Abstract:
Russia’s war in Ukraine fundamentally challenges the post-Cold War international order. Yet the scenario of a renewed Cold War must be balanced by alternative visions of European order. This contribution reassesses the concepts of interdependence, socialization, normative power, and international society taken from international relations theory to develop some general lessons for European order and concrete pointers toward alternative policy paths. Such an order needs to build on a more honest engagement, serious great power management mirrored by societal linkages, and creative thinking about joint institutions and regional overlaps.

The 1938 Munich Agreement (Akehurst, 1972) by which the Allies allowed Adolf Hitler’s Germany to take the Sudetenland from Czechoslovakia is also known as the Munich Betrayal or, to English speakers, as appeasement by Neville Chamberlain (Valladares, 2020). This historical moment reminds me very much of how the West has dealt with Russia since Vladimir Putin rose to power. Like Adolf Hitler, Vladimir Putin has been sending aggressive signals to his neighbours and Western nations (Putin, 2007) since his 2005 speech arguing that the collapse of the Soviet empire ‘was the greatest geopolitical catastrophe of the [20th] century’” (Putin, 2005). Note that he did not mention the Bloodlands that Timothy Snyder described, i.e. the killing of 14 million people in Central and Eastern Europe (Snyder, 2010), or World War II (Halloran, 2015) as the greatest catastrophe.

During a recent webinar, I was asked to address the following question: what does Russia’s invasion of Ukraine mean for Türkiye’s approach to the Caucasus and Central Asia? At first, the question struck me as odd. Having worked on these issues since the late 1990s and now living in Istanbul, it seemed obvious to me that Türkiye’s goals in these regions have been enduring since the end of the Cold War and were not changing because of Russia’s latest invasion of Ukraine. These goals, I said, were and remain to: secure westward exports of oil and natural gas produced in the Caspian Basin; promote stability in the South Caucasus; and strengthen Türkiye’s business and cultural ties with the Turkic populations of Azerbaijan, Turkmenistan, Kazakhstan, Uzbekistan, and Kyrgyzstan. Türkiye’s approach toward Russia in this context also remains what it has been since the Ottoman centuries: cooperate where possible but confront where necessary. Reflecting momentarily on this question, however, I realized how different Ankara’s goals appear from the perspectives of Washington, Paris, and Athens. In these and other NATO capitals, Turkish foreign policy seems to have shifted from its pursuit of “zero problems with neighbors” during the early years of the leadership of Recep Tayyip Erdogan to one of “zero neighbors without problems.” Türkiye is thus viewed within the Atlantic Alliance as a belligerent outlier, bent on violating international law to pursue the extraction of Eastern Mediterranean hydrocarbons, enabling Azerbaijan to use military force during the Second Karabakh War, and aligning in Syria more with Russia than with its own treaty allies.

4. Vengeful Citizens, Violent States: A Theory of War and Revenge, Rachel Stein

Abstract:
By showing that mass vengefulness helps democratic leaders bring their nations to war, this wonderful book significantly advances our understanding of how cultural values affect international politics. Its most important contribution is demonstrating that democracies that retain death penalty laws were significant more likely to initiate the use of force than non-death-penalty democracies in the 1945–2001 period. The finding is robust to a variety of control variables and specifications, although skeptics may wonder whether it might be inflated by ethnocentrism, beliefs about the utility of violence, or other unmeasured potential covariates. Rachel Stein attributes the belligerence of death penalty states to cross-national differences in vengeful cultures, on the grounds that citizens’ vengefulness predicts both cross-sectional support for the death penalty and cross-national differences in the penalty’s retention. Her rigorous analysis greatly strengthens the case that the unusual bellicosity of retributivists, observed by Stein and other researchers, affects actual interstate conflict.

