Abstract:: Since the early 2000s, Turkish foreign policy has experienced a fundamental transformation. Turkey's regional and global position, its relations with the countries in surrounding regions, and its long-lasting disputes with its neighbors were reshaped through the adoption of the "zero-problem with-neighbors" policy. In line with this policy, Turkey has taken a pro-active stance and followed a multi-dimensional foreign policy approach to establish itself, first, as a conciliatory partner for peace with its neighbors, and second, as an agent of mediation between its clashing neighboring countries. 2009 was a year of foreign policy initiatives towards Syria, Armenia, and Iraq, including the Kurdish Regional Government. And it marked the beginning of more positive and constructive relations between Turkey and the United States. Turkey gained substantial ground in becoming a regional hub for energy by undersigning two critical energy deals. Yet, two major issues remain as challenges for Turkish foreign policy: a) the EU accession process, and b) the Cyprus dispute.

Abstract:: On March 23, 2010, President Barack Obama signed into law the Patient Protection and Affordable Care Act (known colloquially as "ObamaCare"), declaring that the law would enshrine "the core principle that everybody should have some basic security when it comes to their health care."1 But, for reasons I have elaborated in previous articles in TOS, far from establishing security regarding Americans' health care, this new law will make quality health care harder to come by and more expensive for everyone. Unfortunately, until our politicians rediscover the principle of individual rights, choose to uphold it, and reverse this monstrosity of a law, we Americans are stuck with it and will have to cope the best we can.

Abstract:: In his seminal review of modern American cultural diplomacy, The First Resort of Kings, American Cultural Diplomacy in the Twentieth Century (2005), Dr. Richard Arndt explored the full breadth of this important element of American international statecraft. Arndt defined cultural diplomacy by first considering how it contrasted with “cultural relations, or “relations between national cultures, those aspects of intellect and education lodged in any society that tend to cross borders and connect with foreign institutions.” Cultural diplomacy, he stated, “can only be said to take place when formal diplomats, serving national governments, try to shape and channel this natural flow to advance national interests.”

107. How an Economy Grows and Why It Crashes

Abstract:: Very few economists predicted an economic catastrophe in 2007. Even following the crash, many continued to claim that our present economic course was fine. As for today? “Three years into the mess, economists now offer remedies that strike most people as frankly ridiculous. We are told that we must go deeper into debt to fix our debt crisis, and that we must spend in order [to] prosper” (pp. xi–xii). The source of such seeming obliviousness, according to Peter and Andrew Schiff, is the early-20th-century economist John Maynard Keynes. According to the Schiffs, Keynes taught that governments could smooth market volatility, increase employment, boost growth, and raise living standards simply by going into more debt and printing more money. Although they grant that Keynes was smart, the Schiffs say he developed some very stupid economic ideas—ideas that are false, dangerous, and causing the collapse of America's economy. The Schiffs set out to counter these harmful ideas in How an Economy Grows and Why It Crashes. The book is an extended allegory of U.S. economic history, with supplementary discussions and illustrations. It begins with three men living on a tropical island, each subsisting on one fish per day, which he catches with his bare hands. One of the men, Able, devises a better way to catch fish: a net. Thus equipped, he hopes to catch more fish, and faster, leaving himself spare time to make new clothes. . . .

Abstract:: Côte d'Ivoire supplies 40 percent of the world's cocoa, and due to its unique climactic conditions, industry experts see no viable alternative to this critical source of raw material. The quality and quantity of the country's cocoa production have declined in recent years, raising concern among international cocoa and chocolate companies about the potential negative effect on the world cocoa market. Political uncertainties have compounded the problem. Reforms needed to reinvigorate the sector are unlikely to be taken until after elections, currently scheduled for October 31, 2010. Major improvements are not expected in the short term. The good news, however, is that production and quality could turn around rapidly if appropriate reforms are implemented after the election and a concerted effort is ma de by the new government to remove barriers to fresh investment.

109. The Responsibility to Protect—Five Years On

Abstract:: The Responsibility to Protect (RtoP) has become a prominent feature in international debates about preventing genocide and mass atrocities and about protecting potential victims. Adopted unanimously by heads of state and government at the 2005 UN World Summit and reaffirmed twice since by the UN Security Council, the principle of RtoP rests on three equally weighted and nonsequential pillars: (1) the primary responsibility of states to protect their own populations from the four crimes of genocide, war crimes, ethnic cleansing, and crimes against humanity, as well as from their incitement; (2) the international community's responsibility to assist a state to fulfill its RtoP; and (3) the international community's responsibility to take timely and decisive action, in accordance with the UN Charter, in cases where the state has manifestly failed to protect its population from one or more of the four crimes. The principle differed from the older concept of humanitarian intervention by placing emphasis on the primary responsibility of the state to protect its own population, introducing the novel idea that the international community should assist states in this endeavor, and situating armed intervention within a broader continuum of measures that the international community might take to respond to genocide and mass atrocities. As agreed to by states, the principle also differed from the proposals brought forward by the International Commission on Intervention and State Sovereignty by (among other things) emphasizing international assistance to states (pillar two), downplaying the role of armed intervention, and rejecting criteria to guide decision-making on the use of force and the prospect of intervention not authorized by the UN Security Council. Five years on from its adoption, RtoP boasts a Global Centre and a network of regional affiliates dedicated to advocacy and research, an international coalition of nongovernmental organizations (NGOs), a journal and book series, and a research fund sponsored by the Australian government. More important, RtoP has made its way onto the international diplomatic agenda. In 2008, UN Secretary-General Ban Ki-moon challenged the UN membership to translate its 2005 commitment from ''words to deeds.'' This challenge was taken up by the General Assembly in 2009, when it agreed to give further consideration to the secretary-general's proposals. RtoP has also become part of the diplomatic language of humanitarian emergencies, used by governments, international organizations, NGOs, and independent commissions to justify behavior, cajole compliance, and demand international action.

