- Consolidating the legitimate use of force in the hands of the state is a vital first step in post-conflict peacebuilding. Transitional governments must move quickly to neutralize rival armed groups and provide a basic level of security for citizens. Two processes are vital to securing a monopoly of force: disarmament, demobilization, and reintegration and security sector reform. Disarmament, demobilization, and reintegration (DDR) involve disbanding armed groups that challenge the government's monopoly of force. Security sector reform (SSR) means reforming and rebuilding the national security forces so that they are professional and accountable. U.S. experience in Afghanistan, Iraq, Liberia, Haiti, Bosnia, and Kosovo yielded three crosscutting lessons: go in heavy, tackle DDR and SSR in tandem, and consolidate U.S. capacity to implement both tasks in a coordinated, scalable way.

- The unrest in Syria offers the Gulf States an opportunity to weaken or even dislodge an Assad regime aligned with Iran, but their ability to project power or shape events in Syria is limited. Dislike of the Assad regime doesn't necessarily align Gulf interests and long-term vision for Syria. Moreover, cooperation on diplomacy and strategy is lacking. Sectarianism, most evidenced in media commentary and clerical statements, is already a major feature of Gulf discourse on Syria. Parts of the Syrian opposition have approached and have been courted by Gulf governments. Still, a degree of unease and mistrust continues to define their relations.

- Israel has been generally quiet regarding the recent turmoil in Syria, a reflection of the issue\'s relative low priority, as well as Israel\'s limited influence on internal Syrian matters. Israel\'s preferred outcome would be a stable Syrian regime that disassociates itself from the “axis of resistance,” poses no bilateral threats, and controls the border area—though Israel sees no clear path for achieving these aims. The view in Israel is that the basic structure of deterrence still holds vis-à-vis Syria and the regime—even in its desperate circumstances—is unlikely to provoke Israel in dramatic ways.

105. Constitutional Interpretation and the Continuing Crisis in Afghanistan

- The recent controversy in Afghanistan over the outcome of the 2010 parliamentary elections ultimately resolved the question of who sits in Parliament, but left a more fundamental question unanswered: "Who has the power to interpret the Afghan Constitution?" Ambiguities in the language of the Constitution make it difficult to determine who has the legal authority to interpret it. The Supreme Court maintains that the Constitution gives it the power of judicial review, but the Constitution also calls for the Independent Commission on the Supervision of Implementation of the Constitution (ICSIC), which the Parliament has mandated to decide constitutional issues instead. Without political and legal consensus over who has final authority to decide different types of constitutional claims, Afghanistan cannot achieve a rule of law where government activities are subject to consistent and transparent rules. Afghanistan must establish clear and unambiguous rules for constitutional interpretation to avoid damaging crises about political leadership and the separation of powers as the security transition and Presidential election approach in 2014.

- The Government of Jordan is deeply concerned about the turmoil in Syria, fearing the spillover effect and knowing Syria's historic capacity to undermine Jordanian internal stability. Initial official Jordanian reaction has been cautious, to avoid antagonizing Syria and provoking retaliation. There is great anxiety over what may follow the collapse of the Assad regime. Jordan is under increased pressure from both internal elements and external powers to toughen its public posture toward Damascus. Ultimately, Amman will react carefully to events in Syria, taking actions that best ensure the security of the state and the survival of the monarchy.

The crisis will continue indefinitely without a political agreement that acknowledges the Nuba rebellion is self-sustaining and reflects a wider malaise within the new Republic of Sudan. With Sudan facing financial collapse, economic normalization must be part of negotiations with Khartoum to end the war in the Nuba Mountains and promote democratization throughout Sudan.

- Since 2007, Belgium has displayed a rather surreal degree of political chaos. Belgian politicians have provoked three cabinet resignations, 24 “royal” mediators, and more than 420 days of coalition formation. With the rise of Flemish nationalism and intercommunal tensions, the country seems to suffer from an intractable ethno-linguistic conflict. The maximum degree of reform Walloon parties can settle with is by far insufficient to Flemish nationalists, whose package of demands is considered unacceptable in Wallonia. One way forward is the creation of a nation-wide electoral district for federal elections in which every Belgian, regardless of residence, can vote for Flemish and Walloon candidates.

- The 2011 Conference on Disarmament (CD) began contentiously when Ambassador Zamir Akram, Pakistan\'s permanent representative to the United Nations, criticized United States\' support of India\'s membership in export organizations that would allow it to engage in nuclear trade. Pakistan believes such membership would further favor India and accentuate the asymmetry in fissile materials stockpiles of the two states. Strategic and security concerns drive Pakistan\'s commitment to block negotiation of a fissile material cutoff treaty. Progress during the CD seems unlikely if the United States and Pakistan remain entrenched in their respective positions.

- During the 1990s, economic mismanagement, political oppression, natural disaster, and loss of external subsidies after the end of communism led to a calamitous decrease in food production in the Democratic People's Republic of Korea (DPRK). The public health infrastructure, including water and sanitation systems, drug distribution and supply chains, and local clinics and hospitals, also deteriorated. At least half a million people died of starvation and millions more suffered acute or chronic malnutrition. Malnutrition increased vulnerability to disease at a time when the health system was incapable of effective response. Fifeen years later, neither health nor the food systems have recovered as the economy persistently stagnates. Health continues to be a low priority for the government. The availability of food is insufficient to meet population needs, hospitals and clinics are significantly ill-equipped, the medical workforce lacks appropriate training, and corruption in drug distribution is pervasive. Malnutrition and anemia, as well as diseases associated with poor sanitation, remain widespread. Over the last few years, DPRK has begun to accept international assistance to address health system needs, most notably to vaccinate children. Although these initiatives address some infrastructure needs, the continued centralized control of health and the lack of open discussion about key issues renders the possibility of reforms sufficient to meet the health needs of the people of North Korea dim. During the economic crisis, tens of thousands of North Koreans migrated to China despite harsh measures imposed by both governments to restrict border crossing and a refusal by China to give legal status to the migrants. To a limited extent, migration ameliorated the health impact of the crisis by stimulating illicit cross-border trade and informal markets that increased some North Koreans' access to food. Even after a disastrous effort by the DPRK government to shut the markets down in 2009, they are re-emerging. China's encouragement of these markets, along with regularizing the status of migrants in China, could advance its own economic interests as well as contributing to improving the health of North Koreans.