5. From Struggle to Permanent Failure Why the Karabakh Attempt at Secession Failed

After 44 days of fighting, the Second Karabakh War came to an end on 10 November 2020 as a result of a Russian‑brokered ceasefire agree­ment. The most important questions here appear to be: what led to this dangerous military escalation, and what does it mean for the conflict, given that it seems to have now entered into a (new) political phase, again? In the declining Soviet Union, what was originally a status dispute over the autonomous Nagorno‑Karabakh region escalated into an international violent conflict between Armenia and Azerbaijan in the early 1990s. Following the end of a bloody war in 1994 (the First Karabakh War, 1992‑ 1994), a fragile situation around the conflict region took root: the “frozen conflict,” as it came to be known, lasted for nearly three decades and led to conditions of neither war nor peace. And during this period, it was feared that the longer the sides had to wait for a peace agreement to be reached, the more likely the conflict would re‑escalate and even­tually erupt again into a hot war. As it turned out, this is exactly what happened: an all‑out six‑week war erupted again unexpectedly between the conflict parties in late September 2020, and, as a result, the Armenian side more or less capitulated. But first things first: in the First Karabakh War, Azerbaijan suffered a major defeat, ceding to Armenian forces not only the secessionist region itself but also seven surrounding territo­ries. These other lands were, as a whole, twice the size of Nagorno‑ Karabakh itself and contained five times the old oblast’s population, the entirety of which was expelled by the time an armistice was signed in 1994. And that is why during this war the UN Security Council re­sponded by passing four resolutions demanding the withdrawal of Arme­nian forces from the occupied areas of Azerbaijan. However, the UN res­olutions failed to have any effect. Since that time, no international protagonists felt a strong, compelling need to try to resolve the Nagorno‑ Karabakh conflict. In addition, all in­ternational actors dismissed the idea of “power mediation.” Moreover, although Russia as a key international actor is directly involved in all the conflicts on the territory of the former Soviet Union, its involvement in the Nagorno‑Karabakh dispute has been rather indirect: in the Karabakh case, Moscow has been both a critical and a questionable actor. On the one hand, the Kremlin has taken a central position in me­diating a peaceful settlement to the conflict while, on the other hand, it has been delivering weapons to both sides. This last represents perhaps the most striking situation regarding the international dimension of the con­flict. Russia is militarily allied with Armenia and has a military presence in the country. It has provided secu­rity guarantees to Yerevan, primarily through their shared membership in the Collective Security Treaty Organization (CSTO), which neu­tralized to a certain extent the poten­tial effects of Russian arms being sold to financially strong Azerbaijan on a purely commercial basis.

6. El artículo analiza la compleja relación, presente en la esfera internacional,entre política y justicia que queda reflejada en el Tribunal Especial para el Líbano. Se emplean,como líneas argumentales, la problemática de su establecimiento por medio de la resolución 1757 (2007) del Consejo de Seguridad y su carácter selectivo, así como la confrontación jurídico-doctrinal planteada en el caso Ayyash et al., también conocido como asunto Hariri. Se subraya la importancia de los factores contextuales,especialmente aquellosdesencadenados a partir de 2004, con el fin de explicar la división interna —con protagonistas internacionales—del país en dos bloques cuya confrontación serviría de pretexto para la puesta en marcha de un tribunal único que responde a los intereses de una comunidad internacional seducida porla posibilidad de lograr una condena judicial por terrorismo contra Hizballah —y/o Siria—en un momento de preponderancia de la formación chií.La decisión interlocutoria de 2011 de la Sala de Apelaciones pareció manifestarse como un buen augurio en aquella dirección al afirmar la necesidad de interpretar el delito de terrorismo recogido en el artículo 314 del Código Penal del Líbano conforme a un crimen internacional de terrorismo de carácter consuetudinario. La revolucionaria decisión —junto con el proceso que llevó a su publicación—reveló,sin embargo,cierta precipitación y oportunismo que por fortuna y justicia la sentencia de 2020 rechaza por innecesaria e incierta.El artículo sostiene que todo ello ha contribuido a debilitar la credibilidad de un Tribunal,ejemplo de justicia selectiva, y ha mostrado pocadeferencia por la soberanía del Estado libanés.

Este artículo trata los diferentes enfoques geopolíticos de las causas de la guerra. Comienza con la exposición de la relación histórica entre la geopolítica y la guerra a partir de las contribuciones de diferentes autores para presentar las principales explicaciones sobre esta materia. De esta forma analizamos el papel de la geografía en la guerra y su impacto en los conflictos. Esto nos conduce a la perspectiva organicista que considera que la expansión del Estado es un fenómeno natural que produce la guerra. Además, la geografía físicainfluye en el estallido de la guerra. El segundo enfoquees el de la disposición de las tierras emergidas que afirma que determinados lugares son propensos a la guerra debido a su ubicación estratégica. El tercer enfoque es el accidentalista. Los autores de esta perspectiva afirman que la guerra depende de la distancia geográfica entre países y los conflictos fronterizos. Finalmente, desarrollamos una nueva perspectiva basada en la fragmentación geopolítica para explicar la guerra en la Europa moderna. Este enfoque explora la importancia de la fragmentación en la formación del Estado moderno y en el moldeamiento de un entorno anárquico con el nacimiento del sistema de Estados. La guerra se convirtió en un rasgo del sistema internacional debido a que el Estado moderno nació para hacer la guerray se convirtió en la institución dominante. Por tanto, la fragmentación geopolítica es la causa principal dela violencia entre Estados en la Europa moderna.

