2. Boom Towns: Restoring the Urban American Dream

- The image of a boom town is commonly used to describe exceptional conditions through which a village suddenly becomes a city. Often such conditions are the discovery of mineral deposits that attracts industry and commerce. While in their booming condition, such towns are oases of societal flourishing relative to their preceding state. In Boom Towns, Stephen J.K. Walters, a professor of economics at Loyola University in Baltimore, explains that cities in general have the capacity perpetually to b forms of boom towns. Cities can serve as magnets to attract people and capital, thus promoting the human flourishing that has always been associated with cities at their best. It is different if cities are at their worst, as Walters explains in brining Jane Jacobs's Death and Life of Great American Cities into explanatory ambit. There are no natural obstacles to cities occupying the foreground of societal flourishing. There are obstacles to be sure, but these are man-made. Being man-made, they can also be overcome through human action, at least in principle even if doing so in practice might be difficult.

- This dense, powerful volume offers profound insights into the U.S. innovation system and its driving forces. The driving forces are Americans' twin desires for technology-based military supremacy (which demands government action) and small government (which militates against it). These twin forces have produced a highly successful, ever-evolving, and unique set of federal institutions and policies, which Linda Weiss calls the “national security state” (NSS). The NSS is the secret to American innovation. Since World War II, it has dominated high-risk innovation, revolutionary technological change, and the formation of new S industries. Weiss's book also reveals that the NSS is not static, but changes in response to changes in perceived geopolitical threats and to shifts in popular anti-statist sentiments. - American extended deterrence commitments span the globe. Despite extensive research on the causes of deterrence successes and failures, evidence of which US allies find what extended deterrence commitments credible is elusive. This article utilizes interviews with former Australian policy-makers to analyze the credibility of the United States to defend Australian forces during the 1999 INTERFET intervention in East Timor. While there was no direct threat to Australian sovereignty, the episode stoked concerns in Canberra regarding the willingness of Washington to come to Australia's assistance. The Howard government coveted a US tripwire force presence, and the Clinton administration's unwillingness to provide this raised serious concerns among Australian political elites about the alliance. While this says little about the separate question of whether Washington would use nuclear or conventional weapons in defense of Australian sovereignty, the Timor case indicates the existence of an extended deterrence credibility deficit regarding the more probable low-intensity conflicts that Australia finds itself in.

Such claims are sometimes made to rally domestic support for some costly international action; at other times they are used to exempt a great power from norms or constraints that weaker states are expected to follow.

- Before the ink on the Treaty of Versailles was dry, the idea of creating an organization dedicated to educating, informing and advising future leaders about the causes and consequences of war was already gaining traction. At 'a series of unofficial meetings held in Paris in 1919',1 Lionel Curtis, an Oxford professor and visionary with a reputation for possessing an impressive array of entrepreneurial skills, was spearheading efforts to establish an Anglo-American research institution where scholars could explore international problems and advocate policy solutions.2 This kind of organization appealed to Curtis and to those with whom he discussed it for several reasons, not the least of which was that it could provide a valuable forum for both policy-makers and prominent policy experts in the leading western powers to talk to one another about international affairs. It was also a concept with which several of the delegates attending the Paris peace talks had some familiarity. In the nineteenth and early twentieth centuries a number of institutions had already taken root in Great Britain and in the United States with the aim of helping policy-makers navigate their way through complex policy problems. They included the Royal United Services Institute for Defence and Security Studies (1831), founded by the first Duke of Wellington; London's Fabian Society (1884), home to a number of prominent scholars, including Sidney and Beatrice Webb, co-founders of the London School of Economics; the Washington-based Carnegie Endowment for International Peace (1910), established by the Scottish-American steel tycoon Andrew Carnegie; and the Institute for Government Research (1916), which merged with two other institutions to form the Brookings Institution in 1927.3 Curtis and his colleagues in Great Britain and the United States were also aware of the ground-breaking research that had been conducted at hundreds of settlement houses in their respective countries. It was at places such as London's Toynbee Hall (1884) and Chicago's Hull House, co-founded by Jane Addams in 1889, that sociologists and other university faculty with expertise in social welfare policy could study the working conditions of the poor.4 In short, proponents of establishing a foreign affairs research institution recognized the importance of encouraging a dialogue between leading social scientists and high-level policy-makers.

- In the past three decades, Chinese Iranian and Middle East Studies have become more and more systematic, which is reflected not only in the great volume of publication, but also in the varied research methodologies and the increase in Iranian and Middle East academic journals. The development of Chinese Middle East studies have accelerated in particular after Arab Spring revolutions and the political changes in the Middle East (2000- 2013). Research institutes evolved from state-controlled propaganda offices into multi-dimensional academic and non-academic entities, including universities, research institutes, military institutions, government offices, overseas embassies and mass media. At the same time, publications evolved from providing an introduction and overview of Iran and Middle Eastern states to in-depth studies of Middle East politics and economics in three stages: beginnings (1949- 1978), growth (1979- 1999), and dealing with energy, religion, culture, society and security. The Middle East-related research programs' funding provided by provincial, ministerial and national authorities have increased and the quality of research has greatly improved. And finally, China has established, as well as joined, various academic institutions and NGOs, such as the Chinese Middle East Studies Association (CMESA), the Asian Middle East Studies Association (AMESA) and the Arabic Literature Studies Association (ALSA). However, Chinese Middle East Studies remain underdeveloped, both in comparison with China's American, European, and Japanese studies at home, and with Middle East studies in the West.

- When I attended the first Summit of the Americas in Miami in 1994, only two female heads of state represented their countries: Dominica and Nicaragua. This past April at the Sixth Summit of the Americas in Cartagena, Colombia, five of the presidents and prime ministers representing the 33 participating countries were women: from Argentina, Brazil, Costa Rica, Jamaica, and Trinidad and Tobago. Their presence was an important example of the progress the hemisphere—and its women—have made. In fact, the region continues to make progress in a variety of areas. Latin America and the Caribbean are tackling ongoing challenges head-on, including promoting girls' education, improving women's and girls' health, facilitating women's political participation, and expanding women's economic opportunities. Governments throughout the hemisphere are increasingly recognizing that no country can get ahead if it leaves half of its people behind.

