be difficult to parse. While human rights abuses in Xinjiang are being exposed internationally, the mechanisms and tactics developed by united front agencies to co-opt overseas Xinjiang-related community groups have gone largely unnoticed. Our research demonstrates how these groups can sow distrust and fear in the community, mislead politicians, journalists and the public, influence government policies, cloud our assessment of the situation in Xinjiang, and disguise the CCP’s interference in foreign countries.

The Chinese Communist Party (CCP) is using technology to enforce transnational digital repression and influence unwitting audiences beyond China’s territory. This includes using increasingly sophisticated online tactics to deny, distract from and deter revelations or claims of human rights abuses, including the arbitrary detention, mass sterilisation and cultural degradation of minorities in Xinjiang. Instead of improving its treatment of Uyghurs and other Turkic minorities, the CCP is responding to critiques of its current actions against human rights by coordinating its state propaganda apparatus, security agencies and public relations industry to silence and shape Xinjiang narratives at home and abroad. Central to the CCP’s efforts is the exploitation of US-based social media and content platforms. CCP online public diplomacy is bolstered by covert and coercive campaigns that impose costs and seek to constrain international entities—be they states, corporations or individuals—from offering evidence-based critiques of the party-state’s record on human rights in Xinjiang and Hong Kong and other sensitive issues. This asymmetric access to US-based social media platforms allows the CCP to continue testing online tactics, measuring responses and improving its influence and interference capabilities, in both overt and covert ways, across a spectrum of topics. The impact of these operations isn’t widely understood, and the international community has failed to adequately respond to the global challenges posed by the CCP’s rapidly evolving propaganda and disinformation operations. This report seeks to increase awareness about this problem based on publicly available information.

This study reviews patterns of domestic and international media reporting and the role of disinformation, misinformation, and media bias in the Tigray conflict, which has been raging since November 2020. Since its outbreak, the conflict has evolved through four broad phases. Throughout these phases, the conflict was characterised by egregious violations of international human rights law, international humanitarian law and international refugee law. To analyse the role of the media in the conflict, this study reviewed local and international media, conducted interviews with local and international journalists and analysts, and consulted secondary literature. Patterns of reporting by international and local media exhibited fairly significant levels of divergence in the issues that were selected for reporting and how they were reported during these four phases of the conflict. The study found significant levels of disinformation, misinformation, and biased reporting that clouded accounts of the conflict and encouraged debates over highly contested issues. International media largely disregarded the role that the TPLF played in provoking the federal government to take military action, at times neglecting to mention the TPLF attack on the Ethiopian Northern Command and occasionally even accusing Prime Minister Ahmed Abiy of ordering a wanton attack on Tigray. International journalists either partially or completely ignored the historical context of the conflict. On the other hand, domestic Ethiopian media largely disregarded the violations that were committed by the federal government and were overly focussed on debunking the claims that were made by the TPLF. Overall, the study found a systematic pattern of local media biased towards the narrative of the federal government, whereas the international media were generally biased towards the narrative of the TPLF. As a result, the voice of the people who suffered the brunt of the fighting became the “casualty” of misinformation, disinformation and biased reporting.

21. Moving from Mirage to Reality: Transitional Justice and Prevention in Morocco

This study examines how transitional justice in Morocco has contributed to the prevention of serious human rights violations, mainly related to state violence and repression and social and economic exclusion. Beginning in the 1990s, Morocco’s a constitutional monarchy engaged in a process of liberalization that included efforts to address past grave human rights violations. In the 2000s, these efforts centered on the Equity and Reconciliation Commission (IER), a truth-telling initiative that recommended and helped bring about other transitional justice processes such as reparations, the preservation of memory, and a series of institutional and legal reforms intended to prevent the recurrence of those violations. Despite the political liberalization that was underway, Morocco’s transitional justice efforts were not undertaken in a context of regime change. Morocco’s experience nevertheless suggests that limited political reform can have real but restricted impact on the prevention of human rights violations. As a truth-telling measure, the IER diagnosed some of the wrongdoings of the past and called for reform to prevent their recurrence. Reparations provided important benefits to victims that had improved inclusion, while collective reparations drew attention to regional exclusion and inequality. Beginning in 2011, a new constitution facilitated institutional and legal reforms that had been recommended by the IER, many of which included the protection of human rights. The fact that the regime that was responsible for past human rights violations remained in control of the transitional justice processes—and at the same time it was perpetrating abuses in the name of anti-terrorism—however, has undermined the legitimacy of those processes and constrained their preventive impact. While the Moroccan monarchy may have no desire to return to the widespread repression of the Years of Lead, the persistence of human rights violations, corruption, inequality, and social unrest in the country suggests that a transitional justice approach that is more comprehensive and inclusive and, in the end, more fully implemented has the potential to make a greater contribution to preventing future wrongs.