In 2019, the 38th Commandant of the Marine Corps released his planning guidance that laid out the strategic focus and future direction of the Marine Corps. General David H. Berger’s intent for the following four years concurred with the analysis of the previous Commandant and the necessary alignment of the Corps with the National Defense Strategy for the future needs of the Fleet by focusing on five areas: force design, warfighting, education and training, core values, and command and leadership. General Berger cogently noted that the coming decade will be characterized by conflict, crisis, and rapid change—just as every decade preceding it. And despite our best efforts, history demonstrates that we will fail to accurately predict every conflict; will be surprised by an unforeseen crisis; and may be late to fully grasp the implications of rapid change around us. Berger’s primary concern is that the Marine Corps is not fully prepared— equipped, trained, or organized—to support the naval force. To that end, force design became the priority for Marine Corps efforts to fulfill its role for the Fleet as prescribed by the U.S. Congress. The level of change required to integrate the Corps of the future with the naval forces of today would not happen overnight and certainly not without a great deal of growing pains to ensure the Corps is equipped and prepared for the future security environment. When Force Design 2030 was released in March 2020, the Marine Corps was prepared to make the force-wide changes necessary to partner with the Navy and serve as the country’s naval expeditionary force. Our current force design, optimized for large-scale amphibious forcible entry and sustained operations ashore, has persisted unchanged in its essential inspiration since the 1950s. It has changed in details of equipment and doctrine as technology has advanced toward greater range and lethality of weapon systems. In light of unrelenting increases in the range, accuracy, and lethality of modern weapons; the rise of revisionist powers with the technical acumen and economic heft to integrate those weapons and other technologies for direct or indirect confrontation with the U.S.; and the persistence of rogue regimes possessing enough of those attributes to threaten United States interests, I am convinced that the defining attributes of our current force design are no longer what the nation requires of the Marine Corps. Berger’s plan pointed to specific areas of change required to make force design a reality: the size, capacity, and capability of the Corps. In an austere fiscal environment, the Marines must assess their current capabilities to achieve a smaller footprint with broader reach—do more with less. As the reality of COVID-19 and the 2020 U.S. presidential election have so poignantly reminded us all, these tasks cannot and should not rest on any single shoulder and any response should be well considered and intended to benefit the greater good. This issue of the Journal of Advanced Military Studies (JAMS) will address elements of the Commandant’s Planning Guidance, particularly the concept of naval integration and what it means for the Services, especially the Marine Corps. Our authors look to the past for relevant examples of military successes and failures of integration, but they also discuss how future warfare will play out based on these concepts. The authors explore the topic from a variety of perspectives, including those for and against, and they offer analyses of past and current attempts and what naval integration may mean for the future of the Corps. The following articles present the capabilities that will be required to shift from a traditional power projection model to a persistent forward presence and how the Marine Corps can exploit its positional advantage while defending critical regions. Our first author, Dr. Matthew J. Flynn, presents a historical approach to the topic in his article “The Unity of the Operational Art: Napoleon and Naval Integration.” Flynn’s research calls for greater coordination between the sea and land domains to improve U.S. national security. His article draws parallels between Napoleon Bonaparte’s defeat and the importance of naval integration for military success: “Napoleon’s fate reveals a great deal about naval integration and how it explains France’s defeat and, most importantly, that there is but one operational art—not one for land and one for sea.” Our second author, Andrew Rhodes, also relies on a historical example with his discussion of the salient lessons that can be learned from the Sino-Japanese War. Rhodes encourages professional military