Abstract:: This article seeks to analyze how norms and procedures created in International Organizations spread to member states. More specifically, the analysis focuses on how changes in the training architecture for UN peace operations, driven by the Brahimi report, caused institutional and procedural changes on the administrative, political and military spheres in Brazil. Combining official documents and analytical literature, through process tracing, we find that the main causal mechanism observed was emulation, given Brazil’s desire to adapt to use the capacity building as a tool for international action.

Abstract:: The debate around viable global governance has become increasingly topical, particularly from the perspective of countries in the Global South. Concerning Africa, despite the continent’s quest to reform the United Nations Security Council (UNSC), existing research has failed to comprehensively address the topic. Consequently, this article explores the arguments and challenges surrounding Africa’s drive to secure a permanent voice in the UNSC. It argues that despite the enduring legacies of colonialism, neocolonial interventions, and being the primary concern of the UNSC agenda, Africa’s claim for fair representation in the Council remains. The article attempts to address the research gap and contribute to the existing debate by examining why Africa has failed to be represented in the UNSC. Africa’s collective initiative towards reforming the UN system is instrumental in ensuring inclusive and sustainable global governance. Nonetheless, Africa’s insistence on immediate and full veto power for new entrants and its demand for representation merely through numbers inside the UN are unfeasible.

Abstract:: El presente estudio aborda el derecho humano a la seguridad desde el enfoque de la Prevención del Extremismo Violento. La Prevención del Extremismo Violento (PEV) es una estrategia en el marco de Naciones Unidas enfocada a fortalecer el respeto de los derechos humanos. La PEV aborda el extremismo violento que conduce al terrorismo desde el enfoque de la prevención y de los derechos humanos. Lo más relevante de esta perspectiva es su innovación para garantizar la seguridad como derecho humano. Es más, la PEVsurge como respuesta a las políticas de seguridad antiterroristas que se consideran insuficientes para erradicar este fenómeno. Las medidas de acción de la PEV, por tanto, van más allá de lo que en sentido estricto se conoce como política securitaria. La educación y la cultura tiene así una función importante en la PEV, como también ponen de relieve las políticas de la UNESCO. El análisis que se desarrolla expone una propuesta de espacio dialógico que aplica la medida de educación, cultura y sensibilización a través de la literatura. Se reflexiona así, a partir del diálogo con Vida y destino de Vasili Grossman, sobre el extremismo violento y los derechos humanos.

Abstract:: Since the mid-2000s, scholars have been using critical theory, poststructuralism, feminism/ queer theory, and postcolonialism to critique the hegemonic narrative of terrorism. They analyze how terrorism discourse (re)produces global hierarchies and power relations. This involves archeological and genealogical research, assessing the formation of the terrorism discourse by analyzing how the peculiar Western discourse has become hegemonic. By incorporating postcolonial and genealogical studies into critical terrorism studies, McQuade and Martini attempt to explain this process in their respective works. Their books are complementary in that they allow readers to trace the historical development of the concept of terrorism from British India to its ubiquity in international institutions. Although they cover different historical periods, it is still possible to see how the concept of terrorism has been used in both of those historical periods – during British colonialism in India in McQuade’s book and after the 1980s in Martini’s book – to normalize discriminatory practices against (post)colonial societies.

Abstract:: The post-World War II era has seen a significant increase in peacekeeping missions, crucial in preserving international harmony and resolving conflicts in nebulous regions and states. Some United Nations members, including Pakistan, have made contributions to assist these operations. This study's main goal is to gain insight into Pakistan's participation in and commitment to UN peacekeeping efforts. The following article uses the qualitative research methodology. This paper aims to explain Pakistan's participation in United Nations peacekeeping Operations (UNPKOs) and the successes Pakistan has achieved in these operations. One of Pakistan's top foreign policy priorities under Article 40 of Constitution of Pakistan 1973 is to maintain international stability and security. Because of this, it has actively participated in United Nations peacekeeping missions since its creation. Pakistan has been an active member of the world community by contributing to 46 missions in 28 different countries and areas. Due to their calm demeanors and outstanding competence, Pakistani peacekeepers have been widely praised for their many successful operations and for winning the support of local populations. To date, 157 Pakistanis have also died in the service for this worthy purpose.

Abstract:: Timor-Leste during and after the process of disarmament, demobilization, and reintegration (DDR) in the years 2000-2004 did not achieve an acceptable level of security. This article, using a DDR maximalist perspective and a liberal perspective in security studies, examines the UN limitations in providing a solid problem-solving process and its implications for DDR. The qualitative data collected from several personal interviews to different stakeholders is analyzed using thematic analysis. Based on these interviews and observations this research finds that the UN had several limitations to carry out DDR in Timor-Leste, being the most salient, the weak legitimacy and the lack of professionalism in human resources.

Abstract:: This paper investigates what role Sweden, by participating in the Neutral Nations Supervisory Commission (NNSC) since 1953, has played to maintain peace on the Korean peninsula. What specific contributions has the NNSC done? How important are they in comparison to other factors that have preserved peace? These issues are analyzed by comparing the tasks of the NNSC, as defined by the Armistice Agreement, and the Commission’s work. Consideration is also given to the Commission’s composition and whether its role has changed throughout the years or not. North Korea’s policy to dismantle the NNSC in the 1990s is included, as are the Commission’s responses and the subsequent reorganization of its work.

Abstract:: For over three decades, the United States and the international community has been attempting to engage North Korea diplomatically, aiming for the complete, verifiable, irreversible denuclearization of North Korea. The Kim family regime has been committing crimes against humanity, but human rights concerns have been discounted by U.S. and other negotiators, fearing they would be an obstacle to a negotiated solution to the grave military and security challenges Pyongyang poses. North Korea has breached each and every one of the international obligations it has assumed, from imembership in the Treaty of Non-Proliferation of Nuclear Weapons to the 1994 Geneva Agreed Framework to the Six Party Talks to the 2012 Leap Day Agreement. While its negotiating counterparts have neglected human rights concerns in multilateral and bilateral talks, North Korea has continued to develop and test its nuclear and ballistic missile programs. It is time for a new paradigm, that brings human rights into the conversation, in a bilateral or multilateral setting.

Abstract:: In March, United Nations (UN) High Commissioner for Human Rights Michelle Bachelet announced an agreement with China for a May visit, which includes access to Xinjiang. The exact date for the visit has yet to be determined, but recent reports indicate it is due to take place before the end of this month, which will make Bachelet the first UN High Commissioner for Human Rights to visit China in 17 years (China Daily, May 11). Negotiations were stalled for years with Bachelet first indicating intent to report on Xinjiang in a 2018 request for unhindered access to “all regions of China” (Office of the High Commissioner for Human Rights (OHCHR), September 10, 2018). At the end of April, a UN advance team arrived in Guangzhou to quarantine before traveling to Xinjiang to lay the groundwork for Bachelet’s visit (South China Morning Post (SCMP), April 25.

Abstract:: This paper seeks to understand if the political, legal and ethical imperatives of a humanitarian war justified Indian military intervention in East Pakistan. It examines the asymmetric, dynamic national power equations that shaped the Bangladesh Liberation War and the genocide that preceded the conflict. At the height of the Cold War between the United States and the Soviet Union, this conflict was a key flashpoint in South Asia. This research was undertaken through a qualitative literature review with the help of declassified archival documents and media from numerous national archives and government databases across the world. Aided by emerging insights, perspectives and research, this paper seeks to evolve, extend and expand our existing understanding of events as they unfolded within the overall matrix of this conflict. The results show that India’s ability to align its foreign policy and media narratives to its military objectives while adroitly managing big power rivalry holds lessons for how smaller states might compel strategic concessions from big powers and global institutions. This requires them to navigate both the asymmetry of national power and the asymmetry of attention during a conflict to secure their interests. In conclusion, recent times have seen an increasing trend for major global powers and alliances to declare war in the name of humanitarianism. The political and ethical imperatives of a humanitarian war in 1971 dovetailed seamlessly with larger Indian strategic goals and was one of the catalysts for the eventual unanimous adoption in 2005 of the global political commitment known as Responsibility to Protect (R2P) in the United Nations.

Abstract:: This article focuses on the impact of Artificial Intelligence (AI) on democracy. It provides an overview of the various ways in which the AI technologies affect the democratic values and processes and the social and political behaviour of citizens. It notes that the use of AI, and its potential for abuse by some governments, as well as by big private corporations, poses a real threat to the institutions, processes, and norms of rights-based democracies. As governments worldwide mull over their AI strategies and policies that would protect citizens against AI-powered dangers, UNESCO announced a remarkable consensus agreement among 193 member states creating the first-ever global standard on the ethics of AI that could serve as a blueprint for national AI legislation and a global AI ethics benchmark.

Abstract:: The United Nations Mapping Report on the Democratic Republic of Congo (DRC) is a powerful reminder of the gravity of the crimes committed in this country. This report found that the period between March 1993 and June 2003 is probably one of the most tragic chapters in the recent history of the DRC. A string of major political crises, wars and multiple ethnic and regional conflicts killed millions of people. However, since the publication of this report there has been a shocking lack of justice for the victims because the Congolese justice system has been ineffective in prosecuting the perpetrators. This article is a valuable contribution to ending impunity in that it proposes an alternative approach to justice. This is based on restorative values and principles, such as the Baraza indigenous restorative justice mechanism. This provides justice to victims, restores peace and reconciliation in the region and, most importantly, holds perpetrators accountable for the crimes and human rights violations they have committed.

Abstract:: InDecember 2021, the UN Human Rights Committee(‘HRC’)published its views in a ground-breaking case (Communication No2918/2016),1finding that the Netherlands had violated a child’s right to a nationality by registeringthem as having‘unknown nationality’in theircivil records. The HRCreasoned that, in so doing, the Netherlands hinderedthe child’s access to international protection as a stateless child.This was the first time that the HRChas ruled on the right of a child to acquire a nationality under art 24(3) of the International Covenant on Civil and Political Rights(‘ICCPR’).FACTSThe case revolved arounda petition by DZ, a child born in Utrecht in 2010 to a Chinese mother. In 2004, she was trafficked to the Netherlands as a minorbut managed to escape her traffickers at the Schiphol Airport in Amsterdam. She then applied for asylum, but her application was unsuccessful. In 2006, DZ’s mother was forced into prostitution. Two years later, she broke out of her captivity and reported the situation to the police, which gave her the right to a temporary status while the investigation was undergoing. Abstract:: The paper analyzed the challenges of poverty in Montenegro. It provided an overview of the structure and scope of UN action in Montenegro and general sustainable development policies and their national implementation. The objective was to research the contributions of the UN system to the sustainable development of Montenegro while focusing on the role of the UNDP in eradicating poverty. The methodology consisted of the literature overview and the case scenario analysis of integrated social protection and employment policies. In addition, secondary data analysis has been employed to complement the research findings. The paper has identified the national socio-economic situation and the contributions of the UNDP in eradicating poverty through the design and implementation of integrative policies. The research proved the importance of the UNDP in fighting poverty in Montenegro and the effective role of the UN in achieving sustainable development.

