1. The Fiscal Impact of Immigration in the United States

The National Research Council and the National Academy of Sciences (NAS) published groundbreaking investigations into the economics of immigration in 1997 and 2017. Both publications contained thorough literature surveys compiled by experts, academics, and think tank scholars on how immigration affects many aspects of the U.S. economy. The 2017 NAS report included an original fiscal impact model as a unique contribution to immigration scholarship. Its findings have been used by policymakers, economists, journalists, and others to debate immigration reform. Here, we acquired the exact methods used by the NAS from its authors to replicate, update, and expand upon the 2017 fiscal impact model published in the NAS’s The Economic and Fiscal Consequences of Immigration. This paper presents two analyses: a measure of the historical fiscal impacts of immigrants from 1994 to 2018 and the projected long‐​term fiscal impact of an additional immigrant and that immigrant’s descendants. An individual’s fiscal impact refers to the difference between the taxes that person paid and the benefits that person received over a given period. We use and compare two models for these analyses: the first follows the NAS’s methodology as closely as possible and updates the data for more recent years (hereafter referred to as the Updated Model), and the second makes several methodological changes that we believe improve the accuracy of the final results (hereafter referred to as the Cato Model). The most substantial changes made in the Cato Model include correcting for a downward bias in the estimation of immigrants’ future fiscal contributions identified by Michael Clemens in 2021, allocating the fiscal impact of U.S.-born dependents of immigrants to the second generation group, and using a predictive regression to assign future education levels to individuals who are too young to have completed their education. Other minor changes are discussed in later sections. Immigrants have a more positive net fiscal impact than that of native‐​born Americans in most scenarios in the Updated Model and in every scenario in the Cato Model, depending on how the costs of public goods are allocated. The Cato Model finds that immigrant individuals who arrive at age 25 and who are high school dropouts have a net fiscal impact of +$216,000 in net present value terms, which does not include their descendants. Including the fiscal impact of those immigrants’ descendants reduces those immigrants’ net fiscal impact to +$57,000. By comparison, native‐​born American high school dropouts of the same age have a net fiscal impact of −$32,000 that drops to −$177,000 when their descendants are included (see Table 31). Results also differ by level of government. State and local governments often incur a less positive or even negative net fiscal impact from immigration, whereas the federal government almost always sees revenues rise above expenditures in response to immigration. With some variation and exceptions, the net fiscal impact of immigrants is more positive than it is for native‐​born Americans and positive overall for the federal and state/​local governments.

Whether it is record-breaking numbers of unaccompanied child and family migrants crossing the southwest border or unprecedented backlogs in immigration and naturalization petitions, immigration governance is buckling from breakdowns in performance across key Department of Homeland Security (DHS) immigration components and partner agencies. Rethinking immigration governance at DHS and across the executive branch is essential. Although many of the issues plaguing the immigration system are due to Congress’s failure to update immigration laws to reflect national needs, the management of DHS’ immigration components is the responsibility of the executive branch. DHS’ current chain of command and coordination capabilities are not strong enough to counteract the centrifugal forces of better-resourced, singular operations (e.g. border security and immigration detention). The DHS components and the agencies they collaborate with in other federal departments lack the assuredness and agility to effectively recalibrate and adjust to new circumstances. The challenge for the DHS immigration components is to fuse broader immigration policy and performance outcomes with enduring border and national security imperatives. This paper examines questions of structure—as compared with leadership and policy—and proposes changes that would enable more effective and humane implementation of the nation’s immigration laws. It identifies four key organizational areas of concern—mission, institutional structures, funding priorities, and institutional culture—essential to the vitality and governance of the U.S. immigration system. We argue that immigration is a system that spans both intra-DHS and interagency organizational entities and processes, and that it must operate as a system to successfully carry out its duties. Managing immigration as a system calls for coordinated operational capabilities, decision-making structures, and resource allocations. The paper provides recommendations that can be accomplished within the current authority of the secretary of homeland security and the executive branch. In addition, it closes with select proposals for a longer-term change agenda that would require legislation.

