Abstract:: This year marks the 30th anniversary of the Paris Peace Agreement on Cambodia. That accord closed the door on years of war, during which the Khmer Rouge “Killing Fields” caused the deaths of up to two million persons (out of a population of seven million) and brought the 1,000-year- old civilization to the point of obliteration. When I landed in Phnom Penh in 1996 to begin my term as U.S. Ambassador, the country was in the fifth year of implementing that 1991 agreement. Looking back on this improbable diplomatic success offers a chance to assess the effectiveness of American diplomacy in the 1990s, and how, despite one extremely unfortunate regression, Indochina and Southeast Asia were irrevocably changed by that accord.

Abstract:: Colin Powell touched our national life and our personal lives in more ways than we realized during his time with us. His passing has brought into sharp focus the difference between the America he believed in and the America we face today. The son of immigrants, his drive to overcome, his respect for all who labor, his belief in the power of the community, and his ability to see what mattered all made him who he was and made us believe in what he believed. The odd thing was that we all thought that world was not only the normal world but also the world that would remain normal—because we lived in America, because we were Americans, because we believed we had a national destiny that was still unfulfilled, that our country was a force for good on the planet and that Americans would always strive to keep it so. The legacy first framed by our Founding Fathers and brought into being over succeeding generations was the vision we inhabited and believed.

Abstract:: There’s no question that this program’s theme, what diplomacy does for Americans, is on the front of everyone’s minds especially given the current challenges in Afghanistan and the fast-paced events around the world. In recent weeks in Afghanistan, our diplomats have been on the front lines working overtime to orchestrate the safe evacuation of Americans and many of our closest Afghan partners. Even though the last American soldier has left Afghanistan, America’s diplomats are still working around the clock in capitals around the world to bring people to safety. I believe we have an obligation to ensure the safety and help those Afghans who for years have worked closely in support of our common mission. Our nation’s diplomats display extraordinary courage each and every day, often putting themselves in harm’s way for the rest of us.

11704. Multilateral Training and Work at Foreign Ministries

Abstract:: Editor’s note: The author was India’s Permanent Representative to the UN Environment Program and to UN Habitat at Nairobi, 1984-86. In foreign ministries, as in all organizations, training has risen to the top of the institutional agenda.[1] ‘Life-long training’ has taken root. In the past, most foreign ministries believed that diplomats needed training on entering the profession, and thereafter learnt on the job. In the past 20 years, at least 30 foreign ministries have established training institutes, including the British Foreign, Commonwealth and Development Office, which had managed without one for over two centuries.[2] Thanks to increased work demands (new issues on the international agenda, the range of official and non-official partners involved, and concepts like public and diaspora diplomacy), the pace of work, especially multilateral, is more frenetic, complexified. Another question comes up: is multilateral work a speciality, or is it just a different diplomatic setting, compared with work in a bilateral embassy or consulate? For most countries, around 85 to 90% out of the diplomatic staff based abroad (as distinct from those in the foreign ministry), engage in bilateral work, also working in embassies and consulates, i.e. handling relations with individual foreign states. The balance are to be found in ‘multilateral missions’, accredited to international or regional organisations. But this is an oversimplification. At around 20 capitals, find the headquarters of multilateral and regional organizations, and the diplomatic missions at such places double as permanent missions accredited to that entity; examples: Addis Ababa (AU), Brussels (EU, NATO), Jakarta (ASEAN), Manilla (ADB), Nairobi (UNEP, Habitat) Paris (OECD, UNESCO), Rome (FAO), Vienna (IAEA, UNIDO). At the headquarters, multilateral and regional affairs may occupy around 10 to 15%. In this essay, we will subsume regional work with multilateral affairs. Other questions come up. How should diplomats be trained for multilateral work? Who should be selected for this work? What are the contemporary trends? We look also at senior management at the US State Department, and professionalization, related to multilateral work. These issues are interconnected.

Abstract:: Editor’s note: The author was the Indian Ambassador to the UN 2013-2015. Calls for “reformed multilateralism”[1] at the UN’s 75th anniversary session in September 2020 stressed the need for equal participation by member-states in UN decision-making. Five years earlier, when adopting Agenda 2030, the United Nations General Assembly (UNGA) acknowledged the inter-linkage between peace, security, and development.[2] With its universal scope, Agenda 2030 on Sustainable Development has become the central focus of the United Nations (UN) for the foreseeable future. Agenda 2030 requires a paradigm shift in the approach of UN member-states to global issues and underscores the imperative for an inclusive human-centric approach through the participation of multiple stakeholders in UN activities. This would enable the UN to pool resources through partnerships to meet the major challenges in all its three “pillars” – political, human rights, and socio-economic development.

Abstract:: Editor’s note: The author was Executive Director of the United Nations World Food Programme 1992-2002 and United Nations Under Secretary General for Management 2003-2005. President Biden’s nomination of Ambassador Linda Thomas-Greenfield as US Ambassador to the United Nations promises to bring effective leadership, professionalism, and immense knowledge to the role. She is one of only a few American diplomats who have had leadership postings dealing with important UN operations at every level—in countries where she served as a foreign service officer, in Geneva, and in Washington DC. In New York, the ambassador will need to summon all her skills and experience to lead the American team at the US mission to the UN. Along with the USUN ambassador and the Secretary of State, US multilateral efforts are led by the Assistant Secretaries of the Bureau of International Organizations and the Bureau of Population, Refugees and Migration and the Permanent Representatives to the UN in Geneva, Rome, Vienna, and Nairobi. The president should nominate people for these positions who have in-depth knowledge of the system and related issues, solid judgment, and strong interpersonal skills. The diplomats must be strategic, prepared, creative, goal oriented, and personally engaging. Process oriented micro-managers will not accomplish much.

Abstract:: Editor’s note: The author served as UK Ambassador to the UN 1998-2003. The UN, with its network of institutions and agencies, is the only truly global organisation. It is a great experiment, not in global governance, because the political direction of the UN lies firmly in the hands of sovereign nations, but in providing both norms and tools for managing the international arena 1. Its system is flawed and may well be unimprovable. But what it tries to do, and does, is indispensable for the avoidance of catastrophic war and for the development of a sustainable world. The UN as an institution is also, not unlike the American Constitution, an adversary of raw power. Born in an era of war and empire, its charter and principles provide shelter and help for weaker nations, and set limitations on the capacity of the strongest countries to throw their weight around selfishly—the generator of empires and wars. It came into being at the instigation of the great powers, and so they know —or they used to know—what they were creating and why. The United States was at the centre of it, seeing it as a great step towards the ending of the era of imperialism. The UN is not just about what happens in the Security Council. The work of the Secretariat, the funds, agencies and programmes, and indeed of several of the intergovernmental institutions such as ECOSOC, is primarily dedicated to every aspect of international development. They act on the premise that if a large part of the world is racked by poverty and disease, the more fortunate part will not have a stable environment in which to enjoy their relative success. The history of regional conflict over the last 75 years bears this out. As the UK’s Permanent Representative between 1998 and 2003, with a permanent place on the Security Council, I made a point of setting my inevitable focus on the Council’s work in the context of this wider UN purpose. The maintenance of international peace and security is an essential component of sustainable development, not just an end in itself.

Abstract:: Editor’s note: The author was U.S. Ambassador to the UN 1989-1992. Franklin Roosevelt knew a good thing when he saw it. In 1943, in the midst of a military campaign for American survival in the Pacific and clawing our way back against Nazi Germany in the Atlantic, Roosevelt put bright people to work to shape what would come next. International cooperation under the League of Nations had twice failed – the U.S. resolved to stay out and the League’s weakness led to World War II. To fix it, Roosevelt took the name for the victory coalition of that great crusade – the United Nations – and fashioned an international organization to promote peace and prosperity through cooperation. Isolationist opposition in the U.S. endured, but many leaders of both parties had the vision and perspicacity to know that friends and allies working together made sense in achieving both objectives. Failure dogged the pursuit, but in Korea, the Gulf, Afghanistan, and the Balkans the organization made a real difference in war and peace. Americans have now been through four years of disdain and disparagement about the United Nations and the Trump administration’s failure to understand or make good use of it. Chinese and Russian opposition did not help. The Biden team comes to power with the challenge – how can we use more effectively Roosevelt’s vision to promote peace and prosperity on the planet?

11709. Cold War Conflicts over a Khmer Temple

Abstract:: Judges at the International Court of Justice in the Hague typically rule on dry and technical issues such as rights of passage through foreign air space or obligations under international conventions. But in October 1959, they were asked to determine ownership of a ruined, thousand-year-old stone temple standing on the windy summit of a cliff in Southeast Asia. The case known as Temple of Preah Vihear (Cambodia v. Thailand) transfixed the two countries during the three years of litigation that followed but also drew close attention from the region’s American diplomats. While declaring themselves neutral in the dispute, the Americans were eager to see it resolved. To them it was a troublesome distraction from the main job in the region, shoring up South Vietnam, where an insurgency that would become the Vietnam War was already underway. American claims of neutrality faced an awkward complication a year into the proceedings. One of the biggest living names in American diplomacy, former Secretary of State Dean Acheson, signed on as hired counsel for Cambodia. His presence in the court’s ornate hearing hall in the Hague led many people to conclude that the U.S. was backing Cambodia.

11710. How Do We Talk to Foreign Audiences After Trump’s Subversion?

Abstract:: When I was the U.S. Embassy press officer in Kyiv, Ukraine in the late 1990s, the public affairs section sponsored programs showcasing and explaining American democracy in the post-Soviet republic. One major event I organized was a public symposium entitled “Holding Elections in a Free Society”. We featured American government and academic experts on topics such as how to maintain a level playing field among competing political parties, registering to vote, ensuring fairness in the counting of ballots, election monitoring, equal access to the media, and similar features of our electoral system. The implicit message, of course, is that our election system is worthy of emulation. But our experience in last November’s presidential election, and the groundless objections about its integrity and result raised by President Donald Trump, culminating in a pro-Trump mob’s attack on the U.S. Capitol on January 6, did not resemble the exemplary depiction in my symposium. How could American diplomats justify holding such programs today, after the president himself condemned our Federal elections as rigged and massively fraudulent, our national government as corrupt, federal bureaucrats as members in a disloyal or self-serving Deep State, and the federal and state courts as biased institutions? The world has noted the deterioration in America’s democratic culture. In the 2019 Index of Democracy published by the Economist Intelligence Unit, the rating of the U.S. on its democracy scale fell from 8.05 in 2015 to 7.96 in 2019 (with 10 as the top score), dropping it further into the “flawed democracy” from the “full democracy” category. The U.S. now ranks 25th of 167 countries rated. American diplomats might be shocked to learn that the Economist team now grades U.S. democracy lower than Mauritius, Chile, and Uruguay according to its measures of features such as the electoral process and pluralism, and the functioning of government.

11711. Can the U.S. Still Be an Example to the World?

Abstract:: Between January 6 and January 20, disbelieving viewers in America and throughout the world watched two weeks of American history, unlike any before, cascade across their TV screens like a 33vinyl record played at 78 RPMs. Cameras recorded the dizzying transformation of the Capitol from take-for-granted placidity, to unimaginable desecration, and finally to a stage festooned to welcome the inauguration of a new president. Foreign Service friends and colleagues in Washington, DC and abroad wondered what the world would take away from these images. We had often encountered military and armed police patrolling cities in other countries—but never in OUR capital. A Department of Justice colleague worried that our work abroad, such as justice system reform in countries from Colombia to Afghanistan, might now be at risk. After witnessing the January 6 events on Capitol Hill, would our overseas partners embrace us with as much confidence? The Constitution and citizen participation in a democracy played a large role in my career abroad as a public diplomacy foreign service officer with the State Department. In the years after the Berlin Wall and Iron Curtain fell, supported by the FAS (Freedom Support Act) and SEED (Support for East European Democracy) Congressional appropriations, helping the people of Central Europe and the former Soviet Union construct, or reconstruct, democratic institutions and practice was an important focus for our embassies in East and Central Europe. These programs were broadly welcomed by our host countries.