- Salam Shabab (Peace Youth) is a unique reality TV series filmed in Iraq that brought together youth from six provinces of Iraq to compete for a chance to become youth “Ambassadors of Peace.” The views of young Iraqis participating in Salam Shabab, along with new surveys on youth perspectives, have begun to create a potential profile of the next generation of Iraqi leaders. Many Iraqi youth express conflicting views on politics and youth participation in Iraq. They are disappointed about not having their voices heard by political and civil society leaders, yet optimistic about their role in shaping the future of their country. Iraqi teenagers express tremendous pride in their local communities, which they associate with peace, unity and coexistence. Yet, the same youth often cannot clearly define what national identity means to them. Regarding their perceptions on building peace, Iraqi youth indicate that peace in Iraq can be achieved through unifying factors such as cross-cultural dialogue. According to them, the similarities among diverse people are more powerful in building peace than their differences. If given the opportunity, a vast majority of Iraqi youth are willing to take on a peacebuilding role, in part by connecting with other youth in Iraq and internationally.

- Gender is often used synonymously with the study of women. This narrow approach overlooks the relational quality of gender and fails to include masculinity issues in analysis and research, which can have important bearing on policy interventions. Taking a more inclusive view of gender roles in conflict, which also recognizes that these roles are dynamic, can lead to more informed research strategies and more productive policy interventions. To effectively combat instances of extreme gender violence, such as the use of sexual violence as a weapon of war, a more nuanced understanding is needed of the actors involved. Instead of being passive actors during conflict, women may be combatants or direct participants in sexual violence. Examining the motivations, belief systems and internal dynamics of armed combatants can provide insight into the origins of sexual- and gender-based violence in conflict. Rather than representing an isolated event, sexual- and gender-based violence during conflict can perhaps best be viewed as a point along a continuum. In the postconflict period, damaged social and economic systems may contribute to the disempowerment of men seeking to return to traditional or customary roles. Coupled with the enduring impacts of trauma, the threat of emasculation can result in high levels of violence within the household environment.

113. Afghan High Peace Council Fails to Reflect Afghan Civil Society

- The Afghan public, along with the international community, appears increasingly supportive of opening negotiations with the Taliban to end the war. The Karzai administration also supports this, as reflected by the June 2010 Peace Jirga held in Kabul and the 70-member High Peace Council that was formed thereafter. In spite of the talks, no one in Washington or Kabul has clarified what reconciliation means in practice, particularly with respect to accountability for abuses that occurred during the rule of the Taliban as well as those that occurred when rival factions fought with each other before the Taliban came to power. On November 10, 2010 representatives from Afghan and international NGOs, as well as the UN, gathered for a one-day Conference on Peace, Reconciliation, and Justice in Kabul to revitalize public discussion on peace and reconciliation among the government of Afghanistan, the international community, and Afghan civil society. The discussions revealed a troubling disconnect between the High Peace Council and Afghan civil society representatives who strongly criticized the Council\'s inclusion of former militia leaders among its members, the lack of transparency in its activities, and the lack of clarity in its objectives. These criticisms indicate that for a peace process to have broad, popular support, the Afghan government and the international community must make greater efforts to engage local leaders in a dialogue and account for the interests of communities and interest groups that are not represented in the High Peace Council.

- In the wake of Haiti's disastrous earthquake, international organizations have begun to recognize gender-based violence as a significant area of concern, particularly within Port-au-Prince's internally displaced persons (IDP) camps. Other forms of gender-based violence include not only rape, but also sexual abuse. Sexual violence is often underreported or not reported at all. This lack of data can prevent accurate assessments of rates of violence or trends. Grassroots organizations are working to reduce and better document sexual violence and to establish local mechanisms for increasing security throughout Haiti's tent encampments.

- Haiti's slow pace of recovery from the January 2010 earthquake is due to the magnitude of the calamity, pre-existing conditions, institutional weaknesses, resource limitations, a cholera epidemic and disputed elections. The pace of new cholera infections and deaths has begun to slow, although infections and death rates remain high in rural areas and risk of renewed high infection rates is significant. Following protracted controversy after presidential and parliamentary elections held in late November 2010, second round runoffs have been scheduled for March 20th with President Rene Préval remaining in office through mid-May. The unexpected return to Haiti in mid-January of former dictator Jean-Claude Duvalier and the potential return of exiled former president Jean-Bertrand Aristide have added to the country's turmoil and uncertainty. Scenarios for Haiti's future are based not only on the international community's ability to provide needed support, but also on the ability of Haiti's leaders and people to successfully elect a credible national government.

- Crisis mapping is a growing field that seeks to leverage mobile platforms, computational models, geospatial technologies, crowd sourced data, and visual analytics to power effective early warning for rapid response to complex humanitarian emergencies. The second International Conference on Crisis Mapping convened from October 1 to 3, 2010, to discuss lessons learned from past and present initiatives and strategies for moving the field forward. Over 250 participants from major international organizations, the technology community, universities, and NGOs attended. Some of the main themes from the conference included the need to design environment-appropriate technologies, improve analysis tools and systems, create standards for the emergent field, engage local populations, and gain a better understanding of the challenges of operating in complex political environments.

- Limited opportunities for economic progress and political expression helped force Egypt's youthful population on the streets and precipitated the demise of long-time leader Hosni Mubarak. Prospects for stability are linked to the government's ability to address youth employment—a core demand of the protesters. The January/February 2011 protests could be the tip of the iceberg. Robust and sustained action is needed to improve human security, starting with employment and income generation opportunities. An effective economic transition in Egypt need not be a zero-sum game. Done correctly, employment-based economic restructuring that focuses on the most vulnerable (and volatile) segments of the population could lay the foundation for a stronger, stable and more peaceful Egypt. The next steps in Egypt's revolution will tackle the difficult task of expanding economic opportunity and providing space for more representative, accountable and participatory governance. Fundamentally, this would require the Egyptian government and military to progressively cede control of the levers of economic power. Employment creation that focuses on the youth is not a silver bullet and will not guarantee success on its own. It will, however, broaden the constituency for reform by making Egypt's youth bulge more involved in shaping the destiny of the country's 82 million citizens.

- With a rise in terrorist activity spreading fear through highly publicized attacks, Pakistan's media landscape has increasingly been used as a battleground between those seeking to promote violent conflict and others seeking to manage or deter it. Pakistan's media community has not yet developed an adequate or widely accepted strategy for responding to this context of persistent extremism and conflict. The rapid rise of extremist radio stations in the Federally Administered Tribal Areas (FATA) and Khyber Pakhtunkhwa (KPK) provinces has paralleled an increase in terrorist attacks, facilitated by affordable access to FM radio, loose government regulation of broadcast media and militant control of pockets in KPK and FATA. Negative media attitudes toward the Pakistan-U.S. relationship often reflect national political differences and market incentives for sensationalist coverage. These attitudes can be transformed through changes in the diplomatic relationship between the countries based on open communication rather than institutional media reform.

