- What lessons have you personally drawn from the decade of war in Iraq and Afghanistan? Blair: The decade of war is really two decades of war–from the time the Cold War ended in about 1989 through the disappearance of the Soviet threat and the involvement of the United States in a series of individual military actions. What I've learned is that we need to do a better job thinking these conflicts all the way through before we engage in them. Because it turns out that we are relearning an old lesson, which is the use of military force is only a part of improving a situation and protecting American interests in a particular country or region. Too often, we think that a military victory itself will cause the desired result. In fact many other factors come in to play; economic development, social development, government improvement. These are not accomplished by the U.S. alone, and certainly not by American military force alone, but often with allies and other partners, and with other civilian capabilities. I think we have not thought them through carefully as to the end state that we are trying to achieve. Next we need to be realistic about the resources that are required; military, civil, and other. I'm afraid these are old lessons that need to be relearned, not new lessons, but they certainly have been borne out as some of the shortcomings of the interventions we have made in recent years. I would add, by the way, that I am not one who says our military interventions since 1989 have all been disasters. I think on the whole they have made the world a better place; bad people who were around then aren't around now, from Manuel Noriega to Saddam Hussein through Slobodan Milosevic and others; so it is not that our military interventions have been wasted. On the contrary–but we need to make sure that we get the maximum possible benefit from them and intervene in a smart way.

- Fred Kaplan's The Insurgents is a highly successful and compelling intermingling of three stories: the rise and eventual fall of General David Petraeus; the intellectual history of counterinsurgency; and the broadening of the learning culture within the United States Military during the Iraq war. Indeed, the heroes of the book are the “insurgents” within the U.S. Army who all but overthrew the dominant paradigm of kinetic warfare in favor of ideas derived from England and France during the end of the colonial era.1 Kaplan's book picks up on the story told by Tom Ricks in The Gamble2 about how this intellectual insurgency transformed the way the U.S. fought the war in Iraq, preferring the counterinsurgency (COIN) approach to protecting civilians from insurgents and lowering their casualty rate, and building alliances in order to reduce the number of insurgents. For Kaplan this is nothing short of a profound alteration of the American way of war, one that caused enormous consternation amongst certain sectors of the military who were wedded to a more conventional approach to war.

- Abstract:
- This article seeks to dissect, with reference to Bhutan’s polity, how the Eurocentric, popular wisdom of democracy, privileging liberal democracy, inadvertently enforces closure to other plausible, non-liberalistic interpretations. In Bhutan, the monarchy and Buddhism carry moral authorities constraining the arbitrary use of governmental power, and nurturing associative bonds in society. This “natural democracy” contravenes the orthodoxy of liberal democracy, according to which the state, as a neutral arbiter, must not accord a special status to any leader or religion. For this reason, political analysts tend to doubt whether Bhutan is a democracy. The circumscribed, liberal-democratic notion emanates from the history in which European universalism has been fabricated as a universal standard to be disseminated throughout the globe. It has thus served to rank different societies in a linear trajectory that positions Europe at the pinnacle of “progress”. The case of Bhutan potentially helps to rectify the constricted wisdom of democracy, to facilitate more open, thorough deliberations, and to start conceptualizing a multipolar world.

- This paper seeks to make an alternative translation/ interpretation of Bhutan’s democracy, in place of the mainstream view that the country has recently made a decisive transition toward democracy. It calls our attention to the country’s time-honored ‘natural democracy,’ which rests on monarchical authority and cohesive rural communities. Both of them represent vernacular forms of freedom and equality, contrary to their widely held image as being averse to democracy. This research was made possible by funding from the Japanese Government's Grants-in-Aid for Scientific Research.

- Turkish foreign policy toward the Middle East has confronted with more and novel security challenges in 2012. The problematic issues related to Arab revolutions of 2011 have already had negative repercussions for Ankara. As a result of diverging policy choices toward the Arab revolutions, these conflicting issues caused more strained relations between Turkey and its neighbors in the region. Regional actors divided over how to respond to political deadlocks in the Middle East. While Turkey, Egypt and Saudi Arabia have sided together, Iran, Syria and the central government of Iraq have made their policies jointly. This very division between the regional actors has increased the security risks within the Middle East. These two camps have particularly conflicting policy agendas and as a result, they have become part of a “proxy war” in Syria which constitutes the biggest security threat to the whole region. Despite the deteriorating situation in Syria and its own tense political environment domestically, Turkey, has continued to strengthen its economic relations with the Middle Eastern capitals except Damascus. It was partly a result of this policy that Turkey's export toward the Middle East increased significantly.

- Termination of the US military presence in Iraq at the end of 2011, bring some problems for Iraq on military, domestic politics and economic area. Just a few months later US military withdrawal, escalating political tension began to delimitate coalition government built on a fragile structure and at the same time has led to emergence of some struggles with in the country. Discourses or expectations of many Iraqi leaders that Iraq will be saved from the problems which he faced and even new independent era will start with the year of 2012 have been turned upside down because of violence and political instability occurring at the beginning of this new independent era. Bombings, political and military strife between ethnic groups, struggle between national government and the Iraqi Kurdish Regional Government (KRG) and particularly worsening of Iraq-Turkey relations forced Baghdad government to waste large part of its energy on these issues. In addition to this, natural resources having strategic importance for economic developments and Iraq's future stand out as a shaping factor of Iraq's foreign and domestic politics.

- The prevailing outlook among analysts before the advent of the recent social movements in North Africa and a number of Arab Middle Eastern countries indicated that the region will continue to resist the wave of democratization. The fall of several authoritarian regimes and continuity of social movements has generated serious doubts in this outlook, leading to the appearance of promising horizons for democratization. This paper argues that these social movements originate from the exacerbating legitimacy crisis of authoritarian governments and rising political, social and economic dissatisfaction of the general public, including the youth and the modern middle class. This work seeks to answer the question: what are the major sociological origins and precipitating factors influencing the advent of social movements in the Middle East and North Africa? In response, it can be argued that the advent of social movements in a number of Middle East and North African countries is rooted in the legitimacy crisis, as well as rising political, social and economic dissatisfaction of the general public, the youth and the modern middle class in recent decades. The web-based social networks and cell phones acted as precipitating factors in the massive mobilization and integration of mass protests and those of the modern middle class and the fall of a number of authoritarian regimes. These movements are notably characterized by being comprehensive, Islamic, democratic, anti-despotic, independence-seeking, and highly reliant on new information and communications technologies. The web-based social networks served as a precipitating factor in massive mobilization of the aforementioned strata within the context of an exacerbated legitimacy crisis and the gap between the state and the society rather than as a structural deep-rooted factor.

- Continual professional development for judicial officers through judicial education programmes has become a common feature in many countries throughout the world. The growing need for these kinds of programmes, specifically in transitioning democracies, is relatively well-documented. One core component of this kind of training deals with social context-related issues. Research has shown that even in societies where equality is enshrined in the constitution or mandated through legislation, unequal treatment before the law persists, hence the motivation for social context training for members of the judiciary. There is limited information in the public domain about these kinds of judicial training programmes and their effectiveness or efficiencies. This article presents a best practice model for designing, implementing and evaluating social context training for judicial officers. The aim is to provide a useful framework for programme designers for the development of future programmes of this kind.

- What happens when an ideological movement whose raison d'être is to challenge the existing political system and government structure, and one that gains its identity and character from criticizing power, takes control of the government? Turkey no longer has a noteworthy Islamist project. We must place this vanishing, or death, at the end of the story, a story that begins with its birth. When Muslims are able to express themselves through democratic means, they move away not only from violence, but also from an ideological Islamic interpretation. The death of Islamism in Turkey can therefore be explained by the wide-open channels of democracy. In such a free and democratic setting, there is no environment for Islamism to survive, especially when it is fit into a different mold through the support of the government.