Arrests and prosecutions for consensual same-sex sexual acts, or for diverse gender expressions, continue unabated across the world. And yet, they are considerably under-reported. Our Identities Under Arrest is a brand-new publication by ILGA World offering a global overview of the enforcement of laws criminalising consensual same-sex sexual acts between adults and diverse gender expressions. The report reviews hundreds of cases in which law enforcements subjected LGBT and gender-diverse persons to fines, arbitrary arrests, prosecutions, corporal punishments, imprisonments and more – up to (possibly) the death penalty. Governments often argue that criminalising laws are ‘dormant’, but this report offers evidence that such claims are largely inaccurate. How – and how often – they are enforced can vary abruptly and in unpredictable ways, making both our communities on the ground and asylum seekers who managed to flee live perpetually under threat. The Our Identities under Arrest report will be of great value to the advocacy work of human rights defenders. It will assist asylum seekers and the legal experts working on their cases. And it will provide researchers, media outlets, governmental and global agencies with the necessary information to build a holistic picture of how the criminalisation on the grounds of sexual orientation, gender identity, and gender expression really looks like.

23. Hong Kong’s future on edge: Countering China’s national security law

Over the past seventy-five years, the United States and its allies have constructed and defended a rules-based international system that has provided unprecedented levels of peace, prosperity, and freedom. In recent years, the system has come under increasing strain, as a new era of great power competition has emerged. Despite hopes that China would become a “responsible stakeholder” in a rules-based system, Beijing has grown increasingly assertive, especially under President Xi Jinping. Beijing’s more confrontational path poses a significant challenge to a rules-based system. The challenge presented by China is particularly acute in the context of Hong Kong, where the Chinese Communist Party (CCP) has brashly violated an international treaty and curtailed democratic institutions and human rights. As the world enters an era of strategic competition with China, Beijing’s actions in Hong Kong should be a priority for policymakers in the United States and allied countries. This report addresses the importance of Hong Kong within the context of China’s broader challenge to the rules-based system and offers recommendations for how the United States and its allies can prevent a further erosion of democracy in Hong Kong and, over time, seek to restore it. It suggests that the United States and its allies still have available a range of pragmatic policy tools that can can be used to exert pressure and impose meaningful costs on Beijing. These should be implemented as part of a broader, comprehensive strategy to prevent China from undermining the rules-based system in the security, economic, and governance domains. On June 30, 2020, the CCP imposed a sweeping new National Security Law on Hong Kong, effectively giving Beijing direct control over the autonomous territory. Since then, China has acted to erode Hong Kong’s liberal traditions, in violation of Beijing’s treaty commitments under the Sino-British Joint Declaration. The National Security Law has for all practical purposes outlawed democratic activism, organizing, and speech. Over the past year, Beijing has cracked down on Hong Kong’s democratic institutions and thrown the pro-democracy movement into disarray. Beijing’s crackdown in Hong Kong is aimed at achieving several objectives. First, China’s leaders seek to maintain the legitimacy of the CCP in the face of a pro-democracy movement that it fears could spread to the mainland. Second, they seek to advance the unification of China by harmonizing the cultural, social, and economic aspects of life across the country, including Hong Kong. Third, the CCP aims to achieve a comprehensive modernization of China, while retaining the Party’s leadership, including by reaping economic benefits from the Greater Bay Area Integration Plan. Finally, China’s crackdown is aimed at stemming the advance of a liberal, democratic world order by pushing back on democratic norms that it views as antithetical to the Party and a danger to its efforts to modernize China on its own terms.

Close cooperation between the United States and the European Union is essential if advanced economies are to develop effective responses to the array of challenges presented by China. Washington and Brussels share concerns regarding competitive distortions arising through the state’s role in the Chinese economy, the use of advanced technologies to repress ethnic minorities and fuel its military, and the spread of authoritarian influence through the Belt and Road Initiative (BRI). However, there has been a lack of coordination and cooperation in recent years between the US and EU when it comes to responding to China’s policies and behaviors. Washington’s focus on risks to US economic and national security contrasts with an emphasis in Brussels on ensuring reciprocity and leveling the economic playing field. But, with the transatlantic relationship back on a better footing under the Biden administration, new structures for transatlantic dialogue being put in place, and a greater focus on the Indo-Pacific in both Washington and Brussels, this paper argues there is now an opportunity for the United States and Europe to learn from each other and harmonize some of their China-related efforts.

26. THE SPECIAL POLICE IN ETHIOPIA

Like many federal and devolved systems, Ethiopia has both federal and regional security forces. In the last fifteen years, however, Ethiopia’s regional states have established regional special police forces, in addition to the regular regional state police. Established first in Ethiopia’s Somali region in 2007 to conduct counter-insurgency operations and riot control, special police quickly spread to all other regions of Ethiopia. The role and status of special police forces in Ethiopia remain contested. Resembling paramilitary forces, the regional special police units are well armed and receive military training. They are rapidly growing in size and have successfully recruited senior (former) army officers into their ranks. Special police forces have become deeply involved in Ethiopia’s interregional conflicts and border disputes, most notably in the current conflict in Tigray. They have even been involved in international operations in Somalia and Sudan and internal coup attempts. They have also been linked to severe human rights abuses. While federal and regional governments are empowered to establish their respective police forces, no specific legal provision deals with the special police force. As trust in the federal government waned in many regional capitals, states have linked the mandate of their special police forces with self-government. Still, special police have overstepped that boundary and engaged in activities, such as international border security and settling interregional disputes, that fall within the exclusive mandate of the federal government and federal forces. This report explores the origins and growth of the special police and its roles in current Ethiopia. It investigates the force’s constitutional and legal ambiguity and places the special police within the broader debate over Ethiopian federalism. Finally, it suggests several models that Ethiopia could adopt to regulate its proliferating special police forces. A failure to do so may have dire consequences for the future of the country.