Abstract:: Moving the bureaucracy is akin to Sisyphus: forever pushing the rock up the hill only to have it roll back. However, with a renewed interest in making diplomacy and the State Department more effective and equitable, the New Year brings a plethora of reports and recommendations to align the oldest and premier United States agency into an institution prepared to meet contemporary challenges. Four of the most prominent reports comes from the American Academy of Diplomacy, the Association of Black American Ambassadors (ABAA), the Belfer Center at Harvard, and the Council on Foreign Relations. The brain trusts of these groups are lifelong diplomats, foreign affairs think tanks, State Department affinity groups, and universities. All put forward overlapping themes: high level responsibility to improve diversity, extensive training and education, and commitment to strengthen State’s relationship with Congress to significantly increase resources.

More than 40 million people reside in this marginal arid geographic area, mostly pursuing subsistence agricultural and pastoral livelihoods. Abstract:: Within hours of being sworn in, President Joe Biden put the United States on track to rejoin the Paris Climate Accord and the World Health Organization. A week later, he signed a new START Accord with Russian President Vladimir Putin, extending the nuclear missile nonproliferation treaty for another five years. These actions—along with many others—were important messages to a world that had grown accustomed to seeing America walk away from treaties. Why would Biden prioritize the international community? Americans are far more concerned about the pandemic, the events of January 6, the faltering economy, and scores of pressing domestic issues. Clearly, the early attention was a chance to give substance to his inaugural promise that “we will repair our alliances and engage with the world once again.” Biden underscored the change of focus in a speech to the State Department in which his now-familiar line, “diplomacy is back,” has become a rallying cry for a crowd eager to resume the day-to-day operations that underpin diplomacy. They can now proceed with the confidence that their work will be valued by the boss.

Abstract:: Given their life experiences, People of Color (POC) and women already possess many of the skills to succeed in diplomacy. These include cross cultural communications, linguistic competence and acceptance of practices absent from life in the United States and Western countries. From childhood, People of Color and women often learn “to fit” into concepts of appropriate attire, hairstyles and even speech, an experience akin to what diplomats face as they encounter new cultures. Male colleagues often dismiss their statements in meetings. Or, later take credit for their ideas and may perceive efforts to reinforce contributions as demonstrating the individual as being “difficult” or “overbearing”, which leaves often good ideas by the wayside in negotiations.

11718. VOA – A Biased, Sentimental Recollection

Abstract:: Editor’s note: Created in 1942 as a U.S. government broadcasting effort to combat Nazi propaganda, VOA is now part of the U.S. Agency for Global Media. VOA provides news, information, and cultural programming to worldwide audiences in more than 40 languages. Throughout the barrage of news over the past year —the pandemic, the presidential election and transition, race relations, climate change, environmental disasters —the Voice of America also made headlines. While multiple reports of outside interference may not have commanded the attention of the general public, they always interested me, partly because of the potential damage to VOA’s well-deserved reputation for objectivity but also because of the soft spot I have in my heart for the institution. My first-ever Washington DC job was in 1964 as a 23-year old summer intern at the Voice of America. I had spent the previous summer as a volunteer (Operation Crossroads Africa) in Nigeria; I had quite a bit of journalism experience and I fit in well as a news writer on the Africa desk, a small cadre of individuals who would pull copy off wire service tickers and other sources and adapt it for broadcasts to Africa.

Abstract:: As a newly minted vice consul at Embassy Islamabad, I interviewed high-ranking generals, scholars, and artists as well as those from the other end of the spectrum—the peasant with no English planning a marketing survey for local sandals in the USA, the convicted rapist who wanted a refusal in order to avoid a court summons, the oily types with no bank statements and dollops of gold nestling on their chest-fur. The cool mendacity of some applicants took the breath away. But it was the multifaceted complexity of fraudulent efforts to gain undeserved benefits via fiddled documents that fascinated us most. One of the most fascinating was the case of a drug-smuggler who claimed to have been born in Montana to a Sierra Leonean mother.

Abstract:: Sometimes a Christmas tree is more than just a decorated evergreen. In connection with Christmas 1994, the last Yule celebration in Bucharest for me and my wife Gerd before our transfer back to Washington at the completion of our tour, we hosted a large holiday party for many of our Romanian friends. The lovely Deputy Chief of Mission (DCM) residence on Strada Pangratti was richly decorated for the season. The focal point was the large Christmas tree standing in the living room next to the staircase leading to the second floor. The tree was well over twenty feet tall and beautifully trimmed, with electric lights and decorations from the United States, my wife’s native Sweden, Romania, and other countries where we had served. For us it was a delight to behold as it and the decorations held so many associations with family and Christmases past. Our guests all seemed to enjoy themselves, eagerly sampling the generous selection of seasonal goodies on offer, and we were pleased to have the opportunity to share our holiday with them. One guest even brought with him a group of a cappella singers, who enriched the festive atmosphere with lovely traditional Romanian colinde, or Christmas carols.

11721. Mongolia’s Emergence

Abstract:: I had long been curious about Mongolia, a lightly populated country twice the size of Texas, which under Genghis Khan and his successors produced, in the 13th century CE, the largest contiguous land empire the world has ever known—9 million square miles. For much of the 20th century people spoke of Outer and Inner Mongolia. The Inner was firmly under Chinese control. The Outer claimed independence but was in fact the first Soviet satellite state, the Red Army having expelled Chinese troops in the early 1920s. The country was almost totally isolated from the rest of the world. In 1939, Japanese forces advanced into Mongolia from China and were pushed back by Soviet forces, in battles that involved tens of thousands of troops but went almost totally unreported in the West. After World War II, Communist China sent twenty thousand or more “guest workers” into Mongolia. It was a prelude to colonization, as China had brought about in Inner Mongolia and would do later in Tibet and Xinjiang. The Soviets did not want a new Chinese state on their border. They and the Mongols managed to get the guest workers sent home. What I knew about the past of Mongolia, Tibet, and Xinjiang came mainly from reading the work of three great explorers and travelers: Sven Hedin, Sir Aurel Stein, and the American diplomat William Woodville Rockhill, who once crossed Tibet on foot. (Henry Adams said that meeting with Rockhill was like having dinner with Genghis Khan.)

Abstract:: While studying Chinese in Taiwan in preparation for assignment at the U.S. Embassy in Beijing, I gave birth to baby William, our first child. Along the way, I learned a fair amount about Chinese birthing beliefs; our teachers at the Foreign Service Language School were happy to talk about the importance of fetal education and how my studying Chinese while pregnant would benefit the baby. A few days before my due date, my husband David dreamed I gave birth to a koala. David’s shock over having a furry animal for a son was compensated by the thrill of hearing the newborn utter a Chinese phrase. We had, after all, spent the previous two years struggling to master tones and characters. Not to mention that the little koala’s question of “gànmá” (干吗) or “whatever for?” seemed right on the money.

11723. Military Crackdown in Burma and the Massacres of 8/8/88

Abstract:: The February military take-over in Burma called to mind the tragic events of 1988, while I was serving as press attaché at U.S. Embassy Rangoon. During August and September that year, massive pro-democracy demonstrations resulted in the massacre of several thousand Burmese citizens at the hands of the brutal military regime. Previous attempts to throw off the shackles of totalitarianism, usually led by students, had taken place in 1962, when ruling General Ne Win’s police killed several hundred students at the University of Rangoon and dynamited the historic Students’ Union Building, and again in 1974, when the regime shot down several hundred students who marched in support of a general strike, arrested thousands, closed down schools and universities, and declared martial law. In 1988, there had been no major uprisings for 14 years, but astrologers were predicting that dire events would happen on the magical date of 8/8/88—the four eights of August 8, 1988. At the embassy, we knew things were coming to a boil. There were widespread reports of students being beaten, raped and killed in the notorious Insein Prison north of Rangoon. In the ethnic minority areas, rape, beatings, looting, and the burning down of villages were commonplace wherever the Burmese army operated. The country’s economy was in a shambles. In September of 1987 the regime suddenly and without explanation demonetized all 25, 35, and 75 kyat notes (whose strange denominations were established in a previous demonetization), so that people holding cash were wiped out; 80 percent of the money in circulation became worthless. Hundreds of enraged students stormed out of the prestigious Rangoon Institute of Technology, smashed traffic lights, and burned vehicles. The regime’s inevitable response was to close schools and universities.

Abstract:: During my foreign service tour in Moscow 1966-1968, embassy security regulations prohibited employees from traveling alone within the Soviet Union. We were warned that we risked being targeted by the KGB, whose operatives might attempt to compromise us in any number of ways. Among those often needing a travel companion to comply with this regulation were the embassy’s Publications Procurement Officers (PPOs), who traveled extensively within the country buying all sorts of books and other publications for various U.S. government organizations. And that is how I came to be invited to join PPO Bill Pryce on a book-buying trip to Ufa and Kazan in early December 1966.

11725. Memories of the U.S. Legation in Budapest 1945-47

Abstract:: Editor’s note: The author lived in Budapest in the immediate post-war period while his father, H.F. Arthur Schoenfeld, was U.S. Minister to Hungary 1945-47. As an eight-year-old, he experienced the pervasive Russian military presence in the heavily damaged city. The house the family lived in has been the residence of U.S. ambassadors ever since. These excerpts from his unpublished memoir of the early days of the U.S. Legation have been edited for length. We arrived just days after hostilities ended in Hungary and less than three months after the Soviets’ long winter siege of Budapest, which damaged or destroyed almost every building in the city. Surprisingly, the house did not seem in bad condition when we moved in. In my bedroom, the occupying Russian troops had lit a fire in the washbasin to warm themselves. This had heavily scorched the wall and blackened the ceiling. Some of the large classical paintings that hung in the downstairs rooms had been bayoneted. The Russians had driven hooks in the dining room walls to tether their horses, but that was pretty much the worst of it. Outside was a different story. The house was situated near the route of the main Soviet military thrust into the city in the last days of the siege. Two German soldiers were buried in shallow graves on the hillside just a few yards behind the house. In the garden field below and in front of the house were the graves of twelve Russian soldiers killed in the fight. We were told that the bodies had been wrapped in the house curtains and stacked for two or three days in the lower entry hall of the house awaiting burial. Above the driveway was a large cave hollowed out of the steep hillside where civilians had taken refuge.

Abstract:: The smallest and least populous independent state in South America, the former Dutch colony of Suriname nonetheless attracted an inordinate amount of U.S. government attention in the early 1980s, due to the presence of aluminum giant Alcoa and the fear that Cuba might use it to establish its first foothold on the continent. Although the U.S. embassy in Paramaribo had adequate personnel for “normal” times, it was not prepared for the situation following the so-called Sergeants’ Coup of February 25, 1980, led by Sergeant Desire “Desi” Bouterse, against the elected Henck Arron government. Following the coup, Bouterse gained effective control of the government as chairman of the country’s National Military Council (NMR) and, initially at least, sought support from Cuba and other leftist regimes.

