Abstract:
Conserving cultural heritage and archaeological sites have become a serious national concern in the Middle East for the war-affected countries, including Iraq and Syria. Because looting and violence have caused massive destruction of cultural heritage and archaeological sites, this study aimed to analyze the legal background concerning the protection of cultural heritage and archaeological sites in the context of Iraq and Syria during 2014 with the rise of the Islamic State of Iraq and Syria (ISIS). This study used the content analysis method and cross-country analyses for Iraq and Syria. The study is guided by two main questions: What is the government's legal role in protecting cultural heritage and archaeological sites? Are there any legal authorities in Iraq and Syria to protect cultural heritage and archaeological sites during war and conflict? In the end, this paper suggests that protecting cultural heritage is the legal responsibility of government which is supposed to be enforced in the legal foundation of the state as a national sovereign power.

Abstract:
The Turkish Military Intervention in the Syrian part of the Kurdistan region, known as Rojava, shows that the Syrian Civil War presents a great number of different sides. The objective of the intervention is to create a safe zone where two million syrians could be resettle, expelling from the area the kurd militias that oppose the government in Ankara. The present article wants to deep in the use of frames used by the Spanish written press when covering the Turkish military intervention in the Arab country. Through a classic and cuantitative methodology, named analysis of content, this paper will go into the mediatic discourses of the national press with the purpose of exploring what explanations are having a biggest importance. This contribution tries to explore if the humanitarian question weights more heavily that the ones focused on security./La intervención militar turca en el Kurdistán sirio, conocido como Rojava, demuestra que la guerra civil siria presenta una gran cantidad de aristas. El objetivo de la misma es crear una zona de seguridad donde reasentar a más de dos millones de refugiados sirios y expulsar del lugar a las milicias kurdas, opositoras al gobierno de Ankara. El presente artículo tiene como finalidad ahondar en el uso de encuadres utilizados por la prensa escrita española a la hora de cubrir la intervención militar turca en el país árabe. A través de una metodología clásica y cuantitativa, análisis de contenido, se ahondará en los discursos mediáticos de la prensa nacional con el objetivo de investigar qué narrativas están teniendo mayor peso. Esta contribución intenta explorar si las cuestiones humanitarias presentan mayor relevancia que las explicaciones centradas en la seguridad.

Abstract:
Terrorist violence led by the Kurdistan Workers’ Party (PKK) is one of the major issues of Turkey since the 1980s. This violence is based upon Kurdish ethnic identity aimed towards establishing an independent Kurdish state in Turkey’s southeast, northern Iraq, northern Syria and north-western Iran. Despite this aim, the terrorist campaign of the PKK predominantly targets security forces and civilians in Turkey. However, the existence of a terrorist group such a long time raises a question of the impact of external support on the formation and maintenance of the PKK. While Turkey has criticised constantly its southern neighbours on the PKK’s activities and tactics, the regional approaches have been largely neglected in the existing scholarly literature. This article aims to close this gap by focusing on the role played by Iraq, Iran and Syria in the PKK terrorism and Turkey’s counter-terrorism policies. The article argues that the major reasons for the unsuccessful result of Turkey’s effort to destroy the PKK were the approaches of ignorance of the PKK activities and the use of the group as a trump card by the three neighbours and insufficient policies to keep under control the regional dimension of the conflict. The article critically analyses historical relationships between these three states and Turkey to explore how the regional dimension has affected the resolution of this conflict.

Abstract:
We are proud to feature a collection of pieces that innovate new methodological approaches, confront the relationship between knowledge and power, and speak to the urgent concerns of the present, infrastructure, ecology, migration, and war. In “Epicures and Experts: The Drinking Water Controversy in British Colonial Cairo,” Shehab Ismail explores taste, class, and the environment. When in 1905 the Cairo Water Company altered its source of intake to deep wells instead of the Nile, it pitted experts, officials, and the urban poor in a battle over knowledge, medical traditions, and water practices. In tracing the five year struggle in which the palate became a battleground, Ismail reveals how taste, as a mode of embodied knowledge became a site of confrontation between heterogenous epistemic persuasions. In “From Mandate Borders to the Diaspora: Rashaya’s Transnational Suffering and the Making of Lebanon in 1925,” Reem Bailony traces debates on the social, political, and economic constructions of Lebanon and Syria, both in the borders of the French Mandate and well outside of it. By placing mahjar studies and Middle East studies in close conversation, Bailony both calls for and provides a model for a methodology that transgresses the territorial confines of the nation-state. In doing so, she reveals the crucial role of the mahjar in consolidating Lebanon as nationally distinct from Syria and in need of different sectarian arrangements. Neha Vora and Ahmed Kanna contribute reflections on two decades of ethnographic experiences researching Dubai and other cities in the Arabian Penninsula. “De-exceptionalizing the Field: Anthropological Reflections on Migration, Labor, and Identity in Dubai,” explores and critiques scholarly identity and authority in a call to develop understandings of Gulf cities that address migration, diaspora, place, and belonging. Vora and Kanna thus put the individual experiences of politics, geography, racialization, and minoritization into conversation with the knowledge that is produced on these historical forces. Graham Pitts reveals how the “human ecology” of Lebanon evolved according to the logic of an expanding and retracting global capitalism in “The Ecology of Migration: Remittances in World War I Mount Lebanon.” In detailing the material and environmental history of migration as well as highlighting World War I, the famine, and remittances, Pitts traces a broader trajectory of Lebanon’s history. In “Writing Shame in Asad’s Syria,” Judith Naef analyzes how the Syrian author Khaled Khalifa built feelings of shame into the literary structure of his novel No Knives in the Kitchens of this City. She traces the multiple forms of shame and how, like rot, its pervasive spread unravels relations. Shame, she suggests, is at once contagious and repulsive, and is one site to both refect on and understand the unraveling of Syrian social landscapes under the Asads’ authoritarianism. We ofer as always a robust set of reviews and review essays that feature the latest contributions to the study of the Middle East.