With the elections of Argentina, Finland, Lithuania, Luxembourg, Montenegro, Paraguay, Qatar and the United States of America, 19 of the 47 Council members in 2022 will be “Friends of the Responsibility to Protect” – having appointed an R2P Focal Point and/or joined the Group of Friends of R2P in New York and Geneva. The Human Rights Council and its mechanisms and procedures – including the Universal Periodic Review (UPR), investigative mechanisms, special procedures and treaty bodies, as well as the technical assistance provided by the Office of the High Commissioner for Human Rights (OHCHR) – all play an essential role in providing early warning of the risk factors that can lead to crimes against humanity, ethnic cleansing, war crimes and genocide, and provide recommendations to prevent their recurrence. The election of Cameroon, Eritrea and the United Arab Emirates – states that have a history of violating human rights and perpetrating atrocities at home or abroad – undermines the credibility of the HRC. States elected to the HRC are supposed to demonstrate their commitment to the highest standards of human rights, including their full cooperation with all UN mechanisms. These are conditions set forth in UN General Assembly Resolution 60/251. The fact that potential mass atrocity crimes are being perpetrated by a number of HRC member states is deeply disturbing. The Global Centre has compiled profiles on each of the newly elected Human Rights Council members. These provide a basic overview of their commitment to prevent mass atrocities by protecting and promoting human rights.

In March this year, the EU, U.S., Canada, and the United Kingdom imposed sanctions on China over the matter. Moreover, the Netherlands, the U.S. and Canada described China’s actions as genocide. For China, however, its actions involving Uyghurs are a key element of domestic politics, which is why it presents accusations as disinformation. It has imposed counter sanctions, including on the EU, and their wide scope indicates that for China, Xinjiang is more important than, for example, the ratification of the Comprehensive Investment Agreement (CAI) with the EU.

The new system will be used for the first time to impose restrictions on those responsible for the detention of Alexei Navalny in Russia. This report explores how the Chinese Communist Party (CCP), fringe media and pro-CCP online actors seek—sometimes in unison—to shape and influence international perceptions of the Chinese Government’s human rights abuses in Xinjiang, including through the amplification of disinformation. United States (US) based social media networks, including Twitter, Facebook and YouTube, along with Chinese-owned TikTok (owned by Chinese company ByteDance), are centre stage for this global effort. The Chinese Government continues to deny human rights abuses in Xinjiang despite a proliferation of credible evidence, including media reporting, independent research, testimonies and open-source data, that has revealed abuses including forced labour, mass detention, surveillance, sterilisation, cultural erasure and alleged genocide in the region. To distract from such human rights abuses, covert and overt online information campaigns have been deployed to portray positive narratives about the CCP’s domestic policies in the region, while also injecting disinformation into the global public discourse regarding Xinjiang. The report’s key findings: Since early 2020, there’s been a stark increase in the Chinese Government and state media’s use of US social media networks to push alternative narratives and disinformation about the situation in Xinjiang. Chinese state media accounts have been most successful in using Facebook to engage and reach an international audience. The CCP is using tactics including leveraging US social media platforms to criticise and smear Uyghur victims, journalists and researchers who work on this topic, as well as their organisations. We expect these efforts to escalate in 2021. Chinese Government officials and state media are increasingly amplifying content, including disinformation, produced by fringe media and conspiracist websites that are often sympathetic to the narrative positioning of authoritarian regimes. This amplifies the reach and influence of these sites in the Western media ecosystem. Senior officials from multilateral organisations, including the World Health Organization (WHO) and the United Nations (UN), have also played a role in sharing such content. The Xinjiang Audio-Video Publishing House, a publishing organisation owned by a regional government bureau and affiliated with the CCP’s United Front Work Department, has funded a marketing company to create videos depicting Uyghurs as supportive of the Chinese Government’s policies in Xinjiang. Those videos were then amplified on Twitter and YouTube by a network of inauthentic accounts. The Twitter accounts also retweeted and liked non-Xinjiang-related tweets by Chinese diplomatic officials and Chinese state-affiliated media in 2020.

The Biden administration’s focus on allies and partners and the inability of democratic U.S. allies Japan and South Korea to move beyond historical pitfalls of apologies and treaties provides President Biden’s team the perfect opportunity to show leadership by taking on a mediator role. By taking an active role, the United States can demonstrate that it is not a passive observer to would-be revisionists in the region, shore up its alliances, and signal to the world that the United States is still the leader in the promotion of human rights. Japan’s colonization of Korea from 1910 to 1945 was brutal. The Japanese military coerced between 10,000 and 200,000 women into sexual slavery and many more Koreans were forced to work in the Japanese war machine, the very one that annexed Korea in 1910. Following the abrupt end of Japanese colonization after World War II, brought about by the only direct use of nuclear bombs on a human population in history, Japan quickly signed treaties and paid reparations to former colonies, recovered its economy, and successfully rehabilitated its image with much of the world. However, it was not until 1965 that Japan-South Korea relations were “normalized.” The new Japan-South Korea relationship included abandoning reconciliation with North Korea altogether, and Tokyo providing grants to an authoritarian South Korean leader who was later assassinated and remains a divisive figure in contemporary Korean domestic politics.