- Women have been both the subjects and objects of Turkish modernization for a long time. They have always been at the forefront of burning questions in Turkey, either with the decades-old debate of wearing headscarves in public institutions, or, lately, with Erdoğan's agenda-setting remarks that women need to give birth to at least three children or abortion will be constrained. However, studies about their position in society or their role in modernization have not gone far beyond superficial repetition. Dedeoglu and Elveren, to a large extent, fill this academic gap in Turkey through editing this book. It consists of thirteen valuable chapters dealing with different aspects of gender issues that are at the junction of tradition and modernity. To this end, the book mainly aims at understanding the impact of neoliberal social policies, political Islam, and EU accession on gender in Turkey. Women stuck between formal equality on paper and social realities in practice are examined using different data sets and topics, from female labor ratios to payment policies, and from social security reform to the individual pension system. For all the diversity of topics, the authors' comprehensive analysis about the reasons for the secondary position of women in society and the possible outcomes of eager but not-yet mature governmental reforms makes this study a reference book not only for readers who want to learn more about gender, society and the neoliberal economy in Turkey, but also for decision makers who want to be aware of the margins of socio-economic dynamics in Turkey.

314. Bridging the Participation Gap with Government-sponsored Neighborhood Development Programs: Can Civic Skills Be Taught?

- I argue that innovative development programs that require citizen participation in the production of public goods can have unexpected benefits for individuals' dispositions toward democracy. In particular, I explore the effect of taking part in state-sponsored neighborhood development programs – direct-democracy type programs that require individuals to organize within their community as a precondition for state help – on participant dispositions toward democracy and willingness to take part in politics. To test this hypothesis, I use original survey data collected in the Mexican state of Baja California. To measure the effect of participation in neighborhood development programs, I conduct a quasi experiment via propensity score matching. I find robust evidence suggesting that participating in such programs correlates with higher levels of political participation, a better sense of community, more positive retrospective evaluations of the economy (according to both pocketbook and sociotropic measures), and overall higher support for the government.

- Mitt Romney and Paul Ryan have labeled themselves “America's Comeback Team”—a political tagline that would be great were it grounded in a philosophical base that gave it objective, moral meaning. What, politically speaking, does America need to “come back” to? And what, culturally speaking, is necessary for the country to support that goal? America was founded on the principle of individual rights—the idea that each individual is an end in himself and has a moral prerogative to live his own life (the right to life); to act on his own judgment, un-coerced by others, including government (liberty); to keep and use the product of his effort (property); and to pursue the values and goals of his choosing (pursuit of happiness). Today, however, legal, regulatory, or bureaucratic obstacles involved in any effort to start or operate a business, to purchase health insurance, to plan for one's retirement, to educate one's children, to criticize Islam for advocating violence, or so much as to choose a lightbulb indicate how far we've strayed from that founding ideal. If America is to make a comeback—and if what we are to come back to is recognition and protection of individual rights—then Americans must embrace more than a political tagline; we must embrace a philosophy that undergirds individual rights and that gives rise to a government that does one and only one thing: protects rights. Although the philosophy of the Founding Fathers was sufficient ground on which to establish the Land of Liberty, it was not sufficient to maintain liberty. The founders advocated the principle of individual rights, but they did not fully understand the moral and philosophical foundations of that principle; they did not understand how rights are grounded in observable fact. Nor did the thinkers who followed them. This is why respect for rights has been eroding for more than a century. If America is to “come back” to the recognition and protection of rights, Americans must discover and embrace the philosophical scaffolding that undergirds that ideal, the scaffolding that grounds the principle of rights in perceptual fact and gives rise to the principle that the only proper purpose of government is to protect rights by banning force from social relationships. The philosophy that provides this scaffolding is Ayn Rand's philosophy of Objectivism. To see why, let us look at Rand's philosophy in contrast to the predominant philosophies of the day: religion, the basic philosophy of conservatism; and subjectivism, the basic philosophy of modern “liberalism.” We'll consider the essential views of each of these philosophies with respect to the nature of reality, man's means of knowledge, the nature of morality, the nature of rights, and the proper purpose of government. At each stage, we'll highlight ways in which their respective positions support or undermine the ideal of liberty. As a brief essay, this is, of course, not a comprehensive treatment of these philosophies; rather, it is an indication of the essentials of each, showing how Objectivism stands in contrast to religion and subjectivism and why it alone supports a culture of freedom. Objectivism stands in sharp contrast to religion and subjectivism from the outset because, whereas religion holds that there are two realities (nature and supernature), and whereas subjectivism holds that there is no reality (only personal opinion and social convention), Objectivism holds that there is one reality (this one before our eyes). Let's flesh out these differences and their significance with respect to liberty. . . .

- This article will examine the changing roles of Central American gangs within the drug trafficking structures, particularly the Mexican drug trafficking organizations (DTOs), operating in the region. This will include the emerging political role of the gangs (Mara Salvatrucha or MS-13 as well as Barrio 18), the negotiations between the gangs and Mexican DTOs for joint operational capacity, the interactions between the two sides, and the significant repercussions all this will likely have across the region as the gangs become both better financed and more politically aware and active. This article is based on field research in San Salvador, where the author was able to spend time with some members of the MS-13. It is also informed by his examination of the truce between the gangs and the Salvadoran government, as well as the talks between the gangs and the Sinaloa cartel.

- The border as a unit of analysis becomes a key player when addressing issues of transnational scale. Throughout history, the shape and meaning of borders have evolved as dynamic configurations responding to a wide range of political, economic, and social affairs. In an effort to understand transnational organized crime (TOC) from a geographical lens, historian Rachel St. John and anthropologist Natalia Mendoza reflect on the changing condition of the U.S.-Mexico border and its spillover effect on peripheral communities. St. John has analyzed the history of the borderlands in her book Line in the Sand, where she explains how the capability of the border to attract people to it creates “a form of negotiated sovereignty” subject to “practical difficulties, transnational forces, local communities and the actions of their counterparts across the line.”[i] Mendoza's ethnographical approach to her field work in the village of Altar in Sonora, Mexico, produced a collection of local narratives on how a community around the border has developed creative ways, both legal and extralegal, to confront the boundary line at a time when governments extend and reinforce the space of state surveillance. The following is a conversation between these two scholars regarding organized crime at the U.S.-Mexico border that can provide a better understanding of a wider conditionality of the boundary line.

- The first democratically elected Prime Minister of Serbia, Dr. Zoran Djindjic, was assassinated in 2003 by an organized crime group closely connected to Serbian state institutions. The group had amassed enormous wealth through transnational drug trafficking. The political sponsors of Djindjic's assassination are still protected in Serbia today due to the high level of systemic corruption and a lack of political will to prosecute those responsible for this heinous crime. Since their protection impedes justice and, thus, obstructs the rule of law and democratic progress in Serbia, contemporary Serbian society could be seen as the hostage of transnational organized crime and corrupted state officials.

- Over the last two decades, the global shadow economy has flourished: according to the UN Office on Drugs and Crime (UNODC), illegal trade—in guns, drugs, timber, elephant ivory, human beings, and virtually anything for the right price—generates an annual turnover of some $870 billion, the equivalent of nearly 7 percent of the world's legitimate exports of merchandise. A recent UNODC publication reports that “states and international organizations have largely failed to anticipate the evolution of transnational organized crime.” The entire industry, it would seem, grew up hidden in plain sight, as if garbed in camouflage from its infancy. What countermeasures have been taken—mostly in the form of conventional law enforcement—“have done little” to stem its growth or minimize its impact. Few scholars are less surprised by these grim facts than Dr. Robert Mandel, professor of international affairs at Lewis Clark College and author of Dark Logic: Transnational Criminal Tactics and Global Security. Mandel has been mulling over transnational organized crime for well over a decade, and his latest meditation on the subject can be read as a sequel to an earlier work: Deadly Transfers and The Global Playground: Transnational Security Threats in a Disorderly World (1999).