Abstract:: Although statelessness within the modern state system has many facets, there has not been any attempt to work out a formal typology. When conceptualising statelessness in singular terms, theorists miss something important: they fail to capture the full moral scope of statelessness. This article addresses this shortcoming. It is divided into four parts. First, I will show how statelessness is categorised under the UN’s framework. Second, I will turn to legal and social theory to argue that statelessness can be best understood through the two concepts of responsibility and recognition. Third, I will identify three different subtypes of statelessness. They derive from the source of nationality deprivation and include voluntary statelessness, structural statelessness and denigrative statelessness. Finally, I will offer some concluding remarks.

20. Is the International Law Commission Taking Regionalism Seriously (Enough)?

Abstract:: Regionalism poses a challenge to the work of the International Law Commission (ILC). The Commission, entrusted by the United Nations General Assembly (UNGA) with the “progressive development of international law and its codification”, is tasked with identifying and elaborating universally accepted and acceptable rules of international law. The challenge posed by regionalism lies in its ambivalent role precisely in relation to the mandate of the ILC: on the one hand, a significant share of practice in international law is generated at the regional level. Since regional practice thus constitutes a substantial part of State practice, the ILC cannot avoid taking regional practice into account if it is to identify and develop common rules. On the other hand, regionalism often involves claims for special legal treatment based on the affiliation with a region; thus, deviations from precisely those general legal rules which the ILC seeks to codify and develop. The present contribution analyses how the Commission has approached regionalism in its previous work and identifies four approaches. It shows that each of these approaches suffers from shortcomings. At the same time, the current projects on General principles of law (GPL) and Sea-level rise in relation to international law possibly indicate the emergence of a more fruitful fifth approach. Based on this analysis, the present contribution shows that the practice of the ILC evinces two methodological challenges arising from regional plurality –, the challenge of equal regional representation and the challenge of regional exceptionalism, – and makes suggestions as to how to address these in the future.

Abstract:: The relationship between the United Nations Security Council and Non- Governmental Organizations has scarcely been considered in scholarship on international security. This lack of academic interest contrasts with accounts on the engagement of NGOs in the production and advancement of UNSC discussions on women and children. By drawing on international relations and social movements’ theoretical contributions, the paper traces NGOs’ strategies to participate in UNSC thematic debates. By looking at the actions of the Watchlist on Children and Armed Conflict and the NGO Working Group on Women, Peace, and Security, the analysis finds that NGOs have built coalitions among themselves and maintained networks with friendly countries and UN specialized agencies to capitalize on favorable political and institutional opportunities and expand the access to the security sector.

24. Winning the Peace Azerbaijan’s Karabakh Reintegration Challenges

Abstract:: The Karabakh conflict was not resolved peacefully. Decades of unfruitful negotiations held under the auspices of the Co‑chairs of the OSCE Minsk Group (France, Russia, and the United States) produced no diplomatic solution. The 30‑year‑long stalemate ended when Azerbaijan re‑gained its occupied territories with a decisive military victory after 44 days of fighting. After the Second Karabakh War, Azerbaijan restored its territorial integrity in conformity with four UN Security Council resolutions. Formally, Azerbaijan’s sovereignty over all Karabakh was restored through the signing of a trilateral settlement that was reached between Azerbaijan and Armenia on November 10th, 2010, with Russia being the facilitator and third signatory. The settlement, which is more than a conventional truce but less than a full peace agreement, ensured the return of the remaining five occupied Azerbaijani areas immediately. A five‑kilometer‑wide corridor connecting Armenia to Karabakh was opened through Lachin, with control granted to a newly‑established Russian peacekeeping force, which also took over control of Khankendi and some surrounding areas populated by ethnic‑Armenians. Despite some delays, the trilateral settlement is being enforced and the Armenian occupation of 20 percent of Azerbaijani territories came to an end in early 2021. Other provisions of the settlement, such as the establishment of the free movement of all Azerbaijani persons, services, and capital to the region, is to follow.

Abstract:: The conflict between Armenia and Azerbaijan over Nagorno-Karabakh has deep historical roots and has been exacerbated by the armed conflict of 2020. In this context, the human rights situation of those affected, and especially of women and girls, is often left invisible. Thus, this article analyses the conflict by referring to the general position of the UN and public international law and by widening the lens, in particular, on international human rights law and the UN mechanisms articulated for the protection of those rights. A distinct focus on the human rights of women and girls is presented, giving an account of the empirical situations they face, to then study them through the lens of human rights with a gender perspective, emphasizing what the main international protection mechanisms dedicated to the issue have expressed in this regard./El conflicto entre Armenia y Azerbaiyán sobre el Nagorno-Karabaj presenta hondas raíces históricas y se ha visto exacerbado por el conflicto armado de 2020. En este contexto, a menudo la situación de los derechos humanos de las personas afectadas y, en particular, los de las mujeres y niñas, queda invisibilizada. Así, este artículo analiza el conflicto refiriendo la postura general de la ONU y el Derecho Internacional Público y ampliando el lente, en especial, sobre el Derecho internacional de los derechos humanos y los mecanismos de Naciones Unidas articulados para su protección. Abstract:: Among the various ad hoc international criminal tribunals that have been established since the end of the twentieth century, the Special Tribunal for Lebanon stands out for its singularity, both at the jurisdictional level and for its contribution to the treatment of victims. The work of the Special Tribunal for Lebanon began in 2009, delivering its first sentence on 18 August 2020. Through its constitution, the United Nations Security Council sought not to abandon the path initiated in 1993 with the creation of the Yugoslavia and Rwanda tribunals; however, the result has not been as expected. This article aims to analyze the peculiarities of the Tribunal and its work, making a critical analysis of it, considering it as a lost opportunity for the reconstruction process in Lebanon./Entre los diversos tribunales penales internacionales ad hoc que se han creado desde finales del siglo XX, el Tribunal Especial para el Líbano destaca por su particularidad, tanto a nivel jurisdiccional como por su contribución al tratamiento de las víctimas. La labor del Tribunal Especial para el Líbano comenzó en 2009, dictando su primera sentencia de instancia el 18 de agosto de 2020. Mediante su constitución, el Consejo de Seguridad de Naciones Unidas apostó por no abandonar el camino iniciado en 1993 con la creación de los tribunales de Yugoslavia y Ruanda; sin embargo, el resultado no ha sido el esperado. Este trabajo pretende analizar las peculiaridades del Tribunal y su trabajo, realizando un análisis crítico del mismo como oportunidad perdida para el proceso de reconstrucción del Líbano.

Abstract:: Games have always been a powerful tool for learning behaviours and attitudes necessary for an efficient socio-cultural performance. In today's digital society this role is played mainly by video games. They provide video players with skills and abilities typical of the time and facilitate the learning of complex processes effectively. The UN, through its different agencies and through various Education programmes, has used this format to bring together and raise awareness among citizens about the main international issues, such as crises and the displacement of refugees. The aim of this text is to analyse how these issues are projected through the case study of the Spanish video game Survival, as well as to assess whether it is a useful tool for raising awareness and providing adequate information to the population. To this end, this article will analyze the message of this title as well as initiatives such as the UNAOC's PEACEapp initiative./Los juegos han constituido siempre una poderosa herramienta de aprendizaje de conductas y actitudes necesarias para el eficiente desempeño sociocultural. En la actual sociedad digital ese papel lo protagonizan, principalmente, los videojuegos. Estos proveen a los video jugadores de habilidades y destrezas propias de la época y facilitan el aprendizaje de procesos complejos con eficacia. La ONU a través de sus diferentes agencias y mediante diversos programas de Educación se ha servido de este formato para aproximar y concienciar a la ciudadanía sobre las principales problemáticas internacionales, como las crisis y desplazamientos de refugiados. El objetivo del presente texto es analizar cómo se proyectan estos temas a través del estudio de caso del videojuego español Survival así como valorar si es una herramienta útil para concienciar e informar adecuadamente a la población. Abstract:: The inclusion of the gender perspective in military operations is now a legal requirement. This exigency is mainly consequence of the doption of the UNSCR 1325. But it is also an operational requirement derived from the need to take into account in decision-making processes the human factor in all its dimensions, to ensure that military actions are adapted to the reality of the scenario in which they take place. This article tries to show that, in the process of integrating this aspect in operations, decision makers tend to only consider the legal aspects of this issue, ignoring the operational benefits that it entails. The official documents of organizations such as the UN or NATO, recognize this duality but, in practice, do not develop this perspective in their operating procedures. All this creates significant problems for those responsible for integrating the gender perspective in operations and requires the introduction of regulatory changes along these lines./Integrar la perspectiva de género en la conducción de las operaciones militares es una exigencia jurídica derivada principalmente de la RCSNU 1325. Pero es también una exigencia operativa derivada de la necesidad de tener en cuenta en los procesos de toma de decisiones el factor humano en toda su extensión, para garantizar que las actuaciones propias se adaptan a la realidad del escenario en el que se desarrollan. A lo largo de este trabajo se evidencia que, en la integración de este aspecto en las operaciones, se tiende a incidir únicamente en los aspectos jurídicos de esta cuestión, pasando por alto los beneficios operativos que conlleva. Los documentos oficiales de organizaciones como la ONU o la OTAN, reconocen esta dualidad pero, en la práctica, no la desarrollan en sus procedimientos operativos, lo que supone un problema para los responsables de integrar la perspectiva de género en las operaciones y hace necesario introducir cambios normativos en esta línea.

29. United Nations’ Sustainable Development Goals and the Most Important Utilitarian Values. Social Security Approach

Abstract:: 2030 Agenda constitutes a comprehensive framework for sustainable development. Nevertheless, not all sustainable development goals properly match the most important utilitarian values (human life and health). It is especially noticeable in terms of disasters and crises, which commonly determine social security. The research objective is to indicate the placement of the values in the particular goals. The systematic literature review indicates 47 information sources. That enables an in-depth analysis of the goals and social security specification elements, highlighting the direct or indirect character of relevant relations. The gaps can be identified considering the social character of the goals, characteristic hazards, danger to human life, and health and urgency of the response. In most cases, the relations between the goals and the values are indirect. They can be improved with a potentially positive influence on sustainable development in all circumstances (including the most dangerous ones). The goals specification states many references for the improvement in a synergistic way respecting the most important utilitarian values, especially in zero hunger, good health and well-being, sustainable cities and communities, climate action, partnership for the goals.

Calls for “reformed multilateralism”[1] at the UN’s 75th anniversary session in September 2020 stressed the need for equal participation by member-states in UN decision-making. Five years earlier, when adopting Agenda 2030, the United Nations General Assembly (UNGA) acknowledged the inter-linkage between peace, security, and development.[2] With its universal scope, Agenda 2030 on Sustainable Development has become the central focus of the United Nations (UN) for the foreseeable future. Agenda 2030 requires a paradigm shift in the approach of UN member-states to global issues and underscores the imperative for an inclusive human-centric approach through the participation of multiple stakeholders in UN activities. This would enable the UN to pool resources through partnerships to meet the major challenges in all its three “pillars” – political, human rights, and socio-economic development.

Abstract:: Editor’s note: The author was Executive Director of the United Nations World Food Programme 1992-2002 and United Nations Under Secretary General for Management 2003-2005. President Biden’s nomination of Ambassador Linda Thomas-Greenfield as US Ambassador to the United Nations promises to bring effective leadership, professionalism, and immense knowledge to the role. She is one of only a few American diplomats who have had leadership postings dealing with important UN operations at every level—in countries where she served as a foreign service officer, in Geneva, and in Washington DC. In New York, the ambassador will need to summon all her skills and experience to lead the American team at the US mission to the UN. Along with the USUN ambassador and the Secretary of State, US multilateral efforts are led by the Assistant Secretaries of the Bureau of International Organizations and the Bureau of Population, Refugees and Migration and the Permanent Representatives to the UN in Geneva, Rome, Vienna, and Nairobi. The president should nominate people for these positions who have in-depth knowledge of the system and related issues, solid judgment, and strong interpersonal skills. The diplomats must be strategic, prepared, creative, goal oriented, and personally engaging. Process oriented micro-managers will not accomplish much.