FIFA gave the bid to Qatar to host the World Cup in 2022. Qatar gave the promise that they would hold a spectacular cup with the construction of a city, stadiums, and luxurious venues and hotels. To complete the construction process, they hired migrant domestic workers, and in the process they have violated human and workers rights, putting workers at risk of death, and betraying the terms and conditions under which the workers had been hired. The United States Holocaust Memorial Museum’s Simon-Skjodt Center for the Prevention of Genocide released a report in November 2021, “To Make Us Slowly Disappear”: The Chinese Government’s Assault on the Uyghurs. The Chinese government’s attacks on the Uyghur community are alarming in scale and severity. The report expresses the Museum’s grave concern that the Chinese government may be committing genocide against the Uyghurs, a Muslim community in the Xinjiang Uyghur Autonomous Region of northwest China. The report also details multiple crimes against humanity that the Chinese government is committing against the Uyghur population. These crimes include forced sterilization, sexual violence, enslavement, torture, forcible transfer, persecution, and imprisonment or other severe deprivation of physical liberty. The Museum’s findings, based on publicly available information, demonstrate that China is failing to uphold its responsibility to protect its citizens from genocide and crimes against humanity. The Chinese government must halt its attacks on the Uyghur people and allow independent international monitors to investigate and ensure that the crimes have stopped. The seriousness of the assault on the Uyghur population demands the immediate response of the international community to protect the victims.

Aglobal contest between democracies and autocracies is raging on the digital front. Technology stands to alter the balance between free, open societies and closed, repressive regimes. Nation states in direct competition with the United States seek to project global influence by shaping an existing digital order to their will. Impulses toward illiberal use of technology at home threaten to curtail individual liberties, constrict opportunity, and erode a truly open society. Democracies do not yet have a model for how to confront this. In the United States, a roadmap for a solution must start with the fundamental question: How should U.S. technology companies, with the help of the U.S. government, respond to the illiberal use of technology by authoritarian actors abroad? This report contends with this question by identifying concrete actions and threat-mitigating strategies that contain the input of government, the tech sector, civil society, and academia. It provides starting points to address the systemic risk inherent in dealing with authoritarian regimes and also examines cost imposition on those complicit in tech-enabled human rights abuses. Yet a strategy aimed only at staunching the illiberal use of technology will fail in the long term. Instead, the U.S. government and tech companies alike must recruit democratic allies to purvey an affirmative agenda that promotes digital freedom across the globe. This report proposes an agenda that stresses privacy leadership by the United States and its technology companies. It identifies areas of collaboration for U.S. allies and democratic partners, like digital trade, foreign law enforcement requests for data, and technical standards. This report’s affirmative agenda also contains an imperative for U.S. tech companies to build commercial norms toward digital freedom and incentivize transparency within their own ranks. For digital freedom to prevail over authoritarian uses of technology, democracies must present something better. Together, they must establish an alternative model for the use of technology globally. These recommendations build that democratic case, starting with the United States.

On November 12, 2018, the United Nations General Assembly passed a resolution on child, early, and forced marriage. As part of this resolution, the General Assembly highlighted the need for better data collection and disaggregation of that data for improved analysis and learning. This report is a comprehensive and user-friendly concept note for a database on child marriage in humanitarian settings, a first step in eradicating the problem. The report identifies the existing knowledge and data on child marriage in humanitarian settings, gaps in that evidence base, and provides recommendations for moving forward with the creation of a comprehensive database. The authors interviewed key stakeholders on child marriage across program, policy, and academia in combination with a comprehensive literature review. The armed conflict in Northern Uganda, stretching across more than two decades, greatly affected the populations of Northern Uganda, which suffered multiple forms of war crimes and gross abuses of human rights. Violations included forced displacement, pillaging, looting and destruction of property, abduction, forced recruitment, slavery, forced marriage, sexual violence, psychological harms, mutilation, killings, torture, and cruel, inhumane, and degrading treatment. These violations have had long-term social and economic consequences for victims, affecting and impairing their functionality, livelihoods, schooling, physical and mental health, social skills, self-esteem, and interpersonal relations in the post-conflict period, with differential impacts on men, women, boys, and girls. This study assesses the opportunities for providing interim relief to victims of conflict-related human rights violations through targeted development programs, pending the establishment of a comprehensive reparations program. Reparations are a response to gross human rights violations, meant to provide redress in its many forms, including compensation to victims. Development assistance differs from reparations in that it is aimed at improving the general socioeconomic conditions of citizens more broadly. This report acknowledges the distinctions between reparations and development, while exploring intersections between the two that could be optimized to address the urgent needs of victims of human rights violations. It identifies substantive and practical considerations that government authorities at the national and local levels should take into account when designing and implementing reconstruction and development programs, and it proposes ways to maximize the potential of ongoing programs to address the immediate needs of victims and mitigate the effects of the abuses they endured. Finally, the study explains how existing recovery and development programs could increase victims’ access, improve their implementation modalities, and address the various challenges and gaps that limit programs’ effectiveness. If they are appropriately designed, local recovery and reconstruction programs can form a foundation upon which reparative approaches can be based and built in the future.

