201. Bracing for Cold Peace. US-Russia Relations after Ukraine

Abstract:: The crisis in Ukraine has turned the tables of the post-Cold War relationship between the United States and Russia. The ongoing transformation can result in a number of outcomes, which can be conceived in terms of scenarios of normalisation, escalation and 'cold peace' - the latter two scenarios being much more probable than the first. NATO ought to shore up its defences in Central and Eastern Europe while Washington and its allies engage in a comprehensive political strategy of 'new containment'. This means combining political and economic stabilisation of the transatlantic area with credible offers of benefits to partners in the East and pragmatic relations with Russia which are neither instrumentalised (as was the case with the 'reset') nor naïvely conceived as a 'partnership'.

202. The European Endowment for Democracy and Democracy Promotion in the EU Neighbourhood

Abstract:: The European Endowment for Democracy (EED) is a recently established instrument of democracy promotion intended to complement existing EU tools. Fashioned after the US National Endowment for Democracy, the EED's privileged area of action is the European neighbourhood. Meant as a small rapid-response, actor-oriented 'niche' initiative, its main task is to select those actors, from both civil and political society able to produce a change in their country. The EED represents a step forward in the EU's capacity to foster democracy, but does not necessarily go in the direction of more rationality and effectiveness. Not all EU member states support the EED with the same enthusiasm and it is still not clear how it fits into the EU's overall democracy promotion architecture. Its actions may be successful in a very constrained timeframe. However, recent crises at the EU's borders would seem to call for a strategy that takes into consideration systemic hindrances, post-regime change complexities, regional dynamics and finally rival plans of autocracy promotion.

Abstract:: I think it is difficult to contest that the most important state player in world affairs over the last one hundred years – and consistently so over this period – has been the United States of America. World War I – into which, to borrow from Christopher Clark's justly celebrated book, we 'sleepwalked' – marks a useful starting point. It is not only the fairly important role America played in bringing WWI to an end that signals the beginning of this era, but also the no less important role it played in shaping the aftermath. Wilson's 14 points were considered at the time 'idealistic' by some of the yet-to-be 'Old Powers'. But by dismantling the Ottoman Empire through the principle of self-determination (not at that time a universal legally binding norm) it was an early swallow to the demise, a mere generation later, of all other colonial empires and the truly decisive reshaping of the balance of power in the post-WWII world. The US played an equally cardinal role in ideating and realizing the United Nations Organization and the Universal Declaration of Human Rights – two lynchpins of our current world order.

204. The Politics of Interest in International Law

Abstract:: The article examines the substance and form of 20th century positivist international law; in particular the way in which each determines the other. The text describes the turn to interests in international law, which evolved slowly in scope and depth. By examining Lassa Oppenheim's focus on 'common interests' that united states and Hans Kelsen's focus on the 'struggle of interests' that constituted politics, the article studies two phenomena produced by the foundational role taken by interests during the 20th century. First, this role contributed to putting an end to the moral discussion about the treatment of native populations. Secondly, it curbed debate about a common political project for a global order, thus creating conformity characterized by abuse of power – all in the name of the neutrality of positivist law. This article suggests that the work of these two leading theoreticians in the field has contributed to the shaping of the legal theory of mainstream positivist international law, and seeks to foreground discussions about the different theories on the role of law in politics. In this manner it aims to help reconceptualize law in such a way as to bring about a situation in which discussions of a common political project for the international arena are more central.

Abstract:: Approval from the United Nations or NATO appears to have become a necessary condition for US humanitarian military intervention. Conventional explanations emphasizing the pull of legitimacy can- not fully account for this given that US policymakers vary consider- ably in their attachment to multilateralism. This article argues that America’s military leaders, who are consistently skeptical about humanitarian intervention and tend to emphasize its costs, play a central role in making multilateral approval necessary. As long as top-ranking generals express strong reservations about intervention and no clear threat to US national security exists, they can veto the use of force. In such circumstances, even heavyweight “humani- tarian hawks” among the civilian leadership, who initially may have wanted to bypass multilateral bodies to maximize US freedom of action, can be expected to recognize the need for UN or NATO approval—if only as a means of mollifying the generals by reas- suring them about the prospect of sustained multilateral burden sharing. Two case studies drawing on interviews with senior civil- ian and military officials illustrate and probe the plausibility of the argument.

206. “Creating a Home away from Home”: Chinese Undergraduate Student Enclaves in US Higher Education

Abstract:: This paper draws on the theory of ethnic enclaves to study Chinese international student communities and their role in constructing Chinese undergraduate student experiences on US campuses. Enclave theory has primarily been used by sociologists to study immigrant and diaspora populations, but it can also provide an important analytical tool for scholars examining the internationalisation of student populations in higher-education settings. Student interviews and participant observation at a representative research-intensive, doctoral-granting institution in the American Midwest indicate that institutional and media characterisations of Chinese international student communities as closed and segregated are far too simplistic. Chinese student enclaves provide their members with crucial information, support, and social spaces that help them adapt to – and in turn change – their host institutions. Chinese students are active participants in and creators of campus cultures that are often in- visible to university administrators, faculty, and peers.

207. Tana Johnson. Organizational Progeny. Why Governments are Losing Control over the Proliferating Structures of Global Governance

Abstract:: According to mainstream functionalist theories of international law and relations, international organizations are vehicles of states, tied to their masters by meticulous legal instructions. As Jan Klabbers recently pointed out in this journal,1 functionalism was based on the idea of establishing peace by channelling international relations into the purportedly technical, a-political realm of international organizations. Research of the last couple of decades has profoundly rebutted the assumption that international organizations are a-political. They have been discovered, among others, to serve as platforms for the formation of epistemic communities, as agorae for political deliberation and contestation or to use their bureaucratic potential and the flexibility of their mandates to establish a degree of independence from their principals. The book by Tana Johnson, professor of political science at Duke University, adds another important perspective that has not been explored so far. She turns our attention to the fact that institutional design might matter for the international organization’s independence from member states. As chief witness for her thesis, she summons the Intergovernmental Panel on Climate Change (IPCC). Originally a brainchild of the US government, it is today a fairly independent institution fallen from grace with its master. Johnson argues that it owes its independence to the influence of international bureaucracies – that is, staff of other international organizations, upon the process that led to its establishment. The thesis puts the spotlight on the fact that a majority of new international organizations that saw the light of the day during the last decades was fostered by pre-existing international organizations.

Abstract:: The tale of the Chagos Archipelago (British Indian Ocean Territory, BIOT) raises a wide spectrum of transnational legal questions, all across the fields of human rights, environment and disarmament. Last-born of the Empire’s colonies, the BIOT was established – and systematically depopulated – for the sole purpose of accommodating a strategic US military base during the Cold War years in 1965–1966. The territory has since generated extensive litigation in the national courts of the United Kingdom (UK) and the USA as well as proceedings in the European Court of Human Rights and an arbitration under Annex VII of the Convention on the Law of the Sea (UNCLOS). Stephen Allen, senior lecturer at the University of London’s Queen Mary College, has long followed and commented on legal developments in the Chagos cases as an observer. The focus of his attention remains the plight of the native Chagossians, a small Kreol-speaking people of African and Malgasy origin, whose exile (mainly to Mauritius, the Seychelles and the UK) has lasted for more than 40 years.

209. Humanity Considerations Cannot Reduce Wars Hazards Alone: Revitalizing the Concept of Military Necessity

Abstract:: The exercise of brute force by militaries, though common, reflects professional incompetency. A well-trained military has an inherent interest in enhancing its operational effectiveness and constraining unnecessary brutality. The law of armed conflict, however, generally ignores the constraining effect of the necessity principle, originally intended to allow only the minimally necessary use of force on the battlefield. Consequently, the prevailing law places the burden of restricting the exercise of brute military force upon humanitarian considerations (and the specific norms derived from them). Humanity alone, however, cannot deliver the goods and substantially reduce war’s hazards. This article challenges the current dichotomy between the two pillars – mistakenly assumed to be polar opposites – of the law of armed conflict: necessity and humanity. It calls for the transformation of the military’s self-imposed professional constraining standards into a revised legal standard of necessity. Though the necessity principle justifies the mere use of lethal force, it should not only facilitate wielding the military sword but also function simultaneously as a shield, protecting combatants and non-combatants alike from excessive brutality. The suggested transformation would bind and restrain the prospective exercisers of excessive force, political and military alike, and restrict the potential damage that might be caused both intentionally (to combatants) and collaterally (to non-combatants). The combined effect of the current changes in war’s pattern and the law of armed conflict, in the military and social thinking of recent decades, and the new strategies available due to the development of new military technologies have all created a new war environment – one that may be ready to leverage the constraining potential of military professionalism into a binding legal standard and norms.