Abstract:: Editor’s note: The author served as UK Ambassador to the UN 1998-2003. The UN, with its network of institutions and agencies, is the only truly global organisation. It is a great experiment, not in global governance, because the political direction of the UN lies firmly in the hands of sovereign nations, but in providing both norms and tools for managing the international arena 1. Its system is flawed and may well be unimprovable. But what it tries to do, and does, is indispensable for the avoidance of catastrophic war and for the development of a sustainable world. The UN as an institution is also, not unlike the American Constitution, an adversary of raw power. Born in an era of war and empire, its charter and principles provide shelter and help for weaker nations, and set limitations on the capacity of the strongest countries to throw their weight around selfishly—the generator of empires and wars. It came into being at the instigation of the great powers, and so they know —or they used to know—what they were creating and why. The United States was at the centre of it, seeing it as a great step towards the ending of the era of imperialism. The UN is not just about what happens in the Security Council. The work of the Secretariat, the funds, agencies and programmes, and indeed of several of the intergovernmental institutions such as ECOSOC, is primarily dedicated to every aspect of international development. They act on the premise that if a large part of the world is racked by poverty and disease, the more fortunate part will not have a stable environment in which to enjoy their relative success. The history of regional conflict over the last 75 years bears this out. As the UK’s Permanent Representative between 1998 and 2003, with a permanent place on the Security Council, I made a point of setting my inevitable focus on the Council’s work in the context of this wider UN purpose. The maintenance of international peace and security is an essential component of sustainable development, not just an end in itself.

Abstract:: Editor’s note: The author was U.S. Ambassador to the UN 1989-1992. Franklin Roosevelt knew a good thing when he saw it. In 1943, in the midst of a military campaign for American survival in the Pacific and clawing our way back against Nazi Germany in the Atlantic, Roosevelt put bright people to work to shape what would come next. International cooperation under the League of Nations had twice failed – the U.S. resolved to stay out and the League’s weakness led to World War II. To fix it, Roosevelt took the name for the victory coalition of that great crusade – the United Nations – and fashioned an international organization to promote peace and prosperity through cooperation. Isolationist opposition in the U.S. endured, but many leaders of both parties had the vision and perspicacity to know that friends and allies working together made sense in achieving both objectives. Failure dogged the pursuit, but in Korea, the Gulf, Afghanistan, and the Balkans the organization made a real difference in war and peace. Americans have now been through four years of disdain and disparagement about the United Nations and the Trump administration’s failure to understand or make good use of it. Chinese and Russian opposition did not help. The Biden team comes to power with the challenge – how can we use more effectively Roosevelt’s vision to promote peace and prosperity on the planet?

Abstract:: The mechanisms of Responsibility to Protect (R2P) as agreed by the world leaders in 2005 were expected to prevent mass atrocities by forming a consensusbased international response that includes the use of force. In early 2011, for the first time, the coercive element of R2P was put into force in Libya by a UNSC resolution. However, the apparent pursuit of a regime change in Libya by the intervening powers has eroded trust in the Western coalition, shattered the belief in humanitarian missions, alienated the non-Western world, and thus broken the fragile consensus. The Libya debacle has strengthened the argument that it is very unlikely, if not impossible, to detach a humanitarian intervention from power politics, and prevent its misuse

35. Breaking the Presumption That Applicants of Statelessness Determination Procedures Are Foreign

Abstract:: This article considers the situation of those who apply for a determination of their status as a stateless person but could, nonetheless, be nationals of the state in which they apply. Cases of in situ statelessness provide the most opportunity for the identification of these situations. After having identified 23 formal Statelessness Determination Procedures (‘SDP’) adopted as of 2020 from 23 countries, it is conclusive that these norms presume the applicant is foreign. However, eight countries have been mapped with safeguards in their SDP norms recognising the possibility that there could be identified applicants who may be nationals and what to do in cases of doubt. These safeguards are adopted by four countries in the Americas (Costa Rica, Panama, Paraguay and Argentina) and four countries in Europe (Georgia, Moldova, Ukraine and Turkey). These constitute good practices that should be taken into consideration by further SDP norms adopted in the future, modifications of current SDP norms and statistics. This issue constitutes a ‘red flag’ for raising awareness of discriminatory state policies that assume stateless applicants are foreign and should receive second-class citizenship (naturalization), rather than refer the case to the corresponding national civil registry authorities and facilitate the access to nationality. The objective of this article has not yet been analysed by doctrine or the United Nations High Commissioner for Refugees.

36. China in UN Peacekeeping Operations: A 30-Year Assessment (1990-2019)

Abstract:: This article presents a broad assessment of Chinese personnel deployments to peacekeeping operations (PKOs) for the past three decades (1990-2019). To this end, an original dataset was built with data collected from the UN Department of Peace Operations. The following four indicators were considered in the analysis: (i) total personnel contribution per year; (ii) personnel contribution per mission; (iii) personnel contribution in relation to the mission’s total contingent; and (iv) personnel in a given mission in relation to the total personnel dispatched by China that year. Generally speaking, UN missions in Liberia (UNMIL) and South Sudan (UNMISS) have been the main destinations of Chinese peacekeepers in the 21st Century, while Cambodia (UNTAC) was by far the only place where China got deeply involved during the 1990s. In addition to displaying descriptive data, the paper also briefly analyses Chinese engagement in these operations.

Abstract:: Issues concerning global climate change – by objective criteria, one of the most serious environmental threats of our time – have for many years been filling the top slots of the international agenda, and the political tem- perature of debates on this topic remains at the highest degree. Soon a new milestone will be reached on the thorny path of the inter- national climate process: on December 31, 2020, the Doha Amendment to the kyoto Protocol of the united nations Framework Convention on Climate Change (unFCCC) comes into force.1 this document extends the time frame of the kyoto Protocol from 2013 to 2020 (hence its unofficial title, kyoto-2) and contains a whole set of amendments to the kyoto guidelines, including updated quantitative criteria for greenhouse gas emission reductions for developed countries. Climate activists will probably schedule their next mass marches for this date, in order to mark this "historic" stage in the fight against global warming. Leaders from a number of states are expected to make bold new calls to “set the bar high” for the sake of averting a global climate col- lapse. But what remains hidden behind the scenes? What are the root caus- es of such a paradoxical situation, in which kyoto-2 is going into effect at the very end of its second commitment period?

Abstract:: After the United Nations’ (UN) 75th anniversary, it is easy today to forget that this most central and far-reaching of all multilateral organizations was born in very high hopes of its permanent relevancy in maintaining international peace and security. But by baking in a veto for each of the five victorious World War II powers—or deemed as such by the 1945 governments in Washington and London, the godparents of the UN Security Council—the seeds of its frequent spells of semiparalysis were sown, spells which have been intensifying for at least the past four years. Indeed, the council arguably operated at near-peak effectiveness only during the years between 1987 – 1994, when the Cold War was ending and then briefly, as of 1990, appeared to have ended. However, misjudgments in Washington over the extent to which Moscow’s alignment with the thinking of Western capitals could be taken for granted—an attitude bitterly resented at the time by the new Russian Federation—ended that brief spell.

Abstract:: President Joseph Biden is reembracing President Barack Obama’s foreign policy strategy, making multilateralism a core principle of his own foreign policy. Biden’s foreign policy team includes Obama Administration veterans such as Antony Blinken, William Burns and John Kerry, all of whom believe in the efficacy of multilateral diplomacy. Biden has returned to the Paris Climate Accord, nullified President Donald Trump’s decision to leave the World Health Organization (WHO) and reengaged with the UN Human Rights Council (UNHRC). If returning to the UN Educational, Scientific, and Cultural Organization (UNESCO) is also a possibility, Biden ought to take a close look at the U.S. experience with that organization because it is a good example of the difficulties that multilateralism can pose for the U.S.

Abstract:: One in five children lives in a country affected by conflict (Save the Children 2019). Despite concerted international and national efforts to protect children, these 415 million children face grave human rights violations that continue to rise. More political will and resources are needed from governments and parties to the conflict to prevent such violence against children and protect children in armed conflict. However, research confirms that out of 431 ceasefire and peace agreements, less than 18 percent of peace agreements included child protection provisions (Watchlist on Children and Armed Conflict). Often, peace-related documents that mention child protection issues do not mention integrating children's participation into peace processes, which is essential to understanding and addressing children's needs during and after the conflict. To end the cycle of violence against children, a paradigm shift must be made in the way peace agreements address children’s issues and rights. Guided by the “Global Policy Paper on Youth Participation in the Peace Process,” commissioned by the United Nations Envoy on Youth, this paper recommends that mediators and child protection actors employ three integrated but non-hierarchical layers for including child protection issues and children’s participation in the peace process: “in the room,” “around the room,” and “outside the room” of formal peace negotiations. This multi-layered, inclusive approach may help achieve the desired results: preventing violence against children and reaching a sustainable peace.

Abstract:: In this article, we analyse the content of the speeches delivered by Brazilian Presidents, Foreign Ministers and Ambassadors at annual Ordinary Sessions of the United Nations General Assembly in the period between 1946 and 2019. Our primary objective is to find out how often and under what circumstances Brazilian diplomats mentioned the subject of American regionalism and whether the mention was made in reference to specific projects or to abstract concepts of regional integration and cooperation. Based on this analysis, we highlight the great deal of importance that was given to MERCOSUR – and, to a lesser extent, UNASUR – to the detriment of other regional integration projects, as well as the preference, by Brazilian diplomats, for a flexible, low-profile, ab- stract and low-cost discursive approach. In short, we found that cooperation and integration have frequently been discussed, although little attention has been devoted to the limits and possibilities of each project under construction.

Abstract:: Two decades ago, history was made as far as gender security is concerned. The United Nations Security Council (UNSC) led a revolutionary policy change by passing Resolution 1325 – also known as the women, peace and security (WPS) agenda – on 31 October 2000. The resolution marked the United Nations’ (UN) full-fledged attention to gendered aspects of peace and conflict. This was revolutionary: advocacy for placing women at the centre of peace processes – not merely as victims, but as peacebuilders. The resolution called for the full participation of women in all efforts towards conflict prevention, resolution, peacemaking and post-conflict reconstruction. This resolution is considered a crucial international document for advocating gender equality in all processes of peacebuilding, both during conflict and post-conflict.[1] It brought into focus the official endorsement of the involvement of women in formal peace processes.[2] This article[3] argues that since we recently celebrated the 20th anniversary of UNSC Resolution 1325 in Africa, and elsewhere, a reality check is in order.