‘Conversion therapy’ is a term describing pseudo-scientific and harmful practices used to attempt altering a person’s gender expression, gender identity or sexual orientation. In 2020, ILGA World has released a ground-breaking report on the issue: Curbing Deception is an extensive global research into laws banning ‘conversion therapies’ both at the national and subnational level. The report explores the vast field of techniques used for the purpose of attempting to alter lesbians, gays and bisexuals’ sexual orientation, to prevent trans youth from transitioning or make trans people de-transition, or to force our gender expressions and roles to align with the social binary stereotypes of masculinity and femininity. It also analyses strategies beyond legal reform to restrict these harmful practices worldwide. Experimentation and abuse have long taken place under the legitimising cloak of medicine, psychology and science. As the report details, gruesome practices – including electroshock ‘therapies’, forced internments in ‘clinics’ and exorcisms – are still applied in numerous countries, pushing people of diverse sexual orientations, gender identities and expressions to living self-loathing lives, up to the extreme consequences of committing suicide. Protection from similar ineffective and cruel treatment is as urgent as ever: our report also exposes how - thanks to the tireless advocacy of activists, survivors and grassroots organisations – States, health professionals and international human rights bodies across the world are speaking up against so-called ‘conversion therapies’.

53. Towards a More Principled European China Policy?

Promoting political values (democracy, human rights and the rule of law) in China is a colossal undertaking, but the EU could be more effective than we think. To do so, it must act strategically, in unity, and in concert with like-minded partners. It must also strengthen its record of upholding political values and reform its procedures for foreign policy decision-making. On 30 June 2020, China adopted a National Security Law for the Hong Kong Special Administrative Region that not only undermines human rights and the rule of law that were promised to its citizens, but also violates international law. A few weeks before, when China’s intention became public, the European Union reacted cautiously, expressing concern but clarifying that the introduction of the law would not adversely affect its relations with China. The EU’s first reaction fell far short of statements released by the United States, the United Kingdom and Australia, among others. But the EU’s reaction grew more critical over time. The first EU institution to adopt a tougher approach was the European Parliament. Shortly after, the European Commission and – to a lesser extent – the European Council followed with statements by its presidents after the EU-China summit held on 22 June 2020. This episode could turn out to be exemplary for the role of political values in the European Union’s relations with China. China and Europe have fundamentally divergent political values, even though they often use the same terminology. For a long time, many Europeans believed that China’s definition of democracy, human rights and the rule of law –, the three constitutive values enshrined in the Treaty of the European Union – would ultimately converge with the European understanding. This has not turned out to be the case. China is growing more self-confident, not only defending but starting to spread its own definitions of the triad of political values. This comes at a time when the EU is realigning its China policy more generally. The new European Commission strives to be a “geopolitical” entity strategically engaging to achieve concrete results in its bilateral relations with China. The starting point of this shift is the 2019 “Strategic Outlook” developed by the European External Action Service, which defines China not only as a “partner”, but also a “competitor” and a “systemic rival”. On political values, China clearly is a “systemic rival”. The crucial question is whether “systemic rivalry” in the field of political values carries implications for other policy fields in which the EU and China are partners or competitors. A general consensus that the EU should adopt a more principled China policy and defend and promote its political values spells out very differently across EU institutions. By institutional design, the European Council is a pragmatic rather than principled institution. Compromise resulting from bargaining among member states with different interests shapes its approach. At the other end of the spectrum, the European Parliament serves a principled watchdog function, but has very limited competencies in foreign and security affairs. The European Commission strives to overcome the decades-old challenge of policy silos resulting from its fragmented institutional structure and the more than 60 sectoral dialogues with China. This carries the potential to turn more principled. However, to this day it is not clear whether the European Commission will make the promotion of political values a policy priority even if this comes at the cost of economic cooperation. This paper outlines ongoing debates on the EU’s new China policy and the role of political values in it, and provides 25 concrete policy recommendations for a more principled China policy that defends and promotes democracy, human rights and the rule of law.

Comprehensive and practical, these guidelines are designed to support Liberian lawmakers in applying human rights principles to their work in security sector reform and governance. In their capacity as the peoples’ representatives, parliamentarians have a critical role to play in promoting respect for human rights. This is even more relevant in Liberia, where security institutions are often reported as the most prominent violators of human rights, notably among vulnerable groups, such as women and LGBTI persons. Therefore, it is essential to reassert that respect for human rights is an obligation deriving from both international instruments and the Liberian Constitution, and to strengthen the security sector’s compliance with these legally binding instruments. Through their core functions of oversight, law-making and representation, Liberian legislators possess an array of tools to help them achieve this objective. However, their lack of basic human rights knowledge and key reform and governance concepts hampers their effective use of these tools. These guidelines aim to bridge this knowledge gap and suggest concrete steps to help Liberian Legislators succeed in this endeavour. Following a brief discussion on why Liberian lawmakers must actively promote respect for human rights in the security sector (Chapter 1), these guidelines lay out what the main international human rights standards and instruments are (Chapters 2 and 3), and make suggestions on how legislators can integrate them in their daily practice (Chapter 4).