210. The Myth of Entangling Alliances: Reassessing the Security Risks of U.S. Defense Pacts

Abstract:: A large literature assumes that alliances entangle the United States in military conflicts that it might otherwise avoid. Since 1945, however, there have been only five cases of what might be characterized as U.S. entanglement—the 1954 and 1995–96 Taiwan Strait crises, the Vietnam War, and the interventions in Bosnia and Kosovo in the 1990s—and even these cases are far from clear-cut. U.S. entanglement is rare because the United States, as a superpower with many allies, is capable of exploiting loopholes in alliance agreements, sidestepping commitments that seriously imperil U.S. interests, playing the demands of various allies off of each other, and using alliances to deter adversaries and allies from initiating or escalating conflicts.

211. A U.S.-China Grand Bargain? The Hard Choice between Military Competition and Accommodation

Abstract:: Despite the intense focus on China's rise, the United States has yet to confront the most challenging question posed by this power shift: Should it pursue a strategy of limited geopolitical accommodation to avoid conflict? U.S. policy continues to focus almost entirely on preserving the geopolitical status quo in Northeast Asia. Given the shifting power balance in Asia, however, there are strong theoretical rationales for considering whether significant changes to the status quo could increase U.S. security. A possibility designed to provide the benefits of accommodation while reducing its risks is a grand bargain in which the United States ends its commitment to defend Taiwan and, in turn, China peacefully resolves its maritime disputes in the South China and East China Seas and officially accepts the United States' long-term military security role in East Asia. In broad terms, the United States has three other options—unilateral accommodation, a concert of Asian powers, and the current U.S. rebalance to Asia. Unilateral accommodation and the rebalance have advantages that make the choice a close call, but all things considered, a grand bargain is currently the United States' best bet.

212. Alliance Coercion and Nuclear Restraint: How the United States Thwarted West Germany's Nuclear Ambitions

Abstract:: When does a nuclear-armed state's provision of security guarantees to a militarily threatened ally inhibit the ally's nuclear weapons ambitions? Although the established security model of nuclear proliferation posits that clients will prefer to depend on a patron's extended nuclear deterrent, this proposition overlooks how military threats and doubts about the patron's intentions encourage clients to seek nuclear weapons of their own. To resolve this indeterminacy in the security model's explanation of nuclear restraint, it is necessary to account for the patron's use of alliance coercion, a strategy consisting of conditional threats of military abandonment to obtain compliance with the patron's demands. This strategy succeeds when the client is militarily dependent on the patron and when the patron provides assurances that threats of abandonment are conditional on the client's nuclear choices. Historical evidence from West Germany's nuclear decisionmaking provides a test of this logic. Contrary to the common belief among nonproliferation scholars, German leaders persistently doubted the credibility and durability of U.S. security guarantees and sought to acquire an independent nuclear deterrent. Rather than preferring to renounce nuclear armament, Germany was compelled to do so by U.S. threats of military abandonment, contradicting the established logic of the security model and affirming the logic of alliance coercion.

213. The Showdown That Wasn't: U.S.-Israeli Relations and American Domestic Politics, 1973–75

Abstract:: How influential are domestic politics on U.S. foreign affairs? With regard to Middle East policy, how important a role do ethnic lobbies, Congress, and public opinion play in influencing U.S. strategy? Answering these questions requires the use of archival records and other primary documents, which provide an undistorted view of U.S. policymakers' motivations. The Ford administration's 1975 reassessment of its approach to Arab-Israeli statecraft offers an excellent case for the examination of these issues in light of this type of historical evidence. President Gerald Ford and Secretary of State Henry Kissinger decided, in large part because of the looming 1976 presidential election, to avoid a confrontation with Israel in the spring and summer of 1975 by choosing to negotiate a second disengagement agreement between Egypt and Israel rather than a comprehensive settlement. Nevertheless, domestic constraints on the White House's freedom of action were not insurmountable and, had they had no other option, Ford and Kissinger would have been willing to engage in a showdown with Israel over the Middle East conflict's most fundamental aspects. The administration's concern that a major clash with Israel might stoke an outbreak of anti-Semitism in the United States likely contributed to its decision to back down.

214. Soft Balancing in the Americas: Latin American Opposition to U.S. Intervention, 1898–1936

Abstract:: In the aftermath of the 2003 U.S.-led invasion of Iraq, scholars of international relations debated how to best characterize the rising tide of global opposition. The concept of “soft balancing” emerged as an influential, though contested, explanation of a new phenomenon in a unipolar world: states seeking to constrain the ability of the United States to deploy military force by using multinational organizations, international law, and coalition building. Soft balancing can also be observed in regional unipolar systems. Multinational archival research reveals how Argentina, Mexico, and other Latin American countries responded to expanding U.S. power and military assertiveness in the early twentieth century through coordinated diplomatic maneuvering that provides a strong example of soft balancing. Examination of this earlier case makes an empirical contribution to the emerging soft-balancing literature and suggests that soft balancing need not lead to hard balancing or open conflict.

Abstract:: The United States has gone to extraordinary lengths since the beginning of the nuclear age to inhibit—that is, to slow, halt, and reverse—the spread of nuclear weapons and, when unsuccessful, to mitigate the consequences. To accomplish this end, the United States has developed and implemented a wide range of tools, applied in a variety of combinations. These “strategies of inhibition” employ different policies rarely seen as connected to one another, from treaties and norms to alliances and security guarantees, to sanctions and preventive military action. The United States has applied these measures to friend and foe alike, often regardless of political orientation, economic system, or alliance status, to secure protection from nuclear attack and maintain freedom of action. Collectively, these linked strategies of inhibition have been an independent and driving feature of U.S. national security policy for more than seven decades, to an extent rarely documented or fully understood. The strategies of inhibition make sense of puzzles that neither containment nor openness strategies can explain, while providing critical insights into post–World War II history, theory, the causes of nuclear proliferation, and debates over the past, present, and future trajectory of U.S. grand strategy.

216. Beyond Emboldenment: How Acquiring Nuclear Weapons Can Change Foreign Policy

Abstract:: What happens to the foreign policies of states when they acquire nuclear weapons? Despite its importance, this question has not been answered satisfactorily. Nuclear weapons can facilitate six conceptually distinct foreign policy behaviors: aggression, expansion, independence, bolstering, steadfastness, and compromise. This typology of foreign policy behaviors enables scholars to move beyond simple claims of “nuclear emboldenment,” and allows for more nuanced examination of the ways in which nuclear weapons affect the foreign policies of current and future nuclear states. The typology also sheds light on Great Britain's response to nuclear acquisition. Britain used nuclear weapons to engage in greater levels of steadfastness in responding to challenges, bolstering junior allies, and demonstrating independence from the United States, but it did not engage in greater levels of aggression, expansion, or compromise. The typology and the British case demonstrate the value of distinguishing among different effects of nuclear weapons acquisition, have implications for scholars' and policymakers' understanding of the role of nuclear weapons in international politics, and suggest avenues for future research.

217. Barriers to Entry: Who Builds Fortified Boundaries and Why?

Abstract:: Fortified boundaries are asymmetrical, physical barriers placed along borders. These boundaries are more formidable in structure than conventional boundary lines, but less robust than militarized boundaries. Their goal is to impose costs on infiltrators and in so doing deter or impede infiltration. A novel dataset of all such boundaries worldwide shows that states are constructing these barriers at an accelerating rate. More than half of barrier builders are Muslim-majority states, and so are the vast majority of targets. A multivariate analysis demonstrates that, contrary to conventional wisdom, states that construct such barriers do not tend to suffer disproportionately from terrorism, nor are they apt to be involved in a significant number of territorial disputes. Instead, differences in state wealth and migration rates are the best predictors of barrier construction. Qualitative case studies suggest that the most effective fortified boundaries are found where the initiating state controls the territory beyond a boundary that blocks the only access route into the state.