educators and planners who are developing future operational concepts to look beyond simply retelling history and consider how the legacy of this conflict might shape Chinese operational choices. He reinforces From the Editors 9 Vol. 11, No. 2 the concept that military history is not simply a resource for answering concerns about future conflict, but it encourages us to ask better questions about the role of the sea Services and how they can handle uncertainty when preparing for the future. Lieutenant Colonel Michael F. Manning’s “Sea Control: Feasible, Acceptable, Suitable, or Simply Imperative” offers a historical review of early twentieth century Japanese naval battles as a framework to model possible future contests for control of the maritime domain. Manning believes that control of the maritime domain is a prerequisite for assured access and sets the condition for successful Joint operations. Manning believes that “nations not only have to compete with their enemy’s major air and naval capabilities but must also defend against land-based airpower; missiles; torpedoes; short-range, antisurface warfare assets; and coastal mines.” Colonel Scott Erdelatz (Ret) and his team of coauthors focused on an old approach for a new era of naval integration that acknowledges the long-term threat posed by China but also considers how much of what we know as the Marine Corps should be retained to fulfill other missions. Erdelatz et al. also analyze how radical integration might incur significant risk for the Marine Corps if long-term force structure decisions are based on still-evolving concepts and unproven technologies. Major Michael Kohler’s article, “The Joint Force Maritime Component Command and the Marine Corps: Integrate to Win the Black Sea Fight,” discusses how most current Marine and Navy integration takes place at the Service-chief level and primarily focuses on the Pacific. Kohler, however, believes that naval integration is also an important component of a successful defense against Russian expansion in the Black Sea region. Dr. John T. Kuehn shifts the focus to carriers and amphibious operations with his article “Carriers and Amphibs: Shibboleths of Sea Power.” Dr. Kuehn argues that aircraft carriers and Amphibious Ready Groups (ARGs) with an embarked Marine Expeditionary Unit represent shibboleths of seapower that conflate a deeper understanding of where the U.S. Fleet belongs now and where it needs to go in the future to face the challenges of the twenty-first century. Major B. A. Friedman’s article, “First to Fight: Advanced Force Operations and the Future of the Marine Corps,” then circles back to the traditional Marine Corps stance as always first to fight and the need for advanced force operations in the Corps of the future. Steven A. Yeadon’s article, “The Problems Facing United States Marine Corps Amphibious Assault,” rounds out the current perspective with a review of issues the Marine Corps has faced with amphibious assaults. Yeadon offers actionable information on current limitations and vulnerabilities of U.S. amphibious forces to chart a way forward for a robust forcible entry capability from the sea. The discussion closes with two articles looking to the future of naval in- 10 From the Editors Journal of Advanced Military Studies tegration and the Marine Corps. Major Matthew C. Ludlow’s article, “Losing the Initiative in the First Island Chain: How Organizational Inefficiencies Can Yield Mismatched Arsenals,” presents what may be considered a losing proposition of initiatives in China’s First Island Chain; however, strategic gaps in capabilities have emerged that could dramatically impact the ability to execute an island-defense strategy. The final article by Lieutenant Colonels Terje Bruøygard and Jørn Qviller, “Marine Corps Force Design 2030 and Implications for Allies and Partners: Case Norway,” offers a larger discussion of Force Design 2030 and its future implications for American allies with a case study on Norway. The authors encourage the Department of Defense to consider greater interoperability between and among Services and allies, including increased communication with allies on changes happening at the Service and national level of the U.S. armed forces. The remainder of the journal rounds out with a review essay and a selection of book reviews that continues our focus on naval integration, but it also highlights continuing challenges in national security and international relations. The coming year will be busy for the JAMS editors as we work to provide journal issues on a diverse range of topics relevant to the study of militaries and defense.