Abstract:
There are a variety of reasons to study geopolitical rivalries, and analysts, officers, and politicians are rediscovering such reasons amid the tensions of the last several years. The best reason to study geopolitical rivalries is the simplest: our need to better understand how power works globally. Power not only recurs in human and state affairs but it is also at their very core. Today’s new lexicon—superpower, hyperpower, and great power—is only another reminder of the reality of the various ways that power manifests itself. Power protects and preserves, but a polity without it may be lost within mere decades. Keith D. Dickson’s article in this issue of MCU Journal, “The Challenge of the Sole Superpower in the Postmodern World Order,” illuminates how fuzzy some readers may be in their understanding of this problem; his article on postmodernism calls us to the labor of understanding and reasoning through the hard realities. Ed Erickson’s survey of modern power is replete with cases in which a grand state simply fell, as from a pedestal in a crash upon a stone floor. Modern Japan, always richly talented, rose suddenly as a world actor in the late nineteenth century, but the Japanese Empire fell much more quickly in the mid-twentieth century. A state’s power—or lack thereof—is an unforgiving reality. This issue of MCU Journal, with its focus on rivalries and competition between states, is refreshingly broad in its selection of factors—from competing for or generating power. Dr. Erickson recalls that Alfred Thayer Mahan settled on six conditions for sea power, all still vital. During the presidential campaign, Trump said he “[doesn’t] like Assad at all” and described the Syrian leader as “a bad guy.” But he compared Assad favorably to the alternatives. “Assad is killing ISIS,” Trump stated, whereas “we don’t even know who they [the rebels] are.” Trump even claimed Assad to be “much tougher and much smarter” than political rivals Hillary Clinton and Barack Obama. Unsurprisingly, Assad and his admirers took heart in Trump’s surprise victory last November, with an adviser to the Syrian president saying the American people had “sent a great, a very important message to the world.” Yet Assad supporters – as well as the Syrian president himself – are taking a cautious approach to the new US administration, unsure of whether, and to what extent, Trump will overhaul American foreign policy. In developing U.S. intervention policy in Kosovo, Iraq, Libya, and most recently Syria, the 1992 to 1995 war in Bosnia and Herzegovina has repeatedly been used as an analogy. For example, John Shattuck, a member of the negotiating team at the Dayton peace talks that ended the war, wrote in September 2013 that for Syria “the best analogy is Bosnia…Dayton was a major achievement of diplomacy backed by force…A negotiated solution to the Syria crisis is possible, but only if diplomacy is backed by force.” Many other analysts and policymakers with experience in the Bosnian conflict—such as Nicholas Burns, the State Department spokesman at the time; Christopher Hill, a member of Richard Holbrooke's negotiating team; and Samantha Power, who began her career as a journalist in Bosnia—also invoked the Bosnian war to urge greater U.S. involvement in Syria. Although the rise of ISIS has significantly altered the conflict over the last year, echoes of the Bosnian conflict remain in Syria: the conflict is a multiparty ethnic civil war, fueled by outside powers, in a region of critical interest to the United States.