218. Balancing in Neorealism

Abstract:: Does neorealism offer a convincing account of great power balancing behavior? Many scholars argue that it does not. This conclusion rests on a misunderstanding of neorealist theory and an erroneous reading of the evidence. Properly specified, neorealism holds that great powers place an overriding emphasis on the need for self-help. This means that they rely relentlessly both on arming and on imitating the successful military practices of their peers to ensure their security. At the same time, they rarely resort to alliances and treat them with skepticism. There is abundant historical evidence to support these claims. Since 1816, great powers have routinely achieved an effective balance in military capabilities with their relevant competitors and promptly copied the major military innovations of the period. Case studies show that these outcomes are the product of states' efforts to ensure security against increasingly capable rivals. Meanwhile, the diplomatic record yields almost no examples of firm peacetime balancing coalitions over the past 200 years. When alliances have formed, great powers have generally doubted the reliability of their allies and of their opponents' allies. Thus neorealism provides a solid foundation for explaining great power balancing behavior.

Abstract:: Neorealism is one of the most influential theories of international relations, and its first theorist, Kenneth Waltz, a giant of the discipline. But why did Waltz move from a rather traditional form of classical realist political theory in the 1950s to neorealism in the 1970s? A possible answer is that Waltz's Theory of International Politics was his attempt to reconceive classical realism in a liberal form. Classical realism paid a great deal of attention to decisionmaking and statesmanship, and concomitantly asserted a nostalgic, anti-liberal political ideology. Neorealism, by contrast, dismissed the issue of foreign policymaking and decisionmaking. This shift reflected Waltz's desire to reconcile his acceptance of classical realism's tenets with his political commitment to liberalism. To do so, Waltz incorporated cybernetics and systems theory into Theory of International Politics, which allowed him to develop a theory of international relations no longer burdened with the problem of decisionmaking.

Abstract:: The US and a coalition of allies are once again intervening in the Middle East. This time it is in response to the rapid military advancement of Daesh, the acronym Arabic speakers use for the Arabic name of ISIS, Al-Dawla al-Islamiya fi al-Iraq wa al-Sham. Some ten weeks into the start of military operations a common view is that the coalition's aerial campaign has only had limited success at best. On the plus side, coalition air power coupled with local forces on the ground were able to save a great many Iraqi Yazidis who were being threatened by Daesh, but equally a great many of this sectarian minority were massacred and, in the case of women and girls, raped or sold into sexual slavery. The Kurds subsequent to the initial retreat of their much vaunted Peshmerga forces have been able to stabilize their fighting lines against Daesh and regain control of the important Mosul dam. This particular success is in part due to the Kurds themselves and in part due to the support of coalition air strikes and delivery of supplies, but it also appears to be due in part to Daesh turning its focus to Anbar and northern Syria. On the negative side, Daesh not only continues to hold Mosul, among many other Iraqi cities and towns, but it has also expanded its control of territory in Anbar province from where it now poses a potential threat to Baghdad and areas in and around the Iraqi capital city. Daesh also made significant advances in northern Syria where it threatened to overrun the Kurdish city of Kobane on the Syria-Turkey border, creating the looming prospect of the massacre of the fighters and civilians still there. Over the past few days the intensification of coalition air strikes in and around this city appears to have halted and at least partially pushed back the Daesh assault, but the city and its inhabitants are far from being safe as it could still fall in the days and weeks to come.

Abstract:: A former writer of British military doctrine, Jim Storr, recently lamented that, although many books explore what happens in war (history) or why wars happen (international relations), very few focus on how wars should be fought (warfare). He concluded this reflects warfare's status as 'a poorly developed discipline'. Consequently, 'It is incoherent, contains a range of poorly described phenomena and is pervaded by paradox.' The underdeveloped discourse concerning warfare, and within it the limited consideration of different approaches to command, may be considered an important contributor to the longstanding gulf between the doctrine of Mission Command espoused by the United States and British armies and actual operational practice, such that the doctrine is 'realized only in some places some of the time'.

Abstract:: In America and the Rogue States, Thomas Henriksen lays out the relationships that exist, and have existed, between America and the states that made up George W. Bush's 'Axis of Evil.' Henriksen outlines the history of the interactions between the United States and North Korea, pre-invasion Iraq, and Iran, and through this draws out a number of themes. He also shows that the ways the relationships have played out are highly situational and there is no one-size-fits-all solution. In the last chapter, Henriksen explores American relationships with a number of states that were either once considered rogue or could become rogue, like Libya, Syria, and Cuba, referring to them as either “lesser rogues” or “troublesome states.” These states have remained “a puzzle for US foreign policy” (1) and are characterized by three things: autocratic governance, sponsorship of terrorism, and pursuit of weapons of mass destruction (WMD). There is no clear definition provided by Henriksen for what can be considered a rogue state, making it difficult to judge what other states, if any, could be considered rogue. Henriksen seems to arbitrarily decide who is rogue and who is not: Cuba is a rogue state, while Myanmar is merely troublesome. Instead of synthesizing a clear definition of the term, something that could then be applied to other states in order to judge their 'rogueness,' Henriksen uses the Bush administration's criteria (the term itself was coined by President Bill Clinton in a 1994 speech in Brussels), which was outlined in the National Security Strategy of 2002 (NSS-2002). These were “brutality toward their own people; contempt for international law; determination to acquire weapons of mass destruction (WMD); advanced military technology; sponsorship of terrorism; rejection of human rights values; and hatred for the United States and 'everything it stands for'”. The use of the NSS-2002 definition allows for the 'Axis of Evil' to fit neatly into the term, which constitutes a problem of tautology, at least for the Bush administration. Further compounding this was that, according to Henriksen at least, the administration was set on going to war in Iraq prior to assuming office. This creates a situation in which it is hard to determine whether the idea of rogue states was created to justify this desire, or it informed the desire prior to the administration taking office.

Abstract:: In light of rising numbers of unaccompanied minors at the Mexico- US border in 2014, this article examines child migration from Mexico, Guatemala, El Salvador, Costa Rica, and Nicaragua. Using data from the Mexican and Latin American Migration Projects that permit us to go beyond simple descriptive analysis about children apprehended at the border, we investigate the extent to which children from these countries: 1) enter without legal authorization to do so; 2) are more likely to cross the border now than in the past; and 3) are tied to their parents' migration. In theory, if immigration and refugee protections worked well for children and offered them legal pathways to reunify with their families, then we would expect low levels of unauthorized entry and no dramatic shifts over time. However, our examination of child migration shows that it is strongly linked to unauthorized entry, period of entry, and parents' US experience.The findings show that the migration of children is closely linked to their parents' migration history. Although the overall likelihood of a Mexican child making a first US trip is quite low, it is practically non-existent for children whose parents have no US experience. Thus, the increase in child migration from Central America, and the continued high levels of child migration from Mexico result from widespread migration networks and the United States' long-standing reliance on the children's parents as immigrant workers. The findings suggest that these children need protection in the form of family reunification and permanent legal status.

227. Beyond DAPA and DACA: Revisiting Legislative Reform in Light of Long-Term Trends in Unauthorized Immigration to the United States

Abstract:: In December 2014, the Center for Migration Studies of New York (CMS) released a paper that provides new estimates of the US unauthorized resident population (Warren 2014). The paper describes the development of a new dataset which has detailed information about unauthorized residents, derived from data collected in the US Census Bureau's American Community Survey (ACS). The dataset will be useful to scholars, researchers, service-providers, and government officials in crafting, implementing, and evaluating programs that serve noncitizens, including the unauthorized. In addition, the new estimates provide an opportunity to examine the dramatic changes in unauthorized immigration in the past two decades and the assumptions that have shaped US policies and public opinion. The new dataset, recent estimates of the unauthorized (Warren and Warren 2013) and statistics on the noncitizen population from IPUMS-USA (Ruggles et al. 2010) highlight several trends related to the decline in the unauthorized population, particularly from Mexico, and the increasing salience of visa overstays in constituting this population. Some trends defy conventional wisdom and all of them have public policy consequences. In particular, we find that: The unauthorized resident population was about a million lower in 2013 than in 2007. The “Great Recession” was not the principal cause of population decline. Annual arrivals into the unauthorized population increased to more than one million in 2000, then began to drop steadily, and have now reached their lowest levels since the early 1980s From 2000 to 2012, arrivals from Mexico fell by about 80 percent. Between 2010 and 2013, the total unauthorized population from Mexico declined by eight percent. In 2006, the number of arrivals from Mexico fell below the total number of arrivals from all other countries (combined) for the first time. The number who stayed beyond the period authorized by their temporary visas (overstays) exceeded the number who entered across the southern land border without inspection (EWIs) in each year from 2008 to 2012. While the CMS estimates are based on sample data and assumptions that are subject to error, these trends are consistent with the best empirical information available. In November 2014 the Obama Administration announced an unprecedented set of executive action initiatives. At this writing, the Deferred Action for Parental Accountability (DAPA) program and the expanded Deferred Action for Childhood Arrivals (DACA) program, which would provide work authorization and temporary reprieve from removal to eligible persons, have been preliminarily enjoined. The temporary injunction, which the US Department of Justice plans to appeal to the Fifth Circuit Court of Appeals, comes in response to a legal challenge to the two programs by 26 states under Article II, section 3 of the US Constitution which requires the President to “take Care that the Laws be faithfully executed,” and under the Administrative Procedure Act (APA). In addition, the Republican majorities of the 114th Congress have vowed to prevent the implementation of these programs. However, the administration has expressed confidence that it will ultimately prevail in court and in its battle with Congress over these programs. Meanwhile, nongovernmental organizations (NGOs), community-based organizations (CBOs), and others continue to plan intensively for the DAPA and DACA programs, as well as for other executive action initiatives. This paper provides estimates of those who are potentially eligible for DAPA and DACA. However, it also looks beyond DAPA and DACA to make the case for broad legislative reform in light of long-term trends in unauthorized migration to the United States and the unauthorized resident population. In particular, it argues that substantial declines in the unauthorized population—a goal shared by partisans on both sides of the immigration debate—will require reform of the legal immigration system, legalization of a substantial percentage of the unauthorized, and a more effective response to nonimmigrant visa overstays.