Abstract:: Russia is famous for red tape, with paperwork required for just about any activity. I had my own first-hand experiences with this obstructive bureaucracy during my assignment to the USSR 1962-1964. As assistant general services officer during my first year in Moscow, I ordered forms and furniture, supervised the motor pool, got broken toilets fixed, and tried to keep in operation our creaky Soviet elevators, which liked to break down late on Friday afternoons. While this was not glamorous diplomacy, it probably taught me more about Russia than what I gained as a political officer during my second year in the post.

11729. Harnessing Halloween for Diversity in Sweden

Abstract:: When my husband David and I starting working at the U.S. embassy in Stockholm in 1989, formerly homogeneous Sweden was beginning to grapple with an increasingly diverse population. I was surprised that the international school included a large number of students from Yugoslavia, and then equally surprised how they melded into the local community as their home country broke up. Faced with growing immigrant issues, the Swedish government generated programs to help foreigners assimilate; David and I spent one weekend brushing up our Swedish language skills with Iraqi Kurds in a government-run language camp. Little did we imagine that we would later be supporting Swedish diversity training by introducing the exotic American holiday of Halloween to schoolchildren. As U.S. embassy spokesperson, I was regularly on the receiving end of a wide range of inquiries. One day while I was out of the office, a journalist called asking to talk to an American about Halloween. In my absence, one of our local employees thought to transfer the reporter to my husband. David obligingly regaled the reporter with stories of Halloween pranks from his childhood, including one involving a mean old man, his prized Cadillac, a cat, and Ex-Lax. His account made the front page of Svenska Dagbladet the next day; fortunately, no one in the embassy seemed overly disturbed by this unauthorized messaging.

Abstract:: In order to join the U.S. foreign service, applicants pass through a gauntlet of written and oral assessments, physical examinations, and security clearance. Once those steps are successfully completed, the Secretary of State sends to the President for approval a list of those to be commissioned as diplomatic and consular officers. The commission is what makes one officially a Foreign Service officer. It’s our only badge of membership, unaccompanied by the diplomatic uniform or other regalia used by some other countries to denote diplomatic status. When I sailed into the port of Southampton in the United Kingdom on the S.S. United States on October 26, 1965, as a newly minted and very junior U.S. diplomatic and consular officer, I was armed with my diplomatic passport and commission, issued by President Johnson and signed by Secretary of State Dean Rusk. Those signatures, of course, were printed on the form, but my name, title, the date, etc. had been entered, elegantly in cursive, apparently by hand. The document, on velum-like paper adorned with an impression seal of the United States, looked to me more like a fancy university diploma than anything else. However, it meant that I was a “real” diplomat and authorized to take on the responsibilities required by my career.

11731. William Rockhill, The Man Who Shaped China Policy a Century Ago

Abstract:: Linguist, author, explorer, and diplomat, William Woodville Rockhill is best known as the author of the Open Door policy toward China put forth by the United States in 1899. In between his first diplomatic assignment in China and his later role as the top U.S. diplomat there, he trekked for months across North Asia, and recorded meticulous observations of climate, geography, and local people in a book published in 1894 by the Smithsonian Institution. In his two decades of service to the United States, Rockhill served both in Washington and as the American envoy to several major countries. He was, however, not just a diplomat. He lived a life uniquely diverse for an American of his or any day. When a boy, he moved with his widowed mother to France. In his teens he entered St. Cyr, the French military academy, where he found time to study Tibetan, the first American to do so. After St. Cyr he became an officer of the French Foreign Legion, and served in Algeria, where the French administration was taking stern measures to control the native Muslim majority.

11732. Forging a Bay of Bengal Community is the Need of the Hour

Abstract:: The Bay of Bengal, the world’s largest Bay, is strategically located in the Indian Ocean. On its western rim, lies the coastline of the Indian Peninsula and to its south, the island nation of Sri Lanka. To the east the bay connects key parts of Southeast Asia including Myanmar, Indonesia, Thailand as well as the Andaman Sea and the Malacca straits. At its very northern cusp lies Bangladesh, which is also the delta of the great rivers of Ganges, Brahmaputra, and Meghna. These rivers connect the Bay in a unique “mountain to sea” ecosystem with natural connectivity to the Bay for the landlocked states of North Eastern India and the Himalayan nations of Nepal and Bhutan. In turn, the monsoon currents which regulate the climate of the Bay of Bengal gather moisture from the bay and dictate precipitation patterns in the mountains and plains in the hinterland. The hills of Meghalaya in North Eastern India record the highest rainfall in the world as they are first hit by the monsoon clouds that gather moisture from the Bay. An interlace of snow and rain fed rivers, their basins, and their estuaries at the Bay nurture a large diversity of aquatic and terrestrial wildlife flora and fauna (e.g., the Sunderban mangroves spanning parts of Myanmar, India and Bangladesh) and offer a great diversity of agricultural produce. The Bay and the countries along and connected by its littoral are a compact maritime sub region connected at the level of economy and ecology, having an enormous impact on the hundreds of its inhabitant who live on its coasts and in its hinterlands.

11733. The Importance of the Bay of Bengal as a Causeway between the Indian and Pacific Oceans

Abstract:: The core Bay of Bengal countries today account for a population of almost 1.78 billion, while adjacent states with interest account for an additional 490 million. The “core states” (X, Y, Z) have a combined GDP of approximately $7.5 trillion, while adjacent states with interest add another $811 billion. While SAARC countries’ total intra-regional trade accounts for only 5% of their total global trade, ASEAN has a more respectable 25% intra trade while EU and North America boast 40-50%. One may reasonably imagine an economically and ecologically integrated Bay of Bengal community to increase SAARC’s current comparatively low figure, given their advantage in population, demography, and entrepreneurial vigor. The Bay of Bengal countries do not have a cohesive community identity, yet. If the Bay of Bengal littorals could evolve toward comprising a Bay of Bengal Community, replicating EEC and ASEAN, possibilities for prosperity for all the littorals would be almost limitless, while hitherto so-called land-locked entities (northeast Indian states, Bhutan, and Nepal) would get a much-needed outlet to the seas. However, the peoples of this region need to “rediscover each other”, revive memories of old civilizational, cultural, and commercial ties that had linked them historically in the past until the post-War new order rent them all asunder. They need to reinvent their regional identity, in a manner of speaking.

11734. Harnessing Inland Waterways for Inclusive Trade Among Bay of Bengal Countries

Abstract:: The transboundary rivers Ganges, Brahmaputra, and Meghna along with their tributaries and distributaries create a vibrant water grid connecting their riparian countries. Historically, these rivers have played a prominent role in shaping the economy of the Indian sub-continent as a major means of trade and transportation. In the post-colonial era, new political boundaries between countries mostly cut off these riverine networks because the priority of the newly-established countries and their governments was to develop road and rail networks for internal consolidation and integration more efficiently. Hence, waterways connectivity among new regional countries was comparatively neglected. India and Bangladesh, for example, share 54 transboundary rivers. Despite existing bilateral agreements for using designated riverine routes for trade and transit, only in the past few years have infrastructural development initiatives started in India for constructing river terminals, multimodal terminals as well as fairway development. And there are other opportunities.

11735. Making BIMSTEC a Regional Vehicle for Nepal’s Economic Growth

Abstract:: Recently, the government of Nepal, led by Nepal Communist Party Chairman KP Sharma Oli who ascended to power in 2018, came up with an integrated foreign policy that reflects rapid changes in both the domestic and geopolitical spheres. The new foreign policy has shifted from a traditional course to a modern one with “Economic Diplomacy” as the main driver. With the slogan of “Happy Nepali, Prosperous Nepal”, Foreign Minister Pradeep Kumar Gyawali has prioritized engagement with regional groupings. It is in this context that the Bay of Bengal Initiative for Multi-Sectoral Technical and Economic Cooperation or (BIMSTEC), established in 1996, with a permanent secretariat in Dhaka, Bangladesh, could serve as an important platform in achieving Nepal’s foreign policy goals of development and prosperity. Nepal became a member of BIMSTEC in 2004.. BIMSTEC acts as a vital bridge for Nepal to connect with South and Southeast Asia to expand its trade, economy, business, investments, and cultural connections. However, due to an unstable domestic political environment, Nepal has not been utilizing regional forums in advancing the nation’s interest. Now, with a stable government in power, Nepal must look at regional forums as important gateways for conducting business and national development.

11736. Dealing with Coronavirus Pandemic in the Bay of Bengal Region

Abstract:: The coronavirus has had a devastating impact on the health and economies of countries in the Bay of Bengal. India, Bangladesh, and Nepal are the region’s most affected countries in terms of COVID-19 cases and deaths, followed by Myanmar, Sri Lanka, and Thailand. It seems that Bhutan and Thailand, the least affected countries in the region, have successfully escaped the brunt of the pandemic. All these countries implemented strict lockdowns as early as March 2020, and the region’s recovery rates have been relatively high. However, the devastation from the pandemic did not reach its peak until after the lifting of lockdowns. The economic costs of the pandemic have soared and are still climbing. Today, most Bay of Bengal countries are facing a second or third wave of COVID-19 infections. India has been badly hit by a huge second Coronavirus wave, registered daily cases over 400,000 since Aril 2021. The damage being done by these additional waves is more intense than their predecessors. The Bay of Bengal countries are now looking for COVID-19 vaccines. India serves as the region’s primary producer of immunizations. Two Indian pharmaceutical companies have launched vaccines, with five more firms in the race to launch their own treatments. When vaccines are developed in India, they are easier to distribute across the region. In terms of availability, accessibility, and affordability, India’s vaccines are better suited to the needs of the region. In recent months, India has successfully supplied over 18 million doses of COVID-19 vaccines to many Bay of Bengal countries, with Thailand being a notable exception. India has also ensured more supply of the vaccines in the neighborhood.

Abstract:: The Bay of Bengal – home to one of the world’s pre-eminent historic trading networks – is once again at the nexus of rising regional and global rivalries. A multiplicity of port developments along the Bay of Bengal littoral underscore the tussle for control of maritime connectivity and trade—as well as diplomatic and defense advantage. Against the backdrop of a weakened post COVID-19 global economy, and as countries seek every possible advantage, the probability of competing tensions spilling over into outright confrontations and tit-for-tat retaliatory measures is high. Unless carefully assessed and managed, small but strategically positioned countries like Sri Lanka can get swept up and carried away in power rivalries being played out on their shores. Indeed, a common narrative has been to assert that Sri Lanka was forced to cede an important port to China after being lured into a ‘debt trap’ by easy Chinese loans. There is no gainsaying that over the last decade, China got a head start in investing in Sri Lanka’s infrastructure push, drawing the country firmly into the orbit of its ambitious Belt and Road Initiative (BRI). Aside from China’s famed involvement in Sri Lanka’s Hambantota port, its long-term footprint is also assured through investments in a large-scale land reclamation project – the Colombo Port City – that is a vital link in its BRI chain of connectivity.

11738. Improving Land Connectivity Around the Bay of Bengal is Essential for Integration

Abstract:: Facilitating cross-border movement by road is the most critical element of any strategy for greater economic integration among BIMSTEC countries. Cross-border road freight can facilitate even a small consignment to be delivered directly across the border with cost-effectiveness; unlike a full railway rake or even a coastal short-sea feeder vessel which require some level of aggregation of consignments into a larger parcel of goods. Direct road services also reduce multiple handling and trans-shipment requirements. Multi-modal solutions that support optimal use of international connectivity from different air and marine hubs in the region can only be facilitated by an existing efficient road freight feeder network. For example, a Bangladeshi exporter can exploit the cheaper and faster shipping connectivity to Europe via India’s Jawaharlal Nehru Port with the help of an efficient cross-border road feeder service that directly connects the exporter’s factory in Bangladesh to this port in western India. As feeder services for ocean and especially air transport? reduce frequency or become more expensive in the post-Covid ‘normal’, access to cheaper and faster connectivity to global markets from large regional hubs will be critical for the region’s entrepreneurs.