110. Making Choices: Prospects for a Canada-EU Free Trade Agreement.

Abstract:: With a population of over 500 million, the European Union (EU) is Canada's second-largest trading partner. In 2006, two-way merchandise trade between Canada and the EU was approximately $78 billion and two-way investment reached $263 billion. While these figures are far from marginal, they pale in comparison to the $626 billion in two-way merchandise trade and $497 billion in two-way investment with the United States. In light of these numbers, analysts have argued that there is room for improvement in the economic relationship between Canada and the EU. They believe that the relationship has been significantly under-traded and under-valued. In an attempt to bolster this claim, a Canada-EU Joint Trade Study commissioned by the European Commission and the Government of Canada (GoC) recently noted that Canada is the EU's 11th-largest merchandise trading partner, with only 1.8 percent of external EU trade in this category (GoC, 2008). In light of the financial crisis in the United States, discussions to revive talks of a Canada-EU Free Trade Agreement (FTA) have begun to garner attention.

Abstract:: High-level US efforts to convince Burma's military government to open its political system to the democratic opposition and release political prisoners prior to scheduled 2010 elections accelerated this quarter. President Obama, Secretary of State Clinton, and Assistant Secretary of State Campbell all weighed in during meetings in Burma and at the first ASEAN-US summit in Singapore after the annual APEC leaders meeting. The ASEAN states welcomed the first US summit with all 10 members. Secretary General Surin Pitsuwan noted that President Obama's praise for ASEAN's key role in Asian international organizations debunked claims by some that ASEAN is no longer the centerpiece of the region's architecture. Singapore's prime minister insisted that the US continues to be Asia's “indispensable” player despite the rise of China and India. In the Philippines, the Visiting Forces Agreement continues to be a political football in domestic Philippine politics as President Arroyo's political opponents claim that the US military violates the Philippine constitution by engaging in combat – an allegation denied by both the US embassy and the Philippine government. On a tip from the US, Thai authorities detained a cargo aircraft coming from North Korea with a load of sophisticated weapons in violation of a UN Security Council Resolution.

Abstract:: India-US relations were characterized by a degree of ennui while India-East Asia relations were overshadowed by public tensions between China and India throughout much of the year. The Obama administration, preoccupied by multiple high-stakes domestic and foreign policy priorities, offered up two high-profile visits for New Delhi with Secretary of State Hillary Clinton going to India in July and Prime Minister Manmohan Singh coming to Washington in November as the first head of state visit. But the newly strengthened Congress-led government, which returned to power after the April-May national elections, remained wary of the Obama administration's priorities and approaches toward a range of issues including its Afghanistan-Pakistan (AfPak) strategy, nuclear nonproliferation, and climate change, as it felt some nostalgia for the primacy of place and purpose offered to India by the bygone Bush administration. Meanwhile, in India's ties with East Asia, even though New Delhi made diplomatic forays ranging from Mongolia to Papua New Guinea to the Pacific Islands Forum to Australia while sustaining its traditional relationships with Japan and ASEAN, the tense Beijing-New Delhi interaction over the decades-old border dispute was the focus of attention for most observers.

Abstract:: Last quarter we focused on remarks by US President Barack Obama and Secretary of State Hillary Clinton proclaiming that “America is back in Asia,” an obvious dig at real and perceived neglect of Asia by the previous administration. This quarter, both were forced to postpone planned trips to Asia although, in Secretary Clinton's case, not before giving a major Asia policy address in Honolulu. This quarter also ended the same as last, amid hints that Pyongyang really would, at some not too distant point (but not this past quarter), return to six-party deliberations. On a more positive note, it looks like arms control agreements are on the way back, following the announcement that the US and Russia had finally come to terms on a new strategic arms agreement, to be signed by both presidents in April. Speculation about the “changing balance of power” in Asia also continues as a result of China's economic resilience and apparent newfound confidence, although it still seems premature to announce that the Middle Kingdom is back, given the challenges highlighted at this year's National Peoples' Congress. Political normalcy also appears to be a long way from returning to Bangkok where the “red shirts” have once again taken to the street, prompting the government to declare a state of emergency.

Abstract:: China was on the defensive this quarter, reacting to interventions by the US, including a notable statement by Secretary of State Hillary Clinton at the annual ASEAN Regional Forum (ARF) meeting in Hanoi regarding the South China Sea. The ARF meeting also saw a new US commitment, backed by ASEAN, to participate actively in the East Asian Summit, raising the profile of that regional body over China‟s preference for Asian-only regional groups. Further complicating China‟s regional calculus were prominent advances in US relations with Vietnam shown during celebrations of a US-Vietnam anniversary in August that involved exercises with a US aircraft carrier deployed near disputed regions of the South China Sea. Chinese officials and commentary in Chinese media at first countered that the US actions were self-serving and destabilizing. Those attacks meshed with public Chinese attacks on concurrent US military exercises with South Korean forces in reaction to North Korea‟s sinking of a South Korean warship. Later, some Chinese commentary dissented from the harsh public approach, and by the end of the quarter, the criticism of the US and others over the South China Sea disputes and other issues subsided. For the time being at least, it appeared that China will remain focused on publicly stressing trade and reassuring diplomacy in Southeast Asia, while defending its territorial claims and continuing to build military capabilities.

Abstract:: This has been a quiet but constructive quarter in cross-Strait relations. Taipei and Beijing were focused on ratifying and beginning implementation of the Economic Cooperation Framework Agreement (ECFA). With Beijing‟s agreement, Singapore and Taipei announced that they would consider negotiating a WTO-consistent economic cooperation agreement. This important flexibility by Beijing allows President Ma to show that ECFA has opened the door at least slightly to Taiwan‟s involvement in regional trade liberalization. Despite Washington‟s approval of small commercial arms sales, Beijing indicated a willingness to resume military exchanges with Washington. Nevertheless, arms sales to Taiwan remain a threat to US-China relations.