228. Democratizing Data about Unauthorized Residents in the United States: Estimates and Public-Use Data, 2010 to 2013

Abstract:: Information about the unauthorized resident population is needed to develop and evaluate US immigration policy, determine the social and economic effects of unauthorized immigration, and assist public and private service providers in carrying out their missions. Until recently, estimates have been available only for selected data points at the national and sometimes the state level. The Center for Migration Studies (CMS) convened a meeting in September 2013 to assess the need for information about the unauthorized resident population. The meeting included leading academics, researchers, non-governmental organizations (NGOs) that serve immigrants, and local, state, and federal government representatives. Based on the recommendations from that meeting, CMS initiated a project to derive estimates of the size and characteristics of the unauthorized population at the national, state, and sub-state levels, and to make the information readily available to a wide cross-section of users. A series of statistical procedures were developed to derive estimates based on microdata collected by the US Census Bureau in the 2010 American Community Survey (ACS). The estimates provide detailed demographic information for unauthorized residents in population units as small as 100,000 persons. Overall, the estimates are consistent with the limited information produced by residual estimation techniques. A primary consideration in constructing the estimates was to protect the privacy of ACS respondents.

229. Reconfiguring the Law of Non-Refoulement: Procedural and Substantive Barriers for Those Seeking to Access Surrogate International Human Rights Protection

Abstract:: Both geographic and normative constraints restrict access to surrogate international human rights protection for those seeking a haven from serious human rights abuses. Primary among territorial restrictions has been the fall-out from the US Supreme Court's decision in Sale v. Haitian Council Centers in which the court explicitly ruled that nothing in US statutory law, or in the 1951 Convention on Refugees or its 1967 Protocol, precluded the interdiction of Haitian refugees in international waters and their return to the country of origin without an effective interview on their protection clams. This ruling is in transparent contradiction to the general international law norm of non-refoulement according to modern scholarship and emerging case law. This paper concludes that Sale should be overturned by statute as should related pre-screening practices. A new standard of “jurisdiction” should be adopted which does not depend on territorial access to a signatory state but on whether the state is exercising power in fact. Similar concerns exist with respect to safe third country agreements which often offend the international customary right of the asylum seeker to choose where his or her claim will be filed. This paper argues that the right of choice should be recognized and onward travel and admission to the country of destination allowed. This result is especially called for where return of the alien by the country of first contact raises serious concerns under the law of non-refoulement. Imbalances noted in this paper include those generated by the new terrorism related grounds of inadmissibility in the United States and the summary denial of children's asylum claims flowing from gang violence. Other questions are raised in this paper concerning work authorization and detention of asylum seekers. Access to an employment authorization Journal on Migration and Human Security document for those filing colorable claims should be recognized by statute to render US practice consistent with that of most other states. Release from detention, on the other hand, for asylum seekers has now been broadly recognized by the US Department of Homeland Security where the asylum seeker's identity can be ascertained and the claim is non-frivolous in nature. This approach is largely consistent with international law, although there have been unnecessary delays in implementing it. On the substantive law, the international customary norm of non-refoulment has been expanded considerably through the development of opinio juris by scholars and the practice of states. This paper traces efforts in Europe to develop a law of temporary refuge for those fleeing civil war situations characterized by humanitarian law violations. Similarly, case law under the European Convention of Human Rights has now come to focus on the harm the claimant would suffer as the result of conditions in the country of origin without identifying an explicit agent of serious harm. Related to these developments has been the notion of complementary protection under which relief can be conferred where the alien would suffer serious harm upon return to the home state but not for a Convention reason. These approaches have now received approval in the European Union Asylum Qualification Directive so that international protection may now be conferred either because the alien would suffer serious harm on account of the intensity of human rights violations taking place in the country of origin, or those conditions, taken in conjunction with the claimant's personal situation, support a finding that the claimant would be impacted. This paper argues that this latter standard has now been made a part of the customary norm of non-refoulement and that it should be recognized by statute as a basis for non-return and coupled with status where the new standard can be met. Such a measure would help restore the nation's commitment to human rights and humanitarian concerns.

230. Problems Faced by Mexican Asylum Seekers in the United States

Abstract:: Violence in Mexico rose sharply in response to President Felipe Calderón's military campaign against drug cartels which began in late 2006. As a consequence, the number of Mexicans who have sought asylum in the United States has grown significantly. In 2013, Mexicans made up the second largest group of defensive asylum seekers (those in removal proceedings) in the United States, behind only China (EOIR 2014b). Yet between 2008 and 2013, the grant rate for Mexican asylum seekers in immigration court fell from 23 percent to nine percent (EOIR 2013, 2014b). This paper examines—from the perspective of an attorney who represented Mexican asylum seekers on the US-Mexico border in El Paso, Texas—the reasons for low asylum approval rates for Mexicans despite high levels of violence in and flight from Mexico from 2008 to 2013. It details the obstacles faced by Mexican asylum seekers along the US-Mexico border, including placement in removal proceedings, detention, evidentiary issues, narrow legal standards, and (effectively) judicial notice of country conditions in Mexico. The paper recommends that asylum seekers at the border be placed in affirmative proceedings (before immigration officials), making them eligible for bond. It also proposes increased oversight of immigration judges.

231. The Intersection of Statelessness and Refugee Protection in US Asylum Policy

Abstract:: More than ten million people are stateless today. In a world of nation states, they live on the margins without membership in any state, and, as a consequence, have few enforceable legal rights. Stateless individuals face gaps in protection and in many cases experience persecution that falls within the refugee paradigm. However, US asylum policy does not adequately address the myriad legal problems that confront the stateless, who have been largely invisible in the jurisprudence and academic literature. Two federal appellate court opinions shed new light on the intersection of statelessness and refugee law in the United States. In 2010, Haile v. Holder examined the asylum claim of a young man rendered stateless when the Ethiopian government issued a decree denationalizing ethnic Eritreans. In a 2011 case, Stserba v. Holder, the court reviewed an asylum claim by a woman who became stateless when the Soviet Union collapsed, and the successor state of Estonia enacted citizenship legislation that included a language requirement. This article analyzes the opinions which suggest that state action depriving residents of citizenship on ethnic and other protected grounds warrants a presumption of persecution. This article also identifies additional circumstances in which stateless individuals may have a well-founded fear of persecution that qualifies them for asylum in the United States. In addition, this article notes that although far too many stateless individuals face persecution, not all of them do. Stateless persons who do not fear persecution, however, are also vulnerable. The absence of state protection condemns them to a precarious existence and their inability to obtain passports or other travel documents often prevents their return to states where they formerly resided. The refusal of most states to admit non-citizens frequently keeps stateless persons in limbo. Stateless individuals stranded in the United States live under a supervisory patchwork that serves neither their interests nor those of the United States. Rather than relying on incremental case law developments and inapposite regulatory schemes, the US State Department and the Department of Homeland Security should convene a task force to report on the size and composition of the stateless population in the United States and the need to develop legislative, regulatory, and other policy guidance concerning statelessness claims.