- Arts Innovator: Andrea Baranenko, Venezuela Latin America is moving forward, but Venezuela is moving in the opposite direction,” says Andrea Baranenko, a 28-year-old Venezuelan filmmaker whose recent documentary, Yo Indocumentada (I, Undocumented), exposes the struggles of transgender people in her native country. The film, Baranenko's first feature-length production, tells the story of three Venezuelan women fighting for their right to have an identity. Tamara Adrián, 58, is a lawyer; Desirée Pérez, 46, is a hairdresser; and Victoria González, 27, has been a visual arts student since 2009. These women share more than their nationality: they all carry IDs with masculine names that don't correspond to their actual identities. They're transgender women, who long ago assumed their gender and now defend it in a homophobic and transphobic society.

The broad principles that justify excluding some human activity from constitutional protection inevitably bleed in ways that support excluding activity that virtually all people think is covered by the First Amendment. The broad principles that justify granting First Amendment protection to activities inevitably bleed in ways that support granting protection to human activities that hardly anyone thinks merit special constitutional protection. The Adversary First Amendment: Free Expression and the Foundations of American Democracy effectively highlights how many standard justifications for excluding commercial advertising from constitutional protection threaten to undermine constitutional protection for consensual core speech rights. Martin Redish less successfully demonstrates that his adversarial theory of democracy would not entail constitutional protection for a wide variety of activity that government may consensually regulate.

- The creation of parliamentary bodies for regional organisations such as Association of Southeast Asian Nations (ASEAN) or Mercosur seems to be at odds with the intergovernmental logic on which these organisations rest. We approach this puzzle from the perspective of norm diffusion theory. In the article we argue that transnational legislative bodies in Southeast Asia and South America have been primarily established to retain the respective organisation's 'cognitive prior', which in both cases rests upon deeply entrenched corporatist norms and ideas. - US-Brazilian relations sunk to one of their lowest points ever following last year's exposure of the US government's massive surveillance of the South American giant-including the correspondence of President Rousseff and the business operations of Brazil's national oil company, Petrobras. Brazilian authorities responded angrily. The Brazilian president called off a highly valued state visit to Washington, denounced the US for violations of sovereignty and human rights, and proceeded to bypass the US to purchase nearly $5 billion worth of fighter aircraft from Sweden. In fact, US-Brazil ties have not been constructive for more than a generation. Yes, relations are mostly amiable, but with limited cooperation, considerable discord and some open clashes. Washington views Brazil primarily as a regional actor, and wants its cooperation mainly on inter-American issues. For Brazil, regional collaboration means working with other Latin American nations-not the United States. Brazil usually wants the US to keep a distance from the region. The US is no more enthusiastic about Brazil assuming a global role; differences over some of the world's most dangerous political and security challenges have made Washington uneasy about Brazil's engagement in international affairs and critical of its foreign policy judgements. Relations will probably improve, but they could get worse. The two governments need to acknowledge that their relationship is fragile and troubled, and take steps both to rebuild trust and to avert further deterioration and new confrontations. They have to be more careful with each other.

- The Israel lobby in Washington is a network of organizations and community groups dedicated to influencing American policy towards the Middle East. Their success and access has made them the model for lobbies on Washington's Capitol Hill and US Government. Long known for successfully influencing American policy towards the Middle East, the lobby now faces its strongest challenge in history at a time when it is also facing what it considers a historically significant issue. The interim accord between Iran and members of the P5+1 have led to turmoil in Washington over the wisdom and plausibility of President Obama's diplomatic approach and about the softening of the current US posture towards Iran. In this debate, powerful conservative groups, a number of key Democrats, and the Israel lobby have been pit against progressive groups and Democratic elected officials in the Senate and the White House. In this article, I will briefly look at the history of the Israel lobby in America and explore its evolution as well as investigate the factors that, over time, caused it to take on a hard-line posture and drift towards the right. I will explore the tactics and strategies that the Israel lobby-the America Israel Public Affairs Committee (AIPAC) in particular-has undertaken to influence the outcome of events and undermine the possibility of diplomatic conflict resolution. Finally, I will examine the pitfalls and challenges hard-line pro-Israel groups face in effectively pursuing these policies and the long term harm they expose themselves to in alienating progressive and pro-peace groups.

- The Conscience of the Constitution: The Declaration of Independence and the Right to Liberty, by Timothy Sandefur. Washington, DC: Cato Institute, 2014. 200 pp. $24.95 (hardcover). While the principles of liberty on which America was founded are under attack from so-called liberals and conservatives alike, and while expanding abuses of government power are too vast and complex for most Americans to fully follow, books by rational, knowledgeable professionals clearly and concisely explaining the problems and offering solutions are of immense value. Timothy Sandefur's The Conscience of the Constitution: The Declaration of Independence and the Right to Liberty fits this bill. Sandefur, a principal attorney at the Pacific Legal Foundation and an adjunct scholar at the Cato Institute, bases his latest work on an underappreciated idea in American legal thinking. It is the idea that the Declaration of Independence—understood as a formal, legal, diplomatic document issued by the representatives of thirteen British colonies to the king of England—is part of the law of the land, just as are the Constitution and the Bill of Rights. In fact, argues Sandefur, the Declaration used to be seen as the “conscience of the Constitution,” and reviving this understanding of its position in the framework of U.S. law will go a long way toward establishing the moral and political context within which lawyers, judges, and Supreme Court justices should argue and interpret constitutional law. Sandefur's thesis is controversial and is not likely to be well received in modern courts and law classrooms. Most law schools teach students to view the Declaration as a mere manifesto or letter of aspiration. But Sandefur wages a compelling intellectual defense of the Declaration-as-law on two fronts: against leftists, who have ridiculously claimed that the document was drafted as a wink-and-nod effort by elite white men to put down minorities and the lower classes; and against conservatives such as Russell Kirk and neoconservatives such as Irving Kristol who, afraid of its “natural rights” language, dismiss the ideas of the Declaration and characterize it as an underhanded “ploy to lure the French” into conflict with the English (p. 14). Sandefur, pointing out the baseless nature of such criticisms, puts forth a strong argument for holding the Declaration as law and highlights the Founding Fathers' own understanding of it as such. . . .

