Abstract:
Violent conflict and state oppression in Myanmar demonstrates the importance of placing conflict analysis and people-centred approaches at the centre of international programming on climate change and environmental protection. In 2021, the United Nation’s Intergovernmental Panel on Climate Change (IPCC) warned that the impacts of the climate crisis will be particularly pronounced in poor and conflict-affected countries. Research also identifies climate change as a ‘threat multiplier’ that, in combination with socio-political factors like poverty, state incapacity and inequality, can intensify violent conflict. However, gaps remain in how to address the increase in climate change vulnerabilities in contexts with violent conflict and state oppression. This is evident in Myanmar, where a historically repressive military regime is threatening to cause longer-term ‘climate collapse’. Since a military coup in February 2021, extractive activities and war economies are destroying the natural environment and placing communities at further risk of displacement, violent persecution and food shortages. These effects of conflict are reducing local people’s capacity to adapt to climate change and threatening civil society’s efforts to protect the environment. Under such conditions, climate change programming needs to place conflict analysis at its centre stage and substitute state-centric and purely technical approaches with people-centred ones, in alignment with the localisation of aid agenda.

2. Post-Disaster Aid in “Politically Estranged” Settings: Findings from Ten Years of Post-Nargis Social Research in Myanmar

This paper aims to inform post-disaster relief and recovery efforts in situations where relations between major development donors and national authorities are estranged. It reflects on the “what” and the “how” of aid as well as on the challenges encountered, and created, by aid providers following the 2008 Cyclone Nargis in Myanmar. It thereby demonstrates the importance of giving agency to communities for both aid delivery and oversight in these settings. Longitudinal social impacts monitoring (SIM) in a panel of 40 villages following the 2008 Cyclone Nargis identified three interrelated, yet often neglected principles that help to determine the effectiveness of post-disaster aid: empowerment—communities not only participate in, but own decision-making throughout the project cycle; transparency—communities know what aid a provider intends to deliver, and how; and accountability—communities can seek redress for aid that risks harming them in some way. Had these principles been applied consistently during the post-Nargis period, the aid effort could have identified critical challenges and opportunities more easily, such as: the fact that communities are readily able to identify what they need, and to prioritize the types of assistance they wish to receive (particularly regarding livelihood recovery); the importance of anticipating longer-term, direct and indirect economic, social, and mental health impacts; the value of building flexibility into the aid effort as needs change throughout the recovery process; the need to differentiate between livelihood groups, consider their interdependence, and target aid accordingly and consistent with village social norms; the importance of including local formal and informal leaders in the decision-making process from the outset; the imperative of providing aid irrespective of identity markers such as ethnicity or religion; and the need to avoid overburdening or harming communities through the way aid is administered. The post-Nargis aid effort faced numerous political and logistical complexities of operating in a country that was facing international sanctions. These challenges notwithstanding, several aid providers demonstrated that adherence to the three principles was possible. The SIM series thus confirmed that, for aid in “politically estranged” post- disaster settings, community-driven approaches can be an effective delivery modality and community-based, participatory social research can be a powerful oversight mechanism.

Myanmar is blessed as well as cursed by its geography. Sandwiched between Asia’s heavyweights, China and India, it is potentially in a favorable position for trade and economic relations with both countries. However, trade and economic relations are secondary to China’s geopolitical and security interests in Myanmar. China´s main objective in Myanmar is to gain access to the Indian Ocean through Myanmar and gain control over a dual-use deep-sea port in Kyauk Phyu on Myanmar´s west coast. Another priority for China involves managing the stability of the two countries´ 2,000 km shared border. The porous border region has for decades played host to armed conflicts and is also the center of a billion- dollar drugs production and trafficking network. China regards Myanmar as forming part of its neighborhood, an extension of its national interests, and is extremely sensitive to any western engagement along its borders.