Abstract:: The United States has been widely blamed for the recent financial crisis. As the U.S. economy floundered and China continued to grow in the great recession of 2008—2009, Chinese authors launched ''a flood of declinist commentary about the United States.'' One expert claimed that the high point of U.S. power projection was 2000. The Chinese were not alone in such statements. Goldman Sachs advanced the date at which it expects the size of the Chinese economy to surpass the U.S. economy to 2027. In a 2009 Pew Research Center poll, majorities or pluralities in 13 of 25 countries believed that China will replace the United States as the world's leading superpower. Even the U.S. government's National Intelligence Council projected in 2008 that U.S. dominance would be ''much diminished'' by 2025. President Dmitri Medvedev of Russia called the 2008 financial crisis a sign that the United States' global leadership is coming to an end, and even a sympathetic observer, Canadian opposition leader Michael Ignatieff, suggested that Canada should look beyond North America now that the ''the noon hour of the United States and its global dominance are over.

Abstract:: The global financial crisis led to the steepest drop in global activity and trade since World War II (International Monetary Fund 2009c). Recession means unemployment of people and resources. It is a bad time to be a worker and a despondent one for worker representatives. The crisis began, publicly at least, with financial panics and ensuing bank failures in the United States in September 2008. The financial bubble of securities and derivatives burst because of “the obesity of banks and shadow banks” (Johnson 2009). However, politicians and governments had given bankers and financiers a license for excess by deregulating finance and trusting open markets. In essence, elected politicians gave small government to bankers, who in turn gave neo-liberal globalization to us.

Abstract:: On 24 February 2005, Prime Minister Paul Martin ended months of speculation by rejecting President George W. Bush's invitation to participate in his administration's ballistic missile defence (BMD) program. Martin had come to power in December 2003, intent on joining as a means of improving defence cooperation with the United States in the wake of Canada's decision not to endorse the US-led war in Iraq that had strained relations between Bush's administration and Jean Chrétien's government.2 But his plan was thwarted by several factors: public disapproval of the war, which by the time Martin took office had hardened into opposition to Bush's foreign policy; the June 2004 general election that reduced Martin's government from majority to minority status; opposition within Martin's Liberal party and among Liberal, New Democratic Party (NDP) and Bloc Québécois (BQ) members of parliament (MPs); and the ambiguous stance of the Conservatives, who had previously supported Canada's involvement. Also contributing to the decision were the Bush administration's non-committal approach to the negotiation, its failure to respond to Canadian concerns about US protectionism, and the president's ill-advised public intervention in the missile defence debate during his visit to Canada in late 2004.

Abstract:: The financial turmoil originating from the U.S. subprime mortgage crisis hit Russia by early September 2008, prompting the Russian government and the Central Bank of Russia to undertake a set of speedy and concerted measures to soften the impact of the crisis. These initial measures supported the value of the ruble as ruble holders, domestic and foreign, switched to dollars. They also provided hard currency to major Russian banks and Russian big business (the so-called oligarchs) which had borrowed heavily from foreign banks for their expanding operations from 2000 to 2007.

122. Organized Crime in Iraq: Strategic Surprise and Lessons for Future Contingencies

Abstract:: After the invasion of Iraq in March 2003, the United States encountered a series of strategic surprises, including the hostility to the occupation, the fragility of Iraq's infrastructure, and the fractious nature of Iraqi politics. One of the least spectacular but most significant of these surprises was the rise of organized crime and its emergence as a postconflict spoiler. This development was simply not anticipated. Organized crime in Iraq in the months and years after March 2003 emerged as a major destabilizing influence, increasing the sense of lawlessness and public insecurity, undermining the efforts to regenerate the economy, and financing the violent opposition to the occupation forces. In 2003, the theft of copper from downed electric pylons made the restoration of power to the national grid much more difficult. In 2008, the capacity to generate funds through criminal activities enabled al Qaeda in Iraq (AQI) to continue resisting both the U.S. military and the Iraqi government. Moreover, with the planned U.S. withdrawal from Iraq, organized crime in the country will continue to flourish by maintaining well established crime-corruption networks. It might also expand by exploiting the continued weakness of the Iraqi state.

Abstract:: The medical marijuana problem is a Janus-like conundrum. One face represents the growing number of suffering patients who are denied medical marijuana yet find it less toxic, more useful, and cheaper than legally available medications. From this perspective, the problem is how to acquire and to use this medicine without swelling the ranks (more than 800,000 annually) of those who are arrested for using this illegal substance, and how to avoid jeopardizing job security through random urine testing. Abstract:: After the september 11 attacks, the Bush administration's foreign policy toward Somalia focused primarily on counterterrorism. This focus was a result of Somalia's proximity to the Middle East, U.S. concern that al-Qa'ida might relocate to the country, a history of terrorist bombings targeting Western interests in nearby Kenya and Tanzania and early contact between al-Qa'ida and individuals in Somalia. Although ties exist between al-Qa'ida and Somalia's al-Shabab militant group, the overwhelming objective of U.S. policy in Somalia should not be confronting international terrorist activity. Instead, the United States should contribute to creating a moderate government of national unity in Somalia, which offers the best hope of minimizing Somali links to international terrorism. Long-term U.S. interests in the Horn of Africa will not be served by a policy that is consumed with military action to the detriment of supporting economic development and a broad based Somali government.

Europe, Germany in particular, may at first have indulged in a certain amount of schadenfreude to observe the abrupt fall from grace of the U.S. financial system. But not for long. As of November 2008, the euro zone is officially in a recession that continues to deepen. Germany's government was compelled to enact a 50 billion euro fiscal stimulus package. The Japanese economy, though perhaps among the least susceptible to the vagaries of the European and U.S. economies, followed soon after, with analysts fearing that the downturn could prove deeper and longer than originally anticipated. Abstract:: In the latter half of the 1990s, as the North Atlantic Treaty Organization (NATO) was preparing to expand its membership for the first time since the admission of Spain in 1982, Russian officials claimed that the entry of former Warsaw Pact countries into NATO would violate a solemn ''pledge'' made by the governments of West Germany and the United States in 1990 not to bring any former Communist states into the alliance. Anatolii Adamishin, who was Soviet deputy foreign minister in 1990, claimed in 1997 that ''we were told during the German reunification process that NATO would not expand.'' Other former Soviet officials, including Mikhail Gorbachev, made similar assertions in 1996—1997. Some Western analysts and former officials, including Jack F. Matlock, who was the U.S. ambassador to the Union of Soviet Socialist Republics (USSR) in 1990, endorsed this view, arguing that Gorbachev received a ''clear commitment that if Germany united, and stayed in NATO, the borders of NATO would not move eastward.'' Pointing to comments recorded by the journalists Michael Beschloss and Strobe Talbott, former U.S. defense secretary Robert McNamara averred that ''the United States pledged never to expand NATO eastward if Moscow would agree to the unification of Germany.'' According to this view, ''the Clinton administration reneged on that commitment . . . when it decided to expand NATO to Eastern Europe.''