3. Border Regulation Begins with Stronger Capacity at Official Points of Entry

After the Trump Administration cutbacks, Congress should invest in the U.S. southern border to benefit trade, stop bad actors, and humanely process people with real asylum claims. Managing vehicular, rail, and people throughput at border crossings is an enormous challenge, but one not being met. U.S. inspectors do not properly screen more than a small percentage of incoming commercial and personal vehicles making this the primary means for narco-trafficking into the United States. Investing more in screening capacity at the official land Points of Entry with Mexico will reduce crime, illegal drug importation, guns going southbound, strengthen regulation and order essential for safe trade and opportunity, and make for a safer environment for those seeking legal entry into the United States. Congress has steadily appropriated new funds for more border screening capacity, but additional investment in screening capacity is still needed to make up for Trump Administration cutbacks. President Biden’s U.S. Citizens Act of 2021 has a range of helpful proposals to make us safer and keep commerce moving. Congress should mandate better measures to evaluate actual screening effectiveness. Congress also should conduct stronger oversight to address shortcomings in the US Department of Homeland Security (DHS) and Customs and Border Protection Agency (CBP) acquisition plans to make sure border inspectors spend the money more effectively and field the right capability in a timely fashion. There is a range of reforms we must make across immigration and border regulation to better serve our nation and those seeking to come here. Immigration and border enforcement have strayed from our values as a country and urgently need reform. Our legal immigration system both in asylum and visa-based needs clear modernization. Millions who have known no home but America deserve citizenship. Enforcement alone also will not solve our problems, but we must improve all aspects of American immigration and our border.

More than 86 million people have legally immigrated to the United States between 1783 and 2019. The legal regime under which they immigrated has changed radically over that time; the politics surrounding those changes have remained contentious, and past immigration policies inform the current political debate. Conflicting visions and piecemeal legislation have left the United States with an archaic and barely coherent immigration system with outdated policy objectives that is primarily controlled by the executive branch of government. We review the history of U.S. immigration policy, including the legal controversies that empowered Congress with its immigration plenary power and the historical policy decisions that still guide the U.S. immigration system, in order to contextualize the current political debate over immigration at the beginning of the Biden administration.

5. One Year after the U.S.-Mexico Agreement: Reshaping Mexico’s Migration Policies

On June 7, 2019, after months of heightened Central American migration through Mexico to the United States, the Mexican and U.S. governments signed an agreement to work together to manage the migration of Central American asylum seekers and other migrants. This ushered in an intense period of policy and institutional change that is reshaping Mexico’s immigration enforcement and humanitarian protection systems. After being threatened with steep tariffs on Mexican goods, Mexico agreed to step up enforcement efforts, accepted the expansion of the U.S. Migrant Protection Protocols (MPP, also known as Remain in Mexico) along the U.S.-Mexico border, and promised to increase collaboration with the United States to disrupt migrant-smuggling networks. In turn, the United States pledged to expedite the asylum cases of migrants waiting in Mexico under MPP and invest in economic development efforts in southern Mexico and Central America to address the drivers of migration. While the full impact of the deal will likely take years to unfold, this policy brief takes stock of what has changed in the first year since its signing. It charts trends in migrant apprehensions and returns by Mexican authorities, and the volume of asylum applications filed in Mexico. The brief also examines challenges that have intensified during this time, including the precarious conditions many migrants face while waiting in Mexican border communities for their U.S. asylum cases to be heard and the COVID-19 pandemic that hit in early 2020. Looking ahead, the brief highlights opportunities for further policy development.

6. Educating English Learners during the COVID-19 Pandemic: Policy Ideas for States and School Districts

As schools closed their physical classrooms in March 2020 due to COVID-19, educators across the United States reported that English Learners (ELs), immigrant students, and students in low-income families were particularly difficult to reach with online instruction. The pandemic and the sudden, forced transition to remote learning have brought into sharp relief the inequities that many of these students face in often under-resourced schools. Despite significant effort on the part of educators to support their students’ continued learning through Spring 2020, these efforts fell short for many ELs and students in immigrant families. Among the most notable barriers: a lack of access to digital devices and broadband, school–family communication gaps, parents’ limited capacity to support home learning, and inadequate remote learning resources and training for teachers on how to use them effectively. With the 2020–21 school year underway, and many schools continuing to operate partly or entirely remotely, this policy brief takes stock of the impact schools’ response to the pandemic is having on ELs and immigrant-background students. It identifies key challenges states and school districts must overcome, and outlines policy recommendations to help them ensure these students are adequately supported in this academic year and beyond. These include prioritizing ELs for in-person instruction when schools buildings begin to reopen, professional development on digital instruction that includes a focus on working with ELs, strategies for strengthening parental engagement, and funding mechanisms to shield high-needs students from the brunt of expected budget cuts. As the authors note, “depending on how states and districts adapt in the coming year, schools could emerge from this crisis having built stronger and more resilient systems on a foundation of equity for ELs and immigrant-background students.”