11739. Three Dilemmas Facing the Indo-Pacific’s Regional Order

Abstract:: For decades, an international order delivered security and prosperity to the Indo-Pacific. The order was based on U.S. military hegemony and alliances that preserved the strategic status quo and multilateral cooperation that enabled economic development and growth. That order is now under strain. The COVID-19 pandemic is challenging the order’s founding principles, prompting some regional states to limit their interdependency in certain sensitive sectors under the guise of supply chain resilience. The pandemic was not the first challenge to test the order; serious threats began to emerge over a decade ago, with the global financial crisis of 2008, and were sharply exacerbated by China’s economic rise and strategic revisionism, which threatens U.S. military and economic primacy and the territorial status quo. The United States, India, and like-minded middle-power partners from the Indo-Pacific and Europe have struggled to respond effectively. The other contributions in this series on navigating U.S.-China competition in the Indo-Pacific show how these states have sought to recover from the pandemic while also answering structural threats of revisionism and economic headwinds from decoupling, protectionism and changing integration patterns. Cutting across those specific policy issues are three overarching dilemmas that each state will be forced to resolve when making policy. How policymakers navigate these dilemmas will define the policy settings of their regional strategy.

Abstract:: Understanding India’s soft power in the Indo-Pacific and the possible impact of its recent decline is essential to a well-informed American strategy in the region. As the world’s second-most populous country and largest democracy, India is an important power and American partner, as highlighted in President Biden’s March 2021 Interim National Security Strategic Guidance, which also identified the Indo-Pacific as vital to American national interests. The Great Power competition in the Indo-Pacific and India’s hard power has been analyzed in other articles in this series. As Joseph Nye pointed out in the 1980s, successful states require both hard and soft power–the wherewithal to coerce as well as the ability to entice and influence the behavior of other countries without force. America’s partnership with India is based not only on the mutual strategic interest of countering China but also on the soft power element of shared democratic values. At the same time, India’s ability to persuade regional countries to partner with it, despite it not having China’s deep pockets or hard power, is key to keeping the Indo-Pacific free and open.

Abstract:: In 2018, the United States government released The National Security Strategy of the United States and its related National Defense Strategy.1 Each document identified key changes in the national security environment, focusing on the emergence of “great power competition” with both Russia and China. President Biden’s interim national security guidance, issued in March 2021, is more circumspect. The guidance avoids the term “great power competition” but points out China’s increased assertiveness and its potential to mount a challenge to the current international system, as well as Russia’s continued interest in expanding global influence.2 The US-China competition, in particular, is regularly compared to the Cold War between the United States and the Soviet Union.3 The Cold War analogy should be used with great caution. It is relatively anomalous in the history of international relations – the result of a unique combination of catastrophic war, which destroyed most of the then great powers, and fundamentally incompatible ideological positions of the two remaining great powers. Similarly, efforts to compare the U.S.-China competition to other bipolar competitions should be made cautiously as well.

11742. India’s Networking Response to the Chinese Threat

Abstract:: India has experienced rising tensions with China in recent years, as demonstrated by two border crises in 2017 and 2020-21. The second event saw the death of some 20 Indian troops, and at least 4 Chinese soldiers, in hand-to-hand combat – the first fatalities in nearly half a century of periodic border face-offs. New Delhi’s policy response has spanned both internal and external balancing. The former has involved augmenting India’s capacity to engage in limited combat of the type that nuclear-armed states have occasionally fought, as did the Soviet Union and China in 1969 and India and Pakistan in 1999. The Indian military has bolstered its border by deploying combat troops, cruise missiles, and advanced combat aircraft. However, China has done much the same, putting pressure on India to upscale its military capabilities. Simultaneously, India has tried to reduce its dependence on the Chinese economy, a more complicated task. Despite a 10 percent decline in bilateral trade owing to the Covid-19 pandemic and border tensions, China was India’s largest trading partner ($77.7 billion) in 2020. The Narendra Modi government sharply cut Chinese investment when the 2020 border confrontation in Ladakh broke out, expelling major Chinese companies like TikTok, WeChat, and UC Browser. Despite these measures, India’s ability to shut China out of its economy is limited. The Indian market depends heavily on Chinese electronic components (70 percent in value terms), pharmaceutical ingredients (70 percent), and consumer durables (45 percent).

11743. In Its Hour of Need: India’s Covid-19 Crisis and the Future of The Indo-Pacific

Abstract:: India struggled with an unprecedented second wave of the COVID-19 pandemic. At its height, more than 400,000 new coronavirus cases were being reported daily. In many countries, the second wave was more virulent than the first, mirroring what happened in the fall of 1918, the second and deadliest phase of the Spanish influenza pandemic. Foreign aid poured into India, but the main challenge is to enable and fast-track partnerships and to ramp up vaccine production. Facing an acute situation at home, the Government of India suspended vaccine exports in late March. This was a major blow to countries who had either received doses as part of India’s vaccine diplomacy, or had placed orders with India’s Serum Institute, the world’s largest vaccine producer. In total, India shipped 64 million doses of vaccines to 85 countries. China has stepped in to fill the gap, further cementing its status as the world’s largest vaccine exporter. Since the pandemic began last year, India reported more than 23 million cases and more than 250,000 deaths. In the first seven days of May, India recorded 2.7 million cases and over 25,700 deaths. Earlier in March, cases began to skyrocket in India’s richest state Maharashtra, home to the country’s financial capital Mumbai, a city with an estimated population of 12.5 million. During March, Maharashtra accounted for nearly 70% of the national caseload. Throughout April, a more potent variant of the virus accelerated infection rates and spread across the country. At the time of writing, not only Delhi but states to the north, west, and south experienced shocking, heart-wrenching scenes of suffering spurred on by a lack of oxygen supplies, intensive care units, and hospital beds. Although authorities did not announce a national lockdown, restrictions ranging from complete lockdowns to partial curfews were put in place across the country’s 28 states and eight union territories.

11744. India’s Options in a Contested Environment: Constraints and Prospects

Abstract:: The past year has witnessed tumultuous and unforeseen changes in the global geopolitical landscape due to the pandemic. While India struggles to contain its devastating second wave, it is simultaneously confronted with a significant national security challenge from across the disputed Himalayan border with China. A skirmish along the Line of Actual Control (LAC) that started in May 2020 escalated rapidly into a full-blown crisis, with clashes in Galwan on June 15, 2020, causing casualties on both sides. After multiple rounds of talks, the crisis remains unresolved and has starkly exposed India’s lack of credible deterrence that could either deny or punish China’s belligerence across the unsettled border. In response to the border crisis, the Indian government promoted and contributed to the rapid coalescence of the quadrilateral security dialogue (Quad)—a loose coalition of the United States, Japan, Australia, and India. Notable milestones in the Quad’s accelerated development include the addition of Australia in the Malabar series of naval exercises and several high-level meetings of officials from the four countries, the highest-profile of which being the first leaders’ summit in March 2021. The assumption that India’s sudden moves to consolidate the Quad were driven primarily by Chinese actions along the LAC may be debated. Nevertheless, if that is the case, it follows that India views its renewed efforts in coalition-building as part of a solution to its China problem. Though the Quad may be useful in tackling security threats in the larger Indo-Pacific region, in the near term, it is unlikely to meaningfully contribute to bolstering India’s ability to deter China along land borders or in the maritime domain.

11745. European Middle Powers in the Indo-Pacific amid GreatPower Strategic Competition

Abstract:: European middle powers are not typically part of U.S. discussions of the Indo-Pacific. However, in an era of growing strategic competition, they are collectively and individually expressing stronger equities in the stability of the region. In May 2021, for example, the United Kingdom’s aircraft carrier HMS Queen Elizabeth set sail for the first time on a tour that will take it to various locations, including to the Indo-Pacific region. The Dutch frigate HNLMS Evertsen, as well as a U.S. destroyer and aircraft, are also part of the carrier strike group. Thus, now is a good moment to step back and reflect on the role of European middle powers in the Indo-Pacific amid the backdrop of great-power, strategic competition. The Netherlands, Germany, and France have recently published strategy documents focused on the Indo-Pacific. The Netherlands’ document released in November 2020 discussed concerns about upholding the United Nations Convention on the Law of the Sea in the South China Sea and the need for the European Union to take a more vocal stance on stability in this region. Germany published a similar document in September 2020 in which it emphasized its deep economic interests in the Indo-Pacific “rules-based international order.” Earlier, France led thinking about evolving regional dynamics in 2018. Through the publication of France’s Defense Strategy in the Indo-Pacific and France and Security in the Indo-Pacific documents in 2019, France expressed its concerns about the impact of China’s activities in the East and South China Sea on regional stability. These issues have also been raised through NATO, which has been grappling with the belief that “China does not share our values” and the implications for alliance security and the international rules-based order.

Abstract:: In February 2020, the editors of this volume organized a POMEPS workshop that explored the origins of the disciplinary divide between the study of Africa and the Middle East, examining issues that span both regions (i.e., cross-border conflict, Islamist politics, social movements and national identity, and Gulf interventionism.) In February 2021, we convened another workshop, sponsored by POMEPS and the newly-founded Program on African Social Research (PASR, pronounced Pasiri) centered on racial formations and racialization across the two regions. Both workshops centered around the need for a genuinely transregional scholarship, one which rejects artificial divisions between ostensibly autonomous regions while also taking seriously the distinctive historical trajectories and local configurations of power which define national and subregional specificities. The workshop brought together nearly two dozen scholars from across multiple disciplines to explore the historical and contemporary politics of racial formation across Africa and the Middle East.

Abstract:: Election campaigns in the age of social media are rapidly changing their character. Due to the declining party loyalty of voters, once stable constituencies have become increasingly volatile and the importance of campaigning has increased. Parties are now thought to be more likely than in the past to opt for negative campaigning. This paper examines the postings that parties or top candidates made on the social media sites Facebook and Twitter during the 2019 National Council election campaign. The results suggest that - at least on social media sites - the cost-benefit analysis of the parties might turn towards negative campaigning, as the average popularity of negative campaigning posts was higher than those that were not tagged with negative campaigning.

Abstract:: Terrorism with religious ideological background today is a serious global threat. The modern infrastructure and the communications of movement allowed terrorist organizations to be able to attack everywhere in the world. The issue that is a point of interest of this paper is the current situation of returning the foreign terrorist fighters to their home country or third countries and the security consequences that may arise if they are not treated properly. Abstract:: In this paper, we analyze the current travel restrictions due to the COVID-19 pandemic imposed by the countries from South-East Europe and briefly compare them with those imposed by the Central European countries. By using official data collection of displacement tracking matrices and analyzing the porosity of the borders in this part of Europe, we research the impact of COVID-19 on human mobility and the related economic and social aspects. Discussions are presented regarding this impact on the travelers, the seasonal workers from some of the selected countries, and the immigrants from the Middle-East. A formal analysis is performed relating the current travel restrictions and the travel ban during the iron curtain.

Abstract:: Public policy permeates the legal principles of a state and its ruling government. The justification of public policy is topical to the ethics and canons acknowledged by that state. These values are determined by the applicable political, social, economic, religious, and legal systems, which differ among states. As public policy usually best illuminates the broad area of government laws, regulations, provincial ordinances, and court decisions, the standards creating public policy alter as states develop. The motif of public policy is critical when the question of enforcement of arbitral awards suffice. There is no definite meaning of the term in the famous Convention on the Recognition and Enforcement of Foreign Arbitral Awards (New York Arbitration Convention) to enforce foreign arbitral awards. Hence, this paper explores and traces some contemporary trends in defense of public policy as an exception to the enforcement of arbitral awards worldwide.