8. Ottomanism at its Final Gasp: Memoirs of the Ottomans on Duty in Arab Provinces during World War I

Abstract:
This study aims to expose the ways in which leading officials of the Committee of Union and Progress (the CUP) interpreted, internalized, and questioned the conditions of their mission in Arab lands during World War I (WWI). It builds on the memoirs of Falih Rıfkı, aide-de-camp of Commander-in-Chief Cemal Pasha, and Halide Edip, an ardent supporter of the social and educational reforms of the CUP government. Both written after the war, these memoirs reflect not only nostalgia and regret but also the complicated relationship between Turkish officials and Arabs on the eve of their breakup from one another as citizens of the Ottoman State. The study also questions the orthodox argument that the Turkist and anti-Arabic ideology of the CUP government in general and Cemal Pasha’s wartime crusade against Arab nationalists in particular triggered the emergence of Arab nationalism. By contemplating the memoirs of CUP members in Arab lands, this study argues that Falih Rıfkı, Cemal Pasha, and Halide Edip tried to understand the region and its people in order to create a mutual future for Turks and Arabs within the Ottoman Empire.

Abstract:
This paper focuses on Turkey’s foreign policymakers’ attitudes in the context of the 2003 US decision to wage war against Iraq. The main goal is to assess and downplay the impact of religion in relation to security-related concerns. Drawing on official speeches, interviews, declarations by key figures in the foreign policy process, the paper argues that religion is nothing more than an intervening factor in the case of Turkey’s approach to the 2003 war in Iraq. Therefore, notwithstanding the role of Islamist elites in the foreign policy decision-making of Turkey, Turkey’s foreign affairs were rather inspired by realist behaviour, driven by pragmatic considerations, aimed at pursuing rationalist goals.

Las guerras dácicas de Trajano (101-106 d.C.) implicaron múltiples movimientos de población por parte de todos los contendientes, que afectaron al desarrollo y desenlace del conflicto, condicionando muchas de las decisiones de las potencias implicadas. Del mismo modo, la intensidad y escala de la conflagración, que se extendió a lo largo y ancho de la Europa danubiana y póntica, se saldó con cuantiosas pérdidas de población, consecuencia directa e indirecta de los enfrentamientos armados. Finalmente, el proceso de consolidación del poder romano en Dacia tras la conquista y sus particularidades supusieron la deportación y desplazamiento intencional de grupos de población nativa, migraciones hacia zonas libres de la ocupación romana y otros problemas de orden sociopolítico y demográfico resueltos por el Imperio romano mediante una colonización planificada del nuevo territorio y toda una serie de arreglos diplomáticos concluidos en 119 d.C. En este artículo abordamos, a través de las fuentes literarias, epigráficas, numismáticas, arqueológicas e iconográficas disponibles, estos procesos demográficos, las realidades derivadas de los mismos y sus consecuencias en el marco de las guerras dácicas de Trajano, procesos que condicionaron la situación geopolítica de la región y, por lo tanto, la futura configuración de la Europa del Este.

11. Not Our War: Iraq, Iran and Syria’s Approaches towards the PKK

Abstract:
Terrorist violence led by the Kurdistan Workers’ Party (PKK) is one of the major issues of Turkey since the 1980s. This violence is based upon Kurdish ethnic identity aimed towards establishing an independent Kurdish state in Turkey’s southeast, northern Iraq, northern Syria and north-western Iran. Despite this aim, the terrorist campaign of the PKK predominantly targets security forces and civilians in Turkey. However, the existence of a terrorist group such a long time raises a question of the impact of external support on the formation and maintenance of the PKK. While Turkey has criticised constantly its southern neighbours on the PKK’s activities and tactics, the regional approaches have been largely neglected in the existing scholarly literature. This article aims to close this gap by focusing on the role played by Iraq, Iran and Syria in the PKK terrorism and Turkey’s counter-terrorism policies. The article argues that the major reasons for the unsuccessful result of Turkey’s effort to destroy the PKK were the approaches of ignorance of the PKK activities and the use of the group as a trump card by the three neighbours and insufficient policies to keep under control the regional dimension of the conflict. The article critically analyses historical relationships between these three states and Turkey to explore how the regional dimension has affected the resolution of this conflict.

Abstract:
Russia and China are terraforming the maritime environment as part of their warfare. In both cases the actions are illegal and the performance is offensive to its actual nature. In the case of China, the practice is construction of artificial islands in the South Chinese Sea and in the case of Russia it is about the infamous bridge built over the Kerch strait, Ukraine. Neither Russia nor China expects an armed conflict with the West in the near future. That is a reasonable assumption, which is weaponized at the political-strategically level. The attack of this weaponized situation is that the trust in the West. Primarily the EU (European Union) and NATO (North Atlantic Treaty Organization), is eroded for every day which these countries challenges the international system which the western democracies say that they present and defend. China and Russia offer their authoritarian systems as a replacement and there are a lot of pseudo-democratic or even out-right authoritarian regimes on the sideline watching this challenge unfold. The article highlights the difference for the NATO-countries in logic of practice when it comes to the political social field on one hand and the military political field on the other hand. The article uses material from a previously unpublished survey made on NATO-officers then attending courses at NATO Defense College (NDC).