Abstract:: The most important and most overlooked energy issue today is the growing crisis of global energy supply. Cheap, industrial-scale energy is essential to building, transporting, and operating everything we use, from refrigerators to Internet server farms to hospitals. It is desperately needed in the undeveloped world, where 1.6 billion people lack electricity, which contributes to untold suffering and death. And it is needed in ever-greater, more-affordable quantities in the industrialized world: Energy usage and standard of living are directly correlated. Every dollar added to the cost of energy is a dollar added to the cost of life. And if something does not change soon in the energy markets, the cost of life will become a lot higher. As demand increases in the newly industrializing world, led by China and India, supply stagnates-meaning rising prices as far as the eye can see. What is the solution? We just need the right government "energy plan," leading politicians, intellectuals, and businessmen tell us. Of course "planners" such as Barack Obama, John McCain, Al Gore, Thomas L. Friedman, T. Boone Pickens, and countless others favor different plans with different permutations and combinations of their favorite energy sources (solar, wind, biomass, ethanol, geothermal, occasionally nuclear and natural gas) and distribution networks (from decentralized home solar generators to a national centralized so-called smart grid). But each agrees that there must be a plan-that the government must lead the energy industry using its power to subsidize, mandate, inhibit, and prohibit. And each claims that his plan will lead to technological breakthroughs, more plentiful energy, and therefore a higher standard of living. Consider Nobel Peace Prize winner Al Gore, who claims that if only we follow his "repower American plan"-which calls for the government to ban and replace all carbon-emitting energy (currently 80 percent of overall energy and almost 100 percent of fuel energy) in ten years-we would be using fuels that are not expensive, don't cause pollution and are abundantly available right here at home. . . . We have such fuels. Scientists have confirmed that enough solar energy falls on the surface of the earth every 40 minutes to meet 100 percent of the entire world's energy needs for a full year. Tapping just a small portion of this solar energy could provide all of the electricity America uses. And enough wind power blows through the Midwest corridor every day to also meet 100 percent of US electricity demand. Geothermal energy, similarly, is capable of providing enormous supplies of electricity for America. . . . [W]e can start right now using solar power, wind power and geothermal power to make electricity for our homes and businesses. And Gore claims that, under his plan, our vehicles will run on "renewable sources that can give us the equivalent of $1 per gallon gasoline." Another revered thinker, Thomas L. Friedman, also speaks of the transformative power of government planning, in the form of a government-engineered "green economy." In a recent book, he enthusiastically quotes an investor who claims: "The green economy is poised to be the mother of all markets, the economic investment opportunity of a lifetime." Friedman calls for "a system that will stimulate massive amounts of innovation and deployment of abundant, clean, reliable, and cheap electrons." How? Friedman tells us that there are two ways to stimulate innovation-one is short-term and the other is long-term-and we need to be doing much more of both. . . . First, there is innovation that happens naturally by the massive deployment of technologies we already have [he stresses solar and wind]. . . . The way you stimulate this kind of innovation-which comes from learning more about what you already know and doing it better and cheaper-is by generous tax incentives, regulatory incentives, renewable energy mandates, and other market-shaping mechanisms that create durable demand for these existing clean power technologies. . . . And second, there is innovation that happens by way of eureka breakthroughs from someone's lab due to research and experimentation. The way you stimulate that is by increasing government-funded research. . . . The problem with such plans and claims: Politicians and their intellectual allies have been making and trying to implement them for decades-with nothing positive (and much negative) to show for it. For example, in the late 1970s, Jimmy Carter heralded his "comprehensive energy policy," claiming it would "develop permanent and reliable new energy sources." In particular, he (like many today) favored "solar energy, for which most of the technology is already available." All the technology needed, he said, "is some initiative to initiate the growth of a large new market in our country." Since then, the government has heavily subsidized solar, wind, and other favored "alternatives," and embarked on grand research initiatives to change our energy sources-claiming that new fossil fuel and nuclear development is unnecessary and undesirable. The result? Not one single, practical, scalable source of energy. Americans get a piddling 1.1 percent of their power from solar and wind sources, and only that much because of national and state laws subsidizing and mandating them. There have been no "eureka breakthroughs," despite many Friedmanesque schemes to induce them, including conveniently forgotten debacles such as government fusion projects, the Liquid Fast Metal Breeder Reactor Program, and the Synfuels Corporation. Many good books and articles have been written-though not enough, and not widely enough read-chronicling the failures of various government-sponsored energy plans, particularly those that sought to develop "alternative energies," over the past several decades. Unfortunately, the lesson that many take from this is that we must relinquish hope for dramatic breakthroughs, lower our sights, and learn to make do with the increasing scarcity of energy. But the past failures do not warrant cynicism about the future of energy; they warrant cynicism only about the future of energy under government planning. Indeed, history provides us ample grounds for optimism about the potential for a dynamic energy market with life-changing breakthroughs-because America once had exactly such a market. For most of the 1800s, an energy market existed unlike any we have seen in our lifetimes, a market devoid of government meddling. With every passing decade, consumers could buy cheaper, safer, and more convenient energy, thanks to continual breakthroughs in technology and efficiency-topped off by the discovery and mass availability of an alternative source of energy that, through its incredible cheapness and abundance, literally lengthened and improved the lives of nearly everyone in America and millions more around the world. That alternative energy was called petroleum. By studying the rise of oil, and the market in which it rose, we will see what a dynamic energy market looks like and what makes it possible. Many claim to want the "next oil"; to that end, what could be more important than understanding the conditions that gave rise to the first oil? Today, we know oil primarily as a source of energy for transportation. But oil first rose to prominence as a form of energy for a different purpose: illumination. For millennia, men had limited success overcoming the darkness of the night with man-made light. As a result, the day span for most was limited to the number of hours during which the sun shone-often fewer than ten in the winter. Even as late as the early 1800s, the quality and availability of artificial light was little better than it had been in Greek and Roman times-which is to say that men could choose between various grades of expensive lamp oils or candles made from animal fats. But all of this began to change in the 1820s. Americans found that lighting their homes was becoming increasingly affordable-so much so that by the mid-1860s, even poor, rural Americans could afford to brighten their homes, and therefore their lives, at night, adding hours of life to their every day. What made the difference? Individual freedom, which liberated individual ingenuity. The Enlightenment and its apex, the founding of the United States of America, marked the establishment of an unprecedented form of government, one established explicitly on the principle of individual rights. According to this principle, each individual has a right to live his own life solely according to the guidance of his own mind-including the crucial right to earn, acquire, use, and dispose of the physical property, the wealth, on which his survival depends. Enlightenment America, and to a large extent Enlightenment Europe, gave men unprecedented freedom in the intellectual and economic realms. Intellectually, individuals were free to experiment and theorize without restrictions by the state. This made possible an unprecedented expansion in scientific inquiry-including the development by Joseph Priestly and Antoine Lavoisier of modern chemistry, critical to future improvements in illumination. Economically, this freedom enabled individuals to put scientific discoveries and methods into wealth-creating practice, harnessing the world around them in new, profitable ways-from textile manufacturing to steelmaking to coal-fired steam engines to illuminants.