- The political stalemate in Côte d'Ivoire following the November 28, 2010, presidential election continues. The majority of the international community recognizes Alassane Ouattara as the winner, but Laurent Gbagbo, the sitting president, insists he won. Financial and diplomatic sanctions imposed on the Gbagbo administration have thus far not forced Gbagbo from power. Maintaining international pressure and focus is critical to resolving the Ivorian crisis, but African states are increasingly divided on how to proceed. The power-sharing arrangement settled on by five African nations in recent elections sets a dangerous precedent. Losers with a strong militia may find it easier to use threats of violence or actual violence to retain a critical power role, thus subverting the intent of the election. African states will continue to experience violence during elections until the security sector is reformed, states refrain from holding elections while militias remain mobilized and armed, elections can be clearly and independently verified, institutions are politically independent, and policies exist to discourage the violent acquisition of power.

120. Constitutional Reform in Transitional States: Challenges and Opportunities Facing Egypt and Tunisia

- Countries emerging from authoritarianism frequently face constitutional challenges, among them sequencing constitutional reform with a transition to democracy, designing a constitutional review process that is seen as legitimate, and addressing substantive constitutional concerns. Sequencing constitutional reform and elections begs the questions who should lead the constitutional reform and when should it be conducted. Constitutional reform prior to elections can leave stewardship over the constitution-making process to unelected and perhaps not wholly trusted transitional governments. Elections prior to constitutional reform may be tantamount to simply handing the machinery of authoritarianism to a new set of actors. Egypt and Tunisia offer different paths to transition and each face criticism. In the end, a less “democratic” solution might be the best one. Whatever the chosen process for constitutional reform, legitimacy must remain the sine non qua of a successful constitution-making moment. Adherence to guiding principles of inclusivity, participation, transparency, consensus and national ownership can legitimize the constitution-making process and the final document itself. Just as the history, society, culture, and preferences of every country is unique, so too is every constitution. Certain common issues, however, are likely to be front and center for countries transitioning from authoritarian rule to democracy. This Peace Brief offers a brief examination of many of these commonly recurring issues.

- At least 80% of all disputes in Afghanistan are resolved through traditional dispute resolution (TDR) mechanisms, principally community councils called shuras or jirgas. TDR is therefore impossible to ignore as the primary justice institution in the country. Still, most women's groups in Afghanistan tend to oppose international donor or Afghan government support for TDR because they generally exclude women from participation and are known to issue decisions that violate women's rights. In the spring of 2011, the U.S. Institute of Peace in Kabul hosted meetings to examine the broader question of how women can gain greater access to justice. The outcome of the conversations was a more nuanced view of TDR and women in Afghanistan and a recognition that creative engagement rather than condemnation is a more productive approach to resolving deficiencies in women's rights in TDR venues.

- Stability in Afghanistan will remain elusive unless disputes between individuals and among communities can be resolved through peaceful and equitable means. However, state justice institutions are barely functioning in much of the country and are incapable of meeting many justice and dispute resolution needs of Afghans. Instead, the majority of Afghans turn to traditional justice mechanisms—including tribal councils and village and religious leaders—to address both civil and criminal disputes. In many parts of the country, including areas recently cleared of insurgents, the best way to make signi_cant, visible, short-term (12 to 18 months) gains in peacefully resolving disputes is to work with community-based structures. USIP has drawn important lessons from its work with Afghan partners to implement pilot programs exploring links between the state and traditional justice systems in four provinces across the country (in Nangarhar, Khost, Paktia and Herat). Programs designed to create or strengthen existing links between traditional justice bodies and state institutions can build mutual trust and harness the strengths of each. Donor-funded traditional justice programs need to involve the Afghan government while also accounting for the practical needs of communities to settle disputes in line with their own traditions and procedures, as well as Afghanistan's laws and human rights norms.

This is important in conflict states, particularly during peace or stability operations. Establishing legislative oversight is difficult in conflict countries because of the absence of historical tradition, the complexity of security agencies, the technical nature of the issues, secrecy laws and the lack of expertise among parliamentarians and their staffs. The U.S. Congress provides a model for effective legislative oversight of the security sector for other countries to emulate. Congress has developed the legal authorities and the traditions required to form an effective partnership with the Defense and Justice departments, the U.S. military forces and civilian security services. Due to the importance of legislative oversight of the security sector to the democratic process, the U.S. Congress provides advice and training to foreign parliaments and parliamentarians in security sector reform. - The presidential and provincial council elections held in Afghanistan in August 2009 were marred by irregularities and fraud, leading voters and candidates to question the fairness and utility of the democratic process there. The Afghan government announced in late January that it will delay Parliamentary elections until September 2010—several months beyond the deadline set by Afghanistan's constitution. The extra time is needed to make adequate logistical preparations, but little has been done so far to reform electoral institutions or policies to prevent a repeat of the problems of the 2009 elections. Without signi_cant changes in the personnel and policies of the Independent Electoral Commission (IEC)—the constitutional body responsible for overseeing all electoral processes— the 2010 election is likely to fall below international standards and risks undermining government (and international) legitimacy at a critical period for the counterinsurgency strategy. In addition, signi_ cant long-term reforms, including a wholesale revision of the voter registry, must be initiated now to ensure that the district council and other future Afghan elections are credible and acceptable.

- Since the advent of Plan Colombia in 2000, U.S. policymakers have sought to help Colombian governments win their multiple wars against insurgents, drugs and terrorism. Conventional wisdom had suggested that pursuing these paths concurrently would lead to peace and security. Colombia today is farther from a peace settlement than it has been in years. With national elections scheduled for the first half of 2010 and presidential candidates yet to be defined, peace does not appear on the government's public policy agenda and it has yet to materialize as a campaign issue. Faith in a military victory appears deeply entrenched at a popular level. Illegal armed groups are retrenching and adapting to years of sustained military offensives and the increased capacity of Colombia's armed forces. While security indicators had largely improved, violence in major cities last year jumped sharply, and internal displacement has reached crisis proportions. Colombia's conflict is increasingly affecting the Andean neighborhood, sending hundreds of thousands of Colombians across the borders. Patterns of violence and intimidation are emerging as illegal armed groups increasingly settle into these border regions. Sporadic incursions and incidents at the border have ratcheted up rhetoric and sparked diplomatic standoffs and movement of troops. A recent bilateral military accord between Colombia and the United States has also exacerbated tensions in the hemisphere. Policymakers increasingly question whether staying the course in Colombia is in the U.S. best interests. Some are calling for an overhaul of U.S. policy. Peace and regional security are integral to the multitude of U.S. interests in Colombia, and they should no longer be subsumed to other strategic interests. It is time to seek peace as a priority. This approach should emphasize respect for human rights and the rule of law; support for truth, justice and reparations for the victims of armed conflict; and the facilitation of processes conducive to peace as a key policy objective.