Abstract:
There are a variety of reasons to study geopolitical rivalries, and analysts, officers, and politicians are rediscovering such reasons amid the tensions of the last several years. The best reason to study geopolitical rivalries is the simplest: our need to better understand how power works globally. Power not only recurs in human and state affairs but it is also at their very core. Today’s new lexicon—superpower, hyperpower, and great power—is only another reminder of the reality of the various ways that power manifests itself. Power protects and preserves, but a polity without it may be lost within mere decades. Keith D. Dickson’s article in this issue of MCU Journal, “The Challenge of the Sole Superpower in the Postmodern World Order,” illuminates how fuzzy some readers may be in their understanding of this problem; his article on postmodernism calls us to the labor of understanding and reasoning through the hard realities. Ed Erickson’s survey of modern power is replete with cases in which a grand state simply fell, as from a pedestal in a crash upon a stone floor. Modern Japan, always richly talented, rose suddenly as a world actor in the late nineteenth century, but the Japanese Empire fell much more quickly in the mid-twentieth century. A state’s power—or lack thereof—is an unforgiving reality. This issue of MCU Journal, with its focus on rivalries and competition between states, is refreshingly broad in its selection of factors—from competing for or generating power. Dr. Erickson recalls that Alfred Thayer Mahan settled on six conditions for sea power, all still vital. Other authors writing for this issue emphasize, by turns, sea power (Steven Yeadon, Joshua Tallis, and Ian Klaus); cyberpower (Jamie Shea); alliances (T. J. Linzy and Ivan Falasca); information (Dickson); and proxies (Michael Auten, Anthony N. Celso, and others).

15. The ad bellum Challenge of Drones: Recalibrating Permissible Use of Force

Drones constitute an incremental advance in weapons systems. They are able to significantly reduce overall, as well as collateral, damage. These features seem to have important implications for the permissibility of resorting to military force. In short, drones would seem to expand the right to resort to military force compared to alternative weapons systems by making resorting to force proportionate in a wider set of circumstances. This line of reasoning has significant relevance in many contemporary conflicts. This article challenges this conclusion. It argues that resorting to military force through drones in contemporary asymmetrical conflicts would usually be disproportionate. The reason for this is twofold. First, under conditions of radical asymmetry, drones may not be discriminatory enough, and, thereby, collateral damage would still be disproportionate. Second, their perceived advantages in terms of greater discrimination are counteracted by the lesser chance of success in achieving the just cause for war. As a result, resorting to military force through drones in contemporary asymmetrical conflicts would generally be disproportionate not because of the harm they would expectedly cause but, rather, because of the limited harm they are ultimately able to prevent. On the basis of normative argument and empirical data, this article ultimately shows that we need to revise our understanding of proportionality not only at the level of moral argument but also in international law.

Two key facts about late medieval England: The kingdom had no standing army and was at war for most of the period between 1294 and 1485. Given these circumstances, it might seem ambitious to identify a role for the military of the time in a non-war environment. Nonetheless, this peacetime role existed, and created a state of preparedness that was crucial to success when the kingdom went to war. Under ‘bastard feudalism’ the leaders of the army, trained in war and incubated in a thoroughly military ethos and culture, through their efforts in domestic governance, provided the stability at home and the financial and material resources which were as vital to the victories of the Hundred Years’ War as the much better known and remembered archers of Crecy and Agincourt. This article will provide background into medieval military and landed society before tracing how the governmental role of this group increased alongside ‘bastard feudalism’ in response to the crown’s need to find the resources for war. It will then show how ‘bastard feudalism’ worked for king, nobles and gentry in tandem and how this, in turn, created experienced administrators who were able to support the war effort. ‘Feudalism’ is a term synonymous with the Middle Ages. The feudal pyramid, with the king at the apex, his nobles and knights beneath, and peasants on the bottom, will be familiar to readers from their school days. ‘Bastard feudalism’, on the other hand, is less well-known and usually has currency only in academic journals. Both are highly controversial terms among medievalists and some even deny the existence of one or the other, or both. Most historians, however, would accept that, in England at least, there was a gradual transition from feudalism—where the principal means by which the king or nobleman rewarded his followers was through a permanent grant of land—to ‘bastard feudalism’—where rewards were primarily paid in cash payments. It was the last European war in a bloody century of European wars. Less than ten years after the collapse of the Berlin Wall, the 1999 Kosovo War—Operation Allied Force, as the North Atlantic Treaty Organization (NATO) referred to it—was unique in many respects. From the perspectives of both international law and the law of armed conflict, it significantly challenged the limits of jus ad bellum, the international laws of war governing the circumstances under which nations are permitted to use force, as well as jus in bello, the laws of war relating to proper conduct in war.[1] After decades of a NATO-Warsaw Pact standoff in Europe and proxy wars elsewhere it was not self-defense, but rather humanitarian considerations, that drew the NATO Alliance, with the United States in the forefront, into this conflict. While the seventy-eight-day NATO bombing campaign captured the world’s attention, not long after its conclusion this military operation began to fade from the public memory. Beyond the Balkans, a little more than two years after the Kosovo War’s conclusion, the traumatic events of September 11, 2001, would virtually remove global examination and recollections of the Kosovo conflict from the agenda. The United States and much of the world embarked on an entirely new, 21st century ideological and combative struggle: fighting the scourge of terrorism. Nevertheless, the Kosovo War has alternatively been referred to as a reference point by Americans who have sought a response to the Syrian conflict as well as by Vladimir Putin as justification for his claims to Crimea and the “protection” of Russian nationals. Some sixteen years after the Kosovo conflict and Operation Allied Force, it is worth asking: are there any insights to be recalled and gained from this conflict? What has been the war’s effect on the law of international armed conflict to date? Is Mr. Putin right to refer to the Kosovo campaign as his justification for the use of force, either implied or explicit, in Crimea or greater Ukraine? It will be argued here that in spite of significant concern and warnings then that the Kosovo campaign would provide a dangerous precedent for international law and even global stability,[2] it has had a nominal if not negligible effect on the body of international law as informed by jus ad bellum. In spite of Mr. Putin’s attempts to try to identify it as a precedent, the Kosovo campaign was indeed an exception. While it was characterized as a messy and “ugly” affair,[3] it did accomplish what it intended to do: stop the killing of potentially tens of thousands of Kosovar Albanians and the expulsion of hundreds of thousands more from Kosovo, ultimately providing them with a better and more secure life than was possible in the pre-Kosovo campaign period.