4. The UN’s Response to the Human Rights Crisis After the Coup in Myanmar: Destined to Fail?

Since seizing power in a coup on February 1, 2021, Myanmar’s military has launched a violent crackdown against anti-coup protesters—a campaign of terror that may amount to crimes against humanity. With violence spreading, there are fears that the country is slipping toward full-scale civil war and state collapse. The international community has appeared almost powerless to respond to this human rights crisis, reflecting a broader weakening of its resolve to prevent and respond to atrocity crimes over the last decade. This policy paper analyzes the human rights crisis created by the coup in Myanmar and assesses the response of the UN, within the context of broader international efforts, when viewed against the many commitments that have been made to protect people from atrocity crimes. The first section outlines the different elements of the human rights crisis and the violations that have been occurring. The second section places the events in Myanmar in the context of international commitments, including by the UN, to address atrocity crimes. The third section reviews the human rights tools that are at the disposal of the UN to understand what works and what does not and to highlight innovative ways to address such a challenging situation. The paper concludes with proposals for what an agenda for protection in Myanmar might entail, building on the ambitious Call to Action for Human Rights launched by the UN secretary-general in 2020. The unfolding tragedy in Myanmar is one of the first major tests of the secretary-general’s initiative, and so far, the UN’s response—both as an intergovernmental body of member states and as a system of operational entities—has been woefully inadequate. While there is no simple recipe for halting the atrocity crimes, the UN could take a combination of measures at several levels: Grounding the response in a political strategy; Increasing capacity for human rights monitoring and quiet diplomacy; Providing clear leadership that encourages a less risk-averse approach; Devising a whole-of-system approach to the UN’s response; Scaling up protection services; and Supporting existing nationally or locally-led protection efforts.

The year 2018 was characterized by a decrease in lethal violence in several of the world’s hotspots, primarily due to a significant de-escalation of the armed conflicts in Iraq, Myanmar, South Sudan, and Syria. The homicide rate also decreased marginally due to population growth outpacing the nominal increase in killings between 2017 and 2018. These two trends jointly resulted in a modest positive change in the rate of violent deaths globally in 2018 which, at 7.8 violent deaths per 100,000 population, is at its lowest since 2012. Still Not There: Global Violent Deaths Scenarios, 2019–30, a Briefing Paper by the Survey’s Security Assessment in North Africa (SANA) project provides an updated trend analysis of global violent deaths and develops global-level scenarios for the years leading to 2030. Based on 2018 figures from the Small Arms Survey’s Global Violent Deaths (GVD) database, the paper also includes a specific analysis of developments in Northern Africa and the five nations of the G5 Sahel region. It finds that under a business-as-usual scenario, Northern Africa’s violent death rate would remain relatively stable by 2030. By contrast, under the same scenario, the fatality rate in the G5 Sahel region would increase significantly.

Abstract:
Countries with geostrategic stakes in Myanmar have reacted in different ways to the military coup of 1 February 2021 and its aftermath, which have resulted in over 750 casualties thus far. China benefits from stability in Myanmar but, given its vast geoeconomic and geopolitical interests as Myanmar is a vital part of the BRI, will not criticize the military. Thailand, itself a military-dominated pseudo-democracy, is certainly reluctant to exert pressure. India focuses on its own national interest and prioritizes the partnership with its strategically important neighbour. Japan applies quiet diplomacy and aims to function as mediator, while at the same time protecting its business interests. The EU and US have sanctions in place, but history shows these do not have much effect on the junta. Russia’s presence is not significant, but Moscow uses arms sales to establish a foothold in the Indo-Pacific. ASEAN aims to mediate with Indonesia in the lead, and even achieved a broad consensus on the situation in Myanmar, but likely remains too divided to deliver lasting change on the ground. Given the divergent geostrategic interests of external actors in Myanmar, a concerted effort to achieve change in the country is unlikely. Hence, sustained change has to come from within the country.