Abstract:: Al-Qa`ida's strategy in Pakistan remains intentionally opaque, but has demonstrably shifted in recent years to promote increased confrontation with the Pakistani state. Al-Qa`ida's fighters originally used Pakistan as a key logistics base and facilitation point for the Afghan and Arab mujahidin during the 1980s, but since 2001 Pakistan has served primarily as an operational safe haven where al-Qa`ida and its affiliates can plan local, regional and international terrorist attacks. Pakistan's Federally Administered Tribal Areas (FATA) and smaller parts of Baluchistan and the North-West Frontier Province (NWFP) comprise al-Qa`ida's physical center of gravity. Increasingly, however, al-Qa`ida has utilized its media prowess and ideological authority to discredit the Pakistani state and promote cooperation among a variety of Pakistani militants to challenge the state's authority and undermine its support for U.S. efforts in Afghanistan.

Abstract:: Throughout history, shifts in governing coalitions have critically affected war termination. For example, the execution of the Athenian democratic ruler Cleophon and the ascendancy of the pro-Spartan oligarchs in B.C. 404 led to Athens' surrender to Sparta and ended the twenty-seven-year Second Peloponnesian War. Similarly, the death of Russian Empress Elizabeth in January 1762 led her Prussophile successor, Peter III, to immediately recall Russian armies that were occupying Berlin and conclude the Treaty of Saint Petersburg by May—ending the fighting between Russia and Prussia in the Seven Years' War. During World War I, riots in Germany ushered in a new government that then negotiated the final war armistice, as Kaiser Wilhelm II fied to Holland. Likewise, during World War II, France and Italy surrendered shortly after changes in their governing coalitions, in 1940 and 1943, respectively. Most recently, on his first full day in office, U.S. President Barack Obama summoned senior officials to the White House to begin fulfilling his campaign promise to pull combat forces out of the war in Iraq.

Emblematic of the rule of law and its New World Order, it is often invoked for the 'authorisation' it gave to Member States of the United Nations 'co-operating with the Government of Kuwait ... to use all necessary means to uphold and implement resolution 660 (1990) and all subsequent resolutions and to restore international peace and security in the area' - but this provision was made contingent upon whether 'Iraq on or before 15 January 1991 fully implements [previous] resolutions'. We examine the range of circumstances in which threats of force have arisen and find that these go beyond the archetypal 'close encounter' between states - such as the Cuban Missile Crisis of 1962 and the 'threats of force' directed against Iraq prior to Operation Desert Fox (1998) and Operation Iraqi Freedom (2003). Making use of the jurisprudence of the International Court of Justice from its Nuclear Weapons advisory opinion (1996), we advance the idea of a prohibition of the application of force, and consider the logistics of its operation in state practice; first, in the recent relations between the United States and Iran and, then, through a modern reprise of the facts of the Corfu Channel Case of April 1949. We allude to the importance of the legislative background and purpose behind this prohibition, constantly reflecting upon the intricacies of state relations in which this provision of the United Nations Charter seeks to make its mark.

151. Piracy, Law of the Sea, and Use of Force: Developments off the Coast of Somalia

Abstract:: Attacks against ships off the coast of Somalia have brought piracy to the forefront of international attention, including that of the Security Council. SC Resolution 1816 of 2008 and others broaden the scope of the existing narrow international law rules on piracy, especially authorizing certain states to enter the Somali territorial waters in a manner consistent with action permitted on the high seas. SC resolutions are framed very cautiously and, in particular, note that they 'shall not be considered as establishing customary law'. They are adopted on the basis of the Somali Transitional Government's (TFG) authorization. Although such authorization seems unnecessary for resolutions adopted under Chapter VII, there are various reasons for this, among which to avoid discussions concerning the width of the Somali territorial sea. Seizing states are reluctant to exercise the powers on captured pirates granted by UNCLOS and SC resolutions. Their main concern is the human rights of the captured individuals. Agreements with Kenya by the USA, the UK, and the EC seek to ensure respect for the human rights of these individuals surrendered to Kenya for prosecution. Action against pirates in many cases involves the use of force. Practice shows that the navies involved limit such use to self-defence. Use of force against pirates off the coast of Somalia seems authorized as an exception to the exclusive rights of the flag state, with the limitation that it be reasonable and necessary and that the human rights of the persons involved are safeguarded.