Abstract:
This article intends to explain the transformation of the foreign policy since the end of the Cold War through the hypothesis of the evolution of the interactions between the professional groups: military, diplomats and industrialists. Using the genesis of French civil-military activities in Bosnia and in Kosovo between 1992 and 2001 as empirical framework, we endeavor to objectify the cross-sector dynamics which permeate with the bureaucratic competition between administrations, the mobilizations of senior officials and the interministerial division of labor in matter of international crises management. We wonder to what extent the international crises “managers” form an institutional space, a professional group or a social field in process of empowerment within the current foreign and defense policy.

19. Humanity Considerations Cannot Reduce Wars Hazards Alone: Revitalizing the Concept of Military Necessity

The exercise of brute force by militaries, though common, reflects professional incompetency. A well-trained military has an inherent interest in enhancing its operational effectiveness and constraining unnecessary brutality. The law of armed conflict, however, generally ignores the constraining effect of the necessity principle, originally intended to allow only the minimally necessary use of force on the battlefield. Consequently, the prevailing law places the burden of restricting the exercise of brute military force upon humanitarian considerations (and the specific norms derived from them). Humanity alone, however, cannot deliver the goods and substantially reduce war’s hazards. This article challenges the current dichotomy between the two pillars – mistakenly assumed to be polar opposites – of the law of armed conflict: necessity and humanity. It calls for the transformation of the military’s self-imposed professional constraining standards into a revised legal standard of necessity. Though the necessity principle justifies the mere use of lethal force, it should not only facilitate wielding the military sword but also function simultaneously as a shield, protecting combatants and non-combatants alike from excessive brutality. The suggested transformation would bind and restrain the prospective exercisers of excessive force, political and military alike, and restrict the potential damage that might be caused both intentionally (to combatants) and collaterally (to non-combatants). The combined effect of the current changes in war’s pattern and the law of armed conflict, in the military and social thinking of recent decades, and the new strategies available due to the development of new military technologies have all created a new war environment – one that may be ready to leverage the constraining potential of military professionalism into a binding legal standard and norms.

Ideas shape human behavior in many circumstances, including those involving political violence. Yet they have usually been underplayed in studies of the causes of armed mobilization. Likewise, emotions have been overlooked in most analyses of intrastate conflict. A mixed-methods analysis of Italian resistance during the Fascist regime and the Nazi occupation (1943–45) provides the opportunity to theorize and analyze empirical evidence on the role of indignation and radical ideologies in the process of armed mobilization. These nonmaterial factors play a crucial role in the chain that leads to armed collective action. Indignation is a push factor that moves individuals away from accepting the status quo. Radical ideologies act as pull factors that provide a new set of strategies against the incumbent. More specifically, detachment caused by an emotional event disconnects the individual from acceptance of the current state of social relations, and individuals move away from the status quo. Ideologies communicated by political entrepreneurs help to rationalize the emotional shift and elaborate alternative worldviews (disenchantment), as well as possibilities for action. Finally, a radical ideological framework emphasizes normative values and the conduct of action through the “anchoring” mechanism, which can be understood as a pull factor attracting individuals to a new status.