The need and scope for conflict resolution and mediation is going up. The numbers of people affected by violence and conflict is increasing. The world is disfigured by prolonged, internationalised civil wars and growing civil unrest. Great power politics are resurgent, the conventions regulating states’ behaviour are fraying, and international law and human rights are being eroded. Profound demographic and climatic changes, the emergence of new technologies and of threats are changing the global landscape in ways that should bring humanity together but too often are exploited for commercial and political gain, driving insecurity and a sense of injustice. The EU has an enormous role to play in this context. It is a powerful global actor pursuing multiple objectives on the world stage. It is committed to human rights, gender equity, sustainable development and a rules based global order, and to supporting others that are taking action, whether inter- governmental and regional bodies such as the UN and AU, or civil society including at the very local level. But the EU also recognises, as the High Representative has put it, the need to learn “to use the language of power”, to deploy its capabilities, whether political, security, economic or regulatory, more strategically to shape reality, address the agents and drivers of violence, and secure peace. So what should the EU’s role in mediation be in this context? The review of the EU’s concept on mediation provides an excellent opportunity to generate debate and to define the parameters of the future of EU mediation frameworks. This study provides a snapshot of the views within the Brussels diplomatic and policy community. Even within this relatively confined universe, there is a very broad diversity of opinions.

Afghanistan’s presidential election took place on September 28, 2019, with less than 2 million people participating out of 9.7 million registered voters. Taking into consideration Afghanistan’s total population of 35 million, the turnout was a historic low—a problem further amplified by the fact that the government poured a huge amount of financial and human resources into election preparation. The main explanation for such low turnout is twofold. On the one hand, security threats such as suicide attacks or gun violence—which reached their peak during the presidential election campaigns—deterred many people from going to polling stations. On the other hand, Afghans have become wary about determining their own political fate because, for decades, regional and international powers have steered the political wheel in Afghanistan, rather the people. After four months, election results have still not been announced, leading to further speculation and anxiety among a population which has already been the victim of four decades of violent conflict in the country. This anxiety is further exacerbated by the ongoing “peace” negotiations with the Taliban. Afghan people have learned from experience that, even in the best-case scenario of the election results or peace negotiations, they cannot hope for new justice measures to heal their wounds. As demonstrated by the experience of Afghanistan and other countries, peace and security will not last without addressing the people’s demands for justice.

Transnational solidarity movements have typically flowed from a central point located in the West, particularly in the United States, to the East and the Global South. Shadi Mokhtari describes this phenomenon as the “traditional West-to-East flow of human rights mobilizations and discourses.” Viewed individually, this phenomenon is not problematic in all cases. However, as Mokhtari argues, this one-directional flow of human rights politics precludes non-Western non-governmental organizations (NGOs) from weighing in on human rights violations committed in the United States. Human rights violations in the United States are typically experienced by marginalized communities, from the mass incarceration and disenfranchisement of African-Americans to the detention and ill-treatment of immigrants, migrants, and refugees. For a truly global human rights movement to emerge—one that is not grounded in Western paternalism and perceived moral superiority—this must change.

Over the twelve years during which Cuba had a seat at the UN Human Rights Council, the regime has been systematically complicit in the grave human rights violations perpetrated in other parts of the world. This can be inferred from the recorded votes, opposing to resolutions condemning dire human rights violations and calling the world into action. They have been constantly abetting and siding with autocratic governments across the world. In the bid to join the Human Rights Council during the 2021-2023 term, the one-party system stated that «should Cuba be elected to the Human Rights Council, it would continue to support its long-standing initiatives». Global democracies, especially those in Latin America who strive to consolidate the respect for human rights, shall oppose to the candidacy of Cuba and any other autocracies to the Human Rights Council, and they must do so publicly and actively in order to avoid the weakening of the International system for human rights protection.

The country report of China in the Bertelsmann Transformation Index (BTI) 2020 shows little change for the continent-sized Asian country since the last report of 2018. Structural challenges continued to intensify and the CCP’s single-party leadership does not consider democratic transformation as an objective to be pursued. On the contrary, the administration of President Xi Jinping continued to oppress opponents and dissidents while intensifying ideological indoctrination and surveillance. The deprivation of civil liberties, the concentration of power and the lack of political participation are the main reasons for classifying China in the BTI as a hard-line autocracy. At the same time, the BTI warns that China is becoming increasingly isolated from the world’s liberal democracies and loses their confidence. Human rights violations in so-called “re-education camps”, where it is estimated that more than one million Uyghurs are held, caused widespread criticism among Western democracies and lead to even more concern over China’s candidacy for the UN Human Rights Council elections in October this year.