- The concept of “peace through health” or “health as a bridge for peace” has been in existence for decades, but remains ambiguous. The idea is best understood as cross-border or cross-group initiatives toward increasing understanding, cooperation, and trust, addressing health concerns of populations and mobilizing health professionals as advocates for peace. Such initiatives can potentially contribute to building a foundation for state-building and economic development. But few rigorous evaluations of peace through health initiatives have been conducted, and the limitations of the idea must be recognized. Peacemaking is an inherently political process, and health-related initiatives are unlikely to contribute directly to peace settlements. Palestinian and Israeli health professionals have a long history of cross-border cooperation in health, including collaboration in disease surveillance, training and advocacy for health. Cooperation is increasingly difficult because of ongoing travel restrictions on Palestinians in the West Bank, because the initiatives are increasingly seen by Palestinians as political in nature—even as a tacit endorsement of the Israeli occupation—and because many Palestin¬ian health professionals prefer to invest their energy in building an effective health system in the West Bank independent of Israel. Efforts to foster cooperation through health initiatives—especially in situations where differentials are so great as in the Israeli-Palestinian conflict—must be directed toward meeting real health needs of the population, be founded on mutuality, and focus on building effective systems.

- With Southern Sudan's referendum on whether to remain part of Sudan or secede approaching, it is vital that the international community encourage and support negotiations on postreferendum arrangements, which include issues ranging from wealth sharing to citizenship rights to security arrangements. Good coordination among the international community will be essential. A single mediator with a clear and strong mandate should lead negotiations on postreferendum arrangements, supported by a contact group or group of friends that can insert targeted pressures and incentives into the process. The mediator needs to be strong enough to prevent “forum shopping” and contain or co-opt spoilers. States and non-state actors that wish to play a central role in negotiations on post-referendum arrangements should demonstrate a long term commitment to Sudan and to overseeing implementation of any agreement. - On January 12, 2010, Haiti suffered a 7.0 magnitude earthquake that destroyed much of the capital city of Port-au-Prince and caused the death of perhaps as many as 200,000 Haitians. The quake—the greatest natural disaster in the country's history—occurred at a point when Haiti appeared to be on the path to stability and progress. U.S. military forces will provide security during the emergency response phase, but aid to United Nations peacekeepers and the Haitian National Police is required to ensure that criminal gangs will not take over once the Americans withdraw. Reconstruction must target unemployment and poverty. Removing rubble and rebuilding essential structures will provide jobs, but it will be important to improve conditions and provide employment in rural areas so people will not return to the overcrowded and slum-ridden cities. The massive inflow of financial aid must not exacerbate Haiti's reliance on foreign nongovernmental organizations to provide essential services. Foreign aid should help Haiti's government expand its ability to manage resources and programs by providing training and budget support. In providing for Haiti's recovery, the international community must look ahead to the long term consequences of its action and work to place Haiti back on the path to sustainable development.

Doing so would require a detailed understanding of the country's complex and evolving political economy. The lingering income and distributional effects of the 2008 Cyclone Nargis, anticipated changes associated with the new constitution and the 2010 elections and the Obama administration's decision to devote more attention to Burma suggest that the time is ripe for the creative application of economic mechanisms to promote and sustain peace. Looming challenges could derail Burma's prospects for economic and political stability. These challenges include irrational macroeconomic policies, failing to ensure all citizens enjoy benefits accrued from natural resources, endemic corruption, a flourishing illicit economy, a dysfunctional financial system and critical infrastructure bottlenecks. Failure to address these problems would frustrate peacebuilding efforts. A conflict sensitive economic strategy for Burma would focus on effective capacity-building, sustained policy reform, progressive steps to reduce corruption, fiscal empowerment of subnational authorities and prudent natural resource management. Success in these areas requires unwavering political will for sensibly sequenced policy improvements by domestic actors and finely targeted support from Burma's international partners.

- Studies indicate that violence in Africa's elections affects between 19 and 25 percent of elections. In many countries where electoral violence is a risk, it tends to recur and may consequently lead to an unfavorable view of democratization. Electoral violence, especially recurrent, seems indicative of more widespread systemic grievances and tensions. These areas intersect and are frequently manipulated by politicians. Some recent actions taken by the government and civil society may offer insights into reversing the trends of recurring violence. The program is based on principles of equity, national ownership, community engagement, and women's equality, and it warrants continued development. Many challenges remain, not least expanding services in insecure areas, and a more stable environment could better enable the Ministry of Public Health to achieve its goals. The U.S. military has supported health services development for the Afghan army and also offers significant emergency care services to civilians in insecure regions, training for health workers, construction of health facilities and other health-related programs. The military's civilian health initiatives, largely disconnected from the Ministry of Public Health, are short term, ad hoc, and unsustainable, and to date have lacked a consistent rationale or strategy, and have not been subject to evaluation. U.S. counterinsurgency strategy seeks to mesh development and security objectives through activities that enhance the legitimacy of the Afghan government in the eyes of its people. In the field of health, there are considerable tensions between counterinsurgency and development strategies, which must be addressed to increase the capacity of the government and meet health needs of the people.

- Since the fall of the Taliban in 2001, the Afghan media sector has experienced dramatic growth in all areas: television, radio, print, internet, mobile phones. As such, the sector holds tremendous potential for making significant contributions to peacebuilding in the country. However, the media sector also confronts numerous challenges that impede its ability to realize this potential – which can only be addressed through the combined efforts and attention of international and domestic stakeholders alike. Among the most pressing challenges is resolving the tension between information operations and counterinsurgency, on the one hand, and developing a viable, credible media sector on the other. All too often efforts to counter extremist messages through expanded military and government access to the airwaves (via purchased air time and proliferating “radio in a box” broadcasts from military outposts) have had a negative impact on both media market economics and media credibility. Sustainability is also a significant issue. A glut of media outlets has arisen that are privately licensed yet sustained by international donor funds and strategic communications money. This has had a deleterious effect on the perception of media, and its effectiveness as a guardian of public interests. The shortcomings of state-owned RTA as a public broadcaster further contribute to this, leading many experts to call for greater investment in long-term training and mentoring as well as regulatory reform to limit government manipulation of the airwaves. Other significant areas for improvement: greater emphasis on quality and diversity of programming (including a need for more Pashto language programs), enhanced efforts to provide security for media practitioners, more professional communications training for Afghan government officials, and more extensive research and understanding of Afghan media consumers themselves.