- Arts Innovator: Francisca Valenzuela, Chile Singer. Fashion designer. Entrepreneur. At 27, Francisca Valenzuela has already reached the kind of success usually associated with a professionally managed career. But instead of a top agent or a big record label, the San Francisco-born Chilean artist owes her achievements to a team that includes her mother, biochemist Bernardita Méndez, her boyfriend and artistic confidante Vicente Sanfuentes, and a small, committed staff in Chile that has skillfully used social media—including 275,000 Twitter followers and fans known as “Franáticos”—to spread the word of her talents. Valenzuela is one of the most engaging examples of a new generation of artist-entrepreneurs who are controlling their own career paths. “I'm not waiting for someone to come rescue me industry-wise,” Valenzuela says, describing how, when her music took off in her late teens, she and her mother purchased Business for Dummies online to understand the fine print in her first contract. Valenzuela's early musical success—with a hit single, Peces (Fish) in 2006—came after years of performing in talent shows, but she was never “serious” about music until she started performing on the underground jazz circuit in Chile. She eventually dropped out of the Universidad Católica de Chile, where she was studying journalism, to pursue her burgeoning musical career. Along the way, she has had two books published, two pop-rock albums that went platinum and gold in Chile, and designed a clothing line for the Chilean brand Foster. Now, Valenzuela develops projects and artistic collaborations through her own company, FRANTASTIC Productions. “We've structured an independent enterprise basically run by two people [that's] competitive with counterparts who have a whole corporate background,” she says proudly. Valenzuela's do-it-yourself ethic in the music industry is not the only thing that sets her apart from many of her peers. Valenzuela spent the first 12 years of her life in the United States before the family relocated to Santiago. In fact, Valenzuela's first book—Defenseless Waters, a collection of poems that she published at age 13 about themes ranging from long-lost love to social injustice to nature—was written in English. “When I was young in the Bay Area, everyone seemed to be doing extracurricular activities, sports, painting, nurturing kids,” she recalls. Valenzuela's literary background and political convictions have inspired her songwriting in Spanish. The title song of her latest album, Buen Soldado (Good Soldier, 2011), focuses on the power dynamic between men and women, and she has been an outspoken advocate of sexual diversity and LGBT rights in Chile, participating in gay rights marches since she was 14.

- Was Abraham Lincoln, as most Americans believe, a defender of individual rights, a foe of slavery, and a savior of the American republic—one of history's great heroes of liberty? Or was he a tyrant who turned his back on essential founding principles of America, cynically instigated the bloody Civil War to expand federal power, and paved the way for the modern regulatory-entitlement state? In the face of widespread popular support for Lincoln (note, for example, the success of the 2012 Steven Spielberg film about him) and his perennially high reputation among academics, certain libertarians and conservatives have promoted the view that Lincoln was a totalitarian who paved the way for out-of-control government in the 20th century. Those critics are wrong. Contrary to their volumes of misinformation and smears—criticisms that are historically inaccurate and morally unjust—Lincoln, despite his flaws, was a heroic defender of liberty and of the essential principles of America's founding. Getting Lincoln right matters. It matters that we know what motivated Lincoln—and what motivated his Confederate enemies. It matters that we understand the core principles on which America was founded—and the ways in which Lincoln expanded the application of those principles. It matters that modern advocates of liberty properly understand and articulate Lincoln's legacy—rather than leave his legacy to be distorted by antigovernment libertarians (and their allies among conservatives), leviathan-supporting “progressives,” and racist neo-Confederates. My purpose here is not to present a full biographical sketch of Lincoln, nor to detail all types of criticisms made against him. Rather, my goal is to present sufficient information about Lincoln and his historical context to answer a certain brand of his critics, typified by Ron Paul, formerly a congressman from Texas and a contender for the Republican Party's presidential nomination in 2008 and 2012. Paul and his ilk characterize Lincoln's engagement of the Civil War as a “senseless” and cynical power grab designed to wipe out the “original intent of the republic.” Such claims are untrue and unjust, as we will see by weighing them in relation to historical facts. Toward that end, let us begin with a brief survey of claims by Lincoln's detractors. The revision of Lincoln and his legacy began in earnest soon after the Civil War, but, at the time, it was relegated to the intellectual swamp of Confederate memoirs and polemics. What was once the purview of a defeated and demoralized rump and of early anarchists such as Lysander Spooner has picked up steam within the modern libertarian movement. In the early 20th century, the acerbic newspaperman and social critic H. L. Mencken seriously suggested that the Confederates fought for “self-determination” and “the right of their people to govern themselves.” He claimed that a Confederate victory would have meant refuge from a northern enclave of “Babbitts,” the attainment of a place “to drink the sound red wine . . . and breathe the free air.” Mencken's musings were but a symptom of a broader change in how many Americans came to view the Civil War. The conflict was no longer “the War of the Rebellion,” but “the War between the States.” The Confederate cause was no longer an essentially vile attempt to preserve slavery, but an honorable attempt to preserve autonomous government. Not coincidentally, during this period, Confederate sympathizers built monuments to the Confederacy throughout the South, and D. W. Griffith's openly racist silent film The Birth of a Nation presented revisionist Civil War history and contributed to the rebirth of the Ku Klux Klan. Sometimes Confederate sympathizers claimed that the Civil War was not really about slavery; other times they claimed that slavery was a glorious institution the South sought to preserve. More recently, Murray N. Rothbard—widely regarded as the godfather of the modern libertarian movement (and someone who saw Mencken as an early libertarian)5—characterized the Civil War as the fountainhead of the modern regulatory state: The Civil War, in addition to its unprecedented bloodshed and devastation, was used by the triumphal and virtually one-party Republican regime to drive through its statist, formerly Whig, program: national governmental power, protective tariff, subsidies to big business, inflationary paper money, resumed control of the federal government over banking, large-scale internal improvements, high excise taxes, and, during the war, conscription and an income tax. Furthermore, the states came to lose their previous right of secession and other states' powers as opposed to federal governmental powers. The Democratic party resumed its libertarian ways after the war, but it now had to face a far longer and more difficult road to arrive at liberty than it had before. Thomas DiLorenzo, a colleague of Rothbard's until Rothbard's death in 1995, penned two books responsible for much of today's libertarian and conservative antagonism toward Lincoln: The Real Lincoln: A New Look at Abraham Lincoln, His Agenda, and an Unnecessary War (2002) and Lincoln Unmasked: What You're Not Supposed to Know About Dishonest Abe (2006). (Both DiLorenzo and Ron Paul are senior fellows of the Ludwig von Mises Institute, an organization that, while bearing the name of the great Austrian economist von Mises, is more closely aligned with Rothbard's anarchist views.) Largely through his influence on popular economist Walter E. Williams, who wrote the foreword to DiLorenzo's 2002 book, DiLorenzo has reached a relatively wide audience of libertarians and conservatives. Williams is known to many as a genial guest host for The Rush Limbaugh Show, a fellow of the Hoover Institute, and a distinguished professor of economics at George Mason University. He gave his imprimatur to DiLorenzo's work, thereby elevating what might otherwise have been a peculiar book from the depths of Rothbard's libertarian, paleoconservative, neo-Confederate intellectual backwater to a nationally known and provocative piece of severe Lincoln revisionism. What are the essential criticisms leveled against Lincoln by such writers as Mencken and DiLorenzo? The most important of these criticisms can be grouped into four categories. First, these critics claim, Lincoln eviscerated the right of secession supposedly at the heart of the American Revolution. Second, say the critics, Lincoln did not truly care about slavery; he invoked it only to mask his real reasons for pursuing war—to expand the power of the federal government. Anyway, the critics add, slavery would have ended without a Civil War. Third, argue the critics, Lincoln subverted the free market with his mercantilist policies, thereby laying the groundwork for the big-government Progressives to follow. Fourth, Lincoln supposedly prosecuted the war tyrannically; in DiLorenzo's absurd hyperbole, Lincoln was a “totalitarian” who constructed an “omnipotent” state. Let us look at each of these criticisms in greater detail—and put them to rest—starting with the claim that Lincoln spurned the fundamental principles of the founding by opposing secession.