And as it is issued every two years it makes it possible to know the consistency (or lack, thereof) of the transformation and its rhythm. The following up. Reading the report, it can be concluded that it has, whilst a new concept is introduced: that of static transformation –a sample of changes that leave the structures of a society intact.

The cauldron of conflict in South Asia has been bubbling since August 5, 2019 when the Hindu nationalist Bharatiya Janata Party (BJP)-led Indian government diluted the provisions of Article 370 of the Constitution of India, giving special status to the disputed state of Jammu and Kashmir, control over which remains at the core of the international dispute between India and Pakistan. Three of the four wars fought between India and Pakistan have been over Kashmir, and the separatist movement (backed by Pakistan) demanding independence has spawned the growth of both insurgent and terrorist groups waging war against the Indian state. India’s sudden, unilateral decision to withdraw Kashmir’s special provisions drew sharp reactions at home and abroad. The Indian government subsequently trifurcated the state, shut down the internet in Kashmir, and detained much of Kashmir’s political leadership without charges in the interest of “public safety.” Muscular action in Kashmir, against a backdrop of what many economists are now calling a structural economic decline in India have led to strong disruptions in India’s diplomatic ties, especially with the United States.

The Chinese government has facilitated the mass transfer of Uyghur and other ethnic minority1 citizens from the far west region of Xinjiang to factories across the country. Under conditions that strongly suggest forced labour, Uyghurs are working in factories that are in the supply chains of at least 82 well-known global brands in the technology, clothing and automotive sectors, including Apple, BMW, Gap, Huawei, Nike, Samsung, Sony and Volkswagen. This report estimates that more than 80,000 Uyghurs were transferred out of Xinjiang to work in factories across China between 2017 and 2019, and some of them were sent directly from detention camps.2 The estimated figure is conservative and the actual figure is likely to be far higher. In factories far away from home, they typically live in segregated dormitories,3 undergo organised Mandarin and ideological training outside working hours,4 are subject to constant surveillance, and are forbidden from participating in religious observances.5 Numerous sources, including government documents, show that transferred workers are assigned minders and have limited freedom of movement.6 China has attracted international condemnation for its network of extrajudicial ‘re-education camps’ in Xinjiang.7 This report exposes a new phase in China’s social re-engineering campaign targeting minority citizens, revealing new evidence that some factories across China are using forced Uyghur labour under a state-sponsored labour transfer scheme that is tainting the global supply chain.

What’s new? Turkey has to deal with thousands of citizens who travelled to join ISIS and have now returned. Of the few convicted, many will soon be released from jail. Others are under surveillance. The fate of the rest is murky. Why does it matter? ISIS’s diminished stature and measures adopted by the Turkish authorities have spared Turkey from ISIS attacks for more than three years. But while the threat should not be overplayed, it has not necessarily disappeared. That Turkish returnees turn their back on militancy is important for national and regional security. What should be done? Ankara’s approach toward returnees or others suspected of ties to jihadism relies mostly on surveillance and detention. The government could consider also offering support for returnees’ families, alternatives for youngsters at risk of being drawn into militancy and support for returnees released after serving ISIS-related jail time.

Violence against women (VAW) remains a globally pervasive human rights violation. According to Care International, one-third of women worldwide will experience physical and/or sexual violence at the hands of men at some point in their lives.i Much of this happens in the workplace, including the factory environments of global supply chains. In India and Bangladesh, for example, research shows that some 60% of garment workers have experienced sexual harassment in the workplace.ii To most effectively respond to VAW – and successfully prevent it – both multi-sectoral and broad societal involvement are required. The initiatives of governments and civil society organisations alone are not sufficient for the effective roll-out of the vast number of programmes required to affect the widespread change in social norms and behaviour that is required. Nor are they sufficient to cater for survivors in need of services. Active engagement with the private sector is required.

KEI’s 2020 Report on American Attitudes Toward the Korean Peninsula focuses on U.S. views on relations with South Korea, U.S. awareness of South Korean brands and cultural products, and views on North Korea and was conducted by YouGov. The results reveal that while Americans have a favorable view of South Korea and about half are supportive of maintaining U.S. troops on the Korean Peninsula, few Americans watched or listened to Korean cultural products in the last year. Americans also view North Korea as one of the three critical challenges for the United States, but fewer than 1-in-3 approve of the administration’s handling of North Korea.

COVID-19 is creating a series of crises that increase the risk of conflict worldwide. Beyond the health impact, issues like worsening inequality, food insecurity, human rights abuses, and political tensions can deepen pre-existing social fractures in any country, creating additional layers of grievance. Addressing these risks early on and building resilience to them is key to preventing the potential for violence. But the pandemic also brings new opportunities for peacebuilding. A system-wide implementation of the sustaining peace approach is critical to ensure that United Nations response contributes to decreasing risks for violent conflict in the longer term—including efforts to “build back better.” This report draws on interviews with 25+ individuals across the UN system and member states to highlight some of the key challenges for peacebuilding in the immediate COVID-19 period as well as in the longer term. The report documents how entities across the UN have made positive steps toward implementing a sustaining peace approach, and provides recommendations for deepening these gains across the system.