Abstract:: Since International Youth Day was celebrated on 12 August 2020, it is a good time to take stock of the youth and their role in peacebuilding and peace processes in Africa. With the youth, peace and security agenda gaining ground in recent years, this is an opportune time for youth-focused organisations to strengthen their work on youth and peacebuilding, while contributing to the ongoing discourse. The youth, peace and security agenda is currently backed by three United Nations Security Council (UNSC) resolutions adopted between 2015 and 2020, namely UNSC Resolutions 2250 (2015), 2419 (2018) and 2535 (2020). Among other priorities, the resolutions emphasise the importance of youth as agents of change in the maintenance and promotion of peace and security;[1] reiterate the need for stakeholders to take young people’s views into account and facilitate their equal and full participation in peace and decision-making processes at all levels; and recognise the positive role young people can play in negotiating and implementing peace agreements and in preventing and resolving conflict.[2] The third resolution, adopted in July 2020, also establishes a regular biennial reporting requirement on youth, peace and security by the United Nations (UN) Secretary-General, which is a great step forward in mainstreaming the youth, peace and security agenda into the work of the UN – especially since youth engagement in peacebuilding and peace processes is ad hoc and intermittent. The reporting requirement will therefore provide a snapshot of ongoing processes and how engagement can be enhanced and deepened in future processes.

Abstract:: Forced displacement continues to be a major challenge to human security across the globe. According to the United Nations High Commissioner for Refugees (UNHCR), the global population of forcibly displaced people increased by 2.3 million people in 2018, and by the end of the year, more than 70 million individuals were forcibly displaced worldwide (UNHCR 2019a). UNHCR also estimated that, in 2018, 13.6 million people were newly displaced as a result of conflicts and droughts (ibid.). Building on the predicament of global sustainability and the 2030 agenda for sustainable development, the Global Compact on Refugees (GCR) is a framework based on four strategic objectives: to (1) ease pressures on host countries, (2) enhance refugee self-reliance, (3) expand access to third-country solutions, and (4) support conditions in countries of origin for return in safety and dignity (UNHCR 2018; UN General Assembly 2019). The GCR urges the international community to respond comprehensively and innovatively to the plight of refugees, and to make a paradigm shift in global humanitarian aid to emphasize refugee self-reliance and livelihoods. One of the risks of such a nonbinding and thin agreement, however, is that the GCR will give rise to a bureaucratic process that “does not come even close to dependably addressing the operational deficits of the refugee regime” (Hathaway 2019, 594). This article looks closely at the prospects for the GCR in sub-Saharan Africa based on the need to shift from a humanitarian system of “care and maintenance” to comprehensive and effective development responses to refugee crises. It also discusses some of these experiences and best practices to promote a resilience-based development approach. It recognizes that development initiatives implemented or still to be implemented under the normative framework of the GCR and the Comprehensive Refugee Response Framework (CRRF) are subject to a multiyear planning and implementation cycle. Therefore, this article does not intend to evaluate their efficacy or measure progress under the GCR, but rather to identify key challenges and to highlight achievements and promising initiatives in sub-Saharan Africa. It particularly focuses on implementation and rollout of the CRRF in Chad, Djibouti, Ethiopia, Kenya, Rwanda, Somalia, Uganda, and Zambia in Africa.

Abstract:: Many scholars have argued that security, peace and conflict are gender neutral. However, studies have shown that women and men experience conflict differently. This article analyses the need to increase women’s role in peace and conflict resolution agenda, particularly based on the experience of the Indonesian Female Peacekeepers in the United Nations Peacekeeping Operation. Feminist theoretical framework and gender analysis were used to look at the impact experienced by men and women during wartime, and women’s role in peace and conflict resolution agenda. It is argued that the change of warfare characteristics from interstate to intrastate conflict, and the new human security framework require the ability of peacekeepers to move closer to communities. In this regard, in line with the United Nations Security Council Resolution 1325 on Women, Peace and Security, Indonesia has committed to increase its female peacekeepers. The participation of women peacekeepers increases community acceptance, and optimize the capability of the military to fulfil its role in protecting democratic societies.

Abstract:: This article departs from liberal institutionalism theory which argues that security sector reform is an important element to guarantee community security in post-conflict state. Nevertheless, this article discovers that Security Sector Reform run by the United Nations in Timor Lester from 2000-2012 failed to provide effective community security. While the people of Timor Leste have their own perceptions about the meaning of security, religious and cultural institutions, the church and "uma lisan" have provided mainly social protection and mechanisms for conflict resolution. Based on in-depth interviews with 15 key informants and survey to 100 respondents during the field research in Dili, this article suggests that the security role of the church and "uma lisan" has substantially substituted the ineffectiveness of the international and state-led security institutions during the United Nations mission in the country.

Abstract:: Deep ocean floor called as Area is considered as Common Heritage of Mankind (CHM) and the mining activities are managed by International Seabed Authority (ISA). In this article, firstly, the significance of the CHM concept with respect to decolonised states and its impact on law of the sea is elaborated. Secondly, the mandate of ISA which assumed responsibility for the translation of the CHM concept into practice is examined. Every state can take part in mining activities in the Area as a ‘sponsor state’ but the lack of precision with respect to responsibility limits have a deterrent effect over the states that are disadvantaged technically and financially. Considering the negative impact of this issue over the CHM concept the Advisory Opinion of the International Tribunal for Law of the Sea that was given in 2011 is examined.

Abstract:: This year marks the 70th anniversary of the first Nobel Peace Prize presented for efforts to achieve peace in the Middle East between Israel and Arab nations in Palestine. The recipient was Ralph Bunche, an American academic and diplomat with the U.N., who received the Peace Prize in 1950 for brokering the Israeli-Arab armistice agreements in 1949. The agreements ended the official hostilities of the 1948 Arab-Israeli War between Israel and Egypt, Jordan, Syria, and Lebanon and established armistice lines between Israeli and Arab nation forces that held until the 1967 Six-Day War. (This same seemingly intractable confrontation yielded two later Peace Prizes: to Anwar al-Sadat and Menachem Begin in 1978 and to Yassar Arafat, Shimon Peres, and Yitzhak Rabin in 1994.)

Abstract:: Immigration policy has taken centre stage in the social sciences over the past 20 years. Despite the proliferation of articles and books in this field, very little attention has been paid to immigration policy as foreign policy. It is domestic policy that prevails in the literature, most notably about the effects of immigration on destination societies. This article distinguishes the domestic and foreign policy aspects of immigration policy, acknowledging as it does so that foreign policy is virtually always an expression of national self-interest. It concludes with observations on the realist and idealist/liberal approaches to international relations theory including with respect to the recently adopted United Nations Global Compact for Safe, Orderly, and Regular Migration and the United Nations Global Compact on Refugees. Its purpose is to draw attention to this neglected aspect of immigration policy and to encourage others to explore it in greater detail, from the perspectives of both individual states and the world’s international institutions.

Abstract:: This article examines the relationship of the Palestine Liberation Organization (PLO) to the United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA) during the 1970s, the period when the PLO reached the zenith of its power in Palestinian refugee camps throughout the Levant. Based on archival United Nations (UN) and UNRWA documents, as well as the PLO’s own communications and publications, the article argues that the organization approached its relationship with UNRWA as part of a broader strategy to gain international legitimacy at the UN. That approach resulted in a complex set of tensions, specifically over which of the two institutions truly served and represented Palestinian refugees. In exploring these tensions, this article also demonstrates how the “question of Palestine” was in many ways an international issue.

Abstract:: The purpose of this article is to assess international negotiation efforts towards ending the civil war in Syria. Although many peace events have been organised since the beginning of the civil war, the existing literature has paid little attention to the impact of international peace efforts in ending the Syrian war. The article aims to close this gap by assessing major peace efforts between 2011 and 2019; The Arab League Peace Plan, the United Nations peace initiatives, and the Geneva, Vienna and Astana peace talks. It analyses these efforts through official reports and documents published by the UN, US, Republic of Turkey, UN Security Council, and members of peace initiatives. These documents are complemented by newspaper articles showing the official views of the regional and global actors as well as the key agents of the conflict. Therefore, the article reveals the reasons for the failure of these conflict resolution efforts. The Syrian government’s reluctance to end the conflict in a non-violent way, the armed groups’ dream of territorial gains and regional and global powers’ involvement in the conflict prevented the solution of the conflict. It utilises official negotiations and ripeness approaches to investigate the insights and contents of peace efforts. The article argues that the regional and global powers have acted as facilitators instead of mediators in the peace talks. It finds that even though these peace events are viewed as official negotiations, they are only pre-negotiation efforts.

Abstract:: The 70th anniversary of the Universal Declaration of Human Rights (UDHR) in December 2018 created a need to problematise its precepts and their political consequences in contempo- rary times. Drawing on Michel Foucault’s genealogical approach to power, this article analyses the normative inscription of the UDHR as the emergence of a juridical-political device that produces new modulations of biopolitics. As such, it is not based on peace, as is commonly argued, but on the permanent reinscription of war, sometimes in dimensions that go beyond the boundaries of sovereignty.

Abstract:: The current Brazilian political and economic context is one of intense crisis and it will inevitably impact public policies. In 2000’s, practices of International Cooperation and Development (ICD) gained emphasis through organized experience sharing between developing country governments and international organizations. Brazil deepened its partnerships with others Southern countries, a practice that came to be known as South-South Cooperation (SSC). However, following the impeachment of President Dilma Rousseff in 2016, the incoming administration introduced government spending limits in the form of a Constitutional Amendment (95/2016) which structurally decreased resources available for SSC and consequently limited possibilities to continue deepening international involvement. This article analyzes the first effects of the new fiscal regime for SSC using a bibliographic review and a case study of the Social Protection.Org platform which is managed by the International Policy Centre for Inclusive Growth (IPC-IG), a centre of research excellence established through a partnership between the United Nations and Brazilian government.

54. State Human Rights Performance and Recommendations under the Universal Periodic Review

Abstract:: This paper analyzes recommendations made to states under the UN Human Rights Council (HRC) Universal Periodic Review (UPR) in order to determine whether or not the UPR is making meaningful recommendations to states under review. The UPR reviews the human rights of all UN Member States every four years. During the review, each state receives a number of recommendations from other UN member states. This paper uses data from UPR Info to determine if states with better human rights performance as measured by the CIRI human rights data project receive fewer recommendations than states with worse performance. It finds that, even when controlling for other factors, states with worse records on civil and political rights generally receive more recommendations than states with better records. States with lower scores from CIRI on women's economic and political rights receive more recommendations regarding women's issues than states with higher scores. These findings hold regardless of region, suggesting that, at a minimum, the UPR process is identifying violators of human rights.

Abstract:: Some authors refer to Western Sahara as “the last colony” of Africa. Indeed, officially, the sahrawi territory has never been decolonized; thus, the situation of Western Sahara is very peculiar in the context of UN Peace Operations, when compared with another ongoing missions, and, yet, is quite unique in the geopolitical context, since the international community has divergent opinions regarding this territory. In this context, the present article aims to answer the following question: Which are the main reasons that allows the deadlock for the resolution in the Western Sahara’s conflict, initiated in the 70s, to endure until the present days, even with the MINURSO establishment in 1991? The hypothesis sustained is that the dilemma in the conflict solution in West Sahara continues due to political-economical interests, and also the interference/ interests of important global geopolitical actors, impelling that the diplomacy intermediate by the UN, through MINURSO, reaches the success and the aimed solution. In order to answer the proposed question, it is intended to present the history of the conflict until the MINURSO implementation, followed by the detailing of that mission and, in the end, to approach economical, strategic and geopolitical interests of the main actors involved in the sahrawi question.