Abstract:: The international community has significantly increased its focus on the improvement of justice systems around the world, in recent years. With the increase in effort and interventions in the sector, there has been a need to create tools to assess justice systems, to identify the main elements affecting the workings of the justice machinery. In a context of increasing interest and engagement in justice systems reform, the ability of citizens to access justice institutions to address their needs has come to be seen as an essential element of development, human rights, democracy, and the rule of law. The Republic of North Macedonia has been dedicated in a certain amount to improving the access to justice following these global trends. However, the pandemic has brought to the surface many obstacles in the realization of these efforts and imposed serious issues that need to be further solved. In this paper, we will elaborate on the present situation in North Macedonia from the personal experience of law clinics and civil society organizations that work and contribute closely on this issue. One of the aspects of creating a competitive advantage in the banking sector is creating digital services. These services have a high impact on the banking sector and enable banks to have a competitive advantage in different manners. In addition to a theoretical approach to creating a competitive advantage in the banking sector, we conducted empirical research on how banks in North Macedonia create competitive advantage by offering digital services. Abstract:: So far, a legal positivism issue in the process of strengthening the rule of law in Bosnia and Herzegovina was not recognized by the wider academic community. The expert report on rule of law issues in Bosnia and Herzegovina addresses, for the first time, legal positivism as a part of the process of strengthening the rule of law in Bosnia and Herzegovina. This paper is an attempt to gather, and in one place present all the advantages offered by the constitutional system of Bosnia and Herzegovina that were not used by its institutions due to the application and implementation of legal positivism. This paper demonstrates misguided reform policies whose sole purpose was the strengthening of the rule of law in Bosnia and Herzegovina but turned to be just superficial adjustments that were unsuccessful. The paper argues the necessity of legal education reform as the key element in the process of strengthening the rule of law. Legal education reform is possible through the reduction of legal positivism impact on future lawyers, and this will be accomplished by the change in the paradigm of legal understanding among future lawyers who will make important decisions on the rule of law in Bosnia and Herzegovina. Two strategic objectives must be met in terms of legal education reform for the strengthening of the rule of law: the development of a critical stance towards legal provisions in force and training in the use of international instruments during the decision-making process.

Abstract:: Elimination of the trade barriers and stimulation of business activity through trade liberalization led to the expansion in the field of the global economy. There are plentiful hesitations about who gains the highest benefit from free trade, especially when it comes to the Comprehensive Economic and Trade Agreement (CETA) between Canada and the European Union. Analogously, the previous mention guides to the dilemma about the trade negotiations and their position in the same agreement in which are the labor standards. 11756. Global Health Governance Post COVID-19: Time for a Hierarchical Order?

Abstract:: The COVID-19 has renovated the debate about global health governance. Many scholars have proposed that the World Health Organization (WHO) should assume the position of a central coordinator with hierarchical powers. This article presents four main objections to this project: the problems with ‘one-size-fits-all’ policies, the heterogeneous distribution of power within multilateral institutions, the risks of crowding out parallel initiatives, and the democratic principle. Testing the WHO’s ability as a provider of technical information, an OLS regression, analyzing the first year of the coronavirus health crisis, from January 2020 to January 2021, in 37 countries reported in the World Values Survey Wave 7, shows a negative relationship between the population trust in the WHO and the number of cases of COVID-19. This indicates that there is a valid case for countries to strengthen the WHO’s mandate, but not to create a hierarchical global health structure.

It shows the real impact of refugees and migrants on European demography. The essence of the modern migration in Europe became very acute since the current migrants are mostly followers of Islam, which in all its aspects and completeness is currently one of the most urgent topics, and draws the special attention of political circles and international clubs. Muslims in Europe are, first, immigrants whose influx into the European continent has seriously changed its demographic picture and political situation. In this regard, it should be said that the growing number of Muslims in Europe is causing certain demographic challenges that significantly affect the European socio-cultural situation, and lead to the financial and political crisis.

Through this article, we will see that the constitutional system, rule of law, democracy or its consolidation, the stability in the country to a large extent are influenced by the way it is conducted the constitutional review process. The application or non-application of this instrument has multi-dimensional effects, negative, destabilizing ones.

Abstract:: Migration is an extremely complex and sensitive concept. The main research purpose is the migration phenomena from the perspective of integration policies adopted by the country of destination concerning the process of cross-border immigration. In this research, we used as a case study the events in South Africa from 2014 until 2019. We chose this country because of its economic development, relative prosperity being one of the main reasons why migrants chose this country. The government is obliged to rethink its policies regarding the status of migrants. Using a qualitative approach, we used four levels of analysis (access to education, labor market, healthcare, political participation) to conduct an exploratory study on how South Africa’s government manages the integration policies. Using official documents and media articles we tried to determine the main characteristics of public policies in regards to integration in terms of social, economics, and politics.

Abstract:: This paper is focused on the Albanian electoral system, its total inclusion approach, protection and promotion of gender characteristics, historical and legal developments on the gender quotas necessity, the comparison in time and space, the barriers and opportunities to promote gender politics in public and social area in Albania. The methodology will consist of a comparative analysis of legislation, the international legal framework, recommendations of international institutions, policy papers on identifying the causes why higher gender representation in politics produces estimated results in the public area, social and economic development. Analysis of the circumstances, historical periods, social and economic impact in legal amendments would be another methodology component. Gender quotas provide a critical minority of women, from 20% to a gender balance of 50%, either as an education of the community to face with real gender balance in common life.

Abstract:: Since 2009 Russia has increased its military forces in Abkhazia and South Ossetia and pursued the policy of ‘creeping annexation in the occupied territories of Georgia. Today, 20% of Georgian territories are occupied by the Russian Federation. The Russian-baked separatists continuously erect barbed-wire border posts in one of the occupied regions of Georgia-South Ossetia and detain Georgian people, under the pretext of ‘illegally crossing the border’. Fundamental rights of the local population are violated daily since the occupants install barbers through people’s houses, gardens, and cultivated lands. Innocent citizens are forced to leave their homes, belongings, and cultivated lands that are left beyond the occupants’ demarcation line. The paper argues that along with other global challenges of the world, the USA-Russia clashes of interests are also found with the Georgian conflicts. While Washington hugely supports Georgia’s territorial integrity and welcomes its Euro-Atlantic aspirations, the Russian Federation, on the contrary, prevents the aforementioned process and directly opposes Georgia’s integration into NATO. The USA condemns Russia’s creeping annexation of Georgian territories and continuously calls on Russia to respect the sovereignty and territorial integrity of an independent country. Furthermore, the USA-Russia relations have considerably deteriorated following Russia’s military intervention in Georgia and the recognition of Abkhazia and South Ossetia as independent states.

Abstract:: This paper explores the state of minority rights in the three Central Asian countries of Kazakhstan, Kyrgyzstan, and Uzbekistan. These countries share a lot of similarities in terms of their post-Soviet authoritarian legacy and weakness of democratic institutions. The repressive political landscapes of the Central Asian states have taken their tolls on minority groups, leaving them discriminated against, mistreated, and severely disadvantaged. Minority rights violations range from ethnic and religious discrimination to state-sponsored homophobia. Even though the leadership changes have positively affected the state of human rights in the three countries, there is still a slow pace of reforms. Overall, domestic changes in Uzbekistan, Kazakhstan, and Kyrgyzstan have not yielded considerable results so far in terms of alleviating the plight of minority groups across these countries.

Abstract:: The complex relationship between international and municipal law has been the bone of significant scholarly contention. In the Indian context, despite a formal commitment to dualism, courts have effected an interpretive shift towards monism by espousing incorporation of international law. The case of Mohammad Salimullah v. Union of India, which involves the issue of deportation of Rohingya refugees from India, represents a challenge in this regard owing to the lack of clarity as to India’s obligations under the principle of non-refoulement. The paper uses the Supreme Court’s recent interim order in the said case as a case study to examine India’s engagement with international law. It argues that the order inadequately examines the role of international law in constitutional interpretation and has the unfortunate effect of ‘refouling’ Rohingyas by sending them back to a state where they face imminent persecution.

Abstract:: International law had had a profound impact and influence on the domestic legal system in the contemporary world. However, the status of international law within the domestic legal system is not properly defined in many of the jurisdictions including Sri Lanka. In the absence of such a constitutional provision, the judiciary as the last bastion of hope has a responsibility of interpreting domestic law in light of the international standards that have been agreed upon by the country through ratification of international treaties and those principles of customary international law that has become binding on the country. However, too much judicial activism could jeopardize the constitutional fundamentals of separation of powers and the rule of law. Therefore, this study argues that the best way to resolve this issue is by providing a constitutional provision for the role of the judiciary in the recognition and implementation of international law in a domestic context. Using a qualitative methodology with a comparative analysis of the constitutional provisions of the selected jurisdictions of India and South Africa a proposal is made for a constitutional provision for the judicial role in the recognition and implementation of international law in Sri Lanka. The results have revealed that a constitutional provision would help to advance the separation of powers and the rule of law and to well define the role of the judiciary in absorbing international treaty law to the domestic sphere, making the law more certain and predictable and upholding the rights and duties of individuals in a domestic context while fulfilling international obligations of a country under the domestic legal system.

Abstract:: The article aims to analyze Brexit from the perspective of the Visegrad Group countries in the context of the future of the European Union. Addressing this issue is important from the point of view of assessing the role of the EU for the Visegrad countries. The main thesis of the research is that Brexit will not lead to a reform of the EU in the coming years, which is what some of the Visegrad Group countries are trying to do. The article is provocative, because, during the migration crisis, the Visegrad Group was shown as a brake on the European integration process. After Brexit, it was considered that some of EU Member States could follow Great Britain and leave the EU. The article complements the scientific achievements in this field, as it presents the view from the country of Central and Eastern Europe.

Abstract:: One of the current issues of criminal law, in general, is the issue of execution of a criminal judgment sentenced by the international criminal court (ad hoc or permanent international criminal court). The issue is ongoing because international criminal courts do not have their institutions for the enforcement of criminal sanctions they impose, but are, in that regard, instructed to cooperate with states that express readiness to execute criminal sanctions - imprisonment sentences imposed by an international criminal court in their prison facilities. Financial services and banking products are also ‘complicated’ for professionals, not to mention the ordinary client. As a result of the features of financial products and services, especially banking, information is required as an initial form of knowledge of these services and products, and this information is intensified through a constant process such as education. Hence, this article argues how financial education is performed in Southeast Europe and even in the EU. Abstract:: This study aims to analyze variables that influence access to bank loans by SMEs in Kosovo and North Macedonia. Research methodology is compound by primary and secondary data. We hypothesized that the age of the SMEs, business size, written business plan, collateral type, and business experience before starting as an owner, owner education, and owner gender influence access to bank loans for SMEs. Econometric model results revealed that age of the SMEs, business size, and written business plan has a significant influence on bank loans borrowed by SMEs, while, collateral type, business experience before starting as an owner, owner level of education, and owner gender have no significant influence on bank loans borrowed by SMEs in the Republic of Kosovo. Furthermore, from the results obtained we revealed that age of the SMEs, business size, written business plan, and owners’ level of education has a significant influence on bank loan borrowed by SMEs, whereas, collateral type, business experience before starting as owner and owners gender have no significant influence on bank loans borrowed by SMEs in the Republic of North Macedonia. The findings suggest some future lines of research at the end and provide recommendations for the main stakeholders of this field of study.