- News breaks that a developing nation\'s budget seems to contain statistical anomalies, with large funds reported missing or unaccounted for. The government\'s official position is inconsistent, and high-ranking officials are suspected of corruption. The international community takes notice but lacks the mechanisms required for corrective justice. The country and its people limp towards progress. Even if this is a story all too familiar in the back pages of the Wall Street Journal it is still a phenomenon that has received too little academic attention. Draining Development? seeks to fill this void by representing a significant collection of analytic papers on illicit financial flows. Commissioned by the World Bank at the request of the Norwegian government and edited by Peter Reuter, the book compiles new empirical and conceptual insights on the composition of illicit monetary flows, the processes that generate them, the sustaining and facilitating role played by tax havens, and the effectiveness of attempts made at prevention and recovery. Substantively, papers in the book cover government corruption, tax evasion and havens, cross border profit sharing, money laundering, human trafficking, transfer price manipulation, and antimoney laundering regulatory schemes. While books that rely on academic compilations can often feel disjointed, here the editor does a tremendous job of presenting the material in ways that allow consistent themes to develop in the reader\'s mind. Taken in its totality, Draining Development? echoes a consistent, persuasive argument: the phenomenon of illicit capital flows is impeding developing and transitional nations and, consequently, the welfare of their people. Furthermore, the international community has yet to successfully deploy the organization and interlocking tools necessary to fully combat the causes and effects of such illicit flows. But which area poses a greater problem, the flows themselves or the social and political structures that created them? Which areas should laws and policies primarily target? The editor suggests a research path to clarify these complex questions. In doing so, Draining Development? serves as the cornerstone of much needed attention and discourse on this subject.

- In Gridlock, Pardis Mahdavi explores the social issues of labor migration in Dubai-a topic less visible than those that make up the daily headlines on the Middle East. The book is a mix of Mahdavi's personal experiences in the Emirate and a scholarly discourse on trafficking policy and its associated political pressures. Peppered throughout with the stories of labor migrants from a variety of backgrounds and working in a diversity of sectors, the book aims for both breadth and academic depth. The former goal works ultimately to the detriment of the latter, as Mahdavi retreads the same ground several times. Nevertheless, the book serves as an important look at a key international issue from a perspective that policy makers may be ignoring. Current U.S. policy regarding the issue of trafficking centers on the State Department's Trafficking in Persons (TIP) Report-the government's "principal diplomatic tool to engage foreign governments on human trafficking." Mahdavi's central thesis relates to her opinions on the use of this report which, at the time of her writing, was primarily used as a diplomatic tool for leveraging political bargaining power against countries such as Dubai with a "known" record of poor human rights. She believes that the TIP report holds a great deal of potential to expand beyond a bargaining tool and can instead be used for enacting true reform in trafficking and migration policy. For this to come about, however, Mahdavi believes that governments need a broader understanding of trafficking beyond their current focus on female sex workers. The accounts of labor migrants in her book serve as a survey of other types of trafficked persons. Though Gridlock's organization may feel more like a collection of essays than a singular, focused work, Mahdavi explores this complex, multifaceted issue from a unique perspective. The breadth of her research appears broader than the views of most policy makers involved in this issue and presents a compelling case for policy reform, with direct social consequences for a multitude of labor migrants from around the globe.

- Informality and Illegality in the Exploitation of Gold and Timber in Antioquia Jorge Giraldo Ramírez and Juan Carlos Muñoz Mora (Medellín: Centro de Análisis Político Universidad Eafit and Proantioquia, 2012), 197 pages. In Informality and Illegality authors Jorge Giraldo Ramírez and Carlos Muñoz Mora, both professors in Antioquia, Colombia, analyze how the gold and timber sectors have become a source of financing for armed groups. Rather than simply rehashing the old resource-curse debate, this slim, but dense, Spanish-language book performs a microlevel analysis of Antioquia's extractive supply chains and impressively identifies the precise mechanisms that incentivize illegal armed actors to enter the market. According to the authors, the confluence of informal extractive markets with high levels of socio-economic inequality and the absence of a well-functioning state incentivizes nonstate actors to assume the state's role and engage in criminal activity. This "criminal ecology" is a self-perpetuating system that is characterized by ineffective state intervention, weak regulation and penalization, and high levels of political and economic leverage by nonstate actors. Ramírez and Mora's findings are impressive, even if their data seems suspect: they find positive correlations between gold mining and the presence of illegal armed groups, informal land tenure, increased violence, and weak institutions. The authors' concluding discussion of contemporary policy recommendations, currently being debated in a variety of forums, including the country's mining code reform and ongoing institutional restructuring process- though appropriate-is too theoretical to be of much use. Moreover, given the dominant role multinational corporations (MNCs) play in Colombia's legal, security, and political spheres, their limited analysis of the relationship of MNCs with Antioquia's supply chain ignores a large part of the policy debate. Though repetitive and dry, Ramirez and Mora's work is a unique take on a polarizing debate. Their framework of the complex relationship between a traditionally informal economy, illegal crime, and the international demand for a scarce resource (gold), while specific to Antioquia, is widely applicable to any number of countries and contexts.

- In recent years, Brazil has been highly revered for its response to HIV/AIDS. Despite the government's delayed response, why and how did the national AIDS program eventually become so successful? This is even further puzzling when one considers the challenges associated with Brazil's decentralized response to healthcare needs, lack of subnational resources and political will to effectively implement AIDS policy. This article maintains that Brazil's successful response eventually required the strategic centralization of national AIDS bureaucratic and policy authority, entailing policies designed to aid local governments while creating fiscal policies incentivizing sub-national compliance with the national bureaucracy and more effective policy implementation. Taking advantage of renewed political support, kindled by international pressures and the president's reputation building pursuits, the sources of AIDS officials' success, however, resided not in their technical and financial prowess, but in their ability to forge historically- based partnerships with civic AIDS NGOs and social movements sharing like-minded ideational beliefs in policy centralization. This article also discusses how these findings contribute new insights into theories addressing the reasons for centralization, as well as the ideational sources of gradual institutional change.

- 2011 brought an opportunity for Israel and Turkey to mend their bilateral relations. The re-election of Erdoğan in June 2011, coupled with the dramatic events of the Arab Spring, provided a new political and regional context in which the relations could be reevaluated. This context enabled Turkey and Israel, with US mediation, to make progress towards drafting an agreement between them – an agreement intended to enable the two countries to restore normal working relations following the 2010 flotilla incident. However, the draft agreement was eventually rejected by the Israeli government in August 2011, leading to a new cycle of escalating tensions between the two countries. This article analyzes the Israeli decision-making process and discourse regarding the crisis with Turkey, and examines the changing circumstances of 2011, including the impact of the Arab Spring and the contrasting Israeli and Turkish reactions to it; the dynamics leading to the Israeli decision to reject the draft agreement; and the possible next phases in Israel-Turkey relations, including the conditions that can provide a new opportunity for the two former allies to become less alienated.

- Land reform in Ukraine lasts for over 20 years now – slow, contradictory, with numerous violations of interests and rights of rural workers and existing laws. During 1990’s - early 2000’s, most of the villagers became the owners of land parcels, but were left with no means for land cultivation and no funds for their purchase (in particular, due to the loss of savings and galloping inflation in the early 1990’s, as well as due to a time-gap between distribution of former collective lands and the actual distribution of collective farms property among the new landowners). As a result, the villagers – sometimes not voluntarily and not always to the tenant of their choice – were forced to lease out their lands. According to the Razumkov Centre’s survey results, as of February 2012, about 52% of landowners leased out their land parcels, and only 7% of them were fully satisfied with leasing terms, another 7% – did not really know who they lease out their land to, 36% – were unaware how much their tenants should be paying them. At the same time, private ownership rights to land of rural workers are not absolute, since the disposal of land is restricted to inheritance and/or sale for public or community needs. As a result, no one is entitled to buy an agricultural land. This situation has emerged as a result of the moratorium on sale and purchase of agricultural land, introduced in 1992. It remains in power for over 20 years now. During this time, the issue of agricultural land market – one of the most controversial and politicized issues in Ukraine – has been widely discussed. However, even today, it seems there is no actual or expected consensus on the issue either in the society or among political forces.

International institutions reduce transaction costs and uncertainty for governments in their future interactions within a specific issue-area. In the last decade, there have been exponential increases in how much direct investment is flowing from China, particularly into the resource sector. As the eurozone crisis has deepened since 2008, there has been continuing talk by political and business leaders of investment in Europe being a key target for Chinese companies. And yet, the amounts invested so far come to less than 5 percent of China's global overseas foreign direct investment (FDI) total. In the crucial determinants of Chinese FDI, the EU ranks low. There is therefore a good structural reason why, despite the ambitious talk of the Chinese coming to invest more in vital sectors in the EU, this is not happening at the moment and is not likely to happen until China develops into a middle income, more developed economy.