- Afghanistan is an exceptionally fissiparous country, riven by innumerable conflicts over scarce resources and longstanding enmities between neighboring groups. Traditionally, such disputes have been managed by ad hoc groups of elders, known as jirgas or shuras. In the past 30 years, the stature and security of the jirga system and of the elders themselves have been challenged and undermined by all the parties contending for power, including the state itself. In the context of weak state institutions, a reinvigorated system of jirgas could make a valuable contribution to resolving the disputes that currently feed the insurgency and make Afghanistan vulnerable to exploitation by groups that destabilize the country and the region, and threaten the West. To explore what might be done to create an enabling environment for jirga-like bodies, USIP is piloting Dispute Resolution Commissions in insurgency-affected provinces, and, on the basis of this experience, will recommend principles and actions for a larger-scale program of support.

- Globalization of infectious disease transmission has led to international and regional initiatives to improve surveillance and response. The World Health Organization's revised International Health Regulations provide a more robust legal framework for outbreak investigations. New regional networks are strengthening collaborative approaches to prevention of pandemics even in parts of the world where political tensions usually run high. To fulfill the promise of these new mechanisms, the United States should integrate capacity development for disease surveillance into its global health strategy, including providing greater investment in laboratories, training and technical assistance for low-income countries. Effective international cooperation has not extended to creating a system for equitable distribution of vaccines, resulting in vast disparities in availability of vaccines between richer and poorer countries. As a result, political tensions between wealthy and low-income countries have increased. Unless inequity is addressed, global health security will not advance.

With the arrival of hurricane season, the failure to provide adequate shelter and instill hope for a better future threatens stability. Donor pledges of more than $5 billion for assistance have not translated into visible progress, fueling discontent and raising growing concern among Haitians about their government's electiveness. Haiti's government has tried to exert leadership in recovery operations despite the destruction of government buildings, the death of nearly 25 percent of the civil service personnel and the massive dislocations caused by the earthquake. The Haitian government has also begun preparations for presidential and parliamentary elections in November 2010. The combination of faltering recovery at a time of national elections could provoke unrest.

- Iran has the most politically active youth among the 57 nations of the Islamic world. As the most restive segment of their society, Iranian youth also represent one of the greatest longterm threats to the current form of theocratic rule. Young activists have heavily influenced the Islamic Republic's political agenda over the past 13 years. After the 2009 presidential election, youth and women were the two biggest blocs behind the region's first sustained “people power” movement for democratic change, creating a new political model in the Middle East. The Islamic Republic has forcibly regained control over the most rebellious sector of society through mass detentions of young activists, expulsions from universities and widening the powers of its own young paramilitary forces. Nevertheless, the demands from young people have not changed over the past year, and their anger is boiling just beneath the surface. The regime also remains vulnerable because it has failed to address basic socioeconomic problems among youth. The impact of Iran's youth on the political, economic and social agenda of the country over the next 25 years is important for U.S. policymakers to consider when facing complex decisions in balancing Iran's nuclear program and its internal political turmoil.

- Lebanon's outreach to Syria is motivated by significant shifts in the regional political landscape, particularly Syria's renewed regional and global influence. Lebanese Prime Minister Saad Hariri appears to have made a strategic decision that rapprochement with Syria is in Lebanon's best interest, offering the greatest chance for stability and resolution of a number of outstanding bilateral issues including greater guarantees for Lebanese sovereignty. Syria's renewed influence in Lebanon comes in a variety of forms, but its alliance with Hezbollah is the most potent trajectory of its power and influence. It is too early to determine whether this shift in relations marks a return of Syrian predominance in Lebanon, or signals a new page in the bilateral relationship. Much will depend on how Syria and Lebanon as well as external players—especially the U.S. and France—contend with the inherent challenges and opportunities that accompany evolving Syrian-Lebanese ties. The establishment of Lebanese-Syrian diplomatic ties presents the United States with an important opportunity to help foster normal relations between the neighboring countries, particularly the long-sought goal of protecting Lebanese sovereignty. Washington should move forward with dispatching an ambassador to Damascus as part of a broader engagement with Syria. Establishment of high-level diplomatic channels in Syria will allow the United States to leverage its influence more directly and effectively to ensure that Syria moves forward on border demarcation with Lebanon and other measures to help bolster Lebanese sovereignty.

Currently Somalia faces a humanitarian crisis with 3.6 million people displaced. Countering the insurgency and alleviating the humanitarian crisis in Somalia demands a creative rethinking of international policy. While the 2008 Dijbouti Accord created a more inclusive Transitional Federal Government (TFG), the international community must weigh whether continued support for the TFG will bring real progress in governance or if it will strengthen popular support for the insurgency. If the international community sees support for the TFG as beneficial, they could consider policies including: Flooding Somalia with development aid and investing in civil society; Expanding the African Union (AU) peacekeeping mission to include representation from other Muslim countries; Finding creative solutions for inter-Somali governance and reconciliation. If the international community calculates that support for the TFG is not beneficial because it will only fuel the insurgency, they should consider a policy of "constructive disengagement," withdrawing support from the TFG and the AU peacekeeping mission, while simultaneously investing in local and regional development projects.

- Successful attacks on key government buildings underscore worries about whether Iraqis can manage their own security. They mask, however, something new in Iraqi society: an emerging vox populi that found potent expression in provincial elections last January, despite the odds. As national elections approach in March, political leaders are realizing that they ignore this growing voice at their peril. Aware that American attention is shifting towards other problems at home and abroad, Iraqis are nervously contemplating how much U.S. support they can expect going forward in their fragile experiment in democratic governance. The U.S. role in helping Iraqis prepare for national elections has been crucial and largely welcome—it should continue through the transition to a new government. Successful complete withdrawal by 2012 depends on an Iraqi government that is responsive to its people’s basic needs and capable of evolving peacefully via fair elections. Longer term, there are several critical areas on which a distracted and resource stretched America should focus. These include intensifying efforts to help Arabs and Kurds resolve disputes and forestall the need for an extended U.S. military presence in northern Iraq. Helping Iraq protect its borders – a vulnerability highlighted by Iran’s recent incursion—and nudging the Gulf Arab states to more actively engage Iraq as an emerging partner in regional security and economic structures will also be key to stability inside and beyond Iraq’s borders. If water is the “new oil” in terms of its resource value and potential to create conflict, that future is now playing out in Iraq. Shortages and poor quality are already causing serious health and economic problems, displacement and raising tensions with Iraq’s neighbors. The U.S. can help here on both the diplomatic and technical sides of the issue.