A spectre is haunting the world: 1914. The approaching centenary of the outbreak of the First World War is a reminder of how the instability produced by changes in the relative balance of power in an integrated or globalized world may produce cataclysmic events. Jean-Claude Juncker, the veteran Prime Minister of Luxem-bourg and chair of the Eurogroup of finance ministers, started 2013 by warning journalists that they should take note of the parallels with 1913, the last year of European peace. He was referring explicitly to new national animosities fanned by the European economic crisis, with a growing polarization between North and South. Historically, the aftermath and the consequences of such cataclysms have been extreme. George Kennan strikingly termed the 1914–18 conflict 'the great seminal catastrophe of this century'. Without it, fascism, communism, the Great Depression and the Second World War are all almost impossible to imagine.

A century ago this autumn the first battle of the Marne ended Germany's attempt to crush France and its ally Britain quickly. In that one battle alone the French lost 80,000 dead and the Germans approximately the same. By comparison, 47,000 Americans died in the whole of the Vietnam War and 4,800 coalition troops in the invasion and occupation of Iraq. In August and September 1914 Europe, the most powerful and prosperous part of the world, had begun the process of destroying itself. A minor crisis in its troubled backyard of the Balkans had escalated with terrifying speed to create an all-out war between the powers. 1 'Again and ever I thank God for the Atlantic Ocean,' wrote Walter Page, the American ambassador in London; and in Washington his president, Woodrow Wilson, agreed.

This paper challenges the conventional wisdom that US power and preferences following World War II led to bilateralism in Asia and multilateralism in Western Europe. It argues that the challenges facing the United States in both regions were similar, as were US policies meant to address them. With some lag, the United States supported the economic recovery of the regional powers it had defeated (Germany and Japan), saw the restoration of regional trade as a prerequisite, sought military bases to assure postwar security, and envisioned rearming its former foes as part of its security strategy. The outcomes in the two regions reflected the preferences and reservations of regional actors. The critical differences between the regions were structural. The existence of middle powers was critical in Europe, the return of colonial powers to Asia precluded regional arrangements in the short term, and geostrategic differences shaped the requisites for regional security.

America's diplomacy towards Europe has passed two broad historic phases. A first, isolationist phase, determined in part by America's need to maintain its domestic multinational consensus, was replaced, after World War II and under the Soviet threat, by a policy of hegemonic engagement. The Soviet collapse opened a new era forcing a reinterpretation of America's role in Europe and the world. Four different narratives have emerged: triumphalist, declinist, chaotic or pluralist. If a unipolar American role seems unlikely to persist, American decline is all too possible. A new hegemonic replacement seems unlikely, which makes the pluralist narrative plausible and desirable. This multipolar world will require an adaptation of the Western alliance and a new way of thinking about interstate relations. Confederal Europe, for its experience in bargaining and conciliation, might have much to offer to the new plural world order.

World War II caused the displacement of millions of people throughout Europe. In response, the United States initiated a public-private partnership that assisted in the resettlement of hundreds of thousands of the region's displaced persons. For nearly 40 years after the War, the US commitment to refugee resettlement played out in an ad hoc fashion as it responded to emerging crises in different ways. During this period the government's involvement with resettlement became gradually intertwined with that of non-governmental resettlement agencies, which came to play an increasingly vital role in the resettlement process. The budding relationship that began in the middle decades of the twentieth century set the foundation for an expansive and dynamic public-private partnership that continues to this day. The Refugee Act of 1980solidified the relationship between resettlement agencies and the federal government, established political asylum in US law, and created the refugee resettlement program and a series of assistance programs to help refugees transition to life in the United States. This legislation marked a decisive turning point in the field of refugee resettlement.

The book The Hidden Histories of War Crimes Trials – edited by Kevin Jon Heller and Gerry Simpson – is a compilation of 21 contributions to a conference convened in Melbourne at the end of 2010. The project aims at a scholarly recovery of accounts of war crimes trials that were ‘either neglected or under-rehearsed’ (at 1) in the discipline of international criminal law. Accordingly, the contributions tell ‘stories about familiar but under-explored and misunderstood landmarks in the conventional history of international criminal law’ as well as about trials that have been less analysed in this field (at 1). Gregory S. Gordon’s illustrative chapter on the trial of Peter von Hagenbach (chapter 2) is a story of the first kind, whereas Benjamin E. Brockman-Hawe’s comprehensive account of the Franco-Siamese tribunal for the Colonial Era (chapter 3) exemplifies the latter type.