Abstract:
The Rohingya—who experienced genocide prior to Burma’s 2021 military coup—are now at heightened risk of genocide and mass atrocities by the Burmese military, known as the Tatmadaw, and the Arakan Army, an ethnic armed organization in Rakhine State. Other vulnerable groups include the broader Muslim community and ethnic and religious minorities in areas where ethnic armed organizations and/or People’s Defense Forces are fighting the Tatmadaw. To prevent mass atrocities, the Tatmadaw should cease attacks on civilians and cede power so Burma can move toward a more diverse, representative, and credible democracy. The US and other governments should conduct a full mass atrocity risk assessment, provide rapid and flexible funding to civil society organizations responding to the crisis, and constrain and condemn the Tatmadaw.

Diplomacy and peace processes are multi-tracked. They happen at multiple levels, from official peace negotiations to informal peacebuilding initiatives. Meaningful participation of women across all tracks is essential to building sustainable peace. While women remain underrepresented in official Track I peace processes, Track II diplomacy has offered women a space to meaningfully participate in conflict-resolution efforts. From past peace processes in Liberia and Myanmar to ongoing efforts in Afghanistan and the Caucasus, Track II diplomacy is both common and especially important for women. This policy brief is designed for an audience of conflict resolution practitioners and policymakers and seeks to capture the most successful and promising practices, highlight how to overcome common constraints, and propose indicators to assess the success of women’s participation in these informal processes.

On 8 November 2020, Myanmar will hold its second election since the country’s gradual liberalization began. Despite presenting itself as a force for liberal democracy five years ago, the National League for Democracy (NLD) has demonstrated its unwillingness to commit itself to the protection of civil freedoms and the expansion of federal governance. It has fallen short of campaign promises by failing to enact meaningful constitutional change, improve economic performance, and address the protracted peace process. Notably, the government has created a climate that represses dissidents and undermines ethnic pluralism. Yet, the NLD’s support base remains strong, in part as a result of Aung San Suu Kyi’s continued ability to appeal to a Bamar-majority voter base by opposing the military cronyism of past and rooting herself in ethno-nationalist values, as witnessed in her decision to respond to charges of genocide at the International Court of Justice at the Hague. As a result, the NLD’s continued dominance over the Union Solidarity Development Party (USDP) is expected to continue. In the ethnic states, the situation is different—here, the ethnic political parties are expected to make gains on the NLD, as their recent merging place them well to take advantage of anti-NLD sentiment that has grown within ethnic minorities over the years because of the NLD’s perceived Bamar-centric governance. In addition, a lack of trust in the Union Elections Commission and complications due to covid-19 are significant sources of risk in the running of the 2020 election.

11. Delivering Healthcare amid Crisis: The Humanitarian Response in Myanmar

Myanmar simultaneously faces multiple armed conflicts and crises, each with its own challenges. In Rakhine state, the government’s persecution of the Rohingya people has led to massive displacement, as have decades of armed conflict in Kachin and northern Shan states. Combined with chronic underdevelopment, these humanitarian crises have left people without access to adequate healthcare, leading international humanitarian actors to step in. The public health system in Myanmar is generally poor, and government funding for health services is among the lowest in the world. There are wide discrepancies in health services between rural and urban populations and between central and peripheral states. In Rakhine, there are only nine public health workers per 10,000 people, and access to secondary and tertiary healthcare is limited. Community-based or ethnic health organizations provide primary healthcare in many areas without government facilities. In crisis-affected areas, UN agencies and international and local NGOs play an important part in providing healthcare services. However, international action can be unbalanced both regionally and medically. In many areas, health actors have focused on responding to diseases like malaria, HIV/AIDS, and tuberculosis, leaving a critical gap in mental health services and clinical health responses to sexual and gender-based violence. Likewise, funding has been imbalanced, with Rakhine state receiving more funding than Kachin or northern Shan. This paper looks at the state of healthcare in Rakhine, Kachin, and northern Shan states, the role of humanitarian actors in the provision of health services, and the trends and challenges affecting the humanitarian health response. It provides several recommendations for improving the humanitarian health response in Myanmar, including: 1. Adjust the scope of the humanitarian response; 2. Advocate for better humanitarian access; 3. Strengthen local capacities, and; 4. Address the dilemmas inherent in providing aid amid a development and human rights crisis.