- TEL AVIV–“Better the devil you know than the one you don't.” It's a 500-year old Irish proverb, but to Mideast policy wonks the phrase is instantly identifiable as Israel's decades-long policy toward its nettlesome neighbor Syria. Nearly four decades have passed since the Yom Kippur War, the last conventional conflict between the two states. During that time, Syrian Presidents Hafez and later Bashar Assad kept their frontier with Israel largely quiet, continuing the fight against it via their proxies Hezbollah in Lebanon and Hamas in the Palestinian territories. In Israel's never-ending search for regional stability—and amid uncertainty over who might replace the Assads—that arrangement seemed good enough. When in 2005 President George W. Bush asked Ariel Sharon his thoughts about toppling Assad, the Israeli premier responded with a question of his own: “Are you crazy?” Likewise, when Syrians first rose up against their regime last spring, Israeli officials remained cagey. Asked last March for comment, Prime Minister Benjamin Netanyahu replied laconically, “Any answer I'll give you wouldn't be a good one.” Shlomo Brom, a former head of IDF strategic planning and an Israeli negotiator with Syria in the 1990s, described Bashar Assad as a “known quantity,” while veteran diplomat Dore Gold urged caution given the volatility caused by anti-government dissent spreading “from the Turkish border down to the Suez Canal.”

- In a remarkable turnaround, Turkey and the Kurdish Regional Government have recently emerged as close partners in a region increasingly characterized by uncertainty. - Following the US invasion of Iraq in 2003, Kurdish politicians were involved in Baghdad governments, and the Kurdistan Regional Government (KRG) became a federal unit with increased autonomy. Nevertheless, the KRG's quest for keeping its autonomy was challenged after the withdrawal of US forces at the end of 2011. When US forces left Iraq, the Baghdad government, headed by Prime Minister Nouri Al-Maliki, the leader of the Shiite State of Law Coalition, tried to centralize power. Unsurprisingly, Maliki's centralization efforts have generated criticism and secessionist repercussions among Kurdish political circles. Furthermore, the Maliki government has violated the basic principles of power sharing, which is sine qua non to strengthen the confidence building processes in divided societies. Two decades on, the region has become more assertive and been making many new friends, largely because of its newfound wealth, its influence in post-Saddam Iraq, and its stability when compared with the rest of Iraq. Oil has been a curse for the Kurds and Iraq as a whole, but now the Kurds appear to have found a way to use its resources for economic development, ensuring that the Kurdistan region remains stable and can establish itself as a self-governing and influential entity.

- This article revisits the key conceptual aspects of the New Monetary Economics (NME) by examining the idea of “monetary separation” and objections raised against it. So long as a dominant role for base money in exchange exists, using it to provide the unit of account remains advantageous and is likely to outweigh any mooted benefits of separation. Recent quantitative analysis, however, shows the transaction demand for government base money to be falling, a development that can be expected to continue in the years ahead. The passage of time thus seems to be weakening the principal basis on which monetary separation has been criticized—namely, the superiority of base money in payments. That development fits into the history of money told by Austrian economists, which emphasises payment practices evolving over time in response to technological improvements and market forces.

- The determinants of government budget deficits have been studied extensively, especially during the years in which the discrepancy between federal income taxes and expenditures has widened. In that respect, it is of interest to explore the causal relationship between government revenues and expenditures. If the direction of causation is from taxes to spending, then enjoying tax cuts without cutting expenditures necessitates starving the beast, as suggested by Milton Friedman (1978) and confirmed by a number of studies including Garcia and Henin (1999), and Chang, Liu, and Caudill (2002). On the other hand, if a tax cut is perceived by rational agents to be a cut in the cost of public goods, then spending would increase. In that case, taxes and spending are inversely related. Support for that relationship—the so-called fiscal illusion hypothesis—is provided by Wagner (1976), Niskanen (1978, 2002, 2006), and more recently by New (2009) and Young (2009). There are also a few studies in which no significant causal relation between tax and spend variables has been reported (e.g., Baghestani and McNown (1994).

Morgenthau, widely considered the “founding father” of the Realist School of International Relations, have long been baffled by his views on world government and the attainment of a world state—views that, it would appear, are strikingly incompatible with the author's realism. In a 1965 article in World Politics, James P. Speer II decided that it could only be “theoretical confusion” that explained why Morgenthau could on the one hand advocate a world state as ultimately necessary in his highly successful textbook, Politics Among Nations, while writing elsewhere that world government could not resolve the conflict between the Soviet Union and the United States by peaceful means. According to Spee Morgenthau posits at the international level a super-Hobbesian predicament, in which the actors on the world scene are motivated by the lust for power, yet he proposes a gradualist Lockean solution whereby the international system will move, through a resurrected diplomacy, out of a precarious equilibrium of balance-of-power anarchy by a “revaluation of all values” into the “moral and political” bonds of world community, a process whose capstone will be the formal-legal institutions of world government.

Faced with the challenges of adapting to globalization and the world's increasingly interconnected financial system, many of these democracies have found it necessary to implement a technocratic form of governance. The distance between the political elite and the people was allowed to grow under these regimes in order to achieve the much-needed efficiency in policy formulation and international integration. This article utilizes the case study of the Netherlands to analyze the implications of this gap, perhaps the most significant of which being the rise of “contemporary populism.” It attempts to make sense of seemingly random and unrelated events that have recently shocked Dutch society and politics within a framework of structural change instead of treating these events as temporal occurrences. It demonstrates how such a framework is necessary in understanding the true reason behind these events and why a temporal argument might lead to superficial conclusions.

- The study is aimed to measure the confidence levels of the extension agents under the Ministry of Agriculture and Forests based in the gewogs for efficient job performance by identifying their perceptions on the various competencies. A total of nine out of the 20 dzongkhags comprising of 60 gewogs from four regions of the country were selected for the purpose of the study. A structured questionnaire-based survey was administered to 150 samples of extension agents at the gewog-level. The study showed that most of the competencies EAs considered important were also possessed by them and vice versa. However, the competencies considered important that were least possessed by EAs were particularly in vital areas, including technical knowledge and skill oriented competencies. The study indicated that EAs needed some form of training in all the 40 competencies of extension knowledge, skills and qualities measured. The technical knowledge competency stood out as the most important training need. The senior extension agents have lower level of confidence on various competencies as compared to their juniors. These differences in the competency levels could be attributed to the lack of consistent in-service training programme. The approaches and practices of delivering extension services are consistently evolving and curriculum of training institutions being improved based on new developments. The implementation of in-service training should be systematized and regularized or at least the frequency of in-service training should be increased in the future so that technical knowledge and skills of employed/senior extension agents in the field are consistently upgraded and their confidence levels on technical competencies further enhanced. In-service training was rated as one of the primary sources of information and knowledge for extension agents. The opportunities to participate in forums like workshops, seminars, conferences and meetings were also found very useful and knowledgeable. Therefore, the Ministry of Agriculture and Forests should accord the highest priority in increasing the frequency of providing in-service training particularly to senior extension agents and also give more opportunities to staff based in the dzongkhags/gewogs for participating in national/regional conferences and seminars.

The question is: How do we get there from here? Andrew Bernstein offered one possibility in “The Educational Bonanza in Privatizing Government Schools” (TOS, Winter 2010-11): Sell government schools to the highest bidders, who would take them over following a transitional period to “enable government-dependent families to adjust to the free market.” This approach has the virtues of simplicity and speed, but also the complication of requiring widespread recognition of the propriety of a fully private educational system—a recognition that may not exist in America for quite some time.

CB: How and when did you get involved in making this movie? HK: I got involved in April 2010 after being contacted by John Aglialoro, my coproducer. At that point, a movie had to be made quickly or John would lose the rights to it. So he contacted me to see if I might be able to help him put together a lower-budget version in short order. CB: As coproducers, what have been John's and your respective roles in the movie? HK: John's role was to keep the movie faithful to the book. Mine was to get the movie into production before June 15. John has probably read Atlas more than a dozen times, and during the process of writing the screenplay and getting the film into production, he was constantly rereading chapters, mulling over the elements of the story, and working to ensure that the production remained true to Rand's ideas. My job was to work with John to make the movie happen, to get all the pieces together so that we could say “action” and make certain the film was completed. CB: Atlas Shrugged is a 54-year-old story. Why do you think it matters today? HK: For starters, many events from the story parallel real-life events today. For instance, whereas in the story the government passes business-thwarting laws such as the “Anti-Dog-Eat-Dog Rule” and the “Equalization of Opportunity Bill,” in real life today the government is passing laws such as the “Emergency Economic Stabilization Act” and the “Patient Protection and Affordable Care Act.” But more fundamentally, the story matters because it dramatizes timeless philosophic truths about human nature, the role of reason in human life, the morality of rational self-interest versus predation or “greed,” the role of the government and of the citizen, and man's need of political and economic freedom. These truths will always matter. . . .