Abstract:: The right to a nationality is often taken for granted. Over the course of decades, UN member states have enshrined this right through fundamental instruments, notably the UN Covenant on Civil and Political Rights. Yet con- servative estimates hold that approximately 10 million people spread across every continent are denied a nationality.1 Some, but not all, are refugees. Collectively, these individuals are stateless—they lack any claim to a nationality recognized or assumed by any state. For many years, statelessness was a forgotten issue, relegated to the realm of state sovereignty prerogatives. Recently, states and the UN have begun to focus on the pressing nature of the problem. They have made progress in addressing statelessness as a global, collectively shared challenge. However, the UN target of eradicating statelessness by 2024, while a fine aspiration, continues to face significant hurdles. These obstacles include a serious dearth of informa- tion about the problem’s scope, discriminatory national legislation and policies that obstruct UN efforts, an ambiguous international legal framework, and the absence of solutions that are accessible to stateless individuals.

Abstract:: Canada is the canary in the coal mine in terms of efforts to combat stateless- ness among Western democracies. One might assume that Canada would have a sophisticated system for addressing stateless persons—those without any citizen- ship whatsoever in any nation—since its reputation for welcoming refugees is unparalleled. In 1986, Canada won the Nansen Medal, the highest distinction bestowed by the United Nations for aiding refugees.1 Its inland refugee determi- nation system is considered the gold standard all over the world. Furthermore, Canadians have a generous refugee sponsorship program, which allows groups of persons, not just the government, to sponsor overseas refugees.2 This system is not without its problems. One notable example is that some border crossers at the Canada-United States border are denied the right to a refugee hearing and are consequently in danger of being sent back—before their refugee claim is assessed—to places where they may face persecution and/or torture.3 Not- withstanding such shortcomings, Canada is a democracy; there are continual efforts to improve the refugee system through dialogue between the courts and the legislature, advocacy and education by lawyers, NGOs, and migrants themselves, and the hard work of civil servants working to improve the system.

Abstract:: This article highlights the continued stark absence of women from key policy spaces and sites of power and restates the case for the importance of gender parity as a fundamental building block of both gender equality and the overall effectiveness of institutions and outcomes. It does so through a focus on the area of international peace and security and the UN’s efforts, highlighting the way in which women’s inclusion is critical for efforts to secure sustainable peace. At a time when both the movement for gender equality and its backlash are ascendant political forces, and the proliferation of armed conflict is testing the credibility of multilateralism, it is significant that the UN is demanding transformation, starting with its own work force; and essential that this focus also include an emphatic insistence on the question of ‘where are the women’ in all areas of peace and security, serving as a model for other international and national actors.

Abstract:: In the second issue of our 20th volume, the critical diplomatic roles from grassroots advocacy to international negotiations are explored. Nahla Valji and Pablo Castillo open this issue, arguing for the importance, and ultimate necessity, of gender parity for the success of the United Nations’ peace and security efforts. This article discusses the great need for gender parity both within the UN system as well as within its advocacy on the ground. Following, Tanya Ansahta Garnett and Kari Øygard offer a case study on women’s roles in peacebuilding and civic engagement in post-conflict Liberia. They discuss whether or not women’s participation and representation is an effective strategy towards meaningful long-term change. Lina Abirafeh then examines the widespread issue of genderbased violence in the Arab region by outlining several case studies. Abirafeh then considers how it continues to withhold women’s political and legal progress in the region. Changing gears, Catherine Tinker and Renata Koch Alvarenga then survey the successes and continued drawbacks to gender equality in climate finance, offering a call to action for quicker implementation of a genderresponsive approach to mitigating the effects of climate change. Rachel Clement and Lyric Thompson conclude this issue by discussing the theory behind a feminist foreign policy and what it will take to move beyond the definition to a comprehensively feminist approach to foreign policy that is engrained in all sectors of diplomacy while also elevating traditionally unheard voices.

Abstract:: Thank you very much for the invitation and thank you for allowing me to speak to you about the United Nations and its role in Central and Eastern Europe. This is probably the first time in the history of our conference that we are discussing the United Nations. I will argue that there is a lot that we as Eastern Europeans can do together and how our coop- eration within the UN can be more fruitful and useful for all. I would like to first discuss how we can cooperate better in the General Assembly, Security Council and the United Nations Secretariat. Where are the opportunities? Where are the challenges? What else should we consider and be aware of? Let us begin with the historical context: what has been the role of the UN for Central and Eastern European countries? During the communist era, we were denied indepen- dence or sovereignty, thus the real interests of our countries were not represented on the global stage. There were of course communist embassies, very close coordination with Soviet diplomats, and weekly or even daily instructions coming from Moscow. This was the case until 1989. Then communism collapsed and our countries regained their inde- pendence and sovereignty. Initially, in the early 1990s, the UN was visibly present in East- ern Europe as a result of civil wars and ethnic conflicts. UN peacekeepers were a familiar sight, serving on various missions seeking to reestablish peace and stability. Then, I would argue, the role of the United Nations in our regional diplomacy and politics declined as the 20th century drew to a close and the 21st century began. This was due to the very powerful roles played by the European Union, NATO and the OSCE. These organizations eclipsed in importance the seemingly distant United Nations in New York City. Now, the situation is changing again, and we are witnessing a resurgence of the UN’s impact on Polish and European diplomacy. The UN is gradually reestablishing its role as useful platform through which Poland can play an active and leading role in promoting the political and economic interests of our region. It is particularly noteworthy that the Polish Minister of Foreign Affairs Jacek Czaputowicz spent the majority of May 2018 in New York – not enjoying the beautiful Big Apple, but working long hours, leading the various debates within the Security Council – giving Polish foreign policy a critical platform on the world stage.

Abstract:: The murder earlier this month of journalist Lyra McKee in Northern Ireland on the night before Good Friday illustrates the fragility of peace in a region in which terrorist violence has persisted. In our cover article, Aaron Edwards writes that this was “the latest in a series of incidents that have raised the specter of a surge in terrorist violence in Northern Ireland.” In examining the evolution of the threat from militant groupings on both sides of the sectarian divide, he notes there has been a “blurring of the concepts of terrorism and criminality that challenges orthodox perspectives on the security landscape in Northern Ireland.” Our interview is with Edmund Fitton-Brown, the Coordinator of the ISIL (Daesh)/Al-Qaida/Taliban Monitoring Team at the United Nations. This issue features the concluding article of a two-article series focused on IED and WMD network convergence. The first article, published in our February 2019 issue, warned there was a high risk that profit-minded suppliers within vast, transnational IED networks may expand in the future into WMD proliferation. In the second article, Major Stephen Hummel, Lieutenant Colonel Douglas McNair, Colonel F. John Burpo, and Brigadier General James Bonner examine in greater detail the ways this could happen. Audrey Alexander and Bennett Clifford examine the threat posed by Islamic State-affiliated hackers and hacking groups. Through “analysis of several U.S. prosecutions of Islamic State-affiliated hackers and their networks, proficiencies, and activities,” they argue that “very few of these actors demonstrate advanced hacking or cyberterrorism capabilities.” Caleb Weiss examines the evolution of the threat posed by the Islamic State in Somalia, noting the group, “which is believed to only number in the low hundreds of fighters, appears to have significantly expanded its operations across Somalia, albeit from a relatively low base.” He argues the resulting reignition of tensions with the much larger al-Qa`ida affiliate al-Shabaab means “it is far from clear whether the Islamic State in Somalia will be able to sustain its operational expansion.”

Abstract:: This article aims to examine the context of the political breakdown in South Sudan, highlighting its effects on human security in the country, and to analyze the response of the United Nations, with a focus on civilian protection, in the period 2014-2018. In this light, the theoretical hypothesis was that “within the framework of a United Nations peace mission, the implementation of a strategy for the protection of civilians corroborates human security in the region of crisis and/or conflict.” In this effort, after this introduction, the methodological considerations about the investigation are presented, followed by a theoretical and conceptual frame that fits the analysis. Subsequently, is the political breakdown in South Sudan, highlighting its effects on human security and, following the central question, the United Nations response focused on the protection of civilians. Finally, we present the conclusive aspects, illuminated by the theoretical hypothesis.

Aksi halde, yeni terörist örgütlerin tartışmalı bölgelerden ortaya çıkacak ve sınır aşırı organize suçlar dolayısıyla elde edilen gelirlerin bu örgütlerin eylemlerini finanse edecektir. Her ne kadar Birleşmiş Milletlerin küresel problemlere çözüm üretmesi gereken kurum olduğu düşünülse de, BM organlarının terörizm ve sınır aşan suçlar özelinde etkili olduğunu söylemek zor olacaktır. Bunun ötesinde, terörizm tanımının ne olduğu noktasında netliğin olmaması, egemen devletlere çıkarlarına göre bir terörizm tanımı yapmalarına imkân sağlamaktadır. Abstract:: Kashmir is the most serious dispute between Pakistan and India that originated with the British decision to give independence to British India that later divided into two states i.e. Pakistan and India. Being a Muslim majority princely state, the people wanted to join Pakistan. However the non-Muslim ruler of Kashmir opted India. The people of Kashmir revolted against this decision which set the stage for the first Kashmir war between Pakistan and India. Since then India has maintained its control over Kashmir by use of force and a heavy presence of Indian security forces. India and Pakistan fought another war on Kashmir in 1965. Despite India’s coercive policies, Kashmiris continued to resist Indian domination. The current uprising in Kashmir is the latest manifestation of Kashmiri revolt against India. Pakistan and India need to hold talks for a peaceful resolution of Kashmir which is also acceptable to the Kashmiris. They do not want to live under Indian rule and want to decide about the future of Kashmir through plebiscite, as promised in the UN resolutions of 1948-49.

Abstract:: The objective of the present study is to explore the levels of health literacy among the rural and urban population of Pakistan and its connection with their subjective wellbeing because promoting health and wellbeing for all have been declared as a sustainable development goal by United Nations. The present study used qualitative methods conducting in-depth interviews with male and female population from two districts of the Punjab to achieve study goals. Findings indicated that a low levels of health literacy prevails in rural areas while the case is little different in Urban areas. Health literacy increases the wellbeing of the people while there are some factors like religious and cultural beliefs of the local community about health which affect the wellbeing of the people even in presence of the good health information. Comprehensive and tailored programs for community mobilization and advancing health literacy are recommended to promote health and wellbeing.

68. Can International Organisations Be Democratic? A Reassessment

Abstract:: This article makes the case for viewing international organisations (IOs) as global polyarchies. Our argument is twofold: on a theoretical level, IOs often meet the criterion of philosophical coherence, as they are based on rules of membership and decision-making that are compatible with those found in democratic institutions. On a practical level, we believe the concerns of IOs about pluralism, inclusiveness and efficacy go far beyond rhetoric, and may decisively influence their activities as well as their outcomes. To this end, the first section explores Robert Dahl’s concept of polyarchy and applies this to global institutions. In the subsequent sections, we advance our empirical argument with the UN as a case study. We reach three main conclusions. The first is that, at the bureaucratic level, the UN Secretariat performs some typically democratic functions, such as multilateral representation and the constitution of international regimes, which turns it into an important channel for feasible democracy in international politics. Second, at the multilateral level, the UN General Assembly (UNGA) represents a specific kind of representative polyarchy by allowing the greatest possible number of countries to have an equal say in global affairs. And third, it also serves as a gateway for multilevelled international representation by including a diversity of non-state actors in what has been called the ‘Third United Nations.’