232. There and Back Again: On the Diffusion of Immigration Detention

Abstract:: From Mexico to the Bahamas, Mauritania to Lebanon, Turkey to Saudi Arabia, South Africa to Indonesia, Malaysia to Thailand, immigration-related detention has become an established policy apparatus that counts on dedicated facilities and burgeoning institutional bureaucracies. Until relatively recently, however, detention appears to have been largely an ad hoc tool, employed mainly by wealthy states in exigent circumstances. This paper uses concepts from diffusion theory to detail the history of key policy events in several important immigration destination countries that led to the spreading of detention practices during the last 30 years and assesses some of the motives that appear to have encouraged this phenomenon. The paper also endeavors to place the United States at the center of this story because its policy decisions appear to have played an important role in encouraging the process of policy innovation, imitation, and imposition that has helped give rise to today's global immigration detention phenomenon. Nevertheless, many US offshore practices have not received nearly the same attention as those of other important destination countries. More broadly, in telling this story, this paper seeks to flesh out some of the larger policy implications of the externalization of immigration control regimes. Just as offshore interdiction and detention schemes raise important questions about custody, accountability, and sovereignty, they should also spur questions over where responsibility for the wellbeing of migrants begins and ends.

233. "Enemy Territory": Immigration Enforcement in the US-Mexico Borderlands

Abstract:: For the last two decades, the guiding strategy of immigration enforcement along the US-Mexico border has been “prevention through deterrence,” or stopping unauthorized immigrants from entering the country rather than apprehending those who have already crossed the border. “Prevention through deterrence” has entailed a massive concentration of enforcement personnel and resources along the border and at ports of entry. It has also led to the detention and removal of increasing numbers of unauthorized immigrants and far greater use of “expedited removal.” As gauged by the doubling in size of the unauthorized immigrant population over the same period, “prevention through deterrence” has not been a successful enforcement strategy. Moreover, it has funneled more migrants to their death in the deserts and mountains of the southwest as they (and smugglers) resort to increasingly dangerous routes to evade border enforcement. In addition, there has been public concern over ethnic profiling and the use of extraordinary authority by Border Patrol agents to conduct arbitrary searches within 100 miles of the border. Despite these problems, the federal government continues to spend billions of dollars each year on the “prevention through deterrence” strategy. A first step in overcoming the deficiencies of this border enforcement strategy is to strengthen accountability within the Border Patrol, so that allegations of excessive force and abuse are investigated and adjudicated promptly and appropriately. The culture of the Border Patrol must be transformed to foster respect for rights. More broadly, the mission of the Border Patrol should be to capture dangerous individuals and to disrupt the operations of the transnational criminal organizations that traffic people, drugs, guns, and money. In addition, providing more pathways to legal entry through immigration reform would enhance border security by attenuating the flow of unauthorized immigrants within which dangerous criminals or terrorists can hide. Finally, the US government should pursue economic policies to promote development in Mexico and Central American countries in order to address the underlying causes of migration.

Abstract:: Foreign policy experts have struggled to describe the unusual character of contemporary world politics. Much of the debate revolves around the concept of polarity, which deals with how power is distributed among nations, as experts ask if the United States is still a unipolar power or in decline as new powers emerge. The polarity debate, however, obscures more than it clarifies because the distribution of power does not determine the fate of nations by itself. It leaves out strategic choice and does not predict how the United States would exercise its power or how others would respond to U.S. primacy. World politics can take many paths, not just one, under any particular distribution of power. The most remarkable feature of post-Cold War world politics has not been the much-discussed power accumulation of the United States—although that is indeed noteworthy—but rather the absence of counter- balancing and revisionist behavior by other major powers.

Abstract:: In developing U.S. intervention policy in Kosovo, Iraq, Libya, and most recently Syria, the 1992 to 1995 war in Bosnia and Herzegovina has repeatedly been used as an analogy. For example, John Shattuck, a member of the negotiating team at the Dayton peace talks that ended the war, wrote in September 2013 that for Syria “the best analogy is Bosnia…Dayton was a major achievement of diplomacy backed by force…A negotiated solution to the Syria crisis is possible, but only if diplomacy is backed by force.” Many other analysts and policymakers with experience in the Bosnian conflict—such as Nicholas Burns, the State Department spokesman at the time; Christopher Hill, a member of Richard Holbrooke's negotiating team; and Samantha Power, who began her career as a journalist in Bosnia—also invoked the Bosnian war to urge greater U.S. involvement in Syria. Although the rise of ISIS has significantly altered the conflict over the last year, echoes of the Bosnian conflict remain in Syria: the conflict is a multiparty ethnic civil war, fueled by outside powers, in a region of critical interest to the United States.

Among the most frequently cited indications of this trend were: An internal debate among Chinese elites in which some participants advocated edging away from Deng Xiaoping's “hiding and biding” strategy and replacing it with something bolder and more self-confident; A “newly forceful, `triumphalist,' or brash tone in foreign policy pronouncements,” including the more open acknowledgement—and even celebration—of China's increasing power and influence; Stronger reactions, including the threatened use of sanctions and financial leverage, to recurrent irritations in U.S.–China relations such as arms sales to Taiwan and presidential visits with the Dalai Lama; More open and frequent displays of China's growing military capabilities including larger, long-range air and naval exercises, and demonstrating or deploying new weapons systems; A markedly increased willingness to use threats and displays of force on issues relating to the control of the waters, air space, surface features, and resources off China's coasts. Abstract:: As Chinese political, economic, and military power continues to grow at impressive rates, the impact of Chinese external behavior on the region has correspondingly increased. Since 2010, it has become commonplace for observers to refer to Chinese foreign policy behavior as abrasive, muscular, or assertive. However, China's heightened willingness to rely on coercive diplomacy—or the simultaneous use of diplomacy and limited use of force to accomplish one's objectives—began much earlier with the Impeccable incident in March 2009. In this case, five Chinese vessels shadowed and aggressively maneuvered in dangerously close proximity to the U.S. Naval Ship Impeccable. In the following months, commentators predicted that China would moderate its behavior in the face of regional backlash. Instead, instances of Chinese platforms maneuvering in a dangerous and unprofessional manner only became more frequent.

Abstract:: Can great powers reach confident conclusions about the intentions of their peers? The answer to this question has important implications for U.S. national security policy. According to one popular view, the United States and China are destined to compete unless they can figure out each other's designs. A recent Brookings Institution report warns that although “Beijing and Washington seek to build a constructive partnership for the long run,” they may be headed for trouble given their “mutual distrust of [the other's] long-term intentions.” Similarly, foreign policy experts James Steinberg and Michael O'Hanlon argue that “trust in both capitals...remains scarce, and the possibility of an accidental or even intentional conflict between the United States and China seems to be growing.” Reversing this logic, many analysts believe that U.S.-China relations may improve if the two sides clarify their intentions. Thus the Pentagon's latest strategic guidance document declares that if China wants to “avoid causing friction” in East Asia, then its military growth must be “accompanied by greater clarity of its strategic intentions.” Meanwhile China scholars Andrew Nathan and Andrew Scobell recommend that even as the United States builds up its capabilities and alliances, it should “reassure Beijing that these moves are intended to create a balance of common interests rather than to threaten China.”

Abstract:: Any evaluation of 20 th century international political and socio - economic engagements inevitably draws heavily on the literature depicting the relations between and within the Cold War blocs. Such cognitive benchmarking has become so extensive that even the earth - shattering World Wars, which preceded US - Soviet brinkmanship, have been sewn together to the Cold War so as to produce a meta - narrative as a means of understanding the dynamics of international relations themselves. For instance, WWI has not merely entered the history books for what it produced; it has also come to be seen as producing the right conditions for Russia's communist revolution and the US's rise to inherit the position of Western leadership — two necessary prequels to the half century of Cold War. But not before these two ideologically opposed blocs join forces to rid the world of fascism and the German pivot in European affairs. WWII has come to represent three chapters in the story of civilisation: the story of genocide (re: Nazi Germany's quest to exterminate world Jewry), the story of non - nationalistic secular ideological struggles and the story of power beyond the pale of power (re: the nuclearisation of power). In other words, WWII has also, largely, been included as a necessary chapter to the Cold War. And certainly it was. Without WWII it is difficult to imagine how, or if, the USSR would have driven west and occupied Central Europe, whether the West European states would not have deployed East, if the US would have deepened its engagements to Europe or any number of dynamics would have unfolded. It is clear that the Cold War is a defining period of international relations history.