This article examines how these new directions are playing out in the Middle East, one of the world's most turbulent regions which also has crucial economic and strategic importance for Turkey. 160. Copenhagen's Inconvenient Truth

Abstract:: This December, diplomats from nearly 200 countries will gather in Copenhagen to negotiate a successor to the 1997 Kyoto Protocol, which for the first time bound wealthy countries to specific cuts in greenhouse gas emissions. Most of these emissions come from burning fossil fuels -- coal, oil, and natural gas -- for energy, from deforestation, and from the agricultural sector. They must be cut deeply in the coming decades if the world is to control the risks of dangerous climate change. Most of those devoted to slashing the world's greenhouse gas emissions have placed enormous weight on the Copenhagen conference. Speaking earlier this year about the conference, UN Secretary-General Ban Ki-moon was emphatic: "We must harness the necessary political will to seal the deal on an ambitious new climate agreement in December here in Copenhagen. . . . If we get it wrong we face catastrophic damage to people, to the planet." Hopes are higher than ever for a breakthrough climate deal. For the past eight years, many argued that developing nations reluctant to commit to a new global climate-change deal -- particularly China and India -- were simply hiding behind the United States, whose enthusiastic engagement was all that was needed for a breakthrough. Now the long-awaited shift in U.S. policy has arrived. The Obama administration is taking ambitious steps to limit carbon dioxide emissions at home, and Congress is considering important cap-and-trade and clean-energy legislation. The road to a global treaty that contains the climate problem now appears to be clear. But it is not so simple. The odds of signing a comprehensive treaty in December are vanishingly small. And even reaching such a deal the following year would be an extraordinary challenge, given the domestic political constraints in Washington and in other capitals that make such an agreement difficult to negotiate and ratify. The many government officials and activists seeking to solve the climate problem therefore need to fundamentally rethink their strategy and expectations for the Copenhagen conference.

Abstract:: China has challenged the United States on multiple policy fronts since the beginning of 2009. On the security dimension, Chinese ships have engaged in multiple skirmishes with U.S. surveillance vessels in an effort to hinder American efforts to collect naval intelligence. China has also pressed the United States on the economic policy front. Prime Minister Wen Jiabao told reporters that he was concerned about China's investments in the United States: “We have lent a huge amount of money to the U.S. Of course we are concerned about the safety of our assets. To be honest, I am definitely a little worried.” The head of the People's Bank of China, Zhou Xiaochuan, followed up with a white paper suggesting a shift away from the dollar as the world's reserve currency. China's government has issued repeated calls for a greater voice in the International Monetary Fund (IMF) and World Bank. To bolster this call, Beijing helped to organize a summit of the leaders of Brazil, Russia, India, and China (BRIC) to better articulate this message.

162. China's Economic Policy in the Time of the Global Financial Crisis: Which Way Out?

Abstract:: This contribution analyses the impact of the global financial crisis on the Chinese economy and the policies implemented by the Chinese government to cope with it. We argue, first, that China has not been able to decouple its economic performance from that of the U.S. and other developed countries. Second, although economic growth in the second quarter of 2009 showed that the stimulus package is working, the current development does not seem to be sustainable. In order to avoid another round of overheating, the government needs to adjust its stimulus policy. Third, the current crisis offers opportunities to conduct necessary structural adjustments in favour of more market-based and innovative industries, more investment by private companies and a stronger role of private consumption in economic growth. Fourth, with the external demand from the OECD countries declining, Chinese export companies need to further diversify their international markets and re-orient their production and sales strategies to some extent towards the domestic market.

Abstract:: In contrast to the hectic third quarter of the Beijing Olympics and South Ossetia, the last quarter of 2008 was calmer for Russia and China. Their bilateral relations, nonetheless, seemed to become more substantive. The 13th annual Prime Ministerial Meeting in Moscow in late October and the 13th session of the Russian-Chinese Intergovernmental Commission on Military-Technical Cooperation in Moscow in early December provided some fresh impetus for the impasse in two important areas of bilateral relations: the long-awaited oil pipeline to China and military relations. Separately, the quarter also witnessed the final, albeit low-key, ceremony for settling the last territorial issue when Russia officially transferred to China control of one and a half islands of the disputed territory near Khabarovsk. However, the world around Russia and China was in turmoil not only because of the financial tsunami that was leaving no nation behind, but also because of regional crises between India and Pakistan as well as Israel and Palestine, and the stagnation in the Korea denuclearization process.

Abstract:: Secretary of State Hillary Clinton's choice of Japan, Indonesia, South Korea, and China for her first official trip overseas helped shine a spotlight on Asia as a high priority region this quarter, as did North Korean Dear Leader Kim Jong-il's announcement that he intended to conduct a satellite launch in early April. The drama surrounding the anticipated launch provided an unfortunate back drop for otherwise very positive pronouncements about intended Obama administration policies in East Asia, even if the quarter closed with only a handful of those eventually to be tasked with implementing these policies at their desks. ASEAN leaders finally held their postponed summit and celebrated the entry into force of their much-maligned Charter. Meanwhile, Australian Prime Minister Kevin Rudd visited Washington to underscore that the U.S. and Australia are still “mates,” even as his reluctance to send more combat forces to Afghanistan foreshadowed the difficulty President Obama faces in getting allies to sign up for his “surge” there. Finally, economic forecasts kept being adjusted downward as Asian leaders prepared for the G20 summit in London in hopes that this would bring a turnaround.

Abstract:: A new calendar year did little to change the tenor of Japanese domestic politics as the public became increasingly frustrated with parliamentary gridlock and the leadership of Prime Minister Aso Taro, whose approval rating plummeted amid a deepening recession. Opposition leader Ozawa Ichiro continued pressure tactics against the government and became the favorite to succeed Aso until the arrest of a close aide damaged his reputation and stunted momentum for a snap election. Aso demonstrated the art of political survival, touting the urgency of economic stimulus over a poll he could easily lose and which need not take place until the fall. In an effort to prevent political turmoil from weakening Japan's global leadership role, the government dispatched two Maritime Self-Defense Force (MSDF) destroyers to participate in antipiracy operations in the Gulf of Aden.