- Eleven years ago, toward the end of my undergraduate years as a philosophy major at the University of Virginia, I was feeling dissatisfied with my knowledge of history. I had taken several history courses but wanted more. Because my immediate interest was ancient Greece, I decided to try a friend's recommendation, The Life of Greece by Will Durant. Finding the book at the library, I was surprised to see that it was but one volume in a massive series called The Story of Civilization—eleven substantial volumes spanning two feet of shelving.1 Although I wanted to learn more about history, I wasn't sure I wanted to learn that much. It turned out that I did. Reading those volumes—sometimes poring over large portions of them multiple times—would be one of the most enlightening and enjoyable experiences of my life. First published between 1935 and 1975, The Story of Civilization is a work of great and enduring value. Exceptional for its masterful prose as well as its size and scope, the Story is a powerful combination of style and substance. An author of rare literary talents, Durant (1885–1981) won a wide readership through his ability to make history intriguing, lively, and dramatic. His volumes, intended for the general reader and each designed to be readable apart from the others, have sold millions of copies. Some even became best sellers, and the tenth volume, Rousseau and Revolution, won a Pulitzer Prize. Individual volumes have been translated into more than twenty languages.2 Having earned a doctorate in philosophy in 1917 from Columbia University, Durant first won fame and phenomenal success with The Story of Philosophy (1926). This book sold two million copies in a few years and has sold three million copies to date; eighty-five years later, the book is still in print and has been translated into nineteen languages.3 Durant followed this book with another best seller, The Mansions of Philosophy (1929).4 His earnings from these and other books, as well as from articles and public lectures, helped free his time for writing The Story of Civilization, which would be his magnum opus. His wife, Ariel Durant (1898–1981), assisted him throughout his writing of the Story, her assistance increasing to the point that, beginning with the seventh volume, she received credit as coauthor.5 The Story of Civilization begins with Our Oriental Heritage, a volume on Egypt and Asiatic civilizations. The remaining ten volumes tell the story of Western civilization (with a substantial treatment of Islamic civilization in one of the volumes6). Durant's original intention was to tell the story of the West up to the present, but, despite working on the Story for more than four decades, he was unable to do so: “[A]s the story came closer to our own times and interests it presented an ever greater number of personalities and events still vitally influential today; and these demanded no mere lifeless chronicle, but a humanizing visualization which in turn demanded space” (vol. 7, p. vii). The increasing space he gave to each period of European history resulted in his having to end the Story with the downfall of Napoleon in 1815; moreover, he had to omit the history of the Americas entirely. He was ninety when the Story's last volume was published and had carried it as far as he could. In each volume Durant takes a comprehensive approach, covering, for each nation and in each period of its history, all the major aspects of civilization: politics, economics, philosophy, religion, literature, art, and science.7 He called his approach the “integral” or “synthetic” method, and regarded it as an original contribution to historiography.8 Elaborating on the origin of his method, he writes: I had expounded the idea in 1917 in a paper . . . “On the Writing of History.” . . . Its thesis: whereas economic life, politics, religion, morals and manners, science, philosophy, literature, and art had all moved contemporaneously, and in mutual influence, in each epoch of each civilization, historians had recorded each aspect in almost complete separation from the rest. . . . So I cried, “Hold, enough!” to what I later termed “shredded history,” and called for an “integral history” in which all the phases of human activity would be presented in one complex narrative, in one developing, moving, picture. I did not, of course, propose a cloture on lineal and vertical history (tracing the course of one element in civilization), nor on brochure history (reporting original research on some limited subject or event), but I thought that these had been overdone, and that the education of mankind required a new type of historian—not quite like Gibbon, or Macaulay, or Ranke, who had given nearly all their attention to politics, religion, and war, but rather like Voltaire, who, in his Siècle de Louis XIV and his Essai sur les moeurs, had occasionally left the court, the church, and the camp to consider and record morals, literature, philosophy, and art.9 Durant's integral history does not only occasionally consider these latter areas (which he calls “cultural history” or “the history of the mind,”)10 it emphasizes them. “While recognizing the importance of government and statesmanship, we have given the political history of each period and state as the oft-told background, rather than the substance or essence of the tale; our chief interest was in the history of the mind” (vol. 10, p. vii). (Nevertheless, the Story contains ample and excellent material on politics.) The Story is by far the most massive and thorough treatment of Western civilization by a single author (or team of two) that I have been able to find. Large teams of historians have collaborated to produce similarly large, or even larger, works. But such works, writes a respected historian, “while they gain substantially in authoritative character, are seriously lacking in correlation and are not written from a . . . harmonious point of view.”11 Harmony is indeed one of the cardinal virtues of Durant's work; readers find therein a beautifully integrated tale of man's past, a veritable symphony of history. For this reason and others—notably, Durant's grand, philosophical overviews and scintillating style—I believe that many, and perhaps most, readers will find no better place to turn for a large treatment of Western civilization than The Story of Civilization. . . .

376. Around the World: "The Communist War against the Philippines and Why It Rages On"

- An insurgency led by the Communist Party of the Philippines (CPP) is ravaging the nation's countryside.1 Children as young as twelve are forced to join the “New People's Army” (NPA) and to fight for the communist cause.2 Farmers are often killed for refusing to support or join the communist cause. Businessmen are threatened with death or the destruction of their property should they not pay taxes to the revolutionaries. Politicians in areas of strong communist influence either become puppets of the CPP-NPA or are murdered. This insurgency has killed more than 120,000 Filipinos to date, and the body count is rapidly rising.3 The communist insurgents' ultimate goal is to conquer the nation, and they are fighting toward this end via two means. The first of these is armed force. According to Jun Alcover, a former high-ranking Communist Party member turned anticommunist congressman, the CPP hopes “to win the revolutionary struggle and change the social, economic, and political landscape in the Philippines—[through] armed revolution, Mao Zedong style.”4 Yettan Verita Liwanag, a coauthor with Alcover of the book Atrocities Lies: The Untold Secrets of the Communist Party of the Philippines, details the communists' plan to carry out this bloody insurrection. The first step would be to draw a significant number of the Armed Forces of the Philippines (AFP) away from the island of Luzon (where the capital is) to the southern Island of Mindanao, where the NPA, allied with secessionist forces such as the Moro National Liberation Front and the Bangsa Moro Army, would be able to bog down the AFP. “Attacks from the combined forces would tie down a large part of the AFP in the south. By splitting the AFP, NPA forces in the Visayaz could then contribute to the uprising by simultaneously assaulting their areas of responsibility. Finally, after achieving strategic advantage over the elements of the AFP by dividing its attention,” the communists in Luzon could “then strike the National Capital Region by surrounding it with pockets of Red-controlled areas and enveloping it from the inside” with a massive uprising of armed and non-armed supporters, ranging from workers to leftist students.5 This is the communist dream of violent revolution as envisioned by the founder and leader of the New People's Army—however, it is a long shot.6 The communists know that the AFP, which is far more powerful than their own modest forces, would almost surely win an all-out military conflict. So the communists are also fighting for control of the Philippines on a second, more insidious front. The CPP-NPA is trying to increase its reputation as a legitimate political party within the international community; meanwhile, it is smearing the Philippine government and the AFP as human-rights violators and mass murderers. The communists hope ultimately to cause enough commotion to invite direct intervention in Filipino affairs from foreign entities (including the United Nations), leading to pressure from those entities to accommodate the communists and perhaps even create a coalition government with them.7 In this way the CPP-NPA could wield much power in the Philippines while reducing the damage to its insurgency force. Even more amazing than the fact that a remnant of the Cold War severely threatens the Philippines is the fact that the Philippine government is permitting it to do so. From its prime in the 1980 of tens of thousands of “comrades,” the NPA has been reduced to a few thousand—a number that the Philippine government could easily squash. Yet a continuous policy of accommodation and appeasement from the Philippine government has allowed the NPA to survive, threatening the prosperity and lives of all Filipinos. . . .