- The revelation in May of this year that the Internal Revenue Service (IRS) was systematically targeting Tea Party and other conservative groups for special scrutiny under the laws governing nonprofit organizations shocked the nation and triggered one of the Obama administration's biggest scandals to date. According to a Treasury inspector general's report, in May of 2010, agents in the IRS's Cincinnati office began singling out applications for nonprofit status from groups with terms such as "Tea Party" or "patriot" in their names. The agents conducted lengthy investigations of the groups to determine whether they intended to spend too much of their money on political activities that are prohibited to most nonprofits.1 The IRS required some groups to answer long lists of questions about their intentions, it demanded donor lists from others, and it even examined Facebook and Internet posts.2 Some groups simply gave up and withdrew their applications. Others spent two years waiting for a decision that never came.3 When Congress investigated the scandal, Lois Lerner, the former head of the office that oversees nonprofit organizations, invoked her Fifth Amendment right against self-incrimination and refused to testify. Later, hearings revealed that Douglas Shulman, the former head of the IRS, was cleared to visit the White House at least 157 times during his tenure and that IRS chief counsel William Wilkins, who was one of two Obama appointees at the IRS, helped develop the agency's guidelines for investigating the Tea Party groups.4 As a result, critics of the IRS have good reason to think that the scandal reaches the highest levels of our government. The public's outrage over this scandal is, of course, entirely appropriate. If the government can enforce laws based on nothing more than one's political views, then both freedom of speech and the rule of law are dead. But the outrage over the IRS's focus on conservative groups obscures a far more important question: Why was the IRS investigating the political activities of any group? The answer to that question is more troubling than the possibility of rogue IRS agents, biased law enforcement, or even abuses of power at the highest levels. As bad as all of those things are, the bigger threat to freedom is a legal regime that requires scrutiny of Americans' political activities and a political and intellectual culture that applauds such scrutiny and openly calls for more of it. This is the situation in America today. Our tax and campaign finance laws impose a host of regulations on Americans based on how much time, effort, and money they spend on political speech, and many opinion leaders agitate for even more laws and investigations every day. Against this backdrop, the IRS scandal should not surprise us. Our politicians and intellectuals demanded regulation of some of the loudest voices in our political debates, and the IRS delivered. Unfortunately, far too many critics of the IRS have accepted the premise that our laws should distinguish between groups that spend money on political activities and groups that do not. Expressing this view, Washington Post columnist Ezra Klein has argued that the real scandal was that the IRS did not treat all nonprofits as harshly as it treated the Tea Party groups.5 Using the same reasoning, congressional Democrats have attempted to blunt the scandal by claiming that the IRS also investigated some groups on the left.6 It appears that these claims are untrue, but the message is clear: As long as the government is scrutinizing everyone's speech equally, then there is no scandal. But this is the opposite lesson to learn from the IRS scandal. For anyone who cares about freedom of speech, the real scandal is that the government regulates Americans' campaign spending at all. So long as laws remain on the books that do so, scandals such as this one-and far worse-are inevitable. But to understand why that is so requires a deeper understanding of the premises on which the laws are based and how the laws operate in practice. . . .