Abstract:: This paper interrogates to what extent the gender component of the Nationally Determined Contributions (NDC) Support Programme of the United Nations Development Programme (UNDP) reaffirms the post-political condition of climate change. By analysing the incorporation of gender in the NDC Support Programme and its articulation in Colombia’s Low-Carbon Development Strategy, the study exposes the strategic, epistemological, and normative risks of advancing feminist ideas within mainstream institutional frameworks. Thus, this paper shows the opportunities and challenges of dislocating the political and epistemological boundaries of climate change policies by promoting feminist ideas.

Abstract:: As one of Syria’s neighbors, Turkey has become a refuge for more than 3.5 million forced Syrian migrants. Though many of them are living in Turkey’s border cities, in or around the refugee camps, many others have already dispersed to other cities. Among these cities, Istanbul has the largest Syrian community. Drawing on a qualitative field work in Istanbul’s neighborhoods, this study explores the Syrian migration to Istanbul and reports the attitudes towards this movement of the local neighborhood and village headmen, known as muhtars in the Turkish local administrative system. As the study shows, their attitudes towards forced Syrian migrants are paradoxical, marked both by feelings of disturbance, worry and uneasiness, and at the same time welcome and support. The study concludes by discussing historical and cultural reasons for these paradoxical attitudes by relating them to the understanding of hospitality in Turkish society to show how socio-psychological explanations of attitude formation towards Syria’s forced migrants seem more appropriate.

72. TURKISH MEDIA’S RESPONSE TO THE 2015 ‘REFUGEE CRISIS’

Abstract:: In 2015 the forced displacement of Syrians entered a new phase with the sharp rise in the numbers of refugees arriving at Europe’s shores mainly through the Eastern Mediterranean route. Grabbing widespread media and public attention, this unprecedent refugee influx and its surrounding events are commonly dubbed as ‘Europe’s refugee crisis’, which as some scholars highlight, is a ‘re-contextualised’ version of already existing processes of politicisation and mediatisation of immigration. This paper intends to contribute to the debate on ‘mediatisation of refugee crisis’ by giving an insight on the role of Turkish media in telling its readers what to think about the ‘refugee crisis’ during this period of particular significance. The paper relies on a content analysis of front-page articles from three Turkish newspapers (Birgün, Hürriyet and Yeni Akit) between July and November 2015. By limiting our analysis to ‘small data’, we look closely how these newspapers on different sides of the political spectrum react to the spread of the refugee crisis to Europe and its implications on Turkey. We highlight the type of coverage and the definition of issues in this particular media content. Overall, we find that the highly mediatised coverage of the Aylan Kurdi incident triggered a significant discursive shift as it has in other national contexts. While all the three newspapers –regardless of ideological stance– were responsive to the spread of the refugee crisis into Europe, news coverage about topics such as socio-economic vulnerabilities of refugees, issues of legal status and social integration in the domestic context was minimal within our period of analysis. We also assert that the way the three newspapers frame the ‘refugee crisis’ especially in relation to domestic or foreign politics shows significant variation. While we find that issues related to border security and border violations received the most intense coverage during the analysis period, we highlight that the coverage is embedded in a humanitarian narrative rather than a security narrative.

73. Assessment of the #IBelong Campaign Mid-Point and the High-Level Segment on Statelessness

Abstract:: 7 October 2019 marked a critical moment in the #IBelong Campaign to End Statelessness.1 This decade long undertaking, launched in 2014 by the Office of the United Nations High Commissioner for Refugees (‘UNHCR’), reached its mid-point this year. As part of the annual Executive Committee meeting, UNHCR held a High Level Segment on Statelessness to assess the status of the Campaign: achievements and successes in the first five years from 2014–19, and remaining areas to be addressed in the last half of the Campaign from 2019–24.2 In order to concretise efforts to fill any identified gaps, and thereby end statelessness by 2024, participants including states, international and regional organisations, and non-governmental organisations (‘NGOs’) were invited to make concrete, timebound and measurable pledges for action. In a watershed moment for the Campaign, it received over 350 pledges from a scope of actors to take steps that will play a role in ending statelessness by 2024.3Statelessness is a surreal problem for those afflicted by it. Without a nationality in any country, stateless persons are often relegated to the fringes of society. Many stateless people are not able to undertake daily functions necessary for survival, such as having a legitimate job or doing things that require identification and legal status such as marrying, going to school, getting medical treatment, owning property or traveling. Even leaving the house to shop for groceries can result in detention when an individual cannot show who they are, where they come from, or where they belong in legal terms. Abstract:: In light of the United Nations High Commissioner for Refugee’s global #IBELONG Campaign to end statelessness by 2024, this paper examines the benefits of citizenship acquisition among Sri Lanka’s previously stateless Up-Country Tamil population. From 1948 until 2003, the Up-Country Tamil population was stateless and excluded from the Sri Lankan political process, though with the 2003 grant of citizenship Sri Lanka was celebrated as an example of what it means to successfully end statelessness. Using a liberal theory of citizenship extended by the Rancièrian concept of dissensus, and based on qualitative interviews and questionnaire surveys conducted in Sri Lanka between July and August 2016, this paper identifies potential shortcomings of citizenship acquisition that clash with the promise of the #IBELONG Campaign and the narrative of Sri Lanka’s success in ending statelessness: a rural rights deficit and a shared absence of belonging despite the acquisition of citizenship.

Abstract:: A state rarely considers leaving an international organization when negotiating the conditions of its entry. Among such organizations is the United Nations (UN), an institution of obvious global importance. The issue of withdrawal, neglected though it often is (whether deliberately or unintentionally), could however be equally as significant as that of entry. By contrast with the Covenant of the League of Nations, the UN Charter makes no provision for withdrawal. The procedure to be followed should a state request to withdraw is therefore left uncertain. The current study therefore examines three primary instruments: the proposal of the Committee of the San Francisco Conference, the Indonesian example and the inclusion of the relevant provisions of the Vienna Convention on the Law of Treaties. The study aims to determine whether these instruments provide an explicit procedure for withdrawal from the UN. The current study contributes to the Turkish literature by providing insight into this largely ignored topic.

Abstract:: The landmark United Nations Convention on the Rights of the Child (UNCRC) introduced „unique‟ provision of the right to child participation in its Article 12. This Convention, ratified by most states including Pakistan, gives right of participation to children in making decisions on matters related to them and makes it binding for the states to implement it in letter and spirit. The state is responsible for creating enabling environment which includes creation of necessary institutions, enacting or where necessary amending laws, formulating policies and strategies, allocating sufficient budgets, making congenial environment for NGOs and public consultations. This paper argues that state in Pakistan has not been able to sufficiently develop the enabling environment to fulfill the obligations that resulted in the aftermath of ratification UNCRC.

Abstract:: On 8 July 2011, the Security Council established the United Nations Mission in South Sudan (UNMISS) to consolidate peace and security, and to help implement conditions for development. On 15 December 2013, violence broke out in the capital Juba and spread to several other locations, resulting in a countrywide armed conflict. The crisis had disastrous consequences for human rights in many parts of the country, especially in areas of greatest military confrontation. During the hostilities, UNMISS estimates that thousands of people were killed. Both parties to the conflict failed to comply with international humanitarian and human rights law directing attacks on civilians based on their ethnicity. As a result, a large number of Internally Displaced Persons (IDPs) sought refuge in UNMISS bases.

Abstract:: Diversity and Inclusion are terms that are commonplace across various industries, including the hiring practices of corporations and in representation at educational institutions. We see diversity and representation play an important role in the democratic nomination race for the 2020 U.S. presidential election, sometimes mentioned only to gain political advantage. Diversity, in terms of whose story gets told and whose doesn’t, is a theme that is woven throughout a variety of global issues, but often takes a backseat to the bigger news stories that tend to dominate media outlets. Yet, diversity or lack thereof is often implicated upon closer examination of global issues. Climate change, development, violent conflict, terrorism, human rights violations, reform of global governance, and problems of democratic representation throughout the globe are closely tied to issues of diversity. Increasingly, questions of diversity and inclusion present a pathway to solutions to many of these problems. For the 21st volume of the Journal, we wished to showcase and champion diversity and representation in academia by bringing the voices of diverse writers and less familiar topics to our readers. This issue features three articles on indigenous rights. Sheelagh Daniels-Mayes and Kristina Sehlin MacNeil write on the concept of diplomacy, focusing primarily on the lesser recognized diplomacies of First Peoples in Australia and Sweden. Priscila Ribeiro Prado Barros posits that the growing involvement of Indigenous Peoples in Brazil, in the defense of their own affairs, have triggered the emergence of a new organizing logic, which considers rights as more important than territorial authority. Finally, Erica Neeganagwedgin examines the Canadian federal government’s 1969 Statement of the Government on Indian Policy and the recent Indigenous Rights Framework that the Canadian government introduced in 2018. The remaining three articles discuss diversity in employment at the UN, the issue of ethnic diversity in the two Sudans, and how international law affects refugees in the Caribbean. Harold Heredia discusses the importance of diversity at the UN as stated in the organization’s charter in Article 101. Luka Kuol examines the case of the two Sudans to argue that ethnic diversity can become a curse when there is a governance deficit that is manifested in social contracts and systems of government that abhor and detest diversity. Westmin James’ article asserts that both international treaty law and customary international law may appropriately aid constitutional interpretation and can protect asylum seekers or refugees from being repatriated to their home country. Our strong desire to provide a platform for less familiar topics was the driving force behind the creation of this issue. We hope you enjoy this issue and the diverse topics that it touches on.

In addition, the measures are said to contribute to law and order, public safety, the fight against impunity, and to the rule of law. Abstract:: The international community’s confrontation with North Korea reached crisis proportions in 2017, following Pyongyang’s ballistic missile launches and its sixth nuclear test. In the wake of a series of high-level summits, tensions began to thaw in 2018. At the inter-Korean summit in Panmunjom on April 27, 2018, South Korean President Moon Jae-in and North Korean leader Kim Jong-un agreed to seek support from the international community to denuclearize. But the international community, led by the U.S. in concert with the United Nations Security Council, has already worked tirelessly over the past 26 years to coordinate efforts to prevent North Korea from developing nuclear weapons. Successive U.S. administrations have worked through the cycle of confrontation, crisis, discussions and agreements with North Korea. Nonetheless, all these agreements have ultimately fallen apart, allowing North Korea to advance its nuclear program. This paper focuses on two key questions: How has the international community contributed toward denuclearizing the Korean Peninsula, and what is its role in facilitating the complete, verifiable dismantlement of North Korea’s nuclear program? Ultimately, the success of denuclearizing the Korean Peninsula will be measured by whether North Korea completely dismantles its nuclear program. Fortunately, the international “tools” are on the table, but successfully denuclearizing North Korea will, in the end, be a matter of effectively enforcing existing international measures.

Abstract:: The historiography of the one of the most significant events of the “Park Chung-hee Era” has changed little in the past decades. Recent research does not analyze the agency of Park and his fellow coup makers. It has largely been taken for granted that Park was the architect and leader of the May 16th coup that eventually brought him to power. However, in 2015, new interviews with Kim Jong-pil were released that strongly contradicted much of the traditional narrative. Kim, one of the main coup leaders, strongly asserted that he was the mastermind behind the coup, and that he enlisted Park to the cause, not the other way around. By comparing Kim’s new narrative with the primary record, this paper attempts to assess the veracity of his comments that challenge the conventional narrative.