- Although Ayn Rand published her epic novel Atlas Shrugged fifty-four years ago, and although it has consistently sold hundreds of thousands of copies annually, Rand's magnum opus has spent decades mired in Hollywood “development hell.” Numerous producers, stars, screenwriters, and film production companies have endeavored but failed to execute a film version (see: “Atlas Shrugged's Long Journey to the Silver Screen,” p. 35). All the while, fans of the novel have anxiously waited for the day when they could watch the story come to life on the silver screen. That day is finally here. Atlas Shrugged: Part I, the first in a planned trilogy, should, for the most part, please the novel's patient fans. Fortuitously following a blueprint similar to one outlined by Rand in the 1970s (see “Adapting Atlas: Ayn Rand's own Approach,” p. 38), the film covers the first third of the story. Like the novel, the movie focuses on Dagny Taggart as she endeavors to save her struggling railroad from both intrusive government regulations and the mysterious John Galt, who is hastening the nation's collapse by causing the great entrepreneurs and thinkers of the country to disappear. She is aided in her efforts by Henry “Hank” Rearden, a steel magnate who is also being squeezed by government regulations and is anxious to put an end to John Galt's activities. Those familiar with the novel know generally what to expect: the disappearance of more and more industrialists and other great producers, the banning of Rearden Metal, the “Anti-Dog-Eat-Dog Rule,” the initial run of the John Galt Line, and finally Wyatt's Torch and the collapse of Colorado.

- It is 1939 and England is in crisis—war looms, the government is in chaos, the people are in despair. All eyes turn to the country's reluctant, recently crowned monarch, George VI, to offer stirring words that will brace them for the coming storm. But there's the rub. The king suffers from a paralyzing stammer, and there are grave doubts that he will be able to deliver the speech that will unite his nation. Tom Hooper's Academy-Award winning The King's Speech is much more than a simple, inspiring wartime tale of a historical figure overcoming a physical and psychological ailment. The story of how Albert, Duke of York, later King George VI, overcame his stammer to give a series of rousing wartime speeches that united and inspired his nation is indeed the framework of the film. But at its heart, the film is the story of the power of the human mind and how hard work and perseverance—not miracles and wishes—are the bulwarks of the human spirit. The film opens in 1925. Albert (played by Colin Firth) must deliver the closing speech of the Empire Exhibition. The king's second son is terrified. He is led to the podium where his speech will not only be heard by the assembled crowd but is being simultaneously broadcast across the Empire. The time comes, and in what can only be described as sheer agony, Albert chokes out the first few words. He is next seen several months later at a session with a so-called “speech therapist” who insists that smoking will “relax the throat” and that stuffing one's mouth full of marbles is the “classic” cure for stuttering. Both remedies, unsurprisingly, fail. Albert, with the help of his wife, Elizabeth (played by Helena Bonham Carter), eventually lands himself in the offices of Lionel Logue (Geoffrey Rush), an Australian speech therapist, who promises that he can help Albert (whom he insists on calling “Bertie” to the prince's continuing disdain) overcome his stammer and speak clearly. The eccentric speech therapist delivers. Through hard work, setbacks, and triumphs, Logue, with sometimes unusual therapeutic techniques and a wry bit of psychoanalysis, treats the prince and helps him rediscover the confidence and self-esteem that had been robbed from him during his bleak childhood. The efforts culminate in the pivotal speech that Albert, as king, must give. Success is the only option—and the psychological tightrope the king must cross during this moment is more compelling than any explosive action sequence one might imagine. . . .

- In The Philosophical Breakfast Club: Four Remarkable Friends Who Transformed Science and Changed the World, Dr. Laura Snyder contrasts the early 19th-century man of science (or “natural philosopher”) with the modern scientist. Yesteryear's men of science were usually wealthy (often from an inheritance), pursuing their scientific interests with no support from a government, university, or corporation. Their discoveries, though long used by kings and governments, were rarely regarded as something that could improve the lives of ordinary men and women. The men of science would hardly ever meet, and they would never debate the merits of their work or papers publicly. Unsurprisingly then, they had reached no consensus as to a proper “scientific method,” and no single process of reaching theories was upheld above any other. The modern scientist, by contrast, is a specialized, credentialed professional who usually works for a government or university while conducting research. This scientist routinely defends his work from contemporaries in the same field, is answerable to the public, and is even seen as a social reformer of sorts, capable of dramatically improving lives politically, economically, or socially. On top of it all, he adheres to a standard account of the scientific method, even as ongoing debates about the specifics of that method emerge and are assessed. Who or what accounts for the transformation of the field of science and of its practitioners? The dominant thesis of Snyder's Philosophical Breakfast Club is that the efforts and achievements of four Cambridge graduates, friends, and men of science—John Herschel, Charles Babbage, Richard Jones, and William Whewell (pronounced “Who-ell”)—are largely responsible for our modern conception of what it means to be a scientist. To support her claim, she presents a biographical account of their lives, discussing their scientific, family, and social lives as well as their goals, personal interests, and the social context surrounding them. Each chapter presents aspects of what the four accomplished (or attempted to accomplish), along with the contextual background necessary to understand the importance of their work. The result is a clear view of the social and scientific atmosphere in which these men lived, and an even clearer understanding of exactly what they wanted to change in the world of science, and why. . . .

- 1. In introducing this EJIL symposium, I cannot help but recall a much debated article published in 1986 in the American Journal of International Law. The author of that article, Stanford professor John Merryman, theorized that there are \'two ways of thinking about cultural property\'. 1 The first, he argued, is the national(istic) way, which conceives of cultural property as part of the nation, with the attendant desire of governments to jealously retain it within state boundaries and to limit its international circulation. The second is the international way, which views cultural property as the heritage of humankind and supports the broadest access and circulation to facilitate exchange and cultural understanding among different peoples of the world. The author left no doubt that the latter view was to be preferred for its alleged capacity to contribute to a cosmopolitan order, in which cultural property can be freely accessed and thus contribute to the intellectual and moral progress of humanity. One may wonder whether this dual perspective accurately reflected the spirit of the law and the policy attitudes of the time when the article was written. Certainly, it cannot adequately explain the present state of the law and, in particular, of international law. Today, there are more than just two ways of thinking about cultural property. Cultural property may be seen as part of national identity, especially in the post-colonial and post-communist context, but it can also be looked at as part of the \'territory\', the physical public space that conditions our world view and which is part of what we normally call \'the environment\' or the \'landscape\'. Cultural property may be seen as moveable artifacts susceptible to economic evaluation, and for this reason subject to exchange in international commerce; but it may also be thought of as objects endowed …

- The regulation of internal armed conflict by international law has come a long way in a very short space of time. Until the early 1990s, there were a minimum of international law rules applicable to internal armed conflict. Today, the situation has changed almost beyond recognition with a healthy body of international law applicable to internal armed conflict. This change has taken place in three principal ways – through analogy to the law of international armed conflict, through resort to international human rights law, and through the use of international criminal law. Each of these approaches stressed its similarity to internal armed conflict or to international humanitarian law. They proved immensely important, filling in what was a more or less blank canvas. However, there are limits to how far they can take us. Today, the canvas is no longer blank and a step back is needed in order to assess the existing state of affairs. Focusing not on the similarities between international and internal armed conflicts or between the various bodies of international law, but on their differences, will allow us to ascertain what further work is in order. It will allow us to identify gaps in regulation and refine relevant rules. It will also force us to re-think our approach to particular issues. Only in this way will we be able to develop the international law of internal armed conflict further.