11769. #MeToo and US Politics: Analyzing the Twitter Conversation

Abstract:: The #MeToo movement has had a profound cultural impact on US society, and notably on US party politics. While many studies have addressed the #MeToo-related controversy arising from the Brett Kavanaugh nomination to Supreme Court Justice in 2018, the relationship between #MeToo and US politics before this event has remained understudied. This article, therefore, addresses this gap by looking at the role of politics at the beginning of the #MeToo movement. Focusing on the first six months of online activity on Twitter (October 2017 – April 2018), over 2 million tweets with the #MeToo hashtag are analyzed to identify the main activity patterns across the dataset and to gain insight on user behavior and participation in the conversation. Results point to the weaponization of #MeToo in the political context from its inception. It is suggested that #MeToo reflects the polarized political climate in the US and that it can be conceptualized as part of the wider “culture wars” (Hunter 1991) that characterize the public debate.

Abstract:: The spread of the Covid-19 has presented an unparalleled challenge for media management as well as for the media content. The pattern of daily life changed due to the excessive use of media. India, as a nation has been in the third position worldwide, many deaths during a pandemic are concerned. Kolkata being one of the metro cities of the country has not been exempted. The regional media content perceived a knowledge gap with the highest circulated national daily of the country. The changed media content, and audience perception towards the change, and the need for media advocacy during any health crisis in general and Covid-19 in particular, is studied in this paper using a mixed approach of both quantitative and qualitative. The discourse analysis of the newspapers in a constructed week format, representing a six months study during the pandemic, and the primary data from the audience suggested the behavior change and attitude formation through media, in this unique study.

Abstract:: Communication is a process and part of human identity without which man could not exist today. Intercultural communication is a form of global communication, which refers to intercultural interactions between different cultures that appear in a social group with different religious, social, ethnic, cultural, and social backgrounds. North Macedonia and Kosovo are considered multicultural states which have ethnic identities within them, which are part of the mosaic and the promotion of intercultural communication is a test of the democratic development of these states. Therefore, this study aims to research and analyze the role of intercultural communication between local communities in both countries, communication of local government with the community, and community participation in public meetings as part of local decision-making. The methodology applied in this paper is the study of literature and the development of quantitative research with local communities. The results show that even though the participation of local communities is low in both countries, due to various factors, intercultural communication has broken down barriers between communities and has influenced the initiatives for the organization and development of the community itself.

Abstract:: Small and medium-sized enterprises (SMEs) have a vital position in the international economy. The study aims to examine the compulsory financial reporting requirements set by the Kosovo Council for Financial Reporting (KCFR) as well as SMEs requirements for reviewing the current classification in the Kosovo context. This study, like most relevant studies, employs ordinal probit regression to examine the relationships among the requirements defined as dependent variables and other control variables such as necessary reclassification review under KCFR, preferred reclassification review under KCFR, experience knowledge of accountants and auditors, continuously education concerning financial reporting, and assessments of business owners. According to the reported conclusions, the application of these requirements in the Kosovo context does not create any opportunities for SMEs. On the contrary, the findings point to a thorough review of the reporting requirements for micro-businesses, as the current classification appears to be a burden for these businesses.

11773. How Govenrment Outflow and Public Debt Affect Inflation: Evidence from See Countries

Abstract:: The study aims to address public debt and government outflow affecting inflation in some of the countries of Southeast Europe, observing a combination of factors both theoretically and econometrically. The investigation included six (6) SEE countries, including the 2006-2020 timeframe, with 90 observations. The dynamic approach, the fixed effect, and the Arellano/Bond estimator were used to check the parameters considered in the study using panel data. Furthermore, the study also applied diagnostic tests such as the Sargan over-identifying restrictions and Pedroni test for cointegration. The results of the fixed effect and Arellano / Bond estimation demonstrate that public debt, current budget outflows, and capital budget outflows affect inflation, while overall budget outflows are insignificant. For further studies, it would be useful to apply other dynamic models by applying other specific factors, which will be considered as a useful contribution to the academic, research, and policy-making structures.

Abstract:: The subject of this analysis was the provisions of the Rome Statute of the International Criminal Court devoted to the leadership requirement of the crime of aggression. The crime in question is the successor of crimes against peace. This paper employed normative and formal dogmatic legal methods in analyzing the particulars of the leadership clause. Besides, this analysis also took into consideration the case-law of certain judicial bodies. This paper aimed to examine whether the leadership requirement of the crime of aggression has been properly constructed for the Statute. The main focus was on the meaning of the conditions stemming from the leadership clause that each perpetrator ought to fulfill to incur criminal responsibility for the crime of aggression. Additionally, this research addressed the criminal responsibility of public and private actors and the modes of participation in the crime in question. The article established that the leadership requirement concerning the crime of aggression has been aptly incorporated in the Statute since this requirement, at the same time, embraces the post World War Two standards concerning crimes against peace and the contemporary notion of aggression as one of the core crimes under international law.

Abstract:: This study examines the effects of the proliferation of SALWs on the security of the Nigerian state. Although this issue has seldom been tackled in regular or academic literature, it reflects the author’s keen awareness that, in an era of globalization, migrants have been identified as important agents in the proliferation of SALWs into third-world countries. The paper seeks to provide an insight into the socio-economic and political variables operating in the source and destination of such movements, with particular emphasis on migrants and arms proliferation. The study uses the qualitative approach for data analysis, it relies on upon, data gathered through secondary sources, and is reinforced with the argument on the liberal theoretical framework of analysis. The paper concludes that, while weapons play a significant role in intensifying conflict that exerts enormous human and economic costs, the causes of such conflicts lie in political, economic, ethnic, and religious differences and disparities. Finally, the paper looks at the appropriateness of examining the full implications of SALWs as a border management theme and the role of complementary measures for facilitating border control.

Abstract:: The victory over the territorial rule of the so-called Islamic State provides an opportunity for the government of Iraq to restore its state institutions and reassert its authority. Can the Iraqi leadership step beyond cycles of failure in this transition to tackle the systemic issues that sustain state weakness and promote the emergence of groups like ISIS? This paper aims to enlighten the challenges faced by Iraq after ISIS for the restoration of peace between minorities and religious groups, and coexistence after the myth, so that conflicts are going on between minorities and religious groups, particularly in Mosul and other cities under the control of ISIS, the state could not reconcile the displaced people. Correspondingly, this paper intends the focus and role of local, regional, and international media in the process of peacebuilding and coexistence in Iraq after ISIS.

11777. Enforcement of the European Union Law Before the Albanian Constitutional Court and the High Court

Abstract:: With the entry into force of the Interim Agreement in 2005 between the EU and Albania, Albanian judges had the obligation to partly apply several provisions of the agreement (the EU law) even in the pre-accession stage. This position was reinforced in 2009, with the ratification of the Stabilisation and Association Agreement, which laid down the obligation of the Albanian government to approximate its existing and future legislation in line with EU acquis and ensure proper implementation. Consequently, as of 2009, Albanian courts had to apply the EU law. The application of the EU law by Albanian courts entails the duty of judges with a twofold task: firstly, to construe their arguments in line with EU law or as close as possible, and secondly, to set aside the domestic law which is found to be incompatible with the EU law. This paper outlines some Albanian courts' decisions concerning applying the EU Law before accession to the European Union. The paper argues that Albanian judges have adopted a ‘Euro-friendly’ approach by referring to the EU Law and SAA agreement even in the pre-accession period. Nevertheless, looking closely at court decisions, the EU law is applied as a persuasive source of law to support the court’s decision and not to explain the importance of relying on EU law or CJEU case law.

Abstract:: The concept of justice has been a constant issue since its conception. The Greeks also attempted to define justice. They have observed justice as goodness in deeds and so a virtue. In the Greek mind, fairness was an attribute of the spirit or soul, while injustice was a sin. Both Plato and Aristotle defined justice as kindness as well as a desire to follow the law. It alluded to the connection between rights and duties. In human interactions, justice was the pinnacle of excellence and the attitude that animates folks in the right fulfillment of their responsibilities. The development of harmony and peace in thinking and conduct was pre-eminently social. In the same way, Aristotle's and Plato's fairness are complementary; both philosophers seek to discover a concept of ability by which unity, harmony, virtue, and pleasure may be produced in a community. Despite this shared agreement, they are fundamentally different in many ways. In this paper, an attempt has been made by the author to discuss the similarities and dissimilarities in theories of justice propounded by Plato and Aristotle.

Abstract:: The Russian Federation is one of the few jurisdictions where recipients and gamete donors have a wide scope of choice between anonymous, identifiable, and known donations. This paper examines how the Russian law regulates this sphere and how it is applied in practice basing on data collected in the largest reproductive cells bank in Russia. It demonstrates that the Russian Federation should be regarded as a country in which there is no single dominant approach to the matter of donor anonymity. The assessment of this ‘freedom of choice’ is not unambiguous. It gives recipients and donors the right to decide which option is the most suitable for their needs and motivations, simultaneously not resolving which values take precedence over others. The donor-conceived persons’ right to disclose donor’s identifying data sometimes may conflict with the donor’s right to protect their privacy and usually, jurisdictions decide which one has the priority.

Abstract:: At the changing geopolitical landscape with the Covid-19 pandemic scenario, the China-India tussle and scale of regional and global exposition has begun to display with certain consequences, which seems to shake the existing regional balance of power. A mounting political and military confrontation between these two powers as experts suggested could create a hurdle on regional-global stability and can strike on the path of globalization. With historical and existing context analysis, this paper explores that putting genuine differences aside, China and India being responsible stakeholders of the global community, can cooperate and contribute to regional and global peace and prosperity. This paper is based on qualitative research and explorative form in a pattern. This paper concludes that to reduce protracted political and border-related tensions, continuous institutional dialogue, regular communication, and formal-informal exchanges could be effective tools for a peaceful resolution. At this juncture, the competition and cooperation approach could be useful for fostering China-India bilateral relations, and this situation will help to address common challenges of the global community, restructure the global order, and re-adjust regional and global scenarios crippled by the Covid-19 pandemic.

Abstract:: The issue of the sea between Albania and Greece has been and continues to be an object of study for various authors. Research shows so far that many studies have tried to go slightly from the descriptive to the explanatory and analytical framework and have generally fallen into the ‘trap’ of subjective approaches creating the phenomenon of nationalism. That appears in different forms, damaging the spirit of friendship and cooperation between both countries. This paper analyzes relations between Albania and Greece and their evolution based on international acts until the decision of the Albanian Constitutional Court annulling the agreement between them on the issue of the sea as incompatible with the constitution in terms of absolute objectivity. The demands of the Greek state for extension with 12 miles under the magnifying glass of the interpretation of the norms of the international law of the sea, the principle of equality and equity are part of the insistence on gaining superiority in the sea area vis-à-vis Albania. All this leading to the dialogue for another treaty cooperation and friendship occupy a vital part of the facts, which constitute an ongoing open discussion about the future of the sea issue on the Hague International Court.

11782. A Prudential Personalist Ethical Appraisal of Human Cloning

Abstract:: Numerous uncertainties are hanging over the biotechnology of human cloning which has prompted medical ethicists and religious organizations to ask questions that bordered on its ethical and religious considerations. In cloning humans, ethical and religious issues arise both in its clinical and laboratory settings hence, the morality of manipulating human genes is the foremost ethical issue among scientists and religious scholars. Therefore, this paper evaluated the human cloning technology using the personalism and prudential personalism ethical-religious models to arrive at a workable moral paradigm. To achieve this objective, the paper employed the phenomenological and critical-literary literature review methods. The paper argued that previous ethical and religious researches have not adequately employed the ‘ideal’ ethical models to appraise the morality of human cloning hence; using the personalism and prudential personalism ethical-religious models were appropriate to reveal that every human life has worth and its commodification is an aberration. The paper concluded that based on the paradigm of prudential personalist ethics, cloning humans (especially, human reproductive cloning) negates respect for human life, human dignity, and communal goods hence it should not be practiced.