Such difference would correspond to an attempt to reconcile the aspects of autonomy and alignment. Nonetheless, this process has proved to be quite controversial and sensitive, since the option for an autonomous foreign policy refers to a project of state and not just a project of government. This equation failed to take into account the comprehensive elements of the exchange and the U.S. position as hegemon. Facing this scenario, this article seeks to analyze the evolution of the bilateral relations in the Rousseff administration, identifying its main pillars, controversies, limitations and opportunities, having as backdrop the broader context of Brazil's international relations as an emerging country. It is a contemporary analysis, which will bring a study based on conjunctural themes and long-term considerations about the strategic views of both partners. Abstract:: This article uses the centenary of the First World War as an opportunity to re-examine a major element of the existing literature on the war—the strategic implications of supposed British decline—as well as analogies to the contemporary United States based upon that interpretation of history. It argues that the standard declinist interpretation of British strategy rests to a surprising degree upon the work of the naval historian Arthur Marder, and that Marder's archival research and conceptual framework were weaker than is generally realized. It suggests that more recent work appearing since Marder is stronger and renders the declinist strategic interpretation difficult to maintain. It concludes by considering the implications of this new work for analogies between the United States today and First World War-era Britain, and for the use of history in contemporary policy debates.

Abstract:: The 'Five Eyes' alliance, led by the United States, spends close to 100 billion dollars a year on intelligence. This review article argues that western countries are distinguished by their sophisticated approach to the making of intelligence-led national security policy. Political leaders and policy-makers who access this sensitive material are often involved in elaborate systems that constitute part of the core executive and which seek to task and improve the intelligence leviathan. Western intelligence therefore has a 'central brain' that devotes considerable energy to both analysis and management. By contrast, in the majority of other states around the world, the orientation of intelligence has often been inward facing, with a high priority given to regime security. Some would suggest that intelligence has been an important component of western power projection, while others would argue that this process has been over-expensive and has under-delivered, not least in the last decade. Either way, the debates about development of the central intelligence machinery that supports western security policies are of the first importance and fortunately this discussion has been advanced by the appearance of several valuable new studies: these are discussed in this review article.

255. Is the US-China Climate Agreement a Game-changer?

Abstract:: The United States and China recently announced a joint climate agreement that creates unprecedented political momentum for the Paris COP21 to be held in December 2015. Yet, it is unclear whether such a deal is an historic breakthrough or business as usual policy. A closer look at the US-China climate agreement shows that the chances that the agreed measures have of limiting global warming to 2°C are very few. If seen in terms of concrete policy action, the US pledge comes closer to a pathway compatible with a 2°C target. By contrast, however, China's pledges are far from consistent with a 2°C pathway. As the COP21 approaches, it is becoming clear that China matters more than ever for an effective climate deal. But it is also becoming increasingly clear that, in the best case scenario, Beijing will support a start now/sprint later agreement in Paris.

Abstract:: The United States and Chile have been working together on scientific endeavors since the visit of US Navy Lieutenant James Gillis in 1849, when he established an astronomical observatory on the Santa Lucia hill in the center of Santiago. Fast forward to today, Chile houses 40 percent of the world's astronomy infrastructure and, by 2020, it will increase to 70 percent. In fact, the National Science Foundation (NSF) has invested over a billion dollars in equipment, infrastructure, and operations in Northern Chile's Atacama Desert, the driest place on earth. Abstract:: Micronesia is a good start word. Particularly the “micro” part. Micronesia is the geographical area of the Pacific, stretching from Kiribati to Palau. On the map, if you see it at all, it is a series of 2,000 micro dots of land totaling just 1,000 square miles. The ocean area meanwhile is nearly three million square miles. Politically, there are five sovereign states and three US territories. At times, one gets the feeling that the countries are too small to get Washington's attention. It is almost as if you need a microscope to magnify the issues to understand what's going on. I'll turn the microscope on just one area, the Republic of the Marshall Islands (RMI). Just like life under the microscope, once you zoom in, the activity and diversity is incredible.

Although he commands one of the smallest militaries in the region, the Emir, Sheikh Tamim bin Hamad Al Thani, is overseeing one of the most ambitious and comprehensive military modernization programs in the world. Though culturally conservative, Doha has welcomed branch campuses of six American universities with an eye toward blending its traditional heritage with the cutting edge practices of Western liberal arts and sciences. In only a few decades, Qatar has transformed from a developing nation to a financial powerhouse with the highest per capita income in the world.

Abstract:: Liberia and the United States have a long history, but since the end of Liberia's bloody civil war in 2003, the relationship has been closer and warmer than ever. Over the past nearly dozen years, the United States has been the largest bilateral partner assisting Liberia in its efforts to rebuild and recover from conflict. We have invested heavily in Liberia's future, working principally through the United States Agency for International Development (USAID), the Department of State's Bureau of African Affairs and the Bureau of International Narcotics and Law Enforcement Affairs, the Department of Defense, and the Peace Corps to reestablish health care delivery, strengthen governance and institutions, educate thousands of children and train teachers, rebuild the armed forces and train police, and spur private sector-led economic growth. President Ellen Johnson Sirleaf has been a strong partner in our mutual commitment to advance democratic values, stressing private sector-led growth and ensuring regional security. Indeed, as we entered the beginning of 2014, the future looked bright for Liberia as the fruits of our and others' investments were poised to show dividends; little did we know the shock that awaited us.

The new trade initiative, which gave duty- and quota-free access to the $11 trillion US market for over 6,000 African products, represented an important paradigm shift in the relationship between the United States and Africa, from one based on charity and paternalism to one of respect and partnership. For the first time African leaders were at the table, working with members of the United States Congress on both sides of the aisle to craft a US policy initiative that gave African nations a powerful tool to seek sustainable, market-based solutions to the continent's seemingly intractable poverty.

Abstract:: When the Soviet Union collapsed over two decades ago, the United States was one of the first nations to recognize Tajikistan as an independent country. Shortly thereafter, a civil war began that lasted for five years and caused considerable death and destruction. Even as fighting diminished in the late 1990s, the suffering of the Tajik people continued. Hunger stalked the land. Damage to roads, bridges, and other infrastructure in some parts of the country was extensive. Economic prospects were bleak because the war had interfered with market development. The United States Government, through the United States Agency for International Development (USAID) and other agencies, began humanitarian relief efforts to help provide basic nutrition to those hardest hit by the devastation of war. In the years since, US assistance programs have evolved from providing only humanitarian assistance to building human capacity and creating long-term, sustainable economic development.

Freedman\'s edited volume, Israel and the United States: Six Decades of U.S.-Israeli Relations, is a compilation of an interesting assortment of essays by Israeli and American scholars from various fields, contending with different aspects of a complicated and multilayered relationship that comprises not only diplomatic and economic links, but also religious, legal, military and strategic connections as well as common beliefs. The first section of the book articulates the political ties between the United States and Israel since 1948. It contends with U.S.-Israeli diplomatic relations, an enquiry of the progression of the pro-Israeli lobby in the United States, and an analysis of the evolution of U.S. public attitudes toward Israel. David Makovsky\'s essay, which deals with the U.S. and the Arab–Israeli conflict, emphasizes that the U.S.\'s relationship with Israel and the Arab world is not a zero-sum game and that the United States can maintain good ties with both sides. The essay reiterates that Israel has been an asset for the United States rather than a liability, which has been suggested by the likes of John Mearsheimer and Stephen Walt. Robert Freedman, in contending with the policies of George Bush and Barack Obama towards the Arab-Israeli conflict, brings to the fore the similarities in their approaches as well as the significant differences, with the former pursuing an episodic approach while the latter has adopted a more continuous line. In his essay on the pro-Israeli lobby in the United States, Dov Waxman discusses the ruptures and fissures that have emerged within the lobby and concludes that there is no single organization that can persuasively claim to exemplify the vast majority of American Jews; as such, its clout/influence is expected to wane. Amnon Cavari\'s essay deconstructs the shifting trends in American support for Israel, contending that a decline in support among college-educated Americans along with an upsurge in support among evangelical Christians could weaken bipartisan backing for Israel.

We believe Piketty’s core message is provably flawed on several levels, as a result of fundamental and avoidable errorsin his basic assumptions. 1 He begins with the sensible presumption that the return on invested capital, r, exceeds macroeconomic growth, g, as must be true in any healthy economy. But from this near-tautology, he moves on to presume that wealthy families will grow ever richer over future generations, leading to a society dominated by unearned, hereditary wealth.