7. Rethinking the U.S.-Mexico Border Immigration Enforcement System: A Policy Road Map

The immigration enforcement regime at the U.S.-Mexico border offers a vivid example of how existing policies, laws, and resource investments are markedly out of step with new migration realities and future needs. A border enforcement system designed to address the once-dominant flows of single adults from Mexico seeking to enter the United States illegally for work is ill prepared to deal with more complex mixed flows of families and unaccompanied children from Central America, some seeking humanitarian protection, others opportunity. Consistent with its world view of immigration as threat, the Trump administration has responded by shutting down any meaningful access to humanitarian protection and asylum, by invoking a public health authority to expel more than 205,000 arrivals during the COVID-19 pandemic, and by constructing hundreds of miles of border barriers. Yet these strategies cannot succeed over the long term, nor are they consistent with U.S. law and international agreements and principles on protection. In this road map, MPI Senior Fellow and former U.S. Immigration and Naturalization Service (INS) Commissioner Doris Meissner outlines some of the steps to a more effective approach, one that builds on border management as an enduring function. Rather than a sole focus on thwarting illegal arrivals, successful border management requires cross-agency and cross-governmental collaboration that marries effective border security with fair, humane enforcement. 8. Noncitizens in the U.S. Military: Navigating National Security Concerns and Recruitment Needs

Abstract:
Noncitizens have a long history of serving in the U.S. military, and in many periods, the promise of expedited naturalization has been used to encourage them to do so. More than 760,000 noncitizens have enlisted and obtained U.S. citizenship over the past century, with peaks during the World Wars and a smaller uptick since September 11, 2001. Yet in recent years, Congress and the Defense Department have raised vetting requirements and changed training and naturalization timelines for noncitizen recruits, citing national security concerns. Such concerns are nothing new, but past military policies have generally reflected the view that national security is better served by having a fully staffed and highly skilled fighting force than by keeping noncitizens out. This policy brief puts these recent changes into context, offering both a historical look at noncitizens in the U.S. military and analysis of how they could help meet modern recruitment needs. Among other things, the brief looks at the Military Accessions Vital to the National Interest (MAVNI) program, through which more than 10,000 noncitizens with in-demand skills have entered the military since 2008 and before recent policies effectively halted the program. The brief also discusses approaches policymakers could take to balance security concerns with the potential benefits of allowing noncitizens with key linguistic, cultural, health-care, and cyber skills to serve in the armed forces.

9. Legal Protections for K-12 English Learner and Immigrant-Background Students

Although education is in many ways a responsibility of states and localities, the U.S. federal government also has an important role to play. National laws, court rulings, and policy guidance help ensure that English Learner (EL) and immigrant-background students have equitable access to a meaningful education. It is then up to states and school districts to color in many of the details as they implement these protections in their free, public primary and secondary school systems. This EL Insight lays out seven key ways the U.S. government protects the educational rights of EL and immigrant-background students, including those with Limited English Proficient and unauthorized-immigrant family members. It also explains the legal framework behind these rules, who enforces them, and how they can be seen in action in schools across the country. Some of the policies highlighted in this brief—such as using a two-step home language questionnaire and English assessment to identify which students are ELs—are well established and look similar across the country. Others, such as requirements for what credentials teachers must have to work with ELs, vary considerably. And while some legal protections have become a basis for strengthening broader educational policy, many have limitations or have fallen short their implementation. This brief is the latest in a series of English Learner Insights, which also includes an introduction to finding and using EL data and to the instructional models schools use to serve ELs.