Abstract:: The complications of the Syrian crisis that has extended over six years are overseen on three distinct levels which are national, topographical, and global. A closer look at the situation in Syria in 2010/2011 will help explain why the regime has survived, the complexities of the situation in Syria, and what makes the search for a stable political settlement so difficult. The purpose of the present study is to highlight the nature of US engagement in the Syrian crisis which involves maintaining the US military presence for regional stability, ensuring the enduring defeat of ISIS, countering the future expansion of the Iranian influence and political settlement to the conflict, containing the Assad’s regime in the interim. By outlining various threats, issues, assessing the Syrian conflict and its key actors, this paper seeks to explain the US response to the Syrian crisis on basis of thematic analysis. In conclusion, the United States' foreign policy has continued in a region vital to its national security interests due to available oil, its impetus to protect Israel, to support security by retaining military bases, to preserve the position of the protectorate of client states, and friendly regimes, and to resist Islamic movements and terrorism.

Abstract:: This paper explores Russia’s response to Covid-19, with a focus on its implications for political freedoms and human rights across the country. It investigates the relationship between the pandemic and reinforcing authoritarianism in Russia. This paper is an in-depth case analysis that uses policy analysis and process tracing to examine Russia’s response to Covid-19 and its effects on Russian domestic politics. The study concludes that the Russian authorities have considerably abused Covid-19-related restrictive measures, not least through curtailing the freedom of assembly and expression. In doing so the Russian authorities have conveniently shielded themselves from mass protests amid constitutional amendments and upcoming legislative elections. Nevertheless, while the authoritarian practices that the Kremlin resorted to during the pandemic are not much different from those of other authoritarian regimes, they proved insufficient in curbing anti-regime dissent. This study inquires into the political repercussions of crisis management in authoritarian regimes and concludes that their authoritarian reactions lead to further crackdowns on civil liberties and political freedoms.

Abstract:: Egypt and Turkey makeup about half of the whole population of the Middle East and are the two leading nations in the eastern Mediterranean, including Iran as a whole. Both countries are now recognized as the two most tremendous modern military forces in the Middle East. Besides, Cairo and Ankara are major Muslim centers: the Al-Azhar Mosque in Egypt is the largest Islamic University in the world and a significant feature of Egyptian soft power; the historical association between Turkey and the last Islamic Caliphate is viewed in the region with great nostalgia. Given these similarities, a deep rivalry between the two countries exists around the world, while Ankara and Cairo have increasingly prevented overt aggression or conflicts. After the Arab Spring, tensions have intensified and, in effect, impacts Libya, Sudan, and the Eastern Mediterranean region. Along with the increased risk of an overt war between the two nations, the rivalry between Turkey and Egypt also challenges the delicate security of the Middle East. It indicates that it needs an international mediator to answer this thorny problem.

Abstract:: Since the beginning of the 2000s, China has embarked on an unprecedented path of economic development, as evidence of which is the largest economic project of the XXI century initiated by the People's Republic of China. The global Belt and Road Initiative announced by the first person of the country, Xi Jinping, is a shortened name of the ‘Silk Road Economic Belt’ and ‘XXI Century Maritime Silk Road’. It covers the Asia-Pacific, Europe, Central Asia, Southeast Asia, West Asia, and Africa and involves more than a hundred countries, international organizations, and leading economic actors. The main participants in the project are China, Mongolia, Russia, Azerbaijan, Belarus, Poland, Germany, the Netherlands, Kazakhstan, Kyrgyzstan, Pakistan, Bangladesh, Iran, and India. The article reviews the role of the Chinese project in a global context. The paper focuses on the role and purpose of Georgia in the Belt and Road Initiative. This study will try to reveal the results for the benefit of Georgia, which is one of the participating countries, and the role of China through research to be made from documents and academic studies on the subject. Georgia tries to conduct its relations with China, as a partner in the project, with a policy of balance without disturbing its relations with the West.

11787. Protecting Women from Intimate Partner Homicide in Post-Conflict Societies: Policy Options for Rwanda

Abstract:: This policy briefing note addresses the challenges and opportunities for identifying women victims of intimate partner violence (IPV) who are at an increased risk of being killed by their partners. It is based on the findings of an APN-supported research project and makes specific recommendations aimed at reducing the rate of intimate partner homicide (IPH) against women in Rwanda. During the genocide against Tutsis, rape was used as a weapon against Tutsi women to humiliate and destroy the targeted group.1 The 2003 Consti- tution of the Republic of Rwanda amended in 2015 marked the turning point for gender equality in the country by putting in place provisions, policies, and programs to increase women’s role in socioeconomic reconstruction. Among other actions, it reserved 24 out of 80 seats in parliament exclusively for women representatives. Rwanda is one of the African countries that domestically implemented UN Resolution 1325 on Women, Peace, and Security (WPS). Regarding this agenda’s call for the abolition of gender-based violence (GBV) in all its forms, the government of Rwanda ratified Law No. 59/2008 on Prevention and Punishment of Gender-Based Violence, which was reinforced by Law No. 68/2018 of 30/08/2018 on Determining Offences and Penalties in General, and the Organic Law No. 01/2012/OL of 02/05/2012, which instituted the penal code for marital rape, forced marriage, child defile- ment, and human trafficking. Subsequently, institutions and programs were established for preventing GBV and providing integrated medical, psychological, and legal services to victims of GBV. Over the past years, Rwanda has made important prog- ress toward gender equality and heightened awareness of GBV, which has resulted in an increase in the reporting of cases of GBV. However, given that IPV in some cases leads to homicide, it continues to pose a major challenge. This brief is based on an adaptation of the Danger Assessment Instrument (DA-20), which measures the risk of IPH in Rwanda for women who have already experienced intimate partner violence. After adaptation, a version of DA-25 has been developed for the Rwan- dan context and its predictive validity has been tested on a sample of 424 women living in the northern region of Rwanda who responded to two scales: Woman Abuse Screening Tool (WAS-8 short scale), which assesses IPV, and DA-25.

11789. Therapeutic Communities in Brazil

Abstract:: Spread across Brazil and attaining an unparalleled political force, therapeutic communities are as inescapable in the debate on drug policy as they are complex to define. Although they are not a Brazilian creation, they have been operating in that country for decades, and their dissemination intensified in the 1990s. In 2011, they were officially incorporated into Brazil's Psychosocial Care Network (Rede de Atenção Psicossocial, or RAPS). Since then, therapeutic communities have been at the center of public debates about their regulation; about how they should—or even if they should—be a part of the healthcare system; about the level of supervision to which they should be submitted; about their sources of funding, particularly whether or not they should have access to public funding; and, most importantly, about the quality of the services they offer and the many reports of rights violation that have been made public. However, a well-informed public debate can only flourish if the available information is based on sound evidence. The SSRC’s Drugs, Security and Democracy Program is concerned with the policy relevance of the research projects it supports, and the debate around therapeutic communities in Brazil points to a clear need for impartial research that addresses different cross-cutting aspects of this topic in its various dimensions: legal, regulatory, health, and observance of human rights, among others. It is in this context that we publish this working paper series on therapeutic communities in Brazil. The eight articles that compose this series offer a multidisciplinary view of the topic, expanding and deepening the existing literature and offering powerful contributions to a substantive analysis of therapeutic communities as instruments of public policy. Although they can be read separately, it is as a whole that the strength of the eight articles that make up this series becomes more evident. Even though they offer different perspectives, they are complementary works in—and already essential for—delineating and understanding the phenomenon of therapeutic communities in Brazil.

11791. 2020 Country Brief: Iran

Abstract:: A nuclear-armed Iran is an unacceptable threat to America and our allies. But because of Donald Trump, we are closer to—not farther from—this nightmare scenario. Donald Trump chose a bellicose, chaotic, go-it-alone strategy toward Iran. He blew up the Iran Deal, the international agreement that froze Iran’s nuclear weapons program, because it was negotiated by Barack Obama. When he blew it up, our European allies were shocked—and for the first time ever, they sided with Iran to preserve the deal over the Trump Administration. And that’s what just happened again at the United Nations in August of this year. Now it will be more difficult to stop Iran’s malign activity in the future. President Obama brought international pressure to bear to force Iran into a difficult choice: they could have an economy or nuclear weapons, but not both. Iran chose an economy, and in doing so, accepted restrictions on its nuclear program and submitted to international inspections. In return, the United States, our European allies, Russia, and China began to resume economic activity with Iran. After freezing Iran’s nuclear program, the United States could have begun dealing with Iran’s other malign activity. Unfortunately, against the advice of his senior national security advisors and allies, President Trump unilaterally withdrew from the Iran Deal. Then he threatened our negotiating partners with sanctions for attempting to salvage the deal. And when that didn’t work, in January, he ordered a unilateral strike to kill one of Iran’s senior military leaders, Qasem Soleimani, risking outright war. Despite all this, he signaled he was open to negotiations with Iran but has not indicated what a successful agreement would include. Trump’s chaotic, bellicose strategy has yielded no positive results. Future policymakers will need to rebuild the coalition to deal with Iran and develop a long-term strategy to get Iran to abandon its nuclear ambitions, end its support for terrorists, and become a responsible global player.

11792. Unpacking US Cyber Sanctions

Abstract:: Malicious cyber activity poses one of the greatest threats to America’s national, economic, and personal security. Yet, the perpetrators of these crimes largely operate with pure impunity and face little consequences for their actions. This is particularly the case for cybercriminals who cost the US economy anywhere from $57 billion to $109 billion in 2016 alone.1 Since 2015, the United States has imposed targeted sanctions (e.g., asset freezes, travel bans) on over 300 individuals and entities in response to malicious cyber activity.2 Many of these sanctions were issued under the cyber-related sanctions program administered by the Department of Treasury and established by a series of Executive Orders under Presidents Obama and Trump and bills passed by Congress.3 Sanctions have largely been imposed on individuals with ties to Iran, Russia, and North Korea, and, in about half of these cases, sanctions have followed indictments. An overwhelming majority of these sanctions have targeted individuals with suspected links to government entities and, only recently, have cyber sanctions targeted cybercriminals.4 As targeted sanctions increasingly become a tool deployed by the US government to punish malicious cyber actors, it remains unclear whether they are having an impact in changing behavior. Research on the impact of sanctions more broadly indicates that sanctions can be an effective tool to impose consequences on bad actors and change their actions when employed multilaterally, as part of a coherent strategy, and effectively messaged.5 However, imposing sanctions on malicious cyber actors without continuously reassessing their impact and the expected reciprocal actions by the target(s), risks a number of potentially negative outcomes. While Congress introduced legislation in the 116th Congress to impose new or codify existing cyber-related sanctions into law,6 it has not exercised the necessary oversight over the Executive Branch’s strategy in issuing cyber-related sanctions and determining their efficacy. With other countries now following America’s lead in issuing these sanctions, the time is ripe for the new Congress to push for an inter-agency, holistic assessment of the impact of US cyber-related sanctions.7 And with cybercrime increasingly threatening all sectors of the US economy, Congress must call for an evaluation as to whether sanctions on non-state cybercriminals should increasingly be used.