Abstract:: The Russian attitude to the Arab Spring—a mixture of skepticism, caution and mis-trust—was for a long time poorly understood outside the country. In the West, which initially saw in the Arab Spring the familiar battle between “democracy from below” and “dictatorship from above,” many accused Moscow of sympathizing with outdated au-thoritarian regimes, even facilitating their behavior, and of being incapable of keeping up with the times. Later, the situation changed. As democratic revolutions were replaced by civil con-flicts (some more peaceful, others more bloody, all exacerbated by ethnic or religious differences) Russia’s conservative position started to find support, both within the Mid-dle East and beyond. The breakthrough Russo-American agreement on Syrian chemical weapons opened the door to the Geneva II talks, bringing factions within Syria to the same talks table, and also helping regulate the Iranian nuclear issue. To understand the factors that shaped the Russian attitude to the Arab Spring, we need to review recent Russian history and how the situation has changed Russia’s bor-ders. In this article, we will attempt to circumscribe these factors, and offer insights into their true nature.

Abstract:: Before the ink on the Treaty of Versailles was dry, the idea of creating an organization dedicated to educating, informing and advising future leaders about the causes and consequences of war was already gaining traction. At 'a series of unofficial meetings held in Paris in 1919',1 Lionel Curtis, an Oxford professor and visionary with a reputation for possessing an impressive array of entrepreneurial skills, was spearheading efforts to establish an Anglo-American research institution where scholars could explore international problems and advocate policy solutions.2 This kind of organization appealed to Curtis and to those with whom he discussed it for several reasons, not the least of which was that it could provide a valuable forum for both policy-makers and prominent policy experts in the leading western powers to talk to one another about international affairs. It was also a concept with which several of the delegates attending the Paris peace talks had some familiarity. In the nineteenth and early twentieth centuries a number of institutions had already taken root in Great Britain and in the United States with the aim of helping policy-makers navigate their way through complex policy problems. They included the Royal United Services Institute for Defence and Security Studies (1831), founded by the first Duke of Wellington; London's Fabian Society (1884), home to a number of prominent scholars, including Sidney and Beatrice Webb, co-founders of the London School of Economics; the Washington-based Carnegie Endowment for International Peace (1910), established by the Scottish-American steel tycoon Andrew Carnegie; and the Institute for Government Research (1916), which merged with two other institutions to form the Brookings Institution in 1927.3 Curtis and his colleagues in Great Britain and the United States were also aware of the ground-breaking research that had been conducted at hundreds of settlement houses in their respective countries. It was at places such as London's Toynbee Hall (1884) and Chicago's Hull House, co-founded by Jane Addams in 1889, that sociologists and other university faculty with expertise in social welfare policy could study the working conditions of the poor.4 In short, proponents of establishing a foreign affairs research institution recognized the importance of encouraging a dialogue between leading social scientists and high-level policy-makers.

Abstract:: On 20 January 1972 an alarming message reached Washington from General Creighton Abrams, the US commander in Vietnam. He stated that 'the enemy is preparing and positioning his forces for a major offensive. There is no doubt that this is to be a major campaign . We foresee a hard battle involving sophisticated weaponry and as much ground combat power as the enemy can generate.' He therefore asked for a number of 'standby authorities' for military actions, notably air power. This was just the latest of a series of warnings from Abrams, but it was deemed important enough to be forwarded to the White House, where President Nixon's National Security Advisor, Henry Kissinger, raised the matter with his boss later the same day. It was agreed that any decision upon future action should be postponed until after the President's televised speech to the nation on Vietnam on 25 January (vol. VIII, no. 2).

Abstract:: The new national security leaders in Japan, the United States, China and the two Koreas have assumed office at a precarious time. Despite the recent relaxation of tensions, conditions are ripe for further conflict in Northeast Asia. The new DPRK leadership is as determined as its predecessor to possess nuclear weapons and ballistic missiles while resisting unification or reconciliation with South Korea and its allies. The new government in Tokyo is also augmenting its military capabilities. Meanwhile, despite Chinese efforts to restart the Six-Party Talks, the Obama administration has refused to engage with the DPRK until it demonstrates a willingness to end its nuclear weapons program and improving intra-Korean ties. But this policy of patiently waiting for verifiable changes in DPRK policies may be too passive in the face of North Korea' s growing military capabilities, leading the new South Korean government, striving to maneuver between Beijing and Washington, to consider new initiatives to restart a dialogue with the North even while reinforcing its own military capabilities.

283. North Korea's Strategic Goals and Policy towards the United States and South Korea

Abstract:: Pyongyang under the Kim dynasty has pursued three broad and consistent strategic goals: (1) The pursuit of nuclear weapons program in order to gain international acceptance of the North as a bona fide nuclear weapons state; (2) securing a peace treaty in an effort to remove U.S. forces from the Korean Peninsula; and, (3) reunification with South Korea on its own terms—the ultimate if increasingly unrealistic objective. To achieve these goals, the North has followed a policy of brinksmanship with the U.S. and South Korea: provoke when Washington or Seoul seem preoccupied, up the ante in the face of international condemnation, and pivot back to a peace offensive, which usually ends with some form of dialogue and negotiation, culminating, finally, in concessions for the North. This article reviews in detail how such policies have been pursued by Kim Il-sung, Kim Jong-il, and Kim Jong-un. It shows that, while there have been changes in North Korean policy, they have been primarily tactical not strategic—the North has changed how it pursues its goals (sometimes using military forces, at other times covert actions, or even negotiations), but it has remained consistent in its objectives. Not even the regime's literal bankruptcy has convinced the regime to change course, and for good reason: such brinkmanship tactics have paid off for the North by making possible the regime's survival for more than sixty years. Kim Jong-un, accordingly, has continued this strategy. This article ends by suggesting how the U.S. and South Korea should deal with the North's militaristic foreign policy. In brief, the two allies need to break the cycle of provocation by making clear they will no longer reward North Korea's destabilizing behavior while pursuing a longer-term goal of their own.

Abstract:: Regional maritime security has clearly wanted improved structures and mechanisms since early 2010. In 2011 Dr. Sam Bateman published an article, "Solving the 'Wicked Problems' of Maritime Security: Are Regional Forums up to the Task?" identifying a number of intractable problems. Recently, Bateman's list has been overshadowed by a variety of new 'wicked problems' and all parties continue to dig the hole deeper. These new issues faced by the East Asian nations include: the impact of domestic politics upon maritime security, the difficulty of striking a balance between the US and China, the struggle for self-reliant defense through rearming, the dearth of alternative models for maritime cooperation, the blurring of operational roles between navies and coastguards, and the reluctance to turn to legal mechanisms of dispute resolution. In Bateman's original exposition, the 'wicked problems' were directly applicable to current maritime security, but denoted some negative outlook. This paper is hopeful that the nations of the region might be willing to put the past behind them, so that some of the mounting catalog of issues can be resolved. If effective solutions are ever to be found, then the nations in dispute will inevitably have to adopt a more flexible mindset and break out of the perilous and unproductive cycles of action and reaction. The key aim of this paper is to identify trust-building strategies through which the nations of the region can mitigate their quarrels and collaborate in solving the challenges of regional maritime security, including both old and new 'wicked problems'.

Abstract:: This paper challenges the conventional wisdom that US power and preferences following World War II led to bilateralism in Asia and multilateralism in Western Europe. It argues that the challenges facing the United States in both regions were similar, as were US policies meant to address them. With some lag, the United States supported the economic recovery of the regional powers it had defeated (Germany and Japan), saw the restoration of regional trade as a prerequisite, sought military bases to assure postwar security, and envisioned rearming its former foes as part of its security strategy. The outcomes in the two regions reï¬‚ected the preferences and reservations of regional actors. The critical differences between the regions were structural. The existence of middle powers was critical in Europe, the return of colonial powers to Asia precluded regional arrangements in the short term, and geostrategic differences shaped the requisites for regional security.

289. The European Convention on Human Rights, the EU and the UK: Confronting a Heresy

Abstract:: The orthodox view of the ECHR and its Court as regime in the context of both the EU and UK has been that it has considerable value albeit with systemic flaws. The purpose of this article is to challenge this orthodoxy. Four inter-related submissions are made: that the ECHR has failed human rights conceptually (1); 'good' or lauded decisions of the ECtHR cannot remedy or sufficiently counter-balance this conceptual failure (2); 'bad' decisions further expose and exacerbate the failure (3); the procedural problems of the ECHR regime may contribute to the underlying failure of concept but their resolution cannot solve it (4). These submissions are to provoke a more intense assessment of value and how such value could be enhanced. It may be too late to see any influence on the accession process but this does not reduce the relevance of the critique for the future of human rights in both the EU and the UK. Ultimately an approach to the ECHR system needs to determine whether it continues to be lauded or its influence resisted (thus seeking reform or replacement - the alternative candidates being the EU Charter and/or a national Bill of Rights) and retained only as an iconic scheme of moral importance.