Abstract:: The quarter ended with the question of whether President Obama's first late-night crisis phone call – the metric for leadership bandied about during the campaign – would be over a ballistic missile test by North Korea. The suspenseful end to the quarter contrasted with its quiet start where the focus of U.S.-ROK bilateral relations was on initial contacts between the Lee and Obama administration teams and policy coordination over the global financial crisis, while the North Korea missile launch issue slowly but steadily moved from a simmer to a slow boil. However events unfold, the launch itself gives the new administration its first taste of North Korean bad behavior and confronts it with the problem of finding the right balance between under- and over-reaction that is needed to move denuclearization negotiations forward.

Abstract:: The bilateral dialogue in the first quarter of the year was cordial, if somewhat distant. The administration of President Barack Obama sent clear and positive signals to the Kremlin. At times President Dmitry Medvedev and Prime Minister Vladimir Putin reciprocated with positive language; at times Moscow's negative rhetoric reappeared. Clearly the Russian leadership has been making a cautious assessment of the new U.S. leader. Optimism was again evident at the London meeting between Obama and Medvedev on the eve of the G20 summit on global economic issues. In London, the two leaders pledged cooperation on a variety of issues, centering on arms control. There has been nothing positive in the bilateral relationship to report since last April when then-President George W. Bush visited then-President Putin at Sochi. Since that time, the relationship has plunged to depths unseen since the Cold War. Although many observers wish to see progress (and have come to forecast it), there is clearly much work to be done to repair the rift that has developed over the past six years.

Abstract:: Secretary of State Hillary Clinton's visit to Indonesia, part of her initial overseas journey to Asia, was enthusiastically received in the world's most populous Muslim country. The secretary praised Indonesia's thriving democracy as evidence of the compatibility of Islam and political pluralism. Noting Southeast Asia's importance to the U.S., Clinton announced that the State Department would begin consideration of a process to sign ASEAN's Treaty of Amity and Cooperation, a prerequisite for membership in the East Asia Summit. She also acknowledged that Washington's harsh sanctions against Burma's military junta had not changed that regime's draconian rule but also pointed out that ASEAN's engagement strategy was equally impotent. Nevertheless, she stated that the U.S. would consult with ASEAN in the process of reviewing its Burma policy. Meanwhile, ASEAN held its 14th summit in Thailand at the end of February. While the global economic crisis dominated the agenda, the future of a human rights commission mandated by ASEAN's new Charter proved the most contentious, with the more authoritarian ASEAN members insisting that noninterference in domestic affairs should remain the underlying principle of any human rights body.

Abstract:: Southeast Asian and broader international attention focused in March on the confrontation between five Chinese government ships and the U.S. surveyor ship USNS Impeccable in the South China Sea near Hainan Island. U.S. and Chinese protests and related media commentary highlighted for Southeast Asian audiences a pattern of U.S. surveillance to learn more about China's growing military presence and activities in the area, and a pattern of China's unwillingness to tolerate such actions in areas where it claims rights that are disputed by the U.S. and other naval powers. The protests and commentary provided a vivid backdrop for China's continued efforts to claim and defend territory in the South China Sea that is also claimed by Southeast Asian nations. Meanwhile, there was little good news on the economic front as China's international trade and economic interchange with Southeast Asia continued to fall rapidly. Chinese diplomatic and political attention to the region remained low during the quarter.

Abstract:: Looking back, it was a hostage to fortune to title our last quarterly review: “Things can only get better?” Even with that equivocating final question mark, this was too optimistic a take on relations between the two Koreas – which, as it turned out, not only failed to improve but deteriorated further in the first months of 2009. Nor was that an isolated trend. This was a quarter when a single event – or more exactly, the expectation of an event – dominated the Korean Peninsula and Northeast Asia more widely. Suspected since January, announced in February and awaited throughout March, despite all efforts to dissuade it North Korea's long-anticipated Taepodong launched on April 5. This too evoked a broader context, and a seeming shift in Pyongyang. Even by the DPRK's unfathomable logic, firing a big rocket – satellite or no – seemed a rude and perverse way to greet a new U.S. president avowedly committed to engagement with Washington's foes. Yet, no fewer than four separate senior private U.S. delegations, visiting Pyongyang in unusually swift succession during the past quarter, heard the same uncompromising message. Abstract:: Australia's government swung from the right to the left of the political spectrum in 2007. The U.S. did the same in 2008. Yet, not much changed in the fundamentals of the 57-year-old U.S.-Australia alliance. The assertion of alliance continuity, however, comes with a major caveat: the tectonic effects being exerted by China's rise. As with the rest of the Asia-Pacific, Australia is adjusting significant aspects of its foreign and security policy to the magnetic pull of China, which was dramatized for Canberra through the middle of 2009 by an outburst of Chinese official anger directed at Australia. Other important influences to consider include the so-called “Kevin Rudd” effect, the global economic crisis, and the ongoing conflicts in the Middle East.

Abstract:: In 2001 approximately 100 Central Intelligence Agency officers, 350 U.S. Special Forces soldiers, and 15,000 Afghans overthrew the Taliban regime in less than three months while suffering only a dozen U.S. fatalities. They were supported by as many as 100 U.S. combat sorties per day. Some individuals involved in the operation argued that it revitalized the American way of war. This initial success, however, transitioned into an insurgency, as the Taliban and other insurgent groups began a sustained effort to overthrow the Afghan government. The fighting, which began in 2002, had developed into a full-blown insurgency by 2006. During this period, the number of insurgent-initiated attacks rose by 400 percent, and the number of deaths from these attacks by more than 800 percent. The increase in violence was particularly acute between 2005 and 2006, when the number of suicide attacks quintupled from 27 to 139; remotely detonated bombings more than doubled from 783 to 1,677; and armed attacks nearly tripled from 1,558 to 4,542. Insurgent-initiated attacks rose another 27 percent between 2006 and 2007. The result was a lack of security for Afghans and foreigners.