84. The Universal Declaration of Human Rights at Seventy: Progress and Challenges

Abstract:: On December 10, 1948, the United Nations General Assembly passed the Universal Declaration of Human Rights (UDHR), the most significant statement from the global community regarding what constitutes the ideal human life in any society and the rights to which all people are entitled. On the basis of the principles laid out in the UDHR, the international community has since negotiated a large number of human rights treaties and conventions and has developed plans of action in relation to all aspects of living a dignified life. The UDHR is arguably one of the most important documents in the history of human civilization; and to the extent that words on paper can change the world, the impact of the UDHR has been profound. However, despite providing a solid foundation for our collective understanding of the rights to which human beings are endowed, today we are still far from realizing these goals, and threats to the very principles enshrined in the UDHR continue to emerge. The declaration has now endured for seventy years, roughly the global average human life span. Thus, this occasion presents a good opportunity to take stock of what has been achieved, what has yet to be accomplished, and to consider the future longevity of this seminal declaration. As with any interpretation of something as complex as the impact of a document on the world, assessments of the UDHR and its ongoing role are mixed. Many in the field of human rights see a glass half full, characterizing the UDHR as a powerful tool that has dramatically shaped political and economic development throughout the world.1 Others focus on the space that remains empty, emphasizing the flaws that inhibit the realization of the document’s goals.2 Indeed, it must be admitted that, even given the indisputable progress that has been made over seven decades, there are today growing threats to human rights. These threats are the consequence of a number of global developments, including shifting geopolitical balances, extreme economic and social inequality, climate change, and a weakening of democratic institutions. These threats are very real, and it is important that human rights proponents monitor and respond to them. But here I argue that the threat to human rights is ever present. And thus, rather than focus on the advances and setbacks of this particular moment, this anniversary is an opportunity to consider the overall historical progression toward human rights as embodied in the UDHR and the obstacles that stand in the way of its full realization. Taking this broader view, there are two issues in particular that stand out as barriers to be overcome. The first is tied to the Westphalian state system, which has come to dominate human political organization. State sovereignty presents a fundamental challenge to any effort to establish universal norms. Implementing universal human rights will always be tremendously difficult in a system that affords final authority to state leaders who lack the necessary incentives. This is nothing new or surprising, of course, and it is not unique to human rights. But it nonetheless requires a careful consideration of how international declarations make their way from ideas on paper to practice. A declaration is only significant to the extent to which it is adhered. As a document with universal endorsement, the UDHR does indeed have power, and it can shape the behavior of actors who otherwise risk appearing to stand against history and human civilization. It can also be used as a normative weapon, both by citizens and by the international community, to shame hypocrites who violate the principles to which they and every nation in the world have agreed. But it is, nonetheless, just a document, and without correspondingly strong global institutional mechanisms to ensure implementation and compliance, its impact is limited. The second major issue is the way in which human rights ideals have been segmented. The separation of rights into social/economic and civil/political has enabled states to focus on some rights to the neglect of others. Global power shifts, especially under the hegemony of the post–Cold War United States, have led to exaggerated selective emphasis on just some of the rights embedded in the UDHR, when in fact none can be fully realized without a comprehensive approach. Political rights cannot be effectively exercised by those lacking access to basic economic necessities. And those meeting their economic needs may find that their voices as citizens are meaningless in a system characterized by vast inequality or in which national institutions are infected by mechanisms that leave them politically marginalized. Rights must be recognized as interconnected and they must be advanced in tandem. Emphasis on some principles to the exclusion of others undermines the comprehensive advancement of human rights. Thus, the current state of affairs is a product of the collective failure to address human rights holistically and to implement real monitoring and accountability measures for states, which are directly charged with upholding them within their borders.

88. After ISIL: Justice and Protection for Children in Iraq

Abstract:: ISIL recruited children through a variety of means, including abducting children from orphanages and hospitals, or offering to pay parents hundreds of dollars a month in exchange for each child’s attendance at military training. Additionally, child soldiers were often taken from particular ethnic groups or religious communities, such as Yazidis and Christians, as a means to terrorize these groups. Since the territorial collapse of ISIL began in 2017, many of these child soldiers have defected; some fled ISIL territory and are living anonymously in Europe while others returned to their home countries. Debates about how national legal systems should handle these former child soldiers have arisen in all of these jurisdictions. In Iraq, which has dealt with a particularly large number of former ISIL child soldiers, there have been concerns about the national justice system’s capacity to adequately address the prosecution and rehabilitation of ISIL’s former child soldiers.

Abstract:: The international migrant crisis made headlines during summer 2015 and challenged the national asylum systems of many countries worldwide. Going beyond academic circles, hot debates on migrants and the role of asylum highlighted the gap and paradoxes that exist between claimed values of solidarity on the one hand, and the restrictive policies and regulations towards asylum seekers on the other hand. This paper documents this tension in oil and gas exporting states, particularly in the Gulf Cooperation Council (GCC) and the Central Asian Republics (CAR). It questions the claimed regional, ethnic and/or religious ties and the borders that have been closed to most asylum seekers from Syria and Afghanistan, who are presently living in poorer (oil and gas deprived) neighboring countries. This paper argues that in a time of low oil revenues and fiscal difficulties, rentier states give priority to the Raison d’Etat over any form of transnational solidarity and commitment to international human rights agreements and charters. New and creative institutional arrangements are needed to deal with the global refugee crisis, as traditional solidarities are, in both regions as well as in other rentier countries, victims of the modernization of politics and its uncaring redefinition of state interest in times of low oil revenues.

Abstract:: This paper considers the normative framework that support regional cooperative practices in public security based on the activities carried out by UNASUR’s South American Council on Citizen Security, Justice and Coordination of Actions against Transnational Organized Crime. The article discusses differences and similarities between the conceptions of cooperation and public policies, analyzes the documents produced within the Council and presents limitations, obstacles and opportunities identified from the reading of these documents with regard to regional cooperation in public security.

Abstract:: To be successful in today's world, leaders must understand the idea of culture. When the word culture is associated with leadership, many might first think of the culture that leadership creates within the framework of an organization. But for leaders who must operate in a tumultuous world connected by modern media, the word literally refers to the understanding of the people and places where they intend to inject themselves. Where Fools Rush In is a study of the failed U.N. and U.S. interventions to create stability and political reconciliation in Somalia from 1992 to 1995, due to the cultural misunderstanding of U.N. and U.S. leaders that created flawed mission objectives. World leaders must make difficult decisions when intervening in the political and social strife of nations when faced with the reality of human catastrophe and genocide. The questions will always remain as to if, how much, and what kind of intervention must occur. The choices are simple: standby, do nothing and watch, or intervene. What international leaders must understand is that, regardless of the boundaries and governmental systems implanted in former colonial and Cold War territories, the people developed their own systems of social organization and governance that predated European or U.S intrusion. When chaos erupts in these areas and the vestiges of these former systems collapse, the indigenous people more often than not return to their deeply entrenched cultural systems to create stability in these regions. Therefore, it is paramount for intervening parties to fully understand these cultural systems and implications if they hope to achieve any level of success. Ultimately, U.N. and U.S. leaders failed in Somalia because they failed to understand the people and their culture. Rather, they ignored it and viewed the situation from purely an ethnocentric western political perspective.

92. The International Criminal Court and the African Union

Abstract:: There is a diplomatic impasse between the International Criminal Court (ICC) and the African Union (AU) regarding accountability for mass atrocities committed in Africa. The AU accuses the ICC of bias against African rulers, in effect, ‘Africans’, while the ICC insists that as a permanent legal institution, it affords justice to all victims of egregious crimes such as war crimes, crimes against humanity and genocide. And so Africans, victims of these crimes, deserve justice too. Since the indictment of the Sudanese president, Omar al-Bashir, twice for crimes against humanity and then for genocide, the ICC has elicited antipathy from some African rulers and their supporters who perceive it as an adjunct of imperialism encroaching on Africa’s sovereignty. However, sovereignty entails responsibility to protect (R2P). The AU Constitutive Act of 2000 affirms this under the non-indifference principle. It is therefore counter-intuitive to accede to international norms and concurrently invoke ‘absolute sovereignty’ as some African rulers attempt to do. Africa’s conflicts are characterised by mass atrocities owing to weak states that are unable and often unwilling to protect citizens and dispense justice. In some cases these states are themselves perpetrators of heinous crimes, which necessitates intervention by the international community. Historically, realpolitik, self-preservation and geopolitics have marred international criminal justice, and Africa’s relationship with the West is steeped in humiliation making some African rulers suspicious of Western-dominated institutions. The perception that the ICC dispenses lopsided justice stems from this history. This paper argues that the choice between justice and peace is a false one since the two mutually reinforce each other, while impunity, if not checked, portends instability in Africa.

Abstract:: When United Nations Secretary-General António Guterres took up his post in December 2016, he observed that “conflicts have become more complex and interlinked than ever before”.1 The increase in complexity that Guterres refers to stems in part from a proliferation in the range of national and transnational stakeholders and interests that affect peace processes. We are now concerned with, for instance, the roles that governance, corruption, organised crime, increasingly fragmented opposition movements, violent extremism, the environment, gender, youth and natural resource management play in contributing to – or hindering – conflict resolution. The proliferation of actors and threats stretches the limits of traditional state and multilateral mediation processes. The challenge of navigating complex stakeholder landscapes is compounded by dynamic, interconnected and unpredictable local to global societal processes. Digital interconnectivity allows people to mobilise in ways that was not possible just a few years ago. The more the world is globalised, the more changes one factor can have in unpredictable and unintended political, economic, migration or conflict consequences elsewhere. The consequence of increasing complexity for peacemakers is that there are more variables that can affect peace processes, less stability in the behaviour of these variables, and less predictability when it comes to how peace and conflict processes are likely to unfold. Complexity therefore renders rigid adherence to analysis, plans and structures ineffective and potentially harmful. In the Democratic Republic of the Congo (DRC), for instance, Eriksen has argued that the state-building project of external actors has failed, in part, because their designs have been based on fixed, non-negotiable conceptions of what the state should eventually look like, without due regard to the complex and evolving interests and relations between domestic powers.2