- The prevailing view of the form which the effort to regulate non-international armed conflicts should take has been summarized by the Appeals Chamber of the International Criminal Tribunal for the former Yugoslavia (ICTY) in the Tadić interlocutory appeal on jurisdiction: '[w]hat is inhumane, and consequently proscribed, in international wars, cannot but be inhumane and inadmissible in civil strife'.This mirroring approach of emulating the laws applicable in international armed conflicts in the non-international context was subsequently adopted by the drafters of the Rome Statute of the International Criminal Court in 1998; the drafters chose to include a list of war crimes applicable in cases of non-international armed conflicts which resembled (though was still narrower than) the list of crimes applicable in international conflicts. The recent Kampala ICC review conference expanded the non-international crimes list, further narrowing the gap between the 'international' and the 'non-international' lists of crimes.Taking a similar position, the 2005 study on customary international humanitarian law (IHL) published by the International Committee of the Red Cross concluded that all but a handful of the rules identified as customary applied in international and non-international armed conflicts equally.Given the traditional resistance by states to assuming the same degree and range of constraints which apply in international armed conflicts in internal ones, humanitarian advocates have sought to advance the regulation of internal armed conflicts by supplementing IHL with norms borrowed from international criminal law (ICL) and international human rights laws (IHRL). The resulting international law of internal armed conflicts has thus been a patchwork of norms which ostensibly apply to all non-international armed conflicts, drawn from the IHL of international conflicts, ICL, and IHRL, often proving to be incoherent, unworkable, and ineffective. - I am grateful to Professor Gabriella Blum for her thoughtful response to my article. Blum's response invites further consideration of three principal issues. She notes my use of the terminology of 'internal' as opposed to 'non-international' armed conflict and its juxtaposition with 'international' armed conflict and queries whether my 'methodological approach as well as specific suggestions would remain equally compelling in other types of non-international armed conflicts'. The choice of terminology was deliberate. I find the descriptor 'non-international' to be somewhat misleading as it unhelpfully defines the category by what it is not. It suggests that there is but one armed conflict and, if it is not international in character, by default it is non-international. However, in practice, an internal/non-international armed conflict is identified in a rather different manner. For example, in order for an internal/non-international armed conflict to exist, the violence must reach a certain level of intensity; yet, for an international armed conflict to exist one dominant view is that there is no such requirement. The category of internal/non-international armed conflict is thus in no way a default category which serves to catch those conflicts which are excluded from the international category. Yet this is what is suggested through the use of the terminology of 'non-international' armed conflict. What the terminology of 'internal' may suggest is that it is limited to those conflicts which are fought entirely within the territorial boundaries of a state. However, even this may be true only up to a certain point. For example, an internal armed conflict with a certain overspill, such as onto the high seas or into the territory of a third state, is still characterized as an internal …

- When the current economic crisis began, political leaders all around the world spread the idea that capitalism needed somehow to be reformed. 1 A couple of years later one might think that not much has been achieved in that direction and blame politicians for their lack of will. However, it is not so clear that reforms – even if the political will existed – would be easy to realize. As Danny Nicol argues, the neoliberal conception of capitalism is constitutionally shielded as a result of the content and the development of different but coexisting legal regimes such as the World Trade Organization (WTO) or the European Union (EU), and of the activism of the European Court of Human Rights (ECtHR). Describing the resulting 'constitutional protection of capitalism' is precisely what this book is about: Nicol tries to determine to what extent national politics are predetermined by the ongoing economic integration. Or, putting it differently, his research aims at explaining how much room for manoeuvre states, and in particular the United Kingdom, maintain now that the international and European economic integration treaties they ratified years ago have evolved in an unexpected way. The author thus identifies two trends 'that have pervaded the evolution of transnational regimes' (at 156), namely their widened scope and their enhanced binding character, and claims that such developments have a special impact on the freedom of Parliament to decide, 2 a freedom which, as we must bear in mind, is at the core of British constitutionalism. - One would expect no less from this study of contemporary forms of slavery by Emmanuel Decaux than that it identifies the fundamental puzzle at the heart of legal issues surrounding human exploitation, namely, that: there is a permanent contradiction between the successive attempts focused on 'slavery in all its forms' as well as 'the practices and institutions similar to' – which are at the heart of international instruments, and the programmes of action of international organisations and non-governmental organisations –; and the criminal law approach which requires a precise definition to incriminate; either domestically, in the name of the determinacy of the crimes and of the penalty, or internationally to allow for criminal cooperation. 1 It is to this fundamental paradox that Decaux devoted his attention during his lectures at The Hague Academy of International Law in 2008. These lectures were published in The Collected Courses of the Hague Academy series and were also reproduced as part of a pocketbook series. 2 The beauty of considering studies written in another language is to liberate oneself from assumptions – the given starting and end points of argument, and the continuity of well established discourses. If nothing else, surveying works in other languages opens the possibility of new revelations and discoveries – even for the most seasoned expert in an area – which come from narratives forged, in this case, in Paris, as opposed to a London or a Washington. With this in mind, Les formes contemporaines de l'esclavage does not disappoint. More so than in a monograph, the chapters of a study emanating from the Hague Academy stand alone, as each originates in a public lecture and thus must stand on its own merits. - Dialogue, this noble art, which, like many other things, was invented by the Greeks, is always a sort of collaboration, a way of trying to attain the truth. Perhaps this is why Plato used it as a literary vehicle when he wrote his Socratic dialogues, a corpus of pieces in which he laid the foundations of Western philosophy. Deeply impressed by the death of his mentor Socrates, Plato wrote some of the most brilliant and insightful works of all time, perhaps in order to keep on debating with his master after his death. In all likelihood, no-one since has ever had the same great ability to create such architectures of thought. His enjoyable and entertaining dialogues deal with essential topics such as the nature of time, politics, love, and death. Not only is his style concise and meticulous, with a proverbial ability to pose the right questions, but also didactic and kind. His dialogues enable all participants to engage in an inquiry which, despite not always being successful in reaching the desired goal, has at least proved to be a fundamental tool in the development of all expressions of human thought. The book under review is inspired, mutatis mutandis, by this very same philosophy regarding dialogue. As its editors (Filippo Fontanelli, Giuseppe Martinico, and Paolo Carrozza) point out in their introduction, '[t]he process of fragmentation of the international legal order and the absence of constitutional devices governing the connections between the various legal regimes can be reduced to a rational picture only through the activity of the judges' (at 23). This is why judges play a key role in creating and developing links between the different legal systems which constitute our multi-level judicial environment. - Historical disputes and nationalism continue to be issues of concern and controversy in the relationship between Japan and China. In 2005, popular nationalist sentiment culminated in nationwide anti-Japanese movements in China. This led to a crucial shift in the way China and Japan deal with history and popular nationalism. An unprecedented dialogue on war memory was initiated in late 2006, and the Sichuan earthquake relief effort in mid-2008 marked a further departure from earlier patterns. The Chinese government shifted away from conventional historiography that largely fed negative images of Japan. While these developments point to new, cooperative attitudes that aim to contain popular nationalist sentiment in manageable proportions, relations are nevertheless increasingly obscured by other tensions in the bilateral relationship.

- This paper investigates the threat of a water war between China and India. It argues that Indian suspicion of China has been premature. Beijing has not yet given its approval for major water diversion projects in Tibet, it has taken some limited steps toward easing the concerns of the Indian government and a growing number of Chinese experts have taken an interest in developing institutional frameworks for managing transboundary rivers. However, a definitive settlement or cooperation will be difficult because both countries perceive themselves as the victim of a greedy neighbor. While India complains about China's ravenous exploitation of the Himalayan rivers, it is common in China to accuse India of exaggerating the Chinese threat and being unreasonable in its demands.

- Despite gloomy predictions about the inevitability of competition between China and India, cooperation between Asia's two emerging powers is possible. It will, however, require a much more concerted effort to bridge the gap in sociocultural understanding that exists between the two countries. While growing economic ties have warmed relations between them, there remains a fundamental lack of appreciation on the part of each country of the underlying cultural and societal norms that define the other—norms that influence each country's perception of its own national interest. We argue that greater appreciation of these elements is critical if China and India are to successfully address issues such as the ongoing border dispute and the mounting trade imbalance. This essay is devoted to exploring avenues for cultural rapprochement and analyzing efforts made thus far. It also explores ways to make the process of engagement more effective, not only at the intergovernmental level but also in terms of person-to-person contact. With the remarkable economic resurgence of Asia, especially that of China and India, we contend that it is urgent for each country to gain a more direct and nuanced understanding of the other.