- From 2006 to 2007, Peter Schiff, CEO of Euro Pacific Capital, was one of few people warning that the U.S. economy was fundamentally unsound and that real estate was grossly overpriced. In his first book, Crash Proof: How to Profit From the Coming Economic Collapse (2007), he predicted that the economy, the housing market, and the stock market would fall apart. He also voiced these predictions on several cable news shows, yet few people heeded his warnings. Some hosts and other guests even mocked and ridiculed him. But Schiff was right. In his recent book, The Real Crash: America's Coming Bankruptcy-How to Save Yourself and Your Country, Schiff says that the worst is yet to come and that the 2008-2009 economic crisis was merely a "tremor before the earthquake." Schiff argues that the main culprit of our economic instability is America's central bank: the Federal Reserve. Through its control of the money supply and the effect this has on interest rates, the Fed artificially inflates the prices of various asset classes, creating so-called "bubbles," and when those prices inevitably collapse, the Fed then inflates the prices of other asset classes. "Throughout the 1990s," Schiff observes, "we had the stock bubble and the dot-com bubble. The Fed replaced that with the housing bubble and the credit bubble. Now, the Fed and the administration are replacing those bubbles with the government bubble" (p. 20). By "government bubble," Schiff is referring to the U.S. dollar and Treasury bonds. When asset prices collapse and recessions ensue, Schiff notes, the Fed-via bailouts and low interest rates-props up insolvent banks and other companies (while also helping to finance government debt). It has taken these actions allegedly to minimize the short-term pain of recessions, but in doing so, the Fed has prevented the economy from correcting itself, making it increasingly unsound. "If you keep replacing one bubble with another, you eventually run out of suds. The government bubble is the final bubble" (p. 23). If the Fed keeps interest rates artificially low and if the government keeps running massive budget deficits, the day will come, Schiff argues, "when the rest of the world stops trusting America's currency and our credit. Then we'll get the real crash" (p. 1). In his introduction to the book, Schiff explains that he is taking a different approach here than he took in his previous books: "[T]his time I have decided that rather than simply predicting doom, I would lay out a comprehensive set of solutions. That's why I wrote this book" (p. 2). After diagnosing our economic problems, Schiff explains how we can fix them. . . .

Taking into account the manner with which States have addressed this issue, the article focuses on the case of Bolivia and its recent attempt to amend the 1961 Single Convention on Narcotic Drugs. It is argued that the normative conflict can be resolved or at least avoided by applying the methods of treaty interpretation, though only at the expense of indigenous rights. Options to change the international drug control regime to ensure indigenous rights are not only limited by the common interest in preserving its integrity, but also by the negative impact this could have on treaty relations.

Secretary of Defense Chuck Hagel noted in April that cyberattacks "have grown into a defining security challenge." - Fred Kaplan's The Insurgents is a highly successful and compelling intermingling of three stories: the rise and eventual fall of General David Petraeus; the intellectual history of counterinsurgency; and the broadening of the learning culture within the United States Military during the Iraq war. Indeed, the heroes of the book are the “insurgents” within the U.S. Army who all but overthrew the dominant paradigm of kinetic warfare in favor of ideas derived from England and France during the end of the colonial era.1 Kaplan's book picks up on the story told by Tom Ricks in The Gamble2 about how this intellectual insurgency transformed the way the U.S. fought the war in Iraq, preferring the counterinsurgency (COIN) approach to protecting civilians from insurgents and lowering their casualty rate, and building alliances in order to reduce the number of insurgents. For Kaplan this is nothing short of a profound alteration of the American way of war, one that caused enormous consternation amongst certain sectors of the military who were wedded to a more conventional approach to war.

- Mitt Romney and Paul Ryan have labeled themselves “America's Comeback Team”—a political tagline that would be great were it grounded in a philosophical base that gave it objective, moral meaning. What, politically speaking, does America need to “come back” to? And what, culturally speaking, is necessary for the country to support that goal? America was founded on the principle of individual rights—the idea that each individual is an end in himself and has a moral prerogative to live his own life (the right to life); to act on his own judgment, un-coerced by others, including government (liberty); to keep and use the product of his effort (property); and to pursue the values and goals of his choosing (pursuit of happiness). Today, however, legal, regulatory, or bureaucratic obstacles involved in any effort to start or operate a business, to purchase health insurance, to plan for one's retirement, to educate one's children, to criticize Islam for advocating violence, or so much as to choose a lightbulb indicate how far we've strayed from that founding ideal. If America is to make a comeback—and if what we are to come back to is recognition and protection of individual rights—then Americans must embrace more than a political tagline; we must embrace a philosophy that undergirds individual rights and that gives rise to a government that does one and only one thing: protects rights. Although the philosophy of the Founding Fathers was sufficient ground on which to establish the Land of Liberty, it was not sufficient to maintain liberty. The founders advocated the principle of individual rights, but they did not fully understand the moral and philosophical foundations of that principle; they did not understand how rights are grounded in observable fact. Nor did the thinkers who followed them. This is why respect for rights has been eroding for more than a century. If America is to “come back” to the recognition and protection of rights, Americans must discover and embrace the philosophical scaffolding that undergirds that ideal, the scaffolding that grounds the principle of rights in perceptual fact and gives rise to the principle that the only proper purpose of government is to protect rights by banning force from social relationships. The philosophy that provides this scaffolding is Ayn Rand's philosophy of Objectivism. To see why, let us look at Rand's philosophy in contrast to the predominant philosophies of the day: religion, the basic philosophy of conservatism; and subjectivism, the basic philosophy of modern “liberalism.” We'll consider the essential views of each of these philosophies with respect to the nature of reality, man's means of knowledge, the nature of morality, the nature of rights, and the proper purpose of government. At each stage, we'll highlight ways in which their respective positions support or undermine the ideal of liberty. As a brief essay, this is, of course, not a comprehensive treatment of these philosophies; rather, it is an indication of the essentials of each, showing how Objectivism stands in contrast to religion and subjectivism and why it alone supports a culture of freedom. Objectivism stands in sharp contrast to religion and subjectivism from the outset because, whereas religion holds that there are two realities (nature and supernature), and whereas subjectivism holds that there is no reality (only personal opinion and social convention), Objectivism holds that there is one reality (this one before our eyes). Let's flesh out these differences and their significance with respect to liberty. . . .