- Despite receiving over $15 billion in U.S. aid since 9/11, perceptions of America in Pakistan remain acutely negative. If Pakistanis continue to be opposed to U.S. policies, the Pakistani government will not be able to deliver on its promises, and U.S. initiatives in Pakistan will not produce desired outcomes. American and Pakistani governments have forged a rather opaque relationship which has not helped to cultivate popular support for policies across Pakistan. Instead, it has fostered an anti- U.S. sentiment in Pakistan that increasingly puts pressure on the government in Islamabad. U.S. policy must be fundamentally changed to turn around the anti-American outlook among Pakistanis. In order to do so, the official relationship needs to be more transparent; frequency of visits by U.S. officials ought to be reconsidered; 'image correcting aid' should be provided in addition to the long-term assistance; Pakistani citizens should be engaged through constant dialogue and debate on U.S.-Pakistan relations; and American and Pakistani officials should remain sensitive about the internal impact of their public statements and actions.

Yet, much progress has been made in the field of conflict prevention, both at the normative and the operational levels. As a crucial actor in conflict prevention, the United States should work with others to forge a consistent approach to countries at risk, urge countries to deal with arbitrary borders through negotiation rather than violence, and support greater cooperation between regional organizations.

As the government of Pakistan responds to the suffering of its people and the damage to the environment and infrastructure, it should seek to provide relief and recovery assistance in ways that contribute to ameliorating marginalization. Disaster managers should ensure that urgent humanitarian demands do not miss the opportunity to achieve relief and recovery in ways that contribute to good governance, sustainable development and stable peace.

172. The ICJ's Advisory Opinion on Kosovo

- On July 22, 2010, the International Court of Justice (ICJ) issued its advisory opinion on Kosovo's declaration of independence of February 17, 2008, observing that the declaration was not in violation of international law. The Court's opinion may facilitate further recognitions of Kosovo but thus far there has been no significant increase in the number of countries extending recognition. Although the Court's opinion was drafted with the specific and unique circumstances of the Kosovo case in mind, it has been followed with interest by separatist parties engaged in contested territorial struggles elsewhere around the world. Separatists are likely also to be watching with interest the next steps that may be taken with regard to Kosovo in the wake of the ICJ's advisory opinion, especially any boundary adjustments that may be proposed and agreed upon between the Serbian and Kosovar governments.

173. Cautious Optimism for Peace in Colombia

- The new Colombian administration that took office in early August faces a unique set of peacemaking challenges and opportunities related to the country's internal armed conflict. Following a spate of tensions with neighboring countries regarding the presence of illegal armed groups along Colombia's border areas, newly-inaugurated President Juan Manuel Santos moved quickly to create new mechanisms with his neighbors to ensure that contentious regional issues are addressed before they reach the boiling point. In a surprising video released just before the president-elect was inaugurated, the top leader of the Colombian Revolutionary Armed Forces-People's Army (FARC-EP), called on Santos to enter a dialogue without preconditions, thereby opening a new window of opportunities to pursue peace. President Santos responded that “the door to dialogue is not locked,” insisting however that the guerrillas must lay down their weapons and meet a series of other pre-conditions before talks could occur. Former mediators differ over whether such preconditions will pose an obstacle to talks. In the final days of August, Brazil and Ecuador rejected a FARC-EP request for meeting with the Union of South American Nations (UNASUR) to discuss a political solution to Colombia's conflict. UNASUR leaders said they would not engage in mediating the conflict in the absence of an express invitation from the Colombian government. The Colombian government has rejected UNASUR mediation and underscored its preference to negotiate directly with the FARC-EP once the latter meets the government's preconditions. Concrete good faith efforts—both public and private—will be required from the government and the guerrillas to build confidence, address the legacy of distrust created by decades of violence and set the stage for future talks.

- There are reasons for skepticism about government-insurgent talks, especially as both sides are known for abusive, unjust and discriminatory policies. However, given the constraints of counterinsurgency, obstacles to an anticipated security transition, and the threat of worsening conflict, the potential for negotiations should be explored. Field research indicates that the coalition's military surge is intensifying the conflict, and compounding enmity and mistrust between the parties. It is therefore reducing the prospects of negotiations, which require confidence-building measures that should be incremental, structured and reciprocal. Strategies should be developed to deal with powerful spoilers, on all sides, that may try to disrupt the process. The form of pre-talks, and the effectiveness of mediators and “track two” interlocutors, will be critical. Pakistan provides assistance to, and has significant influence over, the Taliban. Talks require Pakistan's support, but giving its officials excessive influence over the process could trigger opposition within Afghanistan and countermeasures from regional states. The perceived threat from India is driving Pakistan's geostrategic policies, thus concerted efforts are required to improve Pakistan-India relations. Negotiations could lead to a power-sharing agreement, but implementation would be highly challenging, especially due to multifarious factional and other power struggles. An agreement could also involve constitutional or legislative changes that curtail fundamental civil and political rights, especially those of women and girls. Genuine reconciliation efforts are required to build better relations between hostile groups. For legitimacy and viability, any settlement must be both inclusive and just: it should therefore seek to reflect the aspirations of all elements of Afghanistan's diverse society. - Iran has subsidized petroleum products, basic foodstuffs, medical goods and utilities since 1980, first to manage hardships during the eight-year war with Iraq, and then to prevent political and economic challenges after the war. Since the 1990s, three presidents have tried to cut back subsidies that are now estimated to cost Iran between $70 billion and $100 billion annually. President Mahmoud Ahmadinejad won parliamentary approval for a controversial plan to phase out subsides by 2015. Under the plan, universal price controls are to be replaced with small cash payments to families and direct support of industries. Some economists are concerned that lifting price controls will trigger dramatic rises in inflation and unemployment. The cutbacks come at a time the government already faces serious economic troubles and tougher international sanctions. For the public, the change is likely to produce the most economic disruption since the revolution. Economic reforms have triggered unrest in the past. If reform succeeds, however, the program could help reduce waste, shrink state outlays and enhance efficiency and productivity.

- Iran has the most politically active youth among the 57 nations of the Islamic world. As the most restive segment of their society, Iranian youth also represent one of the greatest longterm threats to the current form of theocratic rule. Young activists have heavily influenced the Islamic Republic's political agenda over the past 13 years. After the 2009 presidential election, youth and women were the two biggest blocs behind the region's first sustained “people power” movement for democratic change, creating a new political model in the Middle East. The Islamic Republic has forcibly regained control over the most rebellious sector of society through mass detentions of young activists, expulsions from universities and widening the powers of its own young paramilitary forces. Nevertheless, the demands from young people have not changed over the past year, and their anger is boiling just beneath the surface. The regime also remains vulnerable because it has failed to address basic socioeconomic problems among youth. The impact of Iran's youth on the political, economic and social agenda of the country over the next 25 years is important for U.S. policymakers to consider when facing complex decisions in balancing Iran's nuclear program and its internal political turmoil.