- In Tunisia, protesters escalated calls for the restoration of the country's suspended constitution. Meanwhile, Egyptians rose in revolt as strikes across the country brought daily life to a halt and toppled the government. In Libya, provincial leaders worked feverishly to strengthen their newly independent republic. It was 1919. That year's events demonstrate that the global diffusion of information and expectations -- so vividly on display in Tahrir Square this past winter -- is not a result of the Internet and social media. The inspirational rhetoric of U.S. President Woodrow Wilson's Fourteen Points speech, which helped spark the 1919 upheavals, made its way around the world by telegraph. The uprisings of 1919 also suggest that the calculated spread of popular movements, seen across the Arab world last winter, is not a new phenomenon. The Egyptian Facebook campaigners are the modern incarnation of Arab nationalist networks whose broadsheets disseminated strategies for civil disobedience throughout the region in the years after World War I. The important story about the 2011 Arab revolts in Tunisia, Egypt, and Libya is not how the globalization of the norms of civic engagement shaped the protesters' aspirations. Nor is it about how activists used technology to share ideas and tactics. Instead, the critical issue is how and why these ambitions and techniques resonated in their various local contexts. The patterns and demographics of the protests varied widely. The demonstrations in Tunisia spiraled toward the capital from the neglected rural areas, finding common cause with a once powerful but much repressed labor movement. In Egypt, by contrast, urbane and cosmopolitan young people in the major cities organized the uprisings. Meanwhile, in Libya, ragtag bands of armed rebels in the eastern provinces ignited the protests, revealing the tribal and regional cleavages that have beset the country for decades. Although they shared a common call for personal dignity and responsive government, the revolutions across these three countries reflected divergent economic grievances and social dynamics -- legacies of their diverse encounters with modern Europe and decades under unique regimes.

- The United States has a major stake in Pakistan's stability, given the country's central role in the U.S.-led effort to, in U.S. President Barack Obama's words, "disrupt, dismantle, and defeat" al Qaeda; its war-prone rivalry with India over Kashmir; and its nuclear arsenal. As a result, U.S. policy toward Pakistan has been dominated by concerns for its stability -- providing the reasoning for Washington's backing of the Pakistani military's frequent interventions in domestic politics -- at the expense of its democratic institutions. But as the recent eruption of protests in the Middle East against U.S.-backed tyrants has shown, authoritarian stability is not always a winning bet. Despite U.S. efforts to promote it, stability is hardly Pakistan's distinguishing feature. Indeed, many observers fear that Pakistan could become the world's first nuclear-armed failed state. Their worry is not without reason. More than 63 years after independence, Pakistan is faced with a crumbling economy and a pernicious Taliban insurgency radiating from its Federally Administered Tribal Areas (FATA), the semiautonomous seven districts and six smaller regions along its border with Afghanistan. It is still struggling to meet its population's basic needs. More than half its population faces severe poverty, which fuels resentment against the government and feeds political instability. According to the World Bank, the Pakistani state's effectiveness has actually been in steady decline for the last two decades. In 2010, Foreign Policy even ranked Pakistan as number ten on its Failed States Index, placing it in the "critical" category with such other failed or failing states as Afghanistan, the Democratic Republic of the Congo, and Somalia. The consequences of its failure would no doubt be catastrophic, if for no other reason than al Qaeda and its affiliates could possibly get control of the country's atomic weapons. The Pakistani Taliban's dramatic incursions into Pakistan's northwestern Buner District (just 65 miles from the capital) in 2009 raised the specter of such a takeover.

Would you like to leave a comment? 1CommentsJoin To the Editor: Roger Altman and Richard Haass ("American Profligacy and American Power," November/December 2010) persuasively argue that continued American profligacy promises to undermine American power. But the situation is even more urgent than they suggest. Although Altman and Haass expect markets to remain calm "possibly for two or three years," the rising price of gold suggests otherwise. Gold has risen from $460 per ounce to $1,400 per ounce in the last five years -- representing a 67 percent devaluation of the U.S. dollar per unit of gold. As former U.S. Federal Reserve Chair Alan Greenspan has said, gold is "the ultimate means of payment." Moreover, on top of new government debt over the next several years, maturing existing debt will need to be refinanced. At 4.6 years, the average maturity of the U.S. federal debt held by the public (debt that now totals $9.1 trillion) is tight relative to, for instance, the average maturity of 13.5 years for British government debt. According to the International Monetary Fund, the maturing debt of the U.S. government will equal 18.1 percent of U.S. GDP during 2011 alone. Altman and Haass rightly note that the U.S. government's annual interest expense will rise dramatically as its stock of debt increases and interest rates inevitably rise. Further debt increases would substantially darken the fiscal outlook for the federal government. And even a relatively small rise in interest rates would have a significant impact. TIM W. - In 2009, the Permanent Court of Arbitration administered a unique case: the Abyei Arbitration between the Government of Sudan and the Sudan People's Liberation Movement/Army. This case is unique in several aspects: first, it is an example of intra-state dispute settlement in a conflict zone rich in natural resources, second, it was conducted under a fast-track procedure, and third, it was fully transparent, with all documents and full webcast of the proceedings still available on the PCA website. Currently there is a large number of outstanding intra-state disputes, not limited to Africa, so this paper assesses why the Parties in the Abyei Arbitration chose arbitration in the first place and whether this model could be successfully applied to other similar disputes.

- This article investigates and explains the development of International Relations studies (IRS) in China, Japan, and India. Beginning in early 1980s IRS experienced exponential growth in China and is becoming a separate discipline in that country. Despite early starts, IRS in Japan and India is still an appendage in other disciplinary departments, programs, and centers although growing interest is discernible in both countries. Continued rise of Asian powers along with their growing roles and responsibilities in constructing and managing regional and global orders is likely sustain and increase interest in IRS in these countries and more generally in Asia. Distinctive trajectories have characterized the development of IRS in China, Japan, and India. Distinctiveness is evident in master narratives and intellectual predispositions that have shaped research and teaching of IR in all three countries. The distinct IRS trajectories are explained by the national and international context of these countries as well as the extensiveness of state domination of their public spheres. Alterations in national circumstances and objectives along with changes in the international position explain the master narratives that have focused the efforts of IR research communities. Extensiveness of state domination and government support, respectively, explain intellectual predispositions and institutional opportunities for the development of IRS. IRS in Asia has had a predominantly practical orientation with emphasis on understanding and interpreting the world to forge suitable national responses. That orientation contributed to a strong emphasis on normative–ethical dimensions, as well as empirically grounded historical, area, and policy studies. For a number of reasons including intellectual predispositions and constraints, knowledge production in the positivist tradition has not been a priority. However, IR theorizing defined broadly is beginning to attract greater attention among Asian IR scholars. Initial interest in Western IR theory was largely a function of exposure of Asian scholars to Western (primarily American) scholarship that has been in the forefront in the development of IR concepts, theories, and paradigms. Emulation has traveled from copying to application and is now generating interest in developing indigenous ideas and perspectives based on national histories, experiences, and traditions. Although positivism may gain ground it is not deeply embedded in the intellectual traditions of Asian countries. Furthermore, theorizing in the positivist tradition has not made significant progress in the West where it is also encountering sharp criticism and alternative theories. Asian IR scholarship would continue to emphasize normative–ethical concerns. And historical, area, and policy studies would continue to be important in their own right, not simply as evidentiary basis for development of law-like propositions. It also appears likely that Asian IR scholarship would increasingly focus on recovery of indigenous ideas and traditions and their adaptation to contemporary circumstances. The net effect of these trends would be to diversify and enrich existing concepts, theories, methods, and perspectives, and possibly provide fresh ones as well. The flourishing of IRS in Asia would make the IR discipline more international.

Recently, two related concepts have been developed to codify the best practices related to resolving crises and conflicts through the coordinated use of a variety of levers of power. Of course, the extent to which this process should be considered conceptual is open to question, given that it reflects only what competent civilian and military leaders have always sought to accomplish. Nonetheless, there is broad intuitive acceptance that the Comprehensive Approach (CA) or Whole of Government (WoG) approach is a strategic level framework for the coordination of all elements of national or coalition power, with an Effects-Based Approach to Operations (EBAO) being the military contribution to the larger effort.