94. Shoring Up a Democracy Under Siege

Abstract:: The US is experiencing an unprecedented erosion of democratic institutions and norms under the Trump administration. While constitutional checks and balances are holding for now, we are seeing the kinds of challenges that have presaged a shift toward authoritarianism in other countries. If not countered, this kind of “constitutional regression” can develop into something that looks like a more lasting authoritarian condition, with institutions that are so hollowed out as to be ineffective, and with impact that outlives the Trump administration. Since November 2016, American civil society’s reform sector has adjusted, adapted, and innovated to meet these challenges. To facilitate their success, the philanthropic sector must likewise adapt. The Open Society Foundations (OSF) are a global philanthropy whose mission is to foster open societies in place of authoritarian ones.[i] Our founder, George Soros, was born in Hungary and lived through the Nazi occupation of 1944 to 1945, which resulted in the murder of over 500,000 Hungarian Jews. In 1947, as Communists consolidated power in Hungary, Mr. Soros left for London where, ultimately, he studied philosophy with Karl Popper, author of The Open Society and Its Discontents, at The London School of Economics and Political Science. In 1956, he emigrated to the US, where he worked in the worlds of finance and investment. He has used the fortune he amassed to support philanthropy that reflects Popper’s philosophy—that no ideology is the final arbiter of truth, and societies can only flourish when they allow for democratic governance, freedom of expression, and respect for individual rights.[ii] Mr. Soros began his philanthropy in 1979, giving scholarships to black South Africans under apartheid who might lead their country out of closed and authoritarian conditions, and into ones governed by democratic principles, respect for the rule of law, protection of the rights of minorities, and civil and political liberties. In the 1980s, he applied the same principles to help promote the open exchange of ideas in Communist Hungary, and across Eastern and Central Europe after the fall of the Berlin Wall. While the Foundations started as an effort to help those in countries emerging from more closed or authoritarian conditions, in 1996, OSF launched its first US-based programs; as Mr. Soros wrote in 2006, “America was an essentially open society [but] even open societies are open to improvement.” Since then, OSF and leaders of civil society have worked to protect democratic society and its institutions in the US and in over 140 countries around the world. At OSF, our guiding principle is that the world is imperfect, but that what is imperfect can be improved. With that comes a commitment to examining our own role in the world, a constant questioning as to whether our philanthropy—what we fund, and how we fund it—is responsive to the most pressing issues facing the world as it really is, and not as we perceive it to be. Still, even though we have spent the last two decades supporting U.S.-based efforts to counter what we view as threats to the American democratic project (e.g. the influence of big, secret money on politics, restrictions on the right to vote, the criminalization of poverty, racial disparities in the criminal justice system, a bipartisan tendency toward government secrecy), to date, we viewed that work as part of a project to ensure that a largely sound framework was improved so that it lived up to its promise. As we reflect on conditions a year after President Donald Trump’s election, however, we think that the US is experiencing an unprecedented erosion and hollowing out of democratic institutions and norms, and could be derailed from this course of improvement. This prompts us to consider how OSF might work differently in order to allow our civil society grantee institutions to more assiduously protect against further decline. Together, these shifts in civil society and philanthropy could erect the bulwark needed to counter both the threat of constitutional regression and the more remote risk of a total constitutional breakdown. These reforms are significantly informed by rights organizations and foundations operating in other countries that are contending with threats to democratic government.

95. Proposals for the Negotiation Process on the United Nations Global Compact for Migration

Abstract:: On September 19th, 2016, the United Nations (UN) General Assembly adopted Resolution 71/1, the text of the New York Declaration for Refugees and Migrants(the “New York Declaration”). Resolution 71/1 is the outcome document of the high-level plenary meeting on addressing large movements of refugees and migrants, held at the UN headquarters. The New York Declaration reflects how UN member states have decided to address the challenge of large movements of people in two main legal categories: asylum seekers/refugees and migrants. Resolution 71/1 includes an annex titled “Towards a Global Compact for Safe, Orderly and Regular Migration” (the “global compact for migration” or “global compact”). This document is comprised of several thematic issues related to international migration that will be the basis of a globally negotiated agreement on how member states should respond to international migration at the national, regional, and international levels, as well as to issues related to international migration and development. The global compact for migration is intended to be adopted at a conference on international migration and development before the inauguration of the 73rd annual session of the UN General Assembly in September 2018. This paper addresses how UN member states should plan to address international migration in the future. It does not refer to refugees and asylum seekers: a global compact on refugees will be drafted by the United Nations High Commissioner for Refugees (UNHCR) in 2018, and to be presented to the UN General Assembly for states’ consideration during its 73rd annual session, which starts in September 2018.[1] For those who have been involved in migration issues within the United Nations, the fact that member states have finally agreed to convene an international conference on international migration represents a major achievement. It is the result of an extended process that started decades ago and was made possible by a long chain of efforts by many state delegations and other stakeholders. The global compact for migration will not be the first outcome document dealing exclusively with international migration. A declaration[2] adopted at a high-level meeting at the United Nations in October 2013, for example, paved the way for the 2018 conference. Nonetheless, the global compact represents a unique opportunity to address international migration comprehensively and humanely. This paper contributes to the discussion on the elements that should be included in the global compact for migration. The paper is divided into two sections. The first section analyzes the main elements of Annex II, “Towards a Global Compact for Safe, Orderly and Regular Migration,” and the criteria that needs to be adopted in order to achieve a substantive outcome. In particular, participants in the negotiation process should aim to balance the concerns of states and the members of host societies, on one hand, with the needs and rights of migrants, on the other. The second section includes proposals to enrich the final global compact for migration and takes into account two documents written by two different actors within the UN system, the Special Representative of the Secretary-General on Migration, and the Special Rapporteur on the Human Rights of Migrants. In particular, the paper proposes that the global compact for migration: sets forth principles that can inform the actions of governments in relation to international migration at all levels; enunciates a clearer definition of state protection responsibilities in relation to migrants in crisis situations and so-called “mixed flows” [3]; affords a substantive role to civil society organizations, the private sector, and academic institutions in the global compact’s follow-up and review process; defines the institutional framework for the implementation and follow-up of the global compact within the United Nations, including through the work of the UN High-level Political Forum on Sustainable Development (HLPF); establishes a mechanism to fund migration policies for states that lack enough resources to invest sufficiently in this task; and builds a cooperation-oriented, peer-review mechanism to review migration policies. The paper has been conceived as an input for those who will take part in the negotiation of the global compact for migration, as well as those who will closely follow those negotiations. Thus, the paper assumes a level of knowledge on how international migration has been addressed within the United Nations during the last several years and of the complexities of these negotiation processes. The author took part in different UN negotiation processes on international migration from 2004 to 2013. The paper is primarily based on this experience.[4]

96. Strengthening the Global Refugee Protection System: Recommendations for the Global Compact on Refugees

Abstract:: On September 19, 2016, the United Nations (UN) General Assembly adopted the New York Declaration for Refugees and Migrants. This document launched a two-year process to develop a Global Compact on Responsibility Sharing on Refugees (“Global Compact on Refugees”) and a Global Compact for Safe, Orderly, and Regular Migration. With a record 65 million displaced persons in the world, the global community must come together to fashion a stronger protection regime for persons on the move. This paper outlines broad themes and specific recommendations that the Global Compact on Refugees should adopt on how to strengthen the global refugee protection system. The recommendations fall into several categories: (1) responsibility sharing for the protection of refugees; (2) filling in protection gaps; (3) balancing and replacing deterrence strategies with protection solutions; (4) refugee resettlement; and (5) building refugee self-sufficiency. Some of the key recommendations include: the development of a responsibility-sharing formula to respond to large movements of refugees; the development of an early warning system to identify and respond to nations in crisis; the adoption of principles included in the Nansen and Migrants in Countries of Crisis initiatives; the use of temporary protection measures to protect populations that flee natural disaster; the adoption of model processes that ensure safe and voluntary return; cooperation between destination and transit countries to expand refugee protections; the provision of asylum and due process protections at borders; the use of development assistance to ensure the self-sufficiency of refugees; the adoption of a goal to resettle 10 percent of the global refugee population each year; the establishment of a refugee matching system between refugees and resettlement countries; and the adoption of coherent strategies, involving all sectors, to address large movements of refugees. This paper draws heavily, albeit not exclusively, from a series of papers published as a special collection in the Journal on Migration and Human Security[1] on strengthening the global system of refugee protection.

97. The United Nations Development Programme and the Two Koreas

Abstract:: This paper examines the United Nations Development Programme’s role in South and North Korea’s economic development. The UNDP is not only the UN’s lead agency for economic and social development, it is one of the few UN organizations to have worked with both countries in traditional bilateral arrangements, as well as a in multilateral initiative. Operating in South Korea from 1963 to 2009, the UNDP contributed to the nation’s economic development by complimenting the government’s policies. However, its role was minor compared to the government’s own actions. Nonetheless, South Korea has served on the UNDP board four times since its UN admission in 1991, raising the country’s diplomatic standing. After North Korea joined the UNDP in 1979, the organization’s work in the country focused on improving food production and supporting industrial development. These activities helped improve the economic crisis since the 1990s. In the 1990s, the UNDP provided humanitarian assistance and scholarships to develop human resources. Pyongyang officials restricted the UNDP’s work throughout the time it was active in North Korea. These violations led the UNDP to suspend operations in 2007. Since the early 1990s, the UNDP has supported the Tumen River Area Development Program, the only initiative that involved the two Koreas, as well as China, Russia and Mongolia. Although the UNDP facilitated initial contacts, it was unable to overcome longstanding animosities and disagreements. The successor Greater Tumen Initiative continues to languish.

98. The United Nations Command and the Sending States

Abstract:: The United Nations Command is the oldest and most distinguished of the four theater-level commands in the Republic of Korea. Authorized by the nascent United Nations Security Council, established by the United States Government, and initially commanded by General of the Army Douglas MacArthur, the United Nations Command had over 930,000 servicemen and women at the time the Armistice Agreement was signed. Sixteen UN member states sent combat forces and five provided humanitarian assistance to support the Republic of Korea in repelling North Korea’s attack. Over time, other commands and organizations assumed responsibilities from the United Nations Command, to include the defense of the Republic of Korea. The North Korean government has frequently demanded the command’s dissolution, and many within the United Nations question whether the command is a relic of the Cold War. This paper examines the United Nations Command, reviewing the establishment of the command and its subordinate organizations. The next section describes the changes that occurred as a result of the establishment of the Combined Forces Command in 1978, as well as the implications of removing South Korean troops from the United Nations Command’s operational control in 1994. The paper concludes with an overview of recent efforts to revitalize the United Nations Command, with a focus on the command’s relationship with the Sending States.

99. UN Humanitarian Actors and North Korea’s Prison Camps

Abstract:: When a typhoon struck North Korea’s northeast in September 2016, it flooded not only schools, health clinics, roads and agricultural lands, but also a reeducation through labor camp housing political prisoners. This presented a challenge to United Nations humanitarian agencies: should they overlook the plight of those in the flooded camp in the interests of working cooperatively with the government, or should they seek to gain entry to all disaster victims in line with the UN’s humanitarian principles? Their decision to ignore the imprisoned victims highlights the need for better integration of human rights concerns into humanitarian action through strengthened cooperation between human rights and humanitarian actors, backup from senior UN officials, and the application of the UN Human Rights Up Front approach to North Korea.

100. Back to the Basics of Growth and Diplomacy: Four Questions to Answer

Abstract:: If American diplomacy is not to be about freedom and democracy, let it be about economic freedom and growth. And let the United States once again lead by example. In September 2017, U.S. President Donald Trump took to the world stage, addressing the United Nations General Assembly for his first time. It was also a week in which the United States marked the 230th anniversary of the U.S. Constitution—a document that continues to serve as an example for nations around the world. Trump began with words of appreciation to leaders of nations who had offered assistance and aid to the United States following hurricanes that had struck Texas and Florida. The U.S. president then continued with a few sentences about the state of the American economy. “The stock market is at an all-time high, a record,” he said. “Unemployment is at its lowest level in 16 years, and because of our regulatory and other reforms, we have more people working in the United States today than ever before.” “Companies are moving back, creating job growth,” he added. Skeptics were plentiful on the cable television shows. But those would not be the words that captured global headlines and that would overtake social media posts around the world. Instead, it was Trump’s far-from-diplomatic language calling out the threat posed by North Korea, as well as the U.S. leader’s focus in part on Iran, Cuba and Venezuela, that dominated the news cycle and sent pundits—and some ambassadors—into a frenzy.