- The Egyptian – Israeli Peace Treaty of April 1979 capped four major wars and inaugurated a new U.S. – Egyptian relationship. Henceforth, U.S. presidents would regard the Egyptian – Israeli treaty as a cornerstone of American interests and values in the region. In 2003, President George W. Bush recognized Egypt as a trailblazer of peace and urged the country to “ show the way toward democracy in the Middle East. ” 1 The remark spoke to Washington ʼ s success reconciling historic adversaries and its ostensible hope for political reform in Cairo. Between the U.S. and Egyptian governments, though, peace and democracy had been at odds since the treaty ʼ s drafting. The autocratic prerogatives of President Anwar Sadat (r. 1970 – 1981) were a sine qua non of successful bargaining. Negotiators on all sides presupposed tight policing within Egypt. At this crossroads of diplomacy and domestic poli- tics, Sadat fused international peace and internal repression.

- More and more Americans are coming to recognize the superiority of private schools over government-run or “public” schools. Accordingly, many Americans are looking for ways to transform our government-laden education system into a thriving free market. As the laws of economics dictate, and as the better economists have demonstrated, under a free market the quality of education would soar, the range of options would expand, competition would abound, and prices would plummet. The question is: How do we get there from here? Andrew Bernstein offered one possibility in “The Educational Bonanza in Privatizing Government Schools” (TOS, Winter 2010-11): Sell government schools to the highest bidders, who would take them over following a transitional period to “enable government-dependent families to adjust to the free market.” This approach has the virtues of simplicity and speed, but also the complication of requiring widespread recognition of the propriety of a fully private educational system—a recognition that may not exist in America for quite some time.

- Eleven years ago, toward the end of my undergraduate years as a philosophy major at the University of Virginia, I was feeling dissatisfied with my knowledge of history. I had taken several history courses but wanted more. Because my immediate interest was ancient Greece, I decided to try a friend's recommendation, The Life of Greece by Will Durant. Finding the book at the library, I was surprised to see that it was but one volume in a massive series called The Story of Civilization—eleven substantial volumes spanning two feet of shelving.1 Although I wanted to learn more about history, I wasn't sure I wanted to learn that much. It turned out that I did. Reading those volumes—sometimes poring over large portions of them multiple times—would be one of the most enlightening and enjoyable experiences of my life. First published between 1935 and 1975, The Story of Civilization is a work of great and enduring value. Exceptional for its masterful prose as well as its size and scope, the Story is a powerful combination of style and substance. An author of rare literary talents, Durant (1885–1981) won a wide readership through his ability to make history intriguing, lively, and dramatic. His volumes, intended for the general reader and each designed to be readable apart from the others, have sold millions of copies. Some even became best sellers, and the tenth volume, Rousseau and Revolution, won a Pulitzer Prize. Individual volumes have been translated into more than twenty languages.2 Having earned a doctorate in philosophy in 1917 from Columbia University, Durant first won fame and phenomenal success with The Story of Philosophy (1926). This book sold two million copies in a few years and has sold three million copies to date; eighty-five years later, the book is still in print and has been translated into nineteen languages.3 Durant followed this book with another best seller, The Mansions of Philosophy (1929).4 His earnings from these and other books, as well as from articles and public lectures, helped free his time for writing The Story of Civilization, which would be his magnum opus. His wife, Ariel Durant (1898–1981), assisted him throughout his writing of the Story, her assistance increasing to the point that, beginning with the seventh volume, she received credit as coauthor.5 The Story of Civilization begins with Our Oriental Heritage, a volume on Egypt and Asiatic civilizations. The remaining ten volumes tell the story of Western civilization (with a substantial treatment of Islamic civilization in one of the volumes6). Durant's original intention was to tell the story of the West up to the present, but, despite working on the Story for more than four decades, he was unable to do so: “[A]s the story came closer to our own times and interests it presented an ever greater number of personalities and events still vitally influential today; and these demanded no mere lifeless chronicle, but a humanizing visualization which in turn demanded space” (vol. 7, p. vii). The increasing space he gave to each period of European history resulted in his having to end the Story with the downfall of Napoleon in 1815; moreover, he had to omit the history of the Americas entirely. He was ninety when the Story's last volume was published and had carried it as far as he could. In each volume Durant takes a comprehensive approach, covering, for each nation and in each period of its history, all the major aspects of civilization: politics, economics, philosophy, religion, literature, art, and science.7 He called his approach the “integral” or “synthetic” method, and regarded it as an original contribution to historiography.8 Elaborating on the origin of his method, he writes: I had expounded the idea in 1917 in a paper . . . “On the Writing of History.” . . . Its thesis: whereas economic life, politics, religion, morals and manners, science, philosophy, literature, and art had all moved contemporaneously, and in mutual influence, in each epoch of each civilization, historians had recorded each aspect in almost complete separation from the rest. . . . So I cried, “Hold, enough!” to what I later termed “shredded history,” and called for an “integral history” in which all the phases of human activity would be presented in one complex narrative, in one developing, moving, picture. I did not, of course, propose a cloture on lineal and vertical history (tracing the course of one element in civilization), nor on brochure history (reporting original research on some limited subject or event), but I thought that these had been overdone, and that the education of mankind required a new type of historian—not quite like Gibbon, or Macaulay, or Ranke, who had given nearly all their attention to politics, religion, and war, but rather like Voltaire, who, in his Siècle de Louis XIV and his Essai sur les moeurs, had occasionally left the court, the church, and the camp to consider and record morals, literature, philosophy, and art.9 Durant's integral history does not only occasionally consider these latter areas (which he calls “cultural history” or “the history of the mind,”)10 it emphasizes them. “While recognizing the importance of government and statesmanship, we have given the political history of each period and state as the oft-told background, rather than the substance or essence of the tale; our chief interest was in the history of the mind” (vol. 10, p. vii). (Nevertheless, the Story contains ample and excellent material on politics.) The Story is by far the most massive and thorough treatment of Western civilization by a single author (or team of two) that I have been able to find. Large teams of historians have collaborated to produce similarly large, or even larger, works. But such works, writes a respected historian, “while they gain substantially in authoritative character, are seriously lacking in correlation and are not written from a . . . harmonious point of view.”11 Harmony is indeed one of the cardinal virtues of Durant's work; readers find therein a beautifully integrated tale of man's past, a veritable symphony of history. For this reason and others—notably, Durant's grand, philosophical overviews and scintillating style—I believe that many, and perhaps most, readers will find no better place to turn for a large treatment of Western civilization than The Story of Civilization. . . .