- The need to engage local Afghan leaders and support community decision making has recently been promoted as a key element of both development and counterinsurgency strategies in Afghanistan. The resulting proliferation of community councils—commonly called shuras or jirgas— sponsored by different actors within the Afghan government and international community has decreased the effectiveness of local governance and rule of law in many places. Traditional Afghan dispute resolution and governance bodies are most effective when they are formed by local residents and genuinely reflect the interests of the community. Their legitimacy decreases if international or government sponsors create shuras or jirgas to promote their own interests. This paradox creates a dilemma for programs designed to foster good governance: how to promote community self-rule that reflects traditional values and mechanisms and that develop locally, while adhering to rigid counterinsurgency and development timelines and strategies. These so-called 'traditional' political structures have an important place in local governance in Afghanistan, but the international community should not assume that such bodies fairly represent their respective communities. Rather, sound understanding of local dynamics and in-depth consultation with local government actors and community leaders are necessary to help ensure that such bodies are represented and thus, legitimate within the community. A more coherent, sustainable vision of long-term local governance and coordinated strategies between the Afghan government and international forces is necessary to bring both stability and development to Afghanistan. In particular, this Peace Brief supports the attempts to create a coherent long-term goal of local governance based on legitimate local actors, most likely selected through elections.

- The June 21st Supreme Court decision in Holder v. Humanitarian Law Project affirmed the constitutionality of the material support statue which makes it illegal for U.S. citizens and organizations to provide material support, including expert advice or assistance, service or personnel, to designated terrorist organizations regardless of whether the support is intended to promote nonviolence and peace. The material support law and the process of listing terrorist groups provides the U.S. government with an enhanced legal structure to arrest alleged terrorists and prevent terrorist acts. However, it is unclear that the process is effective in practice or that enhancing the government's legal power to prevent acts of terrorism outweighs the unintentional consequences of prohibiting nongovernmental organizations (NGOs) from working on the front lines of conflict zones to promote conflict resolution. Looking to the future, NGOs can work with the State Department and Congress to find ways to allow peacebuilding and humanitarian organizations to continue their operations legally, while also not threatening national security.

- Defying expectations, successful polio vaccination campaigns have taken place in well over two dozen armed conflicts, and continue today. Polio vaccination campaigns amid war have often succeeded in gaining the cooperation of anti-government forces such as Sendero Luminoso in Peru, multiple rebel groups in the Democratic Republic of Congo, and the Taliban in Afghanistan. Diplomatic means have also been employed to overcome severe political obstacles to such campaigns, even when the campaigns have become a flashpoint in places of political turmoil. Such campaigns face many challenges because vaccinators need to reach all villages without threats to their own lives or the programs' implementation. They require security for safe passage for immunizations and sometimes temporary cease-fires. The many successes of vaccination campaigns can be attributed to the programs' exclusive focus on the immunization needs of children; the use of interlocutors who are credible because they demonstrate neutrality; transparent discussions with opposition groups about the reasons for the campaigns; a role for opposition groups in facilitating the campaigns; limits on the number of days vaccinations take place; and the absence of any strategic or political goals for the effort beyond polio eradication.

- On May 20, 2010, USIP and the International Peace Institute brought together some of Chad's national, regional and international stakeholders to discuss Chad's democratization, the regional security dynamics and the management of the oil sector.Electoral reform, as called for in Chad's 2007 "August 13 Political Agreement," has been poorly implemented, endangering the credibility of the upcoming February legislative elections. Improvements in regional security prompted the Chadian government to request the departure of the United Nations Mission in the Central African Republic and Chad (MINURCAT), which was charged with securing and providing humanitarian relief along the Chad-Central African Republic border. However, many question if Chadian forces can fill the security gap. Oil exports have significantly increased Chad's budget, with most of these gains being invested in the military. The improved regional security provides an opportunity to invest in sectors such as education, health care, and development, which have been neglected.

- On September 18, Afghanistan held its second parliamentary elections since the fall of the Taliban. Like last year's vote, these elections were marked by high levels of violence, low turnout and widespread reports of fraud.Despite the challenges, however, Afghans across the country defied Taliban threats and overcame problems with the electoral administration to signal their support for the democratic process. Participation appeared higher among the youth demographic, which is a promising sign for the future of democratic processes in Afghanistan. It is still too early to tell whether the quality of the elections was better than the flawed 2009 process, but the Independent Election Commission (IEC) has improved its procedures and transparency both before and after the elections, and has so far helped to restore the credibility of the institution as a neutral administrator of the electoral process. Meanwhile, the Electoral Complaints Commission (ECC) is again under-resourced, has had little time to establish and train the Provincial Electoral Complaints Commissions (PECCs) that will be adjudicating the 4,200 election day complaints, and has yet to make public its decisions regarding the campaign or polling complaints.The ultimate success of the 2010 elections depends less on the level of fraud that was committed on election day-which was bound to be high-and more on the way in which the fraud is handled by the IEC and ECC. If they are transparent and honest about the problems, and take responsible corrective action, then the elections can be considered a partial success despite its flaws.

- The announcement that 429,000 fraudulent or possibly foreign names were on the voters registry halted the preparations for already delayed 2009 presidential election and revived the divisive discussion of citizenship and identity in Côte d'Ivoire (Ivoirité) The stalled electoral process highlighted unresolved issues such as the failed demobilization and disarmament processes and the marginalization of civil society from the implementation of the 2007 Ouagadougou Peace Agreement. In April 2010, the U.S. Institute of Peace, the Community of Sant'Egidio and George Mason University's Institute for Conflict Analysis and Resolution brought key leaders of Ivorian civil society and the religious community to Washington, D.C. to develop an approach for resolving the present political impasse and to actively participate in the peace process. The April meeting resulted in the Washington Appeal, which urges Ivoirians to tolerate ethnic and political diversity, reduce the tensions around elections, identify longstanding grievances, and expand the role of civil society in the peace process.

- In Afghanistan and Pakistan, humanitarian space has shrunk as the Taliban and other insurgent groups have stepped up attacks on civilians, especially international aid workers, contractors and local leaders. Health programs continue to operate, but the ability of nongovernmental organizations (NGOs) to recruit and retain staff and to travel outside Kabul has suffered. The United Nations, International Committee of the Red Cross (ICRC), and other groups have sought to persuade the Taliban and other armed groups not to impede or interfere with humanitarian aid activities. These efforts have had some success where the aid is administered by Afghans, but they have not limited attacks on international staff, who along with all foreigners, remain at high risk of attack. Many NGOs act as implementing partners in the government's strategy to implement a comprehensive primary care system in Afghanistan under the direction of the Ministry of Public Health. They have managed to maintain those services with local staff despite their association with the government of Afghanistan, so long as they operate with impartiality and community engagement. The vulnerability of their staff to attack appears to be a product of generalized insecurity or the presence of foreign aid workers, rather than a result of collaboration with the Ministry.NGOs report that military activities in Afghanistan and Pakistan, and military involvement in the medical sector, have contributed to the shrinkage of humanitarian space. The military's provision of health services through Provincial Reconstruction Teams and other mechanisms, though well-intended, sometimes sows confusion about the allegiances of U.S. and other Western aid workers and creates tensions with humanitarian principles the agencies rely on to operate in conflict environments. The conduct of the Afghanistan National Army and Police and the Pakistan military in entering facilities to gain access to arrest insurgents or gather information also leads to greater insecurity for NGO personnel.