11793. Taking Action on Cyber Enforcement: Assessing US Legislative Progress in the 116th Congress

Abstract:: The 116th Congress experienced events like no other in American history, including unprecedented levels of malicious cyber activity. Global estimates say that ransomware attacks have increased by 148% since February 2020, with many US hospitals and schools falling victim and having their operations suspended.1 Leading up to and during the pandemic, Members of the 116th Congress responded and drafted cybersecurity legislation, introducing 316 bills to tackle the issue—a 40% increase from the previous Congress. This memo presents a comprehensive analysis of the cybersecurity legislation introduced in the 116th Congress and is a successor to our memo assessing the cybersecurity legislation in the previous Congress. Unlike the 115th Congress, the two chambers of the 116th were each under the control of a different party. Still, more than half of the introduced bills were bipartisan, including 85% of the bills signed into law. However, only 11% of the introduced bills focused on imposing consequences for the human actors behind cyberattacks, such as imposing sanctions or strengthening laws to prosecute criminals to hold them accountable for their actions. Following the trend of past congresses, most of the bills focused on protecting data and securing critical infrastructure. But while defending data and infrastructure is important, the lack of legislation to address the challenges of imposing consequences on the human actor suggests that Congress should prioritize introducing and passing bipartisan legislation that reduces the impunity with which malicious cyber actors, particularly cybercriminals, act. Here are the main takeaways from the bills introduced last Congress: Cybersecurity-related legislation increased by 40% since the 115th Congress. Of the 316 bills introduced, 14 became law, with nine related to appropriations or agency authorizations legislation. However, only 36 of the 316 bills introduced in the 116th Congress, and just three of the 14 provisions signed into law, focused on imposing consequences on the human actors behind cyberattacks. Cybersecurity remains a largely bipartisan issue. Over 50% of all legislation and 85% of all bills signed into law had a bipartisan co-sponsor.

11794. Follow the Money: Few Federal Grants are Used to Fight Cybercrime

Abstract:: Like traditional crime, not all cybercrime rises to the level that requires a federal response. And like other crimes, victims will call upon state and local law enforcement to respond.1 They are unprepared. The 18,000 law enforcement agencies in the United States lack the tools, personnel, and resources to respond to cybercrime effectively. State and locals have turned to federal funding to fill these gaps, but federal government grants do not prioritize combatting cybercrime. The Justice Department (DOJ) has never identified cybercrime as an “Area of Emphasis” for their main criminal justice grant that awards state and local criminal justice agencies $400-$550 million annually.2 And while DOJ and the Department of Homeland Security (DHS) provided nearly $2 billion that state and local officials could use for cyber enforcement purposes in Fiscal Year (FY) 2019, data from DHS implies that very little is used for cybercrime. Only 2% of all DHS preparedness grant programs were used for all cybersecurity needs in FY 2019.3 Moreover, just three grants in FY 2019 were solely dedicated to cybercrime with a total budget of $12.7 million.4 As a result, only 45% of local law enforcement agencies have access to adequate digital evidence resources, according to one survey. This leads to a backlog of un-analyzed evidence needed to investigate cybercrime and a sense of futility about law enforcement’s ability to close cases.5 While Members of Congress have introduced several bills to create dedicated cybersecurity grant programs for state and local entities, these proposals tend to not include cyber enforcement needs as an eligible expense.6 Moving forward, Congress should: Call on DOJ and DHS to prioritize combatting cybercrime as a main law enforcement issue within their grants. Require prioritization of cyber enforcement needs in grant programs administered by DOJ and DHS in annual appropriations bills; and List cyber enforcement spending as an eligible expense in any bills creating new cybersecurity grant programs for state and local governments.

Abstract:: President Biden has announced plans to re-engage with Iran on the Joint Comprehensive Plan of Action (JCPOA), also known as the Iran Nuclear Deal. In this paper, we briefly outline the five most likely pathways ahead, each of which has strengths and challenges: Return to the JCPOA as it was. Return to the JCPOA plus new commitments that address other security concerns with Iran. Restore the JCPOA as it was plus a set of confidence-building measures to address other security concerns. Formally link a requirement for Iran to address our other concerns as a pre-condition for further talks. Return to the pre-JCPOA Middle East, where US and allies work to rollback Iran’s nuclear program and actively deter its regional actions by confrontation, punishment, and isolating measures. Each path carries risk and opportunity for restoring American leadership in the world, and congressional Democrats should remember the perfect deal does not exist. Members of Congress would be wise to measure the next deal against the status quo ante: an unconstrained, belligerent Iran again racing to a bomb.

11796. The Militarization of Cyberspace? Cyber-Related Provisions in the National Defense Authorization Act

Abstract:: With Congress struggling to pass stand-alone cybersecurity legislation, the National Defense Authorization Act (NDAA) is now the primary vehicle to pass all matters of cybersecurity legislation. Because the annual defense bill typically requires provisions to have a tie to national security, other cyber issues, like those pertaining to criminal justice, tend to be excluded. As a result, the authorities and resources awarded to Department of Defense (DoD) cyber mission far outpace those provided to civilian agencies responsible for partnering with state, local, private, and international partners. With ransomware and cyber incidents at an all-time high, Congress should either include a new title in future Defense bills to bolster US cyber enforcement and civilian agencies’ capabilities or pass a cyber-omnibus bill to fix policy gaps and provide commensurate funds to federal and local agencies to combat malicious cyber activity. In this paper, we analyzed the last five NDAAs (2017-2021) to chronicle Washington’s reliance on the NDAA to shepherd through a wide swath of cybersecurity legislation. We found that: Members of Congress included 290 cyber-related provisions in the past five NDAAs, with the past two NDAAs accounting for 60% of those provisions. In fact, the FY 2021 NDAA contained 380% more cyber-related provisions than the FY 2017 NDAA. The 179 cyber-provisions included in the past two NDAAs far outpace the 14 cybersecurity bills that the 116th Congress passed (two of which were those NDAAs). Across 13 categories, three of the top four were aimed at the DOD core cyber missions, such as changing organizational processes and structures, protecting DoD assets, and engaging with foreign partners while deterring nation-state adversaries. In FY 2020, the number of non-DoD-related cyber provisions began increasing, such as supply-chain security and industrial policy, critical infrastructure protection, and election security. The provisions in these NDAAs helped improve US offensive cyber capabilities, implement measures to deter cyber adversaries, and shore up our cybersecurity defenses, all of which are needed. But because cybersecurity is a multifaceted issue that expands beyond national security and touches on criminal justice, workforce development, private-sector collaboration, and privacy issues, Congress must ensure it takes a holistic approach when creating cybersecurity laws.

11798. Border Regulation Begins with Stronger Capacity at Official Points of Entry

Abstract:: After the Trump Administration cutbacks, Congress should invest in the U.S. southern border to benefit trade, stop bad actors, and humanely process people with real asylum claims. Managing vehicular, rail, and people throughput at border crossings is an enormous challenge, but one not being met. U.S. inspectors do not properly screen more than a small percentage of incoming commercial and personal vehicles making this the primary means for narco-trafficking into the United States. Investing more in screening capacity at the official land Points of Entry with Mexico will reduce crime, illegal drug importation, guns going southbound, strengthen regulation and order essential for safe trade and opportunity, and make for a safer environment for those seeking legal entry into the United States. Congress has steadily appropriated new funds for more border screening capacity, but additional investment in screening capacity is still needed to make up for Trump Administration cutbacks. President Biden’s U.S. Citizens Act of 2021 has a range of helpful proposals to make us safer and keep commerce moving. Congress should mandate better measures to evaluate actual screening effectiveness. Congress also should conduct stronger oversight to address shortcomings in the US Department of Homeland Security (DHS) and Customs and Border Protection Agency (CBP) acquisition plans to make sure border inspectors spend the money more effectively and field the right capability in a timely fashion. There is a range of reforms we must make across immigration and border regulation to better serve our nation and those seeking to come here. Immigration and border enforcement have strayed from our values as a country and urgently need reform. Our legal immigration system both in asylum and visa-based needs clear modernization. Millions who have known no home but America deserve citizenship. Enforcement alone also will not solve our problems, but we must improve all aspects of American immigration and our border.

11799. To Patch or Not to Patch: Improving the US Vulnerabilities Equities Process

Abstract:: The process that determines when and how the US government discloses unknown cybersecurity vulnerabilities to relevant companies or withholds them for government purposes lacks sufficient accountability, transparency, and public trust. Malicious actors do not hesitate to exploit “zero-day vulnerabilities,” or vulnerabilities that a company has had zero days to patch, with Chinese-based hackers most recently using a zero-day in Microsoft Exchange Servers to infect hundreds of thousands of systems.1 Yet, the government also uses zero-days to carry out activities that are in the nation’s interest and, as a result, does not tell the impacted software or hardware vendor about the vulnerability. In this case, the government determines that the benefit of not disclosing the vulnerability outweighs the consequence of a bad actor potentially exploiting the vulnerability for nefarious purposes. In 2010, the US government created the Vulnerabilities Equities Process (VEP) to convene federal agencies that represent a range of national interests—including security, intelligence, foreign policy, commerce, and civil rights and liberties protection—to weigh distinct perspectives on how vulnerabilities should be patched or briefly kept open for law enforcement, intelligence gathering, or military purposes. However, the VEP is not codified in law and has failed to deliver greater transparency around government retention of vulnerabilities nor ensures accountability for the government’s decisions. Congress and the Biden administration should address deficiencies with the VEP to increase transparency, strengthen accountability, build public and industry trust, and establish a world-leading model for decision-making around what to do about high-value vulnerabilities. This paper details seven steps for the Biden administration to enhance transparency and accountability in the VEP while preserving government priorities, as well as flexibility for the defense of democratic values and institutions.

11800. 2021 Reader’s Guide to Understanding the Proposed US Cyber Enforcement Budget

Abstract:: Cyber attacks in the United States continue to devastate and disrupt day-to-day operations in the private and public sectors. Marked by events like the ransomware attack on Colonial Pipeline that created gas shortages and increased prices, cybercrime impacts everyday citizens, even if they are not directly targeted by an attack. The Department of Homeland Security (DHS) reported that in 2020 there were “over $4 billion in cybercrime losses reported to the U.S. government.”1 This growing cybersecurity threat has only been exacerbated by the rise of cryptocurrencies like Bitcoin and exposed network vulnerabilities from those working from home during the pandemic.2 In response to this influx of cyber attacks, the Biden Administration has taken steps to both bolster the federal government’s ability to detect and respond to cyber attacks as well as protect its own systems.3 The Department of Energy (DOE) and DHS have both made cybersecurity a top priority in their latest initiatives. President Biden called on DOE to launch a 100 day plan aimed at preventing disrupted services for electric utilities, and DHS announced a series of 60-day “sprints” to support private and public partners against ransomware.4 The FY2021 National Defense Authorization Act also created the first U.S. National Cyber Director, tasked to lead the implementation of U.S. cyber policy and strategy, and rapidly improve cybersecurity defense capabilities. Although ransomware attacks have spiked, the federal government has made inroads on combatting cyber criminals. The Cyber Enforcement Budget for FY2022 should continue funding and seek to build on the key improvements and actions taken by the Biden administration. In this guide, we will look at the budget implications for cyber enforcement, recommendations for Congress, and provide a detailed breakdown of the proposed budget’s funding allocations. Specifically, we recommend that Congress should: Restore the $15 million of funding cut from the State Homeland Security Program. The program provides critical grants to states that require recipients spend at least 10% of their grants on cybersecurity needs. Require an alignment of cybercrime goals and outcomes across law enforcement agencies within the Departments of Homeland Security, Justice, and Treasury. Ensure that federal agencies are prepared to implement President Biden’s cybersecurity executive order.