The U.S. immigration system is in desperate need of an overhaul—and has been for many years. What has been missing is an alternate vision for a path forward that treats immigration as a comparative advantage and strategic resource, while also accounting for heightened security and rule-of-law imperatives, that can together further U.S. interests, values, and democratic principles as a society. This concept note outlines a new MPI initiative, Rethinking U.S. Immigration Policy, that seeks to fill this gap. The multiyear initiative will generate a big-picture, evidence-driven vision of the role immigration can and should play in the future of the United States, acknowledging policymakers are operating against a backdrop of globalization challenges, tech-induced disruptions reshaping the future of work, growing competition for talent, and national polities increasingly skeptical of government’s ability to manage migration. The initiative's starting point is to recognize that there are new realities facing the United States that should drive immigration policymaking in the coming period, not a return to the tired debates of the past 20 years that have foundered again and again amid rising partisanship and polarization. Among these new realities: a rising old-age dependency ratio, changing challenges at the U.S.-Mexico border, need for greater flexibility in the immigration systems as other countries have modernized their immigrant-selection systems, and a shattering of the bipartisan consensus that for decades has seen legal immigration as a positive. Historically, immigration policymaking and legislation have only succeeded through across-the-aisle cooperation and a search for common ground. This initiative is committed to re-energizing such bipartisanship and recapturing a new center in formulating and advancing fresh, feasible solutions.

11. Immigration and the U.S. Labor Market: A Look Ahead

In the coming decades, the U.S. labor market will experience major transformations that challenge the country’s economic growth and competitiveness. The native-born workforce will age and shrink as baby boomers retire and birth rates decline. Technological innovations, though unlikely to result in mass unemployment as some observers fear, will displace some workers, particularly in low-skilled occupations. And traditional employer-employee relationships are becoming less common as contracting, outsourcing, and other alternative staffing arrangements spread. While these forces may bring some productivity increases, they are also likely to result in rising inequality between skilled and unskilled workers, lower economic growth, and mismatches between the skills workers have and those that are increasingly in demand. What role, this think piece by a former chief economist for the U.S. Labor Department asks, can immigration play in mitigating these undesirable economic outcomes and supporting U.S. economic growth? Immigration could help employers hire for hard-to-fill positions, and it could reduce the costs and increase the availability of goods and services, especially in growing sectors such as health and elder care. But while immigration may benefit employers and workers with complementary skills, particularly at the high end of the skills spectrum, it can negatively affect some low-skilled workers, who have already been hard hit by technological change, globalization, and weakening labor unions. Reforms of immigration policy to support economic growth should thus be paired with a broader agenda and investments to raise the skills and earnings of workers without college degrees, whether native born or immigrant. 2018 was a banner year for the U.S. economy, but long-run projections are much less bright. Intensifying forces—including the aging of the workforce, stagnating labor force participation rates, and emerging gaps between the skills U.S. employers seek and those workers possess—are poised to significantly reshape the U.S. labor market. Other trends, including globalization and automation, are likely to dramatically transform how and where work is done. Against the backdrop of these changes, this think piece asks: What role can immigration play in bolstering future workforce and economic growth, and meeting shifting demand for both high- and low-skilled labor? In addition to supporting labor force growth, the brief’s authors conclude that immigrant workers can help mitigate a number of other symptoms of the U.S. economy’s long-run malaise, including low productivity growth, declining domestic geographic mobility, and falling entrepreneurship. But while immigration may benefit employers, consumers, and some U.S. workers, it can adversely affect others, particularly low-skilled U.S. natives and earlier-arrived immigrants. A plan to increase employment-based immigration, the authors contend, should thus be paired with policies and programs to support these groups in acquiring new skills and shifting to growing sectors. The future growth prospects of the US economy are severely constrained by a lack of working-age population growth. Fewer workers means less output without increases in productivity so large as to be highly unlikely. Increased immigration alone directly addresses the problem of fewer workers contributing to the US economy. Sound policy can help boost both the quality and quantity of available workers while ensuring that increased immigration serves to broaden rather than diminish opportunities for native-born workers.