9. A Look Back at NATO’s 1999 Kosovo Campaign: A Questionably "Legal" but Justifiable Exception?

It was the last European war in a bloody century of European wars. Less than ten years after the collapse of the Berlin Wall, the 1999 Kosovo War—Operation Allied Force, as the North Atlantic Treaty Organization (NATO) referred to it—was unique in many respects. From the perspectives of both international law and the law of armed conflict, it significantly challenged the limits of jus ad bellum, the international laws of war governing the circumstances under which nations are permitted to use force, as well as jus in bello, the laws of war relating to proper conduct in war.[1] After decades of a NATO-Warsaw Pact standoff in Europe and proxy wars elsewhere it was not self-defense, but rather humanitarian considerations, that drew the NATO Alliance, with the United States in the forefront, into this conflict. While the seventy-eight-day NATO bombing campaign captured the world’s attention, not long after its conclusion this military operation began to fade from the public memory. Beyond the Balkans, a little more than two years after the Kosovo War’s conclusion, the traumatic events of September 11, 2001, would virtually remove global examination and recollections of the Kosovo conflict from the agenda. The United States and much of the world embarked on an entirely new, 21st century ideological and combative struggle: fighting the scourge of terrorism. Nevertheless, the Kosovo War has alternatively been referred to as a reference point by Americans who have sought a response to the Syrian conflict as well as by Vladimir Putin as justification for his claims to Crimea and the “protection” of Russian nationals. Some sixteen years after the Kosovo conflict and Operation Allied Force, it is worth asking: are there any insights to be recalled and gained from this conflict? What has been the war’s effect on the law of international armed conflict to date? Is Mr. Putin right to refer to the Kosovo campaign as his justification for the use of force, either implied or explicit, in Crimea or greater Ukraine? It will be argued here that in spite of significant concern and warnings then that the Kosovo campaign would provide a dangerous precedent for international law and even global stability,[2] it has had a nominal if not negligible effect on the body of international law as informed by jus ad bellum. In spite of Mr. Putin’s attempts to try to identify it as a precedent, the Kosovo campaign was indeed an exception. While it was characterized as a messy and “ugly” affair,[3] it did accomplish what it intended to do: stop the killing of potentially tens of thousands of Kosovar Albanians and the expulsion of hundreds of thousands more from Kosovo, ultimately providing them with a better and more secure life than was possible in the pre-Kosovo campaign period.

The Arab Spring gave rise to a variety of transitions in the Middle East. Although initial developments in Tunisia and Egypt created optimism, tragic events in Egypt, Syria, Tunisia and elsewhere revived fears about a return to authoritarian governments, failed states and civil war. With no foreseeable change in the UN Security Council with regard to Syria, the country's neighbors, including Turkey, face the risk of instability. Although a recent agreement between the US and Russia marked a major step toward destrying the regime's chemical stockpile, it fails to address the conflict itself. As such, spillover effects continue to threaten Syria's neighbors. This paper highlights the critical nature of the situation and the international community's role in finding a solution.

After more than three years of corrosive wars, Syria no longer exists as a nation-state. It has been replaced by disparate entities and precarious arrangements – to the detriment of the Syrian population. The 'Divided States of Syria' are in large part the result of the survival strategy of the regime, aided by the futile pursuit of a 'political solution' by the international community. As the tragedy deepens, the recovery of Syria becomes more difficult, and the implications for regional stability increase in gravity. The West – the United States in particular – has abstained from forceful engagement. Yet, the price to pay today may in retrospect pale in light of the political, strategic and moral catastrophes that the current reserved approach is enabling.

The civil war in Syria continues to devastate social and political structures, precipitating floods of refugees and surging populations of internally displaced people. Syria has degenerated into sectarian- and ethnic-based warring mini-states vying for power as their country faces utter social disorder. It mass-produces a growing cadre of battle hardened foreign and domestic jihadists affiliated with the various al-Qaeda brands. The war weariness of America and the unmanageable chaos in Syria combine to create shifts in regional politics. This article seeks to put into perspective the crucial role that regional mediation can play in nudging along practical solutions. Without regional commitment and coordination among key Middle Eastern powers, namely Iran, Saudi Arabia and Turkey, international diplomatic efforts to restore order and stability in Syria are not likely to succeed.

On September 27, 2013, the security council of the United Nations unanimously adopted resolution 2118 in support of the decision of the organization for the Prohibition of chemical Weapons (oPcW) made on the same day in The Hague to place Syrian chemical weapons under international control and dismantle them. This was the culmination of the Ministerial Week at the 68th session of the un general assembly in New York, an event which was expected by all, but not all believed that it would happen. All, however, eventually acknowledged that it came about largely through to the efforts of Russian diplomats who, led by Foreign Minister Sergey Lavrov, negotiated day after day with the U.S.. partners, seeking a solution which not only would avert the threat of a military strike against Syria, but would also open the way for politically resolving the most complicated crisis in the SAR.

SINCE SEPTEMBER 11, 2001, the United States has damaged its reputation and national security by lurching from one war to the next. Afghanistan, which began triumphantly for the Bush administration, has devolved into a protracted and inconclusive war in which the Taliban is making fresh inroads as American and allied forces hand over security to the Afghan army. Then there is Iraq. It was purveyed by the Bush administration to the American public as a mission that could be accomplished swiftly and smoothly. Neither occurred. Since then, President Obama's self-styled humanitarian intervention in Libya has led to instability, allowing local militias, among other things, to pretty much bring the oil industry to a standstill by disrupting major export terminals. Most recently, it looked as though Syria might be Libya all over again-an American president embarks on an uncertain crusade, and Britain and France join to provide the necessary diplomatic persiflage for justifying a bombing campaign.

The regime of Bashar al-Assad in Syria has been demonstrating a relatively high level of tenacity amid the proxy war raging in the country for over two years now. Indeed, the authoritarian regime in Tunisia folded up in two weeks; the Mubarak regime in Egypt, in slightly over four weeks; the Colonel Qaddafi regime collapsed after six months of NATO strikes. Russian expert Prof. Edouard Ozhiganov has offered a methodologically exact comment: “Any political regime can be described as stable to the extent to which it can neutralize inside and outside pressure using its own resources and instruments.”