12. Guatemala’s Achilles’ Heel: The 2030 Agenda and the Fight against Corruption

In late 2015, momentum toward implementation of the 2030 Agenda for Sustainable Development was steadily building in Guatemala. This momentum was driven by the International Commission against Impunity in Guatemala (CICIG) and protesters in the streets demanding action against corruption. Since 2017, however, a political standoff in Guatemala has started reversing these gains. A sustained reversal would undermine efforts to address the country’s longstanding socioeconomic needs. This study analyzes recent gains and setbacks in Guatemala’s efforts to implement the 2030 Agenda and provides recommendations for ways the country can fight corruption and securitization to sustain peace and promote sustainable development. It suggests better communicating the 2030 Agenda through multi-stakeholder outreach, improving monitoring or progress, aligning international aid with local objectives, and continuing to engage with the private sector. This issue brief is part of the International Peace Institute’s (IPI) SDGs4Peace project, which seeks to understand how the 2030 Agenda is being rooted at the national and local levels and to support the implementation of the Sustainable Development Goals. The project focuses on five case studies: Guatemala, the Gambia, Greece, Lebanon, and Myanmar. Implementation of the 2030 Agenda provides each of these countries an opportunity not only to buttress existing aspirations but also to build new partnerships that transcend traditional approaches.

Contract disclosure is a growing global norm. The Extractive Industries Transparency Initiative (EITI) board agreed to require all member governments to disclose the contracts they sign with oil, gas and mining companies beginning in January 2021. Around the world governments, companies and civil society are increasingly advocating for disclosure. In Myanmar, progress has been extremely slow. Despite civil society activists and several major investors supporting reforms, the government has not disclosed any petroleum or mining contracts so far. With new licenses expected to be issued in the petroleum, minerals and gemstone sectors, the Myanmar government should act now to keep pace with a global trend.

Despite geological potential, Myanmar's mining sector has attracted few large-scale companies to date and the sector generates little government revenue. The authors of this briefing present the challenges the Myanmar government has faced in designing an effective mining tax regime. They suggest three ways in which the government could attract greater investment and allow the people of Myanmar to maximize benefits from the potentially significant mineral wealth of their country. The briefing is informed by the Natural Resource Governance Institute’s engagement with Myanmar’s Ministry of Natural Resources and Environmental Conservation (MONREC), helping the ministry implement strategic reforms.

FACTSHEET | NOVEMBER 2019: Starting in October 2016 and then again in August 2017, Myanmar’s security forces engaged in so-called “clearance operations” against the Rohingya, a distinct Muslim ethnic minority, in Rakhine State, Myanmar. The operations, in particular those that started in August 2017, were characterized by brutal violence and serious human rights violations on a mass scale. Survivors report indiscriminate killings, rape and sexual violence, arbitrary detention, torture, beatings, and forced displacement. Reports have also shown that security forces were systematically planning for such an operation against the Rohingya even before the purported reason for the violence — retaliation for small scale attacks committed by the Arakan Rohingya Salvation Army (ARSA) — occurred. As a result, an estimated 745,000 people — mostly ethnic Rohingya — were forced to flee to Bangladesh. According to the UN Human Rights Council-mandated Independent International Fact-Finding Mission on Myanmar (FFM), the treatment of the Rohingya population during the “clearance operations” amounts to genocide, crimes against humanity, and war crimes, the commission of which evokes specific obligations and responsibility under international law. In its final report, published in September 2019, the FFM concluded that “the State of Myanmar breached its obligation not to commit genocide” and found that Myanmar “continues to harbor genocidal intent” towards the Rohingya. On November 11, 2019, The Republic of The Gambia filed suit against Myanmar in the International Court of Justice (“ICJ”) for violating the Genocide Convention. This momentous lawsuit brings a critical focus to Myanmar’s responsibility as a state for genocide and compliments ongoing investigations into individual accountability. This fact sheet answers fundamental questions about the ICJ case, and seeks to clarify available avenues for justice for the crimes committed against the Rohingya population.