The U.S.-Japan alliance is viewed as a cornerstone of stability, the rule of law, and promotion of democracy in the Indo-Pacific. The new U.S. administration presents an important opportunity to strengthen and refocus relationships and initiatives in the region as they aim to tackle the challenges of an assertive China. In the context of globalization and transnational social justice movements, there is no longer such a clear delineation between the politics of domestic issues, such as political underrepresentation and minority rights, and those affecting foreign policy. Under the new administration, the United States and Japan have ample opportunity to reinvigorate democratic advancement, especially on gender and racial justice. To this end, civil society and social movement groups play a key role in demonstrating why only democracy can ensure the sustainability of representative institutions, cohesive societies, and inclusive economies driven by innovation and opportunity. Historically, these groups have been essential to promoting democratization within the alliance and in the Indo-Pacific region. On issues of gender justice, transnational feminist and human rights networks brought global attention to the comfort women issue starting in the 1980s. Linkages between groups in the United States, Korea, and Japan have strengthed calls for justice for the comfort women and highlighted the delegitimacy of previous backroom deals on the issue—such as the 1965 treaty with then South Korean dictator, Park Chung-hee, and the private negotiations between PM Abe and President Park in 2015. These movements for social justice underscored the growing role played by transnational civil society in international affairs and they raised the bar on the level of transparency and meaningful inclusion necessary to resolve such deep-rooted conflicts.

In recent years, several studies have reported on the exploitation endured by migrant workers in Southern European Union member states—especially in sectors such as agriculture and food production. However, there has been much less focus on the North. New research now shows that agri-food workers in Northern Europe also face poor and even abusive conditions. In this light, Are Agri-Food Workers Only Exploited in Southern Europe? focuses on production in Germany, Netherlands, and Sweden. These three EU member states have stronger social protections than Italy, Spain or Greece—yet the dynamics driving wage compression and the violation of workers’ rights are like those in Southern Europe. This publication provides recommendations on how the EU and national governments can act to make Europe’s agri-food system more sustainable, benefiting farmers, consumers, workers, and the environment.

Eradicating the exploitation of agri-food workers, promoting fairer food supply chains, and offering consumers effective tools to make truly informed food choices remain huge challenges in Europe. This report highlights the limitations of relying solely on food labelling schemes to meet these goals, and finds that voluntary certification schemes do not adequately enforce regulations or protect human rights. The report also argues, however, that the EU can use a number of tools to foster more just food supply chains, with ethical labels playing a role in that process as part of a “smart mix” of measures. The case studies in this report show that it is possible to have increased transparency in food labelling and supply chains, as well as better protections of workers in Europe and throughout the world. Additionally, the report explains how the EU can play an important role in providing food businesses with clear regulatory frameworks to ensure their operations do not harm workers or the environment.

Afghan paramilitary forces working with the United States Central Intelligence Agency (CIA) have long been a staple in the US war on terrorism in Afghanistan and the border region with Pakistan. The problems associated with these militias take on new significance given the recent momentum in talks between the US government and the Taliban about the withdrawal of US forces from Afghanistan. Whose interests do the militias represent? How can they be integrated into a peace agreement – if at all? Will their use value for the US in future counterterrorist operations outweigh the case for closing them down in the service of human rights and a sustainable peace? The militias are at least nominally controlled by their CIA paymaster, but to what extent will the operations of the CIA be monitored and streamlined with overall US policy towards Afghanistan? The CIA-supported militias are a particularly troublesome version of the regionally based militias in Afghanistan that have developed over the years around local strongmen with external support. The present units originate in the 2001 invasion, when US military forces and the CIA organized Afghan militias to fight Islamist militants. Almost two decades later, the CIA is still running local militias in operations against the Taliban and other Islamist militants. Throughout, the militias reportedly have committed serious human rights abuses, including numerous extrajudicial killings of civilians. CIA sponsorship ensures that their operations are clouded in secrecy. There is virtually no public oversight of their activities or accountability for grave human rights abuses. This paper pulls together publicly available information about the CIA’s “Afghan army,” charts the problems it represents for creating a sustainable peace settlement in Afghanistan, and examines possible measures for addressing these problems.

Gendarmeries and constabulary-type police go by many names, but all combine characteristics of both the military and civilian police. Because of their unique skill sets, demand for such forces to face new threats to domestic and international security has increased everywhere. Abstract:
Today, 15 March, marks eight years of deadly conflict in Syria. Since 2011 half a million people have been killed, 11.9 million have been displaced from their homes and 13 million remain in dire need of humanitarian assistance. As the conflict enters its ninth year and the prevailing media narrative is that the civil war is coming to an end, civilians in Syria still face the threat of war crimes and crimes against humanity.

Abstract:
Human rights are a very important area in contemporary international relations. The doctrine of human rights was concretized after a process of development of more than three centuries after the end of the Second World War and has changed the institutional panorama and the relations between actors at the international level. On the other hand, regardless of its «lack of teeth», the international regime on the subject has transformed the way states relate to international bodies, transnational civil society organizations and other governments.