Abstract:: It has been all too common to criticize the Obama administration for a lack of strategic vision in responding to the Arab uprisings. While such criticism may be valid, it is time to move beyond critique and articulate not just a bold vision, but one that policymakers can realistically implement within very real economic and political constraints. During the remainder of its second term, the Obama administration has an opportunity to rethink some of the flawed assumptions that guided its Middle East policy before the Arab Spring—and still guide it today. Chief among these is the idea that the United States can afford to continue turning a blind eye to the internal politics of Arab countries so long as local regimes look out for a narrow set of regional security interests. With so much policy bandwidth focused on putting out fires, the United States has neglected the important task of thinking about its longer term engagement in the region. Crisis management is the most immediate concern for policymakers, but it's not necessarily the most important.

Abstract:: China's rise constitutes the most serious geopolitical challenge facing the United States today. On current trends, China could–many say will–develop a national economy larger than that of the United States as early as the end of this decade, at least when measured in purchasing power parity terms. China's national ambitions too are clear: at the very least, Beijing seeks to recover the centrality it enjoyed in Asian geopolitics until the coming of colonialism. Its economic renaissance since the 1980s has now positioned it to play a major global role that was simply unimaginable some thirty years ago. With its extraordinary military modernization program, Beijing has also made tremendous strides toward holding at risk the United States' forward deployed and forward operating forces in the western Pacific, thereby raising the costs of implementing U.S. security guarantees to its partners in the region. Its unique characteristics–being a continental sized power, possessing a gigantic and technologically improving economy, having a strategically advantageous location, and rapidly acquiring formidable military capabilities-add up quickly to make China a consequential rival to the United States, even if it differs from previous challengers in character, aims, and ambitions.

Abstract:: Conviction is widespread and increasing in both the United States and China—as well as many other countries—that the U.S.–China relationship is becoming less stable and more dangerous. We do not agree. Relations between Beijing and Washington in 2013 are more extensive, more varied, more interdependent, and more important to one another as well as to the global system than at any time in the past. But suspicion and mutual distrust persist and may have intensified. Yet, despite dramatic changes in the international system and the need to manage fleeting as well as persistent problems, the United States and China have maintained strategic stability for four decades. The relationship is less fragile and volatile than many assert, with strategic stability the result of multiple factors that reinforce one another and limit the deleterious effects of developments threatening specific "pillars" that undergird the relationship. Complacency and failure to address misperceptions and mistrust, however, will have unfortunate consequences for both sides.

Abstract:: If there is one idea that has consistently influenced western foreign policy since the Cold War, it is the notion that extending interdependence and tightening economic integration among nations is a positive development that advances peace, stability, and prosperity. As a post-Cold War idea guiding U.S. and European foreign policy, there is much to be said for it. The absorption of Eastern Europe in both the European Union and NATO helped consolidate market democracy. Globalization led to unprecedented growth in western economies, and facilitated the ascent of China and India, among others, taking billions of people out of poverty. Access to the international financial institutions also offered emerging powers the strategic option of exerting influence through existing institutions rather than trying to overturn them. Some policymakers and experts believe that this process holds the key to continuing great power peace and stability.

Abstract:: THE UNITED STATES supposedly is premised on “separation of church and state,” which means the American government should be neutral regarding religion. But is that really true? The author, a law professor and committed secularist, has strong opinions on this matter. Particularly since the 2004 presidential election that returned George W. Bush to the U.S. presidency for a second term, Ledewitz has been concerned that American secularism—both as an individual choice and a stance on the part of government—is under threat. Although the proportion of secular Americans has been growing rapidly in the twenty-first century, the successful marriage of religion and conservative politics in the U.S. might be inhibiting secularism from full acceptance as a valid alternative to religious commitment. After completing two earlier books on secularism in the U.S., Ledewitz reached the rather specific conclusion “that American constitutional law stood in the way of any serious engagement of secularism with religion” (p. xiii, emphasis mine). Thus, he sets forth in Church, State, and the Crisis in American Secularism to accomplish two tasks. First, he aims to detail how and why he feels current interpretation of “church-state separation” by the U.S. Supreme Court is problematic. Second, he endeavors to construct an alternative legal approach that would put religious people on common ground with secularists before the eyes of American law.

Abstract:: Having reached an interim accord in Geneva, two governments with a tortured political history must now work to sell it and the diplomatic strategy they have laid out to their own constituencies back home. In this paper, the role of the United States Congress in the process of developing American foreign policy in general and, in the current matter of Iran's nuclear file in particular will be examined. To do so, it describes the history of the relationship between the White House and Congress and then examines the difficult task of the Obama administration to garner support for its strategy in Congress. It reviews the reservations voiced by many in Congress regarding the Geneva nuclear interim accord as well as their misgivings regarding a final agreement. As the matter at hand involves high stake politics in the Middle East, it may carry grave consequences for the status quo in the region. The possible ramifications and the way this effects the position of those in Congress will also be explored. Lastly, since lobby groups have historically had a major role in American foreign policy towards the Middle East, their extensively-discussed role in this case as well as challenges they face will also be touched upon. In general, this paper proposes to describe specifically the way the US policy towards Iran is being formulated and what role Congress plays in the process. Effort will be made to find out to what extent the domestic politics has an impact on the approach of Congress towards Iran and how Congress may be influenced by Middle East regional powers.

Abstract:: What is the relationship between the doctrine of Tony Blair and America's invasion of Iraq? This paper tries to answer this question. So, it looks at the American invasion of Iraq and the British response, and argues that Brain always prevails over brawn. United States was and still is a hard power. Britain plays a soft power role in international relations. Britain usually uses the American strength and resources for the benefit of Britain. When the British describe their relations with the United States as "special," they mean that they have the power to influence and direct US foreign policy. For an understanding of the international politics, we must concentrate on Anglo-Saxon "interdependency" through the "special relationship" which often exists between British Prime Ministers and US Presidents. Winston Churchill, British Prime Minister of the 1940s, Harold Macmillan in the 1960s, Margaret Thatcher in the 1980s and Tony Blair in the 2000s, all had special relationships with their US counterparts. While not always the case, the relationship between Tony Blair, British Prime Minster, and George Bush, American President, was beneficial to British interest and Blair's doctrine of International Community declared in 1999. it is imperative not only to understand international politics, but also to react properly to international politics. As it has been proven in the Iraq case, Tony Blair manipulated US foreign policy during the George Bush presidency.

299. Arctic Security - An Equation with Multiple Unknowns

Abstract:: In May 2008, the five Arctic coastal states - the United States, Russia, Canada, Norway and the Kingdom of Denmark, including Greenland and the Faroe Islands - signed the Illulissat Declaration. The declaration established that the 'Arctic Five' will lay claim to the sea territorial rights awarded to them by the 1982. United Nations Convention on the Law of the Sea (UNCLOS), and that they will settle disputes within the framework of existing international law. This was a very strong message to NGOs and external state actors, arguing that a protective treaty should govern the Arctic, just like the Antarctic.

300. How Argentine Farmers Overpowered Monsanto: The Mobilization of Knowledge-users and Intellectual Property Regimes

Abstract:: Since the 1980s, governments and transnational corporations from core countries led by the United States have driven a global upward ratchet of intellectual property protection. In agriculture, this has meant strengthening the rights of seed companies over the plant varieties they develop and curtailing the rights of farmers over the seeds they cultivate. Exceptionally, from the 1990s to 2013, Argentine soy growers overcame the pressures from the seed industry, guaranteeing the right to freely save seeds of proprietary varieties from their own harvests for future cultivation. Based on a comparative historical analysis of conflicts over intellectual property on seeds in Argentina, Brazil, and Paraguay from the 1990s to 2013, this study suggests that a successful mobilization of knowledge-users in struggles over intellectual property depends on (1) the organizational stability of their political representation, (2) the coordination between the organizations that represent them, (3) the existence of independent channels for the representation of knowledge-users most sensitive to royalty payments, and (4) their ability to produce a public discourse capable of drawing support from a broad coalition.