- Although Ayn Rand published her epic novel Atlas Shrugged fifty-four years ago, and although it has consistently sold hundreds of thousands of copies annually, Rand's magnum opus has spent decades mired in Hollywood “development hell.” Numerous producers, stars, screenwriters, and film production companies have endeavored but failed to execute a film version (see: “Atlas Shrugged's Long Journey to the Silver Screen,” p. 35). All the while, fans of the novel have anxiously waited for the day when they could watch the story come to life on the silver screen. That day is finally here. Atlas Shrugged: Part I, the first in a planned trilogy, should, for the most part, please the novel's patient fans. Fortuitously following a blueprint similar to one outlined by Rand in the 1970s (see “Adapting Atlas: Ayn Rand's own Approach,” p. 38), the film covers the first third of the story. Like the novel, the movie focuses on Dagny Taggart as she endeavors to save her struggling railroad from both intrusive government regulations and the mysterious John Galt, who is hastening the nation's collapse by causing the great entrepreneurs and thinkers of the country to disappear. She is aided in her efforts by Henry “Hank” Rearden, a steel magnate who is also being squeezed by government regulations and is anxious to put an end to John Galt's activities. Those familiar with the novel know generally what to expect: the disappearance of more and more industrialists and other great producers, the banning of Rearden Metal, the “Anti-Dog-Eat-Dog Rule,” the initial run of the John Galt Line, and finally Wyatt's Torch and the collapse of Colorado.

- 1. In introducing this EJIL symposium, I cannot help but recall a much debated article published in 1986 in the American Journal of International Law. The author of that article, Stanford professor John Merryman, theorized that there are \'two ways of thinking about cultural property\'. 1 The first, he argued, is the national(istic) way, which conceives of cultural property as part of the nation, with the attendant desire of governments to jealously retain it within state boundaries and to limit its international circulation. The second is the international way, which views cultural property as the heritage of humankind and supports the broadest access and circulation to facilitate exchange and cultural understanding among different peoples of the world. The author left no doubt that the latter view was to be preferred for its alleged capacity to contribute to a cosmopolitan order, in which cultural property can be freely accessed and thus contribute to the intellectual and moral progress of humanity. One may wonder whether this dual perspective accurately reflected the spirit of the law and the policy attitudes of the time when the article was written. Certainly, it cannot adequately explain the present state of the law and, in particular, of international law. Today, there are more than just two ways of thinking about cultural property. Cultural property may be seen as part of national identity, especially in the post-colonial and post-communist context, but it can also be looked at as part of the \'territory\', the physical public space that conditions our world view and which is part of what we normally call \'the environment\' or the \'landscape\'. Cultural property may be seen as moveable artifacts susceptible to economic evaluation, and for this reason subject to exchange in international commerce; but it may also be thought of as objects endowed …

Would you like to leave a comment? 1CommentsJoin To the Editor: Roger Altman and Richard Haass ("American Profligacy and American Power," November/December 2010) persuasively argue that continued American profligacy promises to undermine American power. But the situation is even more urgent than they suggest. Although Altman and Haass expect markets to remain calm "possibly for two or three years," the rising price of gold suggests otherwise. Gold has risen from $460 per ounce to $1,400 per ounce in the last five years -- representing a 67 percent devaluation of the U.S. dollar per unit of gold. As former U.S. Federal Reserve Chair Alan Greenspan has said, gold is "the ultimate means of payment." Moreover, on top of new government debt over the next several years, maturing existing debt will need to be refinanced. At 4.6 years, the average maturity of the U.S. federal debt held by the public (debt that now totals $9.1 trillion) is tight relative to, for instance, the average maturity of 13.5 years for British government debt. According to the International Monetary Fund, the maturing debt of the U.S. government will equal 18.1 percent of U.S. GDP during 2011 alone. Altman and Haass rightly note that the U.S. government's annual interest expense will rise dramatically as its stock of debt increases and interest rates inevitably rise. Further debt increases would substantially darken the fiscal outlook for the federal government. And even a relatively small rise in interest rates would have a significant impact. TIM W. - This article investigates and explains the development of International Relations studies (IRS) in China, Japan, and India. Beginning in early 1980s IRS experienced exponential growth in China and is becoming a separate discipline in that country. Despite early starts, IRS in Japan and India is still an appendage in other disciplinary departments, programs, and centers although growing interest is discernible in both countries. Continued rise of Asian powers along with their growing roles and responsibilities in constructing and managing regional and global orders is likely sustain and increase interest in IRS in these countries and more generally in Asia. Distinctive trajectories have characterized the development of IRS in China, Japan, and India. Distinctiveness is evident in master narratives and intellectual predispositions that have shaped research and teaching of IR in all three countries. The distinct IRS trajectories are explained by the national and international context of these countries as well as the extensiveness of state domination of their public spheres. Alterations in national circumstances and objectives along with changes in the international position explain the master narratives that have focused the efforts of IR research communities. Extensiveness of state domination and government support, respectively, explain intellectual predispositions and institutional opportunities for the development of IRS. IRS in Asia has had a predominantly practical orientation with emphasis on understanding and interpreting the world to forge suitable national responses. That orientation contributed to a strong emphasis on normative–ethical dimensions, as well as empirically grounded historical, area, and policy studies. For a number of reasons including intellectual predispositions and constraints, knowledge production in the positivist tradition has not been a priority. However, IR theorizing defined broadly is beginning to attract greater attention among Asian IR scholars. Initial interest in Western IR theory was largely a function of exposure of Asian scholars to Western (primarily American) scholarship that has been in the forefront in the development of IR concepts, theories, and paradigms. Emulation has traveled from copying to application and is now generating interest in developing indigenous ideas and perspectives based on national histories, experiences, and traditions. Although positivism may gain ground it is not deeply embedded in the intellectual traditions of Asian countries. Furthermore, theorizing in the positivist tradition has not made significant progress in the West where it is also encountering sharp criticism and alternative theories. Asian IR scholarship would continue to emphasize normative–ethical concerns. And historical, area, and policy studies would continue to be important in their own right, not simply as evidentiary basis for development of law-like propositions. It also appears likely that Asian IR scholarship would increasingly focus on recovery of indigenous ideas and traditions and their adaptation to contemporary circumstances. The net effect of these trends would be to diversify and enrich existing concepts, theories, methods, and perspectives, and possibly provide fresh ones as well. The flourishing of IRS in Asia would make the IR discipline more international.