14. Solutions to Fight Private Prisons’ Power Over Immigration Detention

For-profit private prison companies have been showering members of Congress and organizations related to President Donald Trump with campaign cash, while simultaneously lobbying lawmakers on immigration detention matters.1 These companies are set to earn hundreds of millions of dollars from Trump’s inhumane and ineffective policy of locking up asylum-seeking families, including small children and others seeking better lives in the United States.2 The U.S. Department of Homeland Security (DHS) oversees approximately 200 immigration detention centers nationwide, including facilities run by the federal, state, and local governments, as well as facilities operated by for-profit private prisons. In November 2017, 71 percent of detained immigrants were confined in private detention facilities, at a reported cost of more than $ 2 billion dollars per year.3 With huge amounts of cash and incentives for pay-to-play arrangements flowing between politicians and the industries they regulate, it is little wonder that voters believe their elected representatives are more attuned to the priorities of big-money corporate interests than to everyday Americans. It is time to adopt bold anti-corruption solutions to help rein in the power of wealthy special interests so that the views and priorities of the general public are more fairly represented when their government formulates important policies.

Syrian immigrants and refugees have frequently been in the news over the past year, and not always in a positive light. President-elect Donald Trump lashed out against Syrians coming to the United States during his campaign, promising a ban on immigration from countries “compromised by terrorism,” calling for “extreme vetting” of immigrants from Muslim and Arab nations, and saying of people already granted refugee status who fled Syria, “If I win, they’re going back.”1 Considering this negative rhetoric, it may come as a surprise to some that immigrants from Syria who live in the United States are in fact doing very well. They are learning English, getting good jobs, owning homes, and starting businesses at impressive rates. These findings are reassuring and should provide the basis for more informed and thoughtful consideration of how to think about current and future Syrian immigrants and refugees. The Syrian immigrants in the study conducted for this issue brief are overwhelmingly people who came to the United States before the recent refugee crisis. Their success is a positive sign that the United States is a place that can provide opportunity for a wide range of people and shows that immigrants from Syria, like other immigrants, are making a real contribution to local economies around the country. Their success is also encouraging as the United States continues to accept refugees fleeing the horrific Syrian war zone. Those refugees will find that it can help to have a receiving community that includes people who speak the same language; share cultural and, in many cases, religious backgrounds; and understand both sides of the transition that ref

On November 20, 2014, as part of President Barack Obama’s executive actions on immigration, U.S. Department of Homeland Security, or DHS, Secretary Jeh Johnson issued a memorandum that established priorities to guide all aspects of immigration enforcement regarding the apprehension, detention, and removal of unauthorized immigrants.1 Those priorities have focused government resources on addressing threats to public safety, national security, and border security rather than on unauthorized immigrants who have been in the United States for years without committing serious crimes. That memorandum, in addition to outlining enforcement priorities, clarified that certain categories of vulnerable people—unless subject to mandatory detention—should not be detained absent extraordinary circumstances.2 Although the memo does not specifically mention lesbian, gay, bisexual, and transgender—or LGBT—immigrants, due to their extreme risk of abuse in detention, they are recognized as a “special vulnerability” category by the DHS.3 Data obtained recently by the Center for American Progress through a Freedom of Information Act request revealed that despite the priorities outlined in the memo, the DHS elected to detain a higher percentage of LGBT immigrants who were not subject to mandatory detention in fiscal year 2015 than the year before the memorandum was issued.4 These data indicate that Immigration and Customs Enforcement, or ICE, officers ignored Secretary Johnson’s enforcement priorities when making custody decisions for LGBT immigrants.

Over the last few years there has been a sharp increase in the number of asylum seekers detained in “expedited removal” along the U.S. southern border who have expressed a fear of return to their home countries. The overwhelming majority of these people are from El Salvador, Guatemala, Honduras and Mexico. A rise in murders, rape, violence against women, kidnappings, extortion, and other brutality in these countries, which varies due to the particular conditions in each country—fueled by political instability, economic insecurity, breakdown of the rule of law, and the dominance of local and transnational gangs—is prompting many people to flee their homes.

The U.S. government interferes with the market for foreign laborers by restricting the number and mix of immigrants and setting tight quantitative limits on foreign-born guest workers. This has created a mismatch between the demand for foreign workers from U.S. businesses and their supply, directly leading to the illegal immigration situation we confront today. The current system inefficiently limits the gains that our economy could achieve from employing larger numbers of foreign workers, and it disproportionately harms small U.S. businesses. The economic fears associated with increased guest workers or immigrants are unfounded. The current Senate immigration reform proposal would be a marginal improvement but does not go far enough. Red Card, an alternative guest worker proposal, would better coordinate labor markets. Ultimately, an immigration market free from government limitations and interference would be the most efficient solution.