- Crime and violence are on the rise in Port-au-Prince due to prisoner escapes during the earth quake. Youth gangs and other armed groups are regaining strength in the most vulnerable neighborhoods and spreading to other areas of the city. In the tent camps around Port-au- Prince, displaced people—especially women—remain vulnerable to crime. These factors have contributed to an increasing sense of insecurity. As political tensions rise in the run-up to elections, armed groups, criminal enterprises and vulnerable youth could once again be mobilized by political forces to fuel violence or disrupt the political process. Gangs and their involvement in criminal and political violence are deeply rooted in Haitian politics, and fueled by widespread poverty, inadequate police presence, government weak ness, and social and economic inequities. Prior to the earthquake, criminal violence had begun to decline due to a combination of political reconciliation, law enforcement operations and investment in marginalized neighborhoods. These fragile gains have been reversed since the earthquake and public confidence in the police has been shaken. Directing resources toward mitigating violence while addressing the underlying sources of crime and violence should remain a priority in post-earthquake reconstruction.

- There is increasing recognition that the violence, displacement, disruption of communities and social networks, and deprivation stemming from war deeply impact the mental health of individuals and the social cohesion of communities. In response, donors and providers are creating programs for psychosocial or clinical services that seek to be culturally appropriate, attentive to the need to build local capacity, and sustainable. The quality and comprehensiveness of mental health programs offered in crises, however, generally remains mixed. Too often the programs do not sufficiently differentiate among widely varying individual needs or focus predominantly on either community-based interventions or the clinical needs of more severely affected people but not both. Services for people with more severe disabilities often replicate institutional models, and accompanying human rights violations, that existed in the pre-war period. The challenge of providing sound programs, moreover, is complicated by a relatively thin evidence base. In the face of these challenges, the “Guidelines on Mental Health and Psychosocial Support in Emergency Settings” adopted in 2007 by the Interagency Standing Committee (IASC) offer a promising approach. They stress understanding local context, programming that attends to psychosocial support needs of the entire community, meeting clinical needs of people with more severe conditions, and respecting human rights. Following the IASC and building the evidence base by assuring adequate evaluation of funded programs can help meet the tremendous mental health needs of suffering populations.

- Post-conflict governance requires simultaneous and complementary action on three levels. national governance, local governance, and civil society. Norbert Mao, a parliamentary leader from Uganda, offered this progression for managing the trade-off between short-term stabilization and long-term capacity building: "In the emergency phase, you should do it for us. In the reconstruction phase, you should do it with us. And in the development phase, you should do it through us." Efforts to develop the capacity of local governments to deliver services may be more responsive to external assistance than programs aimed at overcoming systemic dysfunctions in the central government, in part because municipal officials are more accountable to their communities. Civil society should be a prominent player in transitioning to “local ownership,” which may erroneously be conceived in terms of ownership by national and perhaps local governments. Building the capacity of civil society entails connectivity with international partners and ideas, not just financing. There are trade-offs involved among the three stakeholders. Among the most salient, when a legacy of abuse of power by the national government and repression of opposition groups must be confronted, an active civil society is essential. An invigorated civil society can fundamentally challenge illicit structures of power that profited from conflict.

The agreement is the most viable framework for bringing peace to Chad. To date, the agreement has been poorly implemented. It jeopardizes the credibility of the upcoming legislative elections, currently scheduled for February 2011. With the forthcoming surge of U.S. military forces into Afghanistan, the U.S. Army has announced contracts worth $1.1 billion for the construction of military bases and training centers for Afghan military and police. Private firms supply everything from construction materials to trainers and administrative staff. Private contractors operating in Pakistan and Afghanistan are required to provide their own security. Up to 15 percent of the cost of construction will go to private security firms, which guard convoys, facilities and personnel.

- Sudan's upcoming elections in 2009 raise hopes and concerns for the country's future. According to the Comprehensive Peace Agreement (CPA), signed in 2005 between the ruling National Congress Party (NCP) and the Sudan People's Liberation Movement (SPLM), Sudan is scheduled to hold national and state level elections in 2009. (Elections are to take place for president of the Government of National Unity, president of the Government of Southern Sudan, members of the National Assembly and the South Sudan Legislative Assembly, and governors and state legislatures in all of Sudan's 25 states) However, delays in each phase of electoral preparation—including the passage of the electoral law, the appointment of the nine National Election Commission members responsible for overseeing elections, and the census—have raised doubts about whether the elections will be held within the timeframe outlined in the CPA.

- Last week's international donor conference to address the question of humanitarian assistance to Gaza underscores the myriad challenges confronting the process. Namely, how should the international community respond to the complex issues surrounding assistance in post-conflict recovery and reconstruction, particularly when several key donors reject any contact with Hamas, the governing authority on the ground? By any estimation, the Gaza reconstruction process will face several perplexing issues: How can billions of US dollars be effectively, transparently and accountably dispersed in a coordinated way, when several key donors and the Government of Israel reject any moves that will bolster the fortunes of Hamas, who m they classify as a terrorist organisation? What impact will an emerging Palestinian National Unity Government have on the mechanisms for overcoming many donors' reluctance to deal directly with Hamas? What opportunities and challenges does the reconstruction of Gaza pose for a rapprochement between Hamas and Fatah? Who will lead the reconstruction process and how will meaningful activity take place in the face of severe restrictions on access and movement? With Hamas in power in Gaza and Israel ref using to consider opening their common borders until kidnapped Israeli Defence Forces Corporal Gilad Shalit is released by Hamas, how is meaningful recovery and reconstruction even possible? In the absence of a credible political process, what use is reconstruction anyway if it merely returns the population of Gaza to their pre-conflict socio-economic imperilment? Lebanon faced a similar situation following the 2006 war between Hezbollah and Israel.

- The current political crisis over elections in Afghanistan stems, in part, from a fundamental gap in Afghanistan's legal and political system: lack of agreement on what entity(s) has the power to resolve constitutional disputes, and how that power is accessed. Without a clear path to settling constitutional disagreements, the system becomes deadlocked as disputes arise, exacerbating tensions between Afghanistan's fragile institutions and factionalized political elite.