- There is little doubt that the North-South axis remains dominant for Latin America's geopolitical positioning. But new relations are emerging and deepening at subnational levels, in turn creating new intercity geographies and challenging that geopolitical notion. These relations are a direct product of economic and cultural globalization. Some examples are the shift of migration from Ecuador and Colombia toward Spain rather than the U.S., the growing economic relations between Chinese businesses and organizations and São Paulo and Rio de Janeiro, and the emergent relations between these cities and Johannesburg, South Africa. The Internet has allowed a rapidly growing number of people to become a part of diverse networks that crisscross the world. And nongovernmental organizations (NGOs) from various parts of the world are establishing active connections over social struggles in Latin America. In other words, beneath the still-dominant North-South geopolitics, transversal geographies are growing in bits and pieces. One trend is the formation of intercity geographies as the number of global cities has expanded since the 1990s. These subnational circuits cut across the world in many directions. A second trend is the growth of civil society organizations and individuals who are connecting around the world in ways that, again, often do not follow the patterns of traditional geopolitics. The New, Multiple Circuits There is no such entity as the global economy. It is more correct to say there are global formations, such as electronic financial markets and firms that operate globally. But what defines the current era is the creation of numerous, highly particular, global circuits—some specialized and some not—interlacing across the world and connecting specific areas, most of which are cities. While many of these global circuits have long existed, they began to proliferate and establish increasingly complex organizational and financial foundations in the 1980s. These emergent intercity geographies function as an infrastructure for globalization, and have led to the increased urbanization of global networks. Different circuits contain different groups of countries and cities. For instance, Mumbai today is part of a global circuit for real estate development that includes investors from cities as diverse as London and Bogotá. Coffee is mostly produced in Brazil, Kenya and Indonesia, but the main place for trading its future is on Wall Street. The specialized circuits in gold, coffee, oil and other commodities each involve particular countries and cities, which will vary depending on whether they are production, trading or financial circuits. If, for example, we track the global circuits of gold as a financial instrument, it is London, New York, Chicago, and Zurich that dominate. But the wholesale trade in the metal brings São Paulo, Johannesburg and Sydney into the circuit, while trade in the commodity, much of it aimed at the retail level, adds Mumbai and Dubai. And then there are the types of circuits a firm such as Wal-Mart needs to outsource the production of vast amounts of goods—circuits that include manufacturing, trading, and financial and insurance services. The 250,000 multinationals in the world, together with their over 1 million affiliates and partnership arrangements worldwide, have created a new pattern of relations that combine global dispersal with the spatial concentration of certain functions often while retaining headquarters in their home countries. The same is true of the 100 top global advanced-services firms that together have operations in 350 cities outside their home base. While financial services can be bought everywhere electronically, the headquarters of leading global financial services firms tend to be concentrated in a limited number of cities. Each of these financial centers specializes in specific segments of global finance, even as they engage in routine types of transactions executed by all financial centers. It's not just global economic forces that feed this proliferation of circuits. Forces such as migration and cultural exchange, along with civil society struggles to protect human rights, preserve the environment and promote social justice, which also contribute to circuit formation and development. NGOs fighting for the protection of the rainforest function in circuits that include Brazil and Indonesia as homes of the major rainforests, the global media centers of New York and London, and the places where the key forestry companies selling and buying wood are headquartered—notably Oslo, London and Tokyo. There are even music circuits that connect specific areas of India with London, New York, Chicago, and Johannesburg. Adopting the perspective of one of these cities reveals the diversity and specificity of its location on some or many of these circuits, which is determined by its unique capabilities. Ultimately, being a global firm or market means entering the specificities and particularities of national economies. This explains why global firms and markets need more and more global cities as they expand their operations across the world. While there is competition among cities, there is far less of it than is usually assumed. A global firm does not want one global city, but many. Moreover, given the variable level of specialization of globalized firms, their preferred cities will vary. Firms thrive on the specialized differences of cities, and it is those differences that give a city its particular advantage in the global economy. Thus, the economic history of a place matters for the type of knowledge economy that a city or city-region ends up developing. This goes against the common view that globalization homogenizes economies. Globalization homogenizes standards—for managing, accounting, building state-of-the-art office districts, and so on. But it needs diverse specialized economic capabilities. Latin America on the Circuit This allows many of Latin America's cities to become part of global circuits. Some, such as São Paulo and Buenos Aires, are located on hundreds of such circuits, others just on a few. Regardless of the case, these cities are not necessarily competing with one other. The growing number of global cities, each specialized, signals a shift to a multipolar world. Clearly, the major Latin American cities have circuits that connect them directly to destinations across the world. What is perhaps most surprising is the intensity of connections with Asia and Europe. Traditional geopolitics would lead one to think that Latin America connects, above all, with North America. There is a strong tendency for global money flows to generate partial geographies. This becomes clear, for example, when we consider foreign direct investment (FDI) in Latin America, a disproportionate share of which goes to a handful of countries. In 2008, for example (a relative peak of FDI), FDI flows into Latin America were topped by Brazil at $45.1 billion, followed at a distance by Mexico at $23.7 billion, Chile at $15.2 billion, and Argentina with $9.7 billion. On average, between 1991–1996 and 2003–2008, FDI in Brazil increased more than five-fold while tripling in Chile and Mexico. Among the countries in the Latin American and Caribbean region receiving the lowest levels of foreign investment in 2008 were Haiti, at $30 million; Guyana, at $178 million; and Paraguay, at $109 million. Globalization and the new information and communication technologies have enabled a variety of local activists and organizations to enter international arenas that were once the exclusive domain of national states.