Abstract:: Though it lags behind the privatization of military services, the privatization of intelligence has expanded dramatically with the growth in intelligence activities following the 11 September 2001 attacks on the United States. The recent confi rmation by the Director of the CIA that contractors have probably participated in waterboarding of detainees at CIA interrogation facilities has sparked a renewed debate over what activities it is appropriate to delegate to contractors, and what activities should remain ' inherently governmental ' . The article surveys outsourcing in electronic surveillance, rendition, and interrogation, as well as the growing reliance on private actors for analysis. It then turns to three challenges to accountability: the necessary secrecy that limits oversight; the different incentives that exist for private rather than public employees; and the uncertainty as to what functions should be regarded as ' inherently governmental ' and thus inappropriate for delegation to private actors.

Abstract:: Despite the success of the U.S. military in conventional warfare, recent experiences in Iraq and Afghanistan have illustrated the challenges of pursuing a counter-insurgent strategy against “asymmetric threats” such as improvised explosive devices or suicide bombers. The “asymmetric” strategy often adopted by insurgents allows a relatively weak for ce to incapacitate a stronger one by exploiting the stronger force's vulnera-bilities rather than meeting it head-on in conventional com-bat. Our current wars have focused national attention on the ability of the Army and Marine Corps to cope with this “asymmetric” environment, yet the influence of airpower has been conspicuously missing from the debate. Even the core military doctrine for counterinsurgency, or COIN, fails to acknowledge the benefits that airpower can play against these asymmetric threats. The Army and Marine Corps recently released Field Manual (FM) 3-24, Counterinsurgency (designated by the Marine Corps as Warfighting Publication 3-33.5), an impressive and influential 282-page document that skillfully addresses many difficult COIN issues. This doctrine is viewed as the overall plan for COIN operations in Iraq, and will likely become the centerpiece of new joint COIN doctrine that will guide all the armed services. Regrettably, this impressive document fails to inform the COIN strategist, and policymakers, on the influence of highly integrated joint COIN strategy. Rather, it treats the influence of airpower as an adjunct capability confined to a short, five-page annex of “supplemental information.” By failing to integrate the full potential of today's airpower capabilities and by focusing almost exclusively on only the ground dimension, FM 3-24 falls short of offering U.S. decisionmakers a pragmatic, joint solution for the challenge of COIN. The current doctrine fails to integrate all aspects of military power that may be implemented for the most effective counterinsurgency campaign. By failing to integrate airpower (or seapower) into this cornerstone doctrine document, U.S. and coalition forces risk planning operations in a dis-jointed fashion where planners do not understand the strengths and weaknesses of service capabilities. This paper examines the influence of airpower on COIN strategy and articulates the benefits of an integrated joint COIN doctrine to combat effectively the insurgents in Iraq and Afghanistan.

Abstract:: One of the greatest challenges of the twenty-first century will be to address the growing mutual suspicion, fear, and misunderstanding between Western and Muslim societies. Within the United States, in particular, there is an increase in Islamophobia, which seeks to dominate the discussion surrounding Islam and Muslims by linking it to the actions and views of an extremist minority. Within this tense environment, a number of organizations and initiatives have taken steps to urge greater dialogue between the West and the Muslim world on an international level. Oftentimes, this is done with the underlying understanding that there is a bifurcation between “the West” and the “Muslim” and/or “Islamic world.” As such, the primary focus is not placed on changing negative perceptions of Islam in the West, but rather, to improve the image of the West in the Muslim world. The fact that Islam exists within the West, and, for the purposes of this article, in America, is often overlooked. Nonetheless, there are an estimated three to seven million Muslims living in America and a greater number of them are second or third generation Americans. The American Muslim community, especially its youth, is at a unique position in history because they actively engage in the process of reconciling its Muslim as well as American identities in the public sphere. Young American Muslims have the capacity to decrease the negative views that some Americans may have towards Islam. This article explores the specific role that the younger generation of American Muslims plays in using cultural expression to bridge the gap between Western and Muslim societies.

Abstract:: The cancellation of a draft peace agreement between the Moro Islamic Liberation Front and the Philippine government triggered renewed violence in the Philippine south and allegations that U.S. forces are involved in Philippine armed forces suppression activities. Both Manila and Washington deny the charges, though U.S. Special Operations Forces have been training the Philippine military in Mindanao since 2002. The U.S. has added new sanctions against Burma's junta and continues to criticize its political repression, while aid for the victims of Cyclone Nargis remains under the Burmese military's control. Ratification for ASEAN's new Charter by its member states has been achieved by eight of the 10 countries. The delays include concerns in the Indonesian and Philippine legislatures about Burma's detention of Aung San Suu Kyi as well as the junta's insistence that any ASEAN Human Rights Commission be toothless. The U.S. State Department has expressed concern over the Malaysian government's arrest of opposition leader Anwar Ibrahim on suspicious sodomy charges. Malaysian leaders responded angrily that the U.S. complaint constitutes interference in Kuala Lumpur's domestic politics and that Washington is not “the policeman of the world.”

Cet article propose, au contraire, l'hypothèse que la question de la « religion civile » se situe au coeur de la spécificité de la laïcité française dans sa dimension historique comme dans son actualité. La Cour constitutionnelle italienne considère, depuis 1989, le principe de laïcité comme fondamental ; plusieurs pays (Portugal, Russie) ont inscrit la laïcité dans leur Constitution ; le Québec a explicitement laïcisé ses écoles en 2000, etc. Et, pourtant, la laïcité continue d'apparaître souvent comme une « exception française » Or cette exceptionnalité n'est nullement conforme à la pensée des pères fondateurs de la laïcité française : Ferdinand Buisson, le maître d'oeuvre (au côté de Jules Ferry et de ses successeurs) de la laïcisation de l'école, et Aristide Briand, l'auteur principal de la loi de séparation des Églises et de l'État de 1905, envisageaient la laïcité de façon universaliste et non substantialiste : il existe pour eux des pays plus ou moins laïques, et la France n'est pas le pays le plus laïque du globe.
